Transcript
- 0:00Speaker 1: We're going to go to Brian Yennis because we're getting
- 0:02Speaker 1: some rumblings in the Clancy courtroom as well. We're told
- 0:06Speaker 1: the media is being allowed back into the courtroom. Brian Yennis,
- 0:11Speaker 1: our national correspondent on the scene there. What can you
- 0:12Speaker 1: tell us, Brian?
- 0:16Speaker 2: Hey, Martha. Well, we know that the media has been
- 0:19Speaker 2: allowed back into the courtroom, but we have been given
- 0:21Speaker 2: no guidance as to why. Our courtroom producer, Maria, is
- 0:25Speaker 2: going to give us an update as soon as she
- 0:27Speaker 2: has it. What we do know is that this jury
- 0:29Speaker 2: was at an impasse today when they told the judge
- 0:32Speaker 2: in a note this morning after an hour of deliberation
- 0:35Speaker 2: that they could not meet. a unanimous, they could not
- 0:38Speaker 2: reach a unanimous decision. So now they have been deliberating
- 0:42Speaker 2: for about six hours more. They usually end deliberation, they
- 0:47Speaker 2: usually end their day in court by 4 p.m. So
- 0:51Speaker 2: we should get some clarity at any moment now. As
- 0:54Speaker 2: to whether or not this will be an end of
- 0:58Speaker 2: deliberation day four, which means this jury will be back
- 1:01Speaker 2: tomorrow at 9 a.m., or whether or not they perhaps
- 1:05Speaker 2: have another note, Martha, as this jury of nine women
- 1:09Speaker 2: and three men. continue to mull over this incredible decision
- 1:13Speaker 2: they have to make as to whether or not Lindsey
- 1:16Speaker 2: Clancy is criminally responsible for strangling her three children. So
- 1:21Speaker 2: we shall see at any moment now. And then, again,
- 1:23Speaker 2: as we have seen day in and day out, there
- 1:25Speaker 2: will be a live feed inside that courtroom if, in fact,
- 1:28Speaker 2: this jury is going to be dismissed for the day.
- 1:30Speaker 2: We will find out at any moment now together.
- 1:32Speaker 3: Martha.
- 1:33Speaker 1: Yeah, I mean, it's interesting, Brian. We saw the same
- 1:34Speaker 1: thing yesterday. They allow all the media to come in.
- 1:38Speaker 1: And yesterday we just heard, OK, we're done. Thank you
- 1:40Speaker 1: very much for your service.
- 1:41Speaker 4: Come back tomorrow.
- 1:43Speaker 1: And as you pointed out, we're going to go live
- 1:45Speaker 1: to the courtroom, Brian, and you can watch this along
- 1:47Speaker 1: with us. Let us know if you want to pipe
- 1:49Speaker 1: in here.
- 1:53Speaker 3: To recess and return tomorrow.
- 1:56Speaker 5: So that's what we're going to do.
- 1:57Speaker 3: We're going to bring them in and then we will
- 2:00Speaker 3: release them until tomorrow morning.
- 2:02Speaker 5: Okay?
- 2:03Speaker 3: Council, ready for the jury? Yes.
- 2:04Speaker 4: Council?
- 2:05Speaker 3: Yes. All right, yeah.
- 2:11Speaker 5: All rise, jurors enter. This concludes now the session. Please
- 2:39Speaker 5: be seated. All right.
- 2:48Speaker 3: Well, thank you, Madam Clerk, members of the jury. So
- 2:52Speaker 3: my understanding is that you would request to be excused
- 2:56Speaker 3: till tomorrow at 9 o'clock. So I'm going to excuse
- 3:00Speaker 3: you till then. I just want to thank you for
- 3:03Speaker 3: all your hard work and commitment so far in this case.
- 3:06Speaker 3: And you know what I'm going to do. I'm going
- 3:08Speaker 3: to remind you. You've come this far. Do not read anything.
- 3:12Speaker 3: Don't listen to anything. Don't talk about this case. And
- 3:17Speaker 3: we'll come in tomorrow morning.
- 3:18Speaker 5: We'll bring you all in.
- 3:20Speaker 3: I'll ask you the same questions I've been asking you
- 3:22Speaker 3: for weeks now, and we'll get you right back out
- 3:24Speaker 3: to resume deliberations. All right. Thank you again for all
- 3:28Speaker 3: your work. Thank you.
- 3:29Speaker 5: Thank you. Court, all rise. This way, please.
- 3:41Speaker 1: All right, see Lindsay Clancy there awaiting her fate, the
- 3:44Speaker 1: mother of three children that she admits to murdering in
- 3:48Speaker 1: the basement of her Duxbury, Massachusetts home. And this is
- 3:52Speaker 1: a case that has got the attention of everybody across
- 3:55Speaker 1: this country, that's for sure. Let's just dip back in
- 3:58Speaker 1: with Brian Yannis at the courthouse in Plymouth, Massachusetts. Brian,
- 4:01Speaker 1: what are you learning?
- 4:05Speaker 2: Well, Martha, look, I mean, this is 23 hours of
- 4:08Speaker 2: deliberations over four days for this jury of nine women
- 4:11Speaker 2: and three men. They will be back tomorrow morning. It
- 4:13Speaker 2: is interesting to note that they went back after sending
- 4:16Speaker 2: that note that they were deadlocked, and they spoke for
- 4:19Speaker 2: another six hours. And instead of perhaps sending in another
- 4:22Speaker 2: note saying they wanted more time or that they perhaps—
- 4:25Speaker 2: are still at an impasse, it's interesting that they've decided
- 4:28Speaker 2: to go back for the night. I mean, it implies
- 4:30Speaker 2: that they're still working through this to see if they
- 4:33Speaker 2: can reach a unanimous decision one way or the other.
- 4:36Speaker 2: And I think it's important to note one last time, Martha,
- 4:38Speaker 2: we do not know the split of this jury. We
- 4:40Speaker 2: don't know if there's 6-6 in there or if it's
- 4:42Speaker 2: 11 versus 1. So a lot to kind of just
- 4:46Speaker 2: infer based on what we're seeing. But we'll be back
- 4:48Speaker 2: here again tomorrow at.
- 4:49Speaker 5: 9 a.m., Martha.
- 4:50Speaker 1: And that is the system in this country. You have
- 4:53Speaker 1: to have a unanimous verdict. There are nine women and
- 4:56Speaker 1: three men on this jury. And we will see, as
- 4:59Speaker 1: you say, we don't know what the split is or
- 5:01Speaker 1: how far they have to go. But at least it
- 5:03Speaker 1: sounds like they said, OK, we're going to go home
- 5:05Speaker 1: and sleep on it. We're going to come back in
- 5:07Speaker 1: here tomorrow and get back at it. So, Brian Yennis,
- 5:09Speaker 1: thank you very much. We just want to quickly bring
- 5:11Speaker 1: in Donna Riccino, criminal defense attorney. host of Crime and
- 5:14Speaker 1: Justice with Donna Rotuno podcast and Fox News contributor. Donna,
- 5:17Speaker 1: any quick thoughts on what we're hearing here from this
- 5:20Speaker 1: jury and the action today?
- 5:25Speaker 4: Well, I commend this jury, Martha. I think it's pretty
- 5:27Speaker 4: astounding that we got this note this morning that they
- 5:30Speaker 4: were deadlocked and now they continue to work. They have
- 5:32Speaker 4: not come back to the court to say we can't
- 5:35Speaker 4: continue to deliberate. We are still at an impasse. So
- 5:38Speaker 4: it looks as if they still want to work through this.
- 5:41Speaker 4: And I have said all along that juries want to
- 5:43Speaker 4: get it right. Juries want to make a decision. So
- 5:46Speaker 4: I think that that's what they are trying to do.
- 5:48Speaker 4: The fact that we have had no other questions from
- 5:50Speaker 4: this jury lead me to believe that they understand the facts,
- 5:54Speaker 4: the law, and the evidence here. They're just having a
- 5:56Speaker 4: hard time coming to a consensus on what all of
- 5:59Speaker 4: us have watched happen over the last four weeks in
- 6:01Speaker 4: this courtroom. Absolutely.
- 6:03Speaker 1: Donna Rotundo, thank you very much. Good to see you.
