- 0:00Speaker 1: What's up, everyone, and welcome back to the program. In
- 0:03Speaker 1: this episode, we're going to pick up where we left
- 0:05Speaker 1: off with the Tyler Robinson Day 4 transcript from the
- 0:08Speaker 1: prelim hearing. In the last episode, we left with the
- 0:12Speaker 1: judge calling for lunch. Now they come back, but the
- 0:16Speaker 1: defense decides that it's not going to cross-examine Agent Davis.
- 0:21Speaker 1: So I don't want him to wait here if he
- 0:22Speaker 1: has other things to do. So no cross-examination. Witness is excused.
- 0:28Speaker 1: Please be seated. Judge Graff, all right, Sergeant, if you
- 0:33Speaker 1: wouldn't mind coming down forward and being brought into the courtroom.
- 0:37Speaker 1: You're still under oath from your previous testimony from the
- 0:40Speaker 1: previous day, so if you'd just like to come up
- 0:42Speaker 1: to the witness stand and be seated to your left,
- 0:44Speaker 1: behind the monitor should be a bottle of water. Prosecution,
- 0:47Speaker 1: your witness. Question, Sergeant Falmina, good afternoon. Answer, good afternoon. Question,
- 0:56Speaker 1: we briefly covered some of your involvement in the case
- 0:58Speaker 1: the other day. I want to return back to your
- 1:00Speaker 1: initial assignment to the case. When you were first assigned
- 1:03Speaker 1: to go to the campus of Utah Valley University. Answer,
- 1:08Speaker 1: on September 10th, 2025. Question, what time did you get
- 1:11Speaker 1: that assignment? Answer, I believe it was approximately 1.30 p.m. Question,
- 1:16Speaker 1: and where were you when you received that assignment? Answer,
- 1:19Speaker 1: I was at headquarters office in Salt Lake. Question, and
- 1:23Speaker 1: did you go directly down to the campus? Answer, yes,
- 1:25Speaker 1: I did. Question, and will you describe what you're seeing
- 1:28Speaker 1: as you arrive there? Answer, yeah, when I arrived there,
- 1:32Speaker 1: I actually arrived onto or near the south end of
- 1:34Speaker 1: the campus, and that's where I saw multiple police cars,
- 1:37Speaker 1: as well as multiple officers from various agencies. Then I
- 1:41Speaker 1: asked to respond to our command post, which was in
- 1:44Speaker 1: the Fugle building there. Question, and the Fugle building, we've
- 1:47Speaker 1: had some testimony about this, but is that just the
- 1:50Speaker 1: south of the courtyard? Answer, yes, it is. Question, and
- 1:53Speaker 1: you were there while officers were securing the campus? Answer, yes,
- 1:57Speaker 1: I was. Question, and do you know generally... how that
- 2:00Speaker 1: was done? Answer, I don't know the specifics, but I
- 2:04Speaker 1: do know that officers were canvassing the area, trying to
- 2:07Speaker 1: look for a suspect, but also trying to see if
- 2:10Speaker 1: anyone else was injured, and then making sure that the
- 2:13Speaker 1: scene was secure and that no unauthorized people were allowed in. Question,
- 2:18Speaker 1: and I think you testified earlier, what was your primary assignment? Answer,
- 2:22Speaker 1: my primary assignment at the campus, as well as throughout
- 2:25Speaker 1: the case, was to oversee the crime scenes, as well
- 2:28Speaker 1: as the physical evidence. Question, before you could do your
- 2:32Speaker 1: work on the crime scene, did the campus have to
- 2:35Speaker 1: become secure? Answer, yes it did. Question, and did that
- 2:39Speaker 1: involve making sure that there was no active shooter on campus? Answer, yes. Question,
- 2:45Speaker 1: and did that involve officers searching buildings and clearing buildings
- 2:49Speaker 1: throughout the campus? Answer, yes. Question, you mentioned that there were,
- 2:53Speaker 1: were there multiple areas that were processed by you and
- 2:57Speaker 1: other crime scene analysts in this case? Answer, yes, there was.
- 3:01Speaker 1: Would you like me to go over them? Answer, let
- 3:03Speaker 1: me direct you to a few of them. Well, yes,
- 3:06Speaker 1: please mention the scenes. Question, yes. So one scene was
- 3:09Speaker 1: a courtyard area, or I guess what we would also
- 3:12Speaker 1: refer to as an amphitheater, where the event took place.
- 3:16Speaker 1: The other scene would have been the Fulton Library, where
- 3:19Speaker 1: there were two bus stops, and then another would have
- 3:22Speaker 1: been the wooded area. And then the last one would
- 3:25Speaker 1: have been the Losey Center building, as well as the
- 3:27Speaker 1: ground below. Question, all right, let's start with the rooftop. First,
- 3:31Speaker 1: who was assigned to process the rooftop area? Answer, the
- 3:35Speaker 1: team that was assigned to process that was Utah Bureau
- 3:38Speaker 1: of Forensic Service. They're also known as our state crime lab. Question,
- 3:42Speaker 1: and generally, what does processing an area involve? Answer, processing
- 3:47Speaker 1: includes documentation, sketching, as well as taking photographs, marking, as
- 3:51Speaker 1: well as labeling evidence, and then determining how to package
- 3:54Speaker 1: them properly, as well as just trying to ID anything probative. Question,
- 4:00Speaker 1: on the rooftop, was evidence found? Answer, yes. Question, what
- 4:03Speaker 1: type of evidence were found on the rooftop? Answer, one
- 4:08Speaker 1: item of evidence that was found was a screwdriver. Another
- 4:11Speaker 1: one would have been what we believe was the shooter's perch.
- 4:15Speaker 1: That was determined based, or that was easy to see
- 4:17Speaker 1: at night, using oblique lighting. We could see disturbances in
- 4:22Speaker 1: the gravel on the rear rooftop and then on the
- 4:24Speaker 1: northeast edge. Our team also found some swipes on the
- 4:28Speaker 1: ledge of that rooftop that were collected? Question, okay, so
- 4:33Speaker 1: a northeast ledge. And is this the dropping off point? Answer,
- 4:37Speaker 1: yes it is. Question, you said swipes. What does that mean, swipes? Answer,
- 4:42Speaker 1: swipes is, I would describe it as kind of hand
- 4:45Speaker 1: marks or any type of mark that's left by something
- 4:47Speaker 1: that causes some type of disturbance. Question, okay, and where
- 4:52Speaker 1: on the ledge were those located? Answer, those were located
- 4:56Speaker 1: right on the edge. excuse me, right on the edge
- 4:59Speaker 1: of that rooftop. And then right below, we also had
- 5:02Speaker 1: some other swipes as well, as well as some other impressions.
- 5:05Speaker 1: And then below, that was a glass window where we
- 5:08Speaker 1: also located some latent prints. Question, okay, I wanted to
- 5:11Speaker 1: return to what you've referred to as the perch, the
- 5:14Speaker 1: sniper position. Were measurements taken from that sniper position to
- 5:18Speaker 1: the tent where Charlie was seated? Answer, yes. Question, do
- 5:23Speaker 1: you know the distance? Answer, yeah, so the distance from
- 5:26Speaker 1: the perch area directly to the tent where Mr. Kirk
- 5:28Speaker 1: was sitting, was approximately 415 feet. If you break it down,
- 5:33Speaker 1: so from the perch to the tent, you're looking at
- 5:35Speaker 1: us basically like this. And this is the perch, and
- 5:39Speaker 1: this is the tent. Question, and now you're describing, I'm sorry,
- 5:42Speaker 1: I have to make a record. You're describing an angle,
- 5:45Speaker 1: a slope downward from the perch to the location of
- 5:48Speaker 1: the tent. Is that accurate? Answer, yes I am, thank you. Question,
- 5:53Speaker 1: go ahead. Answer, yes, so the angle, so again the distance,
- 5:57Speaker 1: the perch to the tent was approximately 415 feet. If
- 6:01Speaker 1: you think about it, or without taking into account the
- 6:04Speaker 1: elevation drop, it was actually 410 feet. So just horizontal
- 6:08Speaker 1: straight across. And then the elevation difference between that is
- 6:12Speaker 1: approximately 68 feet. Question, okay, 410 feet from the perch
- 6:17Speaker 1: to the tent with a 68 foot vertical drop. Is
- 6:20Speaker 1: that right? Answer, yes. Question on a rooftop. Were shoe
- 6:23Speaker 1: impressions found on the rooftop? Answer, yes there was. Question,
- 6:28Speaker 1: did those who processed that area of the crime scene
- 6:31Speaker 1: collect the latent prints and those shoe impressions that you
- 6:33Speaker 1: talked about? Answer, yes they did. Question, and is this
- 6:37Speaker 1: a good point to read a stipulation into the record?
- 6:39Speaker 1: Judge Graff, alright. Question, the language of this has been
- 6:43Speaker 1: agreed upon by the parties. The parties stipulate that investigators
- 6:48Speaker 1: at the crime scene observed latent fingerprints and a pawn
- 6:50Speaker 1: print on the glass window. near the area where the
- 6:53Speaker 1: individual landed when the individual jumped from the rooftop of
- 6:56Speaker 1: the Losey Center at UVU. SBI Investigate determined that only
- 7:02Speaker 1: three of the latent prints, 11B, 11C, 11D, were of
- 7:06Speaker 1: comparable or of poor comparable value. She excluded Tyler Robinson
- 7:11Speaker 1: as the source of any of these three latent prints. Ms.
- 7:14Speaker 1: Farmer reviewed other prints on the window and found that
- 7:17Speaker 1: they did not have adequate value for comparison. Subsequent examinations
- 7:22Speaker 1: of these three latent prints, or actual latent prints by
- 7:24Speaker 1: the FBI, were inconclusive. That area that was described in
- 7:28Speaker 1: that stipulation, is that the area in the glass window
- 7:31Speaker 1: that you're talking about? Answer, yes it is. Question, that's
- 7:35Speaker 1: on the northeast corner of the low-sea center? Answer, yes. Question,
- 7:39Speaker 1: and that's the area where we see in the video
- 7:41Speaker 1: an individual drop from the roof? Answer, yes. Question, I
- 7:45Speaker 1: want to move on to another area, the courtyard. First,
- 7:48Speaker 1: will you describe what that area of the crime scene
- 7:50Speaker 1: looked like? Answer, yeah. So when I arrived on scene,
- 7:53Speaker 1: you have different steps. I believe there were maybe like
- 7:56Speaker 1: five or six hovered in grass. And again, when I
- 8:00Speaker 1: was there, there were personal belongings spread throughout. There was
- 8:03Speaker 1: a tent towards the west end of the courtyard area,
- 8:06Speaker 1: as well as some banners and some barriers as well. Question,
- 8:10Speaker 1: was that area processed for evidence as well? Answer, yes,
- 8:13Speaker 1: it was. Question, what was done to process that area? Answer,
- 8:18Speaker 1: photography as well as just examining the tent area to
- 8:20Speaker 1: see if there's anything there. Question, and who was assigned
- 8:24Speaker 1: to process the courtyard area? Answer, the FBI. Question, all right.
- 8:28Speaker 1: I want to take you to another area, a wooded area.
- 8:31Speaker 1: Was there a wooded area that was processed as well? Answer,
- 8:34Speaker 1: yes there was. Question, will you describe first off where
- 8:38Speaker 1: that area is? Answer, yeah. So this area is located
- 8:42Speaker 1: northeast of the Losey Center building and it's across from
- 8:45Speaker 1: Campus Drive. Question, Your Honor, could we publish Exhibit 35, please? Answer, yes. Question,
- 8:52Speaker 1: and if I may approach the witness, I'll put the
- 8:54Speaker 1: hard copy of the exhibit as well. Judge Graff, all right.
- 8:58Speaker 1: So they get it published. The questioning starts again. All right,
- 9:02Speaker 1: on the screen in front of you, will you take
- 9:03Speaker 1: a look at Exhibit 35? Answer, yes. Question, do you
- 9:06Speaker 1: recognize that? Answer, yes, I do. Question, will you take
- 9:10Speaker 1: a moment to orient yourself on the map and tell
- 9:12Speaker 1: me when you found the relevant points that help you
- 9:14Speaker 1: understand what the map is of? Answer, yes. Question, do
- 9:18Speaker 1: you see the courtyard on the map? Answer, yes, I do. Question,
- 9:22Speaker 1: can you zoom in on the courtyard area? Kind of
- 9:25Speaker 1: the center of it? There's a pointer on the screen.
- 9:27Speaker 1: Is that the courtyard? Answer, yes, it is. Question, all right,
- 9:31Speaker 1: now the low-sea center will you describe? Well, let's just
- 9:34Speaker 1: jump to the wooded area. Where's the wooded area that
- 9:37Speaker 1: you're talking about? The scene that was processed? Answer, yep,
- 9:41Speaker 1: the wooded area. If you go from the courtyard and
- 9:43Speaker 1: go northeast, you're going to come across this big parking lot.
- 9:47Speaker 1: And then if you go just directly north to that,
- 9:49Speaker 1: question okay at this point, it might be easier or
- 9:53Speaker 1: easiest for you to actually indicate on the physical map.
- 9:56Speaker 1: If you don't mind just standing up, give you a
- 9:58Speaker 1: handheld mic here. Question, yeah, so the wooded area is
- 10:02Speaker 1: approximately right here in this area. Question, okay, so just
- 10:06Speaker 1: to make a record of the area on the northern,
- 10:08Speaker 1: I guess I'll say, the north is up on this map.
- 10:11Speaker 1: Is that right? Answer, yes. Question, do you know where
- 10:14Speaker 1: Campus Drive is? Answer, yeah. Campus Drive is this road
- 10:17Speaker 1: that winds right along here. Question, okay. And so that's
- 10:21Speaker 1: kind of a windy road and begins in the upper
- 10:23Speaker 1: left-hand corner of the exhibit and winds down through the
- 10:26Speaker 1: center of the map and kind of exits to the
- 10:28Speaker 1: middle right side of the map. Is that right? Answer, yes. Question,
- 10:32Speaker 1: and the wooded area. Where is that in relation to
- 10:35Speaker 1: Campus Drive? Answer, it's north of Campus Drive. Question, okay,
- 10:40Speaker 1: kind of, probably the center right of the map. Is
- 10:43Speaker 1: that right? Answer, yes, that's correct. Question, will you describe
- 10:47Speaker 1: first off What is on the south side across the
- 10:49Speaker 1: street from the wooded area? Answer, yes. So on the
- 10:52Speaker 1: south side of the wooded area, we have the computer
- 10:55Speaker 1: science building, which is to, I guess, east. And then
- 10:58Speaker 1: we have a parking structure. And we have a walkway
- 11:01Speaker 1: along here. In between that connects the computer science building
- 11:04Speaker 1: and the low-sea center building. And then right onto the
- 11:07Speaker 1: southwest of the parking lot area is going to be
- 11:09Speaker 1: the low-sea center building. Question, okay. Now, you referred to
- 11:14Speaker 1: that area across the street from the wooded area as
- 11:16Speaker 1: a parking structure. That's a parking lot, right? Answer, I'm sorry,
- 11:20Speaker 1: pardon me. Question, and there's a parking structure on campus, correct? Answer, yes,
- 11:25Speaker 1: there is. Question, but it's different than the parking lot
- 11:29Speaker 1: you just mentioned. Answer, yes. Question, okay. All right, folks,
- 11:34Speaker 1: we're going to wrap up right here. And in the
- 11:36Speaker 1: next episode, we're going to pick up where we left off.
- 11:39Speaker 1: All the information that goes with this episode can be
- 11:41Speaker 1: found in the description box.
