- 0:00Speaker 1: What's up everyone and welcome to another episode of the
- 0:03Speaker 1: Epstein Chronicles. In this episode we're going to get right
- 0:06Speaker 1: back to the Maria Farmer complaint filed against the United
- 0:10Speaker 1: States government. M. The USAO's failure to timely notify CEOS
- 0:16Speaker 1: in violation of the USAO manual. The USAO manual section 9-74.030 states,
- 0:25Speaker 1: requires that the USAO shall inform CEOS Child Exploitation and
- 0:31Speaker 1: Obscenity Section of all significant investigations and cases being prosecuted
- 0:36Speaker 1: in the district concerning child abuse, child pornography, and obscenity crimes.
- 0:42Speaker 1: As with the Civil Rights Division notice requirement, this ensured
- 0:45Speaker 1: that personal experience with child pornography and child abuse crimes
- 0:50Speaker 1: were involved in preparing such cases. At all relevant times,
- 0:54Speaker 1: The CEOS was based in D.C. In 2003, the FBI
- 1:00Speaker 1: launched with CEOS and NCMEC the Innocence Laws Project to
- 1:05Speaker 1: combat domestic sex trafficking of children. Upon information and belief,
- 1:11Speaker 1: despite this manual's requirement and the FBI's focus on domestic
- 1:15Speaker 1: child sex trafficking, the USAO did not involve CEOS in
- 1:19Speaker 1: their Epstein investigation and until more than a year after
- 1:22Speaker 1: the USAO was notified about the matter. Long after the
- 1:26Speaker 1: cursory investigation was completed, the USAO had prepared a prosecution memorandum,
- 1:32Speaker 1: and the USAO was already considering, if not moving forward,
- 1:35Speaker 1: with resolving the matter without charging Epstein. N. The USAO's
- 1:41Speaker 1: failure to comply with the manual's express requirements concerning an
- 1:45Speaker 1: NPA and the extraordinary grant to Epstein of transactional immunity
- 1:50Speaker 1: from federal prosecution. USAO Manual Section 9-27.600 authorizes government attorneys
- 1:59Speaker 1: to enter into an NPA in exchange for a person's cooperation,
- 2:04Speaker 1: which appears to be necessary to the public interest and
- 2:07Speaker 1: other means of obtaining the desired cooperation are unavailable or
- 2:11Speaker 1: would not be effective. See also Criminal Resources Section 719-20
- 2:18Speaker 1: The government and a cooperating defendant or witnesses might enter
- 2:22Speaker 1: into a non-prosecution agreement if the defendant or witness agrees
- 2:26Speaker 1: to cooperate. The USAO Manual Section 9-27.620 and 9-27.630 provide
- 2:31Speaker 1: guidelines for prosecutors on entering into an NPA. USAO Manual
- 2:35Speaker 1: Section 9-27.640 prohibits a government attorney from entering into an
- 2:39Speaker 1: NPA if in exchange for a person's cooperation without first
- 2:51Speaker 1: obtaining the approval of the appropriate Assistant Attorney General or
- 2:55Speaker 1: his or her designee when the person is someone who
- 2:58Speaker 1: is likely to become of major public interest. The USAO
- 3:03Speaker 1: completely failed to obtain or take any significant steps to
- 3:06Speaker 1: seek Epstein's cooperation in violation of USAO Manual Section 9-27.600-640.
- 3:15Speaker 1: which requires witness cooperation in exchange for an NPA. Instead,
- 3:20Speaker 1: in 2008, defendant granted Epstein the deal of a lifetime,
- 3:23Speaker 1: an extraordinary secret NPA, allowing Epstein to plead the two
- 3:28Speaker 1: minor state law crimes while immunizing his co-conspirators. Moreover, throughout
- 3:33Speaker 1: the investigation, Epstein continued to engage in the sexual abuse
- 3:38Speaker 1: and trafficking of young women, moving his primary operation to
- 3:41Speaker 1: the Virgin Islands and elsewhere. and even sexually assaulting at
- 3:45Speaker 1: least one young woman in Florida. Epstein continued his sex
- 3:49Speaker 1: trafficking operation with impunity right under the nose of the
- 3:52Speaker 1: FBI and USAO. The USAO's failure to comply with USAO
- 3:59Speaker 1: manual requirements regarding witness immunity. U.S. Code 18 Section 6001
- 4:07Speaker 1: authorizes the USAO to grant limited immunity to in exchange
- 4:11Speaker 1: for witness testimony in limited circumstances. Under Section 6001, the
- 4:16Speaker 1: USAO Manual Section 9-23.00 allows the USAO to apply for
- 4:23Speaker 1: an order granting a witness limited-use immunity when a witness
- 4:27Speaker 1: invokes their self-incriminating privilege. As to witness immunity, the Department
- 4:32Speaker 1: of Justice utilizes only those provisions contained in Title 18
- 4:37Speaker 1: regarding witness testimony. Immunity requests shall be forwarded to the
- 4:41Speaker 1: witness immunity unit and approvals for specified Attorney General officials
- 4:46Speaker 1: were necessary for such immunity. Criminal Justice Manual 720 Nothing
- 4:52Speaker 1: in the statutory scheme, USAO manual, or USAO policy authorized
- 4:57Speaker 1: a grant of immunity without witness cooperation, a written immunity request,
- 5:02Speaker 1: or needed approvals. However, without meeting with Epstein co-conspirators, obtaining
- 5:08Speaker 1: any approvals, or utilizing limited use immunity, the USAO agreed
- 5:14Speaker 1: in the NPA that the United States will not institute
- 5:17Speaker 1: any criminal charges against any potential co-conspirators of Epstein, thereby
- 5:22Speaker 1: granting all of Epstein's co-conspirators, named and unnamed, known and unknown,
- 5:28Speaker 1: full transactional immunity. the USAO's failure to comply with the
- 5:34Speaker 1: VRRA-CVRA USAO Manual and Attorney General Guidelines regarding victims' rights.
- 5:42Speaker 1: The USAO Manual confirms the statutory obligation to protect child
- 5:47Speaker 1: victims of sex abuse. After noting the alarming increase in
- 5:51Speaker 1: reports of child sex abuse, each year the insufficient attention
- 5:56Speaker 1: paid to child victims and the non-committent aggravation of child
- 6:00Speaker 1: trauma The USAO Manual acknowledges the primary goal of every
- 6:05Speaker 1: Justice Department, law enforcement officer, investigator, prosecutor, victim, witness professional,
- 6:11Speaker 1: and staff member shall be to reduce the trauma to
- 6:14Speaker 1: child victims and child witnesses caused by the criminal justice system.
- 6:19Speaker 1: In addition, the USAO Manual Section 9-75610 mandates that the
- 6:24Speaker 1: provision of service referrals to every child victim to protect
- 6:30Speaker 1: child victims and witnesses Justice Department personnel are required to
- 6:33Speaker 1: provide child victims with referrals for services and should provide
- 6:38Speaker 1: child witnesses with services referrals. USAO Manual Section 3-7.300 establishes
- 6:46Speaker 1: additional instructions and procedures regarding victims and witness assistance, including
- 6:51Speaker 1: training and implementation of victim rights services. The Attorney General
- 6:56Speaker 1: Guidelines 2005 also establishes various rights for all victims. including
- 7:01Speaker 1: the right to be reasonably protected from the accused and
- 7:04Speaker 1: the right to be treated with fairness and with respect
- 7:07Speaker 1: for the victim's dignity and privacy. Contrary to the USAO's
- 7:12Speaker 1: manual express goal to reduce trauma to child victims and
- 7:15Speaker 1: witnesses and the Attorney General's confirmation of the right to
- 7:19Speaker 1: be treated with fairness and dignity, federal law enforcement referred
- 7:24Speaker 1: to the victims throughout the investigation as prostitutes instead of
- 7:27Speaker 1: victims of child sexual abuse. and to the charges against
- 7:31Speaker 1: Epstein as procuring prostitution of a minor, not child sexual abuse. Similarly,
- 7:38Speaker 1: under the Attorney General Guidelines for Victim and Witness Assistance,
- 7:41Speaker 1: responsibility to crime victims begin at the earliest opportunity after
- 7:46Speaker 1: the detection of a crime, with investigative agencies providing reasonable
- 7:50Speaker 1: protection to victims. The 2005 Attorney General Guidelines for Victim
- 7:56Speaker 1: and Witness Assistance required employees to to minimize the frustration
- 8:01Speaker 1: and confusion that victims of crime endure in its wake.
- 8:06Speaker 1: The 2005 Attorney General Guideline also imposed mandatory training on
- 8:11Speaker 1: all employees with primary responsibilities, including crime victim contact. Upon
- 8:17Speaker 1: information and belief, even though Maria had informed the FBI
- 8:20Speaker 1: that Epstein and Maxwell threatened her, and other victims reported
- 8:24Speaker 1: that Epstein was threatening them with loss of life and limb,
- 8:27Speaker 1: at no time did the defendant offer Maria or any
- 8:30Speaker 1: other victim protection from Epstein or his co-conspirators. Nor did
- 8:34Speaker 1: they offer service, referrals, or other information as required by
- 8:38Speaker 1: the USAO Manual, Attorney General Guidelines, VRRA, and CVRA. Instead,
- 8:44Speaker 1: the FBI delivered false and misleading communication to victims, promising
- 8:49Speaker 1: them that the Justice Department would make its best effort
- 8:52Speaker 1: to protect their rights, including the reasonable right to confer
- 8:55Speaker 1: with the attorney for the United States in the case.
- 8:58Speaker 1: and to be reasonably heard at any public proceeding in
- 9:02Speaker 1: the district court involving the plea. The victim notice further stated,
- 9:06Speaker 1: at the time when the investigation was complete or nearly complete,
- 9:10Speaker 1: at this time your case is under investigation. Q. The
- 9:14Speaker 1: USAO's failure to enforce the NPA's terms or purpose. The
- 9:20Speaker 1: basis of Epstein's NPA was the USAO's agreement to defer
- 9:24Speaker 1: his prosecution in exchange for his compliance with the agreement.
- 9:30Speaker 1: MPA 1 and 2 attached in OPR Report, Exhibit 3.
- 9:34Speaker 1: These offenses shall be deferred in favor of prosecution by
- 9:37Speaker 1: the state of Florida, provided that Epstein abides by the
- 9:40Speaker 1: following conditions and the requirements of this agreement, set forth below.
- 9:45Speaker 1: Per the NPA, this deferral would cease if Epstein violated
- 9:49Speaker 1: any of the NPA's terms. The federal grand jury investigation
- 9:53Speaker 1: and subpoenas would be revived, and the United States could
- 9:56Speaker 1: terminate the agreement, investigate, and prosecute him. Upon execution of
- 10:02Speaker 1: this agreement and a plea agreement with the state attorney's office,
- 10:05Speaker 1: the federal grand jury investigation will be suspended, and all
- 10:09Speaker 1: pending federal grand jury subpoenas will be held in abeyance
- 10:12Speaker 1: unless and until the defendant violates any term of the agreement.
- 10:17Speaker 1: Epstein asserts and certifies that each of these terms is
- 10:20Speaker 1: material to the agreement, that a breach of any one
- 10:23Speaker 1: of these conditions allows the United States to elect to
- 10:26Speaker 1: terminate the agreement and to investigate and prosecute Epstein and
- 10:30Speaker 1: any other individual or entity for any and all federal offenses.
- 10:37Speaker 1: Epstein violated at least four key and material terms of
- 10:41Speaker 1: the NPA, but the United States failed to terminate the
- 10:44Speaker 1: NPA or take any other serious action. First, the NPA
- 10:48Speaker 1: required Epstein to plead guilty to solicitation of prostitution of
- 10:52Speaker 1: multiple minors. Epstein shall plead guilty to the solicitation of
- 10:56Speaker 1: minors to engage in prostitution in violation of Florida Statute
- 11:01Speaker 1: Section 796.03. However, Epstein pleaded guilty to solicitation of only
- 11:06Speaker 1: one minor. In doing so, rather than Epstein pleading guilty
- 11:11Speaker 1: to a pattern of abuse of multiple minors, Epstein admitted,
- 11:15Speaker 1: only to procuring the prostitution in one isolated incident with
- 11:20Speaker 1: one 16-year-old girl. Alright folks, we're going to wrap up
- 11:23Speaker 1: right here, and in the next episode, we're going to
- 11:25Speaker 1: pick up where we left off. All the information that
- 11:28Speaker 1: goes with this episode can be found in the description box.
