SPEAKER_00: Today's Kulin Naf Kuflamid, and we're gonna start by the new parak on the top of the Umur, Hazraya Valachayim, which by the way is the third to last parak in the Massaf over here.
0:09
SPEAKER_00: But it's not long proken, so we'll be done with everything in about a week.
0:12
SPEAKER_00: Zratasham.
0:13
SPEAKER_00: But either way, Hadzaraya Valachhaya Valachaya Yahim, by the way, very welcomed, easier daffin right now, compared to what we've been doing.
0:21
SPEAKER_00: So the Zraya, the Khayaim and the Kevah, we know are what's called Matnaskunah.
0:26
SPEAKER_00: They, as the Mishnah are gonna explain, apply by Kulin specifically.
0:30
SPEAKER_00: Zraya Lachhaim and Kaiva are parts of the animal that you have to give to the Koin.
0:33
SPEAKER_00: It's Matniskuna, that the Khajvar who granted us, and it's uh Bai Chulun, it's not in my Khim.
0:38
SPEAKER_00: And with that, the Mishnah says the Zraya, Val Chayaim, the Kev's ray is the front leg, the khayaim is like the jawbone, the keybah one of the stomachs.
0:45
SPEAKER_00: That all you have to give to the koyim.
0:48
SPEAKER_00: And that's naigin beerat or the chutzar.
0:50
SPEAKER_00: So it's naeg, whether you're in a tzra, whether you're in a chutzar, it's bifneabis, whether the basement is around, or actually says whether it's uh either kayim while it's uh around, or like nowadays when we're in galaxies, it's not around, shlaybifnea bais, but chulin of lemon gadash.
1:02
SPEAKER_00: These matnaskuna only apply by chulin and not by khotchim.
1:06
SPEAKER_00: Shaivadin.
1:07
SPEAKER_00: And the Mishnah says, interesting, the Mishnah's talking a little bit like a Gemar right now.
1:10
SPEAKER_00: I would have thought to make a Kabukimer to say that they apply also by Khartchim.
1:14
SPEAKER_00: Why?
1:14
SPEAKER_00: Umbay Machulun Chenim Mhachayabin Mchavashik, Matn Matan is Madachulin.
1:19
SPEAKER_00: That's not Haiivin Chazubashik.
1:21
SPEAKER_00: What's chazhik?
1:22
SPEAKER_00: Those are the mataskunas that you have to give from Khajim.
1:24
SPEAKER_00: So Madakhulin, that's not Haivin Chazabashik.
1:27
SPEAKER_00: So chaiben matanas, you're still hiving the matanas.
1:29
SPEAKER_00: Matanas stam for today just means the matanas by chulin, which is the Zuraya the Khayaim and Kaiva.
1:34
SPEAKER_00: So Khulin, that's not Haiivin Chazibashik, it is Haiiv in the Matana.
1:38
SPEAKER_00: So Kh'im Shikhayovin the Chazivashikana Dinchya and the Matanas.
1:41
SPEAKER_00: So Kh'im for sure.
1:42
SPEAKER_00: Khajim for sure you should be chai of in these matanas of uh Zurachayim and Kaiva.
1:46
SPEAKER_00: Tamunaimar, that's why we need a Josha to tell you not that way.
1:49
SPEAKER_00: We're gonna discuss in the gym or why do we need a Josha?
1:51
SPEAKER_00: But the point is the Mishnah says that's why you need a Josha to tell you.
1:54
SPEAKER_00: Don't make this Kawukhaimer.
1:56
SPEAKER_00: It says, which teaches me, Ain Lamasha Umr Binyan.
2:02
SPEAKER_00: It says only what we learnt about.
2:05
SPEAKER_00: And these matanas are not going to apply by Kotchim.
2:09
SPEAKER_00: I would have thought to make Kabukimer that they're gonna apply by Kotchim, Kamash Malon, that inloy elamasha omrinian, oysam, and not anything else, and that's why these matanas do not apply by khotchim, they only apply by chulim.
2:21
SPEAKER_00: That's the first part of the Mishnah, and that's the part we're gonna need for today's Gemara.
2:24
SPEAKER_00: Now we have the second part of the Mishnah that the Gemara in later Daphne is gonna get into, but what we need to know for the second part of the Mishnah, again, we're not gonna get into it today, but basically there's different types of khadim, as we know, there's kadusha's a guuf, there's kedusha's dhamim.
2:37
SPEAKER_00: Within Kedusha's a guf, the basic way that it works, which we already know, is when kid's something that that's kaddush we keddusha's a guf, meaning that itself.
2:47
SPEAKER_00: That uh animal, let's say, has kiddusha's a guf, what does that mean?
2:51
SPEAKER_00: You're not generally able to be poidet.
2:53
SPEAKER_00: Meaning it's guuf is kadush, right?
2:56
SPEAKER_00: And you can't necessarily be poid, it's not uh it doesn't just have kadusha's dumim that you could freely do whatever you want with it as long as you're poidet.
3:02
SPEAKER_00: So something that has kiddush as a guf, once it gets a mum, however, we know it's considered psuli amugdashim.
3:07
SPEAKER_00: Once it's psuli amugdashim, then you're able to be poidet, and that's the alochul, even if it has kaddush as a guh.
3:13
SPEAKER_00: Again, if it gets a mum, now you're poidet, uh it's considered psuli amugdash, now you could be poidet.
3:18
SPEAKER_00: So our Mishnah is gonna discuss even a more dumbed-down case.
3:21
SPEAKER_00: What if you were makdish it after it already had a mum?
3:25
SPEAKER_00: So the first case is something that was qaddish, and then it got a mum.
3:28
SPEAKER_00: So it's a higher level of hektish, it's bona fide, complete uh hektish, kadash bakdush as a ghuf, and then it got a mum.
3:34
SPEAKER_00: So it's a higher level of keddushah there's different alakas afterwards, it's still considered, it's still considered katshim to a certain extent.
3:40
SPEAKER_00: Even once you're pointed, it's it's a big giza va avaida, there's different alakas.
3:44
SPEAKER_00: But if the mum was there before you were makdish, you tried to be makdish this animal, that already had a mum, it's not a mum that developed afterwards.
3:51
SPEAKER_00: You it already had a mum and you tried to be makdish this animal to make it kadash be kadusha gof, it's gonna have a much low lower level of kadusha.
3:57
SPEAKER_00: And that's what the Mishnah is about to discuss.
3:58
SPEAKER_00: That if you're Makdash after it already had a mum, the din is gonna be different and it's gonna have a much lower level of kadusha.
4:05
SPEAKER_00: And with that continues the Mishnah.
4:06
SPEAKER_00: Kala Kutchim Shekada Mumkavua like Nation.
4:08
SPEAKER_00: Any kotim that it already had a mumkavua.
4:11
SPEAKER_00: We know there's different types of mumming.
4:12
SPEAKER_00: So for our purposes to be considered a mm-dash, it needs to be a mumkavua, permanent mum, not a mum oidr.
4:17
SPEAKER_00: So any kutchim that had a mumkavua before you were makdish it.
4:21
SPEAKER_00: So you tried to be makdish this, and then uh you tried to be makdish a big dusha as a ghost, but it already had a mumkavua, viniftu, so then you were poided.
4:29
SPEAKER_00: So again, it gets a certain level of kadusha, but then you were poided, it has a mum, of course you can be poidid, right?
4:34
SPEAKER_00: So the Mishnah says that all these things are gonna apply.
4:38
SPEAKER_00: The common denominator between all these things is that it has the regular data of hulin.
4:41
SPEAKER_00: That chhayovin bibhoira, uvi matanas chaivin bichhoira, if if it gives birth to a bihar, if it's female, it has a bihar, just like chulin.
4:48
SPEAKER_00: Only chulin, you're chaibbihar.
4:50
SPEAKER_00: Uh matanas, you're chaiven the matanas.
4:52
SPEAKER_00: The matanas over here refers to our matanas of our Mishnah's, which again only apply only by chulin.
4:57
SPEAKER_00: The y'itzin the hulin, they godz vilayavid, and it's not as giza baida, meaning it's completely hulin.
5:03
SPEAKER_00: The vlod and mechavan mutter, and its offsprings and its milk is completely mutter.
5:07
SPEAKER_00: Again, it's like chulin.
5:12
SPEAKER_00: Did of chulin.
5:12
SPEAKER_00: But shacht and machut' potr.
5:14
SPEAKER_00: And if you shacht it outside the basin, you're gonna be potur, even though there's an issue of shit's chutz, then only applies to cutshame.
5:20
SPEAKER_00: This is completely hulin.
5:21
SPEAKER_00: And by the way, over this part is talking about even before you were paid.
5:24
SPEAKER_00: Yeah, such as the chulin, even before you're paid, there's no you're not there's no khia for shritaschutz.
5:28
SPEAKER_00: Shech and machut potter.
5:29
SPEAKER_00: The anas and tmura, and it's not subject to the allahs of tmurah, it's chulin.
5:33
SPEAKER_00: The mesu, yftu, and if it dies, you could still be poidet.
5:36
SPEAKER_00: Okay, so that's that basically tells you that if you were Maktish an animal that already had a mum kavua, it's considered 100% like Hulin.
5:44
SPEAKER_00: Like I all these alakas, chutzmina bhor mina miser, except for Bahorin Meiser, which we're gonna see that rather Bahorin Miser, we look at it as if it was Hegdash and Koidim Lemuman, as if it's a regular case of Hektish that get developed a mum afterwards.
5:57
SPEAKER_00: And that's what that's what the Mishnah is about to discuss.
5:59
SPEAKER_00: That kosh, kada magdash and as muman.
6:01
SPEAKER_00: Any time that the hektish came before the mum, meaning you were Makdish, this, it was 100% uh Hektish Bekadush as a guf, it was the Kaddish Bekadush as a guf, and nothing was wrong with it, and then it developed a mum, then it's already more codch.
6:14
SPEAKER_00: Then it has a higher level, it's not considered bona fide hul.
6:16
SPEAKER_00: And even once you're paid it, it still has certain Israel and certain allochas.
6:20
SPEAKER_00: And that's what the Mishnah is saying.
6:20
SPEAKER_00: That callshot magdash is mum, and if you were makdish, and then it developed a mum, aim oiver cutamagdish, or it had a mum before you were machisha, but it wasn't a mumkavua.
6:28
SPEAKER_00: It was a mum eivur before you were machdish.
6:30
SPEAKER_00: So again, you were makesh it basically without a mum kavua, Ulakhim came mumkavua, and then afterwards, once you were machdish, then it's a mum kavua afterwards, veneftu and you replied it, it's potter from Bahira, it's potter from a tonas like kektish.
6:44
SPEAKER_00: It's pot sir potter like kotchim from Bhakaira from Armatanas Rada Khaim and Kiva, because on only Hulan has that.
6:52
SPEAKER_00: And there's the Iser Giza Vahvoida just like Sullia Mugdashim, Vivan Vichavan Asir Akabidainam and its offspring and its milk is gonna be asri even after you're pointed, just like Kotchim again.
7:04
SPEAKER_00: You're gonna be high for Shkita's Khutz.
7:06
SPEAKER_00: Again, this is specifically before you were pointed.
7:09
SPEAKER_00: Before you're pointed, you're gonna be high for Shkita's Khutz.
7:11
SPEAKER_00: Guys in Tmura, it's subject to the Allah's of Timurah like regular Kot's him.
7:14
SPEAKER_00: They may su, yikburu, you're not gonna be able to be pointed.
7:17
SPEAKER_00: If it dies, then you have to bury it like Kotchim.
7:20
SPEAKER_00: But either way, what do we see?
7:22
SPEAKER_00: Now there's different stages.
7:23
SPEAKER_00: Again, something that is, something that is hectish, and then developed a mum afterwards.
7:28
SPEAKER_00: That's regular Psula Mugdashim, you could be poided, but it's subject to the allahas like regular Psula Mugdashim.
7:32
SPEAKER_00: It's considered hectish, considered katshim for all these allochas.
7:35
SPEAKER_00: But if it had a mum kavuah before you were makeshid, and now you tried to make it cut us with kedush zaguf, and then you're paid it, the aloha is, then it's considered like regular chulin, because again it had a mum kavuah before you were makeshit as a much lower level of kiddushah.
7:47
SPEAKER_00: Zhakti Gemara.
7:48
SPEAKER_00: And again, we said in the Gemara, we're gonna focus on the first part of the Mishnah.
7:50
SPEAKER_00: So let's focus on the first part of the Mishnah.
7:52
SPEAKER_00: First part of the Mishnah taught us about the matonas that you have by Khulin, Zeroya, Likhayaim, and Kevah go to the Kayin, by every regular animal, Bizmanazeb, Bizman, the Bas Amigdash, whether you're in Arzas, whether you're in Chutzards, it doesn't matter, it goes to the Kayin.
8:05
SPEAKER_00: And we tried to say that, by the way, I would think Shahaya Bidin, I would think there's a Kabul Khimer to tell you that these matonis apply also by Khotchim.
8:13
SPEAKER_00: Why?
8:13
SPEAKER_00: Because by Khatchim you have uh we can make a kabukheimer because you have chazov a shaykh by Khajim, and over here you don't have Chzeva Shik, and you're still Khiban Matanas, so for sure by Khajim that has Chavashik, you should be chai of matanas.
8:22
SPEAKER_00: Kamashma, the pasik says, Aysam.
8:24
SPEAKER_00: Aysam teaches me no in the khala masha khazabin.
8:26
SPEAKER_00: Zakti gimara.
8:27
SPEAKER_00: Time in the Kazavrachman Aisam.
8:29
SPEAKER_00: That's only true.
8:30
SPEAKER_00: I don't make this kabukheimer because the pasik said I sam, like we saw in the Mishnah.
8:33
SPEAKER_00: Hola, vachia mina kachim chaiim matanais.
8:35
SPEAKER_00: But if not, I would I would think to make this kabukheimer to tell you that khad shim are gonna be hiven these matanis.
8:40
SPEAKER_00: Why would I think such a thing without the pasik?
8:41
SPEAKER_00: In the king of mefrach, I can tell you a pirchan that malehulin shekin haiven be bihaira.
8:46
SPEAKER_00: You're gonna try to tell me a kabochimer to teach you from to teach you from hulin to khodchin that you're gonna be high in matanas as well.
8:54
SPEAKER_00: I can tell you that it's different.
8:55
SPEAKER_00: You can't make that kabukimer because hulin's different.
8:57
SPEAKER_00: You can't learn from hulin because malechulin shekin haib and bebuchaira.
9:00
SPEAKER_00: Hulin has a uh a humra over khotchim that hulin is chaib be bihaira, masha inkain bekachim, right?
9:07
SPEAKER_00: And therefore you can't just make a kabukheimer who said it's more chamr just because it's kachim.
9:11
SPEAKER_00: Hulin has its own humras, right?
9:12
SPEAKER_00: This is a classic period.
9:13
SPEAKER_00: And says the Gemara, you're right, but I wouldn't be learning from Hulin generalized.
9:18
SPEAKER_00: I would have learned, Casey means sharin.
9:20
SPEAKER_00: I would have learned from specifically male animals of Kulin.
9:23
SPEAKER_00: Schharin and Sharim are not subject to Bekhaira.
9:26
SPEAKER_00: Rashi says beat sha'in and yodin because they don't uh give birth, right?
9:30
SPEAKER_00: Males don't give birth, and therefore they're not subject to bikhira for their offspring because they don't give birth, and therefore, what you learn from the males of chulin, and it doesn't have the khumra of Bekhirah, so that's where I would have made the Kawakhaimer to teach you by Khotchim that it has matanas as well, unless I have, and that's why I need Oisam to tell you not that way.
9:47
SPEAKER_00: So it's like and bereishes age, I'll find you a different khumra.
9:51
SPEAKER_00: Skarim are chaiben raishes agez.
9:55
SPEAKER_00: Even sharm by katrim are not hayibereus age, but raishus age only applies to khulin, and that applies by sharim as well, by the way.
10:02
SPEAKER_00: Rishage applies to everything, but it's sqharim as well, so it's not limited only to females.
10:06
SPEAKER_00: And therefore, if you you can't how are you learning from Sharim?
10:08
SPEAKER_00: You have the same Pircha to tell me that Skarim, even Skarim Bhakulin, have a different Khumra that applies to them as well, that doesn't apply by Kotchim, that it's Khaim and Rachis Agaz, and therefore, why would I ever have thought such a to make such a Kaaba Khamer?
10:19
SPEAKER_00: I don't need the Pasikai Sam, says the Gemara, you're right, but me Tioshin, let's qualify it further.
10:24
SPEAKER_00: I would have thought to make a Kaabokheimer specifically from male goats.
10:27
SPEAKER_00: Because by male goats, there's no racial sagais.
10:29
SPEAKER_00: They don't really have uh uh wool, and therefore there's no raish sagez by male goats.
10:34
SPEAKER_00: They're also male, so they're not subject to bikhoira.
10:37
SPEAKER_00: So since it doesn't have these khumras, not necessarily any khumra by by tioshim, and that's where I would have made the kabochimer one from, and that's why I need the word the the positive by some.
10:45
SPEAKER_00: Says the gumara mala tioshim shiken nichnas ladirlis asser.
10:49
SPEAKER_00: Tioshim, I can tell you that there is a khumra.
10:51
SPEAKER_00: Why?
10:51
SPEAKER_00: Because she came nichnasin lidirlis asser.
10:54
SPEAKER_00: That they that all khulin basically is subject to Mayser Behema.
10:59
SPEAKER_00: Siri Kaidash by Mayser Behema.
11:01
SPEAKER_00: We know every tenth one, so there's Mayser Behemah.
11:03
SPEAKER_00: So that's why that's a khumra that you only have by chulin.
11:06
SPEAKER_00: So how would I think to make a kavachimer from this if it has a khumrah of Maister Behema?
11:12
SPEAKER_00: And she's the Gemaram is Kainim.
11:14
SPEAKER_00: I learn it specifically from Tiyoshim, which are male goats, and there are also skinim, which are not subject to Maister Behema, because they'd already passed their time.
11:23
SPEAKER_00: Skainim doesn't mean specifically very old animals, it just means that it's not the year anymore.
11:26
SPEAKER_00: Meaning they did Maister Behema last year, there's only one time.
11:28
SPEAKER_00: They don't have to go through it every year.
11:30
SPEAKER_00: And therefore, Zkainim, it doesn't apply.
11:34
SPEAKER_00: Why does Maser Bahima apply to Skainim?
11:36
SPEAKER_00: Not because it doesn't apply to Khla, because this animal already did it last year.
11:40
SPEAKER_00: Well?
11:42
SPEAKER_00: Good question.
11:42
SPEAKER_00: But says the Gemara, Mahla Skin Sh Kane, Nichnasuladirlisr.
11:46
SPEAKER_00: They already did last year, so they were subject to Maysabahema, so it still applies.
11:49
SPEAKER_00: Says the Gemara vi lakuach veyasim.
11:52
SPEAKER_00: We're talking about Tiyashim that are lakwach viyasim.
11:56
SPEAKER_00: We're talking about tiyoshim, male goats that are lakwah viyasam that are bought or viyasim, they don't have a mother.
12:02
SPEAKER_00: Where mice behema, they're potter from Maysabahema in this case, and therefore, and therefore I'm learning I would learn from you.
12:08
SPEAKER_00: This is what my Kaabuchim was built from.
12:10
SPEAKER_00: Again, they're males, so you don't ask me the Kasha that it has a humra of Bihar, because it doesn't.
12:15
SPEAKER_00: They're males.
12:15
SPEAKER_00: Ain't and yold it.
12:17
SPEAKER_00: They're tiashim, so gracious against doesn't apply because they're goats.
12:20
SPEAKER_00: Okay?
12:21
SPEAKER_00: And also they're lakulah and yasim, and therefore myself doesn't apply.
12:24
SPEAKER_00: So you don't have a khumra.
12:26
SPEAKER_00: This is the case we would be learning with Kamash Malan.
12:30
SPEAKER_00: I would have learned that I would have learned that Kabukhmer to teach you that matanas also apply by Khatshim, Kamash Malan have the Pasak of Aisab.
12:37
SPEAKER_00: But Malankuh Yasim Shikain nichnasin ben on Lidirla Saser.
12:40
SPEAKER_00: I understand maybe by specifically a goat that you bought or a goat that doesn't have a mother, that specific one is not high in Mayser Bahema.
12:47
SPEAKER_00: But shekein nichnasan nichnasin ben min on uhir lidir la isasr, but the same type, meaning goats in general, are subject to Mayser Behema.
12:56
SPEAKER_00: So I hear this specific goat is not, but goats in general are.
12:59
SPEAKER_00: And therefore, maybe it's still a khumra that I have here over Kotchim, says the Gemara Bin Min and Kamrit.
13:03
SPEAKER_00: Once you're coming onto that, that we look at the whole min, Khatshim nami be minin nichnas and lhidirlis asser.
13:08
SPEAKER_00: Is Khim a different min?
13:09
SPEAKER_00: Khatchim is the same type of animal, it's just a different, it's it's Khajim, and therefore Khatshim, the same type of min is also haiv and maiser behemoth, just if it's not Kachim, right?
13:16
SPEAKER_00: So you can't compare the two, and that's why it's not a riah.
13:18
SPEAKER_00: And again, we're back to uh basically learning the kabukhar would have been specifically from Tioshim's Kharim that were either bot or yasim, and all these three khumrus don't apply by this combination, as I said a second ago, and that's where I would have learned the Kabukimr from that just like over here by the Hul by Hulin, you have the Matana, so too by Kotchim, where you have Chazabashik, for sure you should have these matanas come out.
13:38
SPEAKER_00: And the pastor said, Oisam to teach you you don't.
13:41
SPEAKER_00: Continues the Gemara.
13:42
SPEAKER_00: Now let's try the opposite way.
13:46
SPEAKER_00: So we just tried to say, we just explained the Mishnah's attempted Kabukheimer, why you should maybe suggest that Kachim is also chaiab in Matanas just like Hulin.
13:54
SPEAKER_00: Now let's try to say the opposite way.
13:56
SPEAKER_00: That Hulin should be chaib and chazibish just like Khauchim.
14:00
SPEAKER_00: Says the Gemaro, that you hulin chaiven machasabashik me kabhaim, oh ma kochim shinihaiven matanas chaiven ishaik.
14:10
SPEAKER_00: That's uh that's not chhaev in the matanas, since we're in the chaim and cava.
14:14
SPEAKER_00: And still chaib and chhazavishik to the qa'anim.
14:16
SPEAKER_00: Soiv in the matanas for sure should be chaib in chosebish.
14:21
SPEAKER_00: That's why the posik says, this we didn't, this part we didn't have in the Mishnah, the Posik says, Ze in Midi Akhiniloi.
14:29
SPEAKER_00: It teaches me this only.
14:30
SPEAKER_00: This Posik is specifically by Zahim Mishpat Akemi, so all me, Zabhai, I'm sure it's the Matonas, and this teaches me Ze in Midi Achriniloi.
14:40
SPEAKER_00: By Chulin, you only have the Matonas, the Zrail Khaim and Keva, and Midi Achriniloi is something else not, and that's why I'm not gonna learn that you have, I'm not gonna learn that you have the um the chazim and the shriik by chulin.
14:53
SPEAKER_00: Says the Gemar.
14:53
SPEAKER_00: Okay, so we're gonna make the same chajbin, right?
14:55
SPEAKER_00: We suggested a Kabukhim to teach you that you should be chaib and chazhik also by Khulin, and we told you no, because I'm to keep it down a little bit.
15:03
SPEAKER_00: I can't I push again thing.
15:05
SPEAKER_00: So but uh but so we suggested maybe make the same same Kabukhar in the reverse to teach you that Chaz of a Shriik should be by by Khulin as well, Kamash Malan I have a posak vizze, teaching you not that way.
15:20
SPEAKER_00: So the Gamar say makes the same chajman.
15:22
SPEAKER_00: Allah time in the Khazah rahman a zehla vahyav meena chulin chai and chaziv a shik.
15:25
SPEAKER_00: So the only reason I wouldn't say this Kabukimar is because I have a posik of zeh but if I didn't have the posik of zed, then I would think that chulin is chaib and chaz of a shaykh, like we just said.
15:33
SPEAKER_00: So the gymar, how could that be?
15:34
SPEAKER_00: How could I possibly suggest to you, and telling you you need a posik to tell me not?
15:37
SPEAKER_00: How can I suggest to you that chulin is chaib and chuz of a shaikh by tnufa?
15:40
SPEAKER_00: Chaz of a shaykh, it's a din and the posik in the tire that it needs tnufa, now by the waving it around.
15:44
SPEAKER_00: Hey chulin of and that's not possible by chulin.
15:47
SPEAKER_00: Why?
15:47
SPEAKER_00: Where are you gonna do it?
15:48
SPEAKER_00: I've right, if you're gonna do it outside, if you're gonna do it outside the base of Middash, lift neashem, because if by tnufa, you have to do snufa always specifically lift nayashem, which is inside the base of migdash.
15:57
SPEAKER_00: And yeah, maybe you're gonna do it inside the base of Middash.
16:01
SPEAKER_00: We're talking about Hulin over here.
16:02
SPEAKER_00: You can't bring Hulin into the Azara.
16:03
SPEAKER_00: That's an issue, and therefore Hilkahlayafshar, so it's not possible.
16:06
SPEAKER_00: If it's not possible, what was your suggestion to tell me based on the Kabukhmer?
16:09
SPEAKER_00: I would have thought of a strike by by a hulin, unless you have a pasuk.
16:13
SPEAKER_00: We don't need a pasuk, it's impossible.
16:15
SPEAKER_00: There's no it's a hilkahlayafshar.
16:17
SPEAKER_00: So Allah Zalam Ali, so why do I need the Pasuk?
16:19
SPEAKER_00: It's impossible anyway.
16:20
SPEAKER_00: I don't need a Pasuk to tell me that it doesn't apply.
16:21
SPEAKER_00: And so the Gamar, you're right.
16:23
SPEAKER_00: I don't need the Pasuk for that.
16:24
SPEAKER_00: I need the Pasuk for something totally different.
16:26
SPEAKER_00: I need the Pasuk for to teach you something Rahizdah said in the name of Rav.
16:30
SPEAKER_00: Or no, sorry.
16:31
SPEAKER_00: Rihidir Rchizdah, the omar Rukhizdah because Rafchizda said, someone who's mazik matanaskuna.
16:40
SPEAKER_00: So he takes uh matanaskuhuna like the like the Zurali al-Khayim in Kevah and he's mazikit.
16:45
SPEAKER_00: So does he have to pay the kahanim?
16:47
SPEAKER_00: So says Rahizdah Potter Milishalim.
16:50
SPEAKER_00: Or he eats Poshit eats it.
16:52
SPEAKER_00: He eats it, he's not a he's not a Kayan, he's a lady, he's raw, whatever it is.
16:55
SPEAKER_00: He's maziker, or he eats it, he's gonna be potter mileshalim, and Rashi explains if he's mazikit, we're talking about specifically before you gave it to the kayin.
17:03
SPEAKER_00: So right now it could go to any kayun.
17:04
SPEAKER_00: There's a lot of kayanim out there.
17:05
SPEAKER_00: So before you give it to the kayun, he's mazikat.
17:08
SPEAKER_00: He throws it, he burns it, rash says he throws it into the fire, or he throws it into the yam, or he eats it, the Gemara says.
17:14
SPEAKER_00: So he's gonna be potter.
17:15
SPEAKER_00: Why?
17:15
SPEAKER_00: Rashi says, Because because it says zeh, and we learn that's what we use the word zeh for.
17:20
SPEAKER_00: The mashma, rashi adds some words, dihsibu zed, the mashma, but litnon.
17:27
SPEAKER_00: When do you have to give it to the kayan while it's still there?
17:29
SPEAKER_00: But if you destroyed it, I will in and kayamas lay chaia of a cause of the colour.
17:33
SPEAKER_00: But if they're not around anymore, even because you destroyed it, the pasik is not and we're about to expand on that.
17:40
SPEAKER_00: And that we're gonna go on a tangent just because we brought this up.
17:43
SPEAKER_00: Why did we bring this up again?
17:44
SPEAKER_00: Because what did we do with the pasik zeh?
17:46
SPEAKER_00: I don't need the posik zeh to teach you that khaz of a shik doesn't apply by chulin because I know that anyways, because heikhal in Ofinu, where would you possibly do it?
17:54
SPEAKER_00: Hey, so since it's not impossible, you can't do the tnufa anywhere, so obviously Khazavishik doesn't apply.
17:59
SPEAKER_00: So what do I need ze for?
18:00
SPEAKER_00: I need zeh to teach me the salah of Khizdah that if you damage Matanas kahuna, you are not haived to pay the qahanim.
18:06
SPEAKER_00: Says the Gemara on that note, gufa.
18:08
SPEAKER_00: Omin R Khizdah Mazak Matanas Ka'nim, oysh, Ochlan, Potr Milishalim.
18:12
SPEAKER_00: If you're Mazak Matanas kahuna, or you ate it, your potri mil shan, you don't have to pay the qa'im.
18:16
SPEAKER_00: Says the gmar, my time.
18:17
SPEAKER_00: Well, what's the reason that you don't have to pay the qanim?
18:18
SPEAKER_00: What's the reason that your pottery?
18:21
SPEAKER_00: First uh suggestion is because of Zed, the Posik Zed that we saw a second ago.
18:27
SPEAKER_00: The second option that the Gemar gives is because it's considered Mam and Shain Lai Taivim.
18:31
SPEAKER_00: What's Mam and Shain Lin Taiven?
18:32
SPEAKER_00: Mam and Shain Lan Taivim is something that there's no one specific bailin that can come and be Taiveya you in court.
18:38
SPEAKER_00: That you owe me this.
18:39
SPEAKER_00: Because he's just gonna say what?
18:40
SPEAKER_00: I don't know, you I owe the other kind.
18:42
SPEAKER_00: I was gonna give it to uh Shimon, not to Ruven.
18:44
SPEAKER_00: And therefore, since it's Mam and Shain Lintai, you can there's no Toy Veya for there to be a nitvah in court, and that's why that's why you're gonna be Potram of the Shalom.
18:53
SPEAKER_00: You shouldn't have done this, you shouldn't have uh eaten the Ka'anim stuff, but now today there's no one specific kind that's gonna be able to bring you to court and be tava you.
19:00
SPEAKER_00: Well I can't anyone because again, you're just gonna say I wasn't gonna give it to you, Bahla, I was gonna give it to my friend the Khan.
19:06
SPEAKER_00: Not you, who are you, to be tave me.
19:09
SPEAKER_00: That's mum and shainla, uh that uh that's what Mamma Shayna Taivim is.
19:12
SPEAKER_00: So that's the second option.
19:16
SPEAKER_00: And that's the reason, that's the second option.
19:18
SPEAKER_00: Again, the first option is the posikviyat zet.
19:20
SPEAKER_00: That's why we brought it into the discussion, Bahla.
19:21
SPEAKER_00: But the second option the Gemara brings, the e the the the iba isimah, is because it's considered mumm and shainla and taiven, and that's why you're not gonna be haiv to pay if you damaged or you ate the matanas kehuna.
19:32
SPEAKER_00: And on that second uh suggestion that the Gemara brought for the reason of this aloha, because Mamma and Shain and Taiven were about to fire away with questions that's gonna be the rest of the daff and also the beginning of tomorrow's daft.
19:43
SPEAKER_00: Just keep on asking on this point that you're telling me that you're not hive to pay because it's mammon shainla and toivem.
19:49
SPEAKER_00: That's where we're gonna ask on right now.
19:50
SPEAKER_00: Says the Gemara.
19:52
SPEAKER_00: I'll ask you again on the second one, not on the positive brought of Zah, but on the second option, the Viba Isema, that the reason you're not gonna be haived if you damage the Matanas Khuna is because it's Mamma Shainla and Tivim.
20:00
SPEAKER_00: It says the Gemara Maiswe, Mishpatakanim.
20:03
SPEAKER_00: What have I learned from the word Mishpat?
20:07
SPEAKER_00: I learned that the Matanas Kiuna are considered din.
20:10
SPEAKER_00: What does that mean that they're considered din?
20:11
SPEAKER_00: Ain't Rashi.
20:12
SPEAKER_00: Rashi says, Dayonin is kokinla mlayatsian bidayonim.
20:15
SPEAKER_00: It means that the dayonim are niskaq to this, that you could be sued in court to make you pay back for the matanas kiuna.
20:22
SPEAKER_00: What do we see clearly?
20:22
SPEAKER_00: Ama Kayan, Rishana Ha Toyvan, Mutsi, and me others.
20:25
SPEAKER_00: So we see the first kayun that comes in is Tavayu is gonna be able to take this out from you in Bazdin.
20:30
SPEAKER_00: So the Kashul of Khizda, the Omar the Matanas Kaun, Mamun Sha'lim Taiv.
20:33
SPEAKER_00: So obviously it's a Kashan of Kizdah that says, that says that it's uh Mamun Shaynlam Taivim.
20:39
SPEAKER_00: Because if it's considered a din, Milami Shah Matan's din, then yeah, it's not Mamma Shayla, someone's gonna be able to take it in.
20:47
SPEAKER_00: And the Gemar clarifies the question that what does it mean that it's din?
20:51
SPEAKER_00: It doesn't mean that someone could take it to Bazdin and Mammish take this away from you, and therefore it's not Mamma Shailimtai, it's Mamma Shayeshla and Taiven.
20:58
SPEAKER_00: And the Gamar, no, that's not what the Brahsa meant.
21:02
SPEAKER_00: It just means Likholkun Bidayonim, that the Dayonim get to decide who gets the Matanas kuna.
21:06
SPEAKER_00: Why would they get to decide?
21:07
SPEAKER_00: Because as a lach, as the Gamar is about to explain that not any Koinam'arits got the Matanas kuna.
21:12
SPEAKER_00: Only Qihanim that were Tamidikha Khamim specifically got matanaskayuna.
21:16
SPEAKER_00: So where it says Milamin, Mishpat in th in the Pasik teaches me Milaman Shamatanas din that it's a din, it doesn't mean it's a din that you could be Tayveya, someone to pay his matanas kuna.
21:24
SPEAKER_00: No.
21:25
SPEAKER_00: It means it's a din that the dayanim have the power to choose who it goes to.
21:30
SPEAKER_00: But not that they're gonna be able to be mighty miyada, and not that it's maman shay slahim.
21:33
SPEAKER_00: Rather, it's mam shayyid lam taimim.
21:35
SPEAKER_00: It says the game about where do we find the salaha?
21:42
SPEAKER_00: How do we know you're not allowed to give them a tanais?
21:44
SPEAKER_00: You don't give it to a kind that's Amarat S.
21:52
SPEAKER_00: You're supposed to do it.
21:53
SPEAKER_00: Why?
21:58
SPEAKER_00: Any kind of lady that has that's machik.
22:02
SPEAKER_00: Then he gets a minos.
22:03
SPEAKER_00: He gets the matanas.
22:06
SPEAKER_00: So again, the Mishpat in the Pasik is not talking, not telling me that you're that any coin's going to be able to be Tavayu.
22:11
SPEAKER_00: The Mishpat in the Pasik is telling me that the Dayanim get the right to choose which Kayanim uh get Matanas kun in general.
22:17
SPEAKER_00: But if you ask me, is it Mammon Shain Lamtai?
22:19
SPEAKER_00: The answer is yes, Mamun Shain Lam Taibim.
22:20
SPEAKER_00: And that's why you're not going to be high to pay, according to the Vchizna, if you damage your eighth of Matanas kuna.
22:25
SPEAKER_00: I'll ask you another cash on this.
22:26
SPEAKER_00: Rebu the Memasa, I'm a Mishpat.
22:28
SPEAKER_00: Again, this word Mishpat in the Pasik teaches me Melamin Chamatanas Din.
22:32
SPEAKER_00: And on this right side, it expands a little further.
22:35
SPEAKER_00: Yochla Filo Chavez Din.
22:36
SPEAKER_00: I would think even Hazvishik, which is the Matanas by Khajchim, right?
22:40
SPEAKER_00: I would think even that's Din.
22:42
SPEAKER_00: Tamilimir's Zeh Tamilimir teaches me that no, only ze, only, only uh by chulin, only the regular matanas of Zrachaim.
22:49
SPEAKER_00: Okay, but sazikramalai.
22:50
SPEAKER_00: What are we talking about that it's din?
22:52
SPEAKER_00: Again, what's the two options?
22:56
SPEAKER_00: Or uh Lekholko Bidayanim, which we saw, that just means they get to choose who it goes to.
23:03
SPEAKER_00: If you're gonna tell me like what we just answered for the previous Bride saw, that it really just means that they get to choose who it goes to.
23:08
SPEAKER_00: Then what we just say in the Briceal.
23:10
SPEAKER_00: That says zeh, it teaches me that it's not din by chose of shaykh, meaning by chose of shaykh, which are the matanais by qim, that if it means over here, that doesn't apply to chzebushik.
23:23
SPEAKER_00: And the chhouse of shaykh goes to anyone, even Amaratzim says again.
23:28
SPEAKER_00: Chase of a shaykh doesn't go.
23:30
SPEAKER_00: It's not uh nechlaq alayidayanim, of course.
23:32
SPEAKER_00: The same Allah applies.
23:33
SPEAKER_00: Chose of Shik also only goes to Hamidah Khamik.
23:35
SPEAKER_00: So Allah is the only other option, Lightzia Bidayyanim.
23:38
SPEAKER_00: Obviously, it means l'itziya bidyanim.
23:40
SPEAKER_00: So what do we clearly see?
23:41
SPEAKER_00: We see the matan's must be Mama in Sheyeshlam Taiven because Lightsiya Bidayanim.
23:47
SPEAKER_00: Again, we just said Ze, according to the Bunam and Mesira, teaches me that the Matanis, that's right, the Khaim and Kaibah are din.
23:52
SPEAKER_00: And what's the option that we just fell onto?
23:54
SPEAKER_00: It must be L'IT Siya Bidayanim.
23:56
SPEAKER_00: That you're gonna be able, someone's gonna be able to bring you to Bazdin, as Rashid said before, the first kayun that finds you, A'ma'ukayain, Rishna Taiven, might see in any other, the first kayyin that uh gets to you is gonna be able to be Timay and you and Besn, which means it's Mamma Meshayeshlam Taiven.
24:08
SPEAKER_00: Kash on what we said before that it's Mamushaimlam Taiven, which is the reason, the second reason, the Ibaisima that we said of Khizdahold, that you're not gonna be chaib if you're Mazak, Matanais.
24:16
SPEAKER_00: Says the Gemara, hacha bimayaskina, the asuliyadeh.
24:20
SPEAKER_00: Over here, that we implied clearly from the Brahsa that he's gonna be able to be Matsia Bideyanin, which says Mashmet's Mamma Sheyeshlam Taivim.
24:27
SPEAKER_00: You want to know what the answer is?
24:28
SPEAKER_00: Why is it different over here?
24:30
SPEAKER_00: Because the asiliyyadeh, we're talking about a case where you already gave it to the kind.
24:33
SPEAKER_00: If you already gave it to the kain, Rashi says it's no different than you stealing uh Vidami Kaman de Kazamine Glime.
24:39
SPEAKER_00: It's like you took his uh they stole his jacket, you already gave it to a specific kind, you're back to the drawing board.
24:44
SPEAKER_00: You're not you it's not that uh any kind can come to you.
24:48
SPEAKER_00: No, the specific kind that you gave it to, and now you uh now you remazak it after you already gave it to him, it belongs to him, just like his jacket belongs to him, and therefore, of course, he's gonna be able to bring you the best in.
24:58
SPEAKER_00: And that's why Milam Shamatan is din, yeah, it's din, that uh he's gonna be taveyu very nicely because he already was the aslyyadi.
25:05
SPEAKER_00: He says, he's the asliyadi, Malambro.
25:07
SPEAKER_00: What's the grace of khidish?
25:08
SPEAKER_00: Why do I need a pasik to tell me mishpat milameid that it's din to teach you he could be tavayu?
25:13
SPEAKER_00: If you already gave it to him, it's his, it's his rash, he said, just like his jacket.
25:16
SPEAKER_00: So why do I need a posik to tell me that he could take you to bezdin for that?
25:19
SPEAKER_00: Of course, it's his and it's his.
25:21
SPEAKER_00: Says the gibberh, I'll tell you why the kidish is.
25:22
SPEAKER_00: Because the asliyadh btivlayu.
25:24
SPEAKER_00: It's not a case where you separated all the matanas and and then gave it to the coin.
25:28
SPEAKER_00: You gave it to you gave him the full animal in its state of teva.
25:32
SPEAKER_00: And he was zecha, or you had this full animal uh that that that that that you put, whatever the case was, he was zeikhe, the matanas out of this animal, but when he got it, it was in its full state of teva.
25:45
SPEAKER_00: Because savar, and you would think it's different because again, because the the matanas weren't separated yet.
25:50
SPEAKER_00: So who said that he is the bylum over those matanas specifically?
25:53
SPEAKER_00: Because Savar Haitana, Matanashlohurma Kamishu Hurmadam, this is a shah sugiya, we know matanish lay hurmu.
25:58
SPEAKER_00: Matanas that weren't separated yet and give it to the client.
26:00
SPEAKER_00: Do we consider it as if it was?
26:02
SPEAKER_00: Do we look at it?
26:03
SPEAKER_00: Let's say he has the whole animal.
26:04
SPEAKER_00: But did he receive the matanas?
26:05
SPEAKER_00: Or no?
26:06
SPEAKER_00: Matana shlai hurmu is not Kemishu Hurmadamin.
26:08
SPEAKER_00: It's not like you already separated them.
26:10
SPEAKER_00: So if this Tana holds Matamashlay Hurma, Kamisha Urmadamin's already separated, then yeah, that's what the Pasik is teaching me.
26:15
SPEAKER_00: That's the Kamash Malan, that Milamishan's din, that even if you didn't separate it physically yet, if you gave it to him in its state of taval, still he was Zah 100%, and he could take you to Bazdin if you're Mazzik that afterwards.
26:31
SPEAKER_00: You have Balabaiz.
26:32
SPEAKER_00: So this is a big veer generally who wouldn't be eligible to collect Leketchik Khopeya.
26:37
SPEAKER_00: And he was uh traveling, so he didn't have all his nichasim with him, and he didn't really have money on him.
26:41
SPEAKER_00: So this Balabai Shayya, it's a klito lekachikhai, and he needed to collect Leketchikhopea because he was uh you possibly didn't have anything to eat to Mayser Ani.
26:49
SPEAKER_00: So Noitel, Sudalach is he's allowed to.
26:55
SPEAKER_00: It says once he gets back and he gets back to his town with his nichasim and his bank accounts, then he has to pay the Anyam back.
27:00
SPEAKER_00: He has to pay the Aniyim back for the Chikhoeah, Mayser Oni, that he took.
27:06
SPEAKER_00: That's a good question.
27:08
SPEAKER_00: I was thinking the same thing.
27:09
SPEAKER_00: I don't know.
27:10
SPEAKER_00: Um but what do we see?
27:16
SPEAKER_00: Laniam Aborishan, yeah.
27:18
SPEAKER_00: Alright, just like we said before, the first kind.
27:19
SPEAKER_00: So yeah, yeah, yeah.
27:20
SPEAKER_00: Right.
27:20
SPEAKER_00: Alma call me the chaiber a khanal the maze of Laniam.
27:28
SPEAKER_00: Yeah.
27:28
SPEAKER_00: So we're so we're basically what do we see clearly over here?
27:30
SPEAKER_00: From the fact that your belezer is mekaiim to pei, so we see that it's considered Mammash Lam Taivim.
27:34
SPEAKER_00: Since he has to pay back.
27:36
SPEAKER_00: So so too, right?
27:39
SPEAKER_00: Right?
27:40
SPEAKER_00: Because if anyone could be Tave, any oni can walk over and be Tave, the first guy that comes could be Tavay, it's Maman Shiyeshlam Taivim.
27:45
SPEAKER_00: So by Kehuna, if you're mazik, Matanas Kehuna, even before you gave it to the Kayin, we should say the same thing that any Kain is going to be able to be Tave you.
27:52
SPEAKER_00: It should be Mamashi Yesh Lam Taivim, and you should be chaib, not like Rhizdah.
27:56
SPEAKER_00: Um Rh Khizdah, Rchizdah answers, Midas Chasidash Shanukhan.
28:00
SPEAKER_00: This dar allaza said, once you get back home, you should pay.
28:04
SPEAKER_00: It's not me din you should pay to teach you that it's mumm and shieslam taiven.
28:07
SPEAKER_00: No, it's me this chasidus that you should pay.
28:09
SPEAKER_00: But Ammar Rabba Rabba says on that.
28:10
SPEAKER_00: Tani Tana Yeshalim.
28:11
SPEAKER_00: The atamrut Midas Khassidh Shanukhan two problems.
28:14
SPEAKER_00: First of all, the Tana said in the Brahsa, Y Shalim.
28:17
SPEAKER_00: Yeshalim sounds like a din.
28:18
SPEAKER_00: And you're telling me that just means Midas Khazidas?
28:21
SPEAKER_00: Yeshalim sounds like it's the din is you have to pay.
28:26
SPEAKER_00: I don't understand the whole question, but the question, you're asking Akasha on Rachdah from Sheetas Rebelezer on Rafchdah?
28:32
SPEAKER_00: The Chachamim in that Mishnah argue on Rebelezer.
28:36
SPEAKER_00: And the Chachamim, we know Yochid Rab and Allah Kirabim.
28:39
SPEAKER_00: What did the Khacham say in the Mishnah?
28:40
SPEAKER_00: We're about to see in a second.
28:41
SPEAKER_00: The Chachamimhol that you're gonna be potter from paying across the board.
28:44
SPEAKER_00: Why?
28:44
SPEAKER_00: Because Ani Haisab Aisas Shah.
28:47
SPEAKER_00: At that point, when you collected it, you were considered a nani.
28:50
SPEAKER_00: You had the din of anani.
28:51
SPEAKER_00: You didn't have your money on you.
28:52
SPEAKER_00: You had the din of anani, and therefore you don't have to pay it back biklaw.
28:55
SPEAKER_00: So you're asking a kasha and of khizda from Shetrazer?
28:57
SPEAKER_00: We bask in like the khachamimlaw and the chahimhol that you were a nani at that time and you don't have to pay anything.
29:01
SPEAKER_00: So what's your kasha?
29:02
SPEAKER_00: Says the Gamar Allah.
29:04
SPEAKER_00: You're right.
29:05
SPEAKER_00: That's why Rubbah says, if there's a kasha over here, then me Seifah.
29:09
SPEAKER_00: I'll ask you a kasha from the sefa.
29:11
SPEAKER_00: That the sefa said, quoted, that he was an ali at that time, and that's why he's not gonna be haired to pay.
29:18
SPEAKER_00: What does that sound like?
29:19
SPEAKER_00: Now you can make a diuk.
29:20
SPEAKER_00: Time of the oniha time of the ani.
29:22
SPEAKER_00: The reason that he's gonna be put up from paying is because he was an ani at that time.
29:25
SPEAKER_00: Ha ashir.
29:26
SPEAKER_00: What if he was an ashir at that time?
29:27
SPEAKER_00: He had a lot of money on him, and Islam decided to take from Maysrani and Lakachikhupaya, and he stole from the Aniim.
29:33
SPEAKER_00: What if he was an Ashir?
29:34
SPEAKER_00: What does that sound like?
29:34
SPEAKER_00: The diuk would be, even according to the Hahamim, Mishalim, he would have to pay.
29:39
SPEAKER_00: And on that we ask a question, says Rabba.
29:45
SPEAKER_00: Why should he have to pay based off the diak we made?
29:47
SPEAKER_00: If he was an ashir at that time, even according to the Chahamim, he should be considered like he was just mazik matanaskiuno, or he ate it, which is the exact case.
29:55
SPEAKER_00: He was an Oshir, he had a lot of money on him.
29:57
SPEAKER_00: And anyways, he went and ate the Lek Chikopeya.
29:59
SPEAKER_00: So why should he be Haiv to pay?
30:01
SPEAKER_00: Of course, like the Dirk we made.
30:02
SPEAKER_00: If anything, it should be the same case of Rivchizda.
30:04
SPEAKER_00: What would Rafhizda tell you in that case?
30:05
SPEAKER_00: Rafhizdah would tell you that uh mazik matanas kiuna, Aisha Achlan, that's the case, Akhlun, he literally ate Matanas Khuna, he should be potter from paying because it's it's Maman Shainla Sha'inlam Taiven.
30:16
SPEAKER_00: So I'm Rukhizdah, Rivchizda.
30:18
SPEAKER_00: And on this Rifkizdah answer is Amida's Khazidh Shanukhan.
30:20
SPEAKER_00: And don't ask me a kasha.
30:22
SPEAKER_00: It says Yeshale, that's Ahmed Middles Chasidus Shanukhan, because this was only a diuk.
30:25
SPEAKER_00: Again, the Khacham said you're potter.
30:28
SPEAKER_00: Mashmah, what was the diat that we made your potter because you were not you were an oni?
30:31
SPEAKER_00: But if you were usher, you would be chaif.
30:33
SPEAKER_00: No, no, don't make that diak.
30:34
SPEAKER_00: Not if you were usher, you would be chaif.
30:35
SPEAKER_00: If you're usher, you would you should probably pay because Amidas Chasid is the right thing to do.
30:39
SPEAKER_00: But are you chaif to pay me din?
30:40
SPEAKER_00: Is it din that you're chaif to pay?
30:42
SPEAKER_00: The answer is no, because your khizd is gonna tell you you're potter because it's mom and sha'in' ta'en.
30:46
SPEAKER_00: Tashmah will try again.
30:47
SPEAKER_00: Mean the balabai shachal pay rais of tvalin, the chain levisha rais of tvallim.
30:52
SPEAKER_00: How do we know that a balabais?
30:54
SPEAKER_00: That ate his paris in a state of tevil before he separated truma, which uh is a terrible thing, but it's uh it's actually a misubadeshamain.
31:01
SPEAKER_00: But we're not focusing on that right now, we're focusing on the Khaishan Mishpat uh aspect of it.
31:04
SPEAKER_00: So he ate it without separating Truma.
31:06
SPEAKER_00: The Truma was supposed to go to the Khan.
31:08
SPEAKER_00: Is he Chaivin out to pay the Kayan?
31:09
SPEAKER_00: That's the question.
31:10
SPEAKER_00: So says the Gemara, Toshma Minana and the Balai Shah Pedrais of Tvalin before he separated the Truma.
31:18
SPEAKER_00: And a levi that got miser, but he ate it all.
31:20
SPEAKER_00: Before he separated the Truma's miser that was supposed to go to the Khan.
31:25
SPEAKER_00: How do we know that he's potter from paying the Kayan?
31:28
SPEAKER_00: And by the way, it's not Potter over here because of Kamalay Midrabine, it's Misabide Shaman.
31:31
SPEAKER_00: There's only Kamalay Midramine generally by uh by Bide Odam, etc.
31:36
SPEAKER_00: But how do I know that he's potter across the board?
31:38
SPEAKER_00: From a Hosh Mishpath perspective, Tamon Laimar Vilay Khalalu Vilay Khalalu Eskochibine israirimu.
31:45
SPEAKER_00: Which teaches me, in the khabain ella mishas.
31:50
SPEAKER_00: When is it considered that it belongs to a qadjbaru, right?
31:56
SPEAKER_00: That it's now truma, it's now a higher level.
32:00
SPEAKER_00: So how do so when is it considered the kayans?
32:03
SPEAKER_00: In the khabin, only once you separated it.
32:06
SPEAKER_00: Once you separated it, then it belongs to the Kains, says the Gemara.
32:10
SPEAKER_00: Okay, I'm Mishash Ramahva Elach, Mia Mishali.
32:12
SPEAKER_00: What does that sound like?
32:13
SPEAKER_00: Now once you did separate it, the deal clearly is that once you did separate it, then you will have to pay if you damaged it or ate it, which is like hash and refchizd, ah, mazik matanas gun.
32:23
SPEAKER_00: It should be like a Vhizda's case of mazik matanas, or you ate them, because in this case, if you separated it or then you didn't give it to the kayan, you ate it, or whatever it is, it's the exact case.
32:32
SPEAKER_00: Why are you gonna be high in that situation?
32:33
SPEAKER_00: says the Gemara Khanami, Da Saliya De Bittiblaya.
32:37
SPEAKER_00: We're talking about a case where you already gave it to the kind.
32:39
SPEAKER_00: You're gonna ask me my Kamash one.
32:40
SPEAKER_00: The Kamash one is you already gave it to the Khan in its state of Tevil.
32:44
SPEAKER_00: You gave it to him in its state of Tevel, and that's why it's Matana, it's uh Maman Shiyeshlain Taiwan, because Savraitana Matana Slay Horma Kamish Urm, because this Tana holds it doesn't matter that you gave it to him in a state of tevil, because it says if we look at it already separated, you gave it to the kind, it belongs to him.
32:59
SPEAKER_00: It's mom and sheeshlaim taivim.
33:01
SPEAKER_00: That's why you would be haived to pay once you already separated it.
33:03
SPEAKER_00: But if you ate it in its state of tevil, then you are going to be then you are going to be pothaj.
33:13
SPEAKER_00: I'm sorry, the whole point over here is that you're gonna be potr.
33:16
SPEAKER_00: The khiddish is that you're potr.
33:18
SPEAKER_00: What what are we gonna answer you according to the Khizdah?
33:21
SPEAKER_00: Again, you're already gave it to the Khan.
33:22
SPEAKER_00: So that's the whole khiddish over here, and it's because of a Josh that you're actually gonna be potr, but you're right, it's not a cash on Rchizdah.
33:27
SPEAKER_00: Maman Shah Inlam Taiven, because over here it's very clearly Mamun Shay Yesh Lam Taiven.
33:31
SPEAKER_00: And that's why in the Dioq, in a case where it was separated, of course, you're gonna be haived to pay the kayin, and we'll hold it here for today, and we're gonna continue tomorrow asking more cashes on Rchizdah.
