Latest / Early Edition with Ryan Bridge / Brad Jacobs: Franchise NZ Chairman and Coffee Club Director on the proposed trespass rules
Transcript
- 0:00Speaker 1: The government's given businesses the power to trespass people from
- 0:03Speaker 1: multiple locations. It's also raised the maximum trespass period from
- 0:07Speaker 1: two years up to three. Brad Jacobs is a franchise
- 0:09Speaker 1: and News Inland chairperson and coffee club co owner with
- 0:12Speaker 1: us this morning. Hey Brad, good morning, Ryan, good morning.
- 0:15Speaker 1: Good to have you on the show. You like the
- 0:18Speaker 1: sound of this. Is it going to make a difference?
- 0:21Speaker 2: Yeah, it certainly will. Obviously. One of the challenges I
- 0:24Speaker 2: guess for franchise groups at the moment is that franchise
- 0:27Speaker 2: businesses are all individually owned, as you know, so there
- 0:31Speaker 2: would be no way at the moment for a group
- 0:33Speaker 2: to be able to trespass someone from multiple locations in
- 0:37Speaker 2: one go. So it would come back to repetition and
- 0:41Speaker 2: multiple franchise's doing the same work over and over again
- 0:44Speaker 2: to be able to achieve the same outcome.
- 0:46Speaker 1: So basically, now, if somebody offends against one franchise franchise e,
- 0:51Speaker 1: then they've sinned against all of them.
- 0:54Speaker 2: That's my understanding of what they're proposing. Yes, so obviously
- 0:57Speaker 2: we haven't seen an exact bill yet or the legislation,
- 0:59Speaker 2: but that's how I understand it.
- 1:01Speaker 1: What about the fine that increasing the maximum fine for
- 1:04Speaker 1: anyone refusing to give their name and address when requested
- 1:08Speaker 1: or giving false information from five hundred dollars to one
- 1:10Speaker 1: thousand dollars. Is that are they saying that's your responsibility
- 1:13Speaker 1: or is that if police are there? What's the story there?
- 1:16Speaker 1: Do you know?
- 1:17Speaker 2: Yeah? Good question. Look, I guess the fines in my view,
- 1:21Speaker 2: remain relatively low, so I'm not sure that they're a
- 1:24Speaker 2: massive deterreent to be honest, While it sounds good, So
- 1:27Speaker 2: they're doubling, they're doubling not necessarily small base. I guess
- 1:31Speaker 2: the key is, yes, you need to be able to
- 1:33Speaker 2: at the moment, you need to be able to have
- 1:35Speaker 2: a lot of details of the person to be able
- 1:36Speaker 2: to actually issue a trespass notice. But again, my uner
- 1:39Speaker 2: standing is that they're working on ways to be able
- 1:41Speaker 2: to reduce that so that if someone does refuse to
- 1:45Speaker 2: give their details, or you may know them by a
- 1:48Speaker 2: common name which may not actually be their legal name,
- 1:51Speaker 2: that there could be ways to be able to still
- 1:53Speaker 2: issue a trespass notice even with that information.
- 1:55Speaker 1: What do you think the fines should be, you know,
- 1:57Speaker 1: if doubling from five hundred one thousand or what ever,
- 2:00Speaker 1: as not the go what should they.
- 2:02Speaker 2: Be I think probably Unfortunately, for some of those repeat offenders,
- 2:06Speaker 2: it wouldn't matter whether it was one thousand, five thousand,
- 2:09Speaker 2: or ten thousand. I'm not sure that they're in a
- 2:11Speaker 2: position to make payment anyway, So I don't know. Doubling
- 2:16Speaker 2: it is certainly a good start, but I don't think
- 2:19Speaker 2: there are massive to terrent.
- 2:20Speaker 1: Unfortunately, in your coffee shop, do you get much abuse
- 2:24Speaker 1: going on because I'm assuming most of the people who
- 2:27Speaker 1: are wanting to steal stuff or going to supermarkets or
- 2:29Speaker 1: to retail stores rather than to a cafe.
- 2:33Speaker 2: Yeah, yeah, absolutely, it'd be our retail members that struggle
- 2:36Speaker 2: more my own personal business. Yes, cafes, we don't have
- 2:40Speaker 2: to trespass people that often in our cafes. No, Fortunately,
- 2:45Speaker 2: it's not a huge problem for us. We certainly, unfortunately,
- 2:48Speaker 2: our team members do get treated unfairly regularly in the cafes.
- 2:52Speaker 2: People get a bit grumpy, but it's not to the
- 2:54Speaker 2: point where you would you'd need to remove someone. In
- 2:57Speaker 2: the CBD, we have four cafe in the CBD, they
- 3:01Speaker 2: do have to face a lot with unfortunately, people on
- 3:05Speaker 2: the streets, homeless people and people with some mental health issues.
- 3:10Speaker 2: Trespassing them sometimes is really just a bit of a
- 3:14Speaker 2: waste of time because unfortunately they don't have anywhere else
- 3:17Speaker 2: to go and so they reappear or they move from
- 3:19Speaker 2: one corner of the city to another. So yeah, it
- 3:22Speaker 2: can be very challenging for our French as these in
- 3:25Speaker 2: the CBD and Auckland in particular.
- 3:27Speaker 1: Interesting Brad, Thank you. Brad Jacobs Franchise New Zealand chairperson,
- 3:31Speaker 1: also co owner of a coffee club.
