- 0:04This is your Morning News update.
- 0:07The House voted 220 to 204 Tuesday to direct the removal of
- 0:12American forces from hostilities with Iran unless Congress
- 0:15authorizes their continued involvement. 7 Republicans
- 0:19joined Democrats. The resolution has not become
- 0:22law and United States operations continue.
- 0:25Also Tuesday, the Congressional Budget Office estimated that the
- 0:29war had cost the Defense Department more than $38 billion
- 0:33through August 1st. IT projects additional costs of
- 0:36two to $3 billion a month, depending on the fighting.
- 0:40The administration has sent the Senate 3 senior Navy
- 0:43nominations. Acting Secretary Hung Kao is
- 0:46nominated for the permanent post.
- 0:48Retired submariners Bill Toady and Richard Breckenridge are
- 0:52nominated for Under Secretary and the Navy's top acquisition
- 0:55job. They have not been confirmed.
- 0:58Belarus has released 25 prisoners following talks with
- 1:02American envoys as Washington eased sanctions on 2 Belarusian
- 1:06companies. In baseball, the Angels beat the
- 1:09Mariners 2 to one. Seattle is now 70 and 82,
- 1:13confirming it cannot finish the season at 500.
- 1:16For the On Air Across America network, I'm Alex Ross.
- 1:30The world is a complicated place.
- 1:32Fortunately, Dave Bowman has opinions, some informed, some
- 1:37inconvenient, and a few that may require supporting
- 1:40documentation, history, politics, and the absurdity of
- 1:44modern life. This is the Dave Bowman Show.
- 1:51Well, good morning, good evening or good afternoon, wherever you
- 1:53are, whatever you do. A lot of things happening in the
- 1:56world today, most of them are far beyond our control, you
- 1:59might say. So perhaps it's time we took a
- 2:01pause and thought about life, thought about the laws of
- 2:05gravity, war, anti-Semitism, free speech.
- 2:11Don't touch that dial. Just try to hear me out for a
- 2:13little while. You can e-mail the show Dave at
- 2:17the Dave bowmanshow.com. You can text us 520-9565, Dave,
- 2:21209-565-3283. Of course, we're
- 2:25online@facebook.com and the Dave bowmanshow.com.
- 2:31So I have no idea. I, I know some of you are
- 2:37wondering and the answer is I don't know nothing.
- 2:41And even if I did know nothing, I wouldn't say anything.
- 2:44So that's all I can say about that.
- 2:47And if you don't know what I don't know nothing about, well,
- 2:52someday you might let me establish my position here
- 2:56before discussing anything else. I find Macklemore and his
- 3:03rhetoric repulsive. I find his presentation of the
- 3:07Israeli Palestinian conflict to be dishonest.
- 3:11He reduces extraordinarily complicated conflicts into crude
- 3:16morality plays. Israel has become the singular
- 3:20victim in his mind. Palestinians become people
- 3:22without political leaders or armed organizations, and Hamas
- 3:26isn't even in his story. I disagree with him.
- 3:30I reject his accusations against Israel, his selective history,
- 3:34and his willingness to be disputed to describe disputed
- 3:37assertations as settled facts. I also recall that in 2014, he
- 3:44performed in a disguise that looked remarkably like medieval
- 3:49Jewish caricatures. His subsequent apology does not
- 3:53require me to forget that he did it, even if I accept his
- 3:58apology. Don't have to forget about it.
- 4:02All that said, Macklemore has a First Amendment right to say
- 4:06stupid, offensive, and morally objectionable things, as do I.
- 4:12The First Amendment was never necessary to protect agreeable
- 4:14speech. It exists precisely because
- 4:16governments cannot be trusted to determine which political
- 4:19positions the public may hear, despite the fact that they want
- 4:23to, and they try each and every day.
- 4:29I will defend Macklemore's right to speak.
- 4:32That doesn't mean I have to agree with him, Doesn't mean I
- 4:35have to buy his music. In fact, I can honestly tell you
- 4:38that I have never consciously listened to anything he has
- 4:41performed. I'm sure I've heard something,
- 4:45but I never said, hey, let's, let's, let's toggle up old
- 4:48Macklemore on the Spotify playlist.
- 4:50There, That's never happened and it never will.
- 4:53I'm not required to attend his concerts.
- 4:55I'm not required to overlook his gross anti-Semitism, nor am I
- 5:02required to provide him with a stage, nor is anyone else.
- 5:06And that distinction is the heart of the whole matter, isn't
- 5:08it? Recently, in case you were
- 5:12unaware, and until this happened, I was not, some dude
- 5:16named Ed Sheeran was on tour. This is what musicians do.
- 5:24And we've had the conversation on what the frock about the
- 5:26problems that these tours are having now and the whole Go
- 5:32Spotify thing and ghost streaming thing and the blue dot
- 5:36issues. We've talked about that.
- 5:38But apparently they Ed Sheeran was on is on tour and Macklemore
- 5:43was with him along with four other groups.
- 5:46Can you imagine sitting through a concert like that?
- 5:48Jesus. At any rate, at a September 4th
- 5:53and 5th series of these conference concerts at MetLife
- 5:56Stadium in New Jersey, Macklemore used the stage to
- 6:01shout from the stage declaring Free Palestine.
- 6:05He of course accused Israel of apartheid and genocide,
- 6:10performed his anthem song supporting the pro Palestinian
- 6:14campus movement. I guess he hasn't gotten that
- 6:16memo yet and used images of Palestinian suffering and
- 6:21political demonstrations. And he argued that Israel and
- 6:26opposition to Zionism are not anti-Semitic.
- 6:31That's, you know, I mean you're entitled to your opinion I
- 6:33guess. Jewish and pro Israeli
- 6:36organizations objected. They argued that Macklemore's
- 6:39presentation vilified Israel, ignored the whole Hamas element
- 6:44of this and used rhetoric and images that Jewish listeners,
- 6:49whoever they may be, reasonably regarded, reasonably regarded as
- 6:53as anti-Semitic. Robert Kraft, who is the owner
- 6:57of the New England Patriots and presumably Gillette Stadium,
- 7:01said, you know what, I don't want this guy at my stadium.
- 7:05Other venue operators reportedly followed Kraft's example, and
- 7:10the promoter of the tour removed Macklemore from the remaining
- 7:12dates rather than cancel the tour, which of course that
- 7:16caused some problems too. Macklemore argues that the
- 7:19accusations of anti-Semitism were used to silence him because
- 7:26his message had reached an enormous mainstream audience,
- 7:29which is arguable. Ed Sheeran said the decision was
- 7:34made by the promoter and the venue owners, not him.
- 7:38He, he wants it very clear that he had nothing to do with it,
- 7:42which is fine 'cause I know a couple of Ed Sheeran songs, but
- 7:49only because they were apparently very popular at one
- 7:52point. Look, Macklemore's accounts of
- 7:56things is radically incomplete. This is not unusual in today's
- 8:00world. Pick one side and and that will
- 8:04be your side. As from when Wise once said to
- 8:07me, a piece of cloth with only one side to it makes for mighty
- 8:10thin material. And Macklemore speaks about
- 8:13Palestinian suffering as though it exists without Hamas's
- 8:17actions on October 7th, decades of failed negotiations, Bill
- 8:22Clinton himself saying, look, they they don't want peace.
- 8:27What do you want to do? Palestinian citizens are
- 8:31suffering. I don't have a problem
- 8:33acknowledging that and that, but that doesn't require me to
- 8:36pretend that Hamas has no responsibility for placing those
- 8:39civilians in danger and prolonging the war.
- 8:43He on the other hand, Macklemore presents this accusation as a
- 8:47verdict. He repeatedly describes Israel's
- 8:50actions as genocide, and that term carries specific legal and
- 8:53historical meanings cannot be treated as an established fact
- 8:57merely because Macklemore said it.
- 9:02When Jewish folks raised legitimate concerns, he simply
- 9:06ignores them, dismisses them, much as we saw the the folks
- 9:10down in Tacoma with the with the, with the brewery.
- 9:13They just really. Well, that doesn't that doesn't
- 9:15play. He claims that the accusations
- 9:18are being weaponized. Are they?
- 9:23Is anybody telling him he can't play his music?
- 9:26Just that he can't play his music at a private venue that
- 9:30doesn't want him? Yeah.
- 9:33It doesn't mean that every accusation, by the way, is
- 9:35false. In 2014, just a reminder,
- 9:39Macklemore appeared on stage wearing a very large prosthetic
- 9:43nose, black wig and a beard. He, of course, denied that this
- 9:47was a Jewish caricature, and he apologized.
- 9:50Air quote. Air quote.
- 9:52But it was pretty obvious what he was trying to do.
- 9:56His present rhetoric also depicts powerful interests.
- 10:00You know, because that's what the Jews do, right?
- 10:03They, they have these private meetings where they decide the
- 10:05world. And he depicts this meeting as
- 10:09what has happened here. Free Palestine, by the way, is
- 10:13not a it's not a policy. It's not a complete policy.
- 10:16Does he support 2 states? Does Israel continue to exist?
- 10:20He never discusses this. Who's in charge in Gaza?
- 10:23What happens to Hamas? What what protects Israel if
- 10:27Israel relinquishes even more territory or military control?
- 10:31He never addresses these things. He has a slogan, but no serious
- 10:36actual answers. And that's the problem, or a
- 10:40problem anyway. Look, the 1st Amendment does not
- 10:44require me to agree with him. It does not also protect only
- 10:52respectable opinions. I'm not the only one has the 1st
- 10:55Amendment right, Neither is Macklemore.
- 10:58We both have it. But popular speech doesn't need
- 11:02constitutional protection. Officially approved speech does
- 11:05not need it at all. The difficult test involves
- 11:08speech that's ignorant, offensive, inflammatory, and
- 11:13wrong. Profoundly wrong.
- 11:15If I sit here and defend his free speech, or defends free
- 11:19speech in general only for people with whom I agree, I'm
- 11:22not defending the principle, I'm defending my own side.
- 11:26Macklemore's views do not become unprotected because I don't like
- 11:30them, because I consider them to be dishonest and anti-Semitic,
- 11:34unless his words satisfy the the recognized legal exceptions.
- 11:38And there are several legal exceptions. 5 I believe that the
- 11:41Supreme Court has come up with true threats, incitement of
- 11:45imminent lawless action, legally actionable defamation.
- 11:50The government can't punish him for expressing them, and I agree
- 11:54with that. But defending his right to say
- 11:57that is not defending, you know, his argument.
- 12:00The distinction must remain clear.
- 12:02Macklemore can say whatever he wants well within those limits.
- 12:06I, in turn, can condemn what he says.
- 12:09Audiences don't have to buy tickets to his shows.
- 12:12And again, blue dot fever is a real thing.
- 12:15Sponsors don't have to pay for this.
- 12:19Jewish organizations can challenge him, and other artists
- 12:23may either defend or criticize him.
- 12:24Which is, of course, what's happening now is we're seeing
- 12:27bit of that. No one is entitled to freedom
- 12:30from social or commercial consequences.
- 12:32Free speech protects the content.
- 12:35It does not decide who wins the argument.
- 12:38And private venues are not the government.
- 12:42So if Gillette Stadium, run by Robert Kraft, decides that they
- 12:46don't want him there, his complaints are pointless.
- 12:53You really want to solve your problem, buy the stadium.
- 12:57Robert Kraft in those stadiums, they're, they're private owners.
- 13:00They have no, there is no First Amendment right to perform at
- 13:03Gillette Stadium or even to remain on the tour.
- 13:05If the if the promoter decides, yeah, this is going to cost me
- 13:08money, He was using someone else's concert, someone else's
- 13:13business arrangements, someone else's audience.
- 13:16Ed Sheeran's fans did not necessarily purchase tickets to
- 13:20see Macklemore and his political demonstration.
- 13:23Venue owners can decide that his appearance is inappropriate or
- 13:26commercially damaging, and that decision is not a constitutional
- 13:31violation, but we still have to consider whether that private
- 13:36power deserves examination or not.
- 13:39This is not government censorship by any way, but
- 13:42coordinated action by major venue owners can substantially
- 13:45restrict an artist's access to audiences.
- 13:48I'm not required to approve of Macklemore to be uncomfortable
- 13:52with what a handful of people deciding that a political
- 13:54position may not be heard in a major venue could be conceived
- 13:59as a problem. Today the excluded speaker is
- 14:03Macklemore. Tomorrow might be me or someone
- 14:08else, a conservative comedian, a Christian musician, or anyone
- 14:12whose position becomes more commercially inconveniently
- 14:16inconvenient. Sorry, making up words here.
- 14:19The First Amendment can't legally bind private venues, but
- 14:25the cultural principle of free speech should still influence
- 14:28how we make those decisions. Macklemore has the right to
- 14:33speak. There's no two ways about that.
- 14:35He does not have the right to someone else's stage.
- 14:39He has the right to say free Palestine.
- 14:41He does not have the right to demand that I agree with him or
- 14:44anybody else. He does not have immunity from
- 14:46criticism or protection from ordinary commercial
- 14:49consequences. Robert Kraft has the right to
- 14:52exclude him from a privately controlled stadium.
- 14:55The public has the right to ask whether his decision was fair,
- 14:58consistent, and proportionate. My defense of Macklemore ends
- 15:03with his freedom to speak does not extend to his argument at
- 15:06all. I find his presentation to be
- 15:09selective, irresponsible, and repellent.
- 15:13I believe his rhetoric encourages hostility towards
- 15:16Israel and Jews while observing the while obscuring completely
- 15:20the responsibility of Hamas. I will oppose those ideas
- 15:25openly, forcefully, and continually.
- 15:28But I will not solve offensive speech by handing anyone the
- 15:32power to decide which political opinions Americans may express.
- 15:37That weapon remains in friendly hands forever.
- 15:40Never. The proper answer to Macklemore
- 15:44is not it's it's not necessarily government silence.
- 15:49How many times do I have to say this, people?
- 15:51The response to bad speech is more good speech, factual
- 15:57rebuttals, historical context, moral clarity, and an
- 16:01unequivocal defense of Israel's right to exist.
- 16:05Macklemore has the right to speak.
- 16:10I have the right to say he's wrong.
- 16:12His argument is repulsive, and I want no part of it.
- 16:16Defending his liberty does not require surrendering my
- 16:21judgement. It requires me to defend the
- 16:24Constitution even when the person in invoking that right
- 16:29flat out makes my skin crawl. Welcome back Plaza Live going to
- 17:15join me 565 Dave, 209-565-3283 is the text machine. e-mail Dave
- 17:19at the Daveboben show.com. Still working out some of the
- 17:22kinks in the the live broadcast stuff, trying to get everything
- 17:28revved up. I think next week is going to be
- 17:31really the the launch point of things, but you'll see that
- 17:35coming. So the House of Representatives
- 17:37approved a resolution late Tuesday directing the removal of
- 17:42U.S. forces from hostilities with Iran unless Congress
- 17:45authorizes their continual involvement.
- 17:49Vote 2:20 to 2047 Republicans joining the Democrats.
- 17:53You heard Alex tell you that in the news.
- 17:57It's the House's third such votes since February 28th.
- 18:02This is not a law. It's a resolution, a resolute.
- 18:07We have resolved that you should do this.
- 18:11Of course, it ignores the reality of the situation, which
- 18:14is that in 1973, Congress gave authority to the president of
- 18:18the United States to do stuff like this.
- 18:21And even the hated President Nixon said, hey, you know what?
- 18:26That's that's probably unconstitutional and Congress,
- 18:33which since 1798 has been divesting itself of anything
- 18:37resembling any actual responsibility decided no, we're
- 18:40going to override that veto and we're going to give the
- 18:42president the right to go to war call.
- 18:47It's not really war because we're but we're going to call it
- 18:49the War Powers Act. He has the powers of war.
- 18:53This goes all the way back to 1798, the cargo of the Brig
- 18:58Aurora, where Congress wasn't sure what to do about the
- 19:04situation with France and the Quasi War with France.
- 19:06And so they actually passed a, a, a law that said to President
- 19:11Adams at the time, hey, you look into this and if you find, quote
- 19:16UN quote, that a state of war exists between US and France,
- 19:19then then that's fine with us. And, and you do whatever you
- 19:21need to do. And of course, John Adams did he
- 19:26found, look, there's a rock and I looked underneath it and there
- 19:29was a war with France. How about that?
- 19:32Of course, by the time they got it all settled out, the war was
- 19:35over. Because it wasn't really a war,
- 19:39I guess. I don't know, wasn't there.
- 19:42I know it had people up in arms. That's it was it was quite the
- 19:46mess. But now we have this War Powers
- 19:49Act that that Congress has used passed in 1973 so that the
- 19:55president can go off and do wars without congressional approval
- 20:01kind of. So again, he's committed the
- 20:06military and, and I think we looked at this couple years ago
- 20:10and it's like 168 uses of the War Powers Act where the, where
- 20:13the presidents of the United States have committed American
- 20:16forces to, to combat operations, which is generally the.
- 20:22Extinction of war, right? It without a declaration of war
- 20:25and without congressional quote UN quote approval.
- 20:28Because once the clock starts to to do it, then I have 30 days or
- 20:3145 days or maybe 90 days or or maybe forever, who knows, maybe
- 20:3610 years like in Vietnam, maybe maybe 8 years somewhere else.
- 20:43Look it it's a confusing mess and it's political theater is
- 20:49what it is. If Congress really wanted to do
- 20:53something about this, they should do something about this.
- 20:56But they don't. They don't really want to do
- 20:58anything about it because they don't really want to be on the
- 21:01record one way or the other come November.
- 21:04This is just a resolution. This doesn't mean anything.
- 21:07It's a resolute. We resolve that the president
- 21:11should pull the forces out and some Republicans in no doubt
- 21:15swing districts who are concerned about the the future
- 21:18of their their election in November decided that, well, I
- 21:23better, I better suck up to my other audience and my other
- 21:26constituents, just like the gal down in southern southern
- 21:30Washington here did with her vote a few weeks ago.
- 21:33It's nonsense. It's political kabuki theater.
- 21:36That's all it is. If Congress really wanted to do
- 21:41something about this and they don't, I want to be clear, they
- 21:44don't care. They don't want to do nothing
- 21:46about it. They can't do anything about it
- 21:48because what are they going to do?
- 21:51They don't, they don't know. They don't know, they don't
- 21:55understand. They don't have a clue what's
- 22:00they're so focused on themselves and getting re electioned that
- 22:04that they can't do anything. Republican Congress hasn't
- 22:08passed a single bit of legislation every every bit of
- 22:11what President Trump has done. Whether you agree with it or not
- 22:14is irrelevant here, but none of it's going to last because it's
- 22:20all been done executively, meaning that as soon as the
- 22:23other party is in charge, they're just going to undo it
- 22:26again. And we're going to go back and
- 22:29forth, back and forth, back and forth.
- 22:30Now the the civil servants love that because then, you know, the
- 22:35people really don't know what's going on because they get to
- 22:39change everything the way they want it.
- 22:40But, but from a governmental standpoint, is that the way that
- 22:45we was, that we were intended to be governed, flopping back and
- 22:48forth between parties and and their agendas?
- 22:51Because nobody can pass a law, Nobody can get where we're
- 22:55supposed to be with this. And more importantly, they don't
- 22:58want to pass a law. They don't want to do this.
- 23:02They want it this way. If Congress really gave anything
- 23:10about this, maybe they'd be holding hearings, maybe they'd
- 23:13be asking what specific military objectives is Congress being
- 23:17asked to support? What exactly are we being asked
- 23:19to pay for $38 billion? They said, I mean, at this
- 23:23point, you know, they used to say a billion here, a billion
- 23:27there, and pretty soon you're talking about real money.
- 23:30And then we had $40 trillion in debt.
- 23:32And it's like, well, what's 38 billion?
- 23:38What specific objective are we being asked to fund?
- 23:42Let me be clear about this. I, I, I, the idea of taking out
- 23:47Iran is attractive to me. I don't trust those.
- 23:49You know this, you've been around me for 25 years.
- 23:52The bad mullahs of, of Tehran need to be taken out.
- 23:56But is this the best way to do this?
- 23:59If you are a member of Congress and you actually oppose the war,
- 24:03what authorization or funding bill have you introduced
- 24:07following a resolution vote? What have you actually done?
- 24:11Look, I don't like the guy Al Green down in Texas.
- 24:14I think he's an ass. But at least he is doing what he
- 24:17says he believes. He's actually passing a bill to
- 24:20force an impeachment vote. If the Democrats are mad at him,
- 24:23it's hysterical. They're furious because they
- 24:25don't want to be on record about this.
- 24:26And Hakeem Jeffries does not want this right now.
- 24:30But he's forcing that vote again.
- 24:33He's a moron. But at least he's doing what he
- 24:36believes. Which of these 220 Congress
- 24:39people that voted for this introduced any legislation
- 24:41whatsoever about the funding of this war and how they're going
- 24:45to do it? If we did pull out right now, as
- 24:50these 220 Congress people have said, what happens?
- 24:55Who protects U.S. forces and shipping?
- 24:58Do you? Do you?
- 24:59Do you honestly think everybody's complaining about
- 25:01gas prices, including me, because I live in Washington
- 25:03state, where our idiot governor tax on an additional buck and a
- 25:06half to every gallon for climate change.
- 25:10But if if the US was suddenly gone tomorrow, what do you think
- 25:15is going to happen to gas prices?
- 25:16Do you think they're going to suddenly plunge down?
- 25:20If you do think that, you're not paying attention to what's going
- 25:24on. You think the Iranians are just
- 25:28going to go, oh, well, the Americans are gone now.
- 25:30So I guess everything's great. Everybody go right on through.
- 25:38Which costs are not being recorded in the CB OS estimate,
- 25:41CBO says may around $38 billion. But look, I, I was an accountant
- 25:46by trade. I, I know what that means.
- 25:49That means the real number is probably closer to 50.
- 25:54Look, folks, Congress enacted the War Powers Act in 1973 after
- 25:59the Vietnam War, which, by the way, was a war but was never
- 26:05declared the intent. The idea was to severely
- 26:10constrain sustained hostilities undertaken without congressional
- 26:14authorization. Both parties and their
- 26:18presidents have disputed the application of it.
- 26:22They've asserted independent commander in chief authority,
- 26:25and they continue to use it even though they might argue that,
- 26:33well, it's it's not, it's not constitutional, but we're not
- 26:36going to stop it because now we're in charge.
- 26:38So we get to use it. Look, the House has voted to end
- 26:43this for the third time, but you'll notice that the war has
- 26:48not stopped. So what exactly did Congress
- 26:52actually do? Same as they always do.
- 26:57Damn all. Are you going to vote for me?
- 27:00Where's my check? Take the time right now.

- 27:09regret. Plausibly live.
