- 0:00Speaker 1: Attorney Harvey Warren stays late in his eighth-floor office, reluctant
- 0:04Speaker 1: to return to the home left empty by his wife's death.
- 0:08Speaker 1: Then a telephone call from a man named Bolster sets
- 0:12Speaker 1: a deadline. He is coming to Warren's office before 10 o'clock.
- 0:17Speaker 1: As the clock advances and the elevator indicator begins its climb,
- 0:21Speaker 1: Warren tries to reach Lieutenant Joe Scarponi of Homicide. On
- 0:26Speaker 1: May 5th, 1949, CBS presented Suspense, Episode 5, Death Has
- 0:32Speaker 1: a Shadow, with Bob.
- 0:34Speaker 2: Hope as Warren.
- 0:35Speaker 1: Alongside William Conrad and Elliot Lewis, Joe Pagano wrote the
- 0:39Speaker 1: script and Anton M.
- 0:40Speaker 3: Leder directed.
- 0:42Speaker 1: We now take you back to the original broadcast.
- 0:55Speaker 2: Now, Autolite and its 60,000 dealers and service stations present Suspense.
- 1:02Speaker 4: Tonight, Autolite brings you Bob Hope in Death as a Shadow,
- 1:14Speaker 4: a suspense play produced and directed by Anton M.
- 1:17Speaker 5: Leder.
- 1:23Speaker 2: Friends, those April showers that bring May flowers have nothing
- 1:27Speaker 2: on an Autolite stay-full battery. Why, the extra water in
- 1:30Speaker 2: an Autolite stay-full battery makes those April showers look like
- 1:33Speaker 2: a drought in the Gobi Desert. Why, an Autolite stay-full
- 1:36Speaker 2: battery needs water only three times a year in normal
- 1:39Speaker 2: car use.
- 1:40Speaker 5: Yes, sir.
- 1:41Speaker 2: An Autolite stay-full battery needs water only three times a
- 1:44Speaker 2: year in normal car use. And in addition, an Autolite
- 1:48Speaker 2: stay-full battery has extra plates for extra power, protected by
- 1:52Speaker 2: fiberglass insulation for stronger life and longer life. Why, in
- 1:56Speaker 2: recent tests conducted according to the Society of Automotive Engineers
- 1:59Speaker 2: life cycle standards, Autolite stay-full batteries gave 70% longer average
- 2:04Speaker 2: life than batteries without all these features. So remember, you're
- 2:09Speaker 2: right with Autolite.
- 2:13Speaker 4: And now, Autolite presents Bob Hope in a tale well
- 2:18Speaker 4: calculated to keep you in suspense.
- 2:26Speaker 3: Don't ever answer a telephone just because you've got nothing
- 2:29Speaker 3: else to do. Just because you're curious. I was sitting
- 2:39Speaker 3: in my big red leather swivel chair. My feet on
- 2:41Speaker 3: the largest mahogany desk money could buy. A bottle of
- 2:44Speaker 3: the best scotch balanced between my special custom-built shoes. Everything
- 2:48Speaker 3: the best. That's the way I like to operate. The
- 2:52Speaker 3: gold lettering across my office window spelling out Harvey Warren,
- 2:55Speaker 3: Counselor at Law. I liked it that way. It had dignity. Yeah,
- 3:00Speaker 3: I had everything. I had a house that rambled for
- 3:03Speaker 3: 14 rooms. I built that house for Lily.
- 3:07Speaker 6: Lily.
- 3:08Speaker 3: She was beautiful. From the top of her auburn hair
- 3:11Speaker 3: to the tip of her pretty little toes. Yeah, I
- 3:14Speaker 3: had it all. I had everything. Till the day my
- 3:17Speaker 3: Lily was murdered. That's why I couldn't stand being home anymore.
- 3:25Speaker 3: I could smell her cologne in every room, the touch
- 3:27Speaker 3: of it on every chair. That's why I was at
- 3:29Speaker 3: the office that night, with nobody but the bottle to
- 3:32Speaker 3: keep me company. And that was the call I should
- 3:37Speaker 3: have never answered. But at night, eight stories up in
- 3:40Speaker 3: an empty office building, that ringing sounded urgent. Like it
- 3:44Speaker 3: was the most important thing in my lonely little world.
- 3:48Speaker 7: Hello?
- 3:48Speaker 3: Warren? Who's this? Oh.
- 3:51Speaker 5: You know who this is.
- 3:53Speaker 3: Yes, Bolster.
- 3:54Speaker 8: No name, stupid. What are you doing at your office
- 3:57Speaker 8: this time of night?
- 3:58Speaker 3: What do you want?
- 3:59Speaker 5: Have you got it?
- 4:00Speaker 3: Well, sure I've got it. It's all ready for mailing.
- 4:03Speaker 3: I'll drop it off when I leave.
- 4:04Speaker 8: Don't bother. I'm going to pick it up tonight.
- 4:07Speaker 3: But I told you I'd mail it.
- 4:08Speaker 8: I changed my mind. I'm coming over. I'll be there
- 4:11Speaker 8: at 10 o'clock.
- 4:12Speaker 3: Well, I can't make it tonight. I'm leaving. I'm just
- 4:14Speaker 3: going out.
- 4:14Speaker 8: You'll make it, all right.
- 4:16Speaker 3: Yeah, but why all of a sudden?
- 4:17Speaker 8: Tonight, War. Warren, don't try anything.
- 4:24Speaker 3: What are you talking about? Why should I try anything?
- 4:27Speaker 3: What could I try?
- 4:28Speaker 8: You could be cute enough to figure out something. You're
- 4:32Speaker 8: that kind of a guy. So, don't try anything.
- 4:37Speaker 3: Something must have gone wrong. All I was supposed to
- 4:41Speaker 3: do was mail him his money. What got into him?
- 4:44Speaker 3: Why would he want to come to my office now,
- 4:46Speaker 3: at night, when the building was empty? Couldn't be just
- 4:49Speaker 3: the money. He was coming for something else. Something else.
- 4:54Speaker 3: But what?
- 5:01Speaker 5: Police Department, Jonathan.
- 5:03Speaker 3: Get me Homicide.
- 5:04Speaker 5: Now, hold on.
- 5:05Speaker 8: It was Homicide, extension 458.
- 5:09Speaker 5: Hello?
- 5:09Speaker 3: Homicide?
- 5:10Speaker 5: This is Homicide.
- 5:11Speaker 3: Is Joe there? Lieutenant Joe Scarponi?
- 5:13Speaker 5: Who's calling?
- 5:14Speaker 3: Harvey Warren.
- 5:15Speaker 5: Oh, hello, Mr. Warren. Hope you've been feeling better.
- 5:18Speaker 3: Well, thanks, Mike. I don't have much time. Would you
- 5:19Speaker 3: get me Joe?
- 5:21Speaker 8: Mr.
- 5:21Speaker 5: Warren?
- 5:21Speaker 3: Where is he?
- 5:22Speaker 5: I don't know.
- 5:23Speaker 3: I've got to get to him.
- 5:24Speaker 5: Something wrong?
- 5:25Speaker 3: You've got to locate him, Mike.
- 5:27Speaker 5: Well, I've got a whole police department, Mr.
- 5:29Speaker 3: Warren.
- 5:29Speaker 5: Just say the word.
- 5:30Speaker 8: What's wrong?
- 5:31Speaker 3: Only Joe. He's the only one that can help me.
- 5:33Speaker 5: Well, he may be calling him.
- 5:35Speaker 3: Then tell him to call me at my office, will you?
- 5:37Speaker 3: Don't make any mistake, Mike. I'm at my office.
- 5:39Speaker 9: I couldn't get it out of my mind.
- 5:50Speaker 3: What had made Bolster switch like that? What had gone wrong?
- 5:52Speaker 3: He must have figured it out and was coming over
- 5:55Speaker 3: for just one thing. To kill me.
- 5:58Speaker 5: Lyon Apartments.
- 5:59Speaker 3: Lieutenant Joe Scarponi, please.
- 6:01Speaker 5: One moment. He doesn't answer.
- 6:11Speaker 3: Well, where can I reach him? He must have left
- 6:12Speaker 3: some kind of a message.
- 6:14Speaker 5: I'm sorry, sir. He hasn't been in all evening.
- 6:16Speaker 3: Well, tell him to call Harvey Warren.
- 6:17Speaker 5: Yes, Mr. Warren.
- 6:18Speaker 3: At my office, understand?
- 6:19Speaker 5: Yes, sir.
- 6:21Speaker 3: He's got my number. Don't make any mistakes. It's my office.
- 6:23Speaker 3: He's got to reach me before 10 o'clock. That's tonight, understand?
- 6:26Speaker 5: I'll tell him, Mr.
- 6:27Speaker 8: Warren.
- 6:27Speaker 5: Thank you.
- 6:30Speaker 3: Madge. I've got to try Madge. He's got to be
- 6:34Speaker 3: in Madge's place. I should have thought of it before. Busy.
- 6:39Speaker 3: That must be Joe. He's got to be there. That's
- 6:41Speaker 3: Joe trying to get me. I've got to wait. I
- 6:44Speaker 3: have to give him a chance to get through. Why
- 6:48Speaker 3: doesn't it ring? Why doesn't he call? Can't wait. Six, nine, four.
- 7:01Speaker 7: Hello?
- 7:02Speaker 8: Madge, baby?
- 7:02Speaker 2: Oh, hello, Warren.
- 7:04Speaker 7: What's this sudden devotion?
- 7:05Speaker 3: Oh, Madge, let me talk to Joe, and don't tell
- 7:07Speaker 3: me he's not there.
- 7:07Speaker 7: Of course he's not here, Warren. What's the matter with you?
- 7:10Speaker 3: Madge, I gotta find him.
- 7:11Speaker 7: Well, I am expecting him.
- 7:13Speaker 10: When?
- 7:14Speaker 1: Soon.
- 7:14Speaker 3: Don't give me double talk, Madge.
- 7:15Speaker 10: When?
- 7:16Speaker 7: We've got a date.
- 7:16Speaker 8: Ten o'clock.
- 7:17Speaker 3: Ten o'clock. That's too late, Madge.
- 7:19Speaker 7: What's the matter, Warren?
- 7:20Speaker 3: Where can I reach him? Where can I find Joe? Well,
- 7:22Speaker 3: did He's not there.
- 7:24Speaker 7: We'll call homicide.
- 7:25Speaker 3: He's nowhere, Madge.
- 7:26Speaker 7: What's wrong, Warren?
- 7:27Speaker 3: There's no time to explain. Help me find him, please.
- 7:29Speaker 7: I'll do what I can.
- 7:31Speaker 3: At my office. Don't forget it. My office. Before ten.
- 7:33Speaker 3: I kept on calling. Everywhere. Every bar he'd ever had
- 7:43Speaker 3: a drink. His favorite restaurants. Even the Turkish bath where
- 7:46Speaker 3: he played handball and got his rub down. Joe was nowhere.
- 7:49Speaker 3: I looked at my watch. It said 9.31. The clock
- 7:53Speaker 3: on the wall showed 9.35. Now I wasn't even sure
- 7:55Speaker 3: of the time. I couldn't afford to be wrong about
- 7:59Speaker 3: the time.
- 8:02Speaker 7: At the tone, the time will be 9.35 and 10 seconds.
- 8:09Speaker 3: The clock on the wall was right. There wasn't much time.
- 8:12Speaker 3: Even if I get a hold of Joe, it'd be
- 8:13Speaker 3: too late. My mind was starting to play tricks. Starting
- 8:16Speaker 3: to tie my insides up in a hundred little knots.
- 8:19Speaker 3: Suppose Bolster got here early. Suppose he got here before
- 8:22Speaker 3: ten and no Joe. I got up in a panic.
- 8:24Speaker 3: My shirt was soaked wet to my back. I could run, yeah.
- 8:28Speaker 3: I could get away while it was still time. But
- 8:30Speaker 3: then Bolster would really know something was wrong. Maybe he
- 8:33Speaker 3: wasn't going to kill me. Maybe he was just coming
- 8:35Speaker 3: for his money. I had to get rid of the hysteria.
- 8:38Speaker 3: Had to get a hold of myself. No use playing
- 8:41Speaker 3: guessing games. I opened the door.
- 8:44Speaker 3: I was going to leave. I wasn't going to be
- 8:46Speaker 3: a sitting duck for a guy like Bolster. At that
- 8:49Speaker 3: time of night, just one elevator was in use. It
- 8:51Speaker 3: was directly opposite my office door. The indicator over the
- 8:55Speaker 3: door flashed numbers when the car was running. I went
- 8:57Speaker 3: to press the button to signal for the night man.
- 9:00Speaker 3: Before I could press it, the car started up. Somebody
- 9:04Speaker 3: was coming up. I wanted to run. I didn't know where.
- 9:07Speaker 3: I was on the top floor. My eyes went to
- 9:09Speaker 3: the ceiling. Down the end of the hallway, there was
- 9:11Speaker 3: a spiral ladder that led into a trap up through
- 9:13Speaker 3: the ceiling. Must have been the opening of the roof.
- 9:15Speaker 3: I started to run for it. I stopped.
- 9:17Speaker 5: Silly.
- 9:18Speaker 3: Went all the time. There was a stairway going down.
- 9:21Speaker 3: I ran for the exit sign and ducked into the stairway.
- 9:23Speaker 3: Down one flight and I smashed right into it. A
- 9:25Speaker 3: steel gate spread like an accordion across the bottom landing.
- 9:29Speaker 3: The gate they always fasten in place at nine o'clock. Trapped.
- 9:33Speaker 3: I was trapped. And then... I just stood there. Everything quiet.
- 9:39Speaker 3: What happened at the elevator? Then I heard the door open. Downstairs,
- 9:48Speaker 3: right below. It didn't come up to the eighth. It
- 9:52Speaker 3: was the night man letting off the cleaning woman. I
- 9:55Speaker 3: walked back up the steps. The light on the indicators
- 10:00Speaker 3: the fifth floor. Then the indicator started flashing again. It
- 10:05Speaker 3: was going down. Now was my time to signal the
- 10:07Speaker 3: night man while he was still in the car. Before
- 10:10Speaker 3: I had a chance, the telephone began to ring. It
- 10:12Speaker 3: was coming from my office. Keep ringing, Joe. I'm coming.
- 10:15Speaker 3: Just don't stop ringing. Hello?
- 10:18Speaker 2: Hello, Joe?
- 10:18Speaker 5: Hello?
- 10:21Speaker 3: That's right. Are you calling... Who?
- 10:26Speaker 7: Oh.
- 10:27Speaker 3: Right number, girly. Wrong party. I looked at the clock.
- 10:31Speaker 3: It was no use. Too late. Even if he did call,
- 10:34Speaker 3: I started to go. I saw the bottle on the table.
- 10:38Speaker 3: I had to take another drink. I felt a little better.
- 10:46Speaker 3: Now I had to get out.
- 10:48Speaker 5: Hello?
- 10:48Speaker 2: Hello?
- 10:50Speaker 3: Look, girly, there's no Sammy at this number.
- 10:52Speaker 7: I know, but you sounded kind of lonely. I'm lonely, too.
- 10:56Speaker 3: Forget it, will you? Don't tie up my phone, understand?
- 10:59Speaker 7: Sure, I know. You waiting for a call, too?
- 11:01Speaker 3: Get off my number. I don't want this phone tied up.
- 11:03Speaker 7: Sure, sure, I understand. But just in case, wine should
- 11:06Speaker 7: take my.
- 11:07Speaker 3: I started to go and wasn't going to stop, not
- 11:09Speaker 3: for anything. Then I realized it might be too late.
- 11:13Speaker 3: Suppose he was on his way up. Suppose he was
- 11:15Speaker 3: watching the entrance. Why did that girl call back? What
- 11:19Speaker 3: did she want? Then I knew it was a trick.
- 11:22Speaker 3: A typical hoodlum trick. Bolster was using that girl to
- 11:25Speaker 3: check up on me. Playing it cat and mouse. His
- 11:28Speaker 3: way of holding me to the phone. Making sure while
- 11:31Speaker 3: he was on his way up. A trick. Twenty minutes
- 11:35Speaker 3: to ten. The clock kept staring at me. The minute
- 11:38Speaker 3: hand beating its way around the circle. Twenty minutes to ten.
- 11:43Speaker 3: That girl again checking up on me. Who did Bolster
- 11:46Speaker 3: think he was kidding? He knew I had to answer
- 11:51Speaker 3: that phone.
- 11:52Speaker 5: Hello. Warren?
- 11:54Speaker 3: Joe, you don't know how I've been trying to get
- 11:56Speaker 3: you all night.
- 11:56Speaker 5: Yeah, I know.
- 11:57Speaker 8: Your line's been busy.
- 11:58Speaker 3: Oh, come right over, Joe.
- 11:59Speaker 8: What's the matter?
- 12:00Speaker 3: There's no time to talk. Just get here.
- 12:02Speaker 8: Oh, well, I got a date, Warren. It's on my
- 12:04Speaker 8: only night off. You know how mad she is.
- 12:06Speaker 3: Joe, this is a matter of life and death.
- 12:08Speaker 8: Whose life?
- 12:09Speaker 3: My life.
- 12:10Speaker 5: Oh, well, I'll be right there.
- 12:12Speaker 3: Before 10, Joe. It's got to be before 10.
- 12:31Speaker 4: For suspense, Autolite is bringing you Bob Hope in radio's
- 12:35Speaker 4: outstanding theater of thrills, Suspense.
- 12:49Speaker 3: Say, what happened to your face?
- 12:52Speaker 2: Lose an argument with a revolving door? No, Hap, I
- 12:55Speaker 2: was at a big community picnic. Oh, sat in the
- 12:57Speaker 2: sun too long, huh? No, I sat at the speaker's table.
- 13:00Speaker 2: In fact, that's how... Well, it was like this. There
- 13:03Speaker 2: was an audience, so I jumped up and said... An
- 13:05Speaker 2: autolite stay-full battery needs water only three times a year
- 13:08Speaker 2: in normal car use.
- 13:09Speaker 3: Why, as a matter of fact, I did.
- 13:11Speaker 2: I said that dandy, dynamic, dependable autolite stay-full battery has
- 13:15Speaker 2: a camel hanging on the ropes back in a corner
- 13:18Speaker 2: when it comes to capacity... Yes, sir. An Autolite stay-full
- 13:21Speaker 2: battery needs water only three times a year in normal
- 13:24Speaker 2: car use.
- 13:24Speaker 3: But how do you phase?
- 13:25Speaker 2: I told him an Autolite stay-full battery has extra plates
- 13:28Speaker 2: protected by fiberglass insulation for longer life and stronger life.
- 13:32Speaker 3: You said this during the picnic supper? Not only that.
- 13:35Speaker 2: I told him in addition how in recent tests conducted
- 13:37Speaker 2: according to the Society of Automotive Engineers Life Cycle Standards...
- 13:42Speaker 2: Autolite stay-full batteries gave 70%, yes, 70% longer average life
- 13:48Speaker 2: than batteries without all these features. And when I got through,
- 13:51Speaker 2: do you know, Hap, they crowned me with a garland
- 13:54Speaker 2: of leaves. Yeah, but that doesn't explain a bunch of things. Oh,
- 13:56Speaker 2: I forgot to mention the leaves were poison ivy.
- 13:59Speaker 8: Oh, and I forgot to mention ear suspense.
- 14:04Speaker 4: And now, Autolite brings back to our Hollywood soundstage Bob
- 14:09Speaker 4: Hope as Warren in.
- 14:12Speaker 3: Death has a shadow. A tale well calculated to keep
- 14:16Speaker 3: you in suspense. My eyes were drawn to the clock again.
- 14:26Speaker 3: I watched the minute hand cutting down the time. If
- 14:29Speaker 3: Joe came with a squad car, he'd be here in
- 14:31Speaker 3: a matter of minutes. But it was his night off.
- 14:34Speaker 3: Maybe he wouldn't be able to get a cab. I
- 14:39Speaker 3: took another drink just for luck. I opened the door
- 14:43Speaker 3: and listened for the elevator. Didn't take long. I went
- 14:46Speaker 3: into the hallway. The light on the indicator was flashing. Two, three, four.
- 14:53Speaker 3: Maybe it wasn't Joe. Maybe it was Bolster. How was
- 14:56Speaker 3: I to know? I ducked into the stairway landing, watching. Joe!
- 15:07Speaker 10: Joe!
- 15:10Speaker 3: Warren, are you nuts? Oh, I've never been so glad
- 15:12Speaker 3: to see you to see anybody.
- 15:13Speaker 10: You know better than that, coming up from behind a guy. Say,
- 15:17Speaker 10: you look terrible.
- 15:18Speaker 3: What's wrong?
- 15:21Speaker 1: Well?
- 15:24Speaker 3: Don't close the door, Joe. Why? When he comes, we
- 15:27Speaker 3: can hear the elevator.
- 15:30Speaker 5: Okay.
- 15:31Speaker 3: Now, what's it all about? He's due here at 10 o'clock.
- 15:35Speaker 3: He's a killer.
- 15:36Speaker 8: Who is a killer?
- 15:38Speaker 3: I have to start from the beginning. You don't have
- 15:39Speaker 3: much time. But you won't understand unless I explain. Okay,
- 15:43Speaker 3: but don't start dramatizing. It's a quarter to ten. Well,
- 15:46Speaker 3: we have to start with the day Lily was murdered.
- 15:48Speaker 3: Remember I called you? And when you came, you found
- 15:50Speaker 3: me sitting in the bedroom looking at her, her head
- 15:52Speaker 3: hanging almost to the floor, the rest of her doubled
- 15:55Speaker 3: up in the bed, her auburn hair gently suspended like
- 15:59Speaker 3: someone spun fine silk around where the bullet went through
- 16:01Speaker 3: that lovely head. She was so beautiful. I was sitting
- 16:05Speaker 3: there looking at her, and the sounds tumbling around my
- 16:08Speaker 3: head The photographers, the newspapermen, flashbulbs, all like a bad dream. Look,
- 16:21Speaker 3: can't you take the hair away from her face? I'll
- 16:23Speaker 3: cut your head off if you touch that, buddy. Let's
- 16:25Speaker 3: see the gun. Show him the gun, Mike. It's a gun.
- 16:28Speaker 5: What's there to see?
- 16:29Speaker 3: Well, we understand it's Warren's gun.
- 16:30Speaker 10: You understand nothing until it's official.
- 16:32Speaker 6: The coroner said it happened this morning, about four hours ago.
- 16:35Speaker 3: Now, how about that, Lieutenant Scarponi? Then quote him.
- 16:37Speaker 5: Don't ask me.
- 16:38Speaker 7: Mike.
- 16:39Speaker 10: Yeah?
- 16:39Speaker 3: They had enough. Get him out of here. Oh, wait
- 16:41Speaker 3: a minute. Not so fast. I want one more shot
- 16:42Speaker 3: of Warren. Put that drink back in your.
- 16:44Speaker 5: Hand, Mr.
- 16:45Speaker 3: Warren, please. Now, look, fella, don't overdo it. This is
- 16:47Speaker 3: no private affair, Lieutenant Scarponi. Why don't you lay off? Well,
- 16:51Speaker 3: put the drink back in his hand. Take it the
- 16:52Speaker 3: way it is and get out. We'd like to do
- 16:54Speaker 3: it the way it happened.
- 16:55Speaker 6: He had a drink in his hand.
- 16:56Speaker 10: It wouldn't look so good, Lieutenant, if the paper said
- 16:58Speaker 10: you were covering up for a lifelong friend.
- 17:00Speaker 3: Mike, get him out of here.
- 17:02Speaker 5: Now, wait a minute. Wait a minute.
- 17:09Speaker 3: Well, this is some mess, Warren.
- 17:12Speaker 9: Yeah.
- 17:13Speaker 3: How did it happen? Oh, I loved her, Joe. You
- 17:16Speaker 3: know how I loved her? More than anything in the world.
- 17:20Speaker 3: Now look at her.
- 17:22Speaker 5: Yeah.
- 17:23Speaker 3: You know we've been fighting. Last night was the worst
- 17:26Speaker 3: that ever happened. So I ran out of the house.
- 17:29Speaker 3: What time? Well, right after dinner. I went down to
- 17:32Speaker 3: the Silver Grill and had a couple. You can check
- 17:35Speaker 3: on that.
- 17:35Speaker 7: Uh-huh.
- 17:36Speaker 3: Then they built more and had a few more. And
- 17:39Speaker 3: I remember calling a cab on Seventh and Hill.
- 17:42Speaker 5: And then.
- 17:43Speaker 3: So help me, Joe. That's all I remember. What do
- 17:46Speaker 3: you mean, that's all you remember? Well, that's all. I
- 17:48Speaker 3: drew a blank. We've known each other all our lives, Joe.
- 17:51Speaker 3: Did you ever know me to black out?
- 17:53Speaker 10: That's not like you, Warren.
- 17:55Speaker 3: But that's what happened. I don't remember anything. Until when?
- 17:59Speaker 3: Until I woke up and called you. And where did
- 18:01Speaker 3: you wake up? Right here in the bedroom.
- 18:03Speaker 8: In bed?
- 18:04Speaker 3: No, in this chair. Just like I am now. I
- 18:08Speaker 3: saw Lily... Just like she is now. Blood on the floor.
- 18:13Speaker 3: I know she's done for, my beautiful Lily. Then I
- 18:16Speaker 3: get up to get a bottle. And I sit down
- 18:19Speaker 3: again in this chair. I take one good long drink.
- 18:23Speaker 3: I reach for the phone on the night table. I
- 18:26Speaker 3: call you. I've been sitting here since. With a bottle.
- 18:31Speaker 7: Mm-hmm.
- 18:33Speaker 3: And the gun, is it yours, Warren? You know that
- 18:37Speaker 3: gun is mine. It was on the floor. It's the
- 18:39Speaker 3: gun that killed her. Joe, do you think I did it? Well,
- 18:43Speaker 3: I don't have to tell you how it looks. I
- 18:45Speaker 3: know how it looks. What I want to know is,
- 18:46Speaker 3: do you think I did it? I'll have to book you, Warren. Oh,
- 18:50Speaker 3: I couldn't have killed her, Joe. You know I couldn't.
- 18:52Speaker 3: I loved her too much. I couldn't have killed her, Joe.
- 18:55Speaker 3: Before we get to.
- 18:55Speaker 10: Trial, Warren, for your own good, you'd better start remembering.
- 19:08Speaker 3: Seems like a long time ago, Joe. I just couldn't
- 19:10Speaker 3: remember what I'd been doing there in the bedroom after
- 19:12Speaker 3: Lily was murdered. Couldn't even remember how I got there.
- 19:14Speaker 10: Two minutes ago, you were scared to death. You were
- 19:16Speaker 10: trying to reach me every place in town.
- 19:18Speaker 3: Well, I'm here. You remember that day in the courtroom?
- 19:20Speaker 3: What's that got to do with the killer who's on
- 19:22Speaker 3: his way up here? Quite a bit, Joe. That's what
- 19:24Speaker 3: I'm coming to. But before he comes, you've got to
- 19:26Speaker 3: know the whole story. I know the whole story. Not quite.
- 19:29Speaker 3: Think back to that day in court, Joe. You remember
- 19:32Speaker 3: how bad it looked for me? All the newspapers were
- 19:34Speaker 3: sure I was done for. Because I couldn't remember where
- 19:36Speaker 3: I was when she was killed. And I knew I
- 19:38Speaker 3: was somewhere else when it happened. But all the evidence
- 19:41Speaker 3: piled against me. Everybody's sure I was a dead duck.
- 19:44Speaker 3: You imagine court at my side and the prosecuting attorney
- 19:47Speaker 3: pressing the jury for the full penalty.
- 19:55Speaker 11: And the only defense offered by the accused is that
- 20:00Speaker 11: he doesn't remember. He pleads not guilty, claiming temporary insanity.
- 20:10Speaker 11: Forgetfulness as so conveniently happening to the accused cannot be
- 20:17Speaker 11: construed as insanity. The state must therefore ask that the
- 20:22Speaker 11: full penalty according to the law.
- 20:25Speaker 4: Matt.
- 20:26Speaker 10: Get me some water.
- 20:29Speaker 2: What a poor man.
- 20:31Speaker 3: He just couldn't take it.
- 20:32Speaker 4: This court will keep order.
- 20:34Speaker 2: Order!
- 20:35Speaker 10: You all right now, Warren?
- 20:36Speaker 8: You feel better?
- 20:37Speaker 7: Joe.
- 20:39Speaker 3: I didn't do it. Yeah, sure, sure. Joe, I remember now.
- 20:45Speaker 3: I remember. I didn't do it. I was out of
- 20:47Speaker 3: town when it happened. I was out of town. I
- 20:55Speaker 3: was out of town when Lily was murdered, Joe. And
- 20:57Speaker 3: we proved it, remember? And I was acquitted. Like a
- 21:00Speaker 3: bad dream, wasn't it?
- 21:01Speaker 10: Look, for the last time, Warren, is this what you
- 21:03Speaker 10: call me up to your office for? What's this got
- 21:05Speaker 10: to do with somebody coming over here to kill you?
- 21:07Speaker 3: Yeah, like a bad dream.
- 21:09Speaker 10: Okay, Warren, I've got a date with Madge. Oh, no, Joe,
- 21:12Speaker 10: you've got a date with the killer. Then who is
- 21:13Speaker 10: the killer?
- 21:14Speaker 3: I'll never forget that day they acquitted me. I walked
- 21:17Speaker 3: out of court a free man. I know you weren't guilty.
- 21:19Speaker 3: Your alibi proved you weren't guilty. I know all that. Yes, Joe,
- 21:23Speaker 3: but you don't know. I was guilty. What did you say?
- 21:29Speaker 3: I was guilty. You're losing your mind, Warren. You're nuts.
- 21:33Speaker 3: If I'm nuts, what does that make you? Makes sense, Warren.
- 21:35Speaker 3: Lily thought I was nuts, too. Smart little woman. Thinking
- 21:38Speaker 3: she could make a sucker out of me. She was
- 21:39Speaker 3: going to leave me. Take half of all I had.
- 21:42Speaker 3: That's what she thought.
- 21:43Speaker 10: How did you kill Lily that morning when you were
- 21:45Speaker 10: in Glendale? I know you were in Glendale because your
- 21:48Speaker 10: alibi proved it.
- 21:49Speaker 3: It was Lily who gave me the idea how to
- 21:50Speaker 3: do it. You know how beautiful she was? Every Thursday,
- 21:53Speaker 3: the maid's day off, she stayed in bed, slept the
- 21:55Speaker 3: clock around, taking care of her looks. I began figuring. Lily,
- 21:59Speaker 3: all day alone. Lily in bed. All I had to
- 22:02Speaker 3: do was hire somebody to kill her while I was
- 22:03Speaker 3: out of town. Then the guy coming up here... That's right,
- 22:07Speaker 3: is the killer. A three-time loser and very tough. I
- 22:10Speaker 3: gave my gun to do it with him. That's all
- 22:11Speaker 3: there was to it. He's the man you want, Joe.
- 22:14Speaker 3: He's on his way up here to kill me. Instead
- 22:16Speaker 3: of doing that, you'll arrest him and clear your books
- 22:18Speaker 3: on the Lily case.
- 22:19Speaker 5: So.
- 22:20Speaker 10: This is why it was so important for me to
- 22:22Speaker 10: get here, huh?
- 22:23Speaker 3: You have to admit it was neat, getting myself pinched,
- 22:25Speaker 3: faking the blackout, stacking the evidence against myself and forcing
- 22:28Speaker 3: you to bring me to trial. I never had a
- 22:30Speaker 3: blackout in my life, but it got me off. Great law,
- 22:34Speaker 3: that double jeopardy. Puts you on the spot, though, doesn't it, Joe?
- 22:38Speaker 3: You know I'm guilty, but there's nothing you can do
- 22:40Speaker 3: about it. The law says I can't be tried twice
- 22:42Speaker 3: for the same crime. You see, Joe, I happen to
- 22:45Speaker 3: be one of those lawyers who knows his law.
- 22:48Speaker 5: Yeah. Yeah.
- 22:49Speaker 10: You've always been at the head of the class. Never
- 22:52Speaker 10: worked too hard to get there. Just by looking over
- 22:55Speaker 10: the next guy's shoulder and using him was the smart way.
- 23:00Speaker 3: Yeah, Kitty, very neat. I knew you'd be a good
- 23:03Speaker 3: sport about it.
- 23:03Speaker 10: Maybe I'm just another dumb cop to you. Well, I
- 23:07Speaker 10: don't like anybody making a sucker out of me. Especially
- 23:10Speaker 10: a guy who's supposed to be my good friend.
- 23:12Speaker 3: Where are you going?
- 23:13Speaker 10: You got a date with this killer who's due here
- 23:15Speaker 10: any minute. Well, I got a date with my girl.
- 23:17Speaker 10: Good night, Warren. We're both gonna keep our dates. Joe,
- 23:20Speaker 10: what are you trying to do?
- 23:21Speaker 3: You're a cop. You've got to pick him up. He's
- 23:23Speaker 3: a killer, Joe. I can pick him up after 10 o'clock,
- 23:25Speaker 3: can't I? Oh, you can't leave me, Joe. You can't
- 23:27Speaker 3: leave me here alone. I don't like your company. Oh,
- 23:31Speaker 3: he's gonna kill me, Joe. He's gonna kill you.
- 23:33Speaker 10: Now, why should he do that to a guy who
- 23:35Speaker 10: pays so well for what he buys?
- 23:37Speaker 3: Well, I'm the only one who knows he fired that gun.
- 23:40Speaker 5: Are you gentlemen all through for the night? Yeah, I'm
- 23:43Speaker 5: all through.
- 23:44Speaker 3: He's gonna stay. I'm going down.
- 23:46Speaker 5: Well, step in. Stay where you are, Warren.
- 23:47Speaker 3: You can't leave me.
- 23:48Speaker 5: Let go of my arm.
- 23:49Speaker 2: Joe.
- 23:50Speaker 3: Close the door, mister. I said close the door. Joe,
- 23:53Speaker 3: he's gonna kill me. Joe.
- 23:56Speaker 8: Hello, Warren.
- 23:59Speaker 3: What? Bolster. It was Bolster standing there and leering at me. Joe,
- 24:05Speaker 3: he's here. Joe.
- 24:07Speaker 5: Shut up.
- 24:09Speaker 3: Don't do that again. What? Where did you come from?
- 24:12Speaker 6: Well, you don't think I'd ever use a front door,
- 24:14Speaker 6: do you? They build these places with fire escapes, you know. Now,
- 24:21Speaker 6: into your office.
- 24:23Speaker 3: I started walking. I had to do something. Him right behind.
- 24:26Speaker 3: Then I made a break for it. Into the office.
- 24:30Speaker 3: Then I saw the butt of his gun smash through
- 24:32Speaker 3: the window. And then Bolster's hand reached through and unlocked
- 24:37Speaker 3: the door. Oh, you're pretty cute. Boaster, you're not going
- 24:49Speaker 3: to do anything. You want your money. Don't you want
- 24:53Speaker 3: your money?
- 24:53Speaker 6: Oh, yeah, yeah.
- 24:55Speaker 3: The money comes first. Well, it's in one of these drawers.
- 24:59Speaker 3: You know, you told me to do it with your gun.
- 25:01Speaker 3: I don't remember which drawer.
- 25:02Speaker 6: I couldn't figure it out why a guy should want
- 25:05Speaker 6: me to plant his gun.
- 25:06Speaker 3: That's strange. I was sure. Warren, where's the money? I'm
- 25:12Speaker 3: trying to find it.
- 25:13Speaker 8: Don't stall.
- 25:14Speaker 3: It was a white envelope.
- 25:15Speaker 6: You know, I didn't figure until you went to trial
- 25:17Speaker 6: and they acquitted you.
- 25:18Speaker 3: That's when I began to worry. So many white envelopes.
- 25:21Speaker 6: But I still wasn't sure until tonight when I got here,
- 25:25Speaker 6: when I see what you've been up to.
- 25:28Speaker 8: Find that dough.
- 25:30Speaker 3: I'm trying.
- 25:31Speaker 6: I misplaced it. And then, then it hit me. You
- 25:34Speaker 6: was free and I was liable. No more tricks.
- 25:38Speaker 5: It should be. Find that dough.
- 25:40Speaker 3: Here. Here it is.
- 25:42Speaker 6: On a desk.
- 25:43Speaker 5: Lay it down. Now turn around.
- 25:49Speaker 3: Don't you want to see if it's all here?
- 25:51Speaker 5: Turn around.
- 25:52Speaker 3: Like a dumb six-year-old kid, I turned around. It was
- 25:59Speaker 3: the funniest sensation. Hearing the shot. Feeling the panic. But
- 26:05Speaker 3: nothing happened. I turned around. Bolster's eyes started to roll.
- 26:10Speaker 3: His mouth opened like he had something to say. And
- 26:12Speaker 3: then he dropped.
- 26:18Speaker 8: No, it didn't happen to you, Warren.
- 26:20Speaker 3: Joe.
- 26:21Speaker 10: The elevator opposite your door and the broken window, you
- 26:24Speaker 10: can thank them both.
- 26:26Speaker 3: You're a very funny guy, Joe. That's some game you played.
- 26:30Speaker 3: Is he dead? He's dead. Hey, what are these for?
- 26:35Speaker 3: I'm holding you for murder. Murder? How can you be
- 26:38Speaker 3: so dumb? I was acquitted, remember? You can't try me again.
- 26:42Speaker 3: I'm talking about this murder. Are you crazy? I didn't
- 26:45Speaker 3: shoot Bolster. I didn't even have a gun.
- 26:47Speaker 10: I thought you were one lawyer who happened to know
- 26:49Speaker 10: all about the law. But didn't you know that it
- 26:52Speaker 10: makes no difference who shot him? The two of you
- 26:55Speaker 10: were committing a felony. And the law says all accessories
- 26:58Speaker 10: to a felony are equally responsible for all acts resulting
- 27:01Speaker 10: from the felony.
- 27:03Speaker 3: Unquote. But Joe, including homicide, Warren, including homicide. I don't
- 27:09Speaker 3: know all about the law like you, Mr. Harvey Warren.
- 27:14Speaker 3: I only know just enough to get by. Let's go. Joe,
- 27:20Speaker 3: wait a minute. Joe, I think I'm going to faint.
- 27:25Speaker 3: I'm going to black out, Joe.
- 27:27Speaker 6: Wait.
- 27:28Speaker 3: You see, I don't remember a thing, Joe. So help me, Joe.
- 27:33Speaker 3: I don't remember.
- 27:51Speaker 4: Thank you, Bob Hope, for a splendid performance.
- 27:54Speaker 3: And thanks for the memory. Suspensefully you sat while I
- 27:58Speaker 3: have been at bat.
- 27:59Speaker 2: And now it's time to talk about our product, and
- 28:02Speaker 2: that's that.
- 28:02Speaker 3: Skinny Wilcox, you sing, too, while I swan.
