- 0:10OK, Jay Fallon here. This is the slippery slope.
- 0:15Now I want to go through a video.
- 0:17This is what's Senator Thorpe. It was a when Senator Thorpe.
- 0:22Lydia Thorpe. I don't agree.
- 0:24I don't particularly like since Lydia Thorpe, but she was
- 0:29talking to asking questions to the, what's her name, the
- 0:36minister for Indigenous Affairs, Senator McCarthy, the Labour
- 0:42minister for Indigenous Affairs, Senator McCarthy.
- 0:47So she was talking to her, asking her some questions during
- 0:50Question Time in Parliament. We're going to have a look at
- 0:53this video. There's parts of it.
- 0:56Look, I actually agree partly with with what Senator Thorpe is
- 1:00saying, which is, you know, I don't agree with anything she
- 1:04says generally. But partly what I agree with is
- 1:08we do have a problem here in Australia and I've spoken about
- 1:10this before when it comes to a bail, bail issues and also
- 1:15holding young people in custody, holding them.
- 1:19I'm, I'm not against holding them.
- 1:21I think they should be held. We shouldn't be granting bail
- 1:25for a lot of the circumstances that we are granting bail for.
- 1:28However, children shouldn't be held in watch houses, shouldn't
- 1:31be children shouldn't be held in prisons that are made for
- 1:35adults. However, with the, with the new
- 1:39bail laws, with the restrictions that we have, we see in all
- 1:44these States and territories that children are being held in
- 1:47watch houses and it's a it's a big problem.
- 1:50Anyway, let's have a look at this, this questioning here with
- 1:53Senator Thorpe and McCarthy and just want to go through what
- 1:58what they're saying and what I think the real issue is.
- 2:02My question is for the Minister for Indigenous Australians.
- 2:06You recently met with state and territory Indigenous affairs
- 2:09ministers about the huge number of unsentenced children being
- 2:14held in prison around this country where we know their
- 2:17human rights are being abused. But despite your best efforts
- 2:22with these meetings, we know state and territory governments
- 2:25are moving backwards. Just this week, your Labour
- 2:29colleague in Victoria, Premier Jacinta Allen, announced she's
- 2:34reviewing the bail laws that have just been brought in so she
- 2:37can hold more kids in prison unsentenced.
- 2:42Why are state governments ignoring you?
- 2:46Thank you, President, and I thank Senator Thorpe for her
- 2:48question. Clearly, as we've said in the
- 2:51Senate on many occasions that the area of justice is a state
- 2:56and territory issue, but the senator is correct.
- 2:59President, when we did meet in November in Perth, I did meet
- 3:03with all Indigenous Affairs Ministers as well as the
- 3:06Coalition of Pete who represent around 800 Aboriginal
- 3:11organisations from across the country along with my Co Chair
- 3:15Pat Turner. And what we did do at that
- 3:18Ministerial Council President is call on every minister at that
- 3:23table to go back to their cabinet and to look at the issue
- 3:27of remand. We are deeply troubled around
- 3:31the rising rates of remand in this country, especially with
- 3:34our youth and the overcrowding that's taking place.
- 3:38And it's not just with our youth across the other jurisdictions.
- 3:42I'm also very concerned about the area that I come from in
- 3:46terms of the NT. So in terms of the question
- 3:49around whether the ministers have responded, that has been
- 3:53sent off to the ministers in terms of sorry, a letter has
- 3:57been sent off to the ministers following up on where they are
- 4:00at with it, and that is something that both Pat Turner
- 4:03and myself are following very closely.
- 4:05Great. Another letter, numerous legal
- 4:08experts told the Children's Justice Inquiry that your
- 4:12government could enforce standards on states to protect
- 4:16the human rights of children. You can use external affairs
- 4:21powers and funding agreements like we see in health and
- 4:24education. Why does your government keep
- 4:26saying there's nothing concrete you can do to protect children
- 4:30when clearly you can? Well, I certainly reject from
- 4:34the outset that our concern for children and our rules around
- 4:39children. In terms of the question that
- 4:41you put, Senator Thorpe, you may not have seen, but just a few
- 4:45weeks ago we did announce the Interim Children's Commissioner
- 4:49for First Nations children across the country, and
- 4:52certainly we want to see the successful applicant for that
- 4:57position announced very soon. So we are making endeavours, but
- 5:01we do recognise that the role and the Care and protection of
- 5:04Children Act across each state and territory jurisdiction is a
- 5:09state and territory jurisdiction matter.
- 5:11So the role of the First Nations Children's Commissioner is to do
- 5:16precisely that in terms of the areas that Senator Thorpe is
- 5:19raising. Will you tell the Prime
- 5:21Minister, minister and attorney General to use the legal powers
- 5:27and leverage we know you have to uphold our international human
- 5:32rights obligations and protect children from ongoing abuse?
- 5:37Or will we just see more chats and meetings that go nowhere?
- 5:41That's all we hear from you. OK, so a bit of Question Time
- 5:47there, Senator Thorpe and Minister for Indigenous Affairs
- 5:52McCarthy. Listen, my my mate take away on
- 5:54all of this. For one, I I do agree there is
- 5:58an issue with children being held being held in in these
- 6:02places. I've seen watch House and places
- 6:04that are not made for children and it does in my opinion, and I
- 6:09think the opinion of a lot of other people, a lot of them are
- 6:12so called experts. But anyway, it does violate
- 6:16human rights. The, the problem that I have
- 6:20with all of this, even though I do agree with some of the
- 6:22sentiment that Lydia Thorpe is saying.
- 6:26And I, I think it's disgusting what the, the government's doing
- 6:29and how they're allowing this to happen.
- 6:31However, when you look at what they're saying, she's talking to
- 6:33the federal minister for Indigenous affairs.
- 6:36Obviously she's doing kind of similar to what Almight, what's
- 6:41his name? The previous Prime Minister did
- 6:44Scomo, remember, everyone talked about, hey, are you going to
- 6:48bring in these rules for the mandates?
- 6:50And he sat there and said, well, this is a state and government
- 6:52state, a state and territory issue.
- 6:55The federal government has no intentions of doing this.
- 6:58And then he sat by while the state and the territories
- 7:02brought in some of the harshest mandates that we that the whole
- 7:06that we've seen across the globe, some of the harshest.
- 7:10And then he sat there and said, well, my hands are clean.
- 7:13My hands are clean. I haven't done anything.
- 7:15The federal government hasn't done anything.
- 7:18But, you know, just blamed everyone else.
- 7:19So they could have done everything.
- 7:20So all I'm saying is when it comes to human rights
- 7:24violations, and obviously the human rights violations are
- 7:29happening, I think within watch houses, standing up and pushing
- 7:34for the federal government to do something is not going to help
- 7:37because they don't particularly want to help.
- 7:39They don't want to take responsibility, but neither
- 7:42should they. And we shouldn't be expecting
- 7:44them to take responsibility. In my opinion, we should.
- 7:48We place far too much responsibility.
- 7:51We give them far too much power. We we need to take back the
- 7:56power. And what I'm saying with take
- 7:58back the power is take responsibility for where you are
- 8:03as an individual. When it comes to Indigenous
- 8:05issues and children being locked up, the problem really kind of
- 8:10starts back at home. We've had the breakdown of
- 8:13family. We've had mothers who don't
- 8:16particularly care about their children, unfortunately.
- 8:18OK, a lot of them, I saw it when I was in the police.
- 8:20A lot of them would rather be out doing other things.
- 8:23You know, as soon as they give birth, we get money.
- 8:26We get given money for, for having a child.
- 8:31Actually, if you if you abort, I put that video up the other
- 8:33week. If you abort your child in a in
- 8:37a late term abortion, you will still collect over 400 or $4000
- 8:42in payments from the government. It's disgusting.
- 8:46So we should stop for one, giving people money for having
- 8:49children. There shouldn't be like a
- 8:50reward. If you, if you want to help
- 8:53support families, well, you can support, you can still supply
- 8:56money in other ways, but by maybe making things cheaper or
- 8:59giving them credit so they can buy, you know, help with the
- 9:02support like you can still buy nappies or things like that.
- 9:05You can, you can get, but not just giving cash.
- 9:08That should be off the table straight away.
- 9:11But we need to take responsibility for our own
- 9:14actions and stop placing the burden and giving the power to
- 9:19government. But when we rely upon the
- 9:22government, all we're doing is we keep, we keep creating like a
- 9:29self professing, a self perpetuating prophecy.
- 9:33This is why I think people like McCarthy and Thorpe, I don't
- 9:37think they're, I don't think they really want to get to the
- 9:40bottom of the issue. If they were really concerned
- 9:44about indigenous issues, they would be looking at OK, the at
- 9:48the grassroots problem. This is what's happening.
- 9:51We've seen the decay of the family units over decades now.
- 9:57We have families that don't care for their children, fathers that
- 10:00don't take any responsibility for the children, fathers that
- 10:03don't work to make a living. We have mothers who don't take
- 10:06responsibility for their children, mothers who don't work
- 10:09or or or who don't stay home and support their children.
- 10:12People don't pay their own way. What was it that Paul said if
- 10:18you don't work, you don't eat? This is my opinion.
- 10:22This is the mindset we need to be taking.
- 10:25If you don't work, you're not going to eat.
- 10:28OK, If you don't work, but you're just going to spit their
- 10:30children, you're not going to get cash in your bank account.
- 10:34That just doesn't happen. People need to take
- 10:36responsibility, and this is the problem with people like Thorpe
- 10:39and McCarthy. They don't particularly want to
- 10:41see the problems stopped, the grassroots problems stopped
- 10:46because they are perpetuating the problem, continuing on with
- 10:51the problem. They continue attacking the
- 10:53government saying well, we need more funding.
- 10:54We need more funding because it helps their own personal
- 10:57funding. It gives them the grievances to
- 11:00keep going out and shouting to the public, it's all the
- 11:03government's fault, rolling up the people.
- 11:05It's all the government's fault. If it's the government's fault,
- 11:07if only the government would give us more money, if they're
- 11:09only the government would give us this, if only the government
- 11:12would give us that, then we could fix all the issues.
- 11:14But the government cannot fix the problem.
- 11:18It cannot fix the problem. First off, 100% as you know, I
- 11:22will always say we need God. But secondly, God gave everyone
- 11:29the ability to decide for themselves and to make their own
- 11:33decisions. If nothing changes.
- 11:35I said I had that episode ages ago.
- 11:37If nothing changes, then nothing changes.
- 11:38If you're looking at your life and you just, you know, you're
- 11:42just constantly in trouble with the law, you're constantly
- 11:44making bad decisions, you're just in a rust and you cannot
- 11:47get anywhere. You need to make the decision to
- 11:50bring about changes in your life.
- 11:52If all you're seeing is yet my granddad, my granddad, he was,
- 11:56you know, on the dole. He never worked.
- 11:57He never did anything. He never amounted to anything in
- 11:59his life. He's just whatever.
- 12:02My mother's exactly the same. My father's exactly the same.
- 12:05My brother's exactly the same. You need to think as a child, I
- 12:09need to change. I need to do things a little
- 12:11differently unless or I'm just going to have the same problem.
- 12:16But the same thing is for McCarthy and Thorpe.
- 12:19All they keep saying sprouting off is the same.
- 12:25They get the answers are always exactly the same.
- 12:27Well, it's the government's responsibility.
- 12:29The government should be doing this.
- 12:30The government should be giving us more money.
- 12:32No, the government should not be giving us more money.
- 12:34The government should be giving less money.
- 12:38Less money you can support in different ways without giving
- 12:42cash. OK, Give less responsibility,
- 12:47give the people back the responsibility, take care of
- 12:50yourselves, ourselves, not rely on government.
- 12:55We should have learnt this during the plan Damic.
- 12:59Like I said, the government, the government doesn't really care
- 13:03about us. The government as far as I can
- 13:05see as I can tell my believe the government has people who are in
- 13:09there for their own interests. I think this is what's happening
- 13:13with Thorpe and people like McCarthy.
- 13:15They're in there for themselves. That's why they're not attacking
- 13:19the problem at the roots. That's why they're not talking
- 13:22about the problem at the at the root.
- 13:24That's why they're not focusing on, hey, families are falling
- 13:27apart. Families have fallen apart.
- 13:29This is the issue. This is where we can fix it.
- 13:32We could stop, we could prevent children from going to prison in
- 13:36the 1st place, and then we wouldn't even have to be talking
- 13:39about funding. We wouldn't have to be talking
- 13:41about bail for children, but they don't want that.
- 13:45They just want more funding, more money.
- 13:47Just keep perpetuating the problem.
- 13:50How is it that Australia before, before Captain Cook, before the
- 13:56English came here, there was roughly 500 and something 550
- 14:02Indigenous countries separate little provinces, OK, across the
- 14:07nation. How is it that you heard it on
- 14:10the video? McCarthy just said there's 808
- 14:14hundred Indigenous organisations.
- 14:16How do we have 800 organisations representing Indigenous people
- 14:20in Australia when there was initially only 500 and something
- 14:25separate countries, Indigenous countries in Australia anyway.
- 14:30And sure, as I know, not all of those countries are thriving and
- 14:35have a real representation anyway.
- 14:38So there shouldn't be 800 there. That's what I mean by they they
- 14:42make the problem worse, but all they want is the money because
- 14:45it helps them individually. We have too many of these
- 14:48corporations that have been set up and they are funnelling the
- 14:51money for themselves. They're not really helping the
- 14:54people on the ground. They're not helping the
- 14:56children, they're not helping the families.
- 14:58They're not educating the people because they don't really want
- 15:02change. They just want the money for
- 15:05themselves. But getting back to it, stop
- 15:10relying on the government and don't be surprised when people
- 15:14like the federal minister there for Indigenous affairs says, oh,
- 15:17well, it's a state and territory issue.
- 15:19They're the ones. That's exactly what exactly what
- 15:22Scomo did with the plan, blaming, blaming them for the
- 15:27mandates. And that's what they're doing
- 15:29now. It's always, well, it's someone
- 15:30else's fault, someone else's fault.
- 15:32They're happy to take our taxes and I don't know about you, but
- 15:36I pay freaking way too much in taxes.
- 15:39They're happy to take our tax money, happy to spend it on
- 15:42rubbish because it's all about lining their own pockets.
- 15:45We give them way too much, way too much power.
- 15:48Way too much power if we all took responsibility for our own
- 15:51actions and show them that we don't need a big government.
- 15:56We should be cutting back on the bureaucracy in this country.
- 15:59Anyway, that's all my opinion. You let me know what you think.
- 16:02If there's any indigenous people out there, I'd love to know what
- 16:04you think. My name is Jay Fallon.
- 16:08Thanks for listening to the Slippery Slope.
