- 0:00Speaker 1: I have to step in here and request that mister
- 0:02Speaker 1: brooksby instructed to stop making comments under his breath. This
- 0:05Speaker 1: witness is very clearly having an emotional and difficult time testifying,
- 0:09Speaker 1: and she doesn't need to hear.
- 0:10Speaker 2: That speas she can't hear anything I'm saying.
- 0:14Speaker 3: Mister Brooks and mis are very good in this courtroom.
- 0:20Speaker 4: Hi everyone, I'm Kevin, and this is just thought. Lounge
- 0:23Speaker 4: Jtail is the true crime channel that delivers serious, well
- 0:26Speaker 4: balanced coverage of the cases that really make you think. Today,
- 0:30Speaker 4: we're taking a look at the shocking and tragic events
- 0:33Speaker 4: that took place at the annual Christmas Parade in Waukesha, Wisconsin,
- 0:36Speaker 4: on the twenty first of November twenty twenty one. Paradegoers
- 0:41Speaker 4: watched in shock and horror as a red suv traveling
- 0:44Speaker 4: at an estimated forty or even fifty miles per hour,
- 0:48Speaker 4: came barreling down Main Street in the historic downtown core
- 0:51Speaker 4: of the small Milwaukee suburb. The sound of the marching band,
- 0:55Speaker 4: chatter and laughter was quickly overtaken with screams from onlook
- 1:00Speaker 4: and calls for help as the vehicle drove through the
- 1:03Speaker 4: parade procession without stopping in the chaos, the driver escaped,
- 1:08Speaker 4: but not for long. A rapid and straightforward investigation pieced
- 1:12Speaker 4: together the events almost all caught on camera. Yet this
- 1:16Speaker 4: case still culminated in one of the most bizarre and
- 1:19Speaker 4: unpredictable trials in recent memory. This is the shocking case
- 1:25Speaker 4: of the Christmas Parade in the trial of Daryl Brooks.
- 1:29Speaker 4: Let's take a look. For nearly sixty years, on the
- 1:43Speaker 4: Sunday before American Thanksgiving, the town of Waukesha, Wisconsin, near Milwaukee,
- 1:48Speaker 4: has held its annual Christmas Parade. Local businesses, community groups,
- 1:53Speaker 4: and associations make up the parade lineup. In twenty twenty one,
- 1:57Speaker 4: this included the Varsity cheer Club, marching bands, the Old
- 2:01Speaker 4: Car Club, and the Dancing Grannies, to name just a few.
- 2:05Speaker 4: At the very end of the parade, of course, was
- 2:07Speaker 4: a special appearance from Santa Claus. The festivities on the
- 2:10Speaker 4: twenty first of November twenty twenty one began as they
- 2:13Speaker 4: did in any other year. The theme was Comfort and Joy.
- 2:17Speaker 4: Children handed out candy, families lined to the streets in anticipation.
- 2:22Speaker 4: The parade itself commenced around four pm. Just after four
- 2:28Speaker 4: thirty pm, parade attendees spotted a red SUV traveling quickly
- 2:32Speaker 4: on a blocked off road, heading in the direction of
- 2:35Speaker 4: the parade procession that had passed by only moments before.
- 2:38Speaker 4: After breaking through barricades, the vehicle had taken a right
- 2:41Speaker 4: turn onto main Street, where witness said it rebbed its
- 2:44Speaker 4: engine before accelerating into the parade route. Witnesses recounted the
- 2:49Speaker 4: rapid speed of the vehicle. Others noticed that it was honking.
- 2:52Speaker 4: Some commented that the vehicle appeared to be veering from
- 2:55Speaker 4: right to left in a kind of zig zag pattern,
- 2:58Speaker 4: either to avoid those in its path or to target them.
- 3:01Speaker 4: The scene was chaotic. It was unclear gunfire was heard
- 3:06Speaker 4: in the vicinity of the vehicle. This was later determined
- 3:09Speaker 4: to be law enforcement firing at the suv in an
- 3:12Speaker 4: attempt to stop it. In the chaos, some parade attendees
- 3:16Speaker 4: registered only the noise of the shots and thought that
- 3:19Speaker 4: it came from the red suv out into the crowd.
- 3:22Speaker 4: After traveling several blocks, the vehicle approached a group of
- 3:25Speaker 4: parade participants rapidly from behind. The vehicle did not stop.
- 3:38Speaker 5: It kept going all the way down the block to
- 3:42Speaker 5: People's Park.
- 3:42Speaker 6: The stoplight and continued straight through it. It's a little
- 3:45Speaker 6: bit difficult to process, you know, just especially how fast
- 3:48Speaker 6: everything went when we were downtown, you know, with you
- 3:52Speaker 6: think in hindsight about what response you could have to
- 3:54Speaker 6: stop the guy, and it's just, you know, even if
- 3:58Speaker 6: I was right in front of it would have been
- 3:59Speaker 6: hard to stop.
- 4:03Speaker 4: Law enforcement, emergency personnel and bystanders rushed to the assistance
- 4:07Speaker 4: of those who had been struck by the vehicle. In
- 4:10Speaker 4: the aftermath that there was chaos and confusion. People were
- 4:13Speaker 4: uncertain whether they had witnessed a deliberate act or an accident.
- 4:17Speaker 4: Belongings were abandoned along the sides of the street as
- 4:20Speaker 4: people rush to either assist or for a safe place.
- 4:24Speaker 4: Doorfronts along Main Street opened up to hundreds of people
- 4:27Speaker 4: on the street who rushed inside. Many people could be
- 4:30Speaker 4: heard calling out for their family members.
- 4:33Speaker 1: Is absolute chaos, people screaming, this doesn't happen here, like
- 4:37Speaker 1: I don't understand why. I really don't understand why. It's
- 4:42Speaker 1: just kids having a good time for Christmas, and then
- 4:44Speaker 1: this suv comes fairly through.
- 4:47Speaker 4: There were five parade participants that died at the scene,
- 4:52Speaker 4: tamer durand fifty two had been marching with the Milwaukee
- 4:55Speaker 4: Dancing Grandy's for the first time. She worked as a
- 4:58Speaker 4: teacher and was a chaplain at the Waukash Memorial Hospital. Virginia.
- 5:02Speaker 4: Ginny Sorensen, seventy nine, volunteered to carry a banner at
- 5:05Speaker 4: the Waukesha Christmas Parade. She was a registered nurse and
- 5:08Speaker 4: also a member of the Dancing Grannis. Another member of
- 5:12Speaker 4: the group, Leanna Lee Owen, was seventy one years old.
- 5:15Speaker 4: She was from Kudahee, Wisconsin, and worked as an apartment manager.
- 5:19Speaker 4: She left behind two sons Wilhelm Hospital at the age
- 5:23Speaker 4: of eighty one, was the oldest victim of the Waukesha
- 5:25Speaker 4: Christmas Parade crash. He was at the parade supporting his wife, Lola,
- 5:30Speaker 4: who was a dancing Granny as well. Jane Kolick, fifty two,
- 5:34Speaker 4: had marched with a Citizen's Bank float. Jane had been
- 5:37Speaker 4: described as a loving, beautiful, and charismatic mother, grandmother and
- 5:41Speaker 4: friend to so many. There were sixty two individuals with
- 5:45Speaker 4: additional injuries, including eighteen children who were sent to hospital.
- 5:52Speaker 4: The red Ford Escape was discovered abandoned by the driver
- 5:55Speaker 4: a few blocks away from the parade route in the
- 5:57Speaker 4: driveway of a house. The neighbor next door said the
- 6:00Speaker 4: suv first drove through his backyard and side swept a
- 6:03Speaker 4: car in his driveway. The driver of the suv was
- 6:06Speaker 4: seen leaving the vehicle. He was wearing a gray sweatshirt,
- 6:09Speaker 4: blue jeans, and sporting dreadlocks. Security cameras across the neighborhood
- 6:13Speaker 4: captured the man's movements. He hid for a time in
- 6:16Speaker 4: a child's playhouse, where he discarded his gray sweatshirt, perhaps
- 6:20Speaker 4: in an attempt to disguise himself. Now in a red
- 6:23Speaker 4: T shirt. The man was easily spotted on subsequent cameras
- 6:27Speaker 4: as he made his way through the neighborhood, roughly a
- 6:29Speaker 4: half mile away from the carnage on Main Street. As
- 6:33Speaker 4: the victims of the incident were cared for and rushed
- 6:36Speaker 4: off to hospital, law enforcement mobilized across the area to
- 6:40Speaker 4: seek out the driver of the red suv. Despite the
- 6:45Speaker 4: proximity of the parade to the homes a half mile away,
- 6:48Speaker 4: news of what had occurred did not immediately reach the residence.
- 6:52Speaker 4: Daniel Ryder, who'd been away on a hunting trip and
- 6:54Speaker 4: was watching football when the crash occurred, said he had
- 6:57Speaker 4: no idea about what had just happened. At just after
- 7:00Speaker 4: five pm, a man came to his door, shaking from
- 7:02Speaker 4: the cold. He was captured on Daniel's doorbell camera.
- 7:06Speaker 2: Hey kid, I'll call some I'll call it uber and
- 7:10Speaker 2: i'll post me waiting for it over here.
- 7:11Speaker 7: But I don't know when it's coming.
- 7:12Speaker 4: Can you call it for me please? It had been
- 7:15Speaker 4: only twenty minutes since the suv had torn through the
- 7:17Speaker 4: parade route barricades, killing five people instantly and injuring dozens more.
- 7:22Speaker 4: Daniel invited the man inside and gave him a jacket,
- 7:25Speaker 4: made him a sandwich, and let him use his phone. Outside. However,
- 7:30Speaker 4: he could see police culminating on the street and he
- 7:32Speaker 4: became nervous. Daniel asked the man to leave, which he did,
- 7:36Speaker 4: but after another day porphoned the police. The man began
- 7:39Speaker 4: to pound on the door again, claiming to have left
- 7:42Speaker 4: his id inside.
- 7:44Speaker 8: Hyde, why V.
- 7:52Speaker 9: Thank you?
- 8:06Speaker 10: I can see your hands up, hands up, heads up.
- 8:19Speaker 8: Here.
- 8:21Speaker 4: The man was arrested and brought in for questioning. His
- 8:24Speaker 4: driver's license, which was found in his pocket, identified him
- 8:27Speaker 4: as thirty nine year old Darryl Brooks. Also in his
- 8:31Speaker 4: pocket was a key to the wrecked for escape abandoned
- 8:34Speaker 4: off of the Parade Road, which was registered in the
- 8:36Speaker 4: name of his mother, Don Woods.
- 8:40Speaker 1: We're no longer looking for a suspect, Gilfil. We do
- 8:43Speaker 1: have a person interesting custody at the moment, but this
- 8:46Speaker 1: is still a very fluid investigation.
- 8:49Speaker 4: Daryl told investigators that a friend had driven him to
- 8:52Speaker 4: Waukesha in his car. There, he met with his ex girlfriend,
- 8:55Speaker 4: Erica Patterson, with whom he shares a teenage daughter. The
- 8:59Speaker 4: two spoke brief and then he left, he said on foot.
- 9:03Speaker 4: Darryl denied driving the red SUV.
- 9:06Speaker 5: I'm trying to be as open and honest with you
- 9:08Speaker 5: as I can be. You know I'm Christian too, and
- 9:12Speaker 5: believe me, I'm not perfect, and neither are you. And
- 9:16Speaker 5: I'm not calling you a terrible man. I'm not saying
- 9:19Speaker 5: you were out yesterday hunting and just let me finish.
- 9:22Speaker 5: But you did not walk to that house. You did
- 9:25Speaker 5: not walk to that house. You did not come here
- 9:29Speaker 5: in a Tankian. You didn't you know you did not
- 9:33Speaker 5: come out here in a Tankia.
- 9:36Speaker 9: Okay.
- 9:36Speaker 5: You've got a key in your pocket to your car,
- 9:41Speaker 5: your mom's name, okay, and that he works for that car.
- 9:49Speaker 5: For the love of God, markets, for yourself, for your family.
- 9:55Speaker 5: You know what happened yesterday for the people. Tell me
- 9:58Speaker 5: what happened well with the car being with your mom's car,
- 10:07Speaker 5: you're driving goofy. People call in. You drove out of
- 10:09Speaker 5: there in your mom's car, the red car. You're driving
- 10:12Speaker 5: a little silly, probably because your pet. You met up
- 10:15Speaker 5: with Eric in the car at the park. Initially, I
- 10:18Speaker 5: believe you told us the gas station.
- 10:20Speaker 11: I have the.
- 10:22Speaker 5: Red Ford Escape. She got in, You talked, and what
- 10:27Speaker 5: you're telling me seems pretty consistent that there was nothing
- 10:29Speaker 5: physical between the But you met her in the car.
- 10:35Speaker 5: I didn't put my hands, but you met her in
- 10:37Speaker 5: the car. What's going on?
- 10:40Speaker 8: Man?
- 10:41Speaker 5: Asking you a question? You were out there. Some people
- 10:45Speaker 5: said you were driving kind of grease. We've got reports
- 10:48Speaker 5: of it. You got the key, you got the car,
- 10:53Speaker 5: Did you take the car? Did your mom give me
- 10:55Speaker 5: the car? I know you know what car I'm talking about.
- 10:59Speaker 5: I just want to know, so some people.
- 11:06Speaker 12: Car driving bit around it. I know what you're saying.
- 11:08Speaker 12: All I'm saying is these. All I'm saying is these
- 11:11Speaker 12: We all been straight up with each other. You knew
- 11:15Speaker 12: it was more to what you was asking me yesterday,
- 11:21Speaker 12: did that what he's playing? That what hexplaining the FBI.
- 11:26Speaker 5: And all that. Right, they're not here today. So if
- 11:30Speaker 5: it's that big a deal, you don't see him.
- 11:32Speaker 12: Here today, Krent.
- 11:35Speaker 5: We've been we've been just messing the car.
- 11:41Speaker 1: We've been cool, man the whole time.
- 11:43Speaker 12: If I did something, if I did something down here,
- 11:47Speaker 12: but do you see him here today?
- 11:48Speaker 5: They're not here today.
- 11:49Speaker 12: But but y'all lied to me. Man, you may it
- 11:52Speaker 12: seem like they just come for no reason.
- 11:54Speaker 5: Well, here's the thing, d out.
- 11:56Speaker 12: And I'm like, what if I if it's some day.
- 11:58Speaker 5: For a minute, pabia, because you have lied to us
- 12:05Speaker 5: as well, because you came out here in the Red
- 12:08Speaker 5: Force game. That is what you came out here, had
- 12:13Speaker 5: the key.
- 12:18Speaker 4: Overnight, law enforcement continued to interview Daryl Brooks. They found
- 12:22Speaker 4: that he had an extensive criminal history, already across multiple states,
- 12:27Speaker 4: beginning with substantial battery charges against him made in Milwaukee
- 12:30Speaker 4: County back in nineteen ninety nine. He had arrested for
- 12:34Speaker 4: drug abuse as well as various violent incidents. In November
- 12:37Speaker 4: two thousand and six, Darrow was convicted of statutory sexual
- 12:41Speaker 4: seduction after impregnating a fifteen year old girl in Sparks, Nevada,
- 12:46Speaker 4: he was required to register as a sex offender. In
- 12:49Speaker 4: the following years, he would repeatedly be caught disobeying these
- 12:52Speaker 4: registration laws. In two thousand and seven, while in custody
- 12:56Speaker 4: in Reno, Nevada, Darrow was interviewed for a documentary about
- 13:00Speaker 4: methamphetamine addiction called Crystal Darkness. In the interview, Darryl speaks
- 13:05Speaker 4: about his goals to be a good father before being
- 13:08Speaker 4: caught up in addiction.
- 13:12Speaker 2: I didn't think about no, I got this, I got
- 13:15Speaker 2: this beautiful kid. Who's who's going without my time? I
- 13:22Speaker 2: thought I would just be this wonderful father. This's just
- 13:26Speaker 2: be greatest dad ever.
- 13:28Speaker 11: You know.
- 13:28Speaker 2: The vision is just like I'm gonna give him everything
- 13:33Speaker 2: that I didn't have. But then it's like reality setting.
- 13:41Speaker 2: You actually become the drug, not even human being. Basically,
- 13:50Speaker 2: That's that's how I felt like I wasn't I wasn't
- 13:55Speaker 2: a human anymore. I was just something something vow disgusting, despicable, hocky,
- 14:09Speaker 2: god go on. I can use a lot of words,
- 14:11Speaker 2: but as that's what I became, is really what I became.
- 14:19Speaker 4: A few years later, in twenty eleven, and back in Wisconsin,
- 14:23Speaker 4: Daryl was charged with resisting an officer during a traffic stop.
- 14:27Speaker 4: During the stop, he turned on his car and put
- 14:30Speaker 4: it in drive. The officer said he feared Daryl Brooks
- 14:34Speaker 4: was going to run him over. By twenty twenty one,
- 14:37Speaker 4: Daryl had spent over twenty years in and out of
- 14:40Speaker 4: jail in Wisconsin, Nevada, and Georgia. But he also crucially
- 14:46Speaker 4: had a long history of mental illness, first seeking treatment
- 14:50Speaker 4: at the age of twelve, Daryl's mother, Dawn, has stated
- 14:53Speaker 4: that he suffers from bipolar disorder and a personality disorder.
- 14:58Speaker 4: Without his medication, she described him as explosive.
- 15:04Speaker 9: I'm in here, Darryl slowly slipping for the past two months. Shouting,
- 15:12Speaker 9: is acting out, is throwing chairs, is destroying things.
- 15:16Speaker 8: It's all of the bob.
- 15:18Speaker 9: It's like someone fending off a time. No, when the
- 15:25Speaker 9: mannequin is going to end?
- 15:28Speaker 8: How far is going to go?
- 15:31Speaker 4: On November fifth, only weeks before the Christmas parade, Darryl
- 15:35Speaker 4: had been released on a thousand dollars bond after running
- 15:38Speaker 4: over his ex girlfriend with a vehicle. On the day
- 15:44Speaker 4: of the Christmas parade, Darryl arranged through a mutual acquaintance
- 15:47Speaker 4: to meet with his ex girlfriend, Erica, the same ex
- 15:50Speaker 4: with whom his heated exchange earlier on in the month
- 15:53Speaker 4: had landed him in jail. The security camera for a
- 15:56Speaker 4: nearby school captured Erica, in a blue jacket, getting out
- 15:59Speaker 4: of the Redford escape after speaking with Daryl. She returns
- 16:05Speaker 4: moments later, followed by two friends, Corey and Nick. An
- 16:10Speaker 4: altercation ensued, which occurred behind the obscured view of the
- 16:14Speaker 4: security camera. A second camera partially captured the encounter. During
- 16:18Speaker 4: the argument, Daryl was outside of the vehicle, facing off
- 16:21Speaker 4: with Erica's friend and roommate, Corey, who claimed he had
- 16:24Speaker 4: swerved to try to hit Erica with his vehicle before
- 16:27Speaker 4: she ran up to the scene. Erica reported being struck
- 16:32Speaker 4: in the face by Daryl while they argued. Nick called
- 16:35Speaker 4: the police, exaggerating to elicit a rapid response. He claimed
- 16:39Speaker 4: on the call that Darrel was in possession of a knife,
- 16:41Speaker 4: which he was not. Regardless, this call to the police
- 16:45Speaker 4: prompted Daryl to drive off, but not before threatening to
- 16:48Speaker 4: kill his ex girlfriend. Minutes later. After walking Erica and
- 16:52Speaker 4: Corey back to the women's shelter where they were staying,
- 16:54Speaker 4: Nick watched as the same red suv sped off towards
- 16:58Speaker 4: Main Street. He said it took off like a bat
- 17:00Speaker 4: out of hell and watched as it drove through a
- 17:03Speaker 4: crowd of people to sixteen.
- 17:06Speaker 10: I had another at Heartland White Rock.
- 17:09Speaker 4: Person right now just.
- 17:20Speaker 9: Drinking injury was.
- 17:33Speaker 11: Okay? Fifteen people on the street.
- 17:50Speaker 9: Ran, where are you?
- 17:54Speaker 2: What is your name?
- 17:55Speaker 1: Your name.
- 18:02Speaker 5: So Erica Patterson.
- 18:27Speaker 6: Three.
- 18:33Speaker 4: The state believed that it was this domestic dispute with
- 18:36Speaker 4: Erica that had led to Darrel's rage fueled rampage into
- 18:39Speaker 4: the Christmas parade, But it was five charges of first
- 18:42Speaker 4: degree intentional homicide in addition to roughly seventy other counts
- 18:47Speaker 4: relating to other victims, injuries, and weapons charges that were
- 18:50Speaker 4: brought against Daryl Brooks. On the day of his bond hearing,
- 18:54Speaker 4: news came of a sixth heartbreaking death. Eight year old
- 18:58Speaker 4: Jackson Sparks had succumbed to his injuries at the Wisconsin
- 19:01Speaker 4: Children's Hospital. His twelve year old brother, Tucker, also seriously
- 19:06Speaker 4: injured at the parade, would make a full recovery. Daryl
- 19:09Speaker 4: Brooks charges increased from five to six indictments for first
- 19:13Speaker 4: degree murder. He could be seen crying in the courtroom.
- 19:16Speaker 4: His bail was set at five million dollars, so he
- 19:19Speaker 4: remained in custody. In February twenty twenty one, Daryl entered
- 19:28Speaker 4: a plea of not guilty, followed by an insanity plea
- 19:31Speaker 4: a few months later, but as the trial date approached,
- 19:34Speaker 4: his defense took a turn when in early September, his
- 19:37Speaker 4: public defenders requested to withdraw from the case. Daryl Brooks
- 19:42Speaker 4: would represent himself, and he was revoking the insanity defense.
- 19:48Speaker 8: What has led to Daryl's behavior his mental illness not
- 19:53Speaker 8: being medicated. Always says, you know, Mama, I'm fighting for
- 19:57Speaker 8: my life. And I said, I know that, baby, but
- 20:00Speaker 8: we have to look at reality for what it is.
- 20:05Speaker 13: What is it?
- 20:06Speaker 8: You know? I said, you did do what they said
- 20:10Speaker 8: you did, even though it wasn't intentional, but you did,
- 20:15Speaker 8: you know, And you're gonna have to go to prison.
- 20:21Speaker 1: Darryl's not an attorney.
- 20:25Speaker 2: How do you think he's going to handle the proceedings.
- 20:28Speaker 8: I'm going to and I hate to say this, You're
- 20:32Speaker 8: going to see mannic for blown. That's what you're gonna see.
- 20:38Speaker 4: The trial for the state b Daryl Brooks has been
- 20:41Speaker 4: accurately described as a legal circus, exactly what Don Woods
- 20:45Speaker 4: had predicted and hoped to avoid. But Judge Doro had
- 20:49Speaker 4: determined that Daryl Brooks was competent to stand trial and
- 20:53Speaker 4: articulate and intelligent enough to represent himself.
- 20:58Speaker 2: Nobody. Ain't nobody gonna talk to me like that, Nobody.
- 21:03Speaker 2: I don't have a problem with doing what you asked.
- 21:05Speaker 7: Me to do.
- 21:06Speaker 2: Not tell me, just like when I ask you about
- 21:12Speaker 2: subject matter jurisdiction that you have yet to prove on
- 21:14Speaker 2: the record. But somehow I'm being intentionally disruptive. But come on, man, stop,
- 21:21Speaker 2: just stop it.
- 21:23Speaker 1: I have to step in here and request that mister
- 21:25Speaker 1: Brooks be instructed to stop making comments under his breath.
- 21:28Speaker 1: This witness is very clearly having an emotional and difficult
- 21:31Speaker 1: time testifying, and she doesn't need to hear that, Sujason.
- 21:35Speaker 2: She can't hear anything I'm saying.
- 21:38Speaker 3: Are very good in this courtroom. You are being disrupted.
- 21:45Speaker 2: Always going to find reason. Somebody's being disruptive because they
- 21:49Speaker 2: want the truth to be out there.
- 21:50Speaker 8: Man, quit it.
- 21:54Speaker 3: I'm advising you that continued interruptions will result in you
- 21:57Speaker 3: forfeiting your rights.
- 21:59Speaker 2: Under under what law fact can you do that? Okay
- 22:03Speaker 2: with the fourth the fourth option that you made up,
- 22:05Speaker 2: that's not even in the law, because you can't do that.
- 22:09Speaker 2: I need to make by law you can't do that,
- 22:11Speaker 2: and you know you can't.
- 22:12Speaker 3: All right, I'm going to excuse everyone. Mister Brooks is
- 22:15Speaker 3: being removed from the courtroom. He will continue in the
- 22:18Speaker 3: neighboring courtroom. Please make sure he has his objection sign and.
- 22:22Speaker 4: An empty court room next to the one where the
- 22:26Speaker 4: proceedings were taking place served as a kind of time
- 22:29Speaker 4: out zone where Daryl was sent with some regularity when
- 22:32Speaker 4: he refused to comply with court instructions.
- 22:36Speaker 2: I want to that I'm not because that's a lie,
- 22:42Speaker 2: since he wanted to make a record and not be accurate.
- 22:44Speaker 2: So let's be accurate on on the record. Since you
- 22:47Speaker 2: think you know so much, so we can open the door.
- 22:52Speaker 3: She was interrupting what he is over the top, mister Brooks,
- 22:58Speaker 3: I'm ordering you to sit down and.
- 23:03Speaker 11: Being an agron.
- 23:05Speaker 3: Under Illinois versus Al and I've warned him repeatedly. He's
- 23:08Speaker 3: being removed from the courtroom.
- 23:10Speaker 4: Aedge Doro had the ability to mute this room. When
- 23:13Speaker 4: she took advantage of this, Brooks was reduced to holding
- 23:16Speaker 4: up his objection sign, at which point he would be
- 23:20Speaker 4: allowed to speak briefly to address his concerns.
- 23:23Speaker 9: Nothing.
- 23:26Speaker 3: You are now all right, attorney offering you master.
- 23:34Speaker 4: Darrel's antics did not cease once he was removed to
- 23:37Speaker 4: the neighboring courtroom. In one incident, he became non responsive
- 23:41Speaker 4: and hid behind a stack of legal boxes, forcing bailiffs
- 23:44Speaker 4: to remove them. After a particularly heated encounter, Daryl stripped
- 23:48Speaker 4: off his shirt and paced the room and threatened to
- 23:51Speaker 4: break items. This occurred on the same day he refused
- 23:54Speaker 4: to wear his suit to court, despite the chance that
- 23:56Speaker 4: it served as a visual bias to the jury.
- 24:00Speaker 10: Criminal trespassed dwelling from two thousand fives.
- 24:03Speaker 3: I need to take a break. This man right now
- 24:05Speaker 3: is having a stare down with me.
- 24:06Speaker 10: It's very disrespectful.
- 24:08Speaker 3: He pounded his fist frankly. It makes me say.
- 24:12Speaker 4: As the trial neared conclusion, most observers were still unable
- 24:15Speaker 4: to pinpoint exactly what the defense argument was, though there
- 24:19Speaker 4: was a laundry list of assertions being made. The first
- 24:22Speaker 4: was the declaration by Darrel that he was a sovereign citizen. Essentially,
- 24:27Speaker 4: he insisted that despite residing in the country, he conveniently
- 24:31Speaker 4: does not accept that he is a citizen of it,
- 24:34Speaker 4: and as such he cannot be bound by US laws,
- 24:37Speaker 4: the rules of the Court, or any other government authority.
- 24:40Speaker 4: Judge Dora rejected his attempts to use the sovereign citizen defense,
- 24:44Speaker 4: finding it to be meritless. This did not stop Darrell
- 24:48Speaker 4: from questioning the Court's jurisdiction over him repeatedly.
- 24:54Speaker 2: Subject manag jerisdiction has to be proven. Record has to
- 24:59Speaker 2: be proven.
- 25:01Speaker 7: You know that just as well as Brooks.
- 25:04Speaker 3: These do not make statements that mischaracterize the law. The
- 25:09Speaker 3: integrity of this jury is advised to disregard the statements
- 25:17Speaker 3: mister Brooks's making regarding subject matter jurisdiction. They are not evidence,
- 25:23Speaker 3: and you are to disregard them.
- 25:26Speaker 4: In another bizarre attempt to divert all responsibility outright, Daryl
- 25:30Speaker 4: Brooks began to insist that he was not, in fact
- 25:34Speaker 4: Daryl Brooks. He did not legally recognize his own name
- 25:39Speaker 4: or consent to being called to Daryl Brooks. In part,
- 25:42Speaker 4: this seemed to be based on an objection to court
- 25:44Speaker 4: records that contained his name typed in all capital letters.
- 25:49Speaker 4: As prosecution witnesses took the stand and referred to him
- 25:52Speaker 4: by name. He registered his objections on the record each time.
- 25:59Speaker 1: How would you describe mister Brooks's haircut today?
- 26:02Speaker 7: Objection?
- 26:02Speaker 2: I don't consent to being caught their name.
- 26:04Speaker 3: Oh sir, I understand your objection. Please do not interrupt
- 26:10Speaker 3: with that further, so that the questioning of the witnesses
- 26:13Speaker 3: may continue.
- 26:14Speaker 9: You may answer if.
- 26:14Speaker 4: You say their name.
- 26:15Speaker 3: I'm objecting, and the jury will disregard the objection if
- 26:21Speaker 3: it's solely for the.
- 26:22Speaker 4: Name purposes, excepting that Daryl Brooks is Daryl Brooks and
- 26:27Speaker 4: that he is a US citizen. The defense then suggested
- 26:30Speaker 4: that the driver of the suv could not be identified.
- 26:33Speaker 4: He questioned many of the victims and other parade witnesses
- 26:37Speaker 4: as to whether they had clearly viewed the driver of
- 26:39Speaker 4: the vehicle. The underlying assertion was that whoever the defense
- 26:43Speaker 4: was claiming to be, he was not driving the suv,
- 26:47Speaker 4: despite being captured on camera doing so.
- 26:51Speaker 3: Mister Brooks, do you have any questions for this witness?
- 26:54Speaker 7: Yes, I do, and object to being caught their name.
- 26:56Speaker 7: For the record, I was pasitive that as possible as
- 27:04Speaker 7: you who is you?
- 27:06Speaker 8: You?
- 27:07Speaker 7: I'm looking at you.
- 27:10Speaker 4: To further establish this point, the prosecution introduced a music
- 27:14Speaker 4: video of the man previously known as Daryl Brooks. In
- 27:17Speaker 4: the video, the defendant is seen wrapping in front of
- 27:20Speaker 4: the same red Ford escape that was later weaponized to
- 27:23Speaker 4: commit the alleged murders.
- 27:27Speaker 2: Just testify.
- 27:29Speaker 7: That this was the alleged defendant.
- 27:31Speaker 2: How do you know that? Can you see a face?
- 27:35Speaker 5: Which question are you asking?
- 27:36Speaker 10: Those were two?
- 27:37Speaker 2: Can you see the face on the circle individual in debt.
- 27:43Speaker 5: Exhibit?
- 27:45Speaker 9: In this fluff, I cannot see the face.
- 27:46Speaker 2: Of the person at has circled. So how do you
- 27:48Speaker 2: know who it is?
- 27:52Speaker 4: I can tell who that is because I have watched
- 27:54Speaker 4: this video in its entirety, and I can tell that
- 27:58Speaker 4: it is you based on.
- 27:59Speaker 6: All of my kind with you.
- 28:02Speaker 4: The Waukesha District attorneys called fifty seven witnesses to the
- 28:05Speaker 4: stand over eleven days, including police officers, parade goers, victims,
- 28:10Speaker 4: family members of victims, and a nearby residents who encountered
- 28:14Speaker 4: Daryl Brooks the day of the parade. Interclosing statement, District
- 28:18Speaker 4: Attorney Susan Oper drew a necessary distinction in their case
- 28:22Speaker 4: between that of intention and motive. Although the state argued
- 28:26Speaker 4: that Darrel was prompted into a rage. By his argument
- 28:28Speaker 4: with Erica, this does not translate into a motive to
- 28:31Speaker 4: injure and kill strangers. At no point did the state
- 28:35Speaker 4: present a motive. Legally they didn't need to, but also chillingly,
- 28:40Speaker 4: they admitted to not knowing what the motive was. It
- 28:43Speaker 4: was just senseless. The key charges of first degree murder, however,
- 28:48Speaker 4: required they prove intent, and that intent was obvious. District
- 28:52Speaker 4: Attorney Opper said it was in Daryl Brooks's actions when
- 28:56Speaker 4: he drove through the crowd and just kept going.
- 29:01Speaker 10: Big things in this case has always been why did
- 29:05Speaker 10: this happen? What was he thinking? Why did he do this? Again,
- 29:10Speaker 10: those are things I don't necessarily have to prove to you.
- 29:17Speaker 10: His intent I do have to prove, and I submit
- 29:20Speaker 10: without any doubt. There's overwhelming evidence that this was an
- 29:26Speaker 10: intentional act by Daryl Brooks and an act of utter
- 29:31Speaker 10: disregard for human life. I say that for these reasons, folks.
- 29:38Speaker 10: Number one, first and foremost, just stop driving. That's intent, folks.
- 29:49Speaker 10: No reasonable person who's gonna come across a group of
- 29:53Speaker 10: teenagers playing band instruments drive over them and keep going.
- 30:01Speaker 4: The defense argued that there was no intent. Witnesses had
- 30:05Speaker 4: testified that the suv was honking its horn a warning
- 30:09Speaker 4: to the individuals in its way. Furthermore, based on no
- 30:13Speaker 4: evidence whatsoever, it was argued that the suv itself was
- 30:16Speaker 4: defective and could not be stopped. This assertion was in
- 30:20Speaker 4: direct opposition to testimony already presented by the prosecution at trial.
- 30:25Speaker 4: A mechanical inspector for the Wisconsin State Patrol examined the
- 30:28Speaker 4: red Ford escape and he did not find any problems
- 30:31Speaker 4: with it that could have interfered with the vehicle's ability
- 30:34Speaker 4: to steer, accelerate, or break.
- 30:40Speaker 7: Which springs to me back to the vehicle.
- 30:41Speaker 2: What if the vehicle couldn't stop because of the malfunction
- 30:44Speaker 2: injection fact evidence? What if the driver of the vehicle
- 30:49Speaker 2: was unable to stop the vehicle? That make the driver
- 30:55Speaker 2: a craze or not craze a rage? Does that make
- 30:59Speaker 2: the driver in a rage and intent on killing people?
- 31:05Speaker 2: You have the decision.
- 31:09Speaker 4: The jury deliberated for an hour and a half after
- 31:12Speaker 4: a long final day in court. By eleven am the
- 31:15Speaker 4: next morning, the verdict was in on all seventy six counts.
- 31:20Speaker 3: We the jury find the defendant, Darryl E. Brooks, guilty
- 31:24Speaker 3: a first degree intentional homicide.
- 31:27Speaker 4: Each of the six first degree murder convictions carries a
- 31:30Speaker 4: mandatory life sentence. Judge Doro is tasked with deciding the
- 31:34Speaker 4: sentencing on the other seventy charges. These will be handed
- 31:37Speaker 4: down at a hearing in mid November. It is expected
- 31:41Speaker 4: that over thirty victims will offer impact statements at this hearing.
- 31:48Speaker 11: Hopefully someone this will bring awareness to mental illness via
- 31:55Speaker 11: our senators and our governors and elect officials. Court Holy
- 32:02Speaker 11: very little help if God, but individuals who are across the.
- 32:06Speaker 8: Rated with your ful alire.
- 32:10Speaker 4: Daryl Brooks has twenty days from sentencing to file a
- 32:12Speaker 4: notice that he intends to appeal his conviction, which he
- 32:16Speaker 4: plans to do. In fact, it has been widely speculated
- 32:20Speaker 4: that much of his bizarre behavior and endless objections were
- 32:23Speaker 4: in part purposefully designed for this one central purpose, to
- 32:27Speaker 4: build a case for appeal and to have the conviction overturned.
- 32:33Speaker 13: There's a discussion since the Burgs announced that perhaps a
- 32:38Speaker 13: decision to represent himself appeal.
- 32:40Speaker 2: I can concerned at all about that.
- 32:43Speaker 13: Well, mister Brooks has a right to an appeal, every
- 32:46Speaker 13: defendant does, and I fully expect him to take advantage
- 32:49Speaker 13: of his rights as a convicted defendant in this case.
- 32:54Speaker 13: I am very confident in the record that Judge Darrel
- 32:57Speaker 13: made and his decision to represent himself.
- 33:01Speaker 4: Yes, it will take months, if not years, for this
- 33:06Speaker 4: appeal to the case to be filed, presumably by one
- 33:09Speaker 4: or more qualified players. And that was the tragic case
- 33:15Speaker 4: of the Waukesha Christmas Parade in the bizarre trial of
- 33:18Speaker 4: Darryl Brooks. Thanks for watching. I'm Kevin. This is just
- 33:22Speaker 4: thot Lounge and I'll see him the next one.
