- 0:01Speaker 1: Now we turn to the reading of the Appalachian News
- 0:03Express for news in Pike County. Your reader today is Maya.
- 0:09We'll begin with the online edition dated in April twenty fourth,
- 0:12twenty twenty six, which the publishers have donated to RADIOI
- 0:17as a reminder. RADIOI is a reading service intended for
- 0:20people who are blind or have other disabilities that make
- 0:22it difficult to read printed material. Our first story is
- 0:27called Fiscal Court recognizes National Prayer Event by Terry L. May.
- 0:33The Pike County Fiscal Court issued a resolution recognizing Pike
- 0:37County's observance of a National Prayer Event, along with several
- 0:41other matters, during its April twenty first meeting. The proclamation
- 0:46declare that Thursday, May seventh will be observed as the
- 0:50National Day of Prayer in the county. The resolution was
- 0:53presented to members of the Local Planning Committee. Quote then
- 0:58National Day. The National Day of Prayer is an annual
- 1:02observance inviting people of all faiths to pray for the nation.
- 1:06The resolution reads, because of the faith more founding fathers,
- 1:10public prayer and National Days of Prayer have a long
- 1:13standing and significant history in American tradition. The National Day
- 1:19of Prayer was first established in nineteen fifty two by
- 1:22a joint Act of Congress and signed by President Harry S. Truman,
- 1:27according to the resolution. Later in nineteen eighty eight, President
- 1:32Ronald Reagan set the event for the first Thursday in
- 1:34May each year. The theme of this year's National Day
- 1:39of Prayer is Glorify God among the nations, seeking Him
- 1:42in all generations. According to the resolution, this is based
- 1:47on the Bible verse quote tell of His glory among
- 1:50the nations, his wonderful deeds among all peoples from First
- 1:54Chronicles sixteen twenty four end quote quote, I raise An Jones,
- 2:00the second Pike County Judge Executive. The Pike County Fiscal
- 2:04Court urged all citizens to give thanks for their many
- 2:07blessings and asked for God's continued guidance, protection, and mercy
- 2:12as we meet the challenges before us. End quote. The
- 2:15proclamation states. In the other actions, the Fiscal Court acknowledged
- 2:22the receipt of the Pike County Extension District Board budget
- 2:26for the upcoming fiscal year, acknowledged the report of financial Statements,
- 2:31supplementary information, and the audit of Pike County Housing Authority
- 2:36Elkhorn City, the Third Elderly Citizens Housing Opportunities Incorporated, and
- 2:42BlackBerry mccarr's Development Incorporated HID Project for the year ending
- 2:47June thirtieth, twenty twenty five. It also authorized the annual
- 2:52orders of afflation for Shelby Creek Volunteer Rescue Squad, Kimper
- 2:58Fire and Rescue Car Squad, and Pike County's Technical Rescue.
- 3:03It also approved the application to the Kentucky Division of
- 3:07Abandoned Mineland's Economic Revitalization Program to construct a build ready
- 3:13site pad at the Wolfpit Industrial and Technology Park, and
- 3:17it approved a contract extension for Title basin. Our next
- 3:23story is trial and Amber Spradlin murder case to go
- 3:27forward to May eleventh by Russ Cassie. The trial of
- 3:32a Florid County man accused of murdering Amber Spradlin in
- 3:37twenty twenty three and the two men accused of attempting
- 3:40to cover it up will go forward on May eleventh.
- 3:44Special Judge Eddie Coleman issued a ruling at the end
- 3:47of a hearing on April twenty third against a prosecution
- 3:50motion that requested the trial be delayed because DNA testing
- 3:55on evidence from the scene had not yet been completed
- 3:58by the Kentucky State Police Crime Lab. In the case,
- 4:02Michael m K McKinney the third, a twenty six, is
- 4:08accused of murder, while he and his father, Michael McKinny
- 4:11the second, fifty eight, and family friend Josh Mullen's aged
- 4:15twenty five, are accused of evidence tampering. In the case,
- 4:22Floyd Commonwealth's attorney Brent Turner said during the April twenty
- 4:27third hearing that he cannot say when testing will be completed,
- 4:30and he has not received information from the lab about
- 4:33a timetable quote. They have given pretty They have pretty
- 4:37commonly given me unrealistic timelines. He said, they didn't even
- 4:41give me a time frame this time. Turner pointed out
- 4:45that one of the factors driving the push to hold
- 4:47the trial was the fact that m K. McKinney was
- 4:50being incarcerated, which has changed since his bond was reduced.
- 4:55That Turner said would lead him to argue that with
- 4:58all three defendants out on bond, it would make less
- 5:02sense to rush the trial. Turner said he is concerned
- 5:06that if the trial goes without evidence testing being completed,
- 5:10than a guilty verdict, if obtained, could be reversed based
- 5:13on evidence that emerges later. Further, he said the evidence
- 5:18could even prove to be exculpatory to the defendants. Quote.
- 5:24We don't want to try it more than once, I guess,
- 5:27is what I'm getting at, Turner said. End quote. Turner
- 5:32asked that Coleman either set a new trial day and
- 5:35hope the evidence comes back in time, or set a
- 5:38status conference to check the status later. Quote. I would
- 5:43be surprised if the final stuff was back before a
- 5:45fall and Turner said. Turner said Spraglin's family is in
- 5:50agreement with delaying the trial. Quote they want it to
- 5:54be done right more than they want it done fast.
- 5:57I think we've all agreed, quote, Turner said. Attorneys for
- 6:02both Michael McKinny the Second and Mullens told Coleman they
- 6:05agreed with the delay, but asked that holmancarceration and other
- 6:09bond conditions be removed if it was granted. However, attorney
- 6:15Brandy O'Neill, representing MK McKinney, opposed the delay, even with
- 6:19MK McKinny being free on bond. Quote, his life is
- 6:23still on hold end quote, O'Neill said. Coleman said that
- 6:28d NK McKinney's opposition to the delay, he would quote
- 6:32unquote see the parties on the previously set trial date
- 6:37of May eleventh. The trial is set to be held
- 6:40in Coleman's courtroom at the Pike County Judicial Center. Our
- 6:45next story is called Candidates make Quick Cases to Hillbilly
- 6:50Day's festival Goers by Russ Cassidy. Candidates seeking several offices,
- 6:58including those seeking to replace US Senator Mitch McConnell and
- 7:02US Representative How Rogers, were given minutes to address Hillbilly
- 7:07Days festival goers at the annual Stump Speaking event held
- 7:11on April eighteenth. These candidates for federal offices were each
- 7:16given three minutes to make a speech, while candidates for
- 7:19state and local offices were given two minutes. Vitalating violating
- 7:24the time limit resulted in them being quote unquote played
- 7:28down by a bluegrass band. However, the candidates for US
- 7:33Senate and the US House made the most of their time,
- 7:36focusing on several issues, including Eastern Kentucky's future and national debates.
- 7:42For US Senate, US Representative Andy Barr, a Republican, kicked
- 7:47off the roster of candidates seeking to replace McConnell. Barr
- 7:52said that it was important that coal mining be restored. Quote,
- 7:57after one hundred and twenty five years proud ar of
- 8:00mining coal in eastern Kentucky, we still have a billion
- 8:04tons of coal in these mountains. Bar said, we need
- 8:07to put our coal miners back to work, not just
- 8:09for the prosperity of our people in Appalachia, but for
- 8:12the national security of the United States of America end quote.
- 8:17Bar said using coal for electricity can play a key
- 8:20role in lowering costs and powering technologies of the future.
- 8:26Barr said he has supported President Donald Trump in several ways,
- 8:30including helping to write the quote unquote One Big Beautiful Bill,
- 8:34helping to enact Trump's energy policies, and voting for Trump's
- 8:37immigration policies. Barr also cited his experience in Congress and
- 8:43said that while McConnell's departure will mean in Kentucky will
- 8:46lose influence, electing Bar will help ensure that someone experienced
- 8:50in Washington takes the sea. Quote. I don't need a
- 8:54learning curve. I can hit the ground running on day one,
- 8:58Barr said. Democrat Charles Booker spoke on the knee for
- 9:03people to be unified to push back against Republican policies.
- 9:08I know we've been up against it, he said. We've
- 9:10seen the floods come, we've seen storms, we've seen dark times.
- 9:14We've seen jobs leave, We've seen prices rides and gas
- 9:17and groceries and health care end quote. Booker also spoke
- 9:22against quote unquote cuts to vital services and the plight
- 9:26of homeless veterans. However, Booker said the issue is not
- 9:31one of Republican versus Democrat. Quote. If you're ready for
- 9:36a government that works for you, stand with me. Booker said.
- 9:40If you want a leader in the Senate that will
- 9:42fight to protect our families instead of protecting the EPSTOM files,
- 9:46stand with me. And if you want a working people's
- 9:50bill of rights, if you want Medicare for all, if
- 9:53you want universal basic income, if you want child care,
- 9:56if you want good paying jobs as true living wages,
- 10:00if you believe in organized labor, if you stand with
- 10:03our teachers, if you believe our veterans deserve the care
- 10:05they need for the sacrifices they've made, stand with me.
- 10:09End quote, he continued. Former Kentucky Attorney General Daniel Cameron,
- 10:15a Republican told the crowd that he was at the
- 10:18stump speaking for the same reasons they were. Quote. You
- 10:22care about a commonwealth and a country that is built
- 10:25on the ideas of merit and opportunity, and we have
- 10:30seen too much division in this country that has been
- 10:33built on the back of diversity, equity, and inclusion, Cameron said. Instead,
- 10:39Cameron said, Cameron said the country should be built on merit, excellence, intelligence,
- 10:44and integrity. The Senate, Cameron said, can ensure that the
- 10:49conditions are set to allow people to quote have more
- 10:52money in their pocket as opposed to bureaucrats in Washington
- 10:56end quote. Cameron said, it is important that the Safeguard
- 11:00American Voter Eligibility Act, also known as the Save America
- 11:05Act be passed. Quote. Another form of setting the conditions
- 11:10in Washington is to make sure that we pass the
- 11:13Safe America Acts so that we ensure the integrity of
- 11:16our elections and ensure that illegalis do not vote in
- 11:20those elections. Endue, Cameron said. Cameron said he will fight
- 11:26for coal, natural gas, and nuclear energy to be used
- 11:29and will use the Senate seat to support law enforcement. Quote.
- 11:33We will always back the blue end quote. Cameron said.
- 11:38Republican Jimmy Leon spoke on several initiatives he wanted to
- 11:41undertake if elected, including a balanced budget, amendment policies related
- 11:46to the protection of life, and ending parental alienation. Democratic
- 11:52candidate Amy McGrath said change is needed. Quote what we
- 11:56are seeing right now today in our country is dangerous
- 11:59and normal. She said. We're seeing prices for everything through
- 12:03the roof health care being taken away, and we are
- 12:06in another Middle Eastern war end quote. McGrath also blasted
- 12:11several policies of the Trump administration. Quote, I'm going to
- 12:15take away these tariffs that drive the prices of everything
- 12:18up end quote. McGrath said. She also pointed to changes
- 12:23in Medicaid. Quote did anyone vote for their hospitals to close?
- 12:28I don't think so. McGrath said, Well, that's what we're getting,
- 12:31and that's why we need new leaders end quote. McGrath
- 12:35said Eastern Kentucky is owed twenty first century infrastructure for
- 12:40powering the nation. Quote. We need investment here, not more slogans,
- 12:45she said. Democratic candidate Dale Romans set his advocacy for
- 12:51the thoroughbred training industry in which he works made him
- 12:55realize that change is needed in Washington. Quote I realize
- 13:00how badly the system is broken, and something needs to change.
- 13:03He said. We need common people to run for these
- 13:06offices end quote. Romans said he wants to bring the
- 13:10Democratic Party back to the center and see more compromise. Quote.
- 13:15You're paying me to go to Washington to work, and
- 13:18that's what I want to do. He said. I can
- 13:21reach across the aisle and work with anybody. Fighting has
- 13:24gotten us nowhere. We've been fighting for the last ten years.
- 13:30Eastern Kentucky has been treated unfairly. You produce all the energy,
- 13:34but you're paying the highest energy costs, he said. Romans
- 13:39also addressed the Trump administration's immigration policy, saying that it's
- 13:44not right to simply deport millions of people. Quote we
- 13:48need to document them and make them productive Americans that
- 13:51are paying into taxes like they're supposed to end quote,
- 13:54Romans said. Vincent Thompson, a Democrat seeking the Senate seat,
- 14:00said he said he was inspired to run by his
- 14:02late wife's struggles within the health system. Quote. Health care
- 14:07should be at the hands of doctors and nurses and
- 14:11those that are trained to do it, not the insurance companies.
- 14:14End quote. Thompson said. He also said his late wife's
- 14:18work with special needs students inspired another plank of his platform. Quote,
- 14:24We're doing a tremendous disservice to all of our kids,
- 14:27Thompson said, adding that early and continuing education should be
- 14:31available to all children so they can be prepared for
- 14:34life's challenges. Several candidates, including Republican Nate Morris, did not
- 14:40attend the event. For US House. U S Representative hol Rogers,
- 14:46who was seeking re election to the fifth congressional district seat,
- 14:50did not attend the stump speaking, but several of those
- 14:53seeking to replace him did. Republican Benjamin hurt Hurley said
- 14:58his focus is on the region, especially after he returned
- 15:01from his service in the U. S. Army, to find
- 15:03a rampant drug problem, a lack of jobs, and a
- 15:06people weaving due to the lack of opportunity. Quote my mission,
- 15:11my overarching goal is to put Eastern Kentucky first, he said.
- 15:16Hurley said bringing jobs into the district is vital. Quote.
- 15:21I really do want to bring in some better paying jobs,
- 15:23Hurley said, pledging that he will set his salary at
- 15:27the median household income at the district if the median
- 15:31income goes up, then his own pay would go up,
- 15:33but the inverse would also be true. Quote if I
- 15:37don't do my job and the median household income goes down,
- 15:40then obviously my pay goes down too, Hurley said. Hurley
- 15:46also said he wants to see term limits set for
- 15:48members of Congress. Quote. Career politicians need to get out
- 15:53of Washington, he said, adding that he is pledging to
- 15:56only serve three terms if elected and re elected, Hurley
- 16:01said he will work to ban stock trading by members
- 16:04of Congress and is pledging not to buy any if elected.
- 16:08Democratic candidate Ned Pillersdorff said his focus is heavily on
- 16:13the current administration's quote unquote attack on social programs. Quote.
- 16:20I am going to reverse and fortify and save the
- 16:23safety Debt, which is under vicious attack by Republican administration.
- 16:27Pillersdorff said. We are the poorest congressional district in the nation.
- 16:33The one big beautiful bill, Pillersdorff said, will be devastating,
- 16:37but the impacts will not occur until after this year's
- 16:41midterm elections are complete. Quote. That bill is a nuclear
- 16:46bomb headed toward our most vulnerable citizens, endo said, Pillarsdwarff.
- 16:52The Republican viewpoint, he said, is a factor in the changes. Quote.
- 16:57The Republicans have made the political calculation that they can
- 17:00crush the less fortunate as long as it helps their
- 17:03billion dollar donors, Pillinstorf said. Republican candidate Jerry Lee Shelton
- 17:10said that he wants to see term limits and a
- 17:12cap on interest charged by credit card companies approve, along
- 17:16with stop on cuts to Medicaid payments. Republican Kevin Smith
- 17:22said he wants to play a role in baking the
- 17:24region better. Quote in Congress, I'm going to fight for family, faith, freedom,
- 17:30and the future of Eastern Kentucky. Smith said. Our next
- 17:36article is called ruling denies the attorney's attempt to replace
- 17:40Circuit Judge Hall in civil cases. A News Expressed staff report,
- 17:48the Kentucky Supreme Court's Chief Justice has denied the request
- 17:52of a Pikeville attorney to have a special judge appointed
- 17:55to replace pike Circuit Judge Howard Keith Hall in several
- 17:59cases he has before the judge. According to the order
- 18:04issued April eighteenth by Kentucky's Supreme Court Chief Justice Deborah
- 18:09Henbry Lambert, Pikeville attorney Glen Martin. Hammond offered no specific
- 18:13evidence that suggests Hall is biased or partial. The issue
- 18:19stems from Hammond's hiring a former FBI agent, Clay Mason,
- 18:23to quote investigate information about Judge Hall's rulings that rendered
- 18:28preference to select parties, attorneys, or defendants end quote before
- 18:34hiring Mason. Records show Hall ruled that Hammond has filed
- 18:38a quote materially false end quote affidavit to avoid the
- 18:43state the Statute of Limitations in a case against three
- 18:49M Company regarding the company's dust masks used by miners
- 18:53in the coal mining industry. Hammond's hiring of Mason was
- 18:58brought to light while under indictment of charges of mail
- 19:03fraud and theft of government funds, charges on which Hall
- 19:07was ultimately found not guilty by a jury. After Hall's
- 19:13suspension by the Kentucky Judicial Conduct Commission ended and he
- 19:17was restored to the bench, Hammond filed motions in several
- 19:20cases asking that Hall be recused from presiding overcations cases
- 19:26in which Hammond is an attorney, who ultimately recused from
- 19:35cases in which no parties opposed Hammond's motion, but remained
- 19:40as the judge in the cases where the defendant's attorneys
- 19:43opposed the move. In the order, Lambert wrote that a
- 19:48reasonable observer might reasonably question whether Hall could maintain impartiality
- 19:52to an attorney who had hired a private investigator to
- 19:56scrutinize his rulings. However, Lambert wrote, upholding Hall's recusal would
- 20:01raise other issues. Quote. But that same reasonable observer, knowing
- 20:07all the facts, would also know that the attorney for
- 20:10the party complaining of bias acted in a way that
- 20:13he could have reasonable reasonably foreseeing to create that bias.
- 20:19Lambert wrote, Giving the party or the party's attorney the
- 20:22benefits of this factory conflict would only encourage similar behavior
- 20:27from other litigants end quote. Lambert wrote that if a
- 20:32judge believes that this type of situation would prevent them
- 20:34from acting without bias or partiality, the code of judicial
- 20:39conduct requires that they step aside. Quote. Since Judge Hall
- 20:45has declined to recuse himself in this case, the Chief
- 20:48Justice presumes he has made that self inquiry and determined
- 20:52that he is able to proceed with an unbiased mind
- 20:55end quote, Lambert wrote. In the order, Lambert noted that
- 20:59the denial is without prejudice of any party to seek
- 21:03appellate review after entry of a final judgment. Our final
- 21:09article is titled County Morris asked for ARH lawsuit over
- 21:16psych services to be dismissed Written by a News Express staff.
- 21:23An attorney for Pike County and Jyler Brian Morris, has
- 21:27filed a motion asking for the dismissal of a lawsuit
- 21:31in which Appalachian Regional Healthcare or ARH, has alleged to
- 21:36the jail failed to play three point two million dollars
- 21:38in bills for psychiatric services. The lawsuit was originally filed
- 21:44in December, but was not served on Pike County Jayler
- 21:47Brian Morris until April twond The civil lawsuit alleges that
- 21:53the PCDC has an outstanding balance of three million, two
- 21:58hundred and sixty five thousand, four four hundred and seventy
- 22:01five dollars in remuneration. ARH seeks full payment of the balance,
- 22:08accrude and accruing interests, attorneys, fees, a jury trial, and
- 22:13other for reef for which it may be entitled. Morris
- 22:17told the News Express that the individuals who received the
- 22:20services from ARH were not inmates at the jail at
- 22:24the time they received treatment. I have not yet had
- 22:30an opportunity to fully investigate the claims made, but believe,
- 22:35based upon the facts alleged and initial review, that each
- 22:39of these individuals had been released from jail and were
- 22:42no longer in custody, nor were they prisoners at the
- 22:45time of their alleged treatment by ARH. Morris told The
- 22:49News Express, it is my understanding that ARH was made
- 22:53aware of this fact prior to initiating this lawsuit. An
- 22:58emotion filed April twentieth, attorney Jonathan C. Shaw asked for
- 23:02the lawsuit to be dismissed mainly because of the lack
- 23:06of a contract for the services provided. While ar H
- 23:11alleges in their lawsuit that a contract arose through Pike
- 23:14County's prior payment of invoices, no written contract was filed
- 23:19as part of the case. Shaw wrote, quote the complaint
- 23:24identifies no written agreement, no specific communications forming an author
- 23:28and acceptance, and no definite terms governing rate scope, duration,
- 23:34authorization procedures, payment, timing, or conditions of performance. Shaw wrote,
- 23:40under Kentucky law, a contract requires mutual ascent to sufficiently
- 23:44definite in certain terms. The allegation that prior payment established
- 23:49a course of dealing is conclusiory and cannot supply the
- 23:53missing essential elements of contract formation end quote. Shaw also
- 23:58wrote that the motion that claims against Morris are redundant
- 24:02and should be dismissed since the complaint alleges only conduct
- 24:05attributor to the county's institutional obligations. This concludes the reading
- 24:16of the Appalachian News Express for news from Pike County.
