12.11.25 · The Mountain Eagle

0:01
Speaker 1: Now we turn to the Mountain Eagle to read news
0:04
from Weisburg. Your reader today is Bill van Arsdale. We
0:10
will begin with the addition dated December tenth, twenty twenty five,
0:14
which the publishers have donated to Radio Eye as a reminder.
0:19
Radio Eye is a reading service intended for people who
0:22
are blind or have other disabilities that make it difficult
0:25
to read printed material. The first headline is Kentucky Missed
0:32
Distillery is holding a birthday bash for the unveiling of
0:36
the county's oldest aged whiskey. Kentucky Missed Distillery in Whitsburg
0:44
is holding a birthday party on Saturday for the release
0:47
of its four year old whiskey, the oldest whiskey ever
0:51
produced in Letcher County. Created as a moonshine distillery, Kentucky
0:57
mist now makes several other alcoholic beverages, including Old Henry,
1:02
a barrel aged corn whiskey. But while the Old Henry
1:07
made there in the past was aged for two years
1:10
in small barrels to approximate the taste of a longer
1:13
aged whiskey, this Old Henry is the real thing, aged
1:17
for four years in full sized barrels. I want to
1:22
see what it's like we haven't tried it either, said
1:25
Kentucky Misted owner Colin Fultz. In Fults's estimation, a special
1:32
whiskey deserves a special day, So this Saturday, the distillery
1:37
will hold a birthday party with tickets at two hundred
1:40
dollars to three hundred and seventy five dollars each. For
1:44
that whiskey, connoisseurs will get a three to four hour
1:48
experience at the distillery. Ticket Holders will learn how to
1:52
distill whiskey from the mash to the finished product, help
1:56
fill up a new barrel of Old Henry to be
1:58
opened in two thousand TI twenty nine, and then cross
2:02
the street to the barrel house to tap into the
2:05
first batch. They will then help with the proofing process
2:09
and bottle their own four year old whiskey. I thought
2:14
it was neat because it's the oldest aged whiskey ever
2:16
made in Electric County. False sid When the barrel is opened,
2:21
it won't be for the faint of heart. Whiskey is
2:25
aged at full strength and cut with water to the
2:28
finished proof before it's bottled. Old Henry is sold at
2:32
ninety proof or forty five percent alcohol by volume. It'll
2:37
be about one hundred and thirty five proof coming out
2:39
of the barrel false sid he said. While the four
2:44
year old batch may be made similarly to other whiskeys,
2:47
there are some key differences, one being the proof at
2:51
which it's aged. It's also similar to chards, a type
2:56
of dark moonshine, but charges are only kept in a
2:59
barrel long enough to color the drink. And unlike some
3:03
other distilleries, Kentucky Missed is picky about its corn, Fult said.
3:09
Some others use any kind of corn available. We're real
3:12
strict about the kind of corn we use, he said.
3:15
We use one white sweet corn from western Kentucky and
3:19
it makes it more consistent. The tasting isn't the only
3:23
part of the day Saturday that is different. People who
3:27
attend will sign the new barrel of whiskey before it's
3:30
sealed up to age, and they'll sign the barrel they
3:33
empty that day. That barrel will be raffled off at
3:37
the end of the day. The next story is city
3:42
takes step needed to get work going on old hotel building.
3:48
The city of Weisburg has taken another step towards the
3:51
second phase of renovations of the old Daniel Boone Hotel
3:56
signing a memorandum of agreement with Letcher County. The Eky
4:01
Heritage Foundation will sign the agreement next clearing the way
4:06
for architects to be interviewed. The city council voted last
4:10
month to award an architecture contract, but learned later that
4:14
it must first interview the architects who applied. The vote
4:19
last month was based solely on scoring done when the
4:22
proposals were opened. This is a project of the City
4:26
of Watchburg, but Pine Mountain Partnership and Lescher County are
4:31
working with the city to see the project to completion.
4:36
The nine thousand, two hundred twenty four square foot building
4:39
was opened as the Daniel Boone Hotel on Independence Day
4:43
weekend nineteen twenty and was last used as a hotel
4:47
in nineteen seventy four. Mountain Comprehensive Health Corporation turned it
4:52
into a clinic after that, and it was used as
4:55
the Letcher County Courthouse while the Courthouse building was being
4:59
renovated on the street in the nineteen nineties. The Dollhare
5:03
family donated it to the City of Witchburg in two
5:06
thousand and nine after about ten years of its sitting
5:10
empty and unused. Before the city could get money to
5:14
renovate it. The roof collapsed, taking part of the three
5:18
floors below with it. The city used a one point
5:23
five million dollar Appalachian Regional Commission grant to gut the
5:27
collapsed interior and build a new roof and new floors,
5:31
but nothing else has been done because no money is available.
5:36
Missy Matthews, who is chairwoman of the Electric County Tourism
5:40
and Convention Commissions, with her husband, Junior Matthews, founded the
5:45
Eky Heritage Foundation and set in February of twenty twenty
5:49
four that it would take about eight million dollars to
5:53
finish the building, far more than the three million dollars
5:56
appropriated by the state legislature in May of that year.
6:01
As a result, the work is being broken into smaller projects.
6:05
The first thing planned is replacement of the windows in
6:09
the building and space for retail, a restaurant, and a
6:13
bar on the main street level. More money will be
6:16
needed to complete hotel rooms on the second and third floors,
6:20
and probably for convention and meeting space in the walk
6:24
out basement. The hotel is one piece of a proposed
6:29
two hundred seven point six million dollar long term plan
6:33
for tourism development in Lesser County. That plan was presented
6:37
to the public in February twenty twenty four. The plan
6:41
includes resorts, hiking trails and mountain biking trails, ATV trails,
6:47
and camping. The next headline is ruling in Stein's case
6:53
hinged on probable cause. The motion to dismiss the murder
6:58
indictment of former Sheriff Sean Mickey Steins hinged on a
7:03
question of yes or no, but a judge said, the
7:06
only question that matters at this point is whether there
7:09
was probable cause to believe the sheriff killed the judge.
7:13
He said there is. Judge Christopher T. Koran also overruled
7:18
emotion to release a copy of a mental health evaluation
7:22
of Stein's conducted by a state psychiatrist to determine whether
7:26
Steins was suffering from extreme emotional disturbance when he shot
7:31
and killed Judge Kevin R. Mullens in his chambers on
7:35
September nineteenth, twenty twenty four. At issue in both requests
7:41
was how Stamper answered two questions from grand jurors before
7:45
returning the indictment against Stein's on November seventeenth, twenty twenty four,
7:50
one juror asked, so he was insane mind as far
7:54
as the investigation is gone. Stamper answered yes. The defense
8:00
argued that Stamper was unfairly giving his opinion, but the
8:03
court ruled the questions from the juror were about the
8:06
medical records Stamper had already given them. The defense also
8:11
sought to dismiss because Stamper answered no when a juror
8:15
asked if there was any evidence Mullins was involved in
8:18
a sexual abuse lawsuit filed by a female inmate against
8:22
the judge's former bailiff, deputy, Ben Fields. Though defense attorneys
8:28
contended that Mullens was involved in the lawsuit because Fields's
8:32
crime occurred in the judge's office, the court ruled that
8:35
a prosecutor has no obligation to give a grand jury
8:38
any evidence other than that which shows probable cause to
8:42
make an indictment. Mullins was not a party to the
8:45
lawsuit and did not give a deposition in it. Kuran
8:50
granted another motion for an evidentiary bail hearing, but denied
8:54
a motion by the defense that a report of the
8:57
Kentucky Corrections Psychiatric Center evaluation of Stein's be unsealed. So
9:03
they could use it at that hearing. A bail hearing
9:07
is not a trial rehearsal, Quran wrote, noting that bail
9:11
is not required to be granted if proof is evident
9:14
or if the presumption of guilt is great. Any proof
9:18
which may exist and be used to contradict the Commonwealth's
9:21
facts naturally exists apart from the sealed KCPC evaluation. Quran,
9:28
who normally sits in the Eighth Judicial Circuit in Western Kentucky,
9:33
wrote that the defense was conflating the role of a
9:36
grand jury, which is to accuse a defendant, with the
9:39
role of a trial jury, which is to adjudicate the charge.
9:44
Qoran ruled that the prosecution's only burden was to present
9:47
evidence that would provide probable cause that the defendant committed murder,
9:53
that is, with intent to cause the death of another person.
9:56
Here Judge Mullens, he caused the death of such person.
10:00
That burden was satisfied, Koran wrote. As noted above, the
10:05
prosecutor played the video footage showing the defendant shooting Judge
10:09
Mullins multiple times. Koran wrote that evidence alone removed the
10:15
question of who shot and killed Judge Mullens. The video
10:20
footage clearly serves as a reasonable ground for belief the
10:23
defendant intended to cause the death when he shot and
10:26
killed Judge Mullins. Koran also ruled that the defense's contention
10:33
that the case should be dismissed because the prosecutors allegedly
10:36
violated rules of criminal procedure by not recording their first
10:41
meeting with the grand jury was moot because there was
10:44
no testimony. Given the plain language of the Rule of
10:48
Criminal Procedure five point one six sub section one and
10:53
statutory interpretation principles support the Commonwealth position that it did
10:57
not provide testimony when it met the grand jury and
11:01
requested subpoenas, and therefore Rule of Criminal Procedure five point
11:05
one six sub section one was not violated when a
11:09
recording of its request was not made. Quran wrote. The
11:15
next story is Basher Trump is bluffing with threat to
11:19
cut off benefits to SNAP recipients. Governor Andy Basher says
11:25
the Trump administration is bluffing when it threatens to cut
11:28
off SNAP benefits unless the state turns over personal information,
11:32
including immigration status, on all SNAP recipients. Basheer said the
11:38
administration first sent a letter demanding the information. In May,
11:43
Basheer joined more than twenty other states insuing the administration
11:48
to block the request, and a judge issued a ruling
11:51
in September saying the federal government is not entitled to
11:55
the data it asked for. Basheer said another letter arrived
11:59
last week asking for the information for a new security protocol,
12:03
but still did not threaten cancelation of benefits. It only
12:07
asked that the states send letters saying why they won't
12:11
provide the information. We as a group of states, we're
12:15
working on that. When during the televised cabinet meeting, which
12:19
is something Brooke Rallins comes out and says or we're
12:22
going to cut them off if they don't send us
12:24
the information by that date, Basheer said, the administration is
12:28
not appealing the judge's earlier order. Bascher said, so it
12:32
still stands. While opponents of Bascher say the federal government
12:37
is entitled to the information to combat fraud, he said
12:41
that's not why the government said it was asking for
12:43
the information. The stated reason was not to detect fraud.
12:48
It was about immigration and wanting to use the information
12:51
for immigration purposes. Bascher said. Baschu speculated that cabinet members
12:57
feel the need to puff up and look strong at
13:00
the cabinet meeting, but said threatening to let people starve
13:04
for political purposes is just wrong and they should knock
13:07
it off. I will go back to court if I
13:10
have to to ensure that these benefits continue, Bashir said.
13:15
The Trump administration has a ruling saying they cannot cut
13:18
off benefits because they don't provide personal information that the
13:22
federal government is not entitled to under law. In the
13:27
next headline, EPA cuts fossil fuels from website on climate change,
13:36
the Environmental Protection Agency has removed any mention of fossil fuels,
13:41
the main driver of global warming, from its popular online
13:45
page explaining the causes of climate change. Now it only
13:49
mentions natural phenomena, even though scientists calculate that nearly all
13:54
of the warming is due to human activity. Sometime in
13:59
the past few day weeks, EPA altered some but not all,
14:03
of its climate change web pages, de emphasizing and even
14:07
deleting references to the burning of coal, oil, and natural gas,
14:12
which scientists say is the overwhelming cause of climate change.
14:17
The website's causes of climate change page mentions changes in
14:21
Earth's orbit, solar activity, earth's reflectivity, volcanoes, and natural carbon
14:28
dioxide changes, but not the burning of fossil fuels. Seven
14:34
scientists and three former EPA officials tell the Associated Press
14:39
that this is misleading and harmful. Now it is completely wrong,
14:44
said University of California climate scientists Daniel Swain, who also
14:49
noted that impacts, risks, and indicators of climate change on
14:53
the EPA site are now broken links. This was a
14:57
tool that I know for a fact that a lot
14:59
of it educators used, and a lot of people. It
15:03
was actually one of the best designed, easy access climate
15:06
change information websites for the US. Earlier this year, the
15:12
Trump administration removed the National Climate Assessment from government websites.
15:19
It is outrageous that our government is hiding information and lying,
15:24
said former Obama National Oceanic and Atmospheric Administration chief and
15:29
Oregon State oceanographer Jane Lubchenka. People have a right to
15:34
know the truth about the things that affect their health
15:36
and safety, and the government has a responsibility to tell
15:39
the truth. An October version of the same EPA page
15:45
saved by the Internet wayback Machine said since the Industrial Revolution,
15:50
human activities have released large amounts of carbon dioxide and
15:55
other greenhouse gases into the atmosphere, which has changed the
15:59
Earth's clime climate. Natural processes, such as changes in the
16:04
Sun's energy and volcanic eruptions also affect the Earth's climate. However,
16:10
they do not explain the warming that we have observed
16:12
over the last century that now reads. Natural processes are
16:19
always influencing the Earth's climate and can explain climate changes
16:24
prior to the Industrial Revolution in the seventeen hundreds. However,
16:28
recent climate changes cannot be explained by natural causes alone.
16:34
Unlike the previous administration, the trope EPA is focused on
16:38
protecting human health and the environment while powering the Great
16:42
American comeback, not left wing political agendas, said Bridget Hirsch,
16:48
EPA spokesperson in an email. As such, this agency no
16:53
longer takes marching orders from the climate cult plus for
16:57
all the pearl clutters out there. The website is archived
17:01
and available to the public. Clicking on Explore Climate Change
17:06
resources on the EPA archived website leads to an error
17:11
message that says this XML file does not appear to
17:15
have any style information associated with it. Former Republican Governor
17:21
Christy Todd Whitman, who was EPA administrator under George W. Bush, said,
17:26
you can refuse to talk about it, but it doesn't
17:28
make it go away. And we're seeing it, everybody's seeing it.
17:34
We look ridiculous. Quite frankly, Whitman told the Associated Press
17:38
in an interview, the rest of the world understands this
17:42
is happening, and they're taking steps, and we're just going backwards.
17:46
We're knocking ourselves back into the stone age. The next
17:51
story is do you want a tattoo erased? It's costly
17:57
and it's painful. Colin Farrells had it done many times.
18:03
So have Angelina, Joe Lee and Megan Fox. Heck, even
18:07
Bart Simpson did, whether it's Marilyn Monroe's face, Billy Bob
18:13
Thornton's name, a sultry Rose, or even Bart's partially inscribed
18:18
homage to his mother. Some tattoos simply have to go
18:22
for one reason or many others, but the process of
18:27
taking them off is longer, much more costly, and ouch
18:31
extremely more painful than getting them put on, according to
18:35
professionals in the industry. Also due to health reasons, some
18:41
souls who braved the ink needles should be wary of
18:44
the laser when having their body art erased or covered up.
18:48
Tattoos have been around for centuries. The oldest known tattoos
18:53
were found on remains of a Neolithic man who lived
18:56
in the Italian Alps around three thousand BC. Many mummies
19:01
from ancient Egypt also have tattoos, as do remains from
19:05
cultures around the world. Tattoo removal likely is almost as
19:11
old as the practice of inking, and including scraping the
19:14
skin to get the pigments off or out. A more
19:19
civilized method evolved in the nineteen sixties when Leon Goldman,
19:23
a University of Cincinnati dermatologist, used hot vapor bursts from
19:28
a laser on tattoos and the skin that bore them.
19:34
Many choose tattoos to honor someone. A twenty twenty three
19:39
survey by the Pew Research Center determined that thirty two
19:43
percent of adults in the United States have tattoos. About
19:47
twenty two percent have more than one. According to the survey,
19:52
honoring or remembering someone or something accounts for the biggest
19:56
reason Americans get their first tattoo. About twenty four were
20:00
sent in the survey regret getting them. Tracy Herman fifty
20:05
four of Plymouth, Michigan, just west of Detroit, has eight
20:09
tattoos and is in the process of getting four phrases,
20:14
including one step at a time, Surrender and through it
20:18
all removed from her feet and arms. She started inching
20:24
up about six years ago and says she doesn't regret
20:27
getting tattoos. Maybe a different choice maybe. Hermann said following
20:32
her fourth tattoo removal session at Chroma Tattoo Studio and
20:37
Laser Tattoo Removal in Brighton, Michigan. There was a period
20:42
in my life that I felt needed some extra reminder,
20:45
Hermann said. I thought I would just embrace the period
20:48
in my life, so that helped, and then just to
20:51
surrender and give it over to God. So half of
20:55
them were really really pivotal to getting me over a
20:58
hump in my life boredom. Among reasons to remove tatts,
21:05
Hermann says the four getting lasered are part of her
21:08
past and that's where she wants them to stay now.
21:12
I just want to move forward and go back to
21:14
the original skin I was born with, she said. But
21:17
the other four I'm going to keep. They still mean
21:20
a lot to me, but they're more hidden. Reasons for
21:24
getting a tattoo removed are as varied and personal as
21:28
the reasons for getting them in the first place, says
21:31
Ryan Wright, a registered nurse and owner of ink Blasters
21:35
Precision Laser tattoo Removal in Livonia, Michigan. A lot of people,
21:41
when they get a new tattoo that makes some of
21:43
their old tattoos look bad, they get the older tattoos
21:46
removed or reworked, right, said Chrome owner Jamie Howard says
21:52
boredom plays a role too. They get a tattoo off
21:57
of whim and they're like, Hey, I'm really bored with this.
22:00
I don't want this anymore. Howard said. It's not about
22:03
hating their tattoo, it's about change for yourself, like snapping
22:09
a rubber band on your skin. Howard and Wright, like
22:14
many who perform laser removals, use something called a Q
22:18
switching or quality switching laser. It concentrates the light energy
22:23
into intense, short bursts or pulses. It's very painful nine
22:29
out of ten. Wright said it kind of feels like
22:32
a rubber band being snapped on your skin with hot
22:35
bacon grease. Howard has had some of her tattoos removed,
22:40
and admits the procedure is painful, but you get through it.
22:44
She said, A couple of days later, you're still feeling
22:47
the sunburn, but it's okay. If you want it bad enough,
22:51
you'll take it off because that's what you want. Light
22:56
heat from the laser breaks the ink into particles small
22:59
enough to be absorbed by the body and later excreted
23:03
as waste. It's not a one undone. Wright said. Tattoo
23:09
removal can take eight to twelve treatments or more. A
23:13
new tattoo can go over the old one once the
23:15
skin has had time to sufficiently heal. Howard consulted with
23:20
Herman as her fourth session at Chroma began. They spoke
23:25
about the previous session and how far along they were
23:28
with the ink removal. Both then donned dark sunglasses to
23:33
protect their eyes from the brightness of the laser. Herman
23:36
winced seconds later it was done, but she still has
23:41
more sessions ahead. Oh gosh, it's a ten when you're
23:45
getting it done, Hermann said, of the pain, it's pretty intense.
23:50
It's doable. I know price is sometimes an issue, but
23:53
it's worth it. Removal can be costly. Howard says the
24:00
minimum she charges is one hundred dollars per session. Wright
24:04
says that on a typical day he does about a
24:06
dozen treatments and that cost depends on the square inch
24:10
size of the tattoo. The cost is really the technology
24:14
in the laser. Wright said, it's not like a time thing.
24:19
Most treatments are under a minute. You're paying for the
24:22
technology and the person who knows how to use the technology.
24:25
You can damage the skin if you don't know what
24:27
you're doing. Tattoo removal not safe for everyone. Using lasers
24:35
to remove tattoos comes with some risks. Skin that bore
24:40
the tattoo can be left lighter than surrounding skin. There
24:44
also can be temporary scarring, infection, redness, or soreness. According
24:50
to the US Food and Drug Administration, consultations on the procedures,
24:54
complications should take place before laser tattoo removal. His clients
25:00
have to sign a waiver that they understand possible complications.
25:06
People who have diabetes and are not controlling the diabetes
25:09
should be wary, he said. Anybody with autoimmune disease or
25:13
any immune deficiencies. Right said, we can't do it if
25:17
you're on blood thinners. I go over the side effects
25:20
with everyone. The next story is Meteor shower coming. It's
25:28
time for one of the strongest meteor showers of the year.
25:33
The Geminids peak this weekend and are visible for a
25:37
few more nights after that. According to the American Meteor Society,
25:42
the meteors tend to be yellow in color and can
25:45
be seen across the globe, but the best viewing happens
25:48
in the northern Hemisphere. Skygazers can see up to one
25:52
hundred and twenty meteors per hour under dark skies during
25:56
the peak Saturday night into Sunday's pre dawn. According to NASA,
26:03
meteor showers appear when fast moving space rocks hit Earth's
26:07
atmosphere and burn up, leaving behind fiery trails the end
26:13
of a shooting star. The meteor shower will appear over
26:17
the whole sky, so look to the darkest part or
26:21
search for the Gemini constellation for which the shower is named.
26:26
Wait fifteen to twenty minutes for your eyes to get
26:28
used to the darkness. The next story is Vaught's Views
26:34
by Larry Vaught. New Coach's dad says he's ready for job.
26:41
Matt Stein has always taken the approach that whatever decisions
26:44
his son William made about his coaching future was none
26:48
of my business. However, the former University of Kentucky defensive
26:53
lineman certainly was happy that his son decided to leave Oregon,
26:58
where he was offensive coordinator, to become the head football
27:01
coach at Kentucky. It's just surreal how this all worked out,
27:07
said Matt Stein, a Louisville attorney. It has been crazy
27:11
in a good way. Somebody asked me before this even
