Transcript
- This is the New Realm Compliance Brief, Volume One, Edition Sixty-Four, for Friday, October Sixteenth. Our top story: Illinois will not wait for Washington. The state Department of Revenue announced it will begin enforcing the Illinois Hemp Act on November twelfth, even though Congress delayed most federal hemp restrictions to December eleventh. Starting November twelfth, any consumable hemp product containing more than four tenths of a milligram of total THC per container, including THC-A, will be treated as cannabis in Illinois and may be sold only by state-licensed dispensaries. The department said unlicensed sales risk product seizures, civil or criminal penalties, and back taxes, and it advised retailers and distributors to review inventory now. Options it listed include returning product to distributors or moving it to states where sales remain legal until December. In federal news, the D E A's chief administrative law judge ordered the agency to respond by October twenty-first to a request from rescheduling opponents for new testimony and document discovery tied to a Government Accountability Office report. The marijuana rescheduling case remains paused in the meantime, extending an already long timeline. Around the states: In New Jersey, Senate and Assembly committees advanced bills that would align the state's hemp-beverage sales deadline with the federal December eleventh date, while banning online and vending-machine sales of intoxicating hemp drinks. And in Kentucky, hemp industry leaders asked state lawmakers in Frankfort to prepare state measures, including lower hemp licensing fees and restored on-premises sales, if Congress reaches a deal before the December deadline. On the radar: October twenty-first, the D E A's reply is due. November twelfth, the federal ban on synthetic cannabinoids takes effect, the same day Illinois begins enforcement. December seventh, comments are due to the T T B on sixteen information collections. And December eleventh, the federal total THC limits arrive. Full details and source links are in today's email.
