- 0:00What Should Be Included in an Illinois Prenup?
- 0:02Before you walk down the aisle, a prenuptial agreement can be one of the most thoughtful and practical decisions you and your partner ever make together.
- 0:09Far from a plan for failure, an Illinois prenup is really a shared financial roadmap that lets couples define property rights, debt responsibilities, and future expectations before stress ever enters the picture.
- 0:20Under the Illinois Uniform Premarital Agreement Act, 750 ILCS 10/2, a prenup is a legally binding contract that becomes effective only once the marriage actually takes place.
- 0:32The Act gives couples broad authority to address property rights, asset management during the marriage, what happens upon divorce or death, spousal support, and which state's law will govern the agreement.
- 0:43One of the most critical foundations of any valid Illinois prenup is fair and reasonable financial disclosure from both partners before a single signature is placed on the page.
- 0:52Under 750 ILCS 10/7(a), a party can challenge enforceability by proving the agreement was unconscionable and that they did not receive adequate disclosure of the other partner's property or financial obligations.
- 1:06Illinois courts, as clarified in In re Marriage of Woodrum, do not demand audited financial statements, but they do require honest and complete enough information for both people to make a truly informed decision.
- 1:17A thorough disclosure should cover salary, bonuses, real estate, retirement and investment accounts, business interests, debts like student loans or credit cards, and any expected inheritances or trust interests.
- 1:30When it comes to property, a well-drafted prenup clearly defines what remains separate, what becomes marital, and how commingling situations will be handled so no judge has to guess later.
- 1:40Without an agreement, Illinois presumes under 750 ILCS 5/503 that anything acquired during the marriage is marital property, and separate property can lose its protection when commingled with joint funds.
- 1:53A prenup can identify premarital assets by account number or property address, preserve their appreciation, and even explain how reimbursement works if marital money pays down a separate mortgage.
- 2:03On the question of spousal maintenance, 750 ILCS 10/4(a)(4) allows couples to modify or eliminate support entirely, limit its duration, or create a formula that differs from Illinois's statutory guidelines.
- 2:17However, under 750 ILCS 10/7(b), a court may still require support if a maintenance waiver causes undue hardship due to circumstances that were not reasonably foreseeable at the time the agreement was signed.
- 2:30It is also important to know that a prenup cannot bind a court on child support or the allocation of parental responsibilities and parenting time, as those decisions always remain under the court's authority.
