- 0:14Will Walden. Two brothers, both former
- 0:18students at the Massachusetts Institute of Technology, or MIT,
- 0:22have been charged with stealing $25 million in cryptocurrency by
- 0:26exploiting a vulnerability in the Ethereum blockchain.
- 0:30The US Department of Justice, or the DOJ, unsealed the indictment
- 0:34on Wednesday, revealing the rapid execution of the scheme.
- 0:37That took. Just 12 seconds.
- 0:40US Attorney Damian Williams stated that the scheme was so
- 0:43sophisticated that it calls the very integrity of the blockchain
- 0:47into question. He emphasized that the brothers,
- 0:50using their advanced education and computer science and
- 0:53mathematics, managed to manipulate the Ethereum
- 0:55blockchain protocols impacting millions of users worldwide.
- 1:00Oh, the accused, Anton Bueno and James Bueno, were arrested on
- 1:06Tuesday as 24 and 28, respectively, and they face
- 1:09charges including conspiracy to commit wire fraud, wire fraud,
- 1:13and conspiracy to commit money laundering.
- 1:16And if convicted, each brother could face up to 20 years in
- 1:18prison for each count. The indictment details that the
- 1:22alleged scheme began in December 2022.
- 1:24After months of planning, the brothers allegedly used their
- 1:27expertise to gain unauthorized access to quote pending private
- 1:31transactions on the Ethereum blockchain, manipulating these
- 1:35transactions to steal cryptocurrency from their
- 1:37victims. And according to the Department
- 1:39of Justice, the brothers exploited a window of
- 1:41vulnerability in the blockchain that exists between the
- 1:44initiation of a transaction and its addition to the blockchain.
- 1:49This period involves the structuring of transactions into
- 1:52proposed blocks, which are then validated and added to the
- 1:55blockchain. And the brothers allegedly set
- 1:57up a network of Ethereum validators using shell companies
- 2:01and foreign exchanges to conceal their identities.
- 2:04This allowed them to manipulate the transaction process,
- 2:07reordering blocks to their advantage and recapturing the
- 2:10cryptocurrency intended for others.
- 2:12And when victims realized their funds have been stolen, they
- 2:15requested returns. But the brothers reportedly
- 2:17refused and took steps to hide their illicit gains.
- 2:20This included creating shell companies and using private
- 2:23cryptocurrency addresses and foreign exchanges that lack
- 2:26stringent Know Your Customer Procedures, or KYC.
- 2:30Their online search history indicated extensive research
- 2:33into the methods and risks associated with their scheme.
- 2:36They search for terms such as how to wash crypto exchanges
- 2:39with no KYC, top crypto lawyers, money laundering, statute of
- 2:44limitations, and does the United States extradite to quote
- 2:49foreign countries. Now the scheme was uncovered by
- 2:51investigators who traced the financial transactions.
- 2:55Thomas Fetterusso, Special Agent in Charge of the IRS New York
- 2:59Field Office, highlighted the role of both advanced technology
- 3:03and traditional investigative methods in cracking this case.
- 3:07The indictments time coincides with the SE CS review of an
- 3:10Ethereum exchange trading fund or ETF.
- 3:13The alleged fund could impact the SE CS decision with chair
- 3:17Gary Gensler expressing concerns about investor protection in the
- 3:21volatile cryptocurrency market. Now, Deputy Attorney General
- 3:24Lisa Monaco described the theft as a technologically
- 3:28sophisticated cutting edge scheme that the brothers
- 3:31executed swiftly after meticulous planning, and the IRS
- 3:35played a crucial role in unraveling this complex fraud.
- 3:39The prosecutors allege that the brothers use their specialized
- 3:43skills, their education at MIT, to exploit Ethereum's
- 3:46transaction validation process. This process involves
- 3:49structuring pending transactions into blocks and then validating
- 3:53them, with the brothers, manipulating them for their own
- 3:56benefit. And the DOJ claims that the
- 3:58brothers actions exploited the system's vulnerabilities to gain
- 4:02unauthorized access and alter transactions.
- 4:04Stealing cryptocurrency. During the brief window before
- 4:07transactions were permanently recorded on the blockchain,
- 4:10about 12 seconds altogether. To steal all this money and when
- 4:14confronted, the brothers allegedly took extensive
- 4:16measures to launder the stolen funds and cover their tracks.
- 4:20This included setting up multiple private cryptocurrency
- 4:23addresses and using foreign exchanges without KYC protocols
- 4:27to obscure the trail of their illicit activities.
- 4:30And the brothers efforts to hide their activities involved
- 4:32detailed preparations. To evade legal repercussions,
- 4:36they searched for legal advice and information on jurisdictions
- 4:39without extradition treaties with the US, demonstrating their
- 4:43awareness of their potential legal consequences.
- 4:45And this indictment calls for the seizure of several bank
- 4:48accounts and personal property linked to the brothers,
- 4:51underscoring the scale of their alleged financial maneuvers
- 4:54designed to conceal their identities in the ownership of
- 4:56these stolen funds. And the DOJ's allegations for
- 5:00the first criminal charges of this kind mark a significant
- 5:04development in the enforcement of cryptocurrency regulations.
- 5:07The schemes, unprecedented in nature, underscores the
- 5:10challenges faced by authorities in policing the rapidly evolving
- 5:14digital currency space. This case, unfolding against the
- 5:17backdrop of the SC, CS considerations on Ethereum ETFs,
- 5:22emphasizes an ongoing need for robust regulatory frameworks to
- 5:25protect investors and maintain the integrity of blockchain
- 5:28technologies. So these two educated brothers
- 5:32face severe legal consequences for allegedly orchestrating a
- 5:36rapid and sophisticated cryptocurrency heist exploiting
- 5:40the Ethereum blockchain. The case is significant because
