- 1:51money rust He's been going around handing out checks. We're going to talk to
- 1:53him about that. Plus Ange Collier from United Way. We'll be stopping by.
- 1:59Actually, it's kind of a kind of a hybrid thing with the United
- 2:00Way and amer Cords some other folks, and they're trying to restock some pantries
- 2:05around the state of West Virginia. We will talk to them about that.
- 2:07Plus a couple of weeks ago, I had a gentleman by the name of
- 2:09Ashley Stinnett on the show who is an actor. He's part of a new
- 2:13film that's called The Good Fight. And this movie is really getting a lot
- 2:17of traction and they've had several screenings here in the area. More coming up
- 2:23this weekend. So Ashley is going to join us briefly to talk about that.
- 2:25Plus, your phone calls and text are welcome. Well. Of course,
- 2:28last night it was the state of the State Governor Jim Justice, the
- 2:32final one of the Justice regime, if you will, it's kind of a
- 2:36harsh term. Stephen Allen Adams is with us. Steve, good morning,
- 2:38how are you, Good morning, Dave happy to be here. And Brad
- 2:42Backlhenny, our own metroduced correspond He's at the Capitol right now. Brad,
- 2:46good morning, how are you Hey? Good morning. I am standing in
- 2:49a newly renovated walkway on the Senate side and it is still a construction zone,
- 2:53but it's quite lovely, all right, Warmer than it used to be.
- 2:58Well, I love the love plastic cheating time of year. And I
- 3:01hear that your guys quarters there has been newly renovated. I haven't been down
- 3:07there, is it. The press cord looking pretty good and not renovated per
- 3:10se. But we got working air conditioning, so that's that's helpful in a
- 3:15building. Yeah, it just cleaned up a little bit. There's a TV,
- 3:17there's coffee. Yeah, it's looking it's getting better. Right, he'd
- 3:21probably put a Hampton in, but without the breakfast. It's probably nicer than
- 3:24all of our apartments that we had our first apartments in college or when we
- 3:28just started out. All right. So so the speech pretty much what we've
- 3:31come to expect from a state of the State from Jim Justice. Lots of
- 3:35crowd recognition, lots of folksy colloquialisms, so to speak. Brad, let's
- 3:39start with you overall, then we'll get specific your take on the state of
- 3:43the state. Last night. I thought it was a lot of reminiscing.
- 3:46This was, in fact a bookend, and it makes sense that the governor
- 3:51would want to come full circle oratorially, so he reflected on the beginning of
- 3:58his time in office, which was you know, he came on and there
- 4:00was a budget crisis, a lot of conflict about how to resolve that,
- 4:04and the state may not be on perfect footing, but it is on much
- 4:10better footing financially, to the point that state officials instituted a twenty one point
- 4:15twenty five percent personal income tax cut that is going into effect now. So
- 4:21a lot of you know, frankly circling the bases, and I thought that
- 4:27in general that was appropriate. If your listeners heard the speech or watched it,
- 4:33I'd be interested in their perception about the ratio of reminiscing to getting down
- 4:40the business and talking actual tangible bullet points, because there were there were few
- 4:47of those. You know. The high points were five percent pay raise for
- 4:53state employees and educators. That's that's one thing the governor is advocating. Just
- 4:59really quickly. He went through six or seven economic development announcements those would have
- 5:03been the centerpiece of any other State of the State speech, and then a
- 5:09few other policy points, three more modest suggestions for tax cuts. So that
- 5:16was my impression was it was heavy on being sort of the grand finale and
- 5:23much shorter on tangibles. Stephen sure, well it was a little long,
- 5:27but you can forgive him for that. This is his final state of state.
- 5:30This is his state of the state. So going a little bit long,
- 5:34you can give him that. And I agree with Brad. There was
- 5:36a lot of reminiscing looking back what he inherited when he came in back in
- 5:42twenty seventeen, all the things that have he's accomplished since then. You can
- 5:46expect that, I will say that a lot of what he talked about last
- 5:50night, about what he wants to do, particularly with some of these projects,
- 5:55are one time expenditures, either supplemental appropriations or money that would be paid
- 6:00of available surplus at the end of this fiscal year for various projects. And
- 6:05I kind of got the impression it was a little lackluster to some extent,
- 6:11because a lot of that's going to change between now and day six, especially
- 6:14when it hits the brick wall that is Senate Finance Committee Chairman Eric tar and
- 6:17I want to get to that. You know, you talked about this spending
- 6:20package, both of you have alluded to it about four hundred million dollars,
- 6:25including a raise for teachers and state employees. Now, the afore mentioned Senate
- 6:28financier Eric tar Is saying the money isn't there, and he referred to it
- 6:32as nothing more than a political stunt from candidate for US Senate Jim Justice,
- 6:39who made that official by the way, yesterday, maybe as opposed to Governor
- 6:43Jim Justice. Your thoughts, Steven, Well, it is interesting, especially
- 6:46when you talk about the modest tax cut proposals that the governor has offered.
- 6:51One would be another increase in the homestead exemption that primarily benefits seniors, finally
- 6:58exempting all Social Security and come from the income tax. We do that kind
- 7:02of partially now, but if that's expanding further, that's something else that benefits
- 7:06seniors, which of course are the majority of this population in the state of
- 7:11West Virginia and who vote. So there's I think things to be said there.
- 7:15Certainly with the one hundred and twenty three million that you would do for
- 7:18a five percent pay raise, which the teacher seatings are really kind of without
- 7:24saying that directly is more of a cost of living adjustment because it will cover
- 7:28EA premium increases. But is it truly a pay raise. I mean,
- 7:31there's certainly some things to pick apart here that certainly myself, Brad and other
- 7:36reporters will do in the coming days because it's some of this is I do
- 7:42feel aimed at trying to move voters, but also trying not to make too
- 7:46many waves to push voters away. Would you agree with that, Brad or
- 7:51you can take it however that you want. What Senator tar said he saw
- 7:55it as as more of a political stunt. That's the way he referred to
- 7:58it, his words. When either you were after somebody caught up with him
- 8:01afterwards. Your take on that, that was Jeff Jenkins, and it was
- 8:05a good get because that was one of the big questions coming out of this
- 8:07is all right, the governor is proposing, but what will Senate Finance Chairman
- 8:11taur do as far as disposing. I don't know that I agree with the
- 8:16political assessments. I mean, I think the governor is making a general case
- 8:22that the state is on much more solid financial putting, and that lends itself
- 8:26to a Senate campaign. But these proposals themselves, they're just not that splashy.
- 8:33I mean, there is a logical reason when state employees are facing increased
- 8:37costs, including for insurance, that you would provide a pay raise. Those
- 8:43state workers do vote, Davie or state worker, you vote, so it
- 8:48doesn't hurt to keep them on your good side. But the rest of the
- 8:52proposals are you know, just just not spending items that are you know,
- 8:58if you're a listener there, can you even remember any of them? Yeah?

- 9:20slash apprenticeships today, guys. Because I always look for the little things that
- 9:24are probably insignificant to other people. The governor noted that he has driven,
- 9:28and I'm very much paraphrasing here, but he has driven a million miles since
- 9:33being a governor, gone through like four vehicles or something like that. My
- 9:37thoughts would be that how fewer miles would have been driven had the governor just
- 9:43lived in Charleston as the constitution requires. Yeah, most people. Yeah,
- 9:48for sure, for sure. I mean I remember when Governor Tomblin was in
- 9:52charge, it was always not uncommon to bump into him walking to and from
- 9:58his offices in the west wing of the cap Real building in the Governor's mansion.
- 10:01So one has to wonder, you know, compared to the miles versus
- 10:05steps, who who who did more in that regards. It's one of those
- 10:09things where, yeah, that's the one curiosity that you know, we're going
- 10:15to kind of maybe miss I don't know, is these stories about the governor
- 10:18driving in from from Louisbourg. And one hand he can say he's not charging
- 10:22the taxpayers all this good stuff, which is what he tried to say last
- 10:26night, but at the same time it also has dealt with, you know,
- 10:30legal cases and things of that nature. Yeah, so it is worth
- 10:33noting. I'm glad you brought that up. But he has said, and
- 10:35I've not looked into it. I'm sure others have that he does not get
- 10:37reimbursed from mile age, so that's on him and not the taxpayers. All
- 10:43right, guys, I know you both have to work, but I guess
- 10:46start getting down to it on budgets under the Dome Brad, you're there now,
- 10:50what's up? Yes, so there are. The way it works every
- 10:54year is the revenue side is presented by the administration first, either the Senate
- 11:00Finance Committee or the House Finance Committee, and then they flip and the budget
- 11:03side is presented to each I think the action, frankly is going to be
- 11:09on the Senate side because of friend of the program Senate Finance Chairman Tar and
- 11:15his discretion, you know, and he is a lightning rod. He is
- 11:20often criticized, but you know, the spending of the public dollar deserves scrutiny,
- 11:26and boy will send at a Tar provide that scrutiny. Steven Sure.
- 11:31Two o'clock today, House Health Committee is going to be taking up a few
- 11:35bills. While those bills is going to be requiring the new West Virginia First
- 11:37Foundation, the foundation that is going to take some of the one billion dollar
- 11:41opoid settlement money and take some of that and distribute it around. But it's
- 11:46a private foundation. They don't have to abuy by public meeting laws. They're
- 11:50not a government identity, even though there are government officials on the committee.
- 11:54So there is a bill to require it to abide by the open Meetings Act
- 11:58in order to keep it transparent. To their credit, they have been transparent
- 12:01to this point. They've had they've let press, Brad and myself know in
- 12:05others they're having meetings, but lawmakers would like to spell it out in uncertain
- 12:11no uncertain terms, that they need to have public meetings. All right,
- 12:13guys, I will say this to the listeners that if you want to know
- 12:16what's going on continually in the age of social media, whatever, make sure

- 18:03this morning, as is Mindy Robinson. Angela, good morning, how are
- 18:06you? Good morning? How are you? I'm fine And Mendy, good
- 18:08morning to you as well. Good morning, doing fantastic now, so help
- 18:11me help me figure all this out now? Okay? So because I know
- 18:14I got the initial information from from from our good friend Margaret over at the
- 18:18United Way. This is life Bridge and an AmeriCorps. I mean, how
- 18:23does this work out here? So you know in a way is our sponsor
- 18:26for our program life Bridge AmeriCorps. Okay, well are AmeriCorps program throughout the
- 18:30sight of wes Virginia. Okay, I guys, I want to make sure
- 18:33I get all that right now. There's a program a chitled the State Wide
- 18:37Pantry Restock, and I understand it's been a it's been done all month in
- 18:41honor of Martin Luther King month. So who wants to start to tell us
- 18:44about it? Sure? I can so. Martin Luther King's vision is to
- 18:48bring community and unity together, helping one another hand in hand. And we
- 18:52had noticed that several pantries get hit really hard after the holidays, and we
- 18:56wanted to see what we could do to helps circumvent that need in their communities.
- 19:02And so all of our members, we have fifty of them at twenty
- 19:04nine different sites all over the state of West Virginia from name name, all
- 19:07members and all sites, Well, I can, I can. I don't
- 19:12want to waste your time. So we do have members all the way up
- 19:18in Ohio and Brook County, all the way down to McDowell County. We
- 19:21have people in schools, We have individuals and homeless coalitions FRNs, all sorts
- 19:26of different nonprofit organizations and that are in this Family Resource Network. I'm familiar
- 19:30with the work that those folks do they do fantastic jobs. So what specifically
- 19:33are we looking for here? Well, each we instead of calling it food
- 19:37pantry, we just said pantry because certain places collect different things. We have
- 19:42baby pantries, some clicked food and pet items, so it's each area has
- 19:48their own. So we have nonperishable food items, baby items, things for
- 19:56the homeless, collitions such as blankets, socks, things like that, and
- 20:02so, like you said, a lot of these pantries collect different items.
- 20:04So that's why the word food pantries, not that you automatically think of that.
- 20:07I would think food probably makes it the bulk of it, but there
- 20:10are other other items as well. Is there a place where people can go
- 20:15to specifically see like what you need for certain areas or do you have anything
- 20:18like that set up? We did well, well, we've been keeping our
- 20:21Facebook page Live Bridge amer Corps up to date. But also you can call
- 20:25the United Way of Central West Virginia at three four Oho thirty five hundred.
- 20:30Is that correct? I don't call it too often, so it's like somebody
- 20:36saying, what's your what's your phone n Nobody knows phone numbers at all anymore.
- 20:41You just push a button on your phone. We go ahead. True,
- 20:42so they can tell any anybody across this to all of our sites,
- 20:47We've been given them up to date list on where the items can be dropped
- 20:51off in all of ours, in all nineteen sites. Talk about the need
- 20:56for these items. I mean, obviously they're depending on what you look at,
- 21:02things are going pretty well, but there's still a lot of people that
- 21:06are in need, so talk about those needs. Yeah. So we actually
- 21:10had each of our members choose what pantry they wanted to support, So we
- 21:12did not say, hey, go use this one, and we wanted them
- 21:17to contact pantries in their area and say, hey, are you in need
- 21:21and if so, what is it that you need specifically, and we can
- 21:23try to help replenish that and need. So as far as items specific ones,
- 21:32of course, food is really a big one because you know, groceries
- 21:33and after the holidays, everyone's penny pension right now, well you know,
- 21:38and there's a lot fewer pennies to pincher. Now, let me just say
- 21:41this, your pennies aren't going as far as they what they used to do
- 21:44because of inflation right now, yes, and the prices keep going up.
- 21:48I mean, it's amazing for anyone that goes to their local grocery store,
- 21:52no matter what it is, and they look at the price of something compared
- 21:56to what it was two years ago, two and a half years ago.
- 21:57So all of our members had noticed, like, are you know that these
- 22:03people are the I'm let me phrase, the pantries are getting more increased numbers
- 22:08than they've ever seen, even like COVID, Like it's almost COVID numbers,
- 22:12which is crazy scary. And from what I hear from people that do your
- 22:17sorts of things, Mandy and Angela, what I'm hearing is people that you've
- 22:22never seen before are utilizing a lot of these pantries right now. I mean
- 22:25people that not not there's any shame or stigma needing help or anything like that,
- 22:30but people that had never ever leaned on something like that in the past
- 22:34are suddenly happy to do that. Angela correct, Most time, a lot
- 22:38of people think that it's maybe homeless that utilize food pantries, and even though
- 22:45that's true, even more so, we're seeing even two income families still needing
- 22:52to utilize food pantries and everything, and we want them to be able to
- 22:56utilize those when and for it to be available so therefore, we didn't want
- 23:00the shortage to affect the kids. We even have pantries, like in the
- 23:07school pantries and Southern West Virginia Community and Technical College and Logan they keep a
- 23:11food pantry for their students, so we want that to be available. And
- 23:18this is what I've been told from people that work at some of these food
- 23:21pantries and that operate them, whether it's out of a church or something similar
- 23:23to a civic you know, or whatever it is that you're doing. They
- 23:27have said that what you think of people using food pantries, and this is
- 23:33what you just alluded to, is not actually reality. It's not necessarily the
- 23:37homeless people, although they do help a lot of those. It's people that
- 23:40are working. It's a lot of elderly people. You have a lot of
- 23:42elderly people that are on a fixed income that it just doesn't go as far,
- 23:48especially as I said earlier with the prices that we see in stores now
- 23:51correct and like elderly, like you said, they utilize the pantries. They
- 23:57We've talked to elderly that said, you know, they choose whether they purchase
- 24:02their medicine or they go to the grocery. Store for the month, and
- 24:06we don't ever want that to be, you know, the only option we
- 24:10wanted to reach out, But it's numerous working families, elderly things like that
- 24:15that are having that are struggling at the moment. So if people are listening
- 24:19to us right now and they want logistics, they want of how's this whole
- 24:22thing work at this restock the pantry, give us, give us the kind
- 24:26kind of a summary on that. I mean, how's this whole thing working.
- 24:29What's the best way for people to get involved. Yeah, So we
- 24:32have our members actually created and decorated all of some boxes that we had them
- 24:37put out into the communities that they're serving in the counties. Some of them
- 24:41are just at local grocery stores, some of them like Kroger and Pickley Wiggily
- 24:45or you can even go to local businesses. We've actually had some members reach
- 24:52out to some businesses and say, hey, you want to have a family
- 24:55or a competition amongst your staff, you can bring in stuff. So we've
- 24:59been really creative as far as how to draw them in. But you can
- 25:03certainly check out our social media. As far as Life Bridge America Corps.
- 25:08We have created marketing packets for all of our sites and locations as far as
- 25:12drop off locations even so be sure to check out that. But really,
- 25:18if you're in the listening area and you're not sure where you can put your
- 25:23donations, definitely called the United Way of Central West Virginia and we will certainly
- 25:27put your donations to a good spot. Can you accept cash donations if somebody
- 25:32would want to do that, Yes, we can. Actually you can donate
- 25:36it to directly to the United Way of Central West Virginia and just say that
- 25:38you want it to go towards the Life Bridge Americ Corps program Pantry Restock and
- 25:42we can certainly make sure that those funds get directed towards. This is going
- 25:45to be going on pretty much, you know, likes you said an Honor
- 25:48Martin Luther King month right till the end of January. We're going to be
- 25:53the boxes and the items will be collected and then distributed to the designated pain
- 26:00trees that they've chosen. You Okay, it's twenty seven minutes away from ten

- 26:32of that nature. I guess what I'm asking is because I know I have
- 26:34a lot of business people that listen to this show. I'm putting you on

- 27:11business out there that would be amazing. I had a text here to the
- 27:14show, and for those if you're new to the show, I get more
- 27:17text and phone calls. Somebody said that we're talking about animals and they wanted
- 27:22to know do you do anything to help out animals. I know you're primarily
- 27:26focused on people, but go ahead. Yeah, So we do have one
- 27:30site that is directly helping as far as pet items. However, we also
- 27:37know of other pantries in the area here as far as Kenawa County, and
- 27:41if we don't know, we'll find it and we'll make use. Yeah.
- 27:45I guess I appreciate you being to give us the information. Again, where
- 27:48people can learn more, you can call the United Way of Central West Virginia

- 30:57movie out. It's called The Good Fight. A lot of les film here
- 31:00in West Virginia co stars John Schneider of Dukes of Hazard fame, and he's
- 31:04going to join us to talk about some additional screenings for that movie that have
- 31:07been added to the schedule. Texas Dave, when are we going to hear
- 31:11about the good news of the Western India Democrats efforts to legalize cannabis. Now,
- 31:15I'm a realist to know it won't happen due to republicans disdain for personal
- 31:18freedoms and they're taliban like policies, but it would be nice to hear about
- 31:22the efforts of the party that values personal freedom and responsibility. I do think
- 31:26that you are going to hear some more about recreational cannabis on the in the
- 31:33session. Rusty Web is with us right now. I've got the sarcasm in
- 31:36that. Now you are. I think the Democrats are the party of personal
- 31:42responsibility. Rusty Web making a cameo appearance with laughter this one. How are
- 31:48you man? Fantastic great to have you here. Yeah, thanks for having
- 31:52me. All right, So I was going to ask you, I actually
- 31:55ask you this off the air last night. If you caught any of the
- 31:56state of the state. But I've already got my answer. You said you
- 31:59did not see much of the stay was watching Andy Griffith at the time,
- 32:04which one doesn't matter. They're all good. So you didn't watch it,
- 32:08okay, So what do you expect from the upcoming legislative session? You could
- 32:12be nine uh so, here here's what. Here's what happens. When you
- 32:15become the super majority. You think that everything is just going to be smooth.
- 32:21But the fact is is, now you have factions, particularly in the
- 32:23House of Delegates. So now what was your what what was your enemy at
- 32:29one time was the opposing party? Now your enemy is are different factions that
- 32:35you're trying to keep together to do things. For example, I think West
- 32:43Virginia is going to eventually go to a sales tax. I mean, that's
- 32:45that's clearly what the idea is. By reducing the income tax, you have
- 32:52to make that revenue up somewhere else. And they the Republicans tried it in
- 32:58one in one bill and it was defeated by the Republicans. Right, So,
- 33:04how do Republicans meet Republicans because of factions? But now when you're down
- 33:08to three and a half percent income tax. You're gonna have to make that
- 33:13up. And I think the sales tax may be. And I don't know
- 33:15if the governor mentioned it, because again I didn't watch it, But you
- 33:21have to go to this sales tax, which I think I thought was a
- 33:23brilliant idea. Ed Gaunch introduced it when he was a state senator. My
- 33:29mother who's passed away, lived in Tennessee. It's wonderful. I have a
- 33:34place in Florida. It's wonderful. It's just everybody pays their fair share.
- 33:38Nobody cheats on a sales tax. The more you buy, the rich buy
- 33:43more, they pay more, the poor by less, they pay less.
- 33:46It's a very equitable, equal tax, and I think that's I think that's
- 33:52where we're headed. But again, if nobody mentioned it last night, maybe
- 33:54I'm totally off key. I don't recall that being mentioned. He did talk
- 33:59about a lot about pay raises for state workers and for teachers, and then
- 34:04Senator Tark afterwards and basically said, no, it's not going to happen.
- 34:07He's not there. Let me let me get your opinion on this, and
- 34:09then I'll get to why you're actually here today. There's been some talk about
- 34:13capital punishment. Senate President Craig Blair has said he wants it for those that
- 34:17are guilty of dealing fentanyl. Mike Stewart, former US attorney, current state
- 34:22senator, attorney or candidate for Attorney General, who had scheduled to have on
- 34:24the show tomorrow, just got a text from mister Stewart. He's not going
- 34:27to be able to be here tomorrow because of commitments. Owner of the capital.
- 34:30He's really pushing this thing. For give me the quick thirty to forty
- 34:32five seconds on Rusty Webb's opinion on capital punishment in West Virginia. I've always
- 34:36favored it under certain circumstances. But it's not going to pass now. I
- 34:40don't. I'm not going to see the light of day either. But I
- 34:43may have signed a few back in the back in the day when I was
- 34:45down there. But you know, the argument against it is kind of an
- 34:50odd argument. It says it's going to cost the taxpayers too much because of
- 34:52all the appeals. Well, that's on capital punishment nationwide, is redit it
- 34:59costs you much to execute someone, not not the actual execution, it's all
- 35:02the peals and the money. Well, it's like ten to twelve years,
- 35:06I mean before somebody actually goes down. All right, the real reason you're
- 35:08here. You've been going around all over man handing out checks like Oprah.
- 35:13Yeah know, you get money, get it, you get money, You
- 35:15get a check. What's this all about? Well, I just felt like
- 35:20after a six year battle, standing shoulder to shoulder with the county commissioners that
- 35:27I represent and mayors that I represent, and it deserves that this moment deserves
- 35:36something bigger than getting a check in the mail. And I'll say that most
- 35:38of them opted for a check. Yes, this is the this is the
- 35:43first check they'll receive. Uh, they will receive what thirteen total, thirteen
- 35:47or fourteen told over the next thirteen years. And I just felt like the
- 35:52first, you know, the first check should should be a big deal that
- 35:57people should be able to, you know, mark this moment in time,
- 36:01that this is when we can change change generational addiction in West Virginia. And
- 36:07you're going to city councils big and small, I mean a couple of smaller
- 36:12ones the other day. So what will the municipalities use this money for?
- 36:17Well, the strings, you know, there are strings attached. There's about
- 36:21a fifteen page document that was actually drafted by the Purdue in the Purdue bankruptcy
- 36:28that we adopted for for West Virginia because it was it was vetted by hundreds
- 36:32of lawyers around the country. It has strings and it basically if if there's
- 36:38a direct or indirect way to educate, treat or abate which is a big
- 36:45term we use in equity abate the drug problem, then and then you can
- 36:52use it for that. But I mean, there's no guarantee it's going to
- 36:55be used for that. No, no, it has to be used for
- 36:58that. Matter of fact, there's a lot there's an auditing system that the
- 37:01West Virginia First Trust Board will will audit every year. So they're not going
- 37:07to use it to put on a No, you can't pave with it,
- 37:10you can't pay, you're not gonna put on a car show with it,
- 37:13or no. No, no no. There are streets attached. No no,
- 37:15and that most of them, I think they should most of go in
- 37:19a special revenue account. Okay. And the reason I bring that up is
- 37:21because let's be honest with the arrested. And you know this, West Virginians
- 37:24don't always have the best record. Those in power of using money what it's
- 37:29designed for. And I'll give you the perfect example was tobacco. It's never
- 37:32been used for its purpose for an never education used. We're still getting tobacco
- 37:38checks from the nineties and it's never been used. And that's another criticism.
- 37:43I have not another criticism, but the legislature should have They should, they
- 37:47should, they should use the money the way it was supposed to be intended.
- 37:52Let me ask you this. I want to ask you to defend your
- 37:53profession for a moment. All right, now, we got attorney rusting way
- 37:55up here. Some have said that some of the attorneys and some of these
- 38:00cases are getting too big a slice of the proverbial pie. Your thoughts on.
- 38:02It's not true at all. Again, I've been in the car with
- 38:08the Attorney General and he will literally say, you know, I'm trying to
- 38:13get the fees lower, right, And he goes, you understand, right,
- 38:15And I said, yeah, I understand, but let me let me
- 38:17just give you before and after. Okay, his predecessor paid thirty to forty
- 38:23percent contingency fee on these types of cases. Okay, do you know what
- 38:30the Attorney general's effective rate was for his attorneys? What is that seven point
- 38:35five percent. That's a huge deduction difference. Okay, Again, the panel,
- 38:42the West Virginia Supreme Court appointed MLP Multi Litigation Panel, determined that fifteen
- 38:51percent of the gross amount was an appropriate amount to pay the attorneys for the
- 38:57cities and counties and for the attorneys who what we called did the work,
- 39:02did the work. You know, everybody refers cases. Nobody does the work,
- 39:07right, so somebody has to do the work. That was fifteen percent.
- 39:12That is at least half of what used to be passed out in this
- 39:15state, and maybe less than half if it's forty percent. So those critics
- 39:22are it's it apparently I don't know who they are, but it's apparently politically
- 39:27driven because it's not factually correl One of those has been our good friend Greg
- 39:30Thomas, who's frequently on the show for Citizens Against Lawsuit Abuse. And I
- 39:34know I had the attorney general and candidate for Governor, Patrick Morrissey on the
- 39:37show earlier. It was Tuesday of this week, and he wanted to specifically
- 39:43address that because I didn't have it all the list of things to talk about,
- 39:45and he kind of jumped in there and said, hey, before we
- 39:47close, you can go back and listen to the show from Tuesday before we
- 39:51close. I want to address this and he pretty much said the same thing
- 39:52you're saying now. Well, he actually the way it worked was a special
- 39:58commissioner made a recomd condation to the panel, and there's an opportunity for objections.
- 40:02Well, the Attorney General filed objections to the fifteen percent. He wanted
- 40:07it to be what his rate is, which is his effective rate. He
- 40:13does this diminishing You know you've seen the diminishing premium on insurance. Yea,
- 40:17that's the way he scales it. The higher, the higher the amount,
- 40:21the lower the fee. And he wanted it to be a seven point five
- 40:24percent effective rate like his was, and they overruled his objections. But he
- 40:29tried the turnty rusty webs here at Dave Allen showing five any line brought to
- 40:34you a part by Meek's Realty Group is a locally owned real estate powerhouse.

- 40:55Mister Webb finished for right now. I'm going to come back and revisit
- 41:02the towns that I'm going to go ahead and send them the checks. But
- 41:06the towns that I missed, I'm going to come back and we're gonna We're
- 41:09going to give it a rest during the legislative session because I know these mayors
- 41:14are going to be busy, So I'm going to revisit it right after the
- 41:19legislative session and finish them off with. I'm going to send them checks.
- 41:23You're going to finish them all. Yeah, yeah, that's the words.
- 41:27But I'm going to complete I'm going to complete singing all the clients. And
- 41:31it's not just about that. It's about me appreciating them allowing me to represent
- 41:37them. I mean, it's it's a big deal to me when someone hires
- 41:39me, and I want to show my appreciation and I want to thank them
- 41:44personally at some of these times. And I don't know, I mean,
- 41:46drugs are a problem nationwide. We all know that. I mean, that's
- 41:50like the dumbest statement of the year. However, I don't think sometimes rusty,
- 41:54And maybe it's because I'm a little a little closer to the situation because
- 41:58of where I'm from. From southern West Virginia. You see drug issues in
- 42:01Charleston, Huntington and all these places, But there are towns, particularly in
- 42:06southern West Virginia, that have been completely devastated. I mean, I'm from
- 42:10Logan and Madison. I know where there you go, and I went to
- 42:15Logan, I went to Logan and Gate. That was my last check.
- 42:17Literally, Logan down to Serafino Mayor and Noletti and those fine folks down them
- 42:23him, I love him. But but what my point is is that,
- 42:27you know, Huntington has kind of been the center of the OBII crisis.
- 42:30The Lord knows that those folks have suffered so much there. But and I'm
- 42:36not pitting one town against no that the town is still there. I mean,
- 42:37Marshall University is still doing what it does, and the hospitals still doing
- 42:40what to do. Go down to places in McDowell County and look look at
- 42:45what they have what's been done there. Entire freaking towns have been wiped out,
- 42:51wiped out and I don't think sometimes maybe our listeners don't understand what this
- 42:57the devastation that this crap has has put on people starting going back, you
- 43:01know, from the pill the pill mill days up to up the current.
- 43:06You know, so well, doing good work out there, man, appreciate
- 43:08it. Thank you. Let me just say one more thingking have that I
- 43:12have. I have received a couple of questions about individual claims. The individual
- 43:20claims were all made if you hired an attorney or you hired me for that
- 43:24matter, for an individual claim as relates rerated to addiction to opioids. Those
- 43:31claims were all made in the Purdue bankruptcy and that is pending before the US.
- 43:36Okay, because I actually have a text here about that. Somebody said,
- 43:39do you have checks for families or lost love once their money? Not
- 43:42the states or the counties or the city. So explain now, if you
- 43:45filed a claim with the Purdue bankruptcy, you should receive some some monies.
- 43:52If you did not file a claim with the Purdue bankruptcy, there are no
- 43:55individual checks that are going to be just how does one go about that?
- 43:59Way? It's done. It's okay. So you had to file with the
- 44:01it was was two years ago. Two years ago was the filing. So
- 44:05if they've not done that, they're not going to get anything, not no
- 44:07individual money, not out of this money, uh, not anywhere until Purdue
- 44:13is resolved. So what you're doing, you're handing out is not it's for
- 44:15the towns. It's not for individuals, not for individuals. The only money
- 44:20will come from Purdue. From Purdue, all right, that's it. Rusty

- 47:25there, Biden has nothing to do with West Virginia bring it into businesses,
- 47:30So please stop. West Virginia has been a Democrat state for years, and
- 47:32I've always ran off business. Now we are a Republican majority of the state
- 47:37is being run like a business. Text says Dave. Not to recreational marijuana
- 47:42in West Virginia. Too much addiction in West Virginia and this nation. This
- 47:45is simply common sense, says that text. All Right, I told you
- 47:47a few weeks ago about this movie that definitely has a West Virginia vibe to
- 47:52it. It's called The Good Fight. A lot of it filmed at West
- 47:53Virginia. Stars a West Virginia guy coloding to be exact by the name of
- 47:58Ashley Stinnett. This movie's turning out to be a head. A couple of
- 48:00screenings have already been held around the state. More a coming. The start
- 48:04of the film, West Virginia native athlete Stennett returns to the show, Ashley,
- 48:07good morning, how are you? Hey? Good morning, Dave.
- 48:09I'm doing great, my friend, how are you doing? They've got limited
- 48:12time, so I want to get right to it. What has the response
- 48:15been so far? It's been amazing. It's been humbling. Last weekend,
- 48:20The Good Fight was the top growthing movie in this entire market, which is
- 48:27pretty amazing. We had sold out crowds and Huntington and Taye Valley. The
- 48:30great news is the movie is going to be back at Marquis Cinemas in Huntington,
- 48:36South Ridge, South Charleston, and in Beckley this coming weekend. So
- 48:40it's been a great grassroots effort. And I should add it's also coming back
- 48:45to Tay Valley, so it's basically playing in the largest market in the state.
- 48:50If we have another good weekend, it's absolutely moving beyond the West Virginia
- 48:54borders, which is great. I mean, this is not about me,
- 49:00h. This is about showing the rest of the country that West Virginians can
- 49:06make high quality motion pictures. You know, we can compete with you know,
- 49:10La New York and Atlanta. So we're just really encouraging people to uh,
- 49:15you know, pack those theaters. You know, it's a good film.
- 49:20It's a faith based boxing movie, and you can bring kids. It's
- 49:23you know, it's a family, family film. And last weekend was tremendous,
- 49:29it really was. And you're headed where again this weekend. Yeah,
- 49:32this weekend the movie. We will be playing at Marquee Cinemas in Huntington,
- 49:37Charleston, which is the south Ridge Marquee Cinemas, and also the Marquee Cinemas
- 49:43in Beckley. And some of the Facebook pages are showing the movie trailer.
- 49:50You can check their websites for showtimes and listings and ticket information. But it'll
- 49:54be playing all weekend across the southern half of West Virginia at cinemas. All
- 50:00right, is there a good place? I know you said some of the
- 50:02movie places are showing trailers, but as there like a simple Facebook page or
- 50:07a website where people can learn specifically about this, hit that, and then
- 50:09I got to cut you loose. Yeah, it's super easy. The Good
- 50:13Fight official movie page. Find it on Facebook. You can watch the trailer
- 50:16and again Huntington, Kay's Valley, Charleston and Beckley be in the theaters.
- 50:21It's a great weekend to go to the movies. Indeed it is, Ashley.
- 50:23I appreciate you being here, man, Thanks a lot, Thanks a
- 50:27friend. All Right, Ashley, send it. Can you go check out
- 50:29this movie again? Plenty of opportunities to do it. Three minutes away from
- 50:31ten to Dave Allen showing five any I brought to you a part by Morgan
- 50:35Amorican America's largest injury law firm. Do you want to remind you that one

- 51:16Tex says Dave, are you asking your listeners to think about other towns at
- 51:22people other than themselves. Are you asking your listeners to have empathy for other
- 51:24people? Dave? Are you becoming woke? I think that's a little sarcasm
- 51:29there, Tex says, I like Rusty Webb. He's a plaintiffs attorney through
- 51:34and through. Don't let him pretend otherwise. Ask him what all the money
- 51:36he's made suing employers and businesses. Well, I'll let him defend that the
- 51:38next time he's on the show. Tex says, Democrats like the earlier text
- 51:43are calling Republicans of Taliban are exactly why so many people like me left that
- 51:47party a long time ago. You can disagree with policy, that's fine,
- 51:51but why do you people have to be so freaking nasty to others. Oh?
- 51:54By the way, thanks to Jabber and Joe, the Taliban and noted
- 51:58terrorist group now has probably the great to supply of US taxpayer funded military equipment
- 52:02in the world. Remember that in November voters. All right, so the
- 52:07packed show, we got through it, the A train and I pulled it
- 52:09off. All right, we gotta go Hobby Live at the Capitol again coming
- 52:15up at ten o six and the AARP Broadcast studios. My producer was the
