Dual Sovereignty: The Legal Sledgehammer Waiting for Ghislaine Maxwell If Pardoned (Part 2) · Beyond The Horizon

Speaker 1: What's up, everyone, and welcome to another episode of the
• 0:03
Speaker 1: Epstein Chronicles. In this episode, we're going to pick up
• 0:06
Speaker 1: where we left off, talking about New York State and
• 0:09
Speaker 1: the possibility of Glenn Maxwell being charged at the state
• 0:12
Speaker 1: level if she does receive a pardon. Financial institutions implicated
• 0:18
Speaker 1: in the Epstein-Maxwell network have already faced lawsuits in New
• 0:21
Speaker 1: York Civil Court, including JPMorgan Chase and Deutsche Bank. And
• 0:25
Speaker 1: for good or for ill... New York State has been
• 0:28
Speaker 1: a hub of legal accountability when any has been brought
• 0:31
Speaker 1: forward for the broader Epstein enterprise. In this context, bringing
• 0:36
Speaker 1: criminal charges against Maxwell would not be a radical move.
• 0:39
Speaker 1: It would be a continuation of an existing legal and
• 0:42
Speaker 1: moral campaign to expose and punish the entire architecture of exploitation.
• 0:48
Speaker 1: Her pardon would not invalidate the facts. It would only
• 0:51
Speaker 1: accelerate the moral necessity to hold her accountable elsewhere. In
• 0:56
Speaker 1: addition to legal grounds New York has political capital to spend,
• 0:59
Speaker 1: prosecutors have publicly aligned themselves with survivor-focused prosecution, promising that
• 1:04
Speaker 1: no one is above the law. If Maxwell were suddenly
• 1:08
Speaker 1: walking free due to a federal pardon, their credibility would
• 1:11
Speaker 1: be on the line. To maintain public trust and fulfill
• 1:14
Speaker 1: their pledges, they would be under immense pressure to act.
• 1:17
Speaker 1: In that moment, inaction would be louder than any indictment,
• 1:21
Speaker 1: and far more damning. The pardon of Maxwell would also
• 1:25
Speaker 1: force the public to confront an uncomfortable truth, that even
• 1:29
Speaker 1: in cases involving child sex trafficking and elite corruption, the
• 1:33
Speaker 1: federal system can be bought or bargained with. Such a
• 1:36
Speaker 1: move would not just be a betrayal of survivors, it
• 1:39
Speaker 1: would signal to predators everywhere that political power can insulate
• 1:43
Speaker 1: them from consequences. The only remaining defense against that message
• 1:48
Speaker 1: would be state prosecution, an assertion that some jurisdictions still
• 1:52
Speaker 1: believe justice is should be blind, even when the defendant
• 1:55
Speaker 1: has friends in high places. Critics might argue that a
• 1:58
Speaker 1: second prosecution would be double jeopardy or an abuse of power,
• 2:02
Speaker 1: but legally, this claim doesn't hold water. The U.S. Supreme
• 2:06
Speaker 1: Court has time and time again affirmed the dual sovereignty
• 2:11
Speaker 1: doctrine allowing both federal and state prosecutions for the same conduct.
• 2:16
Speaker 1: And in moral terms, one could argue that no amount
• 2:18
Speaker 1: of legal technicality should stand between a predator and accountability.
• 2:23
Speaker 1: especially when survivors are still bearing the scars. Maxwell's ability
• 2:28
Speaker 1: to manipulate legal systems should not be mistaken for innocence.
• 2:32
Speaker 1: If anything, it makes her even more dangerous. We must
• 2:36
Speaker 1: also consider the ripple effect. If Maxwell were allowed to
• 2:39
Speaker 1: walk free, it would embolden others, those still lurking in
• 2:42
Speaker 1: the shadows of Epstein's network. It would send a message
• 2:45
Speaker 1: to co-conspirators, silent enablers, and participating clients that accountability is optional. consequences, negotiable,
• 2:53
Speaker 1: and well-placed political favor is the ultimate get-out-of-jail-free card. State
• 2:58
Speaker 1: prosecution in New York would not just be about Maxwell.
• 3:01
Speaker 1: It would be a warning to every man and woman
• 3:04
Speaker 1: who ever thought what they did with Jeffrey Epstein would
• 3:07
Speaker 1: stay buried forever. Justice, if it's going to mean anything
• 3:11
Speaker 1: at all, must extend beyond one courtroom, one jurisdiction, or
• 3:14
Speaker 1: one verdict. If the federal government fails to carry the
• 3:17
Speaker 1: full weight of moral accountability and then it becomes a
• 3:20
Speaker 1: solemn duty of the states to step up. And no
• 3:23
Speaker 1: state is better positioned to do so than New York,
• 3:26
Speaker 1: where the crimes were committed, where the victims were abused,
• 3:29
Speaker 1: and where the walls of Epstein's townhouse still whisper the truth.
• 3:33
  Speaker 1: A pardon doesn't erase that, but a prosecution, state-level, unflinching,
• 3:37
Speaker 1: and unapologetic just might begin to restore what was lost.
• 3:42
Speaker 1: If New York chooses not to act, it looks at
• 3:45
Speaker 1: a mountain of evidence, the pain of survivors, the clear-cut
• 3:48
Speaker 1: violations of state law, and still shrinks away. Then, it
• 3:51
Speaker 1: will confirm what so many already suspect, that justice is selective, conditional,
• 3:56
Speaker 1: and reserved for the powerless. It will say that no
• 4:00
Speaker 1: matter how many laws are broken, no matter how many
• 4:03
Speaker 1: girls are harmed, accountability can still be bartered away behind
• 4:06
Speaker 1: closed doors if the right names are on the guest list.
• 4:09
  Speaker 1: This isn't just a failure of the prosecution, it's a
• 4:12
Speaker 1: betrayal of public trust. Because Ghislaine Maxwell isn't some confused
• 4:17
Speaker 1: middleman or low-level fall guy. She was the engineer of logistics,
• 4:22
Speaker 1: the gatekeeper, the fixer, the madam who made it all
• 4:25
Speaker 1: run smooth so the rich never had to look dirty.
• 4:28
Speaker 1: And she did it all in New York City, over
• 4:31
Speaker 1: and over again, in the same brownstone, behind the same
• 4:35
Speaker 1: locked doors, on the same beds that prosecutors now pretend
• 4:38
Speaker 1: are too far in the past to matter. But they
• 4:41
Speaker 1: do matter. Because the girls that were abused there still
• 4:45
Speaker 1: live with it, and they still remember. Letting her skate
• 4:48
Speaker 1: would do more than absolve Maxwell. It would stain every
• 4:52
Speaker 1: institution that remained silent, every official who once promised the
• 4:55
Speaker 1: public they would leave no stone unturned, every prosecutor who
• 4:59
Speaker 1: posed in front of cameras and declared war on child
• 5:01
Speaker 1: sex trafficking. If all that fire and fury ends in
• 5:04
Speaker 1: a shrug and a sigh because a president handed her
• 5:07
Speaker 1: a get-out-of-jail-free card, then what was it ever worth? What
• 5:11
Speaker 1: did any of it ever mean? Because let me tell
• 5:15
Speaker 1: you right now, somewhere in this country, there's a teenage
• 5:17
Speaker 1: girl being groomed right now by someone with money, influence,
• 5:21
Speaker 1: and a contact in high places. That predator is watching
• 5:25
Speaker 1: how this ends, watching to see if this system actually
• 5:28
Speaker 1: has teeth, or if it just gnashes its gums for show.
• 5:32
Speaker 1: If Maxwell is pardoned and the state does nothing, it
• 5:35
Speaker 1: will send a loud, clear signal, don't worry, keep doing
• 5:38
Speaker 1: what you're doing. If you're rich enough, connected enough, shameless enough,
• 5:42
Speaker 1: Nothing will ever touch you. And that should terrify every
• 5:46
Speaker 1: decent person who has ever demanded better. Because if we
• 5:50
Speaker 1: can't even prosecute someone like Elaine Maxwell, someone convicted in
• 5:53
Speaker 1: federal court, someone named by hundreds of survivors, someone who
• 5:57
Speaker 1: ran operations out of a mansion in broad daylight, then
• 6:01
Speaker 1: who can we ever prosecute? What does a crime even
• 6:04
Speaker 1: look like anymore, if not this? How grotesque does the
• 6:07
Speaker 1: truth need to be before someone actually picks up the
• 6:10
Speaker 1: phone and files the fucking charges? And my advice to
• 6:14
Speaker 1: prosecutors in New York? Don't wait for political permission. They
• 6:18
Speaker 1: should not be hesitating out of fear of blowback. Their
• 6:21
Speaker 1: job is not to serve the headlines or cater to
• 6:23
Speaker 1: the powerful. Their job is to serve justice. And right now,
• 6:27
Speaker 1: that job is sitting on a platter. Ready, waiting, fully documented,
• 6:32
Speaker 1: legally sound, morally obvious. All that's left is the courage
• 6:36
Speaker 1: to act. And if they don't, we need to be
• 6:40
Speaker 1: honest about what we're witnessing. It won't be justice, it
• 6:43
  Speaker 1: won't be closure, it'll be a white-gloved handshake between institutions
• 6:47
Speaker 1: that protect each other, while the rest of us are
• 6:49
Speaker 1: told to clap and move on. It'll be the final
• 6:52
Speaker 1: chapter in a story of power shielding power, dressed up
• 6:55
Speaker 1: in legalese and cowardice. It will confirm that even in
• 6:59
Speaker 1: the face of monstrous, well-documented evil, there are still some
• 7:03
Speaker 1: doors no DA is willing to knock on. But if
• 7:07
Speaker 1: they do act, If New York does what the federal
• 7:09
Speaker 1: system would be too compromised to do, then for once,
• 7:12
Speaker 1: the survivors win. Not fully, not completely, but enough to
• 7:16
Speaker 1: know that their abuser didn't escape scot-free. Enough to believe
• 7:19
Speaker 1: that the truth still matters, that power can be checked,
• 7:22
Speaker 1: that pain doesn't have to be swallowed in silence. And
• 7:25
Speaker 1: in a world this broken, that would be something real,
• 7:29
Speaker 1: something worth fighting for. Because the question isn't can New
• 7:32
Speaker 1: York prosecute Ghislaine Maxwell? The law says yes. The facts
• 7:36
Speaker 1: say yes. The survivors are screaming yes. The only question
• 7:40
Speaker 1: left is whether anyone in power is brave enough to
• 7:43
Speaker 1: say it out loud. And if they aren't? If they
• 7:46
Speaker 1: just let her disappear into the shadows with a smug
• 7:49
Speaker 1: grin and a clean slate, then let it be known
• 7:52
Speaker 1: justice didn't fail, it was told to stand down, and
• 7:55
Speaker 1: it obeyed. So, here we are. After everything we've laid out,
• 8:00
Speaker 1: the jurisdiction, the evidence, the survivor testimony, the legal precedent,
• 8:04
Speaker 1: you're left with one simple truth. Glenn Maxwell can still
• 8:07
Speaker 1: be prosecuted by the state of New York. The law
• 8:10
Speaker 1: allows it. The facts demand it. And the survivors, they
• 8:13
Speaker 1: deserve it. A federal pardon's not a magical spell. It
• 8:17
Speaker 1: doesn't absolve guilt. It doesn't raise pain. It doesn't mean
• 8:20
Speaker 1: she didn't do it. It just means someone with power
• 8:23
Speaker 1: decided to pretend that she didn't. And if that's the
• 8:26
Speaker 1: standard we're accepting now, if presidential whim can overrule everything,
• 8:31
Speaker 1: we have slipped into something far darker than injustice. We've
• 8:34
Speaker 1: slipped into feudalism, where loyalty, silence, and connections matter more
• 8:39
Speaker 1: than truth. But this story doesn't have to end that way.
• 8:43
Speaker 1: New York has been handed an opportunity few prosecutors ever get.
• 8:47
Speaker 1: A second chance. A clean shot. An open door to
• 8:50
Speaker 1: right a wrong that could soon go global in its insult.
• 8:54
Speaker 1: And if they fail to walk through it, then they're
• 8:56
Speaker 1: not just complicit in Maxwell's escape, they're accessories to the
• 9:00
Speaker 1: erosion of public faith in justice itself. Because let's be honest,
• 9:05
Speaker 1: if Ghislaine Maxwell walks away clean, then who doesn't? Who's
• 9:09
Speaker 1: left to answer for Epstein's empire? The co-conspirators, the clients,
• 9:12
Speaker 1: the billionaires, who were shuffled into silence by the cowardly
• 9:15
Speaker 1: media outlets and white glove lawyers? If the person who
• 9:19
Speaker 1: helped build the pyramid is allowed to vanish into the shadows,
• 9:22
Speaker 1: then no one else is ever going to be dragged
• 9:24
Speaker 1: into the light, no matter what she tells the DOJ,
• 9:27
Speaker 1: as she sits in that jail cell. And what does
• 9:30
Speaker 1: that mean for the survivors? For the girls who were exploited, discarded,
• 9:34
Speaker 1: and then ignored? What message do we send when the
• 9:37
Speaker 1: system that was supposed to protect them instead shields their abuser? Again.
• 9:42
Speaker 1: Do we really expect them to keep believing in justice?
• 9:45
Speaker 1: Even when the clearest, most documented case of elite abuse
• 9:48
Speaker 1: gets flushed down a political toilet? Yo, this isn't complicated.
• 9:52
Speaker 1: It's not abstract. The mansion was in Manhattan. The girls
• 9:56
Speaker 1: were trafficked across state lines. The grooming happened on New
• 9:59
  Speaker 1: York's This isn't a question of jurisdiction. It's a question
• 10:03
Speaker 1: of will, of spine, of whether anyone in a position
• 10:07
Speaker 1: of power has the courage to go after someone whose
• 10:09
Speaker 1: Rolodex still makes people nervous. And maybe that's the point.
• 10:13
Speaker 1: Maybe the silence is an incompetence it's fear. Maybe the
• 10:16
Speaker 1: reason so many powerful people want this case buried is
• 10:19
Speaker 1: because Ghislaine Maxwell knows too much. And maybe the reason
• 10:23
Speaker 1: they're willing to let her walk is because they'd rather
• 10:25
Speaker 1: set her free than hear her speak. But justice isn't
• 10:28
Speaker 1: supposed to be shaped by secrets. It's supposed to break
• 10:31
Speaker 1: them open. So here's the ask. Not for forgiveness, not
• 10:36
Speaker 1: for hope, but for action. For a state prosecutor in
• 10:39
Speaker 1: New York to step up and say, not on my watch.
• 10:42
Speaker 1: For someone, anyone, in a position of authority to remember...
• 10:46
Speaker 1: Why they took that oath in the first place? The
• 10:48
Speaker 1: law is still there, the files are still there, and
• 10:50
Speaker 1: the pain? It never left. If this country still believes
• 10:54
Speaker 1: in consequences, this is the moment to prove it. Not
• 10:57
Speaker 1: with statements, not with symbolism, but with charges, real ones,
• 11:01
Speaker 1: that stick, that sting, that tell every predator still lurking
• 11:05
Speaker 1: in the shadows, you're not safe anymore. Because if we
• 11:08
Speaker 1: let Glenn Maxwell vanish into the wind, then justice didn't lose,
• 11:12
Speaker 1: it surrendered, and it will never be taken seriously again
