- 3:46structural asymmetry. Because developed nations own
- 3:50the data pipelines and the modeling capabilities.
- 3:52Developing nations enter diplomatic negotiations at a
- 3:55systemic disadvantage. I see They are essentially
- 3:58forced to negotiate using the terms, the risk assessments and
- 4:01the predictive models generated by the very countries that
- 4:04historically industrialized and emitted the most carbon.
- 4:07Wait, so is the research telling us that whoever controls the
- 4:10climate models basically controls the rules of
- 4:12international diplomacy? It is because defining the risk
- 4:16is just as powerful as fixing the risk.
- 4:19So it's essentially like playing poker, but one player not only
- 4:22has the most chips, they also own the casino, printed the deck
- 4:25of cards and get to dictate what a winning hand looks like.
- 4:30That's a great way to put it. Like if a country in the global
- 4:32N dictates the specific algorithmic models for how sea
- 4:37level rise will impact a coastline in the Global South,
- 4:40the global S has to argue for financial reparations using the
- 4:43global N's math. The casino analogy captures the
- 4:46structural imbalance perfectly, and the asymmetry is managed by
- 4:49what the text call epistemic communities.
- 4:52What are those? There are these exclusive
- 4:54transnational networks of recognized experts who
- 4:57standardize the data formats and define what constitutes A
- 5:00legitimate risk. Oh wow, yeah.
- 5:02If a developing nation cannot independently run localized high
- 5:05resolution models of drought impacts, they cannot effectively
- 5:09argue for a specific technology transfers or loss in damage
- 5:12funds. The science doesn't just inform
- 5:14the diplomacy, it actively constructs the boundaries of
- 5:17what can be negotiated. OK, so if developing nations are
- 5:20already losing the data war at the negotiating table, meaning
- 5:24they can't even define the environmental risks on their own
- 5:27terms, what leverage do they actually have left?
- 5:30Historically, a state's ultimate leverage is its physical
- 5:34territory, its actual borders. Right, but our sources from the
- 5:38US Indo Pacific Command look at what happens when that physical
- 5:41collateral literally dissolves and it fundamentally breaks how
- 5:45we understand the map. It does, assuming you are
- 5:47already familiar with the UNCLS. The United Nations Convention on
- 5:51the Law of the Sea. Yes, exactly.
- 5:53You know, it grants coastal states an exclusive economic
- 5:56zone, or EEZ, extending 200 nautical miles from their coast.
- 6:01That zone is the economic lifeblood for many nations.
- 6:04It dictates sovereign rights over fishing, oil and deep sea
- 6:07minerals. But how can a nation claim 200
- 6:10miles of ocean resource rights if the island that generated
- 6:13those rights is literally underwater?
- 6:15Doesn't that break traditional international law?
- 6:18That is the mechanical problem in international law right now.
- 6:20Under traditional interpretations of UNCLSA,
- 6:23maritime zone is measured outward from a coastal baseline.
- 6:26Usually the low water line along the coast, Right, Right.
- 6:28It is physically tethered to the land.
- 6:31The legal doctrine has always been that the land dominates the
- 6:34sea. But what happens to the legal
- 6:37rights over that massive maritime zone when the sea level
- 6:40rises and the physical baseline permanently recedes, or the
- 6:44island generating the zone becomes entirely submerged?

- 7:32mile sovereign boundary around a point on the map that is just
- 7:36open water? Doesn't that completely fracture
- 7:39the traditional Westphalian concept of sovereignty?
- 7:41It fractures it completely. Westphalian sovereignty, which
- 7:44has been the foundation of the international system since the
- 7:461640s, is predicated on a state having absolute, exclusive
- 7:51control over a defined piece of physical territory.
- 7:54So no land, no state. Exactly.
- 7:56If the physical territory ceases to exist, the traditional legal
- 8:00framework suggests the state and its associated maritime rights
- 8:03should also cease to exist. Wow.
- 8:05But we are watching real time legal innovation driven by
- 8:08existential necessity. The Pacific island states are
- 8:11rejecting the traditional concept of ambulatory baselines.
- 8:14Ambulatory meaning baselines that move as the physical coast
- 8:17moves. Correct.
- 8:18Instead, they are pushing a fixed boundary approach and they
- 8:21are building a legal precedent. They point to a 2014 ruling by
- 8:25the Permanent Court of Arbitration regarding the Bay of
- 8:27Bengal, which stated that maritime baselines must be
- 8:30stable and definitive to ensure security.
- 8:32And the geopolitical reactions to this legal shift are
- 8:35incredibly revealing. The military documents highlight
- 8:39that the US, along with allies like the UK and France, publicly
- 8:43supports this fixed boundary approach.
- 8:45Right. They want to lock in those
- 8:46boundaries to preserve stability and protect the fishing and

- 11:21globally altered atmosphere caused heavily by European
- 11:23industrialization, the EU engages in what post colonial
- 11:27scholars call othering. Exactly.
- 11:29It makes the migration an African problem to be managed
- 11:32rather than a shared global consequence.
- 11:34And reading through this, it looks like a brilliant, if
- 11:37cynical, legal maneuver. If you categorize these moving
- 11:41populations simply as economic migrants seeking better
- 11:44opportunities due to local instability, you avoid
- 11:47triggering the 1951 Refugee Convention.
- 11:50You've hit on the core legal objective of the framing.
- 11:53The 1951 Refugee Convention defines A refugee strictly
- 11:57around persecution based on race, religion, nationality or
- 12:01political opinion. It does not include
- 12:03environmental degradation. It does not.
- 12:05By vigorously categorizing climate migrants under the
- 12:08umbrella of economic development and border security, the global
- 12:11N avoids the monumental task of rewriting international refugee
- 12:15law, which would mandate legally binding protections and asylum
- 12:18quotas. Wow.

- 12:55perspective. How does that differ?
- 12:57Well, constructivism argues that international relations are
- 13:00shaped by historical context, shared ideas, and moral norms.

- 17:16And perhaps most impactfully, you have local municipalities
- 17:20taking on international diplomatic roles, mayors of
- 17:23massive global hubs. Through networks like the C 40s,
- 17:26cities are sharing green infrastructure technology,
- 17:29establishing 0 emission zones and negotiating direct
- 17:33partnerships with foreign entities.
- 17:34Completely independent of their national presidents or prime
- 17:37ministers. Exactly.
- 17:38The actual architecture of climate diplomacy is no longer
- 17:41confined to state ambassadors in Geneva.
- 17:43It's a horizontal multi layered web spanning across all levels
- 17:47of society. It's as if the global system is
- 17:50the biological Organism desperately trying to route
- 17:53around a blockage in its main artery.
