- 1:40on the show. A little programming note I have. Yesterday I gave my
- 1:44unsolicited advice to Huntington mayor Steve Williams, who's also running for governor, on
- 1:51what he could do to better his chances of being elected governor. Well,
- 1:55the Steve Williams folks were listening, and Steve Williams is on the show tomorrow,
- 1:57so he's gonna tell me, I listened to your advice, Dave,
- 2:01and I'm going to do the exact opposite but he's going to be on the
- 2:04show tomorrow, so I'm looking forward to have it. Mayor Williams now candidate
- 2:07for governor, Steve Williams will be on the show tomorrow. Always wanted I
- 2:13had this guy in studio, Rich the realtor, our buddy, Rich the
- 2:15realtor client from Meek's Realty. Good morning, sir, How are you,
- 2:17hey, Dave? Good morning? How are you? Thank you for being
- 2:20here? Yeah? Sure, hey, it's your favorite holiday today, right,
- 2:23all those kids coming and banging on your door. I love it.
- 2:25I love when the kids come to the house. I really always always sourcing
- 2:30out the neighborhood for their parents to see if they want to buy anything there.
- 2:32Yeah, okay, let me ask you this stuff. All right,
- 2:35So somebody shows to shows up at Rich the Realtor's house to after trick or
- 2:38treating? What are they going to get? All chocolate? All? Chal?
- 2:42I got the good stuff? Yeah, I mean it's the good stuff.
- 2:45So interesting, you know, Dichotomy and you and I were talking about
- 2:50this earlier. When my wife and I first moved to Tayes Valley back in
- 2:53twenty fourteen. I guess our first Halloween, Yeah, would have been would
- 2:55have been twenty fourteen there. We were totally blown away rich with how much
- 3:00different UH trick or treating was in Tay's Valley as compared to other areas.
- 3:06A true story. Their first year there, there were kids all over the
- 3:08neighborhood, but did not have a single trick or treater at her house.
- 3:13They walked right by, which you know, if I saw me on the
- 3:16front porch in my underwear with a middle of light, yeah I'd probably I'd
- 3:21probably walk home by too. But first year there, the kids in neighborhood
- 3:24everywhere, not a single trick or treater. We had all this candy and
- 3:29they just walked on by. Couldn't figure out why until somebody told me about
- 3:34Tay's Valley style trick or treating. Uh. At least in the neighborhood where
- 3:38we were, kids will not come up to your door as they did in
- 3:43other areas where I had lived. You got to sit outside, you gotta
- 3:46set outside. You got to set tonight. It's going to be a challenge,
- 3:49you know, to set out there tonight. My wife just suggested that
- 3:52I set in the garage with the car running. Uh. She thought that
- 3:55would be a really good keep the door closed. That way, I can
- 3:59hear if the kids not on the on the doors there. But apparently what
- 4:01I learned it's in Day's Valley. If you want to have trick or treaders,
- 4:05you want to come by your house, you had to actually go,
- 4:10you know, either sit on your front porch and walk out to them,
- 4:14or you have to if it's warm enough, which is not going to be
- 4:15tonight, you had to just sit out there and wait. It was so
- 4:17much different from Logan rich because in Logan, where I had we moved from.
- 4:23I mean, not only did kids come up on your porch, they
- 4:26would take your copper pipes and your catalytic converter as well. So just it
- 4:30was a totally different thing. That's that's changed over the years. I mean
- 4:32I grew up there. I grew up in Scott Deephone and we banged on
- 4:34the doors when we were kids. You did it in July, didn't you.
- 4:38We did. Yeah. So just however along until it wore up our
- 4:41costumes. But yeah, let's and of course, you know, people of
- 4:45our generation, we remember those the plastic mass costumes. You remember that you
- 4:48couldn't breathe and you do all that for a pack of raisins. You know,
- 4:51you basically cut off their supply, you know, to to your extremities
- 4:56and whatever and to your to your brain for a pack of rais an answer.
- 5:00So I'm looking back out. I don't know whether it was whether.
- 5:01All right, let's talk from real estate, and it's always Rich is always
- 5:04open to take your calls or texting if you questions about real estate. Rich
- 5:08is your guy. Rich. I read this article the other day and I
- 5:11thought this can't be right. So I figured I would ask the expert.
- 5:14Oh boy, so as soon as one gets here, Yeah, I'll let
- 5:16you know. No, I figured I would ask this question of you.
- 5:19The sale of multi family housing units outpacing single family homes? Is that right?
- 5:28Not necessarily the sale of them, but the building of the building of
- 5:31them. The building. Yeah, I told you to get it wrong.
- 5:33Yeah. So that's the National Association Realtor's article that came out too. So
- 5:36that just that for the first time, I don't know if it's ever or
- 5:40if it's the first time in recent years, but they are building more multi
- 5:42family homes, meeting duplexes and quads and townhouses, those kinds of things.
- 5:47The builders are I mean that's where their money is. Why versus why I
- 5:50said, I just think that's where the cost effectiveness is. So the cost
- 5:54of building is so high so that you can build a duplex for about the
- 5:57same price you can build a single family home, you sell it to two
- 6:00different people. So it's just or it just I think it's about living space
- 6:06for versus what they can afford to build, you know, just do well.
- 6:10I grew up in a duplex. I mean my second house we lived
- 6:13in growing up my teenage years was in a duplex. Uh. And I
- 6:16will just say this, I really feel sorry for the lady next door.
- 6:19We had an elderly and an older lady that lived beside of us. She
- 6:24was a widow and oh I mean I say old. I mean she was
- 6:26a intersevenor and she had you know a bunch of yahoo teenage kids, you
- 6:30know, hanging out the house next door. I really felt sorry for her.
- 6:31And I don't know but I could go back to live because kar am
- 6:33I you know, I don't know if I could go back to living like
- 6:35that again. Someone asked me this the other day, rich and so I
- 6:41figured again I would ask you if I decided to sell my home. And
- 6:45I know this is a very generic question and every situation is different. What
- 6:48am I looking at as far as out of pocket cost go from the seller
- 6:51sign Yeah, so you know you have to expect to have some Traditionally,
- 6:57you're going to have to expect to have some buyer closing fees participation. So
- 7:01a lot it's very common for the buyers they're closing feel on their loan to
- 7:04you know, somewhere around five thousand dollars. They're going to probably ask the
- 7:08seller to participate in that. They don't have to. Everything in real estate's
- 7:11negotiable, but I would expect you to, you know, I'll make twenty
- 7:15five hundred of it, just as a general rule. That would behalf about
- 7:19their buyer's closing costs. And you've got another thousand dollars toward your own closing
- 7:24costs for attorney fees, transfer of title taxes, those kind of things that
- 7:28get you. And then you should budget a couple of thousand dollars for repairs,
- 7:31you know, because there's going to be an inspection, there's likely to
- 7:34be some deferred maintenance that happens, and you know, home inspections can be
- 7:39a little scary but the reality of it is a couple thousand dollars typically on
- 7:43a budget will will make you comfortable to be able to get there. And
- 7:46home inspections, you know, you and I were actually having a conversation not
- 7:50long ago about home inspections. They can make or break a new home buy
- 7:55And just because home is expensive doesn't automatically mean it's going to pass on home
- 8:00inspection because it depends on It's just like any kind of other inspection. It
- 8:03depends on what inspector that you get and how specific that they because they don't
- 8:07want to be held biable. Well, that's that's the thing with home inspectors.
- 8:11They're gonna they're gonna see why a you know, and they're going to
- 8:13point out every single thing, probably ninety percent of what they see or just
- 8:18defer maintenance items. It's true in most homes throughout the valley or throughout our
- 8:22area, probably nationally, and then you know, you just kind of have
- 8:24to focus on the safety related items, and you know, electrical issues and
- 8:28plumbing leaks and roof leaks and things that could you know that the new buyer
- 8:33is gonna want fixed, but you know you're not going to necessarily I don't
- 8:35know, as an example, put new clocking around the vanity in the bathroom
- 8:41or something of that nature. But the home inspector is absolutely going to call
- 8:43it out. Yeah, and again it depends on which home inspectory you get.
- 8:46Yeah, different opinion. That's how thorough that they are. And I
- 8:50know you folks in real estate and there's things that you're allowed to say and
- 8:54aloud, but do you probably silently to yourself, probably say when so and
- 8:58so is getting this home inspector, you just kind of go, oh god,
- 9:01we all we all have our preferred vendors, our preferred affiliates, and
- 9:05you know, and then those the ones that kind of make well, just
- 9:09prepare yourself. I try and have the conversation that with sellers when I'm going
- 9:11to list their home, just to what to expect so that it doesn't freak
- 9:15them out. The same thing with buyers, you know, so that they
- 9:16don't they know that, hey, there's going to be a ton I mean,
- 9:20I can just you know, share this, my my house is under
- 9:22contract, have the home inspection recently. I know the inspector well, I
- 9:26you know, when he's finished, he's like, hey, I'm all done.
- 9:28I'm like, hey, how'd it go. Hopefully didn't find anything too
- 9:31bad. He actually said, you know, if they're all like this one,
- 9:35we wouldn't even home inspectors. So I'm like, that's a relief.
- 9:37You know. We get the report and it's sixty two pages, so just
- 9:41don't don't freak out, you know, whether you're on the buyer or the
- 9:45seller side. Right, I'm talking to Rich. Really not that bad.
- 9:46We're talking to Rich the realtor client here from a Meek's Realty. All right,
- 9:50So let's talk about getting attorneys involved. Nothing good in life ever comes
- 9:54when you get attorneys involved. And I'm just saying that because I know I
- 9:56have a lot of attorneys who listen to the show. Kidding of course,
- 9:58but in not all instances, but some instances, there's going to be attorneys
- 10:03involved in transactions. Yeah, you've got to have a title attorney who can
- 10:05translate the lead and do the title search and go back. You know what
- 10:09they're going to do is get that, get all those records transferred over to
- 10:11you, make sure your taxes are paid. They've got to report all of
- 10:15that anyway, and they're typically going to you know, be one thousand dollars
- 10:18or so on both sides of that transaction for the buyer and the seller,
- 10:22and you need them and there's some good ones out there they're going to you
- 10:24know, just again, you got to you don't want to have any surprises
- 10:28that you know, oh my gosh, my taxes didn't get transferred over,
- 10:31and then the sheriff is selling your house a couple of years later because you
- 10:35didn't pay your taxes. So you and I Rich both live in Taysese Valley
- 10:39and we know they're coming. Putnam County Chamber of Commerce just had another ribbon
- 10:45cutting. This passed Friday for an all new housing development. This one was
- 10:48out of Route thirty five. New Core is coming. We're already seeing people
- 10:54moving into Putnam County. They're moving into various areas, but it's obviously Mason
- 10:58County, but they're moving into Putnam and it seems like more than anywhere else
- 11:01right now. And that a lot of that has to do with because we
- 11:03have a very low crime rate. We we have, you know, some
- 11:07of the best schools in the state and things that nature. That's one of
- 11:09the reasons why they're moving. But with all of these people that are are
- 11:16are moving in. We still need homes. We still need houses. Yeah,
- 11:20another development being built in wind filled right beside the well. You'll make
- 11:24fun of this because you're good at this, but it's right inside the funeral
- 11:26home. They're wind bill on thirty four. But they're building more town homes
- 11:30there and just we need those houses and we need those builders to do it.
- 11:33So, you know, the inventory levels have kind of leveled out.
- 11:35I mean, they're you know, part of the whole raising of the rates
- 11:39with the goal I think was to obviously to build some inventory back up where
- 11:45we're just you know, we just don't have it and haven't had it now
- 11:48since COVID happened. But it has kind of leveled out. The expectation is
- 11:50they think that it might be flat for another year or so and then potentially
- 11:54it might go back up a little bit. But we need homes. We
- 11:58need places to build them. You know, place is to buy or builders
- 12:01rather to build those houses for us so we could sell them well and again
- 12:05with and there are people that are coming into into Putnam County and some of
- 12:09the other areas right now. And the one of the problems is is and
- 12:11this is not just a Putnam County thing. This is going on in various
- 12:15various points of the state because people are relocating here. As you said,
- 12:20we need homes. We need people to build homes or even for you know,
- 12:24people to sell their home. So, you know, people ask me,
- 12:28you know, when's the right time to buy? Is it? You
- 12:30know rates are close to eight percent now based on your you know, your
- 12:33death, the income and all that stuff. But I always think the right
- 12:37time to buy is when you need to buy. You know that, don't
- 12:39You're not really holding out for the ideal scenario right now. If you need
- 12:43to buy a house, then find yourself a good realtor, and I know
- 12:46one, so call me. But if you need to buy it, then
- 12:50just buy the house and then worry about the rate a couple of years down
- 12:52the road. You can always refinance that. Is there a time of year
- 12:56in your experience that seems to be better for buying homes or maybe when you
- 13:00see more people that are reaching out, is it you know spring and people,
- 13:03you know, after the fall happens and people look at their houses and
- 13:05they think, man, I don't want to live in this place. Is
- 13:07it winter time? Because they're tired of the air blowing in. Is there
- 13:11a certain time, Well, the spring selling season is definitely the heaviest volume
- 13:16of it for all of us. I mean, that's just we sell more
- 13:18homes, so more buyers are motivated, more sellers are motivated. People are
- 13:20trying to get ahead of the school for the following year. They're trying to
- 13:24get it into a home before their summer vacation, move over the summer,
- 13:28that kind of thing. So the springtime traditionally is the busiest time of the
- 13:31year. Rich, is always a pleasure to talk to you. Where can

- 17:37She's in the studio this morning. Good morning, Allen, how are you.
- 17:41Good morning, I'm great, beautiful Christmas, all morning, Happy Halloween.
- 17:45Thank you. Boom. So that's as scary as it gets this morning,
- 17:48right, Yeah, we're talking about healthcare though. That could be kind
- 17:52of scary, very scary transition. See, that's why it's why they pay
- 17:53me the big bucks. That was impressive. Yeah, that's not really well,
- 17:56we're trying to take some of the fright out of Oh let's see what
- 18:00you did there. Okay, all right, So open enrollment starts tomorrow.
- 18:04Starts tomorrow and runs through January fifteenth. But if you want your coverage to
- 18:10begin January one or twenty twenty four, you need to be enrolled by December
- 18:14fifteenth. There's going to be a press conference I think happening today. Talk
- 18:17about that, talk about that. Yeah, I'm very excited. Jeremy Smith,
- 18:19director of the West Virginia Navigator Program, will be with us. Will
- 18:23be at six hundred Leg in Sullivan Way. So anybody would like to come,
- 18:27should pop up on the second time eleven o'clock. OK. So you're
- 18:32leaving there directly, I presume YEA. So those who may be new to
- 18:36the process generally speaking, and explain what explain what open enrollment is. Yeah,
- 18:41I mean this is really fascinating this time around because the subsidies have been
- 18:45enhanced so much. So open enrollment is a time where you can look at
- 18:49no matter what's happening in your life, you can look at changing the coverage
- 18:55you have, securing coverage that you may not have because of some of the
- 19:00changes to the ACA. You may have a employer based policy that maybe consumes
- 19:07fifteen percent of your household income that would make you eligible to actually look at
- 19:11a more affordable policy through the marketplace. You know that wasn't that hasn't always
- 19:15been available. So this open enrollment gives you a time to really assess the
- 19:21different healthcare health insurance products in the marketplace. And what are the most common
- 19:26questions people have about open enrollment? How do I do it? I mean,
- 19:30you know it's intimidating. Yeah, I mean it's pretty intimidating. I've
- 19:33done this work in different ways for a long time. I've sat on a
- 19:37hospital board and I've not seen anything more complicated than healthcare from every aspect of
- 19:44it. But what is so helpful here is working with a navigator. And
- 19:48that's why I'm excited about Jeremy Smith being with us at eleven this morning.
- 19:53As a navigator, you can make a call to ACA navigator dot com.
- 19:57So I'm going to repeat that a couple of times because i want people to
- 20:00have that number or that website ACA navigator dot com. Or you can call
- 20:07one eight four four nine eight two two seven three seven, and there's a
- 20:11staff of trained people that'll just sit down with you and go through the policies
- 20:17that are available to you in the marketplace. And there's a lot of them,
- 20:21and it's it's something you can begin on your own, but it's truly
- 20:25complicated because of your premiums may differ based on not only household income but your
- 20:30zip code. So what might be true for Sally, it may not be
- 20:33too true for Fred depending on where they live. Okay, and let's talk
- 20:37about that. As far as the different divisions. Are we talking about different
- 20:41states? There are differences. Are we talking about areas in West Virginia that
- 20:44Charleston may be different than Huntington, for example, neighborhoods it can be different.
- 20:48Yeah, yeah, I mean zip codes really really important, and the
- 20:51household income is a real significant factor as well, and Also again, even
- 20:56if you have an employer based and it consumes a certain amount of your income,
- 21:02it would qualify one for reduce, actually enhance subsidies. That would make
- 21:07a policy that may be even better than what's offered through your employer based healthcare
- 21:11and make it affordable for you. Talk about the organization West Virginia's for Affordable
- 21:15Healthcare, you folks, have you been on the show before and now there's
- 21:18been on to talk about overall your organization and what your mission is. Yeah,
- 21:22our mission day really is to bring a consumer voice to public policy and
- 21:26healthcare. And you know, one sentence that probably sums it up better than
- 21:30anything, and we want to hear from consumers about the barriers they have felt
- 21:33to healthcare, and then we want to work with lawmakers to improve policies to
- 21:40make healthcare more affordable and accessible to every West Virginia. What is the relationship
- 21:47between your organization to people that do the kind of work that you do.
- 21:51What has that relationship been like in dealing with those under the dome in the
- 21:56legislature and whatever. I think it's been very positive. Just about everybody we
- 22:00speak to want every West Virginian to have healthcare We may have different approaches on
- 22:07how to get there, but you know, we're pretty close to covering every
- 22:11West Virginian. Twenty thirty years ago, over twenty percent of West Virginians were
- 22:15uninsured. Today only six percent of West Virginians are uninsured. And that's a
- 22:22variety that goes from employer based, which most of us get our healthcare,
- 22:26to Medicaid and now the Affordable Care Act. So that's pretty impressive, but
- 22:33that still means about one hundred and seven thousand West Virginians are uninsured. And
- 22:38some of that is because they don't have employer based Perhaps they make too much
- 22:45to be eligible for Medicaid, but their past experiences they could not afford the
- 22:52premiums on the ACA. They're much more affordable now than they were, so
- 22:56I would encourage people who aren't covered to take another look at that. Ellen
- 23:02Allen, as executive director of West Virginians for Affordable Healthcare. Open enrollment begins
- 23:06tomorrow. Press conference scheduled for eleven o'clock this morning to teach people more about
- 23:10it. Talk about the age of West Virginians. Allen, not you specifically,
- 23:15Yeah, but because that could get me hurt. You know, you
- 23:18never do that. But but you know, here's the thing. West Virginia
- 23:23is the oldest state in the nation, and so obviously with that is going
- 23:26to be is going to become because it's simply a numbers game, Allen,
- 23:32There's going to be more questions and there's going to be more people that are
- 23:34trying to get signed up. Talk about that. Yeah, I'm glad you
- 23:37asked me that, because, I mean, there's a real economic issue to
- 23:40healthcare, right and I'm not quite eligible for Medicare, but I do want
- 23:45to talk about that because it's also open enrollment for Medicare, and talking about
- 23:51complicated that piece is even more complicated. What I learned recently, and I
- 23:55didn't know this, and I've been doing this for a while, is the
- 23:57state Health Insurance program has essentially navigators that will help people look at their Medicare
- 24:04options and the different supplements, and that also will look at your income,
- 24:10it'll look on your healthcare needs, and I would encourage people to take a
- 24:14look at that, and that would really be focused of course on people aged
- 24:17sixty five and up, which is a large portion of West Virginians. Yeah,
- 24:21I have I have actually someone in my family right now that just turned
- 24:25sixty five, and he is going through this right now. And he's somebody
- 24:29that's worked his entire life and he's to the point now that he's looking at
- 24:33retirement and not right away, but try to weigh out all these different things
- 24:37about and it's and this is somebody who's spent their life with paperwork and things
- 24:42of that nature. And now he was just like, he's calling my wife
- 24:47and not calling me, but he's called my wife that's saying I'm lost on
- 24:52this. I'm lost. Well, that's why several of my friends are Medicare
- 24:56eligible and pass this on to him. It's called the HIP program. This
- 25:00is West Virginia, and they actually have people all over the state that will
- 25:04help you over the phone or set up an appointment with you just to talk
- 25:07about your options on Medicare and how to supplement supplement and what program will be
- 25:15best. But the State Health Insurance Assistance Program West Virginia SHIP and the number
- 25:19is one eight seven seven nine eight seven four four sixty three. And they
- 25:25are fantastic, okay, And they're just there to answer basic questions. Yeah,
- 25:30basic questions. Even a lot of times you can do this over the
- 25:33phone and walk through and they may have the site up both of you all
- 25:37looking at the same time. They also can set up a one on one
- 25:41appointment with your friend of mine. Just did that and it was really really
- 25:42helpful for And that's kind of, you know, one of the things with
- 25:47West Virginia, as I said, being an older state as we are,
- 25:49you know, you you get to a certain point in your life, and
- 25:52I'm starting to look at that right now. I'm not there yet, but
- 25:55I'm starting, like you, I'm starting to look in that direction right now,
- 25:57I'm thinking, Okay, I've worked, you know for however many years
- 26:00I worked, you know, one hundred and eighty I think, And now
- 26:04I'm starting to look at things like starting to think about this thing. After
- 26:07a while, your mind changes a little bit and your mindset change, especially
- 26:11when you know your fifties as I am, it becomes pretty crucial. I
- 26:15mean. And that if we have time, I'd like to talk a little
- 26:19bit about it. You bring up a good point we're thinking about that.
- 26:22You know, people can really prepare for this because open roame it begins tomorrow.
- 26:27It runs through January fifteenth. If you want coverage effective January, first,
- 26:33you need to have it by December fifteenth, and I would encourage people
- 26:36to start calling the navigator now, call them now, because I know I
- 26:41spoke with the Jeremy I think two weeks ago and they're already booking halfway through
- 26:45November. So get on their schedule. Give them a call because some of
- 26:49the some of the things you can do and help planning. Time is of
- 26:53the essence. Time is of the essence because it is complicated, and there's
- 26:56not like and this is what I think she'll oppressive. There's not just one
- 27:00plan that fits everybody. They all have unique characteristics that look at what your
- 27:07healthcare needs are and it you know you don't want to pay for more coverage
- 27:10than you need, but you also want to make sure you're not vulnerable financially
- 27:14if something would happen. So just being able to work through those can save
- 27:18you thousands of dollars a year, and it also make sure you're not missing
- 27:22coverage that you need to shop early. Really look at your family's needs or
- 27:27your needs if it's just for you, look at your current plan, consider
- 27:32the cost, and seek that expert advice that the navigators can give you.
- 27:36They're really great. But Dave Allen Show's brought to you, parted by a
- 27:38general hardware and number of Windfield. From kitchens to paints to deck, straight
- 27:41framed wood, roofie metal, on anything else you're going to need. You
- 27:45can find a general hardware and number of Windfield down one now on the executive
- 27:48director of West Roguinis for Affordable Healthcare. You've given us a lot of date.
- 27:51It's a lot of phone numbers, so on and so forth. So
- 27:52let's rack them up and shoot them again, as my grandfather used to say,
- 27:56and start from the top and go over all of the numbers and the
- 28:00dates and so on and so forth. Ahead, Okay. Op enrollment begins
- 28:03tomorrow and runs through January fifteenth. If you want coverage effective January one,
- 28:10you need to get enrolled by December fifteenth, So give a Navigator a call
- 28:15again. These are people who are just focused on West Virginia, specifically ACA
- 28:21navigator dot com. They have a nice website that's easy to use, and
- 28:25their number is one eight four four ninety eight two two seven three seven.
- 28:30And if you're eligible for Medicare, and again you're already an open enrollment there,
- 28:36you want to give the West Virginia Ship State Health Insurance Program A call
- 28:41one eight seven seven nine eight seven four four sixty three. They also have
- 28:45a website wvship wvs hip dot org. Again, these people are really helpful,
- 28:52They know their stuff and they can save you hours and hours of time.
- 28:56Ellen, it's always a pleasure to talk to you. News Executive Director,

- 32:52cargo shorts, white socks above the ankle, white leather sneakers, talk about
- 32:59the past, talk about gas prices, talk about the NFL. On second
- 33:04thought, we're all good in this department. Happy Halloween, let's see.
- 33:07Okay, all right, so sports a T shirt. Okay, I got
- 33:13that cargo shorts, I got that white sox above the ankle. No,
- 33:16no, don't. I don't do that. White leather sneakers, not yet.
- 33:22That was the official outfit of my father, who passed in twenty fourteen.
- 33:28I've been told my stepmother tells me when I get to be sixty five,
- 33:30I inherit his new balance shoes with the grass statings on him. That's
- 33:34what I've been told. Talk about the NFL. I can do that all
- 33:37day. And by the way, the Eagles are just going to kill or
- 33:39the Eagles are gonna get killed by the Cowboys this weekend. Wishful thinking on
- 33:45my part, But anyway, I appreciate the texture there, all right.
- 33:47So City of Charleston is going to hold their final in a series of meetings
- 33:52called Here to Serve This one said for tomorrow evening at six at the Roosevelt
- 33:54Center, five O two Roughner Avenue. Now This has been an opportunity to
- 33:59get questions, answer, to complain, to give compliments, whatever you want
- 34:02to do. It's your time with city officials to do whatever. This is
- 34:10the final one schedule, at least for now. Others have been held Kadas
- 34:14City. They had one at Mary C. Snow Elementary, Oakwood Road and
- 34:17downtown of a library. Again, this is the final one. They'll have
- 34:21reps from the various city departments on hand, Mayor's office, police Department,
- 34:24streets, roads, fire, all of them. So get out there and
- 34:28make your voice heard. It's tomorrow night starting at six at the Roosevelt Center
- 34:31on Rouughner and I understand that these have been pretty well attended. This is
- 34:35the final one that's on the schedule. So this one again is tomorrow evening
- 34:39at six. It's the Roosevelt Center, five O two Roughner Avenue in Charleston.
- 34:43Speaking of the mayor, next Monday is her day in the sun,
- 34:49so to speak. She'll be in on mayor Monday starting at nine forty next
- 34:53Monday morning. So if you have questions or comments for the mayor, get

- 35:12for me on the show this coming Friday morning. Trick or Treat happening tonight
- 35:17most areas six to eight or so, depending on where you live. I
- 35:20did see one county. I think it was Wayne that's starting at five,
- 35:22but it's six to eight most areas. And I'll be honest with you,
- 35:28I guess I was that weird kid who I'm turned into a weird adult.
- 35:31But I was never really a big fan of trick or treating growing up.
- 35:36I stopped trigger treating probably fourth or fifth grade. Just wasn't my thing.
- 35:40As much as I love food, I was never really a big candy eater,
- 35:45so I literally gave my food away to other kids or family members.
- 35:50Now I'm an adult who doesn't get excited about it much either. I'm also
- 35:54not a Christmas fan, so I just lived for the humdrum of everyday life.
- 36:00That heavyman said, enjoy your trick or treating and be safe out there
- 36:05tonight. I got to give credit where credit is due. You credit the
- 36:10booking agents, the promoter, city officials, others, whoever responsible for the
- 36:15great concerts that we're getting in. Charles announced last Friday that ru Speedwagon is
- 36:22coming to Charleston Long with Rick Springfield talking about your ultimate show for Gen xers

- 36:47this morning. So listen to Animal for your chance to win. And by
- 36:52the way, if you haven't had a chance to check out our all news
- 36:53station in the Mountain, it's been on since July. Steve, Animal,
- 36:55Shock, Lutricia, the whole crew just killing it right now. So if
- 36:59you're a classic rock this is your station, the only one in the valley
- 37:01that's playing nothing but classic rock. So go cheg it out. Text says,
- 37:08well, they sent me pictures, but here we go again another illegal
- 37:13alien caravan headed towards the border. Those were pictures that were sent to me.
- 37:17Appreciate that Texas, Dave. Why can't the state leaders go around the
- 37:22state and let people vent since they won't answer the phones when we call.
- 37:27Well, I know that is that certain groups of the legislators do these public
- 37:30meetings from time to time, and I don't know if that's who the texture
- 37:34is referring to. But not necessarily a bad idea, Dave Alan Show brought
- 37:42to you partly bout Husband's Pizza this month that your favorite hustans get a large
- 37:45at and inch pepperoni pizza and any pizza Dia only twenty one ninety nine.
- 37:47Find your local husbands for dining delivery pickup a husbandspizza dot com. So my
- 37:52news headlines this morning, Hoppy is going to get into this one a little
- 37:57bit further right off the top of the show at ten or six on Talk
- 38:00Client, a US district magistrate has recommended a default judgment in the class action
- 38:07lawsuit against the Southern Regional Jail in Beckley over inhumane conditions at the jail.
- 38:14Now, the magistrate is allegending that several paper records into investigations and grievances were
- 38:22his words intentionally destroyed out that's not good. And there was a lawsuit over
- 38:32the whole thing filed in September twenty twenty two against the Southern Regional Jail.
- 38:37They also named the Division of Corrections and every county commission that pays the house
- 38:43inmates in the Southern Regional Jail. So that's the way it works is these
- 38:46county commissions pay their jail. Here on the news a lot of times the
- 38:50jail bills. Well, if you feed into the Southern Regional Jail, which
- 38:53Charleston does not, then that's where the county commissions come into play there.
- 38:59So they filed lawsuits there. The governor Chief of Staffed Brian Abraham says there
- 39:04was never any intention to destroy any documents or evidence. He called anything related
- 39:07to that quote a mistake, not a purposeful action en quote. Now we
- 39:14have a story posted about it on the website. Leslie Rubin of WCHS Television
- 39:22has been the one covering story. She's actually going to be on Hoppy as
- 39:25the first guest coming up at ten o six this morning, Texas. A
- 39:30good job with the interview with Ellen well, thank you very much. Our
- 39:32job is to give out, is to get information out to people. Our
- 39:37lead story on the website this morning is Judge kick ass. I'm sorry,
- 39:40your honor Judge Mary clair Acres is refusing to lower bail in this Systonville neglect
- 39:46case. Jane white Fair and Donald ray Lance are being held on two hundred
- 39:53thousand dollars bail each following their arrest earlier this month. And you know the
- 40:00story by now. The two are accused of having their kids, a son
- 40:07and a daughter, both teenagers, locked in a shed on their property in
- 40:10Sissonville. Now there was another younger child upstairs and aloft of a separate structure.
- 40:22Now White Feathers, attorney whose marked plants, is saying that there is
- 40:24another side to the story, that there was actually a key inside the shed
- 40:31that would have allowed the kids to leave anytime they wanted. And he called
- 40:38the barn, which I haven't seen it. I've seen the pictures that we
- 40:43posted online and the TV news crews have done and so on and so forth.
- 40:46A barn is kind of a stretch. It was more of a shed,
- 40:51as Chris called it, more than anything else. But he's saying the
- 40:53defense attorney is is that the kids could leave any time they wanted, and
- 40:58he called it just a hangout for the brother and sister. M oh kay.
- 41:07I'm not sure what the explanation for the filthy conditions inside was, including
- 41:13buckets that were being used as bathroom facilities, or the fact that a brother
- 41:19and sister never want to hang out together in the first place, let alone
- 41:22have a quote unquote hangout. And look, I'm not hating on attorney plants,
- 41:27that's his job. I mean, he's a defense attorney, but dude,
- 41:31really, uh, judge kicked. Judge Acres called one of the defendant's
- 41:38white feather a flight risk. Of course, this this couple originally from Washington
- 41:43State, uh, and refused to lower her bond, and all five of
- 41:47the kids we understand now are in the care of of a CPS. It's
- 41:52it's just a tragic story, and you know it's it happened earlier in uh
- 42:00October, I think is when the story first broke in October second, I
- 42:05think it's I think that was the date of it, and it got nationwide
- 42:07attention and of course a another West Virginia stereotype further by people that aren't even
- 42:15from West Virginia, by the way, they just moved here not long ago.
- 42:19And one of the defendant's brothers commented about seeing the key, and it
- 42:23was brought up in the I guess in the bond hearing yesterday that why didn't
- 42:28the police see the key that was hanging there? And so on, and
- 42:30so I'm sorry, I just can't buy that story. I'm not an I'm
- 42:34not an attorney. Again. I'm not hating on mister Plants. That's his
- 42:37job. He's a defense attorney. But I just can't. I just I
- 42:40just can't buy into that story. I just can't. We're going to take
- 42:45a break. The Dave Allen Show is brought to you a part by your

- 46:04How about the former in North Dakota GOP state senator who was indicted for
- 46:08child porn and child sex tourism. It's so strange how members of the Party
- 46:13of Christians and Family Values tend to wind up in that position, says text
- 46:17are not really familiar with the story. I will look into it, but
- 46:21I can tell you I don't think either party has a has a necessarily has
- 46:25a lock on things of that nature. Sadly, Kat Skelton has a story
- 46:30post at wv Metronews dot com. The Kanawah County Prosecuting an Attorney's office said
- 46:36yesterday the deputies in Kanawha County were justified in a shooting in Cross Lanes led
- 46:42to the death of Brian Edwards Spencer. There was a press conference held about
- 46:46Esjcat has a story posted. You will recall this story. This is out
- 46:49of cross Lanes and this was a person originally from Logan County that was hold
- 46:54up at a hotel and had been to prison. And he was actually called
- 46:58by a former I think or love interest of his and they said he's not
- 47:01going out without it. He went out with a bang, was what he
- 47:04said. And I guess there was an investigation of the police. They say
- 47:07it was totally justified according to a texture. All right, let's talk a
- 47:13little bit about traffic. And I somehow missed all the tie ups you have
- 47:17to normally with all the traveling that I do when I was sixty four,
- 47:22I'm the one stuck in the middle of it. Yesterday afternoon, however,
- 47:24I was on the other end of sixty four in Huntington, and although there
- 47:29I was, there was an accident at one point westbound outside Huntington. By
- 47:34that time, I was traveling eastbound, had a back home. So if
- 47:37you were traveling and trying to get out of Charleston yesterday around three point thirty
- 47:42four five o'clock normal quitting time for most people, it was a no go
- 47:45for sure. And this morning I just missed an accident on sixty four East
- 47:52near the Winfield accident. I mean when I say I missed it, I
- 47:54missed it by a couple of maybe five ten minutes because my life was traveling
- 48:00behind me and she was about five miles behind me, and she called me.
- 48:05It's to say now she's held up in this accident that I had just
- 48:08missed. People, I don't know what the what the cause of the accident
- 48:14was. You probably saw the picture we had it posted online about the truck
- 48:16that lost a lot of plywood apparently on sixty four. Slow down. It's
- 48:23not that hard. And I'm somebody that from time to time has a lead
- 48:28foot. I will be the first to admit it, but not in situations
- 48:31like that, not yesterday, when it was an absolutely miserable travel day because
- 48:35of the rain and leaves down and so on and so forth. And experts
- 48:38will tell you that there's usually more accidents in rain Actually it is the statistical
- 48:44fact. There are more a lot more accidents in rainy conditions than snowy and
- 48:46icy conditions. Just slow down. Ninety nine percent of the accidents could be
- 48:58eliminated if people would just slow down and realize that in the work zones,
- 49:05the speed limit is fifty five miles an hour, and that's an optimal that's
- 49:09when it's perfect. That's when it's sunny in seventy five. If it's raining
- 49:13like it was yesterday, it's a lot lower than that. It's not hard
- 49:16people, you know, just Ton'd be stupid Texas Dave I hung out in
- 49:27some shady places that didn't even have a bucket. I'm guessing you have two.
- 49:30Just say, maybe we didn't have all of the information when you crucified
- 49:34these people as possible. Yeah, I mean, and that's why that's why
- 49:37you have a trial, and that's why it goes to court. Absolutely,
- 49:43you know, absolutely, and it'll all come out. I'm just saying that
- 49:46that defense seems to me to be a little bit weak. But as a
- 49:51defense attorney, that's your job is to find things that you can find people
- 49:54that will believe them, And I'm not saying it's right or I'm just saying
- 49:58from my opinion, I don't know anybody involved, wasn't unseen. I'm just
- 50:01saying that looks a little a little sketchy, but the texture is right.
- 50:06You know, sometimes we have a tendency, especially in this era of constant
- 50:09median we constantly have We're constantly connected to the Facebook and new sites and X
- 50:15and so on and so forth and Instagram and whatever that everybody plays judge jury
- 50:20an executioner, and we're all guilty of that. First, I'm the first
- 50:23one to admit that I am coop. A couple of minutes left in the
- 50:28show. You got the kid all all jacked up and ready to go and
- 50:31get schedules tonight. We'll see what happens with her when I get want to
- 50:35check in here in a couple hours. She was not feeling all that great
- 50:37last night, was starting to get a little running nose, worried that we
- 50:39have three parties this weekend already, So I'm worried that maybe she got got
- 50:44a little cold somewhere, you know. And the thing about it is,
- 50:46when you and I were kids, you know, growing up, the trick
- 50:49or treating thing six' eight on Halloween night, and now we have trunk
- 50:52re treats, which we just had thirty five hundred kids over at Gomar Ballpark
- 50:57last week for trick or beat and all the area organized. I know,
- 51:00the Benny Keaton s trying my buddy Chris and those folks had had a truck
- 51:02or treade in. The churches have truck or treats and so on and so
- 51:06forth. So there's certainly not an excuse for any kid not to be able
- 51:09to trick or freed somewhere. Yeah, I think that, you know,
- 51:13there is a thing where our communities aren't as walkable as they used to be.
- 51:16They're not built with the sidewalks necessarily, and sometimes it's not as safe
- 51:21as it was when we were kids, or at least the impression is.
- 51:22It's not as the impression is, it's not as safe. Actually it is
- 51:24safer now, Yeah, I know, I think generally speaking it is.
- 51:27And most of the stuff we were scared about as kids, it wasn't really
- 51:30anyway, like the razor blades and can never happ like that. It was
- 51:31fake. It was all fake, a moral panic that was made up.
- 51:35So but not that you shouldn't check your candy and make sure your kids are
- 51:37safe and all that stuff. But just keep in mind that that stuff was
- 51:39largely just made up and then like local news ran with it and it became
- 51:44urban legend. More or less, it never happened. Yeah, yeah,
- 51:45never. There's not a verifiable case of it anywhere, sort of like the
- 51:47Satanic panic, it just didn't exist. That being said, I was more
- 51:52of a uh. I liked trick or treat, but like you, I
- 51:54didn't go trick or treating. Late into my life. I was more of
- 51:58the scary movies, scary and vironment haunted house kind of like I like to
- 52:01going to haunted houses. I like to being scared and things like that,
- 52:04but I didn't do a lot of tricker treating. All right, Well,
- 52:07best of luck to all the tricker treaders out there tonight. Little Ssie,
- 52:09enjoy yourself, and I'm sure Dad uh and Shannon will probably be if she
- 52:14does feel like when it will probably enjoy some of the fruits of the labor,
- 52:16you know, but it's not a whole lot of fruit. It'll be
- 52:17more like chocolate covered stuff. All right, We gotta go. Thank you
- 52:21to Ellen Allen and Richard Real for being on the show today. Hoppies coming
- 52:23up with a loaded up talk line today on this show Tomorrowhuntington mayor candidate for
- 52:28Governor Steve Williams is here. Ashley offered glance from the Putnam Kennon Chamber of
- 52:30Commerce. Is here today or tomorrow? I should say as well, Happy
- 52:35Halloween folks, see you tomorrow. Till then, have fun and love somebody
