- 0:00Welcome to Tour Talk Live. We are live from Mass Tours
- 0:03Puerto Rico. I have myself, John and Joe with
- 0:06us today. Joe is back home in
- 0:07Philadelphia. John and I are at the wonderful
- 0:10Vanderbilt Hotel in Condado, Puerto Rico.
- 0:13We have a very busy day to get into you.
- 0:16Just because we're traveling doesn't mean we take a week off.
- 0:18Let's hop right into it. Yep, Joe, thanks for joining us.
- 0:22Wish you could be here. Weather is beautiful, but I'm
- 0:24sure Pennsylvania is nice as well.
- 0:26Some people call the Pennsylvania the San Juan of
- 0:31North Waka. The San Juan of North America.
- 0:36The San Juan of the North. All right, what's the first one
- 0:39we're going into? Yeah.
- 0:40So talking about social media addiction, it's been the topic
- 0:44for weeks now after that verdict came through in Los Angeles.
- 0:49But it doesn't stop there. Fresh off of the $375 million
- 0:52reward in New Mexico for a public nuisance against Meta, we
- 0:57now are entering phase two of the trial.
- 0:59New Mexico is seeking $3.7 billion in damages.
- 1:04They're just getting hit from all fronts, whether it's the
- 1:07civil actions or these actions from the attorney general's, not
- 1:11just in New Mexico, but across the country.
- 1:13Joe, what's going on here? What can we expect to happen in
- 1:15social media addiction? And and did I hear that right?
- 1:183.7 B. Billion with a billion with ABA
- 1:20lot of agencies sell services, SEO packages, paid media
- 1:24packages, social packages, but our digital doesn't really
- 1:28operate that way. We build acquisition systems
- 1:30while staying tactic agnostic about how they get there.
- 1:33And we're founder owned. It's Mark and I, so we're not
- 1:37going to force your law firm into whatever the agency happens
- 1:40to sell. If that's the kind of alignment
- 1:42you want, check out RR Digital at rrdigitalmedia.com.
- 1:47Yeah, that, that's right. So basically like you mentioned
- 1:50there, John, we had the initial trial, the Attorney General from
- 1:54New Mexico brought the action due to the public nuisance.
- 1:58They got 375 billion here. They're claiming that Meta is a
- 2:03public nuisance. So here, here they're seeking
- 2:06$3.7 billion. They're saying that medic
- 2:10created this epidemic where everybody's addicted and they
- 2:13need this money to help remedy it.
- 2:16On the other end, Medic saying that this amount of award salt
- 2:21and the remedies that they're seeking is untenable and even
- 2:25threatening to pull out in New Mexico if such a ward gets
- 2:29entered against them. Mehta is arguing basically if
- 2:32they created a public nuisance, so do alcohol companies that
- 2:37then lead to people driving drunk.
- 2:40So it's a kind of new theory that they're bringing the first
- 2:44time it's ever been brought. But the numbers really big.
- 2:47And like you mentioned, all of the other attorney generals from
- 2:50every state really is watching to see what happens in the trial
- 2:53that's going to be decided just by the judge, not in front of a
- 2:56jury. So what was awarded in the 375
- 2:59and how is that different from the 3.7 that they're seeking?
- 3:02So that was they were saying that they violated the consumer
- 3:07protection laws. So for each violation there was
- 3:10a penalty. I think it was maybe $5000 for
- 3:13each violation. That ended up being 375,000,000.
- 3:18Here it's a different claim. They're saying that medic caused
- 3:22the public nuisance here and that's why they're seeking that
- 3:253.7 billion. First time I've heard that one.
- 3:28Yeah, I mean the the Domino's keep falling against Meta.
- 3:31This is very interesting. And we and you're seeing this
- 3:34happen across the country. Attorney generals from states
- 3:37all across the nation are pursuing claims not just against
- 3:40Meta. We saw it against Roblox couple.
- 3:42Weeks ago. This is wow.
- 3:43This isn't a federal charge. This is a state charge.
- 3:46So if they win any substantial amount of money times, you know,
- 3:5049 more states, this could be a very large amount of damages for
- 3:53Meta potentially. Yeah, exactly.
- 3:56And that, that just shows how important it is to have this
- 3:59multi prong kind of attack in these type of litigations,
- 4:02right? We have the MDL, we have state
- 4:05court proceedings, we have a GS. The pressure is really mounting.
- 4:08So hopefully we can get a good result here, get some more
- 4:12pressure, get some changes, and then that will help all of the,
- 4:15you know, personal injury cases that we've been focusing on
- 4:18mainly. I'm looking forward to seeing
- 4:20how this progresses. I think we all all are very
- 4:23intrigued on all the meta lawsuits that are going on right
- 4:26now. Yeah, I mean, and, and don't let
- 4:28Meta fool you, right? 3.7 billion is a lot of money,
- 4:31but for Meta it's not that much. Yeah.
- 4:33I pay like partially that much, just an ad spend per month.
- 4:38Moving on to Roundup. So last week we talked about the
- 4:42oral arguments for preemption ruling.
- 4:44What's going on with that? What are the updates here, Joe?
- 4:46Yeah. It happened this week.
- 4:47Yeah, right. Yeah.
- 4:49So we talked about the oral argument before the Supreme
- 4:52Court. We're expecting a decision in
- 4:54June. See how that turns out.
- 4:57Not sure if everybody on the plaintiff side super optimistic
- 5:01about that, but while that was going on, we also had the
- 5:05hearing for the basically injunctive relief before the MDL
- 5:09judge. Basically a couple law firms
- 5:12were seeking relief from this Missouri class action
- 5:15settlement. There was a hearing on April
- 5:1730th. During the hearing, the MGL
- 5:19judge said that it felt like this settlement was dirty and he
- 5:24felt like the opt out provisions was bizarre and they've never
- 5:28seen anything like this. However, he said it wasn't
- 5:31really his place to get involved and ultimately it'd be up to the
- 5:35Missouri Supreme Court or the United States Supreme Court to
- 5:39see if this settlement was appropriate.
- 5:41But in the meantime, it doesn't seem like there's anything
- 5:44that's going to stop this settlement from going forward.
- 5:48So we have about a month left until the June 4th opt out
- 5:52deadline, need to have the wet signatures for that.
- 5:55And then in early July, we have the final approval hearing.
- 5:58It looks like this settlement's going forward regardless of the
- 6:02issues and questions people have brought to date.
- 6:05June. 4th less than a month to get all the wet signatures and
- 6:09it's still an insane deadline Yeah it's.
- 6:11It's coming up on us, so make sure you guys are in touch with
- 6:14your clients evaluating their case, you know, see how much
- 6:18they would get and if you think it'd be worthwhile for them to
- 6:20opt out of the settlement. Otherwise, all indications are
- 6:24it's going forward. There's nothing really
- 6:26substantial in the way of this settlement coming to final
- 6:30approval. So be aware of this deadline,
- 6:33certainly. Definitely keep your ear to the
- 6:34streets and round up for the next 30 to 45 days because a
- 6:38lot's going to be happening there.
- 6:40Let's talk about Suboxone. So we have a deadline coming up
- 6:42in that MDL. What is that deadline about and
- 6:46what do firms and individuals need to be aware of pertaining
- 6:49to that deadline? Yeah, another important deadline
- 6:51coming up. This one's in June 1st.
- 6:54So back when there was potentially a statue coming up
- 6:57with regard to the label change in this case, the court allowed
- 7:02people to file a bundled complaint with multi plaintiffs.
- 7:06The deadline to submit the the fact sheet, the PAQ is coming up
- 7:11on June 1st. So for this, you need the fact
- 7:14sheet signed by the client, you need the proof of usage of
- 7:18Suboxone, and then you also need medical records showing the
- 7:22proof of injury after Suboxone usage.
- 7:24So everybody's really scrambling to meet that deadline.
- 7:28Some of these clients are a little bit hard to get in touch
- 7:30with to make sure you're reaching out.
- 7:33While we have that going on, we're starting to get the kind
- 7:36of court guidance on what's going to be happening with the
- 7:39bellwether trials. It doesn't look like it's going
- 7:41to be in 2017, really looking like the beginning of 2018.
- 7:46But what everybody needs to really worry about is that June
- 7:481st deadline. Don't let your kick your case,
- 7:51get kicked out for missing the discovery.
- 7:54So make sure you're on top of that staying in touch with your
- 7:57clients. And I am getting a quick update
- 7:59from the box. I believe Joe meant to say 2027
- 8:02and 2028, not 20/17/2018. Yeah, you're, you're right.
- 8:06That was that was before we started doing torque talk.
- 8:09So 2017 and then 282017 not applicable. 2027 doesn't look
- 8:18like we're going to have a bellwether then either. 2028 is
- 8:21when we'll have that initial Suboxone bellwether.
- 8:24Moving on to weight loss, we have the Dauber hearing
- 8:26scheduled for May 12th. What's going on?
- 8:28What should we expect? Yeah.
- 8:29So we have parallel tracks going on.
- 8:32We have the MDL in New Jersey State court and then we also
- 8:35have the gasser intestinal injuries and then the vision
- 8:39loss cases. This hearings just going to be
- 8:41focused on the gastrointestinal injuries.
- 8:44We'll see what injuries are going to survive.
- 8:46If you guys remember, 6 months or so ago, the judge came down
- 8:50with the a ruling pretty strict. We weren't exactly expecting
- 8:54this saying that you couldn't have a differential diagnosis.
- 8:58You needed a gastric emptying studying to show that the client
- 9:02had gastroparesis. We're seeing over 85% of the
- 9:06injuries in this litigation and Bob gastroparesis.
- 9:10So following the Dahlberg hearing, we'll see if any other
- 9:12injuries, you know, prolonged hospitalization, vomiting, you
- 9:17know, maybe some sort of bowel obstruction, if any of those
- 9:20other injuries survive the Dahlberg challenge or if this is
- 9:23slowly going to be focused on gastroparesis, we'll have a
- 9:27decision probably 60 to 90 days out from that hearing next week
- 9:31on May 12th. Yes, similar to weight loss.
- 9:33Also in hair relaxer, we have a dubber hearing coming up.
- 9:35That's the May 15th I believe. What should we expect in that
- 9:40Dubber hearing? Yeah, a little bit further
- 9:42behind it and hair relaxer, May 15th, the deadline for the reply
- 9:47briefs for Dahlberg. So you know, initially each side
- 9:51does their initial Dahlberg motion, then the other side gets
- 9:54a chance for a response, then the reply is the initial filing
- 9:58party gets to come back and say why the other party was wrong.
- 10:02So we'll get that fully briefed. We'll get the hearing scheduled
- 10:06in that. That's going to be in the
- 10:08beginning of the summer. And then we're waiting to see
- 10:10whether or not the three cancers survive.
- 10:13So we have endometriin, uterine and then ovarian.
- 10:17Are all three cancers going to survive the Dahlberg challenge
- 10:20there or only do 2 out of the three come out?
- 10:23So it's really important to follow along these litigations,
- 10:26especially these Dahlberg hearings.
- 10:28You'll get a clear sense of what type of cases are going to be
- 10:31compensable. And then MDL, we'll bring you
- 10:34guys the updates in real time as we always do on Tort Talk.
- 10:38Yeah. And this had these dauber
- 10:41hearings and have some significant impacts on our next
- 10:43power rankings, says might, might very much move some people
- 10:47up, might move some people out of the top 10.
- 10:49Yeah, definitely. You know, once we get past that
- 10:52Dauber hearing, you usually see the cases increase in the power
- 10:55rankings because the uncertainty isn't there, right?
- 10:58We know clearly what injuries are supported, what can we get
- 11:02in front of the jewelry on. So as those cases get more
- 11:05mature, they usually climb in the power rankings.
- 11:08Yeah. But even beyond dauber hearings,
- 11:10we have a handful of trials slated from now through the
- 11:13summer. We've got the next social media
- 11:15addiction trial coming. We've got more Uber sex abuse
- 11:19trials coming up. There's just a flurry of
- 11:21activity like we haven't seen before in mass torts.
- 11:24And it's for a number of different reasons.
- 11:26And it's it's really great to see.
- 11:28We're here in Puerto Rico. There's already some buzz.
- 11:31The conference officially starts on Wednesday.
- 11:33Right now, as we're recording this, it's Tuesday morning, but
- 11:36we will definitely be speaking to all the decision makers, all
- 11:38the leaders across all the litigations that we've been
- 11:41talking about for months. We're going to try and get some
- 11:43inside scoop and what's going on behind the scenes.
- 11:45Well, Joe's not here to get the whispers of the people like he
- 11:49normally does. We have some inside moles that
- 11:51we feeding us the information of what everyone's talking about.
- 11:53We'll be reporting back next week, so don't worry.
- 11:56Our ears are the street. We have our people around.
- 11:58We'll report back with what we find.
- 12:00Yep, Yep. Joe, we miss you, Puerto Rico
- 12:03misses you. Enjoy the San Juan of the North.
- 12:07Safe travels and and all your escapades in the coming weeks
- 12:10for your own trials and and those of you watching, stay
- 12:13tuned. We've got more coming from
- 12:15Puerto Rico. We'll catch you next time on
- 12:17tour talk.
