0:01
Speaker 1: Now we turn to the Mountain Eagle to read news
0:04
from Whitesburg. Your reader today is Bill and Arsdale. We
0:09
will begin with the addition dated February twelfth, twenty twenty six,
0:14
which the publishers have donated to Radio Eye as a reminder.
0:19
RADIOI is a reading service intended for people who are
0:22
blind or have other disabilities that make it difficult to
0:25
read printed material. The first headline is a relief from
0:32
the cold and maybe from higher power bills. It's a
0:37
safe bet to say few people were happier with Tuesday's
0:41
sixty five degree temperatures than those of us living in
0:44
the twenty counties in eastern Kentucky served by a Kentucky
0:48
Power company, which is seeking permission to increase its already
0:53
high monthly rates. While cooler weather was expected to return
0:57
to Electric County Wednesday and Thursday, above freezing temperatures are
1:02
forecast to be the norm from Friday through at least
1:04
next Tuesday. Meanwhile, this week's edition of The Mountain Eagle
1:09
has more Kentucky power related news. The next story is
1:16
local law office helping fight Kentucky Power's rate hike. Several
1:24
community and consumer organizations are urging state regulators to reject
1:29
Kentucky Power Company's request for another electric rate increase, arguing
1:34
the proposal would further burden households in eastern Kentucky and
1:38
failed to address the utility's long term challenges. In a
1:43
post hearing brief filed with the Kentucky Public Service Commission,
1:47
the groups Appalachian Citizens Law Center of Whitesburg, Kentuckians for
1:52
the Commonwealth, Kentucky's Solar Energy Society, and Mountain Association said
1:58
the region is caught in a cycle of of rising
2:00
rates and declining population that harms both customers and the company.
2:07
When you raise rates in a region that's already losing
2:09
people and jobs, you don't stabilize the system, You shrink it,
2:14
said Byron L. Garry, an attorney with the Kentucky Resources Council,
2:18
which represents the groups. That leaves fewer customers paying higher
2:23
bills and sets the stage for the next increase. Kentucky
2:29
Power is seeking its third base rate increase in about
2:32
five years, in addition to fuel charges and other search
2:36
charges already included on monthly bills.
2:40
Speaker 2: High rates high usage.
2:43
Speaker 1: According to the filing, Kentucky Power already has the highest
2:47
average residential electric rates among investor owned utilities regulated by
2:52
the Commission. Customers in the company's service territory also use
2:57
more electricity than most households elsewhere in the state. The
3:02
groups said that combination reflects structural conditions rather than excessive consumption.
3:09
People aren't using more electricity because they're careless, said Tom
3:13
fitz Fitzgerald, director of the Kentucky Resources Council. They're living
3:18
in older homes, many with electric heat and poor insulation.
3:23
Usage is high because efficiency is low. The brief states
3:27
that many households struggle during winter months, sometimes limiting heating
3:32
to reduce bills that consume a large share of household income.
3:37
Repeated increases are questioned. Kentucky Power has told regulators that
3:43
higher rates are needed to maintain reliable service. The interveners
3:48
countered that repeated increases may worsen the company's long term
3:52
outlook by accelerating customer loss.
3:56
Speaker 2: Each increase makes it harder for.
3:57
Speaker 1: People to stay and harder for the company to maintain
4:01
a stable customer base, said Ashley Willis, a staff attorney
4:05
with the Kentucky Resources Council. That's the cycle we're asking
4:09
the Commission to break. The filing also notes that Kentucky
4:13
Power's parent company, American Electric Power, has reported strong profits
4:19
in recent years and announced large capital investment plans. It
4:24
raises serious questions when customers here are told they must
4:27
pay more to keep the system running while the parent
4:30
company reports record earnings, Wilms said. Disputes over cost savings,
4:36
rate design. Kentucky Power has said it has taken steps
4:41
to control costs, but the group's dispute that claim, citing
4:45
increases in operating, maintenance, and transmission expenses. They also note
4:50
the company filed for the current increase before the previous
4:54
rate change was fully implemented. If the cost controls were working,
4:58
we wouldn't be back here so quick, Fitzgerald said. The
5:02
interveners also criticized the company's proposed residential rate design, saying
5:08
it would benefit high usage customers while increasing bills for
5:12
average households more than advertised. This design rewards higher usage
5:17
at a time when the Commission has said reducing winter
5:20
demand should be a priority.
5:22
Speaker 2: Gary said.
5:24
Speaker 1: Prepayd plan liability language challenged. The filing also raises concerns
5:30
about Kentucky powers proposed pre paid billing option known as flexpay,
5:36
which would require customers to pay for electricity in advance.
5:41
Pre pay shifts risk onto customers who are already struggling,
5:45
said Roger Colton, an energy affordability expert who testified for
5:50
the interveners. It removes the cushion people rely on when
5:54
money is tight. The groups also object to proposed tariff
5:58
language they say could limit customer's ability to seek compensation
6:03
for injuries or property damage related to electric service. A
6:08
utility tariff shouldn't be used to weaken customers legal rights, Grey,
6:12
said Attorney General. Settlement still raises bills too much. The
6:19
office of Kentucky Attorney General Russell also opposes the proposed
6:23
rate increase and declined to join the settlement agreement, arguing
6:28
it relies on short term credits while locking in higher
6:32
rates long term. In filings with the Commission, the Attorney
6:36
General said the settlement still produces rate increases that many
6:40
households cannot afford, particularly in eastern Kentucky, where electric bills
6:46
are already among the highest in the state. The Attorney
6:49
General's office criticized the use of deferred tax credits to
6:53
reduce bills in the first two years, noting that the
6:57
credits expire while the higher bid rates remain in place.
7:03
The office also raised concern about proposed changes to residential
7:06
rate design and prepaid billing, warning both changes could shift
7:12
risk onto customers without meaningfully reducing overall costs. Calls for alternatives.
7:20
Rather than approving another rate increase, the interveners urged the
7:23
Commission to require Kentucky Power to pursue long term affordability measures,
7:30
including programs to help customers pay down pass due balances,
7:35
and expanded energy efficiency and weatherization efforts. You can't rate
7:40
design your way out of poverty, Colton said, lowering energy
7:45
used through efficiency is the only sustainable way to lower bills.
7:50
Decision pending. The Public Service Commission will review briefs and
7:55
testimony from all parties before issuing a decision later this year.
8:00
This case is about more than a single rate increase,
8:03
Wilms said. It's about whether Eastern Kentucky continues down a
8:07
path of rising bills or whether regulators insist on a
8:11
different approach. The next headline is company defends rate request.
8:18
Kentucky Power Company is urging state regulators to approve a
8:22
proposed rate increase in settlement agreement, arguing the plan is
8:26
necessary to maintain reliable electric service in eastern Kentucky while
8:31
limiting bill impacts for customers. In a forty four page
8:35
post heering brief filed with the Kentucky Public Service Commission,
8:40
the utility said declining population, falling electricity sales, and rising
8:45
infrastructure costs have weakened its financial position and made a
8:50
rate adjustment unavoidable. Kentucky Power is seeking its third base
8:55
rate increase in about five years. Company officials save the
8:59
request reflects the actual cost of providing service in a rural,
9:04
mountainous region with high poverty rates and aging infrastructure. Kentucky
9:10
Powers service territory is unique in its terrain and customer
9:14
socioeconomic status, the company wrote, noting that both customer counts
9:19
and electricity usage continue to decline. Financial stability cited as
9:25
key issue. Kentucky Power said the rate increase is needed
9:30
to maintain financial stability and attract capital required to keep
9:34
the electric system safe and reliable. It is vital that
9:38
the company be allowed a reasonable rate increase that also
9:42
includes the opportunity to earn a reasonable rate of return.
9:46
Cynthia Wiseman, Kentucky Power's president and chief operating officer, said
9:51
in testimony cited in the brief, that allows us to
9:55
continue to attract affordable capital and provide the safe and
9:59
reliable service customers deserve. The company sid its credit ratings
10:04
are near the bottom of the investment grade range and
10:07
warned that continued under earning could raise borrowing costs and
10:12
limit future investment. Continued or sustained poor financial performance will
10:18
adversely affect the capital available to the company and the
10:22
cost of that capital, the brief states. Settlement, highlighted as
10:27
customer protection, a central focus of Kentucky Powers filing, is
10:32
a settlement agreement reached with Kentucky Industrial Utility Customers Incorporated
10:37
and the Kentucky Solar Energy Industries Association. The company urged
10:42
the Commission to approve the agreement without modification. Under the settlement,
10:47
the total revenue increase would be reduced from about ninety
10:51
five point six million dollars to seventy seven point four
10:54
million dollars.
10:56
Speaker 2: Kentucky Power sid.
10:58
Speaker 1: The agreement also includes ties temporary bill credits funded through
11:02
deferred tax liabilities, which the company said would reduce customer
11:06
bills during the first two years. The settlement agreement provides
11:11
the Commission with a middle ground, said Tanner Wolfram, Kentucky
11:15
Power's director of regulatory Services. It balances the Kentucky's financial
11:20
needs with customer's ability to pay. Kentucky Power estimated residential
11:25
customers will see an average bill increase of about seven
11:29
percent in the first year, rising gradually in later years
11:33
as the temporary credits expire. These benefits are only available
11:38
if the settlement agreement is approved in its.
11:40
Speaker 2: Entirety, the company wrote.
11:43
Speaker 1: Kentucky Power also asked the Commission to approve a pre
11:46
paid billing option known as flexpay. The company said the
11:51
program would give customers more control over energy use and
11:55
payment timing. Flexpay benefits customers by providing flexible ability and
12:00
greater insight into energy usage, the company wrote, adding that
12:05
similar programs have been successfully implemented by other utilities. Reliability
12:11
costs emphasized. The filing places significant emphasis on reliability, particularly
12:18
vegetation management and storm related expenses. Kentucky Power said trees
12:24
outside rights of way remain the leading cause of outages
12:28
in its service territory. As part of the settlement, Kentucky
12:32
Power agreed to defer some vegetation related capital spending while
12:37
gaining the ability to defer future costs for later review.
12:42
The company also supported including two million dollars in annual
12:46
storm costs in base rates, citing recent Commission orders that
12:51
limited its ability to recover non major storm expenses. The
12:56
next story is new filing seeks to bull strict case
13:00
for former sheriff's testimony in case against his ex deputy.
13:06
Attorneys for Sabrina Atkins on Tuesday filed a detailed supplemental
13:11
motion in federal court outlining what testimony they expect from
13:15
former Electric County Sheriff Mickey Steins, after a magistrate judge
13:20
denied an earlier request to have Steins transported to testify
13:24
a trial.
13:26
Speaker 2: The filing, submitted in U.
13:28
Speaker 1: S District Court for the Eastern District of Kentucky, responds
13:31
to an order by Magistrate Judge Edward B. Atkins, who
13:35
ruled last week that the plaintiff had not adequately explained
13:39
the necessity of Steins's testimony in a civil lawsuit against
13:43
the Letcher County Sheriff's Department and former deputy Ben Fields. Steins,
13:49
who is incarcerated on a murder charge in the shooting death.
13:52
Speaker 2: Of District Judge Kevin R.
13:54
Speaker 1: Mullens, is identified in the case as the final policymaker
13:58
for the Sheriff's office during the period at issue. In
14:02
the supplemental filing, Atkins's attorney, Joe Childers, listed seventeen specific
14:08
areas of expected testimony, including allegations that the Sheriff's department
14:13
failed to conduct required training on sexual misconduct, did not
14:18
enforce secondary employment policies, handled complaints informally rather than through
14:23
written procedures, and lacked an internal affairs function. Motion also
14:29
claims Stein's would testify that he recommended Fields for employment
14:34
with East Kentucky Correctional Services and was aware that Fields
14:37
performed EKCS duties while wearing a Sheriff's deputy uniform. According
14:43
to the filing, Steins is expected to acknowledge that Fields
14:47
violated departmental sexual misconduct policies and that the department did
14:52
not discipline employees for sexually explicit communications exchanged among deputies.
15:00
Magistrate Judge Atkins, no relation to Sabrina Atkins, had denied
15:05
the original motion without prejudice, allowing the planet to refile
15:09
with greater detail. The court has not yet ruled on
15:12
the renewed request. Sabrina Atkins alleges that Fields coerced her
15:18
into having sex in exchange for reducing or waiving home
15:22
incarceration monitoring fees while she was on bond. Fields has
15:27
denied the allegations, but pleaded guilty in Lecture Circuit Court
15:31
to third degree rape, third degree sodomy, tampering with a
15:35
prisoner monitoring device, and second degree perjury. The civil trial
15:41
is scheduled to begin March fourth in London. Fields moonlighted
15:46
as a home incarceration supervisor for East Kentucky Correction Services Incorporated,
15:51
which was one of the original defendants in the case,
15:54
and provided electronic monitoring devices ankle bracelets to persons required
15:59
to wear them as a condition of their bond. The
16:03
case revolves around Atkins's claim that Fields coursed her into
16:07
having sex in exchange for not paying her home monitoring
16:11
fees when she was released on bond after being arrested
16:15
on a drug charge. Fields claims in the civil suit
16:19
that Atkins pursued him, including sending pictures of her chest
16:23
to him on text messages. Whether or not Fields's claim
16:28
that Atkins seduced him as found to be true in
16:30
the civil case, Kentucky law makes it a crime for
16:34
a person to have sex with someone over whom they
16:36
have authority. Fields pleaded guilty and Lecter Circuit Court to
16:41
third degree rape, third degree sodomy, two counts of tampering
16:45
with a prisoner monitoring device, and second degree perjury. He
16:50
was sentenced to seven years, with six months to be
16:54
served in the Lectra County Jail where he worked before
16:57
becoming a court security officer, and the other six and
17:00
a half years probated. He is now serving that probationary time.
17:06
Eastern Kentucky Correction Service Incorporated of South Shore settled with
17:10
Atkins last month. While the order dismissing the case against
17:15
e KCS says both parties will pay their own legal fees,
17:19
other terms of the settlement have.
17:21
Speaker 2: Not been disclosed.
17:23
Speaker 1: Atkins is now intending to raise money online, starting a
17:27
gofund me account asking for eight hundred dollars. So far,
17:33
she has raised twenty dollars. Atkins has posted links to
17:37
the account several times over the past few days, asking
17:40
for money, saying she has suffered nightmares and panic attacks.
17:45
The money, she said would be used to pay legal fees,
17:48
motel costs, and travel expenses related to her lawsuit. The
17:53
financial burden of legal fees, now exceeding one hundred fifty
17:57
thousand dollars has been crippling Atkins. The next headline is
18:03
ex inmate says money is behind most courthouse rumors.
18:07
Speaker 2: Note.
18:08
Speaker 1: The Mountain Eagle is publishing this story because unverified allegations
18:13
circulating on social media have raised serious questions within our
18:17
community about events connected to the Letter County Courthouse and
18:21
the killing of District Judge Kevin R.
18:23
Speaker 2: Mullins.
18:24
Speaker 1: The judge at the center of these rumors is deceased
18:27
and cannot respond. For that reason, we have taken care
18:30
to clearly distinguish between documented facts, personal opinions, and unproven claims,
18:37
and we have sought comment from those named. Readers are
18:41
encouraged to approach all information, especially that encountered online, with
18:45
caution and critical judgment. A former inmate of the Lectri
18:50
County Jail says revenge, attention, and money are motivating the
18:54
spread of rumors and unverified allegations of sexual abuse connected
18:59
to the Letcher County Courthouse. She has also provided an
19:03
audio recording to The Mountain Eagle that she says reflects
19:07
the motivations of people spreading those allegations.
19:11
Speaker 2: Letcher District judge Kevin R.
19:12
Speaker 1: Mullens, who was shot to death in his chambers by
19:16
then sheriff Sean Nicky Steins on September nineteen, twenty twenty four.
19:22
The shooting occurred shortly after a deposition given by Steins
19:26
in a lawsuit whose core allegation is that Mullins's bailiff
19:30
entered the courthouse after hours and had sex for the
19:33
woman who had been released on bond with electronic monitoring.
19:37
While the lawsuit contains no allegation that Mullins was involved,
19:41
the timing of Steins's deposition and the killing fueled online
19:46
rumors and accusations against the judge. The salacious nature of
19:51
the lawsuit, combined with the killing of a judge by
19:54
the official charge with protecting him, triggered intense speculation across
19:59
social media, true crime podcasts, video blogs, and tabloid television.
20:06
No criminal charge, civil claim, or sworn testimony has accused
20:10
Mullens of sexual misconduct. The fact that Mullins is dead
20:15
and cannot defend himself does not sit well with Randy Holbrook.
20:20
In and out of juvenile court, Holbrook transitioned to adult
20:23
court when she came of age, and eventually spent fifty
20:27
two months in prison for a felony conviction of promoting
20:30
contraband after being found in position of metham famine while
20:35
in jail. Now thirty one years old, married, sober, and
20:40
living in Alabama, Holbrook said she still has deep roots
20:44
in Letcher County. She has been defending the late judge
20:48
on social media and agreed to speak with the newspaper
20:51
about why she has taken a position opposite that of
20:54
former inmates with whom she spent years in jail and prison. Holbrook,
21:00
who was an honors student and athlete during her high
21:02
school years, said she stepped forward because she knows what
21:07
it is like to be falsely accused of a sex
21:09
crime and believes such behavior would have been completely out
21:13
of character for Mullins. I've been dealing with him since
21:17
I was fifteen or sixteen years old in truancy court,
21:20
and he was always good to me, Holbrook said. He
21:24
was never out of the way with me, and I
21:26
do have a little rough history with drugs and things.
21:29
Because of her experience, she said she understands how Mullins's
21:33
family and others connected to the courthouse may feel about
21:37
the rumors now circulating online. Hilbrook said she also respected
21:42
former sheriff sewn Mickey Steins, what was horrified by video
21:46
showing him shooting Mullins in the judges chambers. Murder is murder,
21:51
she said. She said she is particularly troubled by allegations
21:56
being spread online by Tya Adams, with whom Hohl spent
22:00
approximately five years in jail and state prison. Holbrook said
22:05
Adams told her she never had sex with Mullins, but
22:08
did have sex with another man whose first name Adams
22:11
used in conversation. Holbrook said she believes the man was
22:15
an attorney who represented Adams, but provided no documentation to
22:20
support that belief. Holbrook said she believes Adams would have
22:24
told her if she had ever been involved with Mullins,
22:27
as Adams now claims she was, beginning at age sixteen.
22:31
I don't know if Kevin was always moral in his career,
22:35
but I know he.
22:36
Speaker 2: Was a good judge. Holbrook said. He was fair.
22:39
Speaker 1: He put a lot of kids back on the right track,
22:42
and he put a lot of kids back with their families.
22:45
Holbrook said she believes people spreading the allegations are motivated
22:49
by the belief that sensational claims can generate attention and
22:53
income online. She said she has heard former acquaintances say
22:58
as much, and that some have attempted to recruit her
23:01
to participate. She also said Adams attempted to persuade her
23:05
to share stories about the judge and jail employees, but
23:08
she refused. Holbrook supplied screenshots of text messages that appear
23:14
to show exchanges between her and Adams. That's what Tia
23:18
is doing, Holbrook said, She's trying to make it go
23:21
viral and make money on YouTube. I believe in karma man,
23:25
and it's going to come back on them. YouTube allows
23:29
users to earn money by attracting viewers to their videos.
23:34
When a channel becomes popular, YouTube places advertising on the
23:38
videos and pays.
23:40
Speaker 2: The creator a share of the revenue.
23:43
Speaker 1: Additional income can come from donations or paid subscriptions. Videos
23:48
that draw strong emotional reactions often get more views, which
23:52
can create incentives to exaggerate or spread unverified information. When
23:58
asked whether she could sup intentiate her claims about motivation,
24:02
Holbrook provided a screen recording from her phone's messaging application.
24:08
The recording shows a conversation with Taia. Identified at the
24:11
top of the screen. The profanity laced recording, which has
24:16
been heavily redacted, does not reference Judge Mullins by name
24:20
and does not constitute proof of any specific allegation. In
24:24
a portion of the recording, she says she is fed
24:27
up with them and it is finally time for us
24:30
to get paid for all that bs they put us through.
24:33
Reached for comment Monday, Adams said she wasn't talking about
24:37
real money when she said that she and other women
24:39
who have served time in the county jail deserve to
24:42
be paid. Adam said she was instead talking about the
24:45
need for law enforcement officers, court officials, and state social
24:49
workers to be held accountable for the wrongdoings she believes
24:53
they have done to her and other women who were
24:55
jailed for drug offenses. I don't want to get paid,
24:59
Adam said, I just want my children and I want
25:01
my freedom.
25:02
Speaker 2: That's all I've ever wanted. Adams, who co hosts a YouTube.
25:07
Speaker 1: Channel called Appalachian Dreams, is the mother of four children,
25:12
three of whom she is not allowed to have contact with.
25:15
She says she is on court ordered probation until two
25:18
thousand ninety nine unless she pays off child support obligations
25:21
before then. All I'm fighting for is my kids, she said,
25:26
and some one is going to have to be held accountable.
25:29
Holbrook recalled encountering Mullins at gas stations and grocery stores
25:33
prior to his death. She said he spoke openly about
25:37
his faith and consistently encouraged her to get off drugs.
25:42
Mullins was also the judge who referred her case to
25:44
the Lecture County Grand Jury, which later indicted her on
25:47
a felony drug charge that resulted in a five year
25:51
prison sentence. Even though he was a judge and had
25:54
to send me upstairs to circuit court, he did what.
25:57
Speaker 2: He had to do, she said.
25:58
Speaker 1: He treated me like a huge when I saw him
26:01
outside the court house. He always told me I could
26:03
do better. I don't believe the stories about Judge Mullins,
26:07
but I can't say they are impossible, she added, from
26:10
my experience, there's no way. This concludes the reading of
26:15
The Mountain Eagle. Your reader has been Bill and Arsenal.
26:19
Now please stay tuned for continued programming on behalf of
26:23
everyone here at radio. I thank you for listening, and
26:27
have a good day.
