- 1:32the BOP's Northeast Regional Office begins arranging for technicians from
- 1:38other BOP institutions to perform temporary duty assignments to MCC
- 1:43New York to perform necessary mechanical, electrical, plumbing, and wiring work. However,
- 1:52during the course of the TDY rotations, work is not
- 1:56consistently conducted on the camera upgrade because tde U personnel
- 2:01are sometimes used to cover shortages at MCC's New York
- 2:05custody posts. July second, twenty nineteen, according to court records,

- 2:42medically screened an MCC New York Facilities assistant asks the
- 2:47Psychology Department to evaluate Epstein because he appears distraught, sad,
- 2:53and a little confused. Epstein is assigned to the MCC
- 2:58New York Special Housing Unit because of significant media attention
- 3:02and his notoriety among other MCC new York inmates. July eighth,
- 3:08twenty nineteen, according to court records, Epstein is arigned in
- 3:13federal court and enters a plea of not guilty to
- 3:16all charges. The court sets a detention hearing for July

- 3:25a routine intake screening of Epstein, the records of which
- 3:28indicate that Epstein denies the history of any mental health problems.
- 3:34After the Chief Psychologist consults with a National Suicide Prevention
- 3:38Coordinator from BOP Central Office, the Psychology Department conducts a
- 3:43further evaluation of Epstein after his return from court. Record
- 3:48show that Epstein denies any suicidal thoughts, but was placed
- 3:52on psychological observation due to the presence of risk factors,
- 3:56high profile case nature of the charges, pre trial status,
- 4:00and ongoing proceedings. July ninth, twenty nineteen, the Psychology Department
- 4:07administers a formal in person suicide risk assessment for Epstein.
- 4:12The Psychology Department continues psychological observation for another day, pending
- 4:18a suitable housing placement. July tenth, twenty nineteen, the Psychology
- 4:24Department administers a formal in person suicide risk assessment for Epstein.

- 5:14At Epstein's request, an mcc New York psychologist meets with
- 5:19him during a legal visit. July eighteenth, twenty nineteen. According
- 5:24to court records, Epstein appears in court for a ruling
- 5:27on the issue of detention. The court orders at Epstein
- 5:31be detained pending trial because he presents a danger to
- 5:34the community and he is a flight risk. The psychology
- 5:38department conducts a thirty day psychology review for the entire
- 5:43shoe population. Epstein is not in the shoe at the time,
- 5:46and therefore his review is not conducted. July twenty second,
- 5:51twenty nineteen, according to court records, Epstein files an appeal
- 5:56of the court's order denying Epstein pre trial release. July
- 6:00twenty third, twenty nineteen, at approximately one twenty seven, a
- 6:05m shoe staff hears noises coming from Epstein's cell Epstein's
- 6:10cell mate, inmate number one says that Epstein has attempted
- 6:14to hang himself. Shoe staff observes Epstein lying on the
- 6:18floor with a piece of orange cloth around his neck.
- 6:21Epstein initially tells emcc new York staff that his cell
- 6:25mate tried to kill him. Epstein's cell mate inmate one
- 6:29tells emcc new York staff that while he was asleep,
- 6:32he felt something hit his legs and when he turns
- 6:35on the light, he saw Epstein with a string around
- 6:38his neck and call the guards. Epstein is transferred out
- 6:41of the shoe and placed on suicide watch in a
- 6:44cell near the Psychology Department and Health Services unit. Later
- 6:50that morning, Health Service's unit personnel conduct a medical assessment
- 6:54and observed that Epstein has red marks two thirds of
- 6:58the way around the front and sides of his neck.
- 7:02The BOP assesses Epstein for risk of suicide and determines
- 7:06that he should remain on suicide watch. July twenty fourth,
- 7:10twenty nineteen, at approximately eight forty five am, Epstein is
- 7:15removed from suicide watch, but remains under psychological observation in
- 7:20the same cell near the Psychology Department and Health Services unit.
- 7:25Medical staff examine Epstein at one o eight pm, and
- 7:29Psychological services staff complete oppost suicide watch report. In contrast
- 7:35to his prior statement that his cellmate tried to kill him,
- 7:38Epstein does not remember how he sustained the injuries to
- 7:41his neck. July twenty fifth through July twenty ninth, twenty nineteen,
- 7:47Epstein is seen by the Psychology department daily, and on

- 8:00twenty ninth, twenty nineteen, Psychology Department staff determine that Epstein
- 8:06can be released from psychological observation and transferred back to
- 8:10the Shoe. Disc failures occur in DVR two of mcc
- 8:16New York security camera system, which result in the system
- 8:19being unable to record, although the cameras continue to work
- 8:23and broadcast live video feed, MCC New York personnel do
- 8:28not learn of the DVR two recording failure until August eighth,
- 8:32two days before Epstein's death. Roughly half of MCC's New
- 8:36York security cameras, including those located in the Shoe, are
- 8:40assigned to record to the DVR two system. July thirtieth,
- 8:45twenty nineteen, Epstein is transferred back to the Shoe. An
- 8:49mcc New York staff psychologist from the Psychology Department sends
- 8:54an email to over seventy BOP staff members stating that
- 8:58Epstein needs to be housed with an appro oropriate cell mate.
- 9:01Epstein and his new cell mate in May three are
- 9:04placed in a cell within the Shoe that can accommodate
- 9:07the electrical needs of Epstein's medical device. MCC new York
- 9:13conducts disciplinary proceedings against Epstein for alleged self mutilation and
- 9:18ultimately concludes that there is insufficient evidence to find that
- 9:22Epstein engaged in a prohibited act. When Epstein is psychologically
- 9:27evaluated in connection with the disciplinary proceedings, he said he
- 9:32does not remember how he sustained the marks around his neck.
- 9:36Mcc new York personnel attempt to obtain an estimate from
- 9:39Company one to run the wiring and conduit for the
- 9:43new camera system, which would eliminate the need for BOP
- 9:47technicians to perform the work. July thirty, first, twenty nineteen,
- 9:53according to court records, Epstein appears in court for a
- 9:56status conference, at which time the court set's deadlines for

- 10:20twenty nineteen, mcc new York Receiving and Discharge staff notify
- 10:26the Psychology Department of the rotation of suicidal tendencies on
- 10:30US Marshall Service paperwork relating to Ebstein. The Psychology department
- 10:35conducts a suicide risk assessment of Epstein, who denies that
- 10:39he is suicidal and determines that suicide watch is not warranted.
- 10:44Psychological staff recommend a follow up in one week August two,
- 10:49twenty nineteen. Mcc new York Special Investigative Services completes its
- 10:54investigation into the incident on July twenty three, twenty nineteen,
- 11:00and finds that there is insufficient evidence to determine that
- 11:03Epstein harmed himself or that he was harmed by his cellmate.
- 11:07August eighth, twenty nineteen, Epstein is seen in the Psychology
- 11:12department and denies suicidal ideation, intention, or plan. Epstein meets
- 11:19with his attorneys and, unbeknownst to the mcc new York personnel,
- 11:23changes his last will and testament. During the meeting, mcc
- 11:28new York staff received notice that Epstein's cellmate will be
- 11:31transferred out of the institution the following day, August ninth,
- 11:36mcc new York staff discover the disc failures that occurred
- 11:40in the DVR two system on July twenty ninth that
- 11:43resulted in approximately one half of the institution security cameras
- 11:48not recording, although the cameras continued to broadcast a live
- 11:53video feed. Mcc new York staff do not perform the
- 11:57work necessary to restore recording functionality of the DVR two
- 12:02system or address long standing performance failures with the institution's
- 12:07camera system. August ninth, twenty nineteen, at approximately a thirty am,
- 12:14Epstein's cellmate in May three is transferred out of mcc
- 12:19new York. Two mcc new York staff members said they
- 12:23notified supervisory staff of Epstein's cellmate transfer and Epstein's need
- 12:28for a new cell mate. Other witnesses did not corroborate
- 12:32these statements. Epstein is not assigned to new cellmate as
- 12:36required by the Psychology Department. Some time between eight am
- 12:41and nine AM, Epstein meets with his attorneys in the
- 12:45Shoe Attorney conference room. Sometime prior to one pm, Epstein's
- 12:50attorneys asked mcc new York staff members if Epstein could
- 12:54be moved to a different housing unit or housed with
- 12:57the cellmate. Mcc new York staff obtain the replacement hard
- 13:02drives to repair the institution security camera system, but do
- 13:06not complete the repairs necessary to restore the recording functionality.
- 13:11And address long standing performance failures within the institutions DVR
- 13:16two system. The US Court of Appeals for the Second
- 13:20Circuit unseals approximately two thousand pages of documents in civil
- 13:25litigation involving Glaine Maxwell, who was later convicted in December
- 13:30of twenty twenty one of conspiring with Epstein to sexually
- 13:34abuse minors over the course of a decade. Some of
- 13:38these documents contain information that may relate to the criminal
- 13:41charges pending against Epstein. There is extensive media coverage of
- 13:46information in the unsealed documents. At approximately six forty five pm,
- 13:52Epstein leaves the attorney conference room. At approximately seven pm,
- 13:57contrary to GOP policy, but with the permit miss of
- 14:00a unit manager, Epstein is permitted to place an unmonitored
- 14:04telephone call to a number with a New York City
- 14:07area code, purportedly to speak with his mother. In actuality,
- 14:12Epstein speaks with somebody whom he allegedly has a personal relationship.
- 14:17After the call, Epstein is returned to his cell, where
- 14:21he remains without a cell mate. Mcc New York Shoe
- 14:25staff members do not conduct the four pm or ten
- 14:28pm inmate counts. After approximately ten forty PM, shoe staff
- 14:34members do not conduct their required thirty minute rounds. August tenth,
- 14:39twenty nineteen, mcc New York Shoe staff members do not
- 14:44conduct the twelve am, three am or five am inmate counts,
- 14:48or any of the thirty minute rounds from twelve am
- 14:52until approximately six thirty am. At approximately six thirty am,
- 14:58shoe staff begins to delu of her breakfast to inmates
- 15:01in the shoe through the foot slots in the lock
- 15:04cell doors. When shoe staff attempt to deliver breakfast to Epstein,
- 15:08shoe staff unlocked the door to the tier in which
- 15:11Epstein's cell was located and then knock on the door
- 15:14to Epstein's cell. Epstein, who is housed a loan in
- 15:18the cell, does not respond to the shoe staff. Shoe
- 15:21staff unlocked the cell door and find Epstein hanged in
- 15:24his cell with one end of a piece of orange
- 15:27cloth around his neck and the other end tied to
- 15:30the top portion of a bunk bed in Epstein's cell.
- 15:35Epstein is suspended from the top bunk in a near
- 15:38seated position, with his buttocks approximately one inch to one
- 15:42inch and a half off the floor and his legs
- 15:45extended straight out on the floor in front of him.
- 15:49Shoe staff immediately activate a body alarm, which notified all
- 15:54mcc new York staff of a medical emergency and prompted
- 15:58mcc new York staff in the control center to call
- 16:02for nine to one to one emergency services. Shoe staff
- 16:05then rip the orange cloth away from the bunk bed,
- 16:08which causes Ebstein's buttocks to drop to the ground. Shoe
- 16:12staff lay Abstein on the ground and immediately initiate CPR.
- 16:17At approximately six thirty three am, BP medical staff respond
- 16:22to the shoe continue CPR, apply the automated external defibrillator,
- 16:27and move Ebstein to mcc new York's Health Services Unit.
- 16:32Minutes after arriving in the Health Services Unit, an ambulance arrives,
- 16:36and paramedics continue CPR in debate Epstein, and administer medications
- 16:41and fluids. At approximately seven ten am, the ambulance takes
- 16:46Abstein to New York Presbyterian Lower Manhattan Hospital, where he's
- 16:51pronounced dead at seven thirty six a m by the
- 16:54emergency room physician. Mcc new York staff unsuccessfully attempts to
- 16:59recover or video from the DVR two system of the
- 17:02shoe and the BOP begins repairing the DVR two system.
- 17:07The FBI seizes all hard drives contained in the DVR
- 17:11two system as evidence. August eleventh, twenty nineteen, the Office
- 17:17of the Chief Medical Examiner, City of New York conducts
- 17:20an autopsy of Epstein. August fourteenth. August fifteenth, twenty nineteen,
- 17:28the FBI returns to mcc New York and sees the
- 17:31additional components of the DVR two system and the entire
- 17:35DVR one system. The FBI's Digital Forensic Analysis Unit in Quantico,
- 17:41Virginia begins to conduct a forensic analysis of mcc New
- 17:46York's DVR systems and determined that there were catastrophic disc
- 17:50failures in the DVR two system disc array, and no
- 17:54recordings were available on the DVR system after July twenty ninth,
- 17:58twenty nineteen. August sixteenth, twenty nineteen, the Office of the
