- 0:03This is a bramble Jam podcast this week on Yo gavel Gabble. If your
- 0:15kid gets hurt while your nanny's watching him, can you sue her? Judge
- 0:19Rows is here to sort out this nanny. No, no, the radio
- 0:22station tricks you into getting their call letters tattooed on your forehead. Is it
- 0:26their fault? Judge Gina tells us real people, real cases, Hey justice.
- 0:32This is yo gabble gabbo. H. That was a comedy of errors.
- 0:40First I realized I didn't have my mic anywhere near here. You.
- 0:45Then you kept the camera on me, your entire thing, and I'm just
- 0:50trying to get my computer turned back on and do the facial recognition. I
- 0:54look up, it's still me, and I'm like, real cases, fake
- 0:57justice. Everyone. This is your gabble gabble though it is. We're just
- 1:00already on Christmas break. We're just Merry Christmas, everybody. Christmas one week,
- 1:06yes, man, We're one week away from Christmas? Can you believe
- 1:10it? A week from today you'll be sitting around your Christmas tree, open
- 1:12up those presents with your immediate family. See what See what Santi brought?
- 1:17Yes, santy Claus, Santa is uh he's immune to mistress, is what
- 1:23I heard. Or he's already had or something. I don't know, Mistress,
- 1:26I don't know why unless he's a mall Santa, because I did see
- 1:32that there was a little situation somewhere recently. Yeah that makes sense, So
- 1:34there you go. Um, if you were Santa, would you take the
- 1:40year off? Oh? Yeah, for sure? Yeah yeah, coal for
- 1:42everybody. Yeah, I always laugh. There's a special that I watched going
- 1:47up a year without a Santa claus Um and it's a ranking and baths sitch
- 1:53and it's great and Santa is a little bit under the weather and Christmas spirits
- 1:56down. Oh he takes takes you. He wants to take the year off,
- 2:00and so the elves go down to see it prove that they're still Christmas
- 2:02spirit. And my I just I I every year, even as a kid,
- 2:07I was like, it's one day, like just like even if you're
- 2:10throwing up, just like fight like, it's literally one day. Even as
- 2:15a kid, I had that counting on you. Yeah, I had that
- 2:17rational. So, um, we've got some doozies today. Who do you
- 2:22have? Judge Ross went back to America's court, baby, and I go
- 2:25back to I went back to the personal injury court, which I just love
- 2:29you has to be. I saw I was watching mine and looked up and
- 2:32just saw a guy with crud tattooed on his forehead. So I can't wait
- 2:36for yours, but I feel like it's the main course. You think mine's
- 2:39a little shorter. Okay, you want me to go ahead? Let okay,
- 2:43So let me introduce you to Tara and Jerry Oakford. I don't want
- 2:47I've had it with that. Yeah, I think we all hope. They
- 2:51are suing Madison Walsh for two thousand, three hundred forty seven dollars and sixty
- 2:55six since. Um, they both need to speak to the manager. They
- 3:00are the parents of a three year old named Cameron. Now I need to
- 3:05tell you this before we go any further in this case. Apparently I just
- 3:09clicked on the YouTube TV DVR. This case is from twenty ten. Okay,
- 3:14wow, so there's gonna be a lot of referencing the internet on this
- 3:17case. And if you have the question of wait a minute, that's not
- 3:21that big of a deal. In two ten, how does Judge Ross look?
- 3:25Um, he looks great, just a fox Chris. He doesn't look
- 3:29at his age much in ten years. It's unreal. Um. This was
- 3:31in season one apparently of this is the first season ever of Judge Rows.
- 3:37So h. This takes place in twenty ten. That should help us technologically.
- 3:40Are you now ready to go? Ready to go? Okay? Good?
- 3:44So U. The parents are suing Madison for their three year old emergency
- 3:50room bills. H not their three year old emergency room bills, their emergency
- 3:53room bills from their three year old while the child was in the care of
- 3:58wash. The child's name is Cameron. They said they hired Madison in March
- 4:01of twenty ten, and they they wanted her to be a part time nanny.
- 4:05Basically, while Tara was at work Monday Wednesday Friday nine am to three
- 4:11pm, she would nanny them, so roughly eighteen twenty hours a week.
- 4:14So on May twenty eighth, roughly three months into Madison's care of Cameron,
- 4:19there was a call made from Madison to Tara saying, oh my goodness,
- 4:25Cameron has fallen down the stairs. Were going to the emergent. He can't
- 4:29get up, He's fallen down. This hate that so um. Judge Raws
- 4:32stops and talks to the dad and says, hey, uh, Jerry,
- 4:36during the three months before this incident, were you pleased with Madison's performance?
- 4:41He says, yep. She was a great nanny. She cared for her
- 4:43son. Our son loved her, no issues, great references. Um,
- 4:47how long did she work with them? Three months? Started March, all
- 4:51of March, all of April. This happened May twenty eight most so they
- 4:56met at the urgent Care clinic and you know, there were some bills associated.
- 5:00I don't know what all happened, but he has a cast on now
- 5:02and we're reminding the boy. The boy does okay. So um, Judge
- 5:06Ross turns to Madison Walsh and says, miss Walsh, h you're responsible for
- 5:11caring for Cameron. Is it every day? No, they do this whole
- 5:13part time. Bid it's three days a week. And then he says have
- 5:15you ever worked as a nanny before, and she says, yeah, I've
- 5:17worked on and off for five years. I'm a student and so I do
- 5:21this to help pay for my college. Um, and I love Cameron like
- 5:26he's my own boy. Um. We were playing in the living room.
- 5:29We were playing hide and see kind of like an I'm gonna get you a
- 5:31game. You know, like three year olds they run around, I'm gonna
- 5:34get you, and that's what we were playing. Wow, I know I
- 5:38know the game well as well anybody's had a three year old and knows the
- 5:40game. So without like, it's not it's not as good as to say,
- 5:44hey, I'm gonna go to sleep game. That's my favorite. Yeah,
- 5:46the favorite game. The best is my kids now are into knock knock
- 5:48jokes. They don't quite know how they work, and it's fantastic. Give
- 5:53me one, um uh and uh, this is one. Rady's knock knock.
- 5:59He's there, Daddy, daddy, daddy. Tickle there's one that's good.
- 6:04That's a good one. Turn it into a tickle bit. I love.
- 6:08Their favorite is I say knock knock, and I say night, night
- 6:13night, and I fall asleep and they come and wake me up. And
- 6:16when they wake me up, I yelled good morning and tickle them and they
- 6:19literally every day after dinner, Jay comes over dead. Can we play knock
- 6:24knock? I think it's a jam. I love it right, so I'm
- 6:27not, no, no, well let's try it. That's not knock knock.
- 6:30No no, no, no, no no. Brand So this three
- 6:33year old tickletill, tickletil. Today you are doing the answers even though I
- 6:40didn't ask the questions. That's impressive. Knock knock brand tickletill, it's good
- 6:47stuff. This is where yours where bramble jam plus sign up ad free.
- 6:51Uh. So, she says she's playing I'm Gonna Get You, and car
- 6:55Cameron darts up the stairs. Yes, he runs up the stairs. He
- 6:59thinks that's part of the fund, so she immediately follows him up the stairs.
- 7:02He's in his room playing and they continue to play the game in his
- 7:06room. I'm Gonna get you, blah blah blah. He runs out of
- 7:10his room and the staircase splits the parents' bedroom and the kid's bedroom. So
- 7:15are you with me? Staircase parents better room one side, kids better room
- 7:18on the other. He runs like he's going and this is her observation.
- 7:21She gets up to chase him. He runs like he's going to his parents'
- 7:25bedroom, and in her witness, she says, it either he turned or
- 7:30he stopped, but his foot slipped on the top step. He fell all
- 7:32the way down the stairs. Immediately, I called the parents, made sure
- 7:38he was okay. We took him to the urgency, urgent care clinic,
- 7:41the urgency. That is what happened, the urgency. So Kevin Ross says,
- 7:44mister and missus Oakford were either of you there when this incident occurred.
- 7:47They both say no. He says, okay, do you have a nanny
- 7:50camp or some sort of surveillance device in your home to see what's going on
- 7:56there? They both say no, and he says, so how do you
- 7:58know this is negligent? And they said, well, I went on the
- 8:01Internet the evening of the incident and saw that Madison had posted board come a
- 8:09babysitting five minutes before she called me, by five minutes before she called me,
- 8:18posted that on the internet. You know the internet. You've heard of
- 8:20it. And Ross said, Madison, did you post that on the internet?
- 8:22And she said, I don't remember putting anything on the Internet. The
- 8:26only time I get on the internet is when Cameron is napping and mister Oakeford
- 8:31starts waving around. She had a paper waving around. Ross is like,
- 8:35what Internet? Well? This my space? Facebook? They don't say,
- 8:37but they say the social site. I think it's Facebook. Oh they can't
- 8:41use it. That's what I think is happening here. So um, mister
- 8:43Rogford says, I have printed this. He says this, I printed this
- 8:48out from the internet. I printed this out from the internet. And this
- 8:54happened five minutes before the phone call. And she says, how do you
- 8:56know what happened five minutes with a phone call? I got called on my
- 8:58lunch break. I would have lunch, I had to clock out twelve thirty's
- 9:01when I got the phone call. We can match it up five minutes ross
- 9:05because hey, have you seen this yet, Madison? No, I've not
- 9:07seen it yet. He says, Well, the timing of this call and
- 9:09this post doesn't describe the same incident that you described to me. I need
- 9:15you to explain the difference. And she says, I understand why you have
- 9:18questions. I don't remember posting that at that time, but I with a
- 9:24three year old, a lot can happen in ten minutes. Their computer is
- 9:28in the living room. I don't recall being on the internet at the time
- 9:31before the incident. That's right, because it's not like she had a smartphone.
- 9:35She would have had to be on a desktop logged in to the internet,
- 9:39right, So then missus oaks a computer. It's in the living room,
- 9:43where they were playing. Okay, Missus Oakrad said she shouldn't be on
- 9:46the internet at all, and Ross says, is that an agreement that you
- 9:48have and and missus Oakford says yes. He says if it's written, it's
- 9:52not written anywhere. But that's an agreement he said they had. Mister Oakford
- 9:54said, look, she's on her phone. We understand accents happened. She's
- 9:58on her phone all the time. Anyway, it would not see Yeah,
- 10:03she would not surprise me if she's also getting on the internet as well.
- 10:07And Madison said, it's never been a problem. You've never complained to me
- 10:09about that. Ever. Ross says, hey, you said she was a
- 10:13good babysitter for three months, so that seems like it's not not adding up.
- 10:18So um, Ross said, hey, is this what like? Is
- 10:22this the only way this could have happened? And and uh, mister Roakeford
- 10:26said, I think it's highly probable based upon this post, and Ross says
- 10:31I do too, I think it's highly probable as well. And then rossays,
- 10:35how she was on the internet, and yes, how's Cameron doing?
- 10:39And and uh, the mom says healing, but he's in a cast just
- 10:43like that like, how dare you so? Now? Ross is ready for
- 10:48the ruling two thousand and six whatever, it doesn't matter, you know that,
- 10:52Like they're not going to split it up? How much two thousand wait
- 10:58for it, three hundred forty dollars and sixty six cents. You know.
- 11:01I think the evidence in this case shows that at the at the very least,
- 11:11it didn't go exactly as she's saying. So in my mind, that's
- 11:16enough to give them the full amount. Ross is going to disagree with it.
- 11:20Interesting, he says, I always like his reasoning. So, look,
- 11:24I'm dealing with a three year old. I've had a three year old
- 11:26who had a couple of them. They're they're everywhere all the time there,
- 11:30Yes, that's exactly right. Is it possible that she was negligent and posted
- 11:37this and he felt? Yeah? In fact, I think it's highly considering
- 11:39the social media post, I think it's highly possible. But is it possible
- 11:43that she was watching this child the whole time like a hawk and this still
- 11:48happened? Yes, it is. It's still possible she was doing a great
- 11:52job and this happened. I have a witness from the dad that says she
- 11:56was a great nanny for three months with great references. I have two very
- 12:03believable witnesses. One was there, one wasn't. I cannot, with any
- 12:09judgment tell you that this definitely happened, and because of that, I have
- 12:13to judge in favor of the defendant for the entire man. No money given.
- 12:18My thing though, is yeah, I don't disagree. You can't prove
- 12:22that. But at the same time, she lied, well, she says,
- 12:28her thing is is I don't remember posting that at that time. A
- 12:31lot can happen. But she all at whether or not you said that.
- 12:37She said she was not on the computer, said I only get on the
- 12:39internet when he naps. Exactly right, Yes, So is that true or
- 12:43not? If if if she was on the internet this time and he wasn't
- 12:46napping, that's a lie. Therefore her witness she's thrown out. There were
- 12:52no phone records. There is a woman who got the thing on lunch break.
- 12:56She clocked out for lunch break, and there's the post um and then
- 13:01in the in the afterwards, the mom just says for the little after post
- 13:03thing, yeah, she shouldn't have been on that internet. Yeah, which
- 13:07shouldn't have been on that You don't get on that internet now, you don't,
- 13:11you shouldn't. Yeah, this internet, that Internet? What about this
- 13:13one? This one? Yes for no way no, Uh, we're gonna
- 13:18come back, Judge Gino, Personal injury for the legal legal sauce. We're
- 13:22gonna get to it here on y gotta go. Well back, everybody,
- 13:31it's time for personal injury chords, Judge Gino. I want to introduce you
- 13:35to a couple of people. One. Uh, he's to Plankton. His
- 13:39name is Joe Bell, joey. Uh. You know in personal injury court,
- 13:43Dan, big money is big money is at stake half mil steak Yeah,
- 13:46well a little more than half mil. Oh didn't know as possible.
- 13:50Here's what we got here, suing Joe bells uh two hundred and fifty thousand
- 13:54dollars in damages okay, ten thousand dollars in future medical and then two hundred
- 14:01and fifty k and paint and suffering for a total of five ten okay.
- 14:05He is suing the k r u D radio station Crude, namely DJ Crazy
- 14:15Silence. DJ Crazy silas one of my favorite names. Let me introduce you
- 14:18to everybody. I did that already. Here we go, Joe Joe Bell.
- 14:24No, Joe Bell started listening to k r u D a few years
- 14:31back and he loved it. Good music, good programs, good DJs,
- 14:39and he was especially fond of DJ Crazy Silas. Yeah, who wouldn't be
- 14:45he's you know you remember you know or not? Or mid two thousands,
- 14:52shock jock radio was at its peace. Oh yeah, the pranks, the
- 14:56craziness of all of it, and that's kind of DJ Crazy Silas was that
- 15:01guy. They loved the pranks. Now he gets a call from a friends
- 15:09says, hey, are you listening to kru D And he's like, no,
- 15:11not right now. And he says, well, here's the thing.
- 15:15They are offering the first person to tat two k r u D on their
- 15:22forehead two hundred and fifty thousand dollars. Wow, now big money. He
- 15:30sees this as a godsend because it's a godwink. Because my guy, he's
- 15:37a little bit down on his left. He's had to move back in with
- 15:39his parents and his parents are about to lose their house. You know what
- 15:43would help there if he had a crud tip dude on your forehead. If
- 15:48you did that, you can get a job pretty easy. Well no,
- 15:50but the two hundred and fifty thousand dollars would be enough to save the house.
- 15:52Okay, cool, Yeah enough to save the house. Now, Gino
- 15:58is like, so you are willing to get kru d crud tattooed on your
- 16:03head to save your parents' house. Yeah, you're a great son. Maybe
- 16:07a little crazy, but you're a great son. So, speaking of crazy,
- 16:11I we got to talk about Crazy Silence. Now, Crazy Silence.
- 16:15He's the DJ. He's a big deal on campus and he is known for
- 16:21his pranks, his games, and his contests, including the classics such as
- 16:27bobbing for pigs feet and the ever popular Mayo belly Flop contest that they have
- 16:34every year where they fill an inflatable pool with Mayo and people do belly flops.
- 16:41Winner takes all, loser walks loser walks, Yes, I think everybody's
- 16:45a loser in that situation. Yes, so that's the type of show Mayo
- 16:48belly Flap. I know exactly, you know exactly who he is. Now
- 16:52back to Joe. Joe says that he heard about it, heard about the
- 16:56contest from a friend, called him out, and so he want to do
- 17:00his due diligence. Called the station the station said, go to the website,
- 17:06check out the page, all the informations there. Okay, okay.
- 17:10So he goes to the website and it says first person to get kr U
- 17:17D right on the forehead, says on the website right. Okay. So
- 17:19he does not waste any time, marches down to the first tattoo parlor that
- 17:26he can find. You don't have to apply or anything, No, you
- 17:27just do it. Okay. Goes down, finds the first tattoo parlor,
- 17:32gets a tattooed right on his head. It's thick, you saw it.
- 17:36It's mess it's big, it is thick requirement he went big. No,
- 17:41he went big. It is from I it is, and it is thick
- 17:45letters. Yeah, it's not like a bold all caps all caps kr U
- 17:51D. And he goes from the tattoo parlor down to the station and he
- 17:56walks into the station and everybody in the station is staring at him in disbelief.
- 18:06They start to laugh at him. They start to take pictures of him,
- 18:10which he thinks they're posting on social media. Yeah, and he starts
- 18:15to get a bad feeling, and so a station representative comes down to meet
- 18:23him and says mister Bell. There's been a horrible misunderstanding. What give him
- 18:30all the money? Silas is like the crazy. Silence is like, never
- 18:36in a million years did I think that someone would actually do this. Now
- 18:38there's a station manager there, and a station manager brings us to the website.
- 18:42Website very clear. Here it is small link on the bottom right that
- 18:48says click for official rules. When you click for the official rules, a
- 18:55new web page pops up and says April Fools. It's April April first.
- 19:00It's an April first bit, April Fools now. And she says not only
- 19:07that, but four weeks leading up to this, on the station, we
- 19:12had an ad running that said our biggest April Fools joke ever is coming April
- 19:18first. Oh my goodness. So that's been running for weeks. Gino says,
- 19:25did you ever hear that at And he says no, And he says,
- 19:29well, I thought you were a big fan. And he says,
- 19:30well, maybe they weren't running it as often as they said they were.
- 19:33That's neither here nor there, So that's happening. Joe says on the website,
- 19:41I didn't see it. I have bad eyes, both eyes bad.
- 19:44I can't see something that's small. Man, he's starting to sound him like
- 19:47a scamer. So U Joe explains how this is negatively, negatively affected his
- 19:52life. One fired from his job. I would imagine, two girlfriend broke
- 19:57up with him, three no love life sense, and four parents still understand
- 20:04parents lost their house. I think, I don't know. I don't know
- 20:07if they were able to save it or not. Plus the removal, he
- 20:11can't afford it. It's a very expensive surgery and it's so thick you saw
- 20:17it that it might not even be able to fully remove that. It sounds
- 20:22like it's uh ten to only ten thousand dollars because that's the only yes.
- 20:26So that's not super expensive, it's he can't afford it, Okay, I
- 20:30can't afford it. Um. So Gino, you know, as he often
- 20:34does, brings in his own witness to give some sort of you know,
- 20:38third party. So he brings in a world renowned radio DJ, Ricky Smiley.
- 20:45I did google Ricky and he's a big deal. Apparently now he gave
- 20:49some insight on the relationship between DJ and listener. Everyone cheers for Ricky Smiley.
- 20:56The crowd is going nuts in Gino's courtroom, and even even my boy
- 21:00Joe bell is Rickie Ricky. He's a big fan of the DJ's now um
- 21:06Ricky tells you know, he's done some pranks in his day, including um
- 21:11telling everybody that they're going to drop one hundred thousand dollars out of a helicopter.
- 21:15It caused a block of backups in Atlanta, which is already a big
- 21:21deal. Turns out it was just one hundred thousand dollars worth of Monopoly money.
- 21:23Big haha, funny time classic classic. So what does this have to
- 21:29do? Gino says, what would would you be able to do something like
- 21:34this? And he says, if I wanted to do something like this,
- 21:38I would have had to get approval from the station. Yeah, and Gino
- 21:42says they did, they gave approval, and he says, well, they're
- 21:45also in court and everyone cheers for Rickie's final and Ricky's finally goes on its
- 21:51way. That's all Raggy gave and it is now time Dan for Judge Gino
- 21:59to rule. I can't wait to see it. Sounds like the crowd is
- 22:02really on the side of this dude who got the Jerrymander? What's his name?
- 22:07Joe Bell, Joe Bell, and I think he's just trying to scam.
- 22:12I mean, and second of all, nobody made you get it in
- 22:15bold prints. There was no size requirement, you did zero readsearch, you
- 22:21acted negligently, and there was a terms and conditions on the site that they
- 22:26said you could click if it is me, I am giving him ten thousand
- 22:33dollars to get it removed, and not a pennymore for any pain and suffering
- 22:37or for anyone's house. I think is it's a sob story he's making up
- 22:41to get rich quick. That's what I think. Now, Gino's gonna tell
- 22:44you have to be at least fifty one percent responsible. There is no way
- 22:48the radio station is that, But personally that's what I'm doing. I think
- 22:52Gino is gonna give him at least two hundred and sixty thousand dollars. That's
- 22:56what I'm going with. So here's what Gina says. Gena says, when
- 23:02it comes to presenting stuff to the public, whether it be on radio or
- 23:07TV, if there's terms and conditions, you have to make that as clear
- 23:11as possible. Okay, the radio station did a couple of things here.
- 23:15One, they made the information about it being April Fools on a separate web
- 23:22page. It was the second web page. It wasn't on the first web
- 23:25page that they sent him to. It was on a completely separate website.
- 23:30And two, they did this without thinking about the fact that they are praying
- 23:40on desperate people. Desperate people aren't going to go find the second website.
- 23:47They're gonna go to the one website that you sent him to and they're gonna
- 23:51see that and be like, this is real. I'm desperate. I need
- 23:53the money. And because of that all the money he is giving him five
- 24:00hundred and ten thousand dollars. Silence and the radio manager are freaking out.
- 24:07They're saying, you don't deserve a penny. You don't deserve a penny.
- 24:11Joe is sobbing, crying, can't believe it, is yelling at them.
- 24:15He says, there's order in my court. There's order in my court,
- 24:18and there's like, what are you doing? Wow. Joe walks out of
- 24:23the courtroom and Silas and the radio manager just watch him in disbelief. Fade
- 24:30to black. Half million dollars. That's bunkers, that's bunkers. Yeah.
- 24:36The only thing in thinking about, like I still stand by what I said,
- 24:40But in thinking about it, did you say he called the radio station
- 24:42to ask He called the radio station to ask, is this read they sent
- 24:48him to and they said, for all the information about this contest, go
- 24:52to this website and the terms of conditions. The terms and conditions were not
- 24:56on the website. It was a link to a second web page. And
- 25:00that's what screwed them. My problem is is that's a better reasoning than he's
- 25:04desperate, because had they had those if you scrolled down to the bottom of
- 25:08the page, didn't see it initially, scroll down in very small print,
- 25:12this is an April fool's joke. Your gino is saying, that would have
- 25:15covered them. I I don't you know he's desperate. People aren't looking for
- 25:19that either. Yeah, yeah, yeah, I think it's a um it's
- 25:25that's obviously hard to predict. I think his point was you did this and
- 25:30and knowing like two hundred forty thousand ards is a lot of money, there's
- 25:33someone that might be desperate enough to do it. He basically said he believes
- 25:37that they like that. They actually did think that somebody was doing We're gonna
- 25:41do it, man, that they made it they made it and increasingly difficult
- 25:47for someone who was desperate. It was quite the case. It was a
- 25:51lot of fun. I love Judge Gino. He's just so good. He's
- 25:56so good, and there's there is a lot of money. It's I could
- 26:00believe it. I I agree. I you know, I would have given
- 26:03him two hundred and sixty. I think it's the radius, like, that's
- 26:06an awful contest. Ye, give him the money that he deserves plus the
- 26:11ten to get it fixed. No pain, no pain and suffering, Like
- 26:12at the pain and suffering. My problem. He still chose to do it.
- 26:18There is there has to be some onus, on the person. Yeah,
- 26:21but that's the problem. Is is that what when you give him the
- 26:23two fifty for the contest, what you're saying is is the radio station is
- 26:26at fault for the fake contest. If you give him that two fifty,
- 26:30in my mind, you have to give him pain and suffering. No,
- 26:32because here's the thing. You do that if you get the two hundred and
- 26:36fifty thousand dollars. He's doing that knowing there are consequences. Yeah, there's
- 26:40consequences. Yes, you know what, I would have a tattoo on my
- 26:42forehead and it's going to have consequences, but it's worth it because of the
- 26:47two hundred and fifty thousand dollars. Yeah, I agree, you're right.
- 26:51That's why we have a hot bench. Whoa, we have guys. We
