- 0:00Do these days see a lot of AI talk and AI coming up?
- 0:05Is this bringing a change in the mindset?
- 0:08Is this bringing a change in the landscape of legislations?
- 0:11How is it happening? How?
- 0:13What are the changes you're seeing?
- 0:16Absolutely. When it comes to AI governance,
- 0:18there's been like, you know, an interesting amount of activities
- 0:21on the continent. So primarily you look at, I
- 0:26mean, understand 2 of countries now have like specific AI
- 0:29strategies, no less than three have like national AI policies,
- 0:33the same countries introducing things like AI charters
- 0:35policies, plan frameworks, so many also on the pipeline.
- 0:40But beyond that, we're also seeing countries take the hard
- 0:43law approach. So think Angola, Morocco, Egypt,
- 0:48Nigeria, these countries at different points have different
- 0:52iterations of AI specific laws. And if you also look at a
- 0:56country like Ghana, for example, instead of AI specific law, what
- 1:00he has, it's what you call like an imagine technologies bill,
- 1:03which is imagining imagining technologies more broadly rather
- 1:07than zeroing in on AI. And I think it's also like an
- 1:10interesting approach because what a country is basically
- 1:13doing is, you know what, it could be AI today in the next 10
- 1:17years, for example, it's probably constant computing.
- 1:19So rather than coming back here to start going through the racks
- 1:23of trying to introduce another technology specific law, how
- 1:26come we don't just look at the emerging technologies more
- 1:29broadly and then just try to set the principles, set the
- 1:33governance framework, which is very close to like a digital
- 1:36clearing house model in place before the regulation.
- 1:39So we've seen a lot of proposed initiatives to have like an AI
- 1:43or an emerging technology specific legislation in
- 1:47different African countries. And more countries have also
- 1:50announced plans like Kenya, Zimbabwe, Uganda, quite a number
- 1:53of countries are also announcing plans to sort of deal with AI in
- 1:57their own different ways to announce, I'm sorry to, to, to
- 2:00introduce AI laws. But beyond that, you're seeing,
- 2:04you know, efforts to amend existing laws, which means
- 2:10basically in some markets and in some of these countries where
- 2:12you also have like proposed laws, they're basically not
- 2:15waiting for any specific laws. So you're looking at amending
- 2:18specific law. So Angola is an interesting
- 2:20example where the data protection law, for example, is
- 2:23being amended and includes specific provisions on AI, like
- 2:28what are prohibited AI activities that you can do, What
- 2:31are the safeguards, data protection safeguards that you
- 2:34need to bake into AI considerations.
- 2:36So the proposed amendment includes all of those things,
- 2:39but another interesting thing we're also seeing away from, you
- 2:41know, trying to go through the hard law is also how existing
- 2:45authorities are also doing things around addressing
- 2:48different things around AI, whether it's the risk or whether
- 2:51it's just issuing warning and safeguard.
- 2:53So if you look at sector specific regulators like capital
- 2:56market authorities in Nigeria, Mauritius, they have a robo
- 3:00advisory guidelines and regulation which is meant to
- 3:04specifically deal with instances of companies using the robo
- 3:07advisors. And then you have data
- 3:10protection authorities who are pretty much playing the role of
- 3:14what you call like a de facto regulator in that domain as
- 3:17well. We've seen moratoriums imposed.
- 3:20We've seen, we've seen a moratorium imposed in Morocco,
- 3:22for example against Fisher recognition technology.
- 3:24We've seen Senegal deny use of Fisher recognition in workplace.
- 3:28You've seen that Kenya suspend a company using yeah, that's,
- 3:35that's an AI company, you know, using iris of people biometrics.
- 3:40You've seen some DPS issue advisories, published
- 3:45guidelines, you've seen them doing public consultation
- 3:49obviously in Senegal and Cote d'Ivoire.
- 3:51So data protection authorities are playing different role and
- 3:54the same thing, you know, competition authorities, Product
- 3:56Safety regulators in Tanzania, Kenya, Human Rights Commission
- 4:02in Nigeria, for example, talking about introducing the guidelines
- 4:05and also setting up a desk office to do with the area.
- 4:07So just to cap cap it up, a lot of things are actually happening
- 4:12was just been shipped in different ways due to national
- 4:15priorities and also different countries are taking different
- 4:20approach. But definitely we're seeing, you
- 4:22know, specific EI regulation coming up or legislation
- 4:26proposed EI legislation coming up.
- 4:27In addition to that authorities, domain regulators, sector
- 4:32speculators are doing, you know, different things at different on
- 4:37different level. 1, of course, there are also like continental
- 4:40initiatives like the African Continental Free Trade
- 4:43Agreement, Digital Trade Protocol that also has now like
- 4:46an emerging technologies and extra which will also be
- 4:49enforced alongside which also be key components about the digital
- 4:52trade protocol will be enforced. So yeah, a whole lot is actually
- 4:55happening on the continent as far as the governance is
- 4:57concerned. To catch the full discussion,
