- 4:38SPEAKER_11: Maybe you can turn the heat up, and then that's all I need.
- 4:41SPEAKER_15: Yes.
- 4:43SPEAKER_11: Hey Dave, how's it going?
- 4:44SPEAKER_15: You know, you've we've been a little bit on a hiatus, not our show, because maybe we recorded in advance, but uh yeah, you uh took a little trip uh to New York.
- 4:53SPEAKER_11: I sure did.
- 4:53SPEAKER_11: Rochester, as it were.
- 4:55SPEAKER_15: Rochester.
- 4:55SPEAKER_11: Mm-hmm.
- 4:56SPEAKER_11: Um six hours away from New York City, it's closer to Canada than it is New York City, just for all my non-New York knowing friends.
- 5:03SPEAKER_11: It is, it's really close to Buffalo.
- 5:05SPEAKER_15: Yeah.
- 5:05SPEAKER_15: Oh yeah, I've been to Buffalo.
- 5:07SPEAKER_15: Close to Niagara Falls.
- 5:10SPEAKER_15: Nice, nice, nice.
- 5:11SPEAKER_15: Well, did you have a good holiday?
- 5:12SPEAKER_11: I did have a good holiday.
- 5:13SPEAKER_11: It was fun seeing all my buddies, um, and I got to spend time with family, of course.
- 5:17SPEAKER_11: How was your holiday?
- 5:18SPEAKER_15: It was great.
- 5:19SPEAKER_15: Nice and quiet, very peaceful, very sweet.
- 5:21SPEAKER_15: Lovely.
- 5:22SPEAKER_11: Oh, as it should be.
- 5:23SPEAKER_15: Exactly.
- 5:24SPEAKER_15: Well, it is the K SJE Sunday morning wake-up call with my ever traveling friend Ren.
- 5:31SPEAKER_11: And my ever staying at home buddy Dave.
- 5:34SPEAKER_15: That was that for a come off the top of my head.
- 5:36SPEAKER_11: Because as soon as you started saying it, I went, Oh, I forgot to write down the describing words, but you did it, you did good.
- 5:42SPEAKER_11: So good job.
- 5:42SPEAKER_15: Well, and we've got kind of an interesting theme today.
- 5:45SPEAKER_15: Um I don't you know, when you said I thought when you said what you wanted to do, I'm like, I uh I did I didn't realize, I guess.
- 5:55SPEAKER_15: So I think this is gonna be an educational show for some folks.
- 6:00SPEAKER_15: Um especially for me.
- 6:03SPEAKER_15: So the Hollies that did every air that I breathe, right?
- 6:06SPEAKER_11: Yeah, the air that I breathe.
- 6:08SPEAKER_15: Um that is you got one that uh somebody tried to similar.
- 6:14SPEAKER_11: This is the let me say the title because I like the title of our show.
- 6:17SPEAKER_11: This is Take It to Court.
- 6:18SPEAKER_15: Take it to Court.
- 6:19SPEAKER_15: That's our show title.
- 6:20SPEAKER_11: These are all songs that in one way or another kind of got in trouble because they're too similar to another song.
- 6:27SPEAKER_11: Some of these cases they really did go to court and and a judge had to proceed over it.
- 6:31SPEAKER_11: A lot of them they they solved it out of court, but you know, the the the legal action was kind of hinted at.
- 6:37SPEAKER_11: And the first example um that I brought to our attention is the Air That I Breathe by the Hollywood.
- 6:43SPEAKER_11: And this next song that I'm gonna play uh is by Radioheaded Creep.
- 6:47SPEAKER_11: Apparently, uh the guys at Radiohead uh kind of got in a little bit of trouble because um both of the songs Creep and the Air That I Breathe share a very similar chord progression and melody in the verse.
- 6:59SPEAKER_11: The most notable similarity is in the descending chord progression and the vocal line during the verses, especially the part where Tom York, the lead singer of Radiohead, sings creep.
- 7:10SPEAKER_11: So I'm gonna play today.
- 7:12SPEAKER_11: I'm gonna play for you the song that is the quote unquote original, and then I'm gonna follow it up with the song that is being accused of being too similar.
- 7:19SPEAKER_15: Sweet.
- 7:19SPEAKER_15: Alright.
- 7:21SPEAKER_15: That sounds like a great plan.
- 7:22SPEAKER_11: Thank you.
- 7:22SPEAKER_11: And I think I have some fun songs.
- 7:24SPEAKER_11: There's definitely some some uh uh eclectic mixes in there.
- 7:28SPEAKER_15: Okay, well eclect me.
- 7:31SPEAKER_11: Well, I hardly know her, or something like that, right?
- 7:36SPEAKER_15: Okay, here's uh coming up too.
- 7:38SPEAKER_15: Keep it here.
- 7:38SPEAKER_11: Yeah, here's Radiohead's creep.
- 7:41SPEAKER_11: Listen to those similarities.
- 7:44SPEAKER_15: I can already tell.
- 8:04SPEAKER_03: Just like an angel skin makes me cry.
- 8:14SPEAKER_03: Float like a fata Eurif.
- 10:43SPEAKER_05: It's so very special.
- 10:48SPEAKER_05: I wish I was special.
- 10:53SPEAKER_04: But I'm a couple I'm a winner.
- 11:03SPEAKER_04: What the hell am I doing?
- 11:08SPEAKER_04: I don't belong.
- 11:13SPEAKER_04: I don't belong.
- 11:18SPEAKER_11: What do you think about that, Dave?
- 11:19SPEAKER_11: Do you think that was-ball?
- 11:21unknown: Yeah.
- 11:22SPEAKER_11: I was wondering what you were saying.
- 11:23SPEAKER_11: You're like, we're not on the air, and I'm like, oh, but we are.
- 11:28SPEAKER_11: Oh, that's right, that's right.
- 11:29SPEAKER_11: There.
- 11:30SPEAKER_11: Okay, now we're officially on air.
- 11:31SPEAKER_11: Yeah, we didn't.
- 11:34SPEAKER_11: The whole first part of the show wasn't real.
- 11:35SPEAKER_15: Yeah, it wasn't on the air.
- 11:37SPEAKER_11: But what do you think about that song, Dave?
- 11:38SPEAKER_11: Do you think it kind of sounded like The Air That I Breathe?
- 11:40SPEAKER_15: Well, in places, yes, but I no, I don't think so.
- 11:44SPEAKER_11: Okay.
- 11:44SPEAKER_11: Well, Albert Hammond and Mike Hazelwood, the original writers of The Air That I Breathe, filed a lawsuit against Radiohead for copyright infringement.
- 11:52SPEAKER_11: Um, and rather than go through the prolonged legal battle, they just settled out of court.
- 11:56SPEAKER_11: Hammond and Hazelwood were officially given co-writing credits for Creek.
- 12:00SPEAKER_11: And apparently it was a pretty like friendly interaction.
- 12:03SPEAKER_11: Like Tom York noticed, yeah, I think I was kind of inspired by your song without even realizing it, maybe.
- 12:09SPEAKER_11: And as soon as they got credit, the Hollies were happy.
- 12:14SPEAKER_11: There's some more tumultuous cases in here, but uh that one is a friendly.
- 12:17SPEAKER_15: We'll get to those later.
- 12:18SPEAKER_11: We'll get to those later.
- 12:19SPEAKER_11: Uh but first, uh here is well after Tony Time, we're gonna have One Back Down by Tom Petty, and then the song that has been accused of copying him, but in the meantime, here is Tony Time.
- 12:32SPEAKER_17: Ladies and gentlemen, it's time for Tony Time!
- 12:35SPEAKER_12: Tony Time You know, you know what?
- 12:39SPEAKER_12: It's a great new year, right?
- 12:40SPEAKER_12: Are you guys having a good new year?
- 12:44SPEAKER_12: You know, Italians.
- 12:45SPEAKER_12: We got a tradition, you know, you eat cottage and lentil soup on Christmas Eve.
- 12:49SPEAKER_12: And you I mean you may have a hearty meal.
- 12:51SPEAKER_12: You eat way too much.
- 12:53SPEAKER_12: That's what I did.
- 12:54SPEAKER_12: Little lentils.
- 12:55SPEAKER_12: So then yeah, it's for wealth.
- 12:57SPEAKER_12: You know, it's kind of a good luck, good wealth for the year kind of thing.
- 13:01SPEAKER_12: And then you wear red.
- 13:02SPEAKER_12: Red is lucky, you know?
- 13:04SPEAKER_12: Yeah, you'll be lucky and wealthy and should be good.
- 13:06SPEAKER_12: It's a good start to a new year, you know.
- 13:08SPEAKER_15: Very good, yeah.
- 13:09SPEAKER_15: I like it.
- 13:10SPEAKER_12: Yeah, yeah.
- 13:11SPEAKER_12: I you know, it's hard for me though, you know, because I don't have red undies and I don't usually I don't usually dress Christmas Day.
- 13:19SPEAKER_12: You know, I just eat black-eyed pizza by undies, so I don't have any red undies, so you know, what are you gonna do?
- 13:29SPEAKER_06: Well I won't back down.
- 13:33SPEAKER_06: No I won't back down.
- 13:37SPEAKER_06: You can stand me up at the gates of hell, but uh won't back down.
- 13:45SPEAKER_11: No I stand my ground, won't be turned around And I'll keep this world from dragging me down, gonna stand my ground and I won't back down and I won't back down Well I know what's right I got just one lie in a world that keeps on pushing me around But I stand my ground And uh back down easy back down One of my total favorites, and this is a case where yeah Tom Petty and Jeff Lynn, the writers of I Won't Back Down, uh did not back down when Sam Smith released his song Stay With Me in 2014, which was written by Sam Smith, Jimmy Napes, and the songwriting duo disclosure.
- 16:24SPEAKER_11: Uh the main similarity is the vocal melody in the chorus in Stay With Me, the line won't you stay with me closely mirrors the melody of the line Well, I won't back down in Petty Song.
- 16:34SPEAKER_11: The chord progressions in the songs also have a similar structure, although not identical.
- 16:39SPEAKER_11: Uh when Stay With Me became ahead of fans began pointing out the similarities online, and Tom Petty and his team heard the comparisons and took action.
- 16:46SPEAKER_11: And rather than once again taking the case to the court, the issue was settled amicably behind the scenes.
- 16:51SPEAKER_11: Sam Smith and their team agreed to give Tom Petty and Jeff Lynn co-writing credits for Stay With Me.
- 16:57SPEAKER_11: I am about to play, but what are you gonna say?
- 16:59SPEAKER_15: Well, I I'll have more to say about this uh before the show ends.
- 17:17SPEAKER_11: You know, they're taking it from fans or yeah, they themselves didn't notice it but uh they're taking the word from fans.
- 17:25SPEAKER_11: I think that a lot of these cases are yeah, just sort of inspirational.
- 17:31SPEAKER_11: Like George Harrison very famous he's not gonna be on this list later too.
- 17:34SPEAKER_11: He very famously said that he subconsciously copied somebody else when he made his song uh My Sweet Lord.
- 17:40SPEAKER_11: Um and I think there's an argument to be made for that.
- 17:44SPEAKER_11: I think as long as everyone's happy in the end and everybody feels rec recognized, I think it's okay.
- 17:49SPEAKER_11: Like how a lot of these are being sold out of word, and all they want is just recognition that, yeah, my song inspired you.
- 17:54SPEAKER_11: That's all I need to hear.
- 17:56SPEAKER_11: Um I am gonna play Stay With Me, and then after that, I am going to give you a rant about a movie that inspired me to do this entire show.
- 18:06SPEAKER_11: Stay tuned.
- 18:20SPEAKER_08: But I still need love because I'm just saying it's never seen too.
- 18:31SPEAKER_08: I don't want you to live for your hope.
- 18:35SPEAKER_08: Oh, I want you stay with me because you say it's for you to see but dark and stay away from me.
- 19:04SPEAKER_08: No, it's not a good look in some self-control.
- 19:09SPEAKER_08: Deep I know there's never worse.
- 19:14SPEAKER_08: But you play with me so it doesn't hurt.
- 19:19SPEAKER_08: Oh, won't you stay with me?
- 19:30SPEAKER_08: This ain't nothing to see, but then stay with me.
- 20:53SPEAKER_17: How about a good ranting?
- 20:56SPEAKER_17: As ranters go, Ren's one of the best, whether it be a movie, TV series, short film, book.
- 21:03SPEAKER_17: Who has time to read?
- 21:04SPEAKER_17: Hmm, probably not a book.
- 21:06SPEAKER_17: Here she is with the rant of the day.
- 21:08SPEAKER_11: Yo, yo, yo, it's been a little bit since I'd done a rant, I think.
- 21:12SPEAKER_15: A couple weeks, yeah.
- 21:13SPEAKER_11: Yeah, well, I had to catch up, I had to watch some other movies, um, and I watched a lot of movies over the holiday season.
- 21:18SPEAKER_11: Uh one of them I actually watched, I think it it came out back in November.
- 21:22SPEAKER_11: It's called Heretic.
- 21:23SPEAKER_11: And it stars I've heard of it.
- 21:25SPEAKER_11: You've heard of it, yeah.
- 21:26SPEAKER_11: It stars um Hugh Grant as a very creepy man, which is so funny because.
- 21:33SPEAKER_15: Oh, he's so sharp.
- 21:36SPEAKER_11: Well, he's he's really fun in this because he plays uh an almost gentlemanly creep who uh is obsessed with religion.
- 21:44SPEAKER_11: He's obsessed with religion and he basically traps these two sister Mormon missionary girls in his house and like puts them through all sorts of trials to test their faith.
- 21:52SPEAKER_15: Oh wow.
- 21:53SPEAKER_11: Um it's a pretty it's a pretty good horror movie.
- 21:56SPEAKER_11: Um I think the first half is better than the second half because in the first half it's much Philosophical.
- 22:01SPEAKER_11: He uh plays for them the example I played for you, the the air that I breathe, and creep.
- 22:05SPEAKER_11: And then also there's a third song that radio had pursued over that sounds too similar to creep.
- 22:12SPEAKER_11: His his whole uh way of thinking basically boils down to all religions are just copies of copies of copies of copies of religions from thousands of years ago.
- 22:22SPEAKER_11: So he wants to find the one true religion, much like how a lot of songs today are just copies of copies of copies of songs that we've been playing for hundreds of years.
- 22:30SPEAKER_11: Um uh tension, but it kind of just gets over the top by the end, and it was really hard for me to take it seriously.
- 22:42SPEAKER_11: It also gave me a panic attack, Dave.
- 22:44SPEAKER_11: Oh wow.
- 22:45SPEAKER_11: It's not gory at all until this one gory scene happens, and then it freaked me out so much and was so unexpected that I had to go to the parking lot and breathe for a couple minutes because it was that upsetting for me.
- 22:55SPEAKER_15: Let me ask you real quick before we because I know we gotta move on.
- 22:58SPEAKER_15: Yeah, is Hugh Grant's not Wolverread.
- 23:00SPEAKER_15: Wolverine.
- 23:00SPEAKER_15: Is that Wolverine?
- 23:01SPEAKER_15: No, no.
- 23:02SPEAKER_11: Hugh Grant was in Nottinghill.
- 23:04SPEAKER_15: Yeah, I yeah, I I yeah, I I don't know.
- 23:06SPEAKER_15: I've never just been a particular fan of it.
- 23:08SPEAKER_11: I like Hugh Grant.
- 23:08SPEAKER_11: I think he's so I think he's so dreamy.
- 23:11SPEAKER_15: Yes, I'm amazing.
- 23:11SPEAKER_11: Hugh Jackman, yes.
- 23:13SPEAKER_11: Ooh, now I I would I would see heretic if it was Hugh Jackman instead of Hugh Grant, but man, Hugh Grant is just so good at being like so sickly sweet.
- 23:20SPEAKER_11: You want to trust him until it's too late.
- 23:22SPEAKER_11: He's like, nope, I've trapped you.
- 23:24SPEAKER_11: Now you're in my uh secret little maze and I'm gonna mess with you.
- 23:27SPEAKER_11: Anyway, that's that's my Hugh Grant impression.
- 23:32SPEAKER_17: Every week, and in Rant.
- 23:34SPEAKER_17: She's relentless.
- 23:36SPEAKER_17: I mean, relentless.
- 23:43SPEAKER_11: There you go.
- 23:44SPEAKER_15: Uh the KSJE Sunday, Sunday, Sunday morning wake-up call with my felonious rent rant.
- 23:53SPEAKER_11: Oh, and my punitive buddy day.
- 23:56SPEAKER_11: I'm just trying to find legal words because this is the take it to court show where we're talking about songs that are just a little too similar to other songs.
- 24:05SPEAKER_11: Uh this next one is a is a pretty famous case.
- 24:08SPEAKER_11: Uh it's between George Harrison and the girl band The Chiffons.
- 24:13SPEAKER_11: The Chiffons, yeah.
- 24:14SPEAKER_11: The chiffons have their song He's So Fine.
- 24:17SPEAKER_11: Yeah.
- 24:18SPEAKER_11: If I remember correctly.
- 24:19SPEAKER_11: Yeah.
- 24:20SPEAKER_15: Do you know this one?
- 24:21SPEAKER_15: Uh no, but now that you say that in George's song um My Sweet Lord.
- 24:27SPEAKER_11: Oh, there we go.
- 24:28SPEAKER_11: I can hear it.
- 24:31SPEAKER_11: I will have more info when we come back, but uh until then, uh, here is the chiffons with their original take.
- 24:38SPEAKER_11: He's so fun.
- 24:40SPEAKER_15: I love this song.
- 24:41SPEAKER_11: It's a cute song.
- 24:47SPEAKER_02: He's so fun.
- 24:59SPEAKER_02: I don't know how I'm gonna do it, but I'm gonna make a mind.
- 25:11SPEAKER_02: He's a soft spoken guy's so we've got a try.
- 25:31unknown: And I wanna make a mind forever.
- 25:38unknown: He's all mine, all we give, gotta be a mind.
- 25:43unknown: Oh yeah, sooner or later, all we care, I hope it's not later.
- 25:49SPEAKER_02: Oh we get, we gotta get together, oh we get sooner than better, oh we give I just can't wait, I just can't wait to be held that his own I work with me to be alone I need that yet to make him alone.
- 26:28SPEAKER_11: Yeah, this one was this court case was not as amicable as the other ones.
- 26:32SPEAKER_11: I'm pretty sure they did take it to court because George Harrison swore up and down that he did not copy that song for My Sweet Lord.
- 26:41SPEAKER_15: Um When it plays next segment, uh I can hear it.
- 26:45SPEAKER_15: I can so hear it.
- 26:46SPEAKER_11: You can hear it already.
- 26:47SPEAKER_11: This was the one where George Harrison, I think, said that he subconsciously plagiarized.
- 26:52SPEAKER_11: Uh both songs share a very similar chord progression and melody, particularly in the chorus, He's So Fine, and My Sweet Lord.
- 26:59SPEAKER_11: The descending melodic structure and the phrasing of the vocals are remarkably close, leading many listeners to notice the resemblance.
- 27:06SPEAKER_11: Uh in 1971, Ray Tunes music said George Harris sued George Harrison for copyright infringement.
- 27:11SPEAKER_11: The trial took place in 1976, and the judge ruled that Harrison had indeed copied He's So Fine, though unintentionally.
- 27:18SPEAKER_11: The court described it as subconscious plagiarism, meaning Harrison didn't deliberately copy the song but had absorbed it into a subconscious and recreated something too similar.
- 27:28SPEAKER_15: And that kind of became a break.
- 27:30SPEAKER_11: Yeah, that kind of became a good thing.
- 27:31SPEAKER_15: But I could still see it the second you hit it, and I started the melodies in my mind.
- 27:34SPEAKER_15: I'm like, oh yeah.
- 27:35SPEAKER_11: That's it.
- 27:36SPEAKER_15: I can see it.
- 27:37SPEAKER_11: Well, in the meantime, uh we're gonna take a little break and then we'll be back with sounds good.
- 27:42SPEAKER_01: Too much of a good thing?
- 27:43SPEAKER_01: Hardly.
- 27:44SPEAKER_01: More of the wake-up call is coming up.
- 27:47SPEAKER_01: And now for something completely different.
- 27:50SPEAKER_00: Nonstop music.
- 27:53SPEAKER_00: The wake-up call on KSJE.
- 28:44SPEAKER_06: We want to see all the tech so long I really want to know you.
- 30:17SPEAKER_06: We wanna see L.
- 30:21SPEAKER_06: We wanna see Low Silo.
- 32:55SPEAKER_15: You know, I remember the days when the the Hall Krishnas were all over the airports and stuff.
- 33:01SPEAKER_11: Yeah, because that used to be a thing.
- 33:03SPEAKER_11: You could just like wait in the airport lobby and like talk to people if you were in a religious, you know, cult or whatever.
- 33:10SPEAKER_15: Well, welcome back into the uh KSJE Sunday morning wake-up call with my premeditated friends.
- 33:18SPEAKER_11: Ooh, and my liable buddy Dave.
- 33:21SPEAKER_15: Oh my god, am I ever gonna be a good one?
- 33:22SPEAKER_11: You're liable just as my ex is doing take it to court songs that sound just a little too similar to each other.
- 33:31SPEAKER_11: The last one, of course, was uh my sweet lord, which was accused of being a copy of he's defined by the chiffons.
- 33:39SPEAKER_11: Uh the chiffons ended up winning that case, and George Harrison still said that he did not mean a copy of anything except that he didn't court really.
- 33:51SPEAKER_15: I mean so many chords.
- 33:56SPEAKER_11: I understand I I really would like I would really be interested in like what kind of court proceedings you gotta go through to prove that a song is a copy of another song and not just like similar sounding.
- 34:11SPEAKER_15: Well, uh there are there are a lot of songs out there that you really start to think about.
- 34:15SPEAKER_15: I never really thought about that one, but I've always enjoyed that if you were cute.
- 34:27SPEAKER_15: Of course it is the name of the show is uh January 19th is the court, even though I think two out of the three cases I brought out were solved outside of court.
- 34:45SPEAKER_11: The court was involved in one way or another.
- 34:50SPEAKER_11: This next one is kind of a fun one, and I know it's not Halloween, but I have to play it so that we can dissect both of these songs and understand if they're similar.
- 34:59SPEAKER_11: This is uh I want a new drug in the news.
- 35:03SPEAKER_11: I love you versus Ghostbusters by Ray Parker Jr.
- 35:10SPEAKER_11: Apparently both songs have a similar tempo groove and baseline as well as comparable harassment stabs and a peppy update field.
- 35:17SPEAKER_11: The key controversy was the nearly identical bass line rhythm and chord progression, especially in the iconic intro.
- 35:25SPEAKER_11: So we are of course gonna start with I want a new drug and then we'll play Ghostbusters and then we'll just have to see.
- 35:31SPEAKER_11: Take it away, Huey.
- 35:32SPEAKER_15: You know what?
- 35:33SPEAKER_15: The whole thing for me is I call BS.
- 35:38SPEAKER_11: You call BS.
- 35:39SPEAKER_11: Well, there's a little bit more of a layer to this one because apparently they approached Huey Lewis first to write the song for Ghostbusters, but he was busy with Back to the Future.
- 35:47SPEAKER_11: So then they got Ray Parker Jr., so I don't know.
- 35:50SPEAKER_11: We'll just have to see.
- 35:51SPEAKER_15: Interesting, that is interesting.
- 35:53SPEAKER_15: You decide, ladies and gentlemen, throwing it out to you.
- 36:06SPEAKER_06: I want a new job.
- 36:08SPEAKER_06: One the wall made me sick.
- 36:11SPEAKER_06: One the wall made me crash my car, I make me feel free.
- 36:17SPEAKER_06: I want a new dry.
- 36:22SPEAKER_06: When the wall made my mouth too dry, I make my eyes too red.
- 36:28SPEAKER_06: When the wall made me nervous, what do you want to do?
- 36:32SPEAKER_06: What the woman makes me feel like I feel when I'm with you When I'm alone with you I wanna do a drummer Wanna won't spill When the dog comes to my I'm coming up I wanna die Wanna won't give me a phone Wanna won't let me speak for me What the woman baby nuts What do you want to do What the makes me feel like you're not with you baby I wanna know the dust one too?
- 38:12SPEAKER_06: One of all made me feel too bad One of all made me feel too good I wanna do that One of all make me talk too much I'll make my face break out What the wall makes me nervous What do we want to do?
- 38:33SPEAKER_06: One that makes me feel like I feel what I want to do I'm alone with you I'm alone with you, yeah, yeah.
- 39:10SPEAKER_15: We're playing vinyl records, man.
- 39:12SPEAKER_15: Ren's got the uh scratching in the rookie.
- 39:15SPEAKER_11: Sorry, I did it again, hold on.
- 39:16SPEAKER_00: Ninety point nine FM and one oh three point three FM K SJE Farmington, New Mexico, Mexico.

- 43:10SPEAKER_11: Who you gonna call Ghost That was of course Ray Parker Jr.
- 43:18SPEAKER_11: with Ghostbusters Who you gonna call, Dave?
- 43:22SPEAKER_15: Well of course I'm gonna call it Ghostbusters, but I guess somebody called him an attorney.
- 43:26SPEAKER_11: Yes, Huey Lewis called his attorney.
- 43:29SPEAKER_11: Uh it was this was another one that was settled out of court, but there was an agreement.
- 43:34SPEAKER_11: It turned to be ugly like decades later.
- 43:37SPEAKER_11: There was an agreement that both parties were supposed to keep the details of the of the case confidential.
- 43:41SPEAKER_11: But in 2001, Huey Lewis mentioned the settlement on an episode of Behind the Music and claimed Ray Parker Jr.
- 43:47SPEAKER_11: had copied their song.
- 43:49SPEAKER_11: Ray Parker Jr.
- 43:50SPEAKER_11: responded by suing Huey Lewis for violating their confidentiality agreement.
- 43:55SPEAKER_11: Even years later, it was it was still messy.
- 43:57SPEAKER_15: I don't know if I can copy things that make you go with that with that.
- 44:03SPEAKER_15: That was that made me go, that made me scratch my head and everything.
- 44:06SPEAKER_15: And like, yeah.
- 44:16SPEAKER_16: I don't know why I like to say that, but uh, these are some things that uh make you go, hmm, besides me going all righty tidy, that's right.
- 44:25SPEAKER_16: David's got it.
- 44:26SPEAKER_16: Here it is.
- 44:28SPEAKER_15: All right, Randy, you know that there is no such a thing as a straight line.
- 44:33SPEAKER_11: No.
- 44:34SPEAKER_11: Doesn't it sound fake or go on?
- 44:35SPEAKER_15: Zoom in close enough to anything and you you will you will see The irregularities for sure.
- 44:42SPEAKER_15: Even a laser light beam is slightly darker.
- 44:47SPEAKER_11: Interesting.
- 44:49SPEAKER_11: So what you're saying is that it's impossible for anything to be completely straight.
- 44:54SPEAKER_15: Now there's a joke in there.
- 44:56SPEAKER_11: I know, you're just waiting.
- 44:57SPEAKER_15: And yeah, I have to tell you, I used to have some really good friends that I house set for them, and they were they were uh lesbian.
- 45:04SPEAKER_15: Okay.
- 45:04SPEAKER_15: And we were driving down the road somewhere, I don't remember where it was, and um I was giving them direction.
- 45:11SPEAKER_15: I said, just go straight, and they go, oh no.
- 45:14SPEAKER_15: Never go straight.
- 45:15SPEAKER_15: Go forward.
- 45:16SPEAKER_11: Yeah.
- 45:17SPEAKER_11: Oh my god, my dad used to say that exact thing to me, but it wasn't a like, it wasn't a gay joke.
- 45:22SPEAKER_11: It was literally just him not liking the word straight.
- 45:26SPEAKER_15: Yeah.
- 45:27SPEAKER_11: Boy.
- 45:28SPEAKER_11: That's super interesting though.
- 45:30SPEAKER_11: It's the same way, like, if you even if you take a scalpel um and you look at it underneath a microscope, it's still super jagged.
- 45:37SPEAKER_15: Yes.
- 45:38SPEAKER_15: All knives are.
- 45:39SPEAKER_15: I mean, even a razor is, but you know, you gotta have a super strong microscope to see it.
- 45:44SPEAKER_11: Yeah, for the m as far as I'm concerned, it's good enough.
- 45:49SPEAKER_11: Which is what a lot of artists said when they were writing these songs and copying other people.
- 45:54SPEAKER_11: Good enough.
- 45:54SPEAKER_15: It's the KSJE Sunday morning wake-up call with my procedural I'm saving another one for last.
- 46:01SPEAKER_11: Okay, cool.
- 46:01SPEAKER_15: My procedural friend.
- 46:03SPEAKER_11: And my inadmissible buddy Dave.
- 46:06SPEAKER_11: Can't bring him to court because it'll just mess up the case.
- 46:09SPEAKER_15: We are taking it to court.
- 46:10SPEAKER_15: All these songs have been uh taken to court for some reason or another.
- 46:13SPEAKER_11: One reason or another.
- 46:14SPEAKER_11: Most of them songs out of court, but still lawyers were involved.
- 46:18SPEAKER_11: Uh the next one is uh uh sort of like emoclassic.
- 46:23SPEAKER_11: I played it on our show a couple months ago, and I'm gonna play it again now because it's so good, but also because it's applicable to the theme.
- 46:29SPEAKER_11: Uh this is Misery Business by Paramour versus Olivia Rodrigo's Good For You.
- 46:35SPEAKER_15: Interesting.
- 46:36SPEAKER_11: Yeah, uh the controversy centers around the chorus of Good For You, which had a similar vocal melody, chord progression, and instrumentation instrumentation to misery business.
- 46:46SPEAKER_11: Both songs have driving guitar ribs, punchy drums, and angsty high-energy vocals.
- 46:50SPEAKER_11: The lyrics also convey feelings of betrayal and anger.
- 46:53SPEAKER_11: Fans were quick to point out the similarities on social media.
- 46:56SPEAKER_11: Once again, the fans getting involved, creating side-by-side comparisons and mashups.
- 47:01SPEAKER_11: And if I'm not mistaken, uh Olivia Rodrigo retroactively gave songwriting credit to two Haley Williams, the lead singer of Paramour, and Josh Farrow.
- 47:12SPEAKER_11: Uh they are now officially listed as co-writers of Good For You.
- 47:15SPEAKER_11: So this was there was no formal lawsuit.
- 47:17SPEAKER_11: This this was just Olivia Rodrigo going, oh my god, you're right.
- 47:21SPEAKER_11: This does sound really similar.
- 47:22SPEAKER_11: Okay, here you guys get credit.
- 47:23SPEAKER_11: So it's pretty good.
- 47:26SPEAKER_11: Yeah, Olivia's really chill.
- 47:27SPEAKER_11: I think your granddaughter really likes her music.
- 47:29SPEAKER_11: And I remember like anytime anybody likes Olivia Rodrigo on there.
- 47:32SPEAKER_11: But first, we're gonna play Paramoy's version.
- 47:34SPEAKER_11: Here is misery business.
- 48:00SPEAKER_09: I'm in the business, the misery.
- 48:02SPEAKER_09: Let's take it from the top.
- 48:03SPEAKER_09: Got a body like an hour, but it's sticking like a clock.
- 48:06SPEAKER_09: It's a matter of time before we all run out.
- 48:08SPEAKER_09: When I thought he was mine, she caught him by the top.
- 48:11SPEAKER_09: I would get one, but I said it was free.
- 48:14SPEAKER_09: I told him I couldn't lie.
- 48:15SPEAKER_09: He was the only one for me.
- 48:17SPEAKER_09: Do we do it for five?
- 48:20SPEAKER_09: I wouldn't biggest smile.
- 48:55SPEAKER_09: Sorry, that'll never change.
- 48:57SPEAKER_09: We're both supposed to have a change.
- 48:59SPEAKER_09: Sorry, money, but I'm passing out this way.
- 49:40SPEAKER_09: It just feels so good.
- 49:49SPEAKER_09: Not one of them involving you.
- 49:52SPEAKER_09: Just watch my wildest trees come true.
- 49:55SPEAKER_09: Not one of them involves them.
- 50:57unknown: You're hearing things.
- 50:58SPEAKER_06: You're hearing things.
- 51:09SPEAKER_18: I guess you moved on really easily.
- 51:11SPEAKER_18: You found a new girl and it only took a couple weeks.
- 51:14SPEAKER_18: Remember when you said that you wanted to give me the world.
- 51:19SPEAKER_18: And go for you, I guess that you've been working on yourself.
- 51:22SPEAKER_18: I guess the therapist I found for you she really helped.
- 51:25SPEAKER_18: Now you can be a better man for your brand new girl.
- 51:31SPEAKER_06: Good for you, you're looking at me help me not be a feeling.
- 51:36SPEAKER_06: Good for you, you're doing great up there with that.
- 51:41unknown: I just made up stuff that I cry.
- 51:50unknown: I guess good for you.
- 51:58SPEAKER_18: Looking for you, I guess you're getting everything you want.
- 52:01SPEAKER_18: You got in the car and your career's really taking off.
- 52:03SPEAKER_18: It's like we never even happen, baby.
- 52:05SPEAKER_18: Tell me what is up with that.
- 52:09SPEAKER_18: And Korea, it's like you never even let me.
- 52:11SPEAKER_18: Remember when you swear to God I was the only person who ever got you.
- 52:15SPEAKER_18: Well, screw that thing, screw you.
- 52:17SPEAKER_18: You will never have to head the way you know that I do.
- 53:04SPEAKER_18: Maybe I'm too emotional.
- 53:07SPEAKER_18: Maybe you never get it all.
- 53:09SPEAKER_18: Maybe I'm too emotional.
- 53:12SPEAKER_18: Your apathy is like wounding soul.
- 53:15SPEAKER_18: Maybe I'm too emotional.
- 53:18SPEAKER_18: Maybe you never get it all.
- 53:30SPEAKER_06: Like a damn sodium path.
- 53:33SPEAKER_06: I've spent the night crying.
- 53:37SPEAKER_06: Just so objected, I really don't guess.
- 53:41SPEAKER_06: I just got for you.
- 53:48SPEAKER_18: For you, I guess you moved on really easily.
- 53:52SPEAKER_11: Do you think that one that one sounds definitely inspired by Paramour?
- 53:56SPEAKER_11: I don't know if I would say they're like s so similar that there would need to be plagiarism involved.
- 54:02SPEAKER_15: Um, it neither one of the songs I'm familiar with, so it's kind of hard for me to be object to be objective.
- 54:09SPEAKER_15: Yeah.
- 54:09SPEAKER_15: Is that the right word?
- 54:11SPEAKER_11: Yeah, objective or even subjective, especially if you don't know the music.
- 54:14SPEAKER_11: Because uh, I mean like I love Misery Business.
- 54:16SPEAKER_11: I I grew up with that song when I was a kid and um teenager, and when I hear good for you, I definitely feel like it's inspired by Paramore, but I don't think she was trying to copy them.
- 54:27SPEAKER_11: But it's still cool that she gave them writing credits because she she admitted that to herself she was inspired by them.
- 54:33SPEAKER_15: Yeah.
- 54:33SPEAKER_15: Yeah, I I I picked my hat's off for sure.
- 54:37SPEAKER_11: Well, I have a little bit of wisdom for us before we get out of here for the day.
- 54:41SPEAKER_15: Is it time for the ever wonderful, ever powerful Zen of Ren?
- 54:46SPEAKER_17: Oh, yeah.
- 54:49SPEAKER_17: Prepare your mind.
- 54:50SPEAKER_17: For now, it is time for the Zen of Ren.
- 54:56SPEAKER_11: No, this one's kind of a different take on plagiarism.
- 55:00SPEAKER_11: This one comes from Guy Debour.
- 55:02SPEAKER_11: Debour Debour, I imagine it's French, or Guy Debour.
- 55:07SPEAKER_11: Ideas improve.
- 55:08SPEAKER_11: The meaning of words participates in the improvement.
- 55:11SPEAKER_11: Plagiarism is necessary.
- 55:13SPEAKER_11: Progress implies it.
- 55:15SPEAKER_11: It embraces an author's phrase, makes use of his expressions, erases a false idea, and replaces it with the right idea.
- 55:23SPEAKER_12: Oh.
- 55:25SPEAKER_11: Because uh, you know, it's obviously really crummy to just steal somebody's idea and make money off of it for yourself.
- 55:31SPEAKER_11: But to a degree, if we want to improve, we've got to take ideas that already exist and continue to improve them.
- 55:38SPEAKER_15: Yeah, I agree.
- 55:39SPEAKER_15: That was nice.
- 55:39SPEAKER_15: I like that.
- 55:41SPEAKER_15: Listen, it's been a great uh day, uh, great show, I think.
- 55:44SPEAKER_15: I I I've really enjoyed the music and I'm enjoyed the information.
- 55:48SPEAKER_11: Thank you.
- 55:48SPEAKER_15: Uh I don't know that I agree with all of it.
- 55:51SPEAKER_15: I think, you know, why can't we all just get along?
- 55:53SPEAKER_15: And everybody has inspired everybody at some point or another.
- 55:57SPEAKER_11: Yes, I completely agree with you there.
- 55:58SPEAKER_11: Um there's only so many chords like you can sing.
- 56:01SPEAKER_15: You know, it could get to me, it's to me as being as petty as suing you because uh I gave you all this information.
- 56:09SPEAKER_11: And and then I used it.
- 56:10SPEAKER_11: Right.
- 56:11SPEAKER_11: I don't And once again, even though the the name of the episode's very dramatic, take it to court, most of these were solved amicably out of court.
- 56:19SPEAKER_11: But there were those two.
- 56:20SPEAKER_15: Yeah, until somebody got a smart mouse and had to and had to talk talk it up.
- 56:25SPEAKER_15: Well now listen, coming up, uh what do we I did I don't even think we got a theme for next week's show yet, dude?
- 56:30SPEAKER_11: We're we're just flying free and fresh in the new year.
- 56:34SPEAKER_11: I mean, I got a couple, we've got artists with just one name.
- 56:36SPEAKER_11: We have another spotlight episode that we're working on for a Miss Chapel Roan because I have recently just gotten super into her music.
- 56:44SPEAKER_15: And I and I have what little I've heard of hers, I like it as well.
- 56:48SPEAKER_11: Oh good, I'm glad.
- 56:49SPEAKER_11: I also have uh we also have some fun shows for uh February for for Valentine's Day.
- 56:56SPEAKER_11: I know we got one that I'm working on called You Can't Say That on Radio with songs that just skirt the edge of the unacceptable and then another one making whoopee.
- 57:07SPEAKER_15: So yeah, that's that's gonna be my favorite, I think.
- 57:11SPEAKER_11: We've got something on our minds this time of year.
- 57:13SPEAKER_15: You know, I'm gonna do some, I don't know, Rocky Blues kind of stuff.
- 57:17SPEAKER_15: I'm putting together a playlist for that too.
- 57:19SPEAKER_11: Love it.
- 57:19SPEAKER_15: We're gonna have some fun uh this year for sure as we as we go forward.
- 57:23SPEAKER_15: And uh we're gonna have a major contest.
- 57:25SPEAKER_15: We'll have more details about that coming up.
- 57:28SPEAKER_11: I'm so excited for the contest.
- 57:29SPEAKER_15: You gotta know, you gotta know music though, because it's, you know, in some cases you may only get a half a note.
- 57:34SPEAKER_11: You know, you may only get a and then you just have to you just have to go with your instincts.
- 57:38SPEAKER_15: That's right.
- 57:39SPEAKER_11: Ooh, I uh man, I wish I could participate, but I guess I'm one of the hosts, so I can't.
- 57:43SPEAKER_15: Yeah, well, you can, but you know, you can't win anything.
- 57:45SPEAKER_11: Dang! All right, well, as long as everybody knows I'm smart and the best.
- 57:49SPEAKER_15: There you go.
- 57:49SPEAKER_15: Well, listen, it's been a great show, Ren.
- 57:51SPEAKER_15: Thank you so much.
- 57:52SPEAKER_15: I guess I'll see you next week.
- 57:53SPEAKER_11: I'll see you next week.
- 57:53SPEAKER_11: I I'll be here.
- 57:54SPEAKER_15: Okay.
- 57:55SPEAKER_11: Keep your eyes open.
- 57:56SPEAKER_15: I'll try.
- 57:58SPEAKER_11: I listen to a wake-up call every week.
- 58:00SPEAKER_11: They make me want a hot dog real big.
- 58:02SPEAKER_13: Oh, rapture.
- 58:03SPEAKER_13: Another week is bent in the dust, but fear not, Ren and David will be back again next Sunday.
- 58:08SPEAKER_13: Same old WC time, same old WC channel, because clearly you're all just dying for more of them.
- 58:15SPEAKER_13: Oh, and by the way, WUC is sole property of Interwest Concepts.com, so don't even think about reusing it without permission.
- 58:25SPEAKER_13: Or who knows, maybe you can, because honestly, who's really paying attention?
- 58:30SPEAKER_13: This is Zeb McCluskey for WUC.
- 58:34SPEAKER_13: And till next time.
- 58:36SPEAKER_13: Be excellent to each other.
