- 0:01Speaker 1: So you'll look.
- 0:02Speaker 2: I watched most of the funeral, and I thought Trump
- 0:04Speaker 2: was great, Hannity was great. There was like Lindsay himself,
- 0:08Speaker 2: filled with moments of great gravity and moments of great humor.
- 0:11Speaker 1: It was. It was a pretty wonderful day, it really was.
- 0:13Speaker 1: And as wonderful as that was, and as sorrowful as
- 0:18Speaker 1: the ceremony was, and today he's going to get buried
- 0:21Speaker 1: in South Carolina, I would start by saying, no matter
- 0:24Speaker 1: how bad you think your day is starting, you're not
- 0:28Speaker 1: doctor Anthony Fauci. You are not Tony Fauci today, because
- 0:31Speaker 1: he is about to get eviscerated. On Capitol Hill. Senator
- 0:36Speaker 1: Ran Paul is delivering his opening remarks. Right now, we're
- 0:39Speaker 1: going to carry all seconds. I've locked something down digitally.
- 0:42Speaker 1: This will take just thirty seconds. Yeah, let's do it.
- 0:45Speaker 3: Go. The COVID lockdown, however, could never have been inflicted
- 0:48Speaker 3: without you aiding and abetting the crime. Children lost years
- 0:52Speaker 3: of education, small businesses built over a lifetime disappeared. Patients
- 0:59Speaker 3: delayed in cancer screenings and other medical care. Families were
- 1:02Speaker 3: separated from dying relatives. Workers were ordered to accept a
- 1:06Speaker 3: medical procedure or lose their jobs, worship, assembly, employment, education,
- 1:11Speaker 3: and travel were restricted in the name of science. Well,
- 1:14Speaker 3: you did not impose every restriction. You used your public
- 1:17Speaker 3: authority to justify them.
- 1:20Speaker 2: Rand Paul five minutes ago, as doctor Fauci's very bad,
- 1:25Speaker 2: very awful, very tough day.
- 1:27Speaker 1: And he's just getting started. I mean, that's just the beginning.
- 1:30Speaker 1: This is gonna that's that's child's play, that he's warming up.
- 1:33Speaker 1: He's just warm. But here's what's the thing of But Mark,
- 1:36Speaker 1: here's what's fascinating. He got this. Fauci got this sleazy
- 1:41Speaker 1: preemptive pardon. And by the way, why do you get
- 1:44Speaker 1: somebody a pardon unless you think they did something wrong.
- 1:47Speaker 1: Biden gave him a pardon. But if he lies under
- 1:50Speaker 1: oath today, and they got documents, they got the diaries,
- 1:54Speaker 1: which you stubbornly refused to call a diary, They've gotten
- 1:58Speaker 1: all this stuff that Fauci is on. They know that
- 2:02Speaker 1: he knew about these certain things like the origins, the
- 2:09Speaker 1: mortality rate, the lockdown that he said he didn't advocate,
- 2:13Speaker 1: but he did. If he lies under oath today, they
- 2:17Speaker 1: could charge him. Now, you're right, you have the perfectly normal,
- 2:21Speaker 1: reasonable perspective. They're probably not going to put this guy
- 2:24Speaker 1: in handcuffs and lock him up. He's eighty five years old,
- 2:27Speaker 1: he's in the twilight of his life. But I'll tell
- 2:29Speaker 1: you there's going to be a reckoning and an accountability
- 2:32Speaker 1: at least on Capitol Hill, which I'm here for. And
- 2:34Speaker 1: we get the popcorn.
- 2:35Speaker 2: Now, get the popcorn ready, which leads to something that
- 2:38Speaker 2: might happen, and I don't know that it will. Because perjury,
- 2:42Speaker 2: fresh perjury is on the table. Doctor Fauci could do
- 2:46Speaker 2: something that a lot of people think he can't do,
- 2:48Speaker 2: and that's plead the fifth. Well, you can't plead the
- 2:50Speaker 2: fifth if you got a pardon. Of course you can
- 2:53Speaker 2: in his particular segment, because the pardon doesn't affect future perjury,
- 2:58Speaker 2: and if he perjures himself, that could be tricky. And also,
- 3:01Speaker 2: what is a pardon a presidential pardon federal crimes? Do
- 3:05Speaker 2: you think there are a few states ready to come
- 3:07Speaker 2: after doctor Fauci and he's still be vulnerable to to
- 3:10Speaker 2: state crimes. He could totally plead the fifth today. I
- 3:13Speaker 2: have no idea whether he will. Like you say, it's
- 3:16Speaker 2: kind of funny, there are two things that make you
- 3:17Speaker 2: look guilty. Pleading the fifth and getting a pardon when
- 3:21Speaker 2: you said, why does anybody get a pardon if they're
- 3:24Speaker 2: not guilty? Haven't there been a few Trump pardons that
- 3:26Speaker 2: have been designed to protection, right, weaponize political prosecutions.
- 3:31Speaker 1: So you're right, and I'm sure their side will say
- 3:34Speaker 1: that we're just weaponizing the system against their Saint Fauci.
- 3:37Speaker 1: But I mean all the all the the app accolades
- 3:40Speaker 1: and the tributes. I mean they the clip we played
- 3:44Speaker 1: yesterday on the podcast podcast My Gosh, by every one
- 3:48Speaker 1: of these so called objective journalists. Oh you're so strong,
- 3:52Speaker 1: you're so brave, you're so handsome. We need you, We
- 3:56Speaker 1: need you, doctor Fauci. These weren't talk show hosts. These
- 3:59Speaker 1: were objective so called journalists kissing his feet. And it's
- 4:04Speaker 1: the whole thing is a nightmare. So we're going to
- 4:06Speaker 1: have a lot of it on the show today, so
- 4:08Speaker 1: show tune in. Hey, two words, we got to go on.
- 4:11Speaker 1: Go I'll put the words out there and you go,
- 4:14Speaker 1: Tony Romo, go, I know, wow.
- 4:18Speaker 2: I didn't want to go yesterday or the day before.
- 4:20Speaker 2: It happened over the weekend. If there's anything I don't
- 4:23Speaker 2: want to say, I steadfastly avoid it. But it never
- 4:26Speaker 2: breaks my top topical list. It's it's noteworthy private figures
- 4:33Speaker 2: in the in the culture when they get in some
- 4:36Speaker 2: type of trouble. I try to just give people some
- 4:39Speaker 2: space and let things breathe fair enough. He chose not
- 4:43Speaker 2: to breathe into the breathalyzer, which is another thing that
- 4:45Speaker 2: makes you look guilty even though all the attorneys tell
- 4:47Speaker 2: you to do it. So now it's a big thing
- 4:49Speaker 2: because TMZ has video and it busts out with a
- 4:52Speaker 2: lot of talk show topics like can you call your
- 4:55Speaker 2: lawyer at the moment the cop says step out of
- 4:58Speaker 2: the car. The short answer is no, Oh, you're not
- 5:00Speaker 2: in custody technically yet. It's the field investigation that would
- 5:04Speaker 2: just impede that, so that she didn't.
- 5:06Speaker 1: Wait, Man, can we start there for a moment, I'm
- 5:10Speaker 1: gonna ask you a question. You get we do the
- 5:12Speaker 1: podcast today, You get in the you get in the
- 5:14Speaker 1: family roadster, you get in the station wagon, and you
- 5:17Speaker 1: head home to your bride and you get pulled over
- 5:19Speaker 1: by a police officer, red light siren. They pull you over.
- 5:23Speaker 1: You don't know why, you have no idea. They come
- 5:25Speaker 1: up to the car, have an exchange, and the officer says,
- 5:28Speaker 1: mister Davis, I need you to step out of the car.
- 5:30Speaker 1: I step out of the car. You step out of
- 5:32Speaker 1: the car. There, Mark, there's not an alternative to that.
- 5:36Speaker 1: That's a lawful command. That's a lawful order from a
- 5:40Speaker 1: legal law enforcement Now people hate this, and I get it.
- 5:43Speaker 1: I'm gonna get a lot of grief for saying this
- 5:45Speaker 1: for you and I. You and I are both gonna
- 5:46Speaker 1: get a lot of grief. But you know what, Tony
- 5:47Speaker 1: Romo said. No, He literally said no. He says no.
- 5:56Speaker 1: I mean a Cowboys fan got on on Twitter this morning.
- 5:59Speaker 1: So Mark, you didn't say no. Oh yeah, go look
- 6:02Speaker 1: at the tape. He says, no, I'm gonna call my lawyer.
- 6:06Speaker 1: Now they're arguing about whether he's gonna get Mark. You
- 6:09Speaker 1: don't argue with the police officer. I don't care who you.
- 6:12Speaker 2: Are right and just and people can go look at
- 6:15Speaker 2: the tape on their own. It's not like he looks
- 6:16Speaker 2: at the copy goad.
- 6:17Speaker 1: No. It might have been a very He was polite.
- 6:20Speaker 1: He was He was like, no, no, I'm gonna call
- 6:23Speaker 1: my lawyer. It's Tony Romo. He's a class act. This
- 6:26Speaker 1: is the guy that took the homeless guy to the
- 6:29Speaker 1: movies years ago. And I mean he's a good guy.
- 6:32Speaker 1: And look, I am not judging him. We neither have
- 6:36Speaker 1: people whether he is well. Look at the hour long tape.
- 6:40Speaker 1: He didn't. Look at the hour long tape. He didn't
- 6:43Speaker 1: look in very good shape. Mark, I mean he was.
- 6:46Speaker 2: And then I'm not making excuses, but he was.
- 6:49Speaker 1: He looked a little tired, looked a little bit. I
- 6:52Speaker 1: don't know.
- 6:52Speaker 2: And I will tell you there are people who are
- 6:54Speaker 2: rushing in to make excuses. Some people saying, oh, he's
- 6:57Speaker 2: not drunk, he's polite, and he's sponsorive.
- 7:00Speaker 1: He's not. There are all kinds of people who are
- 7:03Speaker 1: very high functioning drunks. They hypothetical hypothetical number two, mister Davis,
- 7:08Speaker 1: we suspect you're intoxicated. You're going to blow into the breathalyzer.
- 7:11Speaker 1: What are you going to say? Golly, that's a tough one,
- 7:13Speaker 1: because it's tough. Yes, here's why. Why is it tough?
- 7:17Speaker 1: You blow into the breathalyzer?
- 7:19Speaker 2: And I ask you, can I ask a dumb question?
- 7:21Speaker 2: Sure in your hypothetical Uh huh, am I drunk?
- 7:25Speaker 1: They'll know if you blow into the breathalyzer. So am
- 7:28Speaker 1: I or no. If you say no, you are well
- 7:30Speaker 1: if you don't.
- 7:31Speaker 2: Say it in your hypothetical that you provided to me,
- 7:35Speaker 2: am I drunk?
- 7:36Speaker 1: Well we're going to find out when you blow into
- 7:39Speaker 1: the breathalyzer. That's the hypothetical. Well, but is it when
- 7:44Speaker 1: I am? Is it the same as Jeff question? All
- 7:47Speaker 1: right ahead? Your question?
- 7:51Speaker 2: If indeed I've like you know, first of all, this
- 7:54Speaker 2: is could I have been popped multiple times in an
- 7:58Speaker 2: earlier life? One thousand percent?
- 8:01Speaker 1: Not proud?
- 8:02Speaker 2: These days far less likely, I'd say almost zero. So,
- 8:06Speaker 2: but if if I think benji'z rife and I did
- 8:09Speaker 2: knock down on a bottle of the line between us,
- 8:12Speaker 2: then maybe I would decline it. If I'm sober, as
- 8:15Speaker 2: a judge no alcohol, I suppose I would confidently do
- 8:19Speaker 2: the breathalyzer. But I've you ever talked to a DW
- 8:22Speaker 2: my attorney. Maybe you should today You'll probably get some
- 8:24Speaker 2: calling you. We're the official talk shows of DWI attorneys
- 8:27Speaker 2: or attorneys in general. They tell you, never do the breathalyzer,
- 8:31Speaker 2: Never do field sobriety. All it can do is destroy you,
- 8:34Speaker 2: even if you're innocent, and I'm not.
- 8:36Speaker 1: You know why they say that because the DWI attorney
- 8:39Speaker 1: is going to do. Their job is to get drunk
- 8:42Speaker 1: properties off the hook. Correct. How do we and how
- 8:44Speaker 1: do we feel about that? I don't feel great about it.
- 8:47Speaker 1: But that's their job. Part of our system. Attorneys defending
- 8:50Speaker 1: people as a vital part of our system. Everybody's in
- 8:52Speaker 1: to everybody's entitled, everybody's entitled to a legal defense. I
- 8:56Speaker 1: get that, but that's but that's their job. Mark if
- 8:59Speaker 1: you're sober, you're gonna blow into the breath of lized.
- 9:01Speaker 1: I would certainly think so. So that's that's bad. I
- 9:05Speaker 1: mean all but again it's I don't know. CBS says
- 9:08Speaker 1: they're going to stand behind him. He may take a
- 9:10Speaker 1: low key role, because for a while there I thought,
- 9:12Speaker 1: oh gosh, is he gonna lose. I mean, he makes
- 9:15Speaker 1: about a billion dollars a year to be a CBS analyst.
- 9:17Speaker 1: I mean, he's got this. They've got kids. Now. He
- 9:21Speaker 1: married the an anchor there, a TV anchor in Dallas.
- 9:24Speaker 2: Untel thirty three, I forget her name exactly, And she's
- 9:27Speaker 2: got and yes, we'll look at you, and and here's
- 9:30Speaker 2: the NFL season just weeks away from his first Giants.
- 9:35Speaker 2: I was like, uh, but I hate ready for this.
- 9:38Speaker 2: I hate it.
- 9:39Speaker 1: So you watch the video. Obviously we all have.
- 9:41Speaker 2: I'm I am mortified for him that millions of people
- 9:45Speaker 2: are seeing this, and yet there's something that stops my mortification,
- 9:49Speaker 2: that interferes with how much I feel for him, and
- 9:52Speaker 2: that is this, what if he's drunk? What if he
- 9:55Speaker 2: really is too drunk to be operating in that car
- 9:57Speaker 2: and could have killed somebody? You know, are we so
- 9:59Speaker 2: so sorry for him?
- 10:00Speaker 1: Then we are not?
- 10:01Speaker 2: Now? Since I don't know, I distanced myself from either conclusion.
- 10:06Speaker 2: Let the wheels turn, so to speak, and see how
- 10:09Speaker 2: that goes. Wisconsin just doesn't care about your first time.
- 10:12Speaker 2: It's like a civil offense, you know, see you don't
- 10:15Speaker 2: do it again?
- 10:15Speaker 1: Whoa really? But the state of Wisconsin also makes it
- 10:18Speaker 1: essentially a crime to refuse to do the breathalyzer, which
- 10:21Speaker 1: I hold you well, they can hop you and take
- 10:26Speaker 1: you to jail. They take you to jail right away,
- 10:28Speaker 1: and then they say, then you're guilty of refusing to
- 10:31Speaker 1: take a breathalyzer, which, frankly, even though I'm a staunch
- 10:34Speaker 1: believer that if you're sober, you're going to take it,
- 10:37Speaker 1: I kind of think you have a right to decide
- 10:38Speaker 1: if I'm going to do something like that, and.
- 10:40Speaker 2: If that's the only thing you do, I mean, if
- 10:42Speaker 2: you really are you know, no smell of alcohol, no unsteadiness,
- 10:48Speaker 2: perfect speech, you know, no no cocktails in the car.
- 10:53Speaker 2: The refusal is probably not going to get you arrested.
- 10:57Speaker 1: I guess they do. And there's a well, it's like
- 11:02Speaker 1: failing the field the field sobriety test you. And what
- 11:04Speaker 1: I want to do. I want to see if I
- 11:06Speaker 1: can find it. Yeah, but I saw a lot of
- 11:07Speaker 1: comments on social media that basically anybody over sixty five
- 11:10Speaker 1: is probably going to fail the field field sobriety test.
- 11:13Speaker 1: That's a great point.
- 11:14Speaker 3: You know.
- 11:14Speaker 1: What I want to do. I want to get a
- 11:16Speaker 1: cop to give me a field sobriety test. I want
- 11:18Speaker 1: to see if i'd pass it. To get traced. I'm
- 11:21Speaker 1: going to see if I'm going a Tampa Bay area
- 11:23Speaker 1: police officer who'd be willing to administer a genius. Wouldn't
- 11:26Speaker 1: that be an interesting exercise? Get Tracy out there, video it.
- 11:29Speaker 1: Let's see if I could pass it. Because he goes
- 11:31Speaker 1: I'm pretty agile. I mean, I've lost the way, thank
- 11:33Speaker 1: goodness again, and I'm in pretty good shape. But somebody said,
- 11:37Speaker 1: full stop, you're over sixty five. You ain't passing that thing.
- 11:40Speaker 1: It's hard to do. And blob did you see what
- 11:42Speaker 1: he was doing? He was like doing exercise.
- 11:47Speaker 2: And then when it was all when it was all
- 11:48Speaker 2: over the office, and you know what, I will say
- 11:51Speaker 2: two things, because everybody's going by this officer ought to
- 11:53Speaker 2: be fired. What she was the picture of professionalism and politeness.
- 11:57Speaker 2: Tony was the picture of politeness. I think this is
- 12:00Speaker 2: kind of the way it's supposed to go. I think
- 12:02Speaker 2: everybody did okay. But thereafter it was all over, they
- 12:05Speaker 2: took him. They couldn't do feel sobriety on a tilted
- 12:07Speaker 2: shoulder on the road. They like to take you to
- 12:09Speaker 2: a parking garage or something. I feel sobriety. And then
- 12:11Speaker 2: when it was all over, he says, did I pass
- 12:13Speaker 2: the test? She says, turn around.
- 12:16Speaker 1: And he knew. He said, here come the cuffs. Nope,
- 12:18Speaker 1: we're gonna put your hands behind you. But I feel
- 12:20Speaker 1: so Look, I love the guy. I hate it. I
- 12:24Speaker 1: hate Look. Even great people make mistakes. We all make mistakes.
- 12:28Speaker 1: Like you said, been there, done that. I'm not much
- 12:30Speaker 1: I've never been much of a drinker in my life.
- 12:32Speaker 1: But I'm sure I've done things of speed's gone through.
- 12:34Speaker 1: I've got traffic violations, you know, limping to get on
- 12:38Speaker 1: the plane early. I mean, i'd make I'm a I
- 12:40Speaker 1: can be a shallow little man, so I make mcgallagher,
- 12:44Speaker 1: you're a little little man. But hey, stay tuned. Fauci
- 12:48Speaker 1: hearings underway, Buckle up podcast. What do we have some
- 12:52Speaker 1: podcast rich material today?
- 12:53Speaker 2: Are some fauci stuff to talk about in the rearview
- 12:56Speaker 2: mirror might have another thought or two about Romo, might
- 12:58Speaker 2: have a number of other things that It's all on
- 13:00Speaker 2: M and M extra, YouTube, Apple and Spotify. Later in
- 13:04Speaker 2: the day, I have a good show.
- 13:05Speaker 1: I love you. Happy Wednesday. See you. He's ready.
