- 1:00joining us here today. Hey guys thank you so
- 1:06much for being here you know this is well how
- 1:09many bazillion times have I said it these are
- 1:12my favorite six days of the year um because I
- 1:15get to spend one on one time with experts in
- 1:18the space that I mean a lot of people they don't
- 1:22get those options so I'm kind of lucky. and I'm
- 1:25going to basically collect information and share
- 1:28it with you because that I feel is my job and
- 1:31that is my desire and it's just what I want to
- 1:35do. So we're going to be talking to Mark here.
- 1:38Mark Gross is a cost seg specialist and really
- 1:42what I'm focusing on right now is the short term
- 1:46rental. So for those of you that have thought
- 1:49hey there are short term rentals And that's a
- 1:53possibility for me. There are ways to do it through
- 1:56arbitrage. I mean, there are so many ways to
- 2:00get into the short -term rental market. But if
- 2:04you want to do cost seg, you're going to have
- 2:07to own the property. So that kind of pushes out
- 2:10the arbitrage, but that is still an absolutely
- 2:12amazing way to make money. Don't push it aside.
- 2:16But for those of us that are looking for ways
- 2:18to potentially get a vacation home that pays
- 2:23for itself. This is the guy you want to talk
- 2:27to. I am super excited. Mark, I'm going to let
- 2:31you intro yourself, give us a little bit of background,
- 2:35and then we'll get going. Sure. Thank you, Angel.
- 2:38I really appreciate this opportunity. I'm Mark
- 2:41Grossman from CSSI, which is Cost Segregation
- 2:44Services, Incorporated. Over the last 20 years,
- 2:48we've completed tens of thousands of studies
- 2:50across the country, not just short -term rentals,
- 2:53but all property types. I've been doing that
- 2:56for over 10 years with them and really enjoy
- 2:59it like saving people money. Absolutely. if you've
- 3:04heard in the past you might have heard hey it
- 3:07needs to be $500 ,000 before you can really do
- 3:10a cost seg maybe you've heard more than that
- 3:12but if you're looking for vacation rentals um
- 3:17you're you're going to be beyond that amount
- 3:20anyway um you know it's having these kinds of
- 3:25events they can get pretty uh well yeah um we
- 3:31get kind of sandwiched with them I'll give you
- 3:34an example. I mean, I'm working on several right
- 3:37now where the acquisition price is probably in
- 3:41the four to 500 ,000 dollar range. One is 300
- 3:43,000 something. What you need to do is take a
- 3:47look at what the acquisition cost is, subtract
- 3:50the land because you can't depreciate the land.
- 3:54And then we do the study based on what the cost
- 3:56basis is of a property after that. So do y 'all
- 4:00have a percentage that you knock out off the
- 4:02top for the land? We don't because it varies
- 4:06significantly depending upon location. Let's
- 4:09say you're in a tertiary market, that's going
- 4:13to be a lot different than maybe Manhattan, New
- 4:16York or Southern California, where I did one
- 4:20in the San Diego area. And the land on that one
- 4:23was about 40 % of the purchase price, where some
- 4:27of the tertiary markets might be 10 to 15%. So
- 4:31it really varies. All right, so again, we're
- 4:33going to get selfish here. We just spent a weekend,
- 4:38a couple of weeks ago. We spent a weekend at
- 4:40a friend's cabin in Broken Bow, Oklahoma. And
- 4:44as we are leaving, I am literally calling the
- 4:46realtor and I'm like, we want to cabin here.
- 4:51And when we set our parameters, we set 700 ,000
- 4:55to maybe, you know, 700 ,000 to a million. And
- 5:01the cool thing about that is, like I said, I
- 5:05had been told that you need $500 ,000 before
- 5:07you can really cost seg with it being a benefit.
- 5:11Now I got friends to say $300 ,000, you know,
- 5:13whatever. But I knew that at $750 ,000, I could
- 5:17cost seg that baby. And this is the last year.
- 5:22So this is 2022. This is the last year that you
- 5:27get 100%. of the bonus depreciation unless it
- 5:31gets voted back in. Correct. As of right now,
- 5:35this is it. Well, one thing to take into consideration,
- 5:40you're right. This is the last year for 100 %
- 5:42bonus depreciation. It goes to 80 % in 2023 with
- 5:48subsequent reductions of 20 % per year until
- 5:51it goes away. However, think about it this way.
- 5:55This came about from the Tax Cuts and Jobs Act
- 5:58at the end of 2017, which had had bonus depreciation
- 6:03for new acquisitions. It was available prior
- 6:07to that time for new construction. Now, that's
- 6:09fairly recent from a time perspective. We've
- 6:12been doing this for 20 years before there was
- 6:16even bonus depreciation for it. So even if the
- 6:19bonus depreciation part is going to be diminished,
- 6:23There's still a lot of value to be associated
- 6:25with cost segregation. This is just kind of a
- 6:27cream on the top. Yeah, no, and I thought about
- 6:30that too, because we come to the residential
- 6:32world. We are buying whole people. That's me
- 6:36and my husband, my family, his family. We grew
- 6:39up in this. We are buying whole people. And even
- 6:43when all of the bonus depreciation is gone, you
- 6:47can still cost sag and get your five year bucket.
- 6:50You can get your seven year bucket, your 15 year
- 6:52bucket. There are buckets that you're still going
- 6:54to benefit from through cost segregation. So
- 6:57don't think that there is no need for cost sag
- 7:00just because it's phased out. That is not the
- 7:04case at all. because you can still take a depreciation
- 7:08at five years instead of waiting for 39 or 27
- 7:12and a half or whatever those years are on the
- 7:14straight line because it's a long time, friends.
- 7:19Yeah, you raised an interesting point there about
- 7:22the differentiation between 27 and a half years
- 7:25and 39 years. Now, the 27 and a half year straight
- 7:30line depreciation is associated with residential
- 7:32property. and the 39 years for the others. Now,
- 7:37what not everybody is aware of is what classification
- 7:41are short -term rentals. They're actually treated
- 7:44as a hotel because it doesn't have a long, it's
- 7:48a 39 year straight line depreciation, not 27
- 7:53and a half because it's based on what the lease
- 7:55terms are. If you have a short -term rental and
- 7:58you have an annual lease on it, then yes, it
- 8:01can be 27 and a half years, but Otherwise, the
- 8:04short -term rentals that I do is based on it's
- 8:0739 and a lot of people are not cognizant of that.
- 8:11Okay, so that kind of changes it, right? That
- 8:16can really affect your strategy as far as what
- 8:21you're hoping to get out of it. I'm not happy
- 8:25with that. Well, it's not a huge deal. I mean,
- 8:30the way the process works is that Because we've
- 8:33done so many studies, we were able to provide
- 8:35a free preliminary analysis. And what we do is
- 8:39ask information about a particular property.
- 8:42How much did you pay for? Estimated land value?
- 8:45What's your tax rate? Things of that nature.
- 8:49And then what we do is provide a free preliminary
- 8:51analysis based on that information, which says,
- 8:56for instance, if it was to be a a multi -family
- 9:00property versus a short -term rental, we'll take
- 9:03that into consideration and provide the numbers
- 9:05accordingly. So we will provide a free analysis
- 9:09which will show the estimated savings and what
- 9:12the cost of the study is so you can determine
- 9:14what the ROI is, whether or not you want to move
- 9:17forward on it or not. Hey guys, it's Angel. In
- 9:23case you didn't know, I put on a three -day virtual
- 9:26summit twice a year. It's the Real Estate Investing
- 9:29Rocks Summit and I've been hosting it since March
- 9:31of 2020. The next one, number 11, is March 25th,
- 9:3626th and 27th. Three full days, no cost to you.
- 9:40My friend Sandy is speaking and she supported
- 9:42me at every single summit since I started. Joe
- 9:46Fairless, Kathy Fedky, a Tony Award winner, another
- 9:49friend who's raised literal millions from people
- 9:52met on LinkedIn and the list goes on. You have
- 9:55to join our mighty networks community gain access
- 9:58and that link, it's in the show notes. Wow. So
- 10:08we were. Honestly, and I'm just going off what
- 10:10we were looking at with broken bow. Um, so when
- 10:14we're looking at properties in broken bow, they
- 10:16basically come turnkey. When you purchase them,
- 10:20you're getting the hot tub, you're getting the
- 10:22bed, you're getting everything. So when you cost
- 10:26tag something like that, do you, do you look
- 10:30at the stuff that's in the house? Oh. Oh, sure.
- 10:36You would look at the bedding and everything
- 10:37that was in the house. We'll take a look at all
- 10:39the different aspects because that's part of
- 10:42what the purchase price is going to be. So we'll
- 10:44take a look at all that. I mean, that's going
- 10:47to be different than let's say you buy a multi
- 10:49-family apartment, which is basically, you know,
- 10:52vacant. Yeah. Each of the units. So we take all
- 10:56those factors into consideration. One of the
- 10:59other things we ask as well is it may not be
- 11:01applicable for the short -term rentals or maybe
- 11:05What are you planning on doing on CAPEX expenditures?
- 11:09And what we can do is take that in consideration
- 11:11and do a separate study and give you additional
- 11:14tax savings on what CAPEX you're doing in addition
- 11:18to the acquisition. Well, and that brings me
- 11:21to another question. So what I was reading was
- 11:25that, okay, you only get, I think it's two weeks
- 11:28max per year at your short term rental. in order
- 11:32for it to meet the tax designation, whatever
- 11:34that magic is. But I also read that if you are
- 11:41going to your property and you're doing maintenance,
- 11:46you're doing the building bunk beds, you're doing
- 11:50things to make the property better, or you're
- 11:53doing maintenance on the property, those weeks
- 11:55don't count against you. But if you're going
- 11:58into the home and you're adding, say, built -in
- 12:00bunk beds, how does that affect the cost side
- 12:04piece? Because it's something you've done after
- 12:07purchase, right? Yeah, because really, what we
- 12:12do is take a look at it as snapshot in time.
- 12:15When you acquire the property, the only exception
- 12:18of that would be when you're doing cat -backed
- 12:20expenditure that could take over a period of
- 12:22time. But what happens after that time is not
- 12:26going to have an impact on the study that we
- 12:29provide. So here's something else I've heard.
- 12:35You're probably like, oh, dear god. So when one
- 12:40fiscal year or one year has passed, so you made
- 12:43the purchase in 2022. In 2023, you've made changes.
- 12:51Could another CASEG study be done on the additional
- 12:55changes and have those put into play? Yeah, I
- 12:59think what you're referring to is what I mentioned
- 13:01before about CAPEX expenditures that we mean
- 13:04by changes, improvements in the property and
- 13:07things of that nature. Yes, the answer is yes.
- 13:10And what we do is when we engage with a client,
- 13:16we ask them upfront, what are your CAPEX expenditures?
- 13:20what your plan is going to be and then what happens
- 13:23is at the end of the calendar year we will say
- 13:26what did you actually do versus what you anticipated
- 13:30you're going to do at that year. Now let's say
- 13:33that you initially weren't planning on doing
- 13:38any CAPEX expenditures but then things happen
- 13:41and then a year or two later or whatever the
- 13:43case might be you decide to do that you can then
- 13:46engage us and we can do a study on just that.
- 13:50portion of it not the initial acquisition because
- 13:53that was already done. Yeah well I think that's
- 13:56really important in the short -term rental model
- 13:58because like my husband and I we come from residential
- 14:01we are buy -and -hold people but I think that
- 14:04the short -term rental model is also really a
- 14:07buy -and -hold kind of model um which is really
- 14:11good for your cost seg because you don't have
- 14:14that recapture right? Correct. And that's one
- 14:17of the initial questions that we ask in our preliminary
- 14:20analysis, and that is, what's your whole period
- 14:23going to be? We say, are you planning on keeping
- 14:25it at least five years? Because if you're planning
- 14:28on doing a quick flip on it within one to three
- 14:31years, it may not make sense to do it because
- 14:34of what you just indicated about the recapture
- 14:36tax. So our objective is not to sell studies,
- 14:40just to make sure we provide things which are
- 14:42meaningful to the clients and they need to be
- 14:44aware of that, which is why upfront we ask those
- 14:47questions. So when someone hires you or your
- 14:51firm for a cost segregation, do you send like
- 14:55one of those engineer people out to look at the
- 14:58property or do you just rely on pictures? Every
- 15:03single one of the tens of thousands of studies
- 15:05that we've done, we have had someone physically
- 15:09go to the property. Take hundreds of photographs
- 15:12and do that. Because one of the things that we
- 15:15do is we will defend the study at no cost in
- 15:19case you ever get audited by the IRS. We cannot
- 15:23defend the study if we don't have that level
- 15:25of detail. We want you as an owner to be able
- 15:29to sleep well at night and know that this is
- 15:32covered. I'm not going to have any issues with
- 15:34this because I know that because of our track
- 15:38record, there's not going to be any problems.
- 15:41And I bring that up because there are Cossack
- 15:46firms out there that are not going to send somebody
- 15:50to your property. They're going to rely on pictures.
- 15:54And if for whatever reason you get audited or
- 15:59you get sent to the IRS, it's not going to hold.
- 16:05you don't want to be in a position where it doesn't
- 16:07hold for you and you certainly don't want to
- 16:09be in a position where it doesn't hold for people
- 16:12that have invested with you. Correct. And another
- 16:15thing to take into consideration is that, well,
- 16:18I'll give you an example. I had a client who
- 16:21bought a large portfolio of dollar generous stores
- 16:24and his CPA recommended to him, why don't you
- 16:29just do two of them and then we'll extrapolate
- 16:31out what it's going to be for the rest of them.
- 16:33because they all have similar footprints. And
- 16:36I talked to the guy and I said, you know what?
- 16:39We just won't do it. We won't do any of them
- 16:41because we have to be able to have, you know,
- 16:45a site visit for every single one. Now, you know
- 16:48what's interesting about that is he went ahead
- 16:50and he said, you know what? I want to go ahead
- 16:52with you guys because I told him it's not just
- 16:55the cost of studying maybe, you know, $1 ,000
- 16:57or whatever the case might be. What's more important
- 17:01than the cost of study is what your depreciation
- 17:04is going to be. One of those those dollar general
- 17:07source for instance had a large retaining wall
- 17:09behind it. One of them you know not every property
- 17:13even though you think they might be identical
- 17:15are really in fact identified and by actually
- 17:19going out there and doing that site visit you're
- 17:22able to identify things that can be depreciated
- 17:25that you're not going to be able to pick up but
- 17:27just looking at some pictures. No, absolutely.
- 17:31And I know that there are companies out there
- 17:33do these statistical sampling. Those are like
- 17:38cookie cutter. Those aren't like what he's talking
- 17:42about with these stores that they're built in
- 17:45whatever area in whatever town and they have
- 17:49to fit the specifications of that location. So
- 17:53they're not cookie -cutters. So if you're doing
- 17:55something with the statistical sampling, we're
- 17:58not saying that's bad or wrong. We're just saying
- 18:00in this particular situation, you really had
- 18:04to have somebody come out there and look at it.
- 18:06Well, some people will say too that the percentage
- 18:10of audits are low, very low, and that's correct.
- 18:13Is that before the 87 ,000 new hires? That was
- 18:17my next sentence. With all the additional people
- 18:21that the IRS has brought on board, the anticipation
- 18:24is that there's going to be a lot more audits
- 18:26and they're going to be looking for things like
- 18:28that.
