- 0:00Speaker 1: What's up everyone and welcome back to the program. In
- 0:03Speaker 1: this episode we're going to pick up where we left
- 0:05Speaker 1: off with the Tyler Robinson prelim hearing transcript and to
- 0:09Speaker 1: do that we're picking up with the prosecution. Ballard, your honor,
- 0:14Speaker 1: just to clarify the record, the state has redacted that portion.
- 0:17Speaker 1: We anticipated that needed to be redacted in 16-1 so
- 0:21Speaker 1: we've redacted that portion. We believe that that's the best
- 0:24Speaker 1: way to proceed now is that we have an edited
- 0:27Speaker 1: video ready that comports with the additional edits that the
- 0:31Speaker 1: court has ordered. We propose that we take a break
- 0:34Speaker 1: so that we can show that to the defense, make
- 0:36Speaker 1: sure we're on the same page, and then anticipate coming
- 0:39Speaker 1: back in and playing Exhibit 16. So they take their break,
- 0:42Speaker 1: now they're back. Now back in session, welcome back, turning
- 0:46Speaker 1: to the state. I apologize, Judge, we're having computer technology
- 0:50Speaker 1: issues and we believe those have been sorted out But
- 0:54Speaker 1: we have not yet had the opportunity to show the
- 0:56Speaker 1: final edited version to the defense. So they go back
- 0:59Speaker 1: and forth, you know, figuring it all out. And the
- 1:03Speaker 1: judge calls a recess. Now they come back. Prosecution. We've
- 1:08Speaker 1: reviewed Exhibit 16 and defense, and it comports with the
- 1:11Speaker 1: court's order. At this point, we would like to put
- 1:14Speaker 1: Agent Davis back on the stand and continue with displaying that,
- 1:17Speaker 1: publishing that. Judge Graff, all right, Agent Davis, if you'd
- 1:20Speaker 1: like to come forward, I remind you you're still under oath.
- 1:23Speaker 1: if you'd like to have a seat there, should be
- 1:25Speaker 1: a water bottle to your left, and after you're situated,
- 1:29Speaker 1: if you wouldn't mind adjusting that microphone and bringing it
- 1:31Speaker 1: closer to you so the record can pick up your testimony. Prosecution,
- 1:37Speaker 1: and just for the record and the court's benefit, we've
- 1:39Speaker 1: made the edits that the court has ordered. We have
- 1:41Speaker 1: shown them to the defense. Pursuant to the timestamps that
- 1:44Speaker 1: the court ordered, wanted those to be reflected very clearly,
- 1:48Speaker 1: so there are sometimes large gaps or just black, empty
- 1:51Speaker 1: silent space. When there are large gaps, we'll fast forward.
- 1:55Speaker 1: Some of those are short enough that we'll just let
- 1:57Speaker 1: it play if the court's okay with that, with proceeding
- 2:00Speaker 1: that way. Judge Graff, thank you. I appreciate giving a
- 2:03Speaker 1: heads up so all parties know what's going on. Thank you, Ms. Hunt.
- 2:07Speaker 1: So at this time, we would move to publish on
- 2:09Speaker 1: the monitor State Exhibit 16. Prosecution. Judge Graff. All right.
- 2:14Speaker 1: And to the media. There's a monitor for your benefit
- 2:17Speaker 1: right next to you. For the camera, there is one
- 2:19Speaker 1: for that direction, as well as for the gallery. And
- 2:22Speaker 1: now the video plays. Speaker number four. This meeting is
- 2:26Speaker 1: to use your statement here instead of your testimony at
- 2:28Speaker 1: a prelim hearing. Do you understand that? Lance Twiggs, uh-huh.
- 2:34Speaker 1: Speaker four. Okay, so in order to do that, I
- 2:36Speaker 1: need to place you under oath and also give you
- 2:39Speaker 1: an admonition about false statements. Okay, first, you do solemnly
- 2:43Speaker 1: swear to affirm that the evidence you shall give in
- 2:46Speaker 1: this issue shall be the truth, the whole truth, and
- 2:48Speaker 1: nothing but the truth. So help you God. Lance Twiggs, yes.
- 2:53Speaker 1: Speaker 4, I also need to notify you that you
- 2:56Speaker 1: are notified the statements you're about to make may be
- 2:58Speaker 1: presented to a magistrate or judge in lieu of your
- 3:01Speaker 1: sworn testimony at a prelim examination. Any false statements you
- 3:05Speaker 1: make and that you do not believe to be true
- 3:08Speaker 1: may be subject to criminal punishment, a Class A misdemeanor.
- 3:12Speaker 1: Do you understand that? Twiggs, yes. Question, it potentially could
- 3:16Speaker 1: be used for punishment as a high offense as obstruction
- 3:19Speaker 1: of justice. In addition, I just want to make sure
- 3:22Speaker 1: that our recording here is clear and that you've been
- 3:24Speaker 1: given a federal agreement and state agreement granting you immunity
- 3:28Speaker 1: from prosecution for materials that you discussed now. Do you
- 3:31Speaker 1: understand that? Twigs, uh-huh. Question, okay, first we're going to
- 3:37Speaker 1: cover some of the things that you've already talked about.
- 3:39Speaker 1: But to make it as part of the record, first,
- 3:41Speaker 1: what's your name? Answer full name with middle name or
- 3:45Speaker 1: just last? Speaker for first and last. Twigs, okay, my
- 3:50Speaker 1: name is Lance Twigs. Question, and do you know Tyler Robinson? Answer, yes, yes,
- 3:54Speaker 1: I do. Question, and this is the same Tyler Robinson
- 3:57Speaker 1: that's been charged with shooting of Charlie Kirk? Answer, yes. Question,
- 4:02Speaker 1: and would you say when you first met Tyler? Answer,
- 4:05Speaker 1: I think it was 2023. I've known him longer than that, though.
- 4:09Speaker 1: That was the first time I met him in person. Question, okay,
- 4:12Speaker 1: and will you describe your relationship with Tyler when you
- 4:15Speaker 1: first met him anyway? Answer, when I first met him,
- 4:19Speaker 1: I didn't know him super well. He was just a
- 4:21Speaker 1: new roommate. So I knew he knew my friend group,
- 4:24Speaker 1: and I knew he liked playing games, but that's about
- 4:26Speaker 1: it when he first moved in. Question, okay, so before
- 4:29Speaker 1: we go on, I realized that my mic was muted
- 4:31Speaker 1: at the onset. Was yours going, your microphone? It's going,
- 4:36Speaker 1: back and forth they're having now. I'm going to repeat
- 4:38Speaker 1: those admonitions to make sure we've got the recording. So again,
- 4:42Speaker 1: I've placed you under oath, just to make a record,
- 4:44Speaker 1: I'm going to do it again. Do you solemnly swear
- 4:47Speaker 1: that the evidence you shall give in this issue shall
- 4:49Speaker 1: be the truth, the whole truth, and nothing but the truth,
- 4:52Speaker 1: so help you God? Twigs, yes. Question and again. I'm
- 4:56Speaker 1: going to give you the false statement admonition. Speaker four,
- 4:59Speaker 1: all right, okay, sorry about the interruption. All right, so
- 5:02Speaker 1: you said when you first met, you were roommates? Answer, yes. Question, okay.
- 5:06Speaker 1: And then at some point in your relationship progressed to
- 5:09Speaker 1: something more than roommates, is that right? Answer, uh-huh. Question,
- 5:13Speaker 1: when was that? Answer, I think we started dating two
- 5:15Speaker 1: or three months after he moved in. Question, okay, and
- 5:19Speaker 1: where did you live at the time? Answer, St. George
- 5:22Speaker 1: in an apartment complex. Question, and is that apartment the
- 5:25Speaker 1: same place you lived on September 10th? Answer, yes. Question,
- 5:29Speaker 1: when you lived there with Tyler, were you in the
- 5:31Speaker 1: same room? Did you live in the same room or
- 5:33Speaker 1: different rooms? Answer, no separate rooms. Question, and at the time,
- 5:38Speaker 1: let's say September 2025, what were you doing with your life?
- 5:42Speaker 1: Were you working, school? Answer, I was working. I was
- 5:46Speaker 1: doing bathtub and shower repair and stuff and new construction. Question, okay,
- 5:51Speaker 1: and how about Tyler? Answer, I think he was both working.
- 5:54Speaker 1: I think he was working for an electrician company then
- 5:57Speaker 1: and he was also in a trade school for being,
- 6:00Speaker 1: I don't know, higher ranking electrician. I'm not sure how
- 6:02Speaker 1: the trade system works for that. Question, okay. Answer, but yeah,
- 6:07Speaker 1: I think he was both. Question, what was his typical
- 6:10Speaker 1: workday like? Answer, I think he'd leave around seven generally.
- 6:14Speaker 1: and get back like three or four, depending on where
- 6:17Speaker 1: the job was and how long it took. And then
- 6:21Speaker 1: on certain days of the week during school semesters, he
- 6:24Speaker 1: would then, later in the day, I think around five
- 6:26Speaker 1: or six, go to school. So yeah. Question, okay, so
- 6:29Speaker 1: let's jump to September 10th. Did he spend the night
- 6:32Speaker 1: in the apartment the night of September 9th into September 10th? Answer,
- 6:37Speaker 1: into September 10th, yeah, I think he did. Question, do
- 6:40Speaker 1: you know when he left the apartment? On September 10th? Answer,
- 6:44Speaker 1: I don't know the exact time. I just know he
- 6:46Speaker 1: left early. I heard him leaving and he just said
- 6:48Speaker 1: he had a long drive to work that day. So
- 6:51Speaker 1: he was leaving early. Question, okay, so early. Any guess
- 6:54Speaker 1: as to when that was? Answer, I don't know. I
- 6:57Speaker 1: would have thought it was 5 a.m. because that's when
- 7:00Speaker 1: an early work day was for him, but it was
- 7:02Speaker 1: probably more like 4. Question, okay, so what time did
- 7:06Speaker 1: you get up on September 10th? Answer, probably 12 or 1. Question,
- 7:11Speaker 1: did you have work that day? Answer, no. Question, and
- 7:14Speaker 1: did you hear from Tyler? Did he call or text
- 7:16Speaker 1: you before? Answer, no. He sent that message in the
- 7:19Speaker 1: group chat I mentioned, but he didn't message me directly
- 7:22Speaker 1: at all that day. Question, okay. When did you first
- 7:25Speaker 1: hear from him? On September 10th. Answer, it was 11
- 7:29Speaker 1: o'clock with that automated message. Question, okay, 11 p.m. Lance Twiggs, yeah. Question,
- 7:36Speaker 1: he asked you here, remember how I was engraving bullets?
- 7:39Speaker 1: Was he engraving bullets before this? Answer, yeah. I don't
- 7:43Speaker 1: remember exactly when, but he said he was planning to
- 7:46Speaker 1: go hunting with his family. And he asked me if
- 7:48Speaker 1: I had a Dremel, because he said he wanted to
- 7:50Speaker 1: engrave messages on bullets. And I just told him where
- 7:53Speaker 1: the Dremel was, and I told him to make sure
- 7:55Speaker 1: he doesn't set off a bullet on accident in the house.
- 7:59Speaker 1: But I didn't really think about it until then. Question,
- 8:03Speaker 1: how long before September 10th was it that he asked
- 8:06Speaker 1: about the Dremel? Answer, I don't remember, because he'd been
- 8:10Speaker 1: talking about the hunting camping trip for a couple months,
- 8:13Speaker 1: but I don't remember when he was specifically asking to
- 8:15Speaker 1: engrave the bullets. Question, are we talking about a year before? Answer,
- 8:20Speaker 1: oh no, not that long. It would have been, I'd say,
- 8:23Speaker 1: at most a month before this was when he was asking. Question, okay,
- 8:28Speaker 1: all right. You talked about the note that he left.
- 8:31Speaker 1: I want to bring this up and I should say
- 8:32Speaker 1: that these text messages that we've been looking at here
- 8:35Speaker 1: are Bates number 54, okay? The notes have been titled
- 8:38Speaker 1: 16-3 with a note, And this is Bates number 58.
- 8:42Speaker 1: Do you recognize that on your screen? Answer, yeah. Question,
- 8:47Speaker 1: what do you recognize? Answer, that was the note under
- 8:50Speaker 1: my keyboard that he was referring to in the first
- 8:52Speaker 1: text of that chain. Question, okay, so where did you
- 8:56Speaker 1: find this? Twigs, on his desk, underneath his computer keyboard. Answer,
- 9:01Speaker 1: I assumed you read it. Answer, yeah. Question, and then,
- 9:05Speaker 1: what did you do with it after you read it? Answer.
- 9:09Speaker 1: I believe I just put it back down on the
- 9:11Speaker 1: desk after I took a picture of it. Question. Okay.
- 9:14Speaker 1: And again, the time you read it was probably around
- 9:16Speaker 1: 11 or so on the 10th. Answer. Yes. Question. The
- 9:20Speaker 1: night of September 10th. Answer. Uh-huh. Question. All right. Did
- 9:24Speaker 1: you ever see that again after you placed it back
- 9:26Speaker 1: on his desk? Answer. No, I don't think I did. Question.
- 9:30Speaker 1: And that was a desk in his bedroom. Answer. Yes. Question.
- 9:34Speaker 1: And that's a separate bedroom to your bedroom. Answer. Yup. Question, okay,
- 9:38Speaker 1: and now I want to go with what's been titled 16-2.
- 9:41Speaker 1: And do you recognize the series of messages here? Answer, yeah,
- 9:45Speaker 1: that was the server, like his friend that I was mentioning. Question, okay,
- 9:49Speaker 1: and this is your phone again? Twigs, yeah. This is Discord. Question,
- 9:54Speaker 1: and who are the members of the server? I don't
- 9:57Speaker 1: want names, just generally, who are these people and members
- 9:59Speaker 1: of this group twigs this is his friend group they
- 10:03Speaker 1: play dnd together every week question okay and i just
- 10:07Speaker 1: want to scroll through this to make sure that you
- 10:09Speaker 1: get a chance to take a look at it or
- 10:11Speaker 1: go to the next page answer yes question so tyler
- 10:16Speaker 1: icum who's that answer that's tyler robinson Question, and these
- 10:19Speaker 1: other people are just others that are members of the server? Answer, yes. Question, Judd, Barnaby, Marina, DM, yes? Answer, yeah,
- 10:29Speaker 1: DM means Dungeon Master, so most of them are names
- 10:31Speaker 1: they're using in the game they're currently playing. Question, got it. Yeah,
- 10:36Speaker 1: it looks like the last text from Tyler, it looks
- 10:38Speaker 1: like was 8pm. And do you know what day this
- 10:41Speaker 1: would have been? 8pm on the 10th or the 11th? Answer,
- 10:44Speaker 1: I would think it would be the 11th. At least
- 10:46Speaker 1: I think so. Because I don't think on the 10th
- 10:48Speaker 1: that he messaged anyone before me at 11th. Question, and
- 10:52Speaker 1: he turned himself in on the 11th, right? Answer, yeah,
- 10:56Speaker 1: I thought so. All right, we're going to wrap up
- 10:58Speaker 1: right here. And in the next episode, we're going to
- 11:00Speaker 1: pick up where we left off. All the information that
- 11:03Speaker 1: goes with this episode can be found in the description box.
