- 3:16Speaker 1: affet David, do not contain all known information, but rather
- 3:20Speaker 1: only those facts believed to be necessary to establish probable
- 3:24Speaker 1: cause for this complaint. I'm familiar with the facts and
- 3:27Speaker 1: circumstances set forth herein as a result of a review
- 3:31Speaker 1: of records, digital surveillance camera footage, and conversations with other
- 3:35Speaker 1: law enforcement officers, and my own investigative efforts as more
- 3:39Speaker 1: fully described below. On September tenth, twenty twenty five, Charles
- 3:43Speaker 1: James Kirk was at the Utah Valley University campus in
- 3:47Speaker 1: orm Utah for a political event. Mister Kirk is a
- 3:50Speaker 1: conservative political activist who is scheduled to speak at an
- 3:53Speaker 1: event in the courtyard area on the UVU campus. The
- 3:57Speaker 1: courtyard area is to the west of the LOWC Center building.
- 4:01Speaker 1: According to video recordings, Charles was wearing a white T
- 4:04Speaker 1: shirt and dark pants, sitting under a white canopy in
- 4:08Speaker 1: a courtyard of the campus facing to the east. Charles
- 4:12Speaker 1: was holding a microphone and speaking to a crowd. While
- 4:15Speaker 1: speaking into the microphone, a loud gunshot was heard at
- 4:18Speaker 1: approximately twelve twenty three hours and Charles appeared to have
- 4:22Speaker 1: been hit in the neck. Blood was seen coming out
- 4:25Speaker 1: of the left side of his neck as he fell
- 4:28Speaker 1: over to his left. Charles was transported to the Timpanogos
- 4:33Speaker 1: Regional Hospital in Oreum. Charles was pronounced deceased at the hospital.
- 4:37Speaker 1: Charles's body was transported to the Office of the Medical Examiner,
- 4:41Speaker 1: where an autopsy was performed on the body. According to
- 4:44Speaker 1: information obtained by the police officer who attended the autopsy,
- 4:48Speaker 1: Sergeant Barrett with the Utah State Bureau of Investigation, Doctor
- 4:52Speaker 1: Guarado of the Office of the Medical Examiner concluded the
- 4:56Speaker 1: autopsy and explained that he was going to certify that
- 5:00Speaker 1: Charles Kirk cause of death was a homicide caused by
- 5:03Speaker 1: a gunshot wound. Investigators review the Utah Valley University surveillance cameras.
- 5:10Speaker 1: While reviewing the surveillance cameras, investigators observed an individual on
- 5:14Speaker 1: the rooftop of the Low C Center building on the
- 5:17Speaker 1: UVU campus at the time of the shooting. Hereafter, the
- 5:20Speaker 1: unidentified individual will be referred to as Robinson. Based on
- 5:24Speaker 1: surveillance camera footage, Robinson appears to be a white male
- 5:28Speaker 1: with dark colored hair, wearing a blue colored hat, sunglasses,
- 5:31Speaker 1: a long sleeved black shirt with a picture of an
- 5:34Speaker 1: American flag and an eagle printed on the shirt, dark
- 5:38Speaker 1: colored jeans, and white gray shoes with white colored shoelaces.
- 5:42Speaker 1: The shoes appear to be consistent with Chuck Taylor's. Robinson
- 5:46Speaker 1: is also carrying a dark colored backpack on his back.
- 5:49Speaker 1: Robinson walks with a distinctive gait. Prior to the shooting,
- 5:54Speaker 1: Robinson appears to walk with a stiff right leg and
- 5:56Speaker 1: a relatively slow pace. Robinson's ability to bend the right
- 6:00Speaker 1: leg appears to be restricted. The investigators were able to
- 6:04Speaker 1: track Robinson's movements on the UVU Campus, starting out approximately
- 6:08Speaker 1: eleven to fifty hours. On nine ten, twenty twenty five,
- 6:13Speaker 1: at approximately eleven fifty hours, a UVU surveillance camera for
- 6:17Speaker 1: his captured Robinson walking across a grassy area north of
- 6:21Speaker 1: Campus Drive at approximately eight hundred west. Robinson walks south
- 6:26Speaker 1: through the parking lot and approaches a pedestrian tunnel that
- 6:30Speaker 1: runs underneath Campus Drive. Robinson pauses briefly before entering the tunnel.
- 6:35Speaker 1: Before entering the tunnel, Robinson pauses at the top of
- 6:38Speaker 1: the stairs and pulls out what appears to be a
- 6:41Speaker 1: cell phone from his right pocket using his right hand
- 6:44Speaker 1: at approximately eleven fifty three hours, Robinson appears to be
- 6:48Speaker 1: manipulating the cell phone device with his hands, possibly texting.
- 6:52Speaker 1: Robinson eventually puts what appears to be a cell phone
- 6:55Speaker 1: back in his right pants pocket using his right hand.
- 6:59Speaker 1: Robinson walked down the stairs and noticeably keeps his right
- 7:02Speaker 1: leg mostly straight walking down the stairs into the tunnel,
- 7:07Speaker 1: Robinson walks through the tunnel and into the parking garage area.
- 7:10Speaker 1: Robinson walks up the stairs to the second level of
- 7:13Speaker 1: the parking garage. While walking up the stairs in the
- 7:16Speaker 1: parking garage, Robinson continues to keep his right leg straight.
- 7:21Speaker 1: As Robinson approaches the landing on the stairs between the
- 7:24Speaker 1: first and second floor, it appears as though there is
- 7:27Speaker 1: something bulging out from Robinson's waistband area as he walks
- 7:32Speaker 1: up the stairs. The bulge appears to be underneath Robinson's
- 7:35Speaker 1: black shirt and on the right side of Robinson's waistband area.
- 7:39Speaker 1: At approximately twelve oh two hours, Robinson is observed walking
- 7:43Speaker 1: on the north side of the Loci Center building, walking
- 7:46Speaker 1: with the same gate as observed earlier. Robinson walks south
- 7:50Speaker 1: on the sidewalk on the east side of the lo
- 7:52Speaker 1: Ci Center building. Robinson enters the lo Ci Center Building
- 7:56Speaker 1: through a set of doors on the southeast corner of
- 7:58Speaker 1: the Loci Center building. At approximately twelve fifteen hours, Robinson
- 8:03Speaker 1: is observed walking up the stairs that lead to the
- 8:06Speaker 1: common area adjacent to the lo Ci Center building. Robinson
- 8:11Speaker 1: walks to a short concrete wall that separates the common
- 8:14Speaker 1: area from the rooftop of the lo Ci Center building.
- 8:17Speaker 1: At approximately twelve seventeen hours, Robinson climbs over the short
- 8:21Speaker 1: wall and appears to crouch down on the north side
- 8:24Speaker 1: of the wall on the rooftop. At approximately twelve twenty
- 8:28Speaker 1: two hours, Robinson stands up and starts running across the
- 8:32Speaker 1: rooftop of the lo CI Center building. Robinson runs to
- 8:35Speaker 1: the west side of the rooftop and appears to scoot
- 8:38Speaker 1: along the rooftop area as he gets closer to the
- 8:41Speaker 1: edge of the rooftop. At approximately twelve twenty two hours,
- 8:45Speaker 1: Robinson lays down in a prone position near the edge
- 8:48Speaker 1: of the rooftop and appears to be facing west in
- 8:50Speaker 1: a direction of the courtyard area. The rooftop of the
- 8:54Speaker 1: lo CI Center building overlooks the courtyard area where the
- 8:57Speaker 1: event featuring Charlie Kirk was taking place. The low C
- 9:01Speaker 1: building is east of the courtyard area. At approximately twelve
- 9:05Speaker 1: twenty three hours, Robinson stands up suddenly from the edge
- 9:09Speaker 1: of the rooftop and sprints north on the rooftop of
- 9:12Speaker 1: the lo CI Center building. This sprinting motion is in
- 9:15Speaker 1: star contrast to the slow and restricted gate observed by
- 9:19Speaker 1: Robinson an earlier surveillance camera footage. Robinson runs to the
- 9:24Speaker 1: northeast corner of the lo CI Center building and approaches
- 9:27Speaker 1: the edge of the rooftop. Robinson places a dark colored
- 9:30Speaker 1: item on the rooftop and proceeds to lower himself off
- 9:34Speaker 1: the rooftop. Robinson drops off the rooftop onto the grass below.
- 9:39Speaker 1: Robinson runs north near the parking lot to the east
- 9:42Speaker 1: of the low CI Center. At approximately twelve twenty four hours,
- 9:46Speaker 1: Robinson runs north across the campus drive road. The area
- 9:51Speaker 1: to the north of the campus drive road where Robinson
- 9:53Speaker 1: crossed over is a grassy area with trees on the
- 9:56Speaker 1: edge of the UVU campus. Investig theator is discovered a
- 10:00Speaker 1: bolt action rifle wrapped in a dark colored towel. The
- 10:04Speaker 1: rifle was determined to be a Mouser Model ninety eight
- 10:07Speaker 1: thirty odd six caliber bolt action rifle. The rifle had
- 10:11Speaker 1: a scope mounted on top of it. Investigators noted that
- 10:15Speaker 1: inscriptions that had been engraved on casings found with the rifle.
- 10:19Speaker 1: Inscriptions on the three unfired casings red hey fascist catch
- 10:24Speaker 1: up arrow symbol, right arrow symbol and three down arrow symbols.
- 10:29Speaker 1: A second on fired casing red oh bella chow bella
- 10:32Speaker 1: chow bella chow chow chow. A third on fired casing
- 10:37Speaker 1: red if you read this you are gay LMAO. Investigators
- 10:42Speaker 1: documented a shoe impression on the northeast corner rooftop edge
- 10:45Speaker 1: of the Low Ce Center building. The shoe impression is
- 10:48Speaker 1: consistent with the shoe sole characteristics of a converse Chuck
- 10:52Speaker 1: Taylor's shoe. While processing the crime scene evidence, technicians were
- 10:56Speaker 1: able to identify the location where Robinson, through physical contact,
- 11:01Speaker 1: had left potential biological evidence. Touch DNA transfers when skin
- 11:05Speaker 1: cells from touch or sweat are shed into an object
- 11:08Speaker 1: during direct or indirect contact, and it can also transfer
- 11:12Speaker 1: from one person to another. This type of DNA evidence
- 11:15Speaker 1: comes from cells or skin cells that contain cellular DNA
- 11:20Speaker 1: and can be recovered from a wide range of services
- 11:23Speaker 1: with the use of forensic DNA techniques. This evidence was
- 11:26Speaker 1: collected in order to obtain a potential DNA profile for Robinson.
- 11:31Speaker 1: Evidence technicians also identified fingerprints and a smear pond print
- 11:35Speaker 1: in the vicinity of the northeast corner rooftop edge of
- 11:38Speaker 1: the Low Sea Center building where Robinson dropped off the
- 11:41Speaker 1: rooftop to the ground below. On nine eleven, twenty twenty five,
- 11:45Speaker 1: Sheriff Smith with the Utah County Sheriff's Office received a
- 11:48Speaker 1: phone call at approximately twenty four hours from Sheriff Brooksby
- 11:53Speaker 1: with the Washington County Sheriff's Office. According to Sheriff's Brooksby,
- 11:57Speaker 1: he had received a phone call from former deputy who
- 12:00Speaker 1: had previously been employed with the Sheriff's office. The former deputy,
- 12:04Speaker 1: identified as Mike Mitchell, explained that he had received the
- 12:07Speaker 1: phone call from the father of Tyler Robinson. Mike Mitchell
- 12:10Speaker 1: explained that Tyler Robinson confessed to his father that he
- 12:14Speaker 1: was the shooter at Utah Valley University. Tyler Robinson's parents
- 12:18Speaker 1: worked with law enforcement to arrange a way for Tyler
- 12:21Speaker 1: Robinson to turn himself in without confrontation with law enforcement.
- 12:26Speaker 1: Mike Mitchell coordinated with law enforcement to have Tyler Robinson
- 12:29Speaker 1: meet with law enforcement at the Washington County Sheriff's Office.
- 12:33Speaker 1: Tyler Robinson arrived at the Washington County Sheriff's Office accompanied
- 12:37Speaker 1: by his parents at approximately twenty two to twenty six hours,
- 12:41Speaker 1: so roughly ten twenty six pm. Tyler Robinson was not
- 12:46Speaker 1: wearing clothing consistent with the clothing observed on surveillance cameras
- 12:50Speaker 1: during and around the time of the incident at UVU.
- 12:53Speaker 1: According to a photo provided to me by Agent Davis
- 12:56Speaker 1: with the Utah State Bureau of Investigation, Tyler ro Robinson
- 13:00Speaker 1: arrived at the Washington County Sheriff's office, wearing a dark
- 13:03Speaker 1: colored hat, a maroon colored T shirt, jeans, and white
- 13:06Speaker 1: gray colored converse style shoes. Tyler Robinson's mother relayed to
- 13:11Speaker 1: law enforcement that Tyler Robinson had expressed having suicidal ideations.
- 13:16Speaker 1: Sergeant Elshols with the Utah State Bureau of Investigation provided
- 13:21Speaker 1: me with a photograph of Tyler Robinson's Utah driver license.
- 13:25Speaker 1: The driver license was taken from the person of Tyler
- 13:28Speaker 1: Robinson by Agent Davis with the Utah State Bureau of Investigation.
- 13:32Speaker 1: On nine twelve, twenty twenty five, at approximately all one
- 13:36Speaker 1: hundred hours, FBI Special Agent Lang conducted an interview with
- 13:41Speaker 1: a boyfriend of Tyler Robinson at a Washington County Sheriff's office.
- 13:45Speaker 1: The boyfriend was identified as Lance Twigs. During the interview,
- 13:48Speaker 1: Lance showed investigator's text messages between Tyler Robinson and himself.
- 13:53Speaker 1: The following is the content of those messages between Tyler
- 13:57Speaker 1: Robinson and Lance Twigs. First message, Tyler, I'm still okay,
- 14:01Speaker 1: my love, but I'm stuck in Oorum for a little
- 14:03Speaker 1: while longer yet. Second message, Tyler, shouldn't be long until
- 14:07Speaker 1: I can come home, but I got to grab my rifle. Still,
- 14:10Speaker 1: to be honest, I had hoped to keep this secret
- 14:12Speaker 1: till I died of old age. I'm sorry to involve you.
- 14:15Speaker 1: Third message, Lance, you weren't the one who did it right.
- 14:19Speaker 1: Fourth message, Tyler, I am I'm sorry. Fifth message, Lance,
- 14:24Speaker 1: I thought they caught the person. Sixth message Tyler, No,
- 14:27Speaker 1: they grabbed some crazy old dude then interrogated someone in
- 14:30Speaker 1: similar clothing. Seventh message, Tyler, I had planned to grab
- 14:34Speaker 1: my rifle from my drop point shortly after, but most
- 14:37Speaker 1: of that side of town got locked down. It's quiet,
- 14:40Speaker 1: almost enough to get out, but there's one vehicle lingering.
- 14:44Speaker 1: Lance showed FBI special Agent Lang additional text messages between
- 14:48Speaker 1: Tyler Robinson and himself. The following is the content of
- 14:52Speaker 1: those messages between Tyler Robinson and Lance Twiggs. First message, Tyler,
- 14:57Speaker 1: three hours ago, there was an officer with a canine
- 14:59Speaker 1: walked nearby the area, hoping that pooch has a bad sniffer.
- 15:03Speaker 1: Second message, Tyler, I'm wishing I had circled back and
- 15:07Speaker 1: grabbed it soon as I got to my vehicle, because
- 15:09Speaker 1: it sounds like the police couldn't get in for a
- 15:12Speaker 1: long while because of the traffic. Third message Tyler, needless
- 15:16Speaker 1: to say, I'm gonna be late coming home. Fourth message, Lance,
- 15:21Speaker 1: just stay safe. Fifth message Tyler, I will. Sixth message Tyler,
- 15:25Speaker 1: I'm more worried that my old man would do if
- 15:28Speaker 1: I didn't bring back my grandpa's rifle. Seventh message Tyler,
- 15:32Speaker 1: He's far scarier than any fed NGL. Eighth message Tyler,
- 15:36Speaker 1: guess I'm just sitting in my car watching reels for
- 15:39Speaker 1: another hour, hoping this guy flocks off. Ninth message, Lance,
- 15:43Speaker 1: are you okay still? Tenth message Tyler, Yes, checking spot
- 15:47Speaker 1: out again now Will. Lance showed FBI special agent laying
- 15:53Speaker 1: additional messages on his cell phone from a social media
- 15:55Speaker 1: app called Discord. In one of the messages that Lance
- 15:58Speaker 1: showed to investigate, the user, Tyler Icam posted, Hey guys,
- 16:03Speaker 1: I have bad news for you all. It was me
- 16:05Speaker 1: at UVU yesterday. I'm sorry for all of this. I'm
- 16:09Speaker 1: surrendering through a share of friend in a few moments.
- 16:13Speaker 1: Thanks for all the good times and laughs. You've all
- 16:15Speaker 1: been so amazing. Thank you all for everything through my
- 16:18Speaker 1: training and experience. Your affient nos at cell phones contain
- 16:22Speaker 1: historical information, including text messages, photographs, device location, information, social
- 16:27Speaker 1: media activity, emails, and videos, among other things. Through my
- 16:33Speaker 1: training and experience, your affient knows that those engaged in
- 16:36Speaker 1: criminal activity who use electronic devices have the same type
- 16:40Speaker 1: of electronic storage data stored on their electronic devices, such
- 16:44Speaker 1: as cell phones. I have investigated many cases war cell
- 16:48Speaker 1: phone forensic searches have turned up valuable evidence including location data, images, video,
- 16:53Speaker 1: text messages, social media posts, and other evidence. In my experience,
- 16:58Speaker 1: those involved in a criminal activity frequently communicate about their ideals, plans, motives,
- 17:03Speaker 1: and even criminal acts, and searches of messaging data often
- 17:07Speaker 1: reveal this evidence. I know that cell phones keep a
- 17:10Speaker 1: historical record of the device's location, text messages and other communications, images, videos,
- 17:15Speaker 1: social media usage, and history websites visited and searches conducted.
- 17:20Speaker 1: These materials can be recovered even if deleted through forensic searches.
- 17:25Speaker 1: Accordingly on requesting authority to seize the cell phone described
- 17:29Speaker 1: and conduct a forensic search using forensic tools such as
- 17:32Speaker 1: Celebrate or other tools used in digital forensics. This affid
- 17:36Speaker 1: David has been reviewed by David Sturgel of the Utah
- 17:39Speaker 1: County DA Office and has been approved for presentation to
- 17:43Speaker 1: the court. Wherefore your affient praise that a search warrant
- 17:47Speaker 1: be issued for the seizure of set items in the daytime.
- 17:50Speaker 1: Application to seal search warrant and related documents. Your affient request,
- 17:55Speaker 1: pursuant to Utah Rule of Criminal Procedure forty, that the
- 17:58Speaker 1: search warrant application an affidavid or other recorded testimony upon
- 18:02Speaker 1: which the warrant is based to include this application for
- 18:06Speaker 1: an order sealing such documents be sealed until March twelfth,
- 18:10Speaker 1: twenty twenty six, for the following reasons pose a serious
- 18:14Speaker 1: impediment to the investigation. This is an ongoing investigation, and
- 18:19Speaker 1: sealing the search warrant will greatly help to preserve the
- 18:22Speaker 1: integrity of the investigation. I declare under criminal penalty of
- 18:26Speaker 1: the State of Utah that the foregoing is true and correct.
- 18:30Speaker 1: This was executed on September twelfth, twenty twenty five, and
- 18:34Speaker 1: was signed by Justin Bowen. All the information that goes
- 18:38Speaker 1: with this episode can be found in the description box.
