- 3:00we normally get. Yes, so that's kind of a big deal. Here.
- 3:06I want to introduce you to Greg Albert. Greg Albert, come on
- 3:12down. I was doing a fat Outbert, I know I was doing a
- 3:15price is right? Can you still do a fat out? Can we still
- 3:16do fat out? I don't know if hey, hey, heyes? Okay,
- 3:20it's Greg Albert. Um. He is suing for one thousand, two
- 3:27hundred and thirty six dollars worth of unpaid electric bills. Okay, he's suing
- 3:30his friend, uh well, former friend, former bandmate and former roommate Levi
- 3:38Prody leave Prody and he's Levi is countersuing for six hundred dollars for damaged property.
- 3:46Are you ready? I'm ready? Uh. Greg and Levi they met
- 3:50three years ago, as most young folks do, at a party, party,
- 3:54a party, and they're doing a little this, doing a little a
- 3:59little dancing, a little a little, a little bit of this, a
- 4:00little bit of that, and they really hit it off because they are both
- 4:04what musicians, Yeah you did us. They're both musicians, and they bonded
- 4:11over their love of music, and they decided, we are going to rent
- 4:14a house together, and we're going to rent a house that has a basement
- 4:18so we can have jam session, jam session the basement. You gotta have
- 4:21a jam. So they started a band, a metal band, A metal
- 4:25band. I don't know if that's met. Um. So they started a
- 4:33metal band together and um. One day, Greg gets home and season envelope
- 4:42from the power company. Okay, an electric bill. I am an electric
- 4:47bill Jing jing jing jing jing zing um and electric Bill was like, hey,
- 4:58uh, your boy leave I owes us over a thousand dollars. Now,
- 5:03yeah, it might be asking together, why does Levi owe a thousand
- 5:09dollars. Well, the way that they set up their renter agreement with each
- 5:15other was that LEVI would pay for one third of the rents okay, but
- 5:18one hundred percent of the of the power of the elector built okay. So
- 5:25that that was so he was responsible for all of it. Now, what
- 5:29he didn't realize when he agreed to this was you're bringing all of these amps
- 5:35and you're constantly jamming. It was a lot of jams, lots of jam
- 5:39sessions, lots uh yeah, um, lots of lots of metal and it
- 5:49was more than he was expecting. Yeah, so he wasn't able to afford
- 5:53it. But it wasn't a thousand dollars for one months it was. It
- 5:55was it was a few months late, built up, built up over time,
- 5:59built up over time. And um, he says, listen, I
- 6:02uh, I went to I went to him and I told him what's up.
- 6:06I asked him for help. Um. But you know it was,
- 6:09you know, ultimately the power was in my name, and so you know,
- 6:14I did the best that I could. I tried, tried. So
- 6:15Greg is sick. So he told Greg, he told he told Greg.
- 6:19Okay, he asked Greg. Yeah, So Uh, Greg is sickness.
- 6:27He's had enough, and so he says, listen, you have until the
- 6:31end of the month to leave. Until then you have to go. You
- 6:36have to move down to the basement because you're not gonna be paying anything.
- 6:40So I'm gonna but you got a month unless your girlfriend comes around and then
- 6:46you gotta leave. Wow, girlfriend was a problem? Is Her name is
- 6:51Marta Marta? And Greg says that Marta uh is extremely annoying and quote has
- 6:59the most annoying voice I've ever heard. Oh wow, Yes, just a
- 7:03voice issue. Greg seems a little bit bigger. So Marta is here.
- 7:09Yeah, her voice not that annoying. She is very uh excitable. She's
- 7:15excitable, and you've only eight minutes, so I've spent less than that.
- 7:20She's only on the stand for him. If you spent less than a minute
- 7:25with her and you're like, oh, she's she trumps two profanities of the
- 7:30thirty seconds that she talks, and Judge Faith tells her to sit down.
- 7:32And it's not like she's angry, she's just talking but can't and so um,
- 7:39she says, listen, Um, I'm not the problem. Greg's girlfriend's
- 7:44the problem. Greg's girlfriend pete on Levi's and Haler. We now we don't
- 7:49get any more information. We don't get any more throw out pete on it
- 7:55in Haler and I get nothing else because she didn't say pee. She said
- 7:58the other pe word for pe for urine, piss, yes, And that's
- 8:01not allowed in Judge Faith's courtroom. And so she tells her to go ahead.
- 8:05That's pity and on the middle school kids to apologie because I said the
- 8:09word. Yeah. Sure, um. And so that's all we get from
- 8:15Marta, okay, thank you. So here's the thing. So, uh,
- 8:20Greg tells Levi leave, don't leave whatever, but go. You gotta
- 8:24go down to the basement to day. And um, Levi is like,
- 8:28listen, it's it's moldy down there. It's a basement. And all of
- 8:33my stuff, my bad all of my possessions yet really moldy. They got
- 8:39moldy. And they go, yes, his bad, so his bad clothes,
- 8:45picks or anything. We don't have any pics of that. But what
- 8:48we do have picks of is another thing that he says was destroyed, and
- 8:52that was a guitar, an electric guitar, which is in shambles down there
- 8:56every night now uh, He's says Greg destroyed it, and Greg's says,
- 9:03yes, it wasn't the mold, it was Greg. It was Greg.
- 9:05It's in shambles, it's in three pieces, okay. And Greg says,
- 9:09yes, I did destroy his guitar, but it wasn't until two months after
- 9:16he left. He left the guitar there, and so I destroyed it.
- 9:20And Judge face like, why did you destroy He's like rock and roll,
- 9:24everyone wants to destroy a guitar. This is the perfect opportunity. Oh my
- 9:28gosh, and so uh he says, you know, it was until two
- 9:31months after. So clearly he didn't want the guitar anymore. It was a
- 9:35perfect opportunity to destroy a guitar, and so I smashed it. I thought
- 9:37it would be fun and it was. And Judge Faith is ready to rule.
- 9:41Wow, well, clearly he owes the power bill. I mean that
- 9:46is there a written agreement anywhere for this? They don't say, but they
- 9:48all seem to be the same. But nobody's arguing whether or not. I
- 9:54think that's easy the guitar. So does Greg owe anything to leave I six
- 9:56hundred dollars from damage? Do we have the the price of the guitar.
- 10:01We don't. It's just a six hundred dollar lump. Some I think it's
- 10:03a no. I think Gregor's gets off Scott Free. You just twelve thirty
- 10:07five six coming his way. You are one hundred percent got a rack coming
- 10:11out exactly right. One for one, Judge Faith says listen, Levi,
- 10:16Um, you were faced with a decision to leave or to go down to
- 10:20the basement. You chose to go under the basement there for the mold is
- 10:24it's yours. That was something you chose, you brought upon yourself. You
- 10:28abandon the guitar by it's nothing, you know whatever, No money for you,
- 10:37You owe all of it for the judge Faith, she is, she
- 10:41is down down the line I'm talking about. I love her. It's great.
- 10:46Um, I can't wait to get to Oh. I love personal entry.
- 10:50Quinn bring it, Mary Sad. We're gonna take a quick break.
- 10:52We'll be right back here on you'll gavel Cavil out of our best. But
- 11:03it's new. We're getting the new buttons. That's right, diving in.
- 11:07Uh here's the thing, not my buttons. Why we're really doing it?
- 11:13Fifty pussycat dolls, some crazy guitar thing diving in Steven Curtish man, we're
- 11:20really we didn't do Yeah, it was just but I said it pre show
- 11:24but I said it still just okay, whatever, not important. What is
- 11:28important is the personal injury court. Let me tell you about who Judge Gino
- 11:33is dealing with. Get into that legal sauce. Patricia McGuire is our plaintiff.
- 11:37Lizzie McGuire, not Lizzie. Patricia dale Brooks is our defense. Dale
- 11:45Brooks, Patricia McGuire is dale Brooks a good old boy. No he's not.
- 11:50He is. Uh, he is a seems like he's got a tie
- 11:54on, he's been a well, we'll get to him. He's not a
- 11:56good old boy country hic dude at all um bale brook He sounds like one
- 12:01old dale Brooks. Patricia is suing for three hundred thousand dollars for injuries received,
- 12:09two hundred thousand dollars in future medical and one point five million dollars in
- 12:15pain and suffering totally possible, totaling two million dollars. That is what she
- 12:22is suing for. Two mill Wow. I didn't know you could. I
- 12:26thought there was a limit on pain meaning but it's Now this is real,
- 12:31This is real life, this is happening. Two mill baby, that's what
- 12:35we're talking about. So let's dive in for two million dollars, real people,
- 12:39this is uncanny. Patricia McGuire is a musician. She plays the bass
- 12:46and the ukulele for her indie band. She has pictures of her playing with
- 12:50her band. Her band is her livelihood, she says, indie band.
- 12:54But that's because they're not signed. But that is how she makes money.
- 12:56She does not another job. It is her full time job. Gino says
- 13:00he plays a little bit of saxophone and she said, you should join the
- 13:03band. They do a little banter ah um. She says. I was
- 13:07on tour for three months with my band. We were traveling the country,
- 13:11playing gigs every night, mostly bars and just small venues. But it may
- 13:16you know, it pays the bills. And while I was gone, I
- 13:18hired mister Brooks to build a top of the notch, top notch, top
- 13:24of the shelf, whatever, top of the notch, not just top notch.
- 13:26You get to the top of that note, you said. You go
- 13:31and you're like, hey, can I get a top notch? That's that's
- 13:33how much top of the notch gonna cost it, It's okay, Uh,
- 13:37a top notch recording studio in her second floor in her bonus room. Basically,
- 13:41she has a two story house, but she wanted the entire second floor
- 13:45of the house to be a recording studio. So um I hired him to
- 13:48build it. UH. Three months go by. I get home. I'm
- 13:52excited to go in and see this uh studio when I return. And before
- 13:56she goes any further, Gino turns and says, mister Brookes te us a
- 14:00little bit abou your credentials. All right, he said, I've been in
- 14:03construction twenty five years. I've had my own remodeling business for most of that
- 14:07time. In my estimation, this job was going to take in between three
- 14:09and a half to four months. We fell a little bit behind. It
- 14:11was not done. It is what it is classic. But I'm a professional.
- 14:16I do things the right way. He says that. So he goes
- 14:20back and says, all right, miss McGuire, tell me what happened,
- 14:22and she says, I walked through my house when I got home. I
- 14:24go up the stairs and I see there's still a drape. It's still a
- 14:28construction site. I opened the drape up. As soon as I opened the
- 14:31drape up, I stubbed my toe. I've been down to check on my
- 14:37toe because it hurts. And then I lift my head up and immediately bump
- 14:41into something. I don't know what it is, but I bump into something
- 14:45and I feel an excruciating pain in the right side of my head. It
- 14:50is unbelievable how much pain this is. So she she goes, she opens
- 14:54up a drape. She comes through that like the cloth whatever. So she
- 14:58subs her toe, bends down, comes back up, and then right something
- 15:03is there that maybe wasn't before, or just the side of her head.
- 15:07We don't know anything else. And she said, she said, I thought
- 15:09I was having a stroke. I call nine one one. I pass out
- 15:11on the nine one one call. I wake up in the hospital bed and
- 15:16the doctor there is there to tell me that a three inch galvanized nail has
- 15:22pierced my skull. Uh. It is gone through her behind the optic nerve,
- 15:31through her temple, behind the optic nerve, and into her skull.
- 15:37They have the X rays. It's a giant nail right here on the X
- 15:43rays. She has where did it come from? She has I'll get there,
- 15:48okay, nine one one, call that. Literally, she says,
- 15:52I'm in pain. I'm in pain. You need to help, and then
- 15:54she's done. She blocks out nothing else. She has picture of a lot
- 15:58of blood on the floor everywhere. Buckets. Uh. I don't know if
- 16:03there's buckets or not, but yeah, um, it's a We turned to
- 16:07mister thank you. Uh. We turned to mister Brooks. He said,
- 16:11it's a galvanized industrial strength nail. It came from a nail gun that was
- 16:15on the construction site. Um. That that's all I can to I wasn't
- 16:19in the room. I can't tell you how she got the nail gun to
- 16:22fire or anything like that. But that's that's where where it came from.
- 16:26Uh. A nail gun, Yes, an industrial strength nail gun, galvanized
- 16:30steel three inch nail. So, mister Brooks, what tell us you're yeah,
- 16:37it came from a nail gun. That's where it came from. Nail
- 16:38gun. And it was this angle right here. Did she hear anything No?
- 16:45Um, she but stubs her toe, leans down, gets up and
- 16:48the nail gun comes through this way. That's what we got. So we
- 16:53asked mister Brooks, what what's going on here, And he says, I
- 16:56pulled up to the house, and when I said to the Cabby, smell
- 17:03you later. And once we got that out of the way, said,
- 17:04I pulled up the house, I saw miss McGuire scurrying in a in a
- 17:08big hurry, and I we had a meeting, and and so I got
- 17:14my and so so I was like, she must have to really go to
- 17:17the bathroom or something. I got my stuff together. I walk in the
- 17:19house, I walk up the stairs, and I immediately see her on the
- 17:23floor. I see the blood. She's passed out. I'm terrified. I
- 17:27call nine one one immediately. I'm freaking out. You gotta get over here
- 17:30quickly. You got even know I give it. We don't, but we
- 17:33have hers and they ask her for the address, and she's out cold.
- 17:37So we don't know that his nine one one call saved her or not,
- 17:41but she he was trying to help her, and and and Gena says,
- 17:45do you feel bad for me? And she's wearing a full rap and an
- 17:48eye patch. UHO always wants to know they feel bad. Do you feel
- 17:52bad? And he's like, I feel really really bad for her, Like
- 17:55I like, this is awful like, I can't believe it happened. Uh,
- 17:59And he said, so, why is this not your fault? He
- 18:00said, well, first of all, you should never go to an construction
- 18:03site by yourself. But but we had a meeting scheduled in the garage at
- 18:10one thirty. I have text messages to prove it. He hands Gina the
- 18:14text messages, and sure enough, my flight gets in at noon. Great,
- 18:18meet me in the garage at one thirty. She says, yes,
- 18:22I will meet you in the garage at one thirty. And he says,
- 18:25here's why this is important. We were going to look over some paperwork.
- 18:27We were gonna make sure she was happy. Then we were going to head
- 18:32upstairs and together I was going to navigate her through the construction site. That
- 18:36way, she would not have injured herself. If she followed my instructions,
- 18:40then she would be perfectly safe. And not only did she not follow my
- 18:44instructions, she was early. She wasn't there at one thirty. She was
- 18:47early in the one thirty. It is her house. She's allowed to be
- 18:48early, but she didn't follow my instructions. Judge Gino said, miss McGuire,
- 18:53did you agree to that meeting? Yes, I agreed to the meeting.
- 18:56I was a bit early. I didn't think I needed No one told
- 19:00me I needed guidance to go through a construction zone. I mean, no
- 19:03one told me that. He wasn't clearly, he can't tell me that.
- 19:07And I thought he was already there. I thought he was already up there.
- 19:10I thought he wasn't in the garage, And so I went up there
- 19:11to meet him, and he said, did you not see a car out
- 19:15front? She said, well, I don't know what kind of car he
- 19:15drives, but there was no car in the driveway. So now, uh,
- 19:21He says, do you take any personal responsibility for your injuries? Miss
- 19:23McGuire, She says, no, I don't make any I was not made
- 19:26aware of any dangers of the site whatsoever. And he says, so,
- 19:30tell me about this two hundred thousand dollars of future medical She was aware though,
- 19:33that it was still under construction. Well, it wasn't a surprise to
- 19:37her. She saw, then they're gonna be pictures that come in a little
- 19:41bit later that would make it obvious that the job is not okay. But
- 19:45you know, if you yeah, you could see the cloth and be like,
- 19:48oh, maybe they left it. Yeah, but when you shop sircase
- 19:51that's still not finished outside of the out there. Okay, it's obvious that
- 19:55there's still Okay, So he says, tell me about this two hundred thousand
- 19:57dollars medical future medical. He says, I understand the three hundred thousand dollars
- 20:00medical. Two hunder kay future medical. And she says she has to have
- 20:04therapy for her for to see. Yeah, she's not They said she probably
- 20:10won't ever see in the right eye again, but retraining her eye. She
- 20:15currently can't play any music if you can only see it. If you're you
- 20:18know, you live a lot of your life with Yeah, double eyesight.
- 20:21Losing one eye give you headaches, Yes, it affects a ton. Yeah,
- 20:26so headaches, optic nerve therapy, and then she can't play her instrument
- 20:30right now, she's currently just hemorrhaging money because she can't play her instrument because
- 20:34it's impossible for her to concentrate visually on things, and so that is costing
- 20:38her money. She can't calculate. It's her entire livelihood that she can't do.
- 20:44The doctor says, this is the pain and suffering is what we're into
- 20:47now. The doctor says, she probably will never have a sight in her
- 20:51right eye again, doesn't know when she'll be able to play again, and
- 20:53so she she thinks her livelihood is completely gone. Her eye coincidentally, will
- 20:59look normal. She may have a scar there, and she says, right
- 21:03now, the scar's nasty, but her eye will look normal. If you
- 21:06look at her, it will look like she has two functioning eyes because it
- 21:10just pierced the optic nerve and it didn't mess with the actual movement or the
- 21:12color or anything else of the eye. So goes back to mister Brooks.
- 21:18He says, look, I feel terrible this happens. I've been in construction
- 21:19twenty five years. I've never had anything like this happened. But I need
- 21:23you to understand. She also wasn't properly dressed to go on the work site.
- 21:27She wore flip flops, which you never do on a work site.
- 21:30And there at the door of the construction site there is a bin of safety
- 21:37equipment that everybody that works there has to have on. There are hard hats,
- 21:41there are vests, there are glasses, there are gloves, anything you
- 21:47need to put on. And if she had just waited, we would have
- 21:49gone through all those steps together, she would have never entered it alone.
- 21:53I don't want this to happen, but I also can't take responsibility for someone
- 21:56entering a work zone without being properly, you know, dressed to be in
- 22:02a work zone. It was a recipe for disaster. Gena says, did
- 22:06you see the bin of equipment? She said, I didn't see it.
- 22:07There is a picture, it's there. There's a picture of the staircase is
- 22:11clearly they're still working. And why would you even climb the staircase with flip
- 22:15flops on? I don't know. So he the court hired an independent contractor
- 22:19to come out and talk about nailguns, and he describes a nailgun and what
- 22:25it does. It's super boring. But then he shows a video of the
- 22:27nailgun that the same model nailgun that was used on the site, and it
- 22:33pierces directly through a hard hat. So basically to prove that was gonna be
- 22:37my my question was gonna be what a hard hat of helped? So he
- 22:41asked this guy, Geno asked this guy that, and he says, wearing
- 22:45this equipment naturally helps. It's good to do, but a nailgun to the
- 22:49head would not be protected by a hard hat. Do we ever get to
- 22:52the bottom of how it fired? No, we do not. We get
- 22:56her version of the story, and that is the only version we get.
- 22:59Stub my toe down, bit back up. Immediately something hit me and I
- 23:02felt excruciating because in order for a nail gun to fire, you it's a
- 23:06trigger, it's a it's a it's a it's a gun, right, a
- 23:10nail gun. Yeah, okay, yeah, So we don't get to the
- 23:12bottom of that. So uh at this point, Judge Gino ready to rule
- 23:18three hundred k passed two hundred k future one point five pain and suffering a
- 23:22total of two million dollars. Well, in order you know, for um,
- 23:29what's his name, Dean Dean cast Dale Brooks, Dale Dale Brooks.
- 23:33In order for dale Brooks to be found uh guilty, so to speak,
- 23:37and this, they have to be able to prove that he was negligent and
- 23:42that he uh you know, didn't take the proper precautions for safety. And
- 23:49it seemed to me it seems like he did, you know, he wanted
- 23:56to have this meeting, he wanted to be there. She rushed ahead,
- 23:59she went through the cloth, She did all she didn't put on the safety
- 24:03equipment that he says is right there, and so it seems like he did
- 24:07everything that he could to make sure that something like this wouldn't happen. But
- 24:11if you have, if you ignore all of the safety clues around you,
- 24:18and you get hurt, I don't know if I don't think that's Dale's fault.
- 24:23And so you know what, I'll give her. I'll give her something
- 24:27because you know, I don't know. Actually I'm not. I'm not gonna
- 24:33give her anything. I'm not gonna give her anything, and I know I'm
- 24:34gonna be wrong. Yeah, So I'm with you on this one hundred.
- 24:40Judge Gino is not I feel I love Personal Injury Court, but I feel
- 24:45that Judge Gino plays to the crowd and the sympathy and the emotion and not
- 24:48the law. Because look, I feel really bad for this girl, but
- 24:52this is on her in my opinion, Like I was very strongly like this
- 24:56construction. Dude is a stand up dude, and he has everything to prove
- 25:00it. His papers are orderly, like he is not a guy that's trying
- 25:03to trick anyone. And Judge Geno says, um, mister Brooks, you
- 25:10tried to do what was right. This still happened. The plaintiff must prove
- 25:15that the defendant's wrong caused the injury. I do believe that the plantiff has
- 25:19proved that it was at least some the defendant was somewhat negligent, and partly
- 25:25response, how how did she prove that? What's something that he did?
- 25:30He never that's that's wrong, Genever, you know it's wrong. It is
- 25:34wrong. He never explains why. But then he looks at her and says,
- 25:37but you are also very much responsible as well. I am basically award.
- 25:44I'm saying that you are forty nine percent responsible and the defendant is fifty
- 25:48one percent responsible, which works out to one million and twenty thousand dollars awarded
- 25:56to the planiff. She's an instant millionaire. She's crying in the courtroom,
- 26:02one out of one eye. Who knows. It's unbelievable. And as much
- 26:07as I love the personal injury court, it drives me crazy that it's just
- 26:11like, I feel bad for her, but the percentage game is such a
- 26:17so ridiculous what however you're feeling that day? G You know, like Fortin,
- 26:25she's only responding, He's only is he responsible. She's responsible for only
- 26:30so you're saying he is more than a half Yes, responsible. Yes,
- 26:34that's wrong. And at the end of the day, the most important thing,
- 26:40and the biggest crime of this is that we don't get to the bottom
- 26:42of how the gun shots the nail. It takes pressure, it takes pressure.
- 26:49There's something, there's something fishy here. Yeah, I agree, she
- 26:55shot herself. I think she fell into it. And like the gun has
- 26:57a thing where if it pushes in, it pops back out, you know
- 27:00what I mean, Like Neil guns on automatic. Yeah, but if he
- 27:03left it on that setting, I mean you could maybe argue I was.
- 27:07I was not happy, but I was happy to have the case. Great
- 27:10case, great case. We gabbled hard, I mean good. I mean,
- 27:12she's a millionaire now, so yeah, good for her for her.
- 27:15Not af your taxes though, Patricia, good luck. Hey, welcome to
- 27:19the uh you know, next tax bracket? Am I right? Everyone?
