- Hey there, and welcome to VoraPrep Audio. Let's start with a situation. Imagine a client you've worked with for years. They're finally ready to retire. They have a two-million-dollar nest egg ready to go. They come to you and say they want to put all of it into a single private placement. And it's one you happen to be selling. The commission for you would be huge. Maybe even life-changing. But you know this investment is illiquid. It's far riskier than anything they've been comfortable with before. So, what do you do? This isn't just a tough hypothetical. It's the kind of scenario that tests the foundation of your career. Specifically, your career as a CERTIFIED FINANCIAL PLANNER™ professional. The CFP. Board's Code and Standards give a very clear answer. Understanding these rules isn't just about passing the exam. It's about protecting your clients. And it's about protecting your own ability to practice. The single biggest idea to internalize is the expanded fiduciary duty. This is the bedrock of the standards. As a CFP professional, your duty to act as a fiduciary applies at all times. That's whenever you're providing Financial Advice to a Client. All times. This isn't just for formal, comprehensive financial plans. It's always. Think of it like a doctor's Hippocratic Oath. The first rule is to do no harm. And to always act in the patient's best interest. For us, that's the fiduciary standard. It's the highest standard of care in the profession. It is non-negotiable. This one big duty is made of three specific duties. First is the Duty of Loyalty. This one is simple. You must put your client's interests above your own. And you must put them above your firm's interests, too. This means you can't use the client relationship to enrich yourself at their expense. In that opening scenario, the massive commission can't be part of your decision. Not at all. Your loyalty is to the client and their retirement. Not to your own payout. Next up is the Duty of Care. This means you have to act with the care, skill, and diligence of a prudent professional. You have to do your homework. You need a reasonable understanding of your client's situation. This allows you to give advice that's not just suitable, but truly in their best interest. It means you're not just winging it. You are applying real expertise. And the third piece is the Duty to Follow Client Instructions. Now, this one has a big condition. You must follow all reasonable and lawful client instructions. If a client asks you to rebalance their portfolio according to their plan, you do it. But what if they ask you to help them hide assets from the IRS.? That's neither reasonable nor lawful. So you don't do it. Your Duty of Care and your duty to the law come first. These duties all come from a set of core principles in the Code of Ethics. Think of these as the 'true north' for how a CFP professional should behave. It's not a checklist; it's a mindset. It starts with personal character. You must act with honesty, integrity, competence, and diligence. Basically, be a professional people can trust to know their stuff and do the work right. It also includes exercising due care, which we just discussed. Then there's the heart of it: acting in the client's best interests. This also means managing your conflicts of interest. You have to either avoid conflicts or fully disclose them. And if you disclose them, you must manage them in a way that favors the client. You can't let a sales contest or a higher payout sway your recommendation. Not if a better, lower-cost option exists for your client. That would be a breach of sound and objective professional judgment. Finally, it's about protecting the client and the profession. This means maintaining confidentiality. What's said in your office stays in your office, unless required by law. It also means acting in a way that builds trust in our profession and in the CFP marks. One of the biggest trip-ups on the exam is the difference between two standards. There's the 'suitability' standard, and the CFP. Board's 'fiduciary' standard. 'Suitability' just means an investment is appropriate for someone. But the fiduciary standard is much higher. The advice must be in the client's best interest. Many investments could be "suitable." But only one or a few will be the best choice. A CFP professional is always held to that higher, best-interest standard. Ethics questions on the exam often present scenarios with a few different things going wrong. Your job is to identify the most important violation. Is it a problem with loyalty? Is it an issue of competence? Read the question carefully. Find the biggest ethical fire you need to put out. Remember, the Fiduciary Duty is your constant guide. It applies at all times when you give financial advice to a client. Keep its three components in mind: Loyalty, Care, and Following Lawful Instructions.
