- 0:03Speaker 1: This is a Bramble Jam podcast.
- 0:13Speaker 2: This week on Yo Gabble Gabble, if your friend's son
- 0:16Speaker 2: comes over and gets injured at your pool, do you
- 0:19Speaker 2: have to pay for it? Welcome to my nightmare. Judge
- 0:21Speaker 2: Gino tells us.
- 0:23Speaker 1: If you borrow your buddy's drums and they get stolen
- 0:26Speaker 1: while you're out getting drunk, you got to pay for
- 0:29Speaker 1: the replacement.
- 0:30Speaker 3: Judge Rinder tells you. Real cases. Fake justice.
- 0:33Speaker 2: This is Yo Gabble Gabble.
- 0:37Speaker 3: Hello. Hello.
- 0:41Speaker 1: Hello.
- 0:42Speaker 3: Sit down.
- 0:43Speaker 2: Sit down. All right.
- 0:46Speaker 3: Sit down, everybody.
- 0:48Speaker 1: It's great to be here today on another episode of
- 0:49Speaker 1: Yo Gabble Gabble, a very simple program for those of
- 0:52Speaker 1: you that are joining us for the very first time.
- 0:55Speaker 1: First of all, thanks for joining us.
- 0:56Speaker 2: Thank you.
- 0:57Speaker 1: Happy you finally found us. There's quite the back catalog
- 0:59Speaker 1: for you to get to. But also, here's the show.
- 1:02Speaker 1: It's very simple. I watched a TV courtroom case. I'm
- 1:07Speaker 1: going to tell my buddy Dan all about this case
- 1:09Speaker 1: that he did not watch. He's going to try to
- 1:11Speaker 1: guess the verdict. And guess what? We're going to flip it.
- 1:14Speaker 3: Reverse it.
- 1:14Speaker 1: He's going to do the entire thing for me, and
- 1:17Speaker 1: I'll try to guess that verdict. And that is why
- 1:18Speaker 1: we call it Yo Gavel Gavel. It's not just called
- 1:21Speaker 1: Yo Gavel. No, it's called Yo Gavel Gavel. That's the
- 1:24Speaker 1: key there. We have no new reviews, which is unfortunate.
- 1:27Speaker 1: That is okay. Dan, I am excited today because a
- 1:32Speaker 1: while back, this was maybe years ago at this point,
- 1:37Speaker 1: I found... a case on YouTube by a British judge
- 1:42Speaker 1: named Judge Rinder.
- 1:44Speaker 3: Judge Rinder. And I found him to be very fun.
- 1:46Speaker 3: And then we didn't have the end of it. Didn't
- 1:47Speaker 3: have the end of it.
- 1:48Speaker 1: Yeah.
- 1:48Speaker 3: And then, like, I just couldn't find him anywhere.
- 1:53Speaker 1: I found out there are a lot of episodes on
- 1:57Speaker 1: the Amazon Prime, the Prime Video.
- 1:59Speaker 3: Oh, Prime Video coming in clutch. Just waiting there for us.
- 2:02Speaker 3: Would you look at that? So I decided to dive in.
- 2:04Speaker 3: Season one, episode one of Judge Rinder. You're just the pilot.
- 2:08Speaker 3: Out the gate. Pilot boy. Pilot boy. Let me hear
- 2:11Speaker 3: about it. They only do first names in John Fender's case.
- 2:15Speaker 3: I love that so much. Charles is suing Seamus for 1,000 pounds. Seamus, 1,000 pounds.
- 2:23Speaker 2: Lift him. Lift him up. Lift him up. Weightlifting is
- 2:27Speaker 2: what you're talking about. Yes.
- 2:29Speaker 3: A thousand pounds. A thousand pounds.
- 2:32Speaker 1: Charles and Seamus were friends in a band together. They
- 2:36Speaker 1: did pop covers.
- 2:37Speaker 3: Pop covers.
- 2:37Speaker 1: Maybe you've heard some of these bands at different gatherings, weddings,
- 2:41Speaker 1: et cetera.
- 2:42Speaker 3: Used to be in a cover band called Brandon and
- 2:43Speaker 3: the Books.
- 2:44Speaker 2: Yep.
- 2:44Speaker 3: The Books.
- 2:45Speaker 2: Can't judge a book by their covers. Well, that's because
- 2:47Speaker 2: it's cover. It was really good. It's a really good
- 2:50Speaker 2: title for... for a name of a band.
- 2:53Speaker 3: Yeah, we would sometimes do originals. And they weren't as good.
- 2:56Speaker 2: And I'm not saying that they were bad. I want
- 2:58Speaker 2: to be very clear, because I went, I was a
- 3:00Speaker 2: brain in the books, bookie. I was a book, booksy.
- 3:03Speaker 3: Booksy. I saw you play a number of times.
- 3:05Speaker 1: Sure.
- 3:05Speaker 2: A lot of times at fall festivals. I saw you
- 3:08Speaker 2: play at a bar, a coffee bar downtown.
- 3:10Speaker 3: A coffee bar.
- 3:11Speaker 2: And it's not that the originals were bad. It's that
- 3:14Speaker 2: when you can, you slam the covers so hard, it's
- 3:18Speaker 2: tough to transition.
- 3:19Speaker 3: Do you know what I mean? I understand. I understand.
- 3:23Speaker 3: I don't like doing covers.
- 3:24Speaker 2: I know. And you were in the front of a
- 3:27Speaker 2: band that did covers.
- 3:29Speaker 1: That's a tough spot to be in. Anyway, Judge Rinder
- 3:33Speaker 1: asks why they're in a band. Seamus says to entertain people.
- 3:37Speaker 1: Rinder says, is there any other reason that you would
- 3:40Speaker 1: be in a band? Seamus does not answer this question.
- 3:44Speaker 1: Rinder says, it's okay. I can be quite frightening. And
- 3:47Speaker 1: Seamus shakes his head yes.
- 3:49Speaker 3: Okay. There you go.
- 3:51Speaker 2: Fun.
- 3:51Speaker 3: What you need to know about Render is... He's a joker.
- 3:54Speaker 3: Very silly man, but takes the law very seriously. Okay.
- 4:00Speaker 3: So they broke up after the summer. Charles and Seamus
- 4:03Speaker 3: no more.
- 4:04Speaker 1: Charles and Seamus no more. Charles was heading to uni.
- 4:08Speaker 2: Uni?
- 4:08Speaker 3: Heading to uni. Oh, good for him. Got to go
- 4:11Speaker 3: some ways for uni.
- 4:13Speaker 1: So Render asks, okay, so when you bought the drum set,
- 4:17Speaker 1: how much did you buy the drum set for? He says,
- 4:20Speaker 1: I bought it for 1,200 pounds. He's suing for 1,000 pounds.
- 4:25Speaker 3: More on that later.
- 4:26Speaker 1: At some point, Seamus asks Charles to borrow his drum kit.
- 4:32Speaker 1: Not just his kit. That would be a soccer uniform.
- 4:36Speaker 1: Borrowing his drum kit.
- 4:38Speaker 3: Drum kit.
- 4:39Speaker 1: That's for those of you out there. You can put
- 4:41Speaker 1: your kit on. And he says, going to play a
- 4:45Speaker 1: show with a new band. We see this text message.
- 4:49Speaker 1: Render is thrown for a loop when he sees that
- 4:52Speaker 1: Seamus called Charles dog, D-A-W-G.
- 4:58Speaker 3: He's like, why did you call him dog? Why did
- 5:00Speaker 3: you call him dog? It's a back and forth there.
- 5:02Speaker 1: He's also thrown for a loop when he says, can
- 5:05Speaker 1: I borrow your drum set, LOL? He's like, I'm sure
- 5:09Speaker 1: you have a very interesting, and sophisticated brand of humor.
- 5:15Speaker 3: But I don't know why. There's an LOL at.
- 5:18Speaker 2: The end of this. I like Judge Rinder.
- 5:19Speaker 3: I've not seen him. He's a funny guy. You've got
- 5:21Speaker 3: to watch Judge Rinder.
- 5:22Speaker 1: So he specifically asks to use the snare and the cymbals.
- 5:28Speaker 3: Turn up my snare. Just snare drum, just assembles, no toms.
- 5:33Speaker 3: Doing some rim shots. No toms. Okay. Charles says, yes,
- 5:39Speaker 3: as long as you take care of them. Okay. So
- 5:44Speaker 3: they go to this gig, right? Plays the gig.
- 5:48Speaker 1: After the gig, they put the drums in the back
- 5:52Speaker 1: room of this bar.
- 5:54Speaker 3: Okay.
- 5:55Speaker 1: Yep.
- 5:56Speaker 3: And, uh, that's where they're going to store the drums
- 5:59Speaker 3: for the night. Okay.
- 6:01Speaker 1: He, uh, render asks if the door was locked. He says,
- 6:04Speaker 1: he's not sure, but trusted the bar staff when they
- 6:07Speaker 1: said that you can put the drums back here.
- 6:09Speaker 3: And there'll be fine.
- 6:10Speaker 2: Okay.
- 6:11Speaker 3: Render says, so, uh, then I'm assuming you drank. You
- 6:16Speaker 3: went and partied?
- 6:16Speaker 2: Yes.
- 6:17Speaker 3: He says, yes, I went and partied.
- 6:20Speaker 1: But I don't believe that I did anything different than
- 6:23Speaker 1: what Charles would have done that night after a gig.
- 6:26Speaker 1: As somebody who's played gigs with him, you play the gig,
- 6:28Speaker 1: you put the stuff away, get some drinks, okay? So
- 6:33Speaker 1: what he ends up doing is he leaves the establishment, right?
- 6:40Speaker 3: Without the drums. Without the drums to go party. Got it.
- 6:43Speaker 3: Some further.
- 6:44Speaker 1: Comes back the next day to discover that the drums
- 6:48Speaker 1: are nowhere to be found.
- 6:51Speaker 3: And the bar staff does not know. Little help here.
- 6:56Speaker 2: Oh, boy.
- 6:57Speaker 3: Bar staff does not know where they are.
- 6:58Speaker 2: Uh-oh.
- 6:59Speaker 1: Uh-huh.
- 6:59Speaker 3: Uh-oh.
- 7:01Speaker 1: Rinder asked if he filed a police report, and he said, no,
- 7:03Speaker 1: I didn't want to get the police involved. And he says, okay.
- 7:07Speaker 3: All right. Now you owe him money. Well, you get
- 7:10Speaker 3: the police involved, and then they're looking, and then they know.
- 7:12Speaker 3: Then they know.
- 7:13Speaker 1: If they find drums, they know. Here's someone who lost them.
- 7:19Speaker 1: Maybe they are yours. So he then asked Charles about
- 7:23Speaker 1: the amount. It is clear what he's asking for is
- 7:25Speaker 1: less than what The full kit is worth, and he
- 7:28Speaker 1: says that he thinks that that is the amount that
- 7:31Speaker 1: just the snare and the cymbals would be.
- 7:32Speaker 3: So that means the rest of the kit is only
- 7:34Speaker 3: 200 pounds. Bass drum toms, $ 200. I don't know about that.
- 7:39Speaker 1: But anyway, Seamus says he doesn't believe that he acted
- 7:42Speaker 1: different than any other reasonable person. Done with the thing,
- 7:45Speaker 1: storm away, made the bar that you're at, we'll take
- 7:48Speaker 1: care of it.
- 7:49Speaker 3: Good to go. Rinder says, you really think the bar
- 7:52Speaker 3: staff is to blame? He says, yes, I do.
- 7:56Speaker 1: He asks about their friendship, and friendship is under quite
- 8:00Speaker 1: the strain. They have tried to remain friends, but Seamus
- 8:04Speaker 1: says at any time he hangs out with Charles, and
- 8:09Speaker 1: he gets by something like a drink or a snack
- 8:12Speaker 1: or something, Charles will be like, well, where's my money? Yeah.
- 8:16Speaker 3: Do one of those numbers. Yeah. You got money for
- 8:18Speaker 3: a snack. Don't have money. That's the worst person. That's
- 8:21Speaker 3: the worst person. I don't think they're doing very well.
- 8:24Speaker 3: I don't either. Judge Rinder, is that your rule?
- 8:26Speaker 2: So this is an interesting one because it's if you
- 8:28Speaker 2: lend something or do they now take responsibility for it?
- 8:33Speaker 2: I do think we've had cases of similar ilk before.
- 8:35Speaker 2: I think the fact that he said take care of
- 8:39Speaker 2: it and there clearly was a lack of trying to
- 8:42Speaker 2: take care of it. He's got to owe him some money.
- 8:44Speaker 2: I don't know if $ 1, 000 is it, but he's got
- 8:46Speaker 2: to owe him some. I don't know how Judge Rinder rules.
- 8:48Speaker 2: I don't know what kind of verdicts he renders, but
- 8:57Speaker 2: I would say give him all the money.
- 8:58Speaker 3: Give him all the money. Judge Rinder says.
- 9:03Speaker 1: When you borrow someone from somebody.
- 9:06Speaker 3: Someone from somebody. Something from somebody.
- 9:08Speaker 2: If you're borrowing a person from someone, you need to
- 9:11Speaker 2: not lose that person.
- 9:12Speaker 1: Yes.
- 9:13Speaker 3: Same is true with items.
- 9:14Speaker 2: Okay.
- 9:15Speaker 3: If you are borrowing.
- 9:16Speaker 1: Something from someone, you have a duty of care to
- 9:20Speaker 1: look after that thing.
- 9:21Speaker 3: I love it.
- 9:22Speaker 1: It was your duty of care to look after this
- 9:25Speaker 1: drum set. You cannot pass on that duty of care
- 9:29Speaker 1: to someone else. Uh, you say that you did everything
- 9:33Speaker 1: reasonable to look after them. The problem is, uh, the
- 9:38Speaker 1: bar doesn't know Charles. They don't, they did not, they
- 9:42Speaker 1: did not say yes to borrowing the drums.
- 9:45Speaker 2: Nope.
- 9:46Speaker 3: Um, they didn't say that they could store them for you.
- 9:48Speaker 1: And if you had brought someone here and you wanted
- 9:51Speaker 1: to sue them, maybe I would hear that case. But
- 9:55Speaker 1: as it is, you borrowed the drums, you lost the drums, uh,
- 10:00Speaker 1: You did not return them as soon as possible. You
- 10:03Speaker 1: went out drinking. And so you failed your duty of
- 10:05Speaker 1: care 1,000 pounds. You stole fizzy lifting drinks. That's exactly right.
- 10:10Speaker 1: Judge Rinder, it doesn't sound like a fun case.
- 10:14Speaker 3: Judge Rinder makes it fun. I can't wait to watch.
- 10:16Speaker 3: Judge Rinder is a good time. Uh, Dan, two times
- 10:19Speaker 3: from now, I'll do it.
- 10:20Speaker 2: Okay.
- 10:20Speaker 1: Yeah.
- 10:20Speaker 2: Uh, I'm going to personal injury court.
- 10:23Speaker 3: Right. This, this is a fun one brain. This is
- 10:26Speaker 3: a fun one. And you know, judge, you know, is
- 10:28Speaker 3: I'm ready to be mad.
- 10:31Speaker 2: Uh, we have Sally Baxter suing Julia Baxter suing Julia Soriano.
- 10:39Speaker 1: For $ 500, 000.
- 10:39Speaker 3: Oh.
- 10:41Speaker 2: 100,000 past medical, 100,000 future medical, 300,000 pain and suffering, 500,000 total.
- 10:53Speaker 3: What could it be for? That's right.
- 10:57Speaker 2: Sally says, listen, my son, Wayne, has been best friends
- 11:01Speaker 2: with the defendant's son, Brad, for a long time. They
- 11:05Speaker 2: heard his, Brad's sister was having a graduation party. He
- 11:09Speaker 2: heard about that party. He went with a group of
- 11:11Speaker 2: friends to hang out with Brad while Brad's sister was
- 11:14Speaker 2: having a graduation party.
- 11:15Speaker 3: You with me so far?
- 11:16Speaker 2: Julia says, your honor, we're having a graduate, a graduation
- 11:20Speaker 2: party for my daughter. You only graduate once. We have
- 11:25Speaker 2: 20 of her friends over. We have, we had no
- 11:28Speaker 2: intention of having anyone else over much less anyone getting
- 11:33Speaker 2: in the pool. That's what she says.
- 11:36Speaker 3: Okay.
- 11:37Speaker 2: This was a party for my daughter. The party was inside.
- 11:40Speaker 2: Sally's son, Wayne, was not invited to this party. Not
- 11:43Speaker 2: a pool party.
- 11:44Speaker 3: Not a pool party. Not a pool party.
- 11:45Speaker 2: Just because you have a pool doesn't mean every party
- 11:47Speaker 2: is a pool party. Not every party is a pool party.
- 11:50Speaker 2: Judge Gino says, but these two are at each other's
- 11:52Speaker 2: house all the time. They're best friends. We got pictures
- 11:54Speaker 2: that prove it. The pictures prove it. But he wasn't
- 11:58Speaker 2: invited to his best friend's party?
- 12:00Speaker 3: Best friend's sister. Sister's party. The sister's party.
- 12:03Speaker 2: We hear from Wayne Baxter who is in a full,
- 12:05Speaker 2: I think it's called an angel brace. It's like from
- 12:08Speaker 2: chest up neck supporters, whole thing. How old is 17?
- 12:13Speaker 2: He said, uh, we went over the house. We went
- 12:15Speaker 2: to the game room. They were having their graduation party.
- 12:17Speaker 2: We went to the game room to play video games.
- 12:19Speaker 2: I'm not a big video game guy. So when everybody
- 12:21Speaker 2: was playing video games, I told one of my friends,
- 12:23Speaker 2: let's go out to the pool. So we go out
- 12:25Speaker 2: of the pool all the time. So I went out
- 12:26Speaker 2: to the pool and, uh, I saw this video online.
- 12:29Speaker 2: This is not his pool.
- 12:31Speaker 3: Not his pool. So he invited the kids to not
- 12:34Speaker 3: his pool.
- 12:34Speaker 2: That's right.
- 12:34Speaker 3: Got it. Love. Okay.
- 12:35Speaker 2: He's like, so I saw this video of this trick
- 12:38Speaker 2: this guy does into the pool off a trampoline. And
- 12:40Speaker 2: we see the video. And it's this, like, he's jumping
- 12:43Speaker 2: on the trampoline. And he pulls his knees into his body.
- 12:47Speaker 2: And then he does two, like, back flips. And lands
- 12:50Speaker 2: in the pool. And he's like, if this kid gets
- 12:53Speaker 2: any money.
- 12:56Speaker 3: This kid, I could already tell you what's going to happen.
- 12:59Speaker 3: Go finish up. Go, go ahead. Uh, no, it gets
- 13:03Speaker 3: worse for it gets better.
- 13:04Speaker 2: He's like, I watched the video a couple of times
- 13:06Speaker 2: and then, uh, I told him to go get the
- 13:08Speaker 2: trampoline and bring it over. And Gino was like, the
- 13:11Speaker 2: trampoline went by the pool.
- 13:12Speaker 1: He's like, no.
- 13:13Speaker 2: It was like over the corner somewhere. We don't keep
- 13:15Speaker 2: the trampoline by the pool. And he's like, so we
- 13:17Speaker 2: dragged the trampoline over next to the pool. I looked
- 13:20Speaker 2: at the video a couple of times, not his trampoline,
- 13:21Speaker 2: not his pool.
- 13:22Speaker 3: That's right.
- 13:22Speaker 2: And then I went for it, jumped on the trampolines,
- 13:24Speaker 2: got a good height going. And I went for it.
- 13:26Speaker 2: My neck and back hit the concrete didn't hit the pool. Uh,
- 13:32Speaker 2: Julia Soriano is like, I didn't know anything was wrong
- 13:34Speaker 2: until I heard screaming. No one was supposed to be
- 13:36Speaker 2: in the pool. I told everyone to.
- 13:38Speaker 3: Stay out of the pool.
- 13:39Speaker 2: Sally's like, your honor. She usually doesn't pay attention to
- 13:41Speaker 2: the kids at her house. They go to the pool
- 13:42Speaker 2: whenever they want. That's just not like she, she, she scatterbrained.
- 13:46Speaker 2: This is just not true. Gina's like, well, I'm listening
- 13:51Speaker 2: to both of you. You both sound like great moms.
- 13:54Speaker 2: And then Sally says her son has never gotten hurt
- 13:57Speaker 2: at my house. And then he says, if her son
- 14:00Speaker 2: did get hurt at your house, would that mean that
- 14:02Speaker 2: it's your fault? Uh-huh.
- 14:04Speaker 3: And she says, it would mean that I'd poorly supervised them.
- 14:07Speaker 2: Yes.
- 14:08Speaker 3: And he said, they're 17 years old.
- 14:11Speaker 2: They're 17 years old. And she said, they're still kids.
- 14:15Speaker 2: I'd be supervising them. Boys get into stuff.
- 14:17Speaker 3: They're 17. Judge Gino's like, Miss Soriano, you were watching
- 14:20Speaker 3: the guest you had invited. You want to.
- 14:23Speaker 1: Know how to make sure that your son's friends never
- 14:27Speaker 1: come around at 17 years old?
- 14:29Speaker 3: Is you always just being there. Being right beside them.
- 14:31Speaker 1: Yeah.
- 14:32Speaker 3: That's what 17-year-olds love. They love it. Hanging out with
- 14:34Speaker 3: their mom and dad. This is Stacy's mom. Different story.
- 14:37Speaker 3: Different story. All together. All the way around. Have you
- 14:40Speaker 3: heard about her?
- 14:41Speaker 2: Have I?
- 14:43Speaker 3: No, we can't.
- 14:43Speaker 2: Not here. Miss Soriana says, yes, the 20 people that
- 14:47Speaker 2: were invited... I was with them. That's who I was
- 14:50Speaker 2: with at my house. My son and his friends said
- 14:53Speaker 2: they were going to play video games. I let them
- 14:55Speaker 2: go play video games. Wayne has been over to my
- 14:58Speaker 2: house so many times. He's like another son to me.
- 15:01Speaker 2: I never imagined in any world he would be going
- 15:03Speaker 2: to the swimming pool. I heard screaming. I ran up
- 15:06Speaker 2: to check. Brad, my son, called 911 to help. Can
- 15:08Speaker 2: I ask really quickly?
- 15:10Speaker 3: Yes. Is Brad out there for all of this?
- 15:13Speaker 2: Brad?
- 15:14Speaker 3: Or did Brad stay inside and play video games? Got it.
- 15:17Speaker 3: I thought he might.
- 15:18Speaker 2: Yeah.
- 15:18Speaker 3: That's what I thought might happen.
- 15:20Speaker 2: So Sally then says, that's Wayne's mom, Brad called me
- 15:23Speaker 2: to let me know Wayne was on the way to
- 15:24Speaker 2: the hospital. He sustained a cervical spine fracture and a concussion.
- 15:28Speaker 2: We thought he was going to be paralyzed for life.
- 15:31Speaker 2: So what was the trick?
- 15:31Speaker 3: It was a... you'd pull your knees in and then
- 15:34Speaker 3: it was two backflips.
- 15:35Speaker 1: Two backflips.
- 15:36Speaker 3: Double backflip. While going forward, obviously. Yes, yes, yes. It's
- 15:39Speaker 3: a pretty good move. Yeah, pretty awesome. Maybe try one.
- 15:43Speaker 3: Maybe try one backflip. Maybe amp up. Yeah, amp up.
- 15:46Speaker 2: Maybe start with a frontflip. Maybe start with a frontflip.
- 15:49Speaker 2: The pain was very, very unbearable. That's how he would
- 15:51Speaker 2: describe the pain. Most people do a one to ten.
- 15:54Speaker 2: He said very, very unbearable. I don't know where that
- 15:55Speaker 2: stands in it, but is that below excruciating?
- 15:57Speaker 3: I don't know.
- 15:58Speaker 2: Sally's like, how could someone let something like this happen
- 16:01Speaker 2: to my child? Gino says, this did happen on your property,
- 16:07Speaker 2: Miss Soriano. And, you know, these severe injuries to a
- 16:12Speaker 2: minor on your property. Is this not your fault? Julia says,
- 16:17Speaker 2: Your Honor, we had a trampoline we were throwing out.
- 16:21Speaker 2: It wasn't near the pool. It was broken. It was
- 16:24Speaker 2: waiting to be picked up with our trash. It hadn't
- 16:28Speaker 2: been used in years. He goes to the side of
- 16:32Speaker 2: my house. and drags it back to the pool. This
- 16:37Speaker 2: is something my buddies would have done. Right?
- 16:39Speaker 3: 100%.
- 16:40Speaker 2: So that's where this gets murky, because Julius says a
- 16:44Speaker 2: 17-year-old doesn't need to be supervised that actively. Kids being kids,
- 16:48Speaker 2: that's like a broken window or a vase, not this. Yeah.
- 16:52Speaker 2: She goes to the plasma. She shows the picture of
- 16:55Speaker 2: the pool in the backyard. There's no trampoline anywhere. She's like,
- 16:57Speaker 2: you can't even see where it would be in this picture.
- 16:59Speaker 2: It's off to the side, around the side of the house.
- 17:02Speaker 2: You would have to do a lot of work to
- 17:03Speaker 2: get that trampoline next to the pool. Gina says, did
- 17:08Speaker 2: you know that if any kid was outside? She goes, no,
- 17:10Speaker 2: I didn't think anybody was outside the house.
- 17:12Speaker 3: Right.
- 17:12Speaker 1: Because the kids that I invited over for the party
- 17:16Speaker 1: were inside.
- 17:17Speaker 2: Brad then steps up to the podium and is like,
- 17:21Speaker 2: Gino's like, this is one of your best butts.
- 17:22Speaker 3: What happened?
- 17:23Speaker 2: Brad says, we all started playing video games.
- 17:25Speaker 3: I got eliminated.
- 17:26Speaker 2: I passed the controller to a friend. I reached for
- 17:28Speaker 2: my water, and I see Wayne outside on the trampoline.
- 17:32Speaker 2: And Gino goes, you didn't know he was outside. Brad's like,
- 17:35Speaker 2: I didn't know he was outside. But by the time
- 17:37Speaker 2: I saw him, he's thrusting his arms forward and starting
- 17:39Speaker 2: to flip. Right? Yeah. And he goes, it was pretty
- 17:44Speaker 2: majestic at first. I got to have a bro's back.
- 17:48Speaker 2: Until it wasn't.
- 17:49Speaker 3: He looked awesome. That's right.
- 17:50Speaker 2: Yeah, yeah, yeah. And he's like, I'm a certified lifeguard.
- 17:53Speaker 2: First thing you do is call 911. I've seen Wayne
- 17:55Speaker 2: play sports. He's like so good at sports.
- 17:59Speaker 3: They cover that in lifeguard class? If someone brings a
- 18:01Speaker 3: trampoline over to the pool. I don't know if they
- 18:02Speaker 3: cover that. I don't know if they get there. Here's
- 18:04Speaker 3: what you do. That's like grad school lifeguarding. Yeah.
- 18:08Speaker 2: He's like, I've seen Wayne get hit playing sports football.
- 18:10Speaker 2: He gets back up.
- 18:11Speaker 3: I mean, I knew something was wrong.
- 18:12Speaker 1: Yeah.
- 18:13Speaker 2: Jane, uh, you know, Gino's very interested that Wayne plays sports.
- 18:15Speaker 2: My kids are on scholarship. You play, your kids play sports.
- 18:18Speaker 2: Sally's like, he's an all-star athlete after this injury that
- 18:21Speaker 2: he had two scholarships offers. We're not sure if he's
- 18:24Speaker 2: going to get them. He has to sit up to sleep.
- 18:26Speaker 2: He needs help washing himself. We're unsure what his recovery
- 18:29Speaker 2: time is. There's a big financial strain on our family. Uh, Missouri, uh,
- 18:34Speaker 2: Gino says, Mr. Rihanna, this case demonstrates the difference between
- 18:37Speaker 2: men and women, teenage girls at 17 might not try this,
- 18:41Speaker 2: but a teenage boy, uh.
- 18:42Speaker 3: He might try this.
- 18:43Speaker 2: And while I don't like the generalization of gender from Gino,
- 18:49Speaker 2: you saying this is something we'd have done does speak
- 18:52Speaker 2: to the fact that this is something that we would like. Yeah.
- 18:59Speaker 3: Yes. There is a, there's a special kind of dumb. Yeah.
- 19:03Speaker 3: That happens. And he's a minor and he's at her house.
- 19:07Speaker 3: Special kind of dumb.
- 19:08Speaker 1: Yeah.
- 19:09Speaker 2: Um, So then he says, but Ms. Baxter, you've got
- 19:13Speaker 2: 20 kids to supervise on the inside. She has 20
- 19:16Speaker 2: kids to supervise on the inside. How is she supposed
- 19:18Speaker 2: to look for your kid who wasn't invited?
- 19:21Speaker 1: Ms.
- 19:21Speaker 3: Baxter says she should have told him to go home.
- 19:24Speaker 2: It's a party for her daughter. She should have said
- 19:26Speaker 2: go home. And Gino goes, are you serious? You said
- 19:28Speaker 2: earlier if someone got hurt on your property, it's your fault.
- 19:32Speaker 2: Now you're saying just to tell him to go home?
- 19:34Speaker 2: There's a doctor they bring on the plasma to explain
- 19:36Speaker 2: his injuries. That's exactly what you'd expect. Julia says bad.
- 19:40Speaker 2: Your Honor, I feel awful that this happened. Wayne's like
- 19:42Speaker 2: another son to me. I didn't want this to happen.
- 19:45Speaker 2: Sally said her daughter invited him on social media.
- 19:50Speaker 3: Okay.
- 19:52Speaker 2: Julia says, no, she didn't. Sally said, Your Honor, she
- 19:54Speaker 2: posted about the party on social media. He commented, I'll
- 19:57Speaker 2: see you there. She liked his post. And then Julia
- 20:00Speaker 2: says something that is easily the most disconcerting thing I've
- 20:04Speaker 2: heard in any of these cases ever, which is, Your Honor,
- 20:07Speaker 2: the chemistry teacher liked the post.
- 20:09Speaker 3: They weren't there.
- 20:11Speaker 2: Why did the chemistry teacher like the post that Wayne
- 20:15Speaker 2: was coming to the party of another minor?
- 20:19Speaker 3: Why is that happening? Did they mean the post?
- 20:24Speaker 2: The 17-year-old, the two high school kids are talking online
- 20:29Speaker 2: and a chemistry teacher is liking a post about a
- 20:31Speaker 2: graduation party.
- 20:32Speaker 3: That seemed weird to me.
- 20:34Speaker 2: I don't know.
- 20:34Speaker 3: Maybe not. I don't know. Yeah. Gino's ready to rule.
- 20:39Speaker 1: Well, I'll just say this. I am prepared to be
- 20:43Speaker 1: heartbroken and wrong. If they get any money, I'm just
- 20:50Speaker 1: going to start suing everybody for anything that happens. Like,
- 20:55Speaker 1: I was walking my dog, and I went into their
- 20:59Speaker 1: yard and tripped and fell and skinned my knee.
- 21:02Speaker 3: That's their fault. It's on their property. This kid is.
- 21:07Speaker 1: dumb and he did a dumb thing. Just like, it's just,
- 21:13Speaker 1: you can't, you can't, he wasn't invited to the party.
- 21:17Speaker 3: Yeah. They have 20 people that they invited to the party.
- 21:20Speaker 3: Not a pool party. Where are all those people inside?
- 21:22Speaker 3: So where are the parents focusing on inside? Why would
- 21:25Speaker 3: they even be looking outside?
- 21:27Speaker 1: They didn't know that Wayne and, and, and company were
- 21:31Speaker 1: out there, you know, Here's the thing. They were so
- 21:36Speaker 1: unaware that they were there that they didn't notice somebody
- 21:39Speaker 1: moving their trampoline from the street to the poolside. They
- 21:44Speaker 1: didn't know. It's so clear they didn't know. They can't
- 21:48Speaker 1: get in trouble for this. They can't. They can't. And
- 21:52Speaker 1: if they have to pay the money for this, I
- 21:56Speaker 1: don't know. I don't know left from right. I don't
- 22:01Speaker 1: know anything anymore.
- 22:03Speaker 2: So when you build a pool, when they do the
- 22:06Speaker 2: final thing with you, they give you all this information
- 22:09Speaker 2: and they give you no dive. I'm supposed to have
- 22:10Speaker 2: no diving stickers at my pool. Sure.
- 22:12Speaker 3: They're given to me.
- 22:14Speaker 2: And they go over the fact that liability cases with
- 22:17Speaker 2: swimming pools like Here's the thing is you are like this.
- 22:21Speaker 2: I know if my kid does something stupid or he
- 22:24Speaker 2: gets injured, I'm not immediately here to point blame. I'm
- 22:28Speaker 2: immediately here to hear the story because I know my
- 22:30Speaker 2: kid's more than capable of injuring himself by doing something stupid.
- 22:33Speaker 3: 100%.
- 22:34Speaker 2: Right?
- 22:35Speaker 3: There are parents out there that aren't like that. Yeah.
- 22:38Speaker 2: And if you have a pool and there's any sort
- 22:43Speaker 2: of gray area, they're going to side with the parent
- 22:47Speaker 2: that isn't the pool owner. They are now Gino starts
- 22:51Speaker 2: with this normal. Do you have the defendant? We have
- 22:53Speaker 2: to prove that 50% defendant, blah, blah, blah. Um, you also,
- 22:58Speaker 2: if you are a homeowner, you're responsible for anyone that
- 23:03Speaker 2: is in your care while they're at your house. That
- 23:07Speaker 2: is an up, basically a, uh, not unwritten rule, but
- 23:10Speaker 2: like a part of like having a minor at your house.
- 23:14Speaker 2: But then he says, uh, Mr. Baxter, the moment you
- 23:19Speaker 2: pulled the trampoline from the trash cans to the pool,
- 23:25Speaker 2: it is very difficult for me to blame the adult
- 23:29Speaker 2: and homeowner in charge of being responsible for your care
- 23:35Speaker 2: when you have pulled something from the trash and put
- 23:38Speaker 2: it next to the pool and injured yourself on it.
- 23:41Speaker 3: When they don't know you're there. That's right.
- 23:44Speaker 2: So he dismisses the case. But if he had just
- 23:47Speaker 2: injured himself in that pool, he was going to get
- 23:49Speaker 2: the money.
- 23:49Speaker 3: Yes. How crazy is that? Yeah. Wild time. Wild time
- 23:54Speaker 3: at the personal injury court. I just think... Common sense, people.
- 23:59Speaker 2: Yeah.
- 24:00Speaker 3: Boy, I don't know.
- 24:01Speaker 2: If my kids are out there swimming, I will walk
- 24:03Speaker 2: in and get a beverage and leave my kids out
- 24:04Speaker 2: there for whatever that is, 30 seconds per minute.
- 24:08Speaker 3: Because they're my kids. Yes. You know what I mean?
- 24:10Speaker 2: Yeah.
- 24:11Speaker 3: I get that if you have other people over, but
- 24:13Speaker 3: if you're 17 years old.
- 24:17Speaker 3: It's crazy. I don't know. Well, we did it, everybody.
- 24:21Speaker 3: Congratulations to us. I'm going to propose we come back
- 24:24Speaker 3: next week. I love it.
- 24:24Speaker 1: We're going to come back next week. We're going to
- 24:26Speaker 1: do this again with two more cases. Until then, All Rise!
