- 0:56You're already taking the first step. just by
- 1:00joining us here today. Hey guys thank you so
- 1:06much for being here you know this is well how
- 1:09many bazillion times have I said it these are
- 1:12my favorite six days of the year because I get
- 1:15to spend one on one time with experts in the
- 1:18space that I mean a lot of people they don't
- 1:22get those options so I'm kind of lucky. and I'm
- 1:25going to basically collect information and share
- 1:28it with you because that I feel is my job and
- 1:31that is my desire and it's just what I want to
- 1:35do. So we're going to be talking to Mark here.
- 1:38Mark Rose is a cost seg specialist and really
- 1:42what I'm focusing on right now is the short term
- 1:46rental. So for those of you that thought hey
- 1:49there are short term rentals And that's a possibility
- 1:54for me. There are ways to do it through arbitrage.
- 1:58I mean, there are so many ways to get into the
- 2:01short -term rental market. But if you want to
- 2:04do cost seg, you're going to have to own the
- 2:07property. So that kind of pushes out the arbitrage,
- 2:11but that is still an absolutely amazing way to
- 2:13make money. Don't push it aside. But for those
- 2:16of us that are looking for ways to potentially
- 2:19get a vacation home that pays for itself. This
- 2:25is the guy you want to talk to. I am super excited.
- 2:30Mark, I'm going to let you intro yourself, give
- 2:33us a little bit of background, and then we'll
- 2:35get going. Sure. Thank you, Angel. I really appreciate
- 2:39this opportunity. I'm Mark Rowson from CSSI,
- 2:43which is Cost Segregation Services, Incorporated.
- 2:46Over the last 20 years, we've completed tens
- 2:48of thousands of studies across the country, not
- 2:51just short -term rentals, but all property types.
- 2:55And I've been doing that for over 10 years with
- 2:57them and really enjoy it, like saving people
- 3:00money. Absolutely. Yeah, and if you've passively
- 3:05invested in anything in the last few years, you
- 3:09have benefited from that negative K1. You have.
- 3:13I'm never going to play with you because we have.
- 3:16Our own personal experience says those negative
- 3:19K1s are amazing. And my take on the 231 is that
- 3:26we are continuing to defer the tax liability
- 3:29and we're moving into a new property, even though
- 3:33there was recapture from the last, we're moving
- 3:36into a new property that will also have cost
- 3:39segregation, bonus depreciation, because this
- 3:42is the last year for it. Well last year for 100
- 3:46% I should yes, I should specify the last year
- 3:51for a hundred percent and so even though we're
- 3:54moving into a new property that recapture I guess
- 3:58follows us and The K1 will It will look at the
- 4:05fact that we had the recapture, but then we have
- 4:07the new depreciation or the new bonus and that
- 4:11should have some cancellation effect Yes, I'm
- 4:18going to head on this a little bit because the
- 4:20answer is kind of it. It depends. And to be able
- 4:24to put out a blanket statement as to. No, I know,
- 4:27I know so many different variables and I don't
- 4:30want to. I'm not trying to hedge the question.
- 4:33It's just that because there's so many different
- 4:35variables, we want to look at what the unique
- 4:37circumstances are for one and it may not be applicable
- 4:41for everybody. So and I'll put it out there for
- 4:44you. This is a TYA answer. So you are covering
- 4:50your butt, but CYB isn't as cool as CYA. But
- 4:55that's just the way it works. It's how much you're
- 5:00recapturing, how much you're getting on the next.
- 5:03And that's why I say that if you've heard me
- 5:05anything else, it's investing is a job. You need
- 5:10to be of the sound mind and of the sophistication
- 5:14to understand. that you have to be able to line
- 5:17these things up so that you don't find yourself
- 5:21in a tax laden situation. You want to be able
- 5:28to line up your investment so that as one comes
- 5:31up, you've got enough to cancel that one out.
- 5:36And that's my own experience. I am not giving
- 5:39you experience or advice as an accountant, as
- 5:41a lawyer, as anything. I'm just saying, from
- 5:45my own experience, you got to make sure you got
- 5:48those things timed out right to where when comes
- 5:51up, you got enough to cancel it out. Because
- 5:55if you can't cancel it out, that is tax liability
- 5:59for you. And that's why I say investing is a
- 6:03job. It really is. You bring up an interesting
- 6:07thing talking about time because sometimes people
- 6:09will ask, well, when's the best time to do a
- 6:12cost segregation? Well, you can get the maximum
- 6:15benefit the first year of acquisition, especially
- 6:19with bonus depreciation. If you wait other years,
- 6:23what's going to happen is the CPA is going to
- 6:25do a straight line depreciation on it for the
- 6:28years that you do it. For the whole property.
- 6:32That includes your faucet. your toilet, your
- 6:36tile, it includes everything. Right. So your
- 6:41basic year, we can still do properties that you've
- 6:44owned for five or 10 years. However, the savings
- 6:47are going to be significantly less than if it
- 6:50was done the first year of acquisition. But then
- 6:53some people will say, well, let's say, for instance,
- 6:56I want to do it for a property that I'm acquiring
- 6:58in 2022. When do you need to do that? You need
- 7:02to do the study before the end of the calendar
- 7:04year 2022. And the answer is no, you don't. You
- 7:09need to have the study completed prior to when
- 7:11you file your taxes. Now, if you were to wait
- 7:16until January, you're pushing the envelope on
- 7:19when the study can be completed for your business
- 7:22taxes in March and your personal taxes in April.
- 7:27CPAs don't like getting the reports that's 11th
- 7:30hour just before you submit the taxes. In our
- 7:34experience, CPAs don't even like it in Cossack.
- 7:37I get referrals from a lot of CPAs and they love
- 7:42it because they realize it helps their clients.
- 7:45But I also, not necessarily for syndicators,
- 7:48but for personal people, for people on properties
- 7:51themselves, frequently they'll do tax extensions.
- 7:55I guess what I'm busy working on right now are
- 7:57people that don't have to do it until the fall.
- 8:01October. Yeah, so this summer we were actually
- 8:06doing studies for properties that people acquired
- 8:09the previous year and they were still able to
- 8:12get it done because they were on a tax extension.
- 8:16Now absolutely and I think it's really neat to
- 8:20just think about these things. If you sit down
- 8:25as a normal person and you think about it, you're
- 8:27like, wait a second. My toilet's not going to
- 8:31last 30 years. All those little knobs in my kitchen,
- 8:37my kids stand on those because my kids are little.
- 8:42My Jacqueline is small for her age and literally
- 8:45broke off one of the handles on one of the bottom
- 8:47drawers because she was standing on it to get
- 8:49up into the cabinet. That's not abnormal. That
- 8:55is the norm. Things don't last. And so the things
- 8:59that don't last should be able to be depreciated
- 9:02out in front. If you want to straight line it
- 9:05fine. But a lot of people do straight line. Great.
- 9:10But if you want to get the benefits for the things
- 9:13that are going to wear out before that 27 and
- 9:16a half or 39 year grouping. You should be able
- 9:20to do that. And there's nothing wrong with that.
- 9:22The IRS code is set up to benefit people that
- 9:26think like that. Yes. That's a good analogy that
- 9:31I'll use, but some people will say, well, is
- 9:33this legal? Well, I'll say, let's say you own
- 9:37a house and you have a mortgage on it and you've
- 9:40interest on it on the mortgage and you have real
- 9:44estate taxes. Now, do you deduct the real estate
- 9:47taxes and the interest on your mortgage, on your
- 9:50personal taxes? Yes. Why do you do that? That's
- 9:54because it's in the IRS tax code. Well, similarly,
- 9:58if you own a commercial property and you do a
- 10:01cost segregation, that's in the IRS tax code.
- 10:04There's nothing wrong with it. Yeah. Now, and
- 10:08I just think there's people that don't know.
- 10:12There are people that just don't know. And they
- 10:15think their only option is straight line over
- 10:17the 27 or 39 years. And that's just not the case.
- 10:22And I had no clue. We've been in this game. So
- 10:26we've been on the residential side for two decades.
- 10:29We had no clue. And we're like, well, could we
- 10:33cost like them now? Well, we could, but we've
- 10:36owned them since 2003. So probably not worth
- 10:40it if it's been that long. Right. Because we've
- 10:43already we've already gone beyond the buckets
- 10:45that would have held us. Not calling buckets
- 10:47because that's where that's the easiest way for
- 10:50me to think of it. Like if it's a five year bucket,
- 10:53things that really have to be replaced within
- 10:57five years, they all go in that bucket. And the
- 11:0170 or 50, you got buckets. So you're putting
- 11:03things in those buckets that don't last as long.
- 11:08And so for me, it's easier to envision it. in
- 11:10the buckets. Yeah, no, that's a good analogy.
- 11:14And another thing I'll bring up too is that talked
- 11:16by different property types. We actually do a
- 11:19number of single family rentals. Hey guys, it's
- 11:25Angel. In case you didn't know, I put on a three
- 11:28day virtual summit twice a year. It's the Real
- 11:31Estate Investing Rocks Summit, and I've been
- 11:33hosting it since March of 2020. The next one,
- 11:36number 11, is March 25th, 26th, and 27th. Three
- 11:41full days. No cost to you. My friend Sandy is
- 11:44speaking, and she's supported me at every single
- 11:46summit since I started. Joe Fairless, Kathy Fedki,
- 11:50a Tony Award winner, another friend who's raised
- 11:53literal millions from people met on LinkedIn,
- 11:56and the list goes on. You have to join our Mighty
- 11:59Networks community to gain access. And that link,
- 12:02it's in the show notes. Not just residential,
- 12:10you know, fourplex or apartment building. And
- 12:13we can actually do a lower threshold of those.
- 12:16And especially, I mean, it might be $200, $250
- 12:20,000 might be the minimum on that, especially
- 12:25if there's I've done some portfolios where the
- 12:28number's been less than that, but it might be
- 12:31a dozen or more properties that are in close
- 12:33proximity to each other so that we can, based
- 12:36on volume, be able to do that. Okay, so that
- 12:40brings me to another selfish question. We got
- 12:43four houses here where we live, and two of them
- 12:48are well over 100 ,000. The other two are like,
- 12:52I don't know, 50 to 75 a piece. Would that be
- 12:55a worthwhile study to try, even though, I mean,
- 12:58they're in the same town. They're probably all
- 13:01within 10 miles of one another. Is that a worthwhile
- 13:04study to pursue? Probably not. Okay, you're breaking
- 13:10my heart, but that's okay. I'm just being honest
- 13:13with you. I mean, we can run the numbers, but
- 13:17I'm going to tell you, it's probably not going
- 13:19to be a worthwhile venture. And especially, considering,
- 13:22you know, are they new acquisitions or have you
- 13:24owned them for a while? Two of them we've had
- 13:29for probably, God, it's so hard. This is 2022,
- 13:36right? We got them probably in 2013. So we had
- 13:40them for probably 10 years. And then two of them
- 13:43we bought in the last couple of years. Probably
- 13:48not. No. Yeah, well, that sucks. Sorry to bust
- 13:53your bubble bubble, but that's the way it goes.
- 13:57OK, I got another question. What about if we
- 13:59refi 'em? It doesn't matter. It's based on the
- 14:02purchase when you acquired it. It has nothing
- 14:05to do with refinance. It has nothing to do with
- 14:09when a property appreciates. Let's say you buy
- 14:11something at $100 ,000, but now it's worth $500
- 14:14,000. Can you do a cost seg on the $500 ,000?
- 14:17No. It's based on what your acquisition cost
- 14:20is. Okay. Well, you burst all my levels. We don't
- 14:27want to be audited and have to give up money.
- 14:30Well, and you know what? Thank you for keeping
- 14:32me out of the orange jumpsuit. Even though you
- 14:36look good in it, but no. Well, I look good in
- 14:38everything. But that's the point. But that's
- 14:43the point. It's really, it comes back too. you're
- 14:47protecting the investor. You're making sure that
- 14:51they're not going to be in a position where,
- 14:52hey, you're about to find yourself in the orange
- 14:54jumpsuit. And really, I ask the questions I asked
- 15:00just to put it out there for everyone. I mean,
- 15:02if you've got properties that you've had for
- 15:0420 years, sorry, this kind of sucks for you.
- 15:10But as you're acquiring new properties, God,
- 15:15keep this into consideration. Even over the next
- 15:19five years, as it is phasing out, 80 % is way
- 15:24better than zero. 60%, 40%, 20%, all of those
- 15:29percentages are still way better than zero. Yeah,
- 15:33plus taking into consideration the fact that
- 15:36because it's political, what is Washington DC
- 15:41going to do in a few years? We don't know, but
- 15:46we suspect that some element of that's probably
- 15:48going to come back. Wait, because all it takes
- 15:52is a vote. All it takes is a vote to get it back
- 15:55in. And there are plenty of people riding both
- 15:59sides of the political fence that are investing
- 16:02in real estate. And they want to benefit as well.
- 16:10And for them to benefit, they have to pass the
- 16:13laws. Yeah, and I'll bring up another thing we
- 16:17were talking about the site visits and let's
- 16:21say you have a 20 unit multifamily property and
- 16:28all the 20 units are identical or a mirror image
- 16:32of each other. They have two bedrooms and one
- 16:35bath. So when we go out and do the site survey,
- 16:39take the photographs. We'll obviously take a
- 16:43lot of pictures exterior the common area. We
- 16:47do not have to go into every single unit. We
- 16:52know that let's say one unit will represent all
- 16:5720 and all we need to do is go into one unit
- 17:00and then and that's something that's really defendable.
- 17:05So just what that does is it helps out that let's
- 17:09say you're looking. you're the landlord it's
- 17:11not going to be less invasive for your tenants
- 17:14to do one of them versus you know every single
- 17:17one. Now obviously if you have something where
- 17:20you're going to have a different footprint in
- 17:22some of them you might have some two bedroom
- 17:24uh two baths some which are one better one bath
- 17:27we would need to go in and take a representative
- 17:30sample of our pictures of each of those individual
- 17:34samples. Yeah but it's still I mean The idea
- 17:39of being able to do this is amazing. And you
- 17:44know, I've talked to friends about house hacking
- 17:46and they're like, well, I can't cause that because
- 17:48I'm house hacking and I'm like. I think. I just
- 17:55don't know all the specifics of it. Does it still
- 17:58have to be a home that is worth 300 ,000 plus
- 18:02or getting into a gray area because one of the
- 18:05pre qualifying questions will ask is. do you
- 18:08live on this property? And if you're living there,
- 18:13you cannot cost sag what it is that you're living
- 18:17in. So it's kind of a greater, again, I'm going
- 18:20to hedge on it. We want to know what the particulars
- 18:22are in a particular situation. What if it's a
- 18:25new flex? Yeah. Yeah, that's a good example of
- 18:29one you can do. So you're living in one of the
- 18:32units. So do you only cost sag the unit you're
- 18:35not living in? Yes. How does that work? Well,
- 18:41let's say you buy it for $300 ,000, assuming
- 18:46that $150 ,000 is for each unit. And then what
- 18:49you would do is take that cost basis for the
- 18:52one that you are running out. OK, so you've got
- 18:58my mind going. I'm thinking of like a bazillion
- 19:01different things right now. And I just want to
- 19:03thank you. Thank you for being here, because
- 19:08the ideas you have given me, I can share with
- 19:12people. Even though we've got our family, we're
- 19:15not going to buy a duplex and live in half of
- 19:17it and cost the other half. That's not going
- 19:19to happen anymore for us, because our family
- 19:22is too large. But for other people that are listening,
- 19:27that is absolutely a possibility for them. whether
- 19:31it's quad or triad, you know, a duplex, whether
- 19:35it's a small apartment complex. I mean, there's
- 19:38things you can do. Oh my gosh. Like to anything
- 19:45you can do to reduce your tax liability is insanely
- 19:51amazing. Yes. Don't leave money on the table.
- 19:56Absolutely. And God, it. It doesn't mean you
- 20:00don't want to help people. It just means that
- 20:04you don't want to pay more than you have to.
- 20:07Would you legally have to? Absolutely. I mean,
- 20:11we help people all the time, whether it's through
- 20:14tithing or charity or whatever it is, we give
- 20:19to other organizations. Reducing your tax liability
- 20:24does not mean you're a jackass. Um, it just means
- 20:31that you want to care for yourself and your family
- 20:35first. I don't think there's anything wrong with
- 20:39that. No, the reason is it's all based on IRS
- 20:42tax code. So we're very stringent on that. Make
- 20:45sure, you know, just like we don't want you to
- 20:48be an orange jumpsuit. We don't want to either.
- 20:51No, absolutely. You know, my thing for being
- 20:54here and well, entertaining all of my ideas.
- 20:58And all my questions because they're a little
- 21:00insane sometimes and you know, but ultimately
- 21:03just thank you for being here and for sharing
- 21:07information with the people that are here listening.
- 21:09And for those of you out there, I really hope
- 21:13that you've considered joining us on the live
- 21:14side because it is amazing and it is awesome
- 21:19to be a part of those live conversations. There
- 21:22is a ton of information here. if that's not something
- 21:25that you want to do. So don't feel obligated,
- 21:29but absolutely know that the live side is amazing
- 21:32and we would love to have you over there. And
- 21:35if you don't join us, until we see you again.
