- 1:47Speaker 6: And that's because yesterday the announcement was made that there's
- 1:50Speaker 6: a new guy coming to head up the West Virginia SSAC.
- 1:54Speaker 6: And again Fred Pursinger literally running down the hall yesterday
- 1:57Speaker 6: said I got breaking news, and so I put Uncle
- 1:59Speaker 6: Fred on the air and he broke the story yesterday
- 2:02Speaker 6: Deary Metrics mid Day, Well, Fred's going to join us.
- 2:04Speaker 4: Get a little bit more clarification on some things.
- 2:05Speaker 6: So he's going to join us to talk about that,
- 2:07Speaker 6: uh coming up, that change of the helm of the
- 2:10Speaker 6: s Sac coming up a little bit later on. Also
- 2:13Speaker 6: Brad mclhanney is going to join us, and as we speak,
- 2:17Speaker 6: well within the next hour or so, there is going
- 2:19Speaker 6: to I think it actually starts a tent. There's going
- 2:21Speaker 6: to be a hearing in Judge Berger's courtroom in Charleston
- 2:26Speaker 6: and has to do with Niosh in Morgantown. There is
- 2:28Speaker 6: a single coal miner that has filed a lawsuit about that,
- 2:32Speaker 6: and so Brad will give us a little.
- 2:34Speaker 4: Preview of that. Let's speaking of previews.
- 2:36Speaker 3: TJ.
- 2:36Speaker 6: Meadows will stop by with a preview of today's Metro
- 2:38Speaker 6: News talk line and more. That's kind of loaded up today.
- 2:42Speaker 6: Our good friend Mayor Scott James, the Saint Albans is here. Hey,
- 2:45Speaker 6: no man, I'm.
- 2:46Speaker 7: Doing great, Dave, nice new digs here man, as first
- 2:49Speaker 7: time I've been here since you already did the studio.
- 2:51Speaker 4: You like it?
- 2:52Speaker 3: Yeah, very nice.
- 2:53Speaker 6: Yeah, it's good enough to put on the air. It
- 2:54Speaker 6: is we should, we should, we should actually put this
- 2:56Speaker 6: on the radio.
- 2:57Speaker 3: It's yeah, But then you have to put our mugs
- 2:59Speaker 3: on that.
- 3:00Speaker 6: Well, they put my mug on in the afternoon on
- 3:02Speaker 6: Metro News television between two and three, right, And I
- 3:07Speaker 6: don't you know that's there's a reason I chose radio.
- 3:10Speaker 6: And yes, go ahead and hit me with a you
- 3:11Speaker 6: got to face for radio because I've never heard that before.
- 3:14Speaker 4: So you're rock in the title of hat house the
- 3:17Speaker 4: golf game.
- 3:18Speaker 7: Uh, well, it's sporadic because I don't get out very often.
- 3:23Speaker 4: So to make yourself feel better, just wear the hat
- 3:24Speaker 4: I do.
- 3:25Speaker 3: I just wear that. I got all kinds of titless hats.
- 3:27Speaker 6: Okay, all right, So you know, I wanted to kind
- 3:30Speaker 6: of catch us up with some things that are going on.
- 3:33Speaker 4: Yesterday.
- 3:34Speaker 6: There was a groundbreaking for a new pharmacy on the
- 3:36Speaker 6: Loop yesterday.
- 3:37Speaker 4: Talk a little bit about that.
- 3:38Speaker 7: Yeah, very exciting. Family care has been a vital part
- 3:43Speaker 7: of growth in Saint Albans. They got their facility at
- 3:47Speaker 7: the Loop where you can go in and see the doctor.
- 3:49Speaker 7: They've got a facility on sixth Avenue that is billing
- 3:53Speaker 7: and warehousing. And now we broke ground yesterday for Family
- 3:58Speaker 7: Cares first pharmacy and it's going to be on the
- 4:02Speaker 7: southwest corner of the present facility down there at the Loup.
- 4:06Speaker 3: So we're excited about that.
- 4:08Speaker 7: I mean, it brings people to Saint Albans and its
- 4:11Speaker 7: economic growth and you know, their footprint and Saint Albans
- 4:15Speaker 7: continues to grow, makes our community a healthier, safer community.
- 4:19Speaker 4: Yeah.
- 4:20Speaker 6: We talked to Jennifer Farr from that group on the
- 4:22Speaker 6: show yesterday about that, and she says that they plan
- 4:24Speaker 6: on having that done by you know, and they've already
- 4:28Speaker 6: got some things going on there, but they plan on
- 4:29Speaker 6: having it done by summer.
- 4:30Speaker 4: That's that's pretty good.
- 4:31Speaker 3: I think.
- 4:32Speaker 7: So pre Construction is doing the work I believe, and
- 4:35Speaker 7: they always do a good job.
- 4:36Speaker 4: So they do they do indeed. So what else going
- 4:39Speaker 4: on in Saint Aubin.
- 4:40Speaker 7: We got a lot happening. It's tis the season out
- 4:43Speaker 7: starting to warm up a little bit.
- 4:46Speaker 3: Starts off this Saturday.
- 4:47Speaker 7: We've got two five one seven seven Foundations having their
- 4:52Speaker 7: event annual event, Make Say Shine and what they do
- 4:57Speaker 7: any organization that wants to bring volunteers to go around
- 5:02Speaker 7: and clean up the community the two five one seven
- 5:07Speaker 7: seven Foundation, We'll give each individual ten dollars. So let's
- 5:13Speaker 7: say organization brings twenty people to work that's two hundred
- 5:17Speaker 7: dollars for your organization.
- 5:19Speaker 6: So'd be great for you know, like little leagues or
- 5:22Speaker 6: civic organizations, anybody.
- 5:24Speaker 3: Yeah, definitely, there's no doubt about that.
- 5:26Speaker 7: And they're meeting at Grace Baptist Tempo I think at
- 5:30Speaker 7: eight o'clock Saturday morning. So if you want to be
- 5:34Speaker 7: part of that show up and make say shine.
- 5:36Speaker 4: Yeah, indeed, then that foundation does a does a great job.
- 5:40Speaker 8: Yeah.
- 5:40Speaker 7: Wald Hall's heads that up, Delicate Hall, and he does
- 5:44Speaker 7: a fantastic job.
- 5:45Speaker 6: He's been on the show numerous times talking about that.
- 5:49Speaker 6: He's probably happy not to talk.
- 5:51Speaker 4: To just to get away from the legislature right now,
- 5:53Speaker 4: just not have to talk about that.
- 5:54Speaker 6: Yeah, I taxed the Walt the other day and I
- 5:58Speaker 6: was trying to book him on a on a particular
- 6:00Speaker 6: day and he wasn't available that day. He probably thought
- 6:02Speaker 6: I wanted to talk too much legislature. I think I'd
- 6:04Speaker 6: give them at little bit of a break from that.
- 6:06Speaker 6: What else are I going on?
- 6:07Speaker 7: Well, we got a water tank project that's already began.
- 6:10Speaker 7: We're putting up the East End up on the hill
- 6:14Speaker 7: behind City Park. They've started letting the pipe and hopefully
- 6:19Speaker 7: that'll be done by the end of this summer, it's
- 6:22Speaker 7: a million a million gallon tanks. So it's going to
- 6:26Speaker 7: provide water in time of need if we ever need
- 6:29Speaker 7: it to the east end of tank.
- 6:31Speaker 4: Now, what would be some of the instances where you
- 6:33Speaker 4: would need it.
- 6:34Speaker 7: Well, if the water plant goes down loses power, we've
- 6:39Speaker 7: got enough water there for two to three days anyway,
- 6:44Speaker 7: So you know, any any event that makes us quit
- 6:47Speaker 7: producing water to water plant, then we utilize the water
- 6:51Speaker 7: tanks in Saint omers All.
- 6:53Speaker 6: Right, Dave Island Show on five eighty Live is brought
- 6:56Speaker 6: to you by by Morgan and Morgan, America's largest injury
- 6:58Speaker 6: law firm.
- 6:59Speaker 4: If you're injured, visit for the People dot com.
- 7:01Speaker 6: And of course you said it is the season, so
- 7:03Speaker 6: you got a lot of warm weather Activiti's be time
- 7:07Speaker 6: for Yakfest here before you know it of us right.
- 7:09Speaker 7: Yep, June thirteenth and fourteenth is Jackfest promises to be
- 7:13Speaker 7: another great two day event. And then of course on
- 7:18Speaker 7: the morning of the fourteenth is the largest flatwater kayaking
- 7:21Speaker 7: event in the country. The Tour to Coal probably about
- 7:24Speaker 7: another eighteen hundred and two thousand kayakes going down the river.
- 7:29Speaker 3: So you know, guys. You can go to.
- 7:32Speaker 7: Tour to Coal Facebook page and sign up. They've got
- 7:36Speaker 7: a link care.
- 7:37Speaker 3: That you can get signed up for tor to Coal
- 7:39Speaker 3: if you want to.
- 7:40Speaker 7: And we have people that come from as many as
- 7:42Speaker 7: twelve to fifteen states around the country that participate in this.
- 7:47Speaker 6: I mean, it's huge, and it just gets bigger and
- 7:49Speaker 6: better every year. And of course, the thing one of
- 7:51Speaker 6: the things that always amazes me about Saint Auban's is
- 7:55Speaker 6: and if you follow the city on social media whatever,
- 7:58Speaker 6: you've always got something going on, especially in the warm
- 8:01Speaker 6: weather months. I mean last week, I think you did
- 8:02Speaker 6: a pub crawl last Friday night. I think downtown sat
- 8:07Speaker 6: Saturday night was a Saturday night. Okay, No, it was
- 8:09Speaker 6: first Friday night. It was Friday night.
- 8:10Speaker 4: It was Friday night.
- 8:11Speaker 6: Yeah, that you did that for in conjunction was sinking
- 8:13Speaker 6: to Mayo, which was a couple of days later, of course,
- 8:16Speaker 6: but there's always something going on.
- 8:18Speaker 3: Yeah.
- 8:19Speaker 7: The Alzheimer's Association approached us about doing one, which you know,
- 8:23Speaker 7: anytime we can help them raise money and get closer
- 8:27Speaker 7: to a cure for that terrible disease, we're always willing
- 8:30Speaker 7: to help out. And the weather didn't cooperate greatly, but
- 8:34Speaker 7: they still profited and so that was a good, good
- 8:37Speaker 7: first event for the Alzheimer's Association.
- 8:42Speaker 3: This Sinco to Mayo pub crawl.
- 8:44Speaker 6: And you've got advantage there the way that the City
- 8:48Speaker 6: of Saint Albans is laid out on old Main there,
- 8:50Speaker 6: because you can actually, unlike a lot of towns, you
- 8:53Speaker 6: can shut down, you know, you in your the majority
- 8:57Speaker 6: of your main street and still have plenty of ways
- 8:59Speaker 6: to get in and out and get around and stuff.
- 9:01Speaker 6: And that's that's a big advantage when you have these
- 9:02Speaker 6: events like that.
- 9:03Speaker 3: Yeah, it really does.
- 9:04Speaker 7: And we're about ready to finalize our PODA Public Outdoor
- 9:08Speaker 7: Designated Area, which is going to be a boost for
- 9:13Speaker 7: all of our festivals and events like pub crawls. And
- 9:19Speaker 7: it's through the abc A and they've tweaked a little
- 9:22Speaker 7: bit at the legislature and made it better. When they
- 9:25Speaker 7: first passed it, you couldn't use it for fairs and festivals.
- 9:28Speaker 3: Now you can.
- 9:30Speaker 7: And the PODA district will run on Main Street from
- 9:34Speaker 7: Third Street all the way to be Street and a
- 9:39Speaker 7: little bit down c Street where the Joe Dobbs Applaza
- 9:43Speaker 7: is and so people that are partect partaking in beer
- 9:50Speaker 7: during these events can go in the bar and then
- 9:54Speaker 7: walk out with their drink. You don't have to have
- 9:56Speaker 7: a beer booth on the street.
- 9:58Speaker 4: Right.
- 9:59Speaker 6: And again these are I mean that they're done in Charleston.
- 10:01Speaker 6: There's a few of those in Charleston, and other cities
- 10:03Speaker 6: have done these as well. Basically, what it is it's
- 10:05Speaker 6: a designated area. Yes that you can and different cities
- 10:09Speaker 6: do it different ways. But you can purchase a cup
- 10:12Speaker 6: and as you said, when you have events like you know,
- 10:14Speaker 6: your chili festivals and things like that, you can actually
- 10:17Speaker 6: purchase the cup and you can take that into the
- 10:19Speaker 6: individual places that serve if they if they choose to
- 10:22Speaker 6: participate in and maybe all of them wont, but uh.
- 10:26Speaker 6: And it's it's it's been a huge success in every
- 10:29Speaker 6: city that's done in and there there have been I
- 10:32Speaker 6: mean very little, if any problems associated with them.
- 10:35Speaker 7: No, there are very few problems. And they started over
- 10:39Speaker 7: in Ohio as an economic development tool and uh, we
- 10:44Speaker 7: you know, saw that here in West Virginia and it's
- 10:47Speaker 7: proven to be very effective in economic growth.
- 10:50Speaker 3: Uh.
- 10:51Speaker 7: And you know that should be finalized here very soon.
- 10:54Speaker 7: We've got to get the signs up to where it
- 10:56Speaker 7: says PoTA district thens no alcohol beyond this point. Yeah,
- 11:00Speaker 7: they'll come down and inspect and if it's clear, we'll
- 11:04Speaker 7: be clear to have the PODA district. Then we will
- 11:08Speaker 7: set certain dates that we're gonna do PODA. We won't
- 11:10Speaker 7: do it every weekend, I don't think, but you know,
- 11:15Speaker 7: this is our first year doing it. We've got something
- 11:18Speaker 7: new this year that we're bringing to Old Main. It's
- 11:20Speaker 7: called Saturday Night on Old Main Day. And what's gonna
- 11:25Speaker 7: happen is at the Joe Dobbs Plaza. We're gonna start
- 11:28Speaker 7: playing music at six thirty. We're gonna close street down
- 11:31Speaker 7: around four thirty and uh so there'll be music playing
- 11:36Speaker 7: from uh six thirty to eight thirty. There's gonna be
- 11:39Speaker 7: food trucks on the street, and then at the end
- 11:43Speaker 7: of Old Main and juncture of B Street, there's gonna
- 11:47Speaker 7: be a big movie screen and then we're gonna show
- 11:50Speaker 7: a movie at dark.
- 11:52Speaker 3: We've got four dates for that.
- 11:54Speaker 7: May twenty fourth, May thirty first, July twenty sixth, in
- 11:58Speaker 7: August second.
- 11:59Speaker 3: So we're very excited.
- 12:00Speaker 7: About this event bringing more people to Saint Albans and uh,
- 12:06Speaker 7: like I've said many times before, I found out if
- 12:09Speaker 7: I can get him to Saint Albans and they visit
- 12:11Speaker 7: our shops and our bars and our restaurants, they keep coming.
- 12:14Speaker 4: Back, indeed they do.
- 12:15Speaker 6: And again you've got some good shops down on Maine,
- 12:19Speaker 6: and not just on Old Main but in other places
- 12:21Speaker 6: as well, and some great restaurants. A couple of my
- 12:23Speaker 6: favorite places uh in the world are down there. A
- 12:26Speaker 6: big shout out to the two guy and the folks
- 12:28Speaker 6: at Shuckers uh uh uh. And also the Cafe of
- 12:31Speaker 6: course as legendary. And there's and and and Drummis and
- 12:34Speaker 6: the other places there too.
- 12:35Speaker 7: Yeah, all all of the see Cafe Drummers, the Tap, Shuckers,
- 12:44Speaker 7: and Cosmels all and Co River Coffee all is going
- 12:47Speaker 7: to participate.
- 12:48Speaker 3: In the poda. Okay, so we're excited about that.
- 12:51Speaker 7: And speaking of Old Maine and businesses, we had a
- 12:54Speaker 7: ribbon cutting at sixty three Old Maine. Used to be
- 12:58Speaker 7: uh Frank McCormick's building. He had multiple ventilation products in there,
- 13:03Speaker 7: but he retired. There's five businesses going in there that
- 13:07Speaker 7: used to be the old Herbert's Music Company building. I
- 13:10Speaker 7: took guitar lessons there for about three months and realized
- 13:13Speaker 7: that I was to adhd.
- 13:15Speaker 3: You learn how to play the guitar.
- 13:17Speaker 4: Same here.
- 13:17Speaker 6: Yeah, my dad played guitar and he tried and at
- 13:20Speaker 6: some point he said, maybe you ought to pursue this
- 13:22Speaker 6: radio thing because he gave up on me go ahead.
- 13:25Speaker 7: But you got Meriakei Muraki Salon sixty three main events.
- 13:31Speaker 7: If you want to rent a space out for you know,
- 13:36Speaker 7: a party of baby Shire or anything like that. You
- 13:42Speaker 7: got Bowsell, which is a company that picks up leaks
- 13:47Speaker 7: through I think it's ultrasound.
- 13:51Speaker 3: Die Rise Kill LLC.
- 13:53Speaker 7: They do masks and makeup and cosmetics for movie and they.
- 14:00Speaker 3: Sell for around the world.
- 14:02Speaker 7: They're international and Beauty of Skin Aesthetics by Riley. So
- 14:06Speaker 7: we've got five businesses that opened up with one ribbon cutting,
- 14:11Speaker 7: and I.
- 14:11Speaker 6: Really wish and we'll wrap it up after this. Man,
- 14:13Speaker 6: I really wish that more cities would do that because
- 14:15Speaker 6: you've got these older buildings, you know, throughout the Kanawha Valley,
- 14:19Speaker 6: and sometimes it's you know, this is not in nineteen
- 14:22Speaker 6: forty eight, so we don't have the need for necessarily
- 14:24Speaker 6: the big department stores like we used to have. But
- 14:27Speaker 6: you got these buildings there, and I wish more people
- 14:29Speaker 6: would do that where you get two or three four.
- 14:31Speaker 6: I know they've got a great one in downtown Huntington
- 14:34Speaker 6: where they did what they did that exact thing where
- 14:36Speaker 6: they get three, four or five businesses all to go
- 14:38Speaker 6: in almost like a little mini mall into these buildings,
- 14:41Speaker 6: utilize the space and everybody benefits.
- 14:44Speaker 7: Yeah, everybody does. The city benefits, the businesses benefit. And
- 14:50Speaker 7: what's so great about our businesses in Saint Albans there's
- 14:53Speaker 7: not a lot of competition between them. Even the restaurants
- 14:56Speaker 7: down in the old main district they don't like Truckers
- 15:00Speaker 7: is seafood and to day cafes got the best wings around,
- 15:07Speaker 7: plus great food, sandwiches, everything else. Drummies they've got delicious food.
- 15:14Speaker 7: The TAP's got a different menu, and then you've got
- 15:19Speaker 7: Cosmel and Co River Coffee. They all serve food, but
- 15:22Speaker 7: they don't compete against each art together, yes, and they
- 15:27Speaker 7: benefit from each other. So that's that's unique and it's
- 15:31Speaker 7: good for our community.
- 15:32Speaker 6: Always a lot of exciting things going on in the
- 15:34Speaker 6: Land of the Red Dragons. Scott James, Mayor, Scott James,
- 15:38Speaker 6: appreciate you being here, man, Thanks a lot.

- 18:31Speaker 6: State White correspond to Brad Macilhoney. Brad, good morning and
- 18:34Speaker 6: welcome back. You took a little time off, much deserved,
- 18:37Speaker 6: and I would say it was a vacation, but I
- 18:39Speaker 6: think you were doing family things that kind of negated
- 18:42Speaker 6: the whole the whole vacation part.
- 18:44Speaker 4: Right.
- 18:45Speaker 8: I'm at a time of life, so surely you've got
- 18:48Speaker 8: to run around greedy and whalen sometimes, you know, tack
- 18:51Speaker 8: some of their appointments, get their hair done, whatever, you
- 18:54Speaker 8: got to run them around.
- 18:56Speaker 6: The cats never leave the house, man, unlike unlike your kids. Man,
- 18:59Speaker 6: My cat's never leave the house.
- 19:00Speaker 4: So I don't. They don't have a lot of appointments
- 19:03Speaker 4: to go to.
- 19:05Speaker 8: Well, anyway, college aged daughters do. And there are times
- 19:10Speaker 8: of year when you know, they will change locations and
- 19:14Speaker 8: they have a lot of stuff, and their stuff has
- 19:17Speaker 8: to be you know, boxed up and stuck in a
- 19:19Speaker 8: car or you aul or whatever and transported somewhere else.
- 19:24Speaker 8: My college aged daughters are in two different locations, and
- 19:29Speaker 8: there was less wear and tear on my brain, but
- 19:32Speaker 8: more wear in tear on my back. So I was
- 19:36Speaker 8: taken them places alone. More appropriately, I was taking their
- 19:40Speaker 8: stuff places.
- 19:41Speaker 6: I have always wondered why with you know, and you've
- 19:45Speaker 6: got college age daughters, why it is that we don't
- 19:48Speaker 6: have a better system for college kids to have to
- 19:51Speaker 6: take all of their crap out, you know, after the
- 19:53Speaker 6: end of every semester, move it somewhere else, only to
- 19:56Speaker 6: bring it back in two to three months.
- 19:57Speaker 4: I mean, there should there be a.
- 19:59Speaker 6: Better system there just once that they live off campus,
- 20:02Speaker 6: that it works out well. Just I've never understood, never
- 20:05Speaker 6: understood why we don't have a better system for.
- 20:07Speaker 8: The Well, capitalism will handle that to you for a
- 20:10Speaker 8: certain degree. There are storage units that will charge you
- 20:14Speaker 8: money keep you tough, okay, And we did that with
- 20:17Speaker 8: some of the things, but you know, the other things
- 20:21Speaker 8: like clothes you still need, especially if you were a
- 20:25Speaker 8: college daughter. You're going to bring the clothes by I

- 20:37Speaker 6: All right, so you're back in the saddle, and uh
- 20:40Speaker 6: you're keeping an eye on a court case in Charleston today, right.
- 20:45Speaker 8: Yeah, some things have not changed, you know, the ever
- 20:48Speaker 8: developing situation with the federal government and the Department of
- 20:52Speaker 8: Government Efficiency. Uh, this is one that has been affecting
- 20:56Speaker 8: West Virginia for weeks. Uh. It is the National Institute
- 21:01Speaker 8: of Occupational Safety and Health, which has a significant presence
- 21:05Speaker 8: in Morgantown, so those are not only West Virtiny jobs,
- 21:09Speaker 8: but that occupational safety and health extends to a variety
- 21:14Speaker 8: of sectors of the workplace, including coal miners. On one
- 21:18Speaker 8: of the federally mandated duties NIOSH does is screening for
- 21:25Speaker 8: black lung. You know, you'd wish in this day and age,
- 21:28Speaker 8: black long would be a relic of the past, but
- 21:30Speaker 8: if not, and the federal law requires screening to be
- 21:36Speaker 8: made available to coal miners. If coal miners are identified
- 21:41Speaker 8: as having developed black lung, then they have a right
- 21:45Speaker 8: to transfer to a non underground workplace role, but it
- 21:52Speaker 8: does require that screening. All that's all up in the
- 21:55Speaker 8: air because NIOSH in Morgantown, which is the place that
- 21:58Speaker 8: does that, has all but gone dark most employees, hundreds
- 22:02Speaker 8: of them now with reduction in force notices that's not
- 22:07Speaker 8: yet permanent, but most of them are not on the
- 22:10Speaker 8: work site anymore.
- 22:11Speaker 2: So.
- 22:11Speaker 8: There was a coal miner who says that he sought
- 22:18Speaker 8: his screening from a local lab late last fall and
- 22:22Speaker 8: then sent it on to NIOSH, and he and his
- 22:27Speaker 8: lawyers say in their corporations that they have gotten no
- 22:31Speaker 8: response yet because NIOSH has gone dark. This coal miner
- 22:37Speaker 8: contends to represent himself and others similarly situated, So other
- 22:43Speaker 8: other coal miners who would have a question about their
- 22:46Speaker 8: own health and whether they should have accommodation made for
- 22:51Speaker 8: them in the workplace. That federal lawsuit where the coal
- 22:57Speaker 8: miner and his lawyers are seeking a temporary injunction has
- 23:00Speaker 8: gone before US District Judge Irene Berger. She has a
- 23:04Speaker 8: hearing just in a few minutes ten o'clock on that
- 23:09Speaker 8: temporary injunction question. The most recent thing that's happened until
- 23:14Speaker 8: now is the federal government has put in its side.
- 23:16Speaker 8: This is the being sued is the US Department of
- 23:22Speaker 8: Health and Human Services, and then Robert F. Kennedy Junior,
- 23:26Speaker 8: in his role as the secretary leading that agency. They're
- 23:29Speaker 8: being represented by US attorneys in Charleston, not in their
- 23:36Speaker 8: more familiar criminal role, but in their civil role for
- 23:40Speaker 8: civil capacity. And the argument on that side is threefold.
- 23:45Speaker 8: One is I have no way of knowing. But one
- 23:49Speaker 8: they're saying that the lead plaintiff actually did receive a
- 23:52Speaker 8: response a negative a negative outcome on whether he has
- 23:58Speaker 8: black long back in December. So the federal government's access
- 24:03Speaker 8: thing that that's already being processed and therefore what is
- 24:08Speaker 8: happening at NIOSH leaves him with no standing like it's
- 24:11Speaker 8: already gone through. You know, they're saying, you don't have
- 24:14Speaker 8: black lung time, no way of me knowing who's telling
- 24:17Speaker 8: the truth.
- 24:17Speaker 6: Right, Yeah, And you know, yes yesterday Brad on the
- 24:22Speaker 6: Metro News midday show, we actually talked to a retiree
- 24:25Speaker 6: of NIOSH And obviously some of the employees there have
- 24:29Speaker 6: to be guarded in what they what they say until
- 24:33Speaker 6: it's one hundred percent a done deal. It looks to
- 24:36Speaker 6: me like what came out Friday night at six thirty,
- 24:39Speaker 6: which UMWA President Cecil Roberts and others slam called it cowardly.
- 24:43Speaker 6: When the statement came out on six point thirty on
- 24:46Speaker 6: a Friday, it's basically saying it doesn't look good for
- 24:49Speaker 6: the future.
- 24:51Speaker 4: A lot of the.
- 24:51Speaker 6: Employees can't necessarily speak out against it, but the retirees can.
- 24:57Speaker 6: And we had the lady on the show yes yesterday
- 25:01Speaker 6: who is a retired missus Wolf from there, and she's
- 25:03Speaker 6: been very, very vocal about this, and I mean she
- 25:07Speaker 6: puts a lot of even though she's retired from there.
- 25:10Speaker 6: And I would urge people if they get a chance
- 25:11Speaker 6: to go back to wv metronews dot com and listen
- 25:13Speaker 6: to that interview that Amanda and I did with her yesterday.
- 25:16Speaker 4: She's been been.
- 25:17Speaker 6: Very vocal about what's going what's gone on at Niosh.
- 25:22Speaker 8: This was Anita Wolf.
- 25:24Speaker 4: Wolf, Yes I can think of her first name.
- 25:26Speaker 8: Yeah, overseeing the very program I've been talking about in
- 25:29Speaker 8: the black lung screening. And you know, her point to
- 25:32Speaker 8: you and to Amanda was that if things continue to
- 25:36Speaker 8: proceed at this trajectory, she thinks coal miners will develop
- 25:40Speaker 8: black lung and lose their lives. And you know, certainly
- 25:45Speaker 8: the people who who run this program are not currently
- 25:49Speaker 8: working technically. That is not yet a permanent situation. And
- 25:55Speaker 8: that's that's the second of the arguments that the federal
- 25:58Speaker 8: government is making. Actually that the federal government is saying
- 26:04Speaker 8: that there can't be a lawsuit demonstrating harm because this
- 26:08Speaker 8: hasn't hardened up yet. It is not yet permanent. These
- 26:13Speaker 8: job losses are are not yet set in stone, and
- 26:16Speaker 8: it could be that some are saved, that there could
- 26:19Speaker 8: be a reorganization. You know, I'm no lawyer. The question
- 26:24Speaker 8: I have on that is, well, if you if you
- 26:26Speaker 8: can't sue if you're this coal miner and you think
- 26:29Speaker 8: you're at risk of black long and you are not
- 26:32Speaker 8: yet allowed to sue because it's not permanent in terms
- 26:37Speaker 8: of the reorganization, well then when could you sue? Only
- 26:40Speaker 8: when the jobs are gone forever, only when the function
- 26:43Speaker 8: of the federal government is zeroed out, then it's okay
- 26:46Speaker 8: to sue. You know, I don't know, I'm no lawyer.
- 26:51Speaker 8: It'll get figured out in court. But double following the logic.
- 26:56Speaker 6: Yeah, and again that hearing is at ten o'clock. Can
- 26:58Speaker 6: we keep a close eye on that, so we urge
- 26:59Speaker 6: people to keep listening to the stations and also follow
- 27:02Speaker 6: you on the website and on social media as well.
- 27:05Speaker 6: Speaking to social media, I want to run this by
- 27:07Speaker 6: before we let you go here. Former US Senator, governor
- 27:13Speaker 6: of Secretary of State all things Above, Joe Manchin out
- 27:19Speaker 6: The Hill first reported that he wrote in a post
- 27:22Speaker 6: on the social media platform x last night that elections
- 27:26Speaker 6: in West Virginia quote are heading in the wrong direction
- 27:30Speaker 6: given the rank choice voting ban from March and a
- 27:33Speaker 6: move from the legislature to potentially close primaries to only
- 27:35Speaker 6: party members starting in twenty twenty six. Let me give
- 27:37Speaker 6: you a quick quote here, lawmakers is, according to Mansion,
- 27:40Speaker 6: lawmakers just banned rank choice voting even though we've never
- 27:43Speaker 6: used it. At the same time to trying to shut
- 27:45Speaker 6: out over three hundred thousand independent voters from participating in
- 27:49Speaker 6: primary elections. That's nearly thirty percent of West Virginia voters
- 27:52Speaker 6: being told their voices don't matter. This isn't leadership, it's
- 27:55Speaker 6: political gamesmanship. And that's according to former Senate or Joe Manchin,
- 28:01Speaker 6: who put that out on X last night. So, number one,
- 28:04Speaker 6: I'll say, anybody that thought Joe Manson was going to
- 28:06Speaker 6: go away quietly, I think you're sadly mistaken. I said
- 28:08Speaker 6: that that he, you know, Mansion, is going to be
- 28:11Speaker 6: around until he's dying breath, speaking out on things that
- 28:15Speaker 6: are of importance to him. What do you make of
- 28:16Speaker 6: that statement by by Senator Mansion reported by The.
- 28:18Speaker 8: Hill, Well, I will admit to you it's it's just
- 28:22Speaker 8: you and me talking quietly amongst ourselves. Yeah, yeah, I forgot.
- 28:26Speaker 8: I forgot the status of that bill. I covered it,
- 28:28Speaker 8: and I thought did that pass? I forgot the past.
- 28:32Speaker 8: A lot happened in the session. It lasts a long time.
- 28:34Speaker 8: It did though it passed in March, weeks before the
- 28:38Speaker 8: session actually came to an end. You know. So ranked
- 28:41Speaker 8: choice voting means that as the voter, you go in
- 28:46Speaker 8: and you picked your first choice, your second choice, your
- 28:48Speaker 8: third choice, and if nobody gets an out and out majority,
- 28:53Speaker 8: then those those votes essentially are consolidated and the third choice,
- 28:59Speaker 8: the third third highest vote getter gets peeled away and
- 29:04Speaker 8: then the first and second or added up. The reasons
- 29:08Speaker 8: that were stated by lawmakers who wanted to do this,
- 29:11Speaker 8: it's not something happening in What's Virginia, but they say
- 29:13Speaker 8: that it confuses voters. They think that, you know, the
- 29:18Speaker 8: the leading vote getter should plainly get should be called
- 29:22Speaker 8: the winner, whether whether it's a plurality or a majority.
- 29:25Speaker 8: So those are the reasons. I was a little surprised
- 29:28Speaker 8: to see mans coming out on this after vote after
- 29:31Speaker 8: the dog left the doghouse, but you know, he has
- 29:36Speaker 8: been passionate about ranked choice voting as part of his
- 29:40Speaker 8: campaign to empower voters in the middle. He's inspired by
- 29:44Speaker 8: his former Senate colleague Lisa Murkowski, who is a US
- 29:49Speaker 8: center by virtue of ranked choice voting in Alaska. One
- 29:53Speaker 8: won her election that way, so it felt a little,
- 29:57Speaker 8: too little, too late to affect West Virginia politics, but
- 30:00Speaker 8: it is interesting commentary by former Senator Mansion.
- 30:04Speaker 4: All Right, Rab, we're gonna let you go.
- 30:05Speaker 6: I know you got to kind of keep a close
- 30:07Speaker 6: eye on things going on with the in a Charleston
- 30:09Speaker 6: court room today. I appreciate it. We'll be listening and
- 30:12Speaker 6: following along on the website and social media. Thanks a lot, man, Hey,

- 30:36Speaker 6: not the putting a stop to things that aren't happening.
- 30:39Speaker 6: Yet that seems to be a focus of a lot
- 30:42Speaker 6: of our elected leaders is we want to pass things
- 30:47Speaker 6: that aren't happening just to make sure they don't.
- 30:52Speaker 4: I don't know, I just I whatever, I just we
- 30:56Speaker 4: seem to do that a lot.
- 30:58Speaker 6: Uh Texas, Dave, where's the push back on Trump and

- 35:00Speaker 6: that you can go to the website and read the
- 35:01Speaker 6: Story wv metronews. Dot com we are just a few
- 35:04Speaker 6: days away from our SISTER station v one hundred's yard
- 35:08Speaker 6: sale Happening At ladley Field at Charleston, on saturday same
- 35:11Speaker 6: day As the east, endyard sales so a lot of
- 35:13Speaker 6: yards sailing going on over the valley. That Day set
- 35:16Speaker 6: up starts at six fifteen in the morning, for vendors
- 35:19Speaker 6: and the sale starts. At eight if you are a
- 35:21Speaker 6: vendor FOR the v one hundred, yard sale you cannot
- 35:24Speaker 6: show up at eight o'clock and think that you're going
- 35:26Speaker 6: to be able. To sell it doesn't work that way
- 35:28Speaker 6: because there's going to be people standing in line who
- 35:30Speaker 6: get in at. That point you got to get there
- 35:32Speaker 6: well before six fifteen is when. It starts doesn't necessarily
- 35:35Speaker 6: have to be there at, six fifteen but you got
- 35:37Speaker 6: to be, there early not. At eight not when. It
- 35:38Speaker 6: starts you will not be allowed to, set, up okay
- 35:40Speaker 6: so please note that, for vendors once you have unloaded,
- 35:45Speaker 6: your car you must move it can't leave it. On
- 35:47Speaker 6: site if you have stuff left over that you don't
- 35:50Speaker 6: want to take home with you, or whatever or wherever you.
- 35:52Speaker 6: Came from the folks At The mountain mission are going
- 35:55Speaker 6: to be on site to take your donations air as
- 35:59Speaker 6: to please keep your. Airs clean you cannot sell food
- 36:01Speaker 6: we have taken. Care of we've got. The food we
- 36:04Speaker 6: got the exclusive on the. Food there we're not. Selling
- 36:06Speaker 6: it but there's food vendors that we have contracted out
- 36:09Speaker 6: to that'll. Be there and remember from a, traffic standpoint
- 36:13Speaker 6: there is only one way To. Ladley field you got
- 36:15Speaker 6: To take Washington to Elizabeth de laidley and get in
- 36:18Speaker 6: line and prepare to wait for just a. Little while
- 36:20Speaker 6: this is for. The vendors, of course it all ends,
- 36:21Speaker 6: at noon and if you're, a vendor you need to
- 36:23Speaker 6: be off the lot by. One o'clock but the big
- 36:27Speaker 6: thing to remember again, for vendors can't just show up
- 36:30Speaker 6: at eight o'clock and think that.
- 36:31Speaker 4: You're going to be able to get on. The lot
- 36:33Speaker 4: that's not going.
- 36:33Speaker 6: To work they start at six point fifteen getting folks
- 36:36Speaker 6: lined up and. In there you also have to provide your.
- 36:38Speaker 4: Own tables we.
- 36:39Speaker 6: Are not in the, table business so you've got to
- 36:41Speaker 6: bring your. Own tables it all ends. At twelve everybody's
- 36:44Speaker 6: got to be done. By one so if you're still
- 36:46Speaker 6: negotiating over That porcelain elvis head that, you need keep
- 36:53Speaker 6: in mind that you're going to have to take your
- 36:56Speaker 6: negotiating somewhere else because you've got to be off a
- 36:58Speaker 6: lot by. One, o'clock well we've got information posted ABOUT
- 37:02Speaker 6: it v one hundred on the website. Social media if
- 37:04Speaker 6: you need any, more Information contact tracy at the front
- 37:06Speaker 6: desk three zero four three four two eight one. THREE
- 37:10Speaker 6: one i mean KNOCK out a couple of text or
- 37:13Speaker 6: text line is a buzz. In today Text says i'm,
- 37:16Speaker 6: AN independent i Disagree with republicans on a LOT and
- 37:19Speaker 6: I think magas have a. Mental disorder with, That said
- 37:22Speaker 6: i'm not Upset about republicans closing. Their primary it's a,
- 37:26Speaker 6: chicken move but it's, their primary and.
- 37:29Speaker 4: There's a lot of people that feel that. Same way.
- 37:31Speaker 6: YOU know i mean bottom line is the party can
- 37:34Speaker 6: choose what they want. To do, you know this is
- 37:36Speaker 6: not a, state issue that's Not a Secretary of state's
- 37:38Speaker 6: office or anything.
- 37:39Speaker 4: Like that this is.
- 37:39Speaker 6: The parties the parties can make their, own rules and
- 37:42Speaker 6: they wanted to. Do that they wanted to close. The
- 37:44Speaker 6: primary now is that going to be a smart move on?
- 37:46Speaker 6: THEIR PART i i have a tendency to, think no
- 37:50Speaker 6: because statistics have proven that independence more often than not
- 37:54Speaker 6: ten to Vote for republican and, conservative candidates not. EVERY
- 37:58Speaker 6: time i don't think it's a very smart move on.
- 38:01Speaker 6: Their part, but hey, You know i'm Not a, republican
- 38:03Speaker 6: anymore so they can do what.
- 38:05Speaker 4: They want so that's where. They are, TECH says.
- 38:12Speaker 6: I think preventative laws are not a, bad thing especially
- 38:15Speaker 6: if the issue is happening elsewhere and is. Foreseeable here
- 38:19Speaker 6: different take, On that.
- 38:21Speaker 4: Tech.
- 38:21Speaker 6: SAYS dave i am an independent voter that's helped To.
- 38:24Speaker 6: Elect republicans since they don't need, MY vote i will
- 38:27Speaker 6: make sure not To. Vote republicans that.
- 38:30Speaker 4: Is a two, way street.
- 38:33Speaker 6: You know, and AGAIN as, i said the statistics have
- 38:37Speaker 6: proven nation why that independents do tend To, vote republican
- 38:41Speaker 6: or at least vote for conservative candidates more than They do.
- 38:43Speaker 6: Democratic candidates but, you know there's. A method they, studied
- 38:47Speaker 6: it they made, the decision.
- 38:49Speaker 4: So we'll see.
- 38:50Speaker 6: What happens wouldn't be surprised if it changes though at,
- 38:53Speaker 6: some point wouldn't. Be surprised no inside info. Or anything
- 38:56Speaker 6: i'm JUST saying i wouldn't be surprised if, it changes
- 38:58Speaker 6: because it wasn't totally popular Within The. Republican party if
- 39:01Speaker 6: you remember when they made, that decision there Were several
- 39:04Speaker 6: republicans that fought it, and, said no we don't want
- 39:06Speaker 6: to turn our back on these independence but in the
- 39:09Speaker 6: end they ended up losing. That Battle midave allen Showing Five,
