- 0:24the statements with the following language. Please find attached to
- 0:27the quotable statement on behalf of Miss Maxwell, emphasis applied.
- 0:31The statement was intended to be a single, one time only,
- 0:35comprehensive response quoted in full to Miss Roberts December thirtieth,
- 0:39twenty fourteen, allegations that would give the media Miss Maxwell's response.
- 0:44The purpose of the preparatory statement was to inform the
- 0:47media recipients of its intent Miss Robert's statement controverting defendants facts.
- 0:54Miss Roberts disputes that any part of the defendant's press
- 0:57release is consistent with those two of Barton's purposes. Indeed,
- 1:01Miss Roberts disputes this and any statement relating to Barton's
- 1:05purposes as explained above. Next, Miss Roberts disputes that the
- 1:09statement was intended to be a single, one time only,
- 1:12comprehensive response quoted in full to Miss Roberts, December thirtieth,
- 1:17twenty fourteen, allegations that would give the media miss Maxwell's response.
- 1:22First Miss Roberts disputes this and any statement relating to
- 1:26Barton's intent as explained above. Second Miss Roberts disputes that
- 1:30anyone intended the press release to be a one time
- 1:33only comprehensive response. The record says otherwise. Gal repeatedly issued
- 1:39this statement via email and over the phone for months
- 1:42on end. Next defendant states, the purpose of the preparatory
- 1:45statement was to inform the media recipients of this intent.
- 1:49First Miss Roberts disputes this and any statement relating to
- 1:53Barton's intent as explained above. Second Miss Roberts disputes that
- 1:57anyone intended the press release to be a one time
- 2:00only comprehensive response. The record evidence says otherwise. Gal repeatedly
- 2:05issued this statement via email and over the phone for
- 2:09months on end. Next to the defendant states, the purpose
- 2:12of the preparatory statement was to inform the media recipients
- 2:16of this intent. First Miss Roberts disputes this and any
- 2:19statement relating to Barton's purpose as explained above. Second, Miss
- 2:23Roberts' disputes that the press release was to inform the
- 2:26media of anything. Defendant issued a press release, instructed them
- 2:30to publish it by telling them it was quotable seemacauley

- 2:39zero zero nine SUPRA, and hired a press agent to
- 2:42feed it to the press. Question did Miss Maxwell retain
- 2:46the services of you and your firm? Answer? Yes, she did.
- 2:49Question is it your belief that the agreement was in
- 2:52effect on January two, twenty fifteen. Answer yes. Question do
- 2:58you recall the terms of that agreement? Answer well, it
- 3:01was a re establishment of an existing agreement, so we
- 3:05go back to the original agreement. It was to provide
- 3:07public relations services to Miss Maxwell. In the matter of
- 3:11Roberts and her activities. C. McCauley declaration at Exhibit six
- 3:16gu deposition. The record evidence shows that defendants intent was
- 3:21for the press to publish her press release. Any other
- 3:24interpretation is not only contrary to logic but unsupported by
- 3:28the record. Defendants purported facts twenty five Miss Roberts' activities
- 3:34to bring light to the rights of victims of sexual abuse.
- 3:37Miss Roberts has engaged in numerous activities to bring attention
- 3:41to herself, to the prosecution and punishment of wealthy individuals
- 3:45such as Epstein, and to her claimed interest to bringing
- 3:49light to the rights of victims of sexual abuse. Miss
- 3:53Robert's statement controverting defendance facts agreed to the portion of
- 3:57defendants assertion in bold font. Miss Roberts not engaged in
- 4:00activities to bring attention to herself. Rather, she has taken
- 4:04action to aid in the prosecution of her abusers, and
- 4:08she seeks to bring light to the rights of victims
- 4:10of sexual abuse. Defendants Purported Facts twenty six. Miss Roberts
- 4:16created an organization, Victims Refuse Silence Incorporated, a Florida corporation,
- 4:22directly related to her alleged experience as a victim of
- 4:25sexual abuse. Miss Robert's statement controverting Defendants facts. Miss Roberts
- 4:31created Victims Refuse Silence Incorporated in order to help other
- 4:35sexually trafficked victims find the resources they need to recover
- 4:38and heal. See Victims Refuse Silence dot Org. Defendants Purported Facts.
- 4:44The goal of Victims Refuse Silence was and continues to
- 4:47be to help survivors surmount the shame, silence, and intimidation
- 4:52typically experienced by victims of sexual abuse. Towards this end,
- 4:56Miss Roberts has dedicated her professional life helping victims of
- 5:01sexual trafficking. Miss Robert's statement Controverting Defendants Facts agreed Defendants
- 5:07Purported Facts twenty eight. Miss Roberts repeatedly has sought out
- 5:12media organizations to discuss her alleged experience as a victim
- 5:16of sexual abuse Miss Robert's statement Controverting Defendants facts denied.
- 5:21Miss Roberts was approached by numerous media outlets and refused
- 5:25to speak to most of them. Media organizations sought her out,
- 5:29she did not seek them out. See McCauley declaration at
- 5:32Exhibit thirty five, an email from Sharon Churcher seeking to
- 5:36interview Miss Roberts the Defendants Purported Facts twenty nine. On
- 5:42December thirtieth, twenty fifteen, Miss Roberts publicly filed an entirely
- 5:47unnecessary joined oer motion laden with unnecessary, lurid details about
- 5:52being sexually abused as a minor victim by wealthy and
- 5:55famous men and being trafficked all around the world as
- 5:58a sex slave. Miss Robert's statement controverting defendants facts see
- 6:05Miss Roberts paragraph seven Supra listing multiple reasons why details
- 6:09were in fact necessary Defendants Purported Facts thirty the Miss
- 6:14roberts alleged purpose in filing the joined her motion was
- 6:17to vindicate her rights under the CVRA, expose the government
- 6:22secretly negotiated non prosecution agreement with Epstein, shed tremendous public
- 6:27light on Epstein and other powerful individuals that would undermine
- 6:32the agreement and support the CVRA. For Miss Roberts's request
- 6:36for documents that would show how Epstein used his powerful
- 6:40political and social connections to secure a favorable plea deal,
- 6:44and the government's motive date Epstein and his co conspirators.
- 6:48Miss Robert's statement controverting defendants facts see Miss Roberts paragraph
- 6:53seven Supra. Listing multiple purposes of Miss roberts lawyers filing
- 6:58the motion the defend Since purported facts number thirty one,
- 7:02Miss Roberts has written the manuscript of a book she
- 7:05has been trying to publish, detailing her alleged experience as
- 7:08a victim of sexual abuse and of sex trafficking in
- 7:12Epstein's alleged sex scheme. Miss Roberts statement controverting defendant facts.
- 7:17See Miss Roberts Paragraph fifty two infra explaining that the
- 7:21context of this statement is misleading defendants purported facts Number
- 7:26thirty two. Republication alleged by Miss Roberts. Miss Roberts was
- 7:31required by interrogatory number six to identify any false statements
- 7:35attributed to Miss Maxwell that were published globally, including within
- 7:39the Southern District of New York, as Miss Roberts alleged,
- 7:42and paragraph nine of Count one of her complaint. In response,
- 7:46Miss Roberts identified the January twenty fifteen statement and nine
- 7:51instances in which various news media published portions of the
- 7:55January twenty fifteen statement in news articles or broadcast story.
- 8:00Miss Robert's statement controverting defendant facts. Miss Roberts objects to
- 8:05this paragraph in its entirety, starting with the bolded heading
- 8:09republication alleged by Miss Roberts. There is no republication as
- 8:14a matter of law in this case, as explained by
- 8:17Miss Roberts's memorandum of law. Accordingly, Miss Roberts is not
- 8:21and has not alleged republication, as noted in her objection
- 8:25that it is defendant, who possesses the knowledge as to
- 8:29where the defamatory statements were published. Unsurprisingly, Defendant failed to
- 8:33comply with Miss roberts discovery requests. On the same as
- 8:38Defendant already knows. Miss Roberts provided a sampling of defendants
- 8:42defamatory statements published by the news media, as identification of
- 8:47an exhaustive responsive list would be unduly burdensome. This, of course,
- 8:51is because defendant caused her statement to be published in
- 8:55an enormous number of media outlets. Miss roberts full response
- 8:59to the interrogatory number six is below. As the court
- 9:02can see, these nine instances were in good faith effort
- 9:05to provide some samples, as it would be virtually impossible
- 9:08to provide them all below. Miss Roberts has also put
- 9:12forth an exhaustive expert report and expert testimony from Jim
- 9:17Jansen regarding the dissemination of defendants tofamatory press release. Miss
- 9:23Roberts objects because the information interrogatory above is in the
- 9:27possession of defendant, who has failed to comply with her
- 9:30production obligations in this matter, and has failed to comply
- 9:33with her production obligations with this very subject matter. See
- 9:37document requests number fifteen from Robert's second request for production
- 9:41of documents to defendant Glenn Maxwell. Maxwell has not produced
- 9:46all URL or Internet addresses for any Internet version of
- 9:51such publication that she directed her agent, Rosscau ascend. Miss
- 9:55Roberts further objects because the information requested above is in
- 9:59the p possession of Defendant's agent, who caused the false
- 10:02statements to be issued to various media outlets. Miss Roberts
- 10:06has not had the opportunity to depose Maxwell's agent, Ross Gau. Therefore,
- 10:11this answer remains incomplete. Consequently, Miss Roberts reserves the right
- 10:16to modify and or supplement her responses as information is
- 10:20largely in the possession of the defendant and or agent.
- 10:23Miss Roberts objects to the interrogatory that violates Rule thirty three,
- 10:28as its subparts, in combination with other interrogatories, exceed the
- 10:32allowable twenty five interrogatories. Miss Roberts objects to this request
- 10:37because it is in the public domain. Miss Roberts also
- 10:41objects in that it seeks information protected by the attorney
- 10:44client work privilege and any other applicable privilege stated in
- 10:48the general objections. Notwithstanding such objections, Miss Roberts has already
- 10:54produced documents supplements such responsive documents with the following list
- 10:58of publications. While the identification of an exhaustive response list
- 11:02would be unduly burdensome, it is an effort to make
- 11:05a good faith effort towards compliance. Miss Roberts provides the
- 11:09following examples, which are incomplete based on the aforementioned reasons,
- 11:14and then that goes on to list a bunch of
- 11:16different Internet articles defendants purported facts number thirty three. In
- 11:21none of the nine instances was there any publication of
- 11:24the entire January twenty fifteen statement Miss Robert's statement controverting
- 11:29defendance facts. While there may be certain publications who did
- 11:33not print every word of Defendant's lengthy press release, most
- 11:36publications quoted the most salient to the point parts of
- 11:40the defendant statement that call Miss Roberts a liar. In
- 11:44each of the nine articles listed above, the defamatory statement
- 11:48as articulated by the complaint, as identified by the court
- 11:51as actionable, is published. See Roberts versus Maxwell one six
- 11:55five FSupp Dot three D one for seven one fifth
- 12:00fifty two SDNY twenty sixteen. Statements that Robert's claims against
- 12:05defendant are untrue, have been shown to be untrue, and
- 12:08our obvious lies have a specific and readily understood factual,
- 12:12meaning that Roberts is not telling the truth about our
- 12:15history of sexual abuse and the defendant's role, and that
- 12:18some verifiable investigation has occurred and come to a definitive
- 12:23conclusion proving that fact. Second in these statements, as they
- 12:27themselves allege, are capable of being proven true or false,
- 12:31and therefore constitute actionable fact and not opinion. Miss Roberts
- 12:35also put forth extensive evidence of the mass distribution of
- 12:39defendants defamatory statements to over sixty six million viewers through
- 12:43her expert witness Jim Jansen ce McCauley declaration at Exhibit
- 12:47twenty four Expert Report of Jim Jansen. All Right, folks,
- 12:51we're going to wrap up this episode here and in
- 12:53the next episode we'll keep it going. All of the
- 12:56information that goes with this episode can be found in
- 13:00the description. Max
