- 0:00Speaker 1: Hi there, everyone.
- 0:01Speaker 2: Happy Friday. It's four o'clock in New York with just
- 0:03Speaker 2: 60 days, 60 days to go until the midterm. States
- 0:07Speaker 2: are now standing up to Donald Trump's unconstitutional attempts to
- 0:11Speaker 2: seize control of our elections. Despite the president's push to
- 0:14Speaker 2: crack down on mail-in voting, the first midterm ballots are
- 0:18Speaker 2: now in the mail. Today, North Carolina started sending out
- 0:21Speaker 2: ballots ahead of November's elections there. As the New York
- 0:24Speaker 2: Times reports, quote, state election officials said they would send
- 0:28Speaker 2: their first batch of absentee ballots just after midnight Friday
- 0:32Speaker 2: to the more than 46,000 voters who have requested them.
- 0:36Speaker 2: Then next Wednesday, Alabama will start mailing out their absentee ballots.
- 0:41Speaker 2: And by mid-September, all states must send out ballots to
- 0:44Speaker 2: the U.S. troops and other overseas voters. Even as Americans
- 0:48Speaker 2: start casting their ballots, Trump refuses to give up on
- 0:52Speaker 2: his effort to disenfranchise voters and suppress the vote. Just yesterday,
- 0:57Speaker 2: the Justice Department filed another emergency appeal with the Supreme Court,
- 1:01Speaker 2: The Trump administration wants the justices to lift a temporary
- 1:05Speaker 2: order that is right now blocking the Postal Service from
- 1:09Speaker 2: implementing Donald Trump's desired executive order to curb mail-in ballots.
- 1:15Speaker 2: While Trump spreads his unfounded delusions and disinformation about the
- 1:20Speaker 2: threats of voting by mail, it is worth pointing out
- 1:23Speaker 2: at this point that it is Donald Trump's preferred method
- 1:27Speaker 2: of casting a ballot. Just last month, Donald Trump voted
- 1:31Speaker 2: by mail. again in the state of Florida. Meanwhile, MS
- 1:35Speaker 2: Now has new reporting on the Department of Homeland Security's
- 1:38Speaker 2: efforts to amplify Trump's debunked election lies. As we have
- 1:42Speaker 2: covered here during these hours all week, DHS is rapidly
- 1:46Speaker 2: expanding its push to hunt down examples of non-citizens who
- 1:51Speaker 2: appear on the voter rolls. So far, they're only finding
- 1:54Speaker 2: a handful of possible cases to investigate. Quote, across the
- 1:58Speaker 2: nine states reportedly targeted in the surge, Some said they
- 2:01Speaker 2: had yet to hear from Homeland Security about any possible
- 2:05Speaker 2: voter fraud investigations. Others were subpoenaed this week for voting
- 2:09Speaker 2: history on what amounted to a small number of individuals
- 2:12Speaker 2: compared to the state's voting populations. Though more subpoenas could come,
- 2:17Speaker 2: they haven't come close to the tens of thousands of
- 2:20Speaker 2: potential non-citizens the Trump administration claims to have identified on
- 2:25Speaker 2: voter rolls. An unnamed DHS spokesperson telling MSNOW, They won't
- 2:30Speaker 2: comment on active investigations, but they did say this, quote,
- 2:34Speaker 2: they're actively rooting out and investigating election fraud wherever it
- 2:38Speaker 2: can be found, end quote. Trump's attack on our elections
- 2:42Speaker 2: is where we begin again today with the Reverend Al Sharpton.
- 2:45Speaker 2: He's the host of MSNOW's Politics Nation, the founder of
- 2:48Speaker 2: the National Action Network. Also with me on set, MSNOW
- 2:52Speaker 2: legal analyst Andrew Weissman is here. And Ian Bassin joins us.
- 2:56Speaker 2: He's the co-founder and executive director at Protect Democracy. He
- 3:00Speaker 2: served as associate White House counsel to President Barack Obama. Ian,
- 3:04Speaker 2: I start with you.
- 3:05Speaker 3: This is....
- 3:09Speaker 2: One of those stories that we cover as unlikely because
- 3:14Speaker 2: it's both unconstitutional and illegal, but because the Supreme Court
- 3:20Speaker 2: has done so much of Trump's bidding, we do sort
- 3:24Speaker 2: of have this white knuckle approach, or at least I do,
- 3:27Speaker 2: in the same way we did with birthright citizenship, which
- 3:29Speaker 2: was equally unconstitutional and unlawful. What are you watching and
- 3:34Speaker 2: girding for?
- 3:36Speaker 3: Well, I think the first thing is the tell on
- 3:39Speaker 3: all of this. As you said, Nicole, when we started,
- 3:41Speaker 3: we're 60 days out from the midterm elections. And you
- 3:43Speaker 3: know what Donald Trump is not talking about? Why voters
- 3:47Speaker 3: should vote for him and his party. What he is
- 3:50Speaker 3: talking about is how he wants to stop people from
- 3:52Speaker 3: being able to vote. And there is kind of the
- 3:54Speaker 3: bottom line summary of what's going on, which is this
- 3:56Speaker 3: is an act of desperation and weakness. Although, obviously, as
- 4:00Speaker 3: you note, it's a dangerous one. But the reason that
- 4:04Speaker 3: they're going to the Supreme Court, and I would note
- 4:06Speaker 3: that they went to the Supreme Court, as you said,
- 4:08Speaker 3: just the other day, before the case that they're asking
- 4:12Speaker 3: the Supreme Court to weigh in on had even been
- 4:14Speaker 3: resolved at the district court level, let alone the circuit
- 4:18Speaker 3: court level. That's another act of desperation. They know they're
- 4:21Speaker 3: losing these cases in the lower courts. They have a
- 4:24Speaker 3: terrible track record. And while the Supreme Court has, as
- 4:27Speaker 3: you note, given Trump way too much ground to cover
- 4:32Speaker 3: and run in in all of his attacks on our democracy,
- 4:35Speaker 3: they haven't quite given him the control over the elections
- 4:38Speaker 3: that he wants, nor has his party in the United
- 4:41Speaker 3: States Senate. So I think he's going to lose these
- 4:43Speaker 3: cases in court. And regardless, what we all need to
- 4:46Speaker 3: know as voters is when someone attacks our right to vote,
- 4:49Speaker 3: Our response is to go out and exercise it, to
- 4:52Speaker 3: exercise it early, to vote early if we're voting by mail,
- 4:55Speaker 3: or to vote in person, but to not let this
- 4:57Speaker 3: intimidate us.
- 4:59Speaker 2: It also feels like there's this thing in that polls
- 5:03Speaker 2: can't pick up. And anyone that works on campaigns, if
- 5:07Speaker 2: you're winning in the polls, you know not to trust
- 5:09Speaker 2: them completely. If you're losing the polls, you maybe overweigh
- 5:14Speaker 2: this thing that doesn't show up in the polls. You say,
- 5:16Speaker 2: maybe we're only losing by less or maybe we're actually winning.
- 5:19Speaker 2: But there is a piece that's unprecedented. And so there
- 5:22Speaker 2: isn't a model for the actual right to vote being
- 5:25Speaker 2: taken away. And when we covered the turnout model in Hungary,
- 5:31Speaker 2: when Viktor Orban is kicked out, it wasn't predicted that
- 5:35Speaker 2: that would be the outcome. I wonder how much just
- 5:38Speaker 2: in terms of your understanding of authoritarian attempts and populations
- 5:45Speaker 2: efforts to reach back for the steering wheel. I wonder
- 5:48Speaker 2: how much you feel is out there that we're not
- 5:49Speaker 2: going to pick up or know about until election night.
- 5:53Speaker 3: Yeah, I mean, look, I do think that every time
- 5:55Speaker 3: Donald Trump does something to attack people's right to vote,
- 5:58Speaker 3: to attack our democracy, our constitutional norms, it does have
- 6:02Speaker 3: a political consequence and a backlash against him. We've seen
- 6:05Speaker 3: that repeatedly. We've seen attacks on the right to vote
- 6:07Speaker 3: in Georgia in recent years, particularly on communities of color
- 6:10Speaker 3: and black voters in Georgia that resulted in a surge
- 6:13Speaker 3: in in voting from those communities, because people don't like
- 6:15Speaker 3: having their rights taken away. And I think there's a
- 6:18Speaker 3: lot of irony in what Donald Trump is doing here.
- 6:21Speaker 3: You know, the polling does suggest that the voters who
- 6:25Speaker 3: are more energized to vote are those who oppose Trump's policies.
- 6:30Speaker 3: And the ones who are less energized, the ones who
- 6:32Speaker 3: are sort of more low propensity voters that tend to
- 6:34Speaker 3: come out when Donald Trump is on the ballot, are
- 6:37Speaker 3: those who the Republicans, frankly, need if they hope to
- 6:40Speaker 3: salvage what is looking like a bloodbath in the midterms.
- 6:43Speaker 3: And the irony here is if you make it harder
- 6:46Speaker 3: for people to vote, if you make it harder for
- 6:48Speaker 3: people to vote by mail and otherwise, the people who
- 6:50Speaker 3: are going to actually crawl over broken glass to vote
- 6:52Speaker 3: are the ones who are more energized and the ones
- 6:54Speaker 3: who might give up are the ones Trump most needs.
- 6:57Speaker 3: So I think the thing we might discover on election
- 7:00Speaker 3: night is that all of Trump's machinations actually came back
- 7:04Speaker 3: to kind of bite him in the.
- 7:06Speaker 1: Yeah.
- 7:07Speaker 2: Yeah. I mean, the history of disenfranchising voters and suppressing
- 7:13Speaker 2: the vote and then this this gray area where they
- 7:17Speaker 2: like to flex the most, just making it more difficult,
- 7:20Speaker 2: getting rid of drop boxes, getting rid of the right
- 7:25Speaker 2: to hand out water in line. I mean, this is
- 7:27Speaker 2: a story as old as time in certain parts of
- 7:30Speaker 2: our country. I wonder what you make of the preparations
- 7:33Speaker 2: to not just resist that, but overcome it with turnout.
- 7:37Speaker 1: I believe there will be huge turnouts. I think that
- 7:40Speaker 1: the fact that Donald Trump's election strategy Is to stop
- 7:46Speaker 1: people from voting.
- 7:47Speaker 2: Like that's it. That's the whole thing.
- 7:48Speaker 1: Just just stop. I'm not even going to try to win.
- 7:51Speaker 2: Correct.
- 7:52Speaker 1: In fact, my big candidate in Texas, I'm going to
- 7:54Speaker 1: talk about how he can't even dress. I'm not trying
- 7:57Speaker 1: to sell these guys. My strategy is to stop people
- 8:01Speaker 1: from voting, which makes people vote. My second point is
- 8:06Speaker 1: they have he's not given his people. or the American
- 8:09Speaker 1: public in general, a motivation to vote. They were voting
- 8:13Speaker 1: last time, though I may have disagreed with them, because
- 8:17Speaker 1: they felt that Biden and Harris had not delivered. They
- 8:21Speaker 1: felt they were being excluded. They felt a certain kind
- 8:24Speaker 1: of way that he sold them about the 2020 election,
- 8:28Speaker 1: on and on and on, too much diversity. He's not
- 8:31Speaker 1: even giving them a reason to vote. In fact, he
- 8:35Speaker 1: doesn't have one because their gas has gone up, the
- 8:38Speaker 1: inflation is choking them, and you have his people that
- 8:42Speaker 1: have voted for him saying openly, I don't think I'm
- 8:45Speaker 1: getting what I want. And he's in a war that
- 8:49Speaker 1: no one sees how we're getting out of it. And
- 8:52Speaker 1: he's going to have a midweek convention that even Republicans
- 8:57Speaker 1: are openly saying, I'm busy, I can't come. So I
- 9:00Speaker 1: really think For someone who has fought him for years,
- 9:04Speaker 1: I'm really saying he's not even on his game because
- 9:07Speaker 1: he usually by now would have a theme and a
- 9:10Speaker 1: rallying cry. And now you're left with him just saying
- 9:14Speaker 1: we're going to stop and shrink the voters on the
- 9:17Speaker 1: other side by having the Supreme Court give us some rulings.
- 9:21Speaker 1: And we'll send J.D. Vance out there to act like
- 9:24Speaker 1: he really knows what he's talking about.
