- 0:02Hi, Jay Fallon. Thank you for listening to the
- 0:05slippery slope. We're very interesting story
- 0:10coming up here. If you're watching on YouTube
- 0:13check it out. Read the story to you the family
- 0:19of killed Afghan. Villager wants more, ADF
- 0:23Personnel to be brought to trial after arrest of former SAS
- 0:29Soldier Oliver shilts. So a rudimentary grave and Rule
- 0:35Afghan in the rule Afghan. Village holds the secret to the
- 0:39first war crimes case to be held in Australia against a member of
- 0:43the country's military. So for more than a decade, the
- 0:47family of farmer and father of two, dad, Muhammad have prayed
- 0:51at his grave in Euros, gone province in southern Afghanistan
- 0:56for the Australian SAS soldiers, involved in his killing to face
- 1:00trial. So more than 11,000 kilometers
- 1:02away. Details of the killing were
- 1:04finally heard this week in a Sydney courtroom.
- 1:08With one decorated essay is veteran, face to charge of War
- 1:12crime, murder. So, Oliver, Jordan Schultz 41 is
- 1:16the first current or former Australian, Defence Force, ATF,
- 1:20member ever. To be charged with war crime, in
- 1:23Australia, after he was arrested in Southern New South Wales last
- 1:27week in relation to the killing yesterday Sydney's Downing
- 1:31Center. Local Court, was told that mr.
- 1:34Schultz was filmed on a helmet camera, shooting the allegedly
- 1:38The unarmed disabled man who is lying still in a wheat field
- 1:42during a raid on his village in 2012.
- 1:45That video was revealed by ABC investigations good old ABC.
- 1:53Don't you love them anyway, revealed by ABC investigations
- 1:57and the Four Corners program in 2020.
- 2:00Sparking a three-year criminal probe, so the arrest was hailed
- 2:05as unprecedented among Australia's Western allies who
- 2:09has so far, resisted trying, their military personnel, for
- 2:13alleged war crimes in civilian courts.
- 2:18So, continuing on this is, however, the trial of mr.
- 2:20Schultz will not go far enough for the family of dad Muhammad
- 2:24who spoke with the ABC from the farm where he died.
- 2:28He said mr. Schultz is not the only man that
- 2:31came here said, Dad, Muhammad's brother Jamshed.
- 2:36Speaking through a translator, do we want those people who took
- 2:39part in this operation? All of them should be arrested
- 2:42and tried all of them, all of them.
- 2:44That's what he says the mr. Muhammad's family lost hope long
- 2:49ago that they would ever see, Justice Afghan Villages first
- 2:53complain to the ADF about the killing months after the 2012
- 2:57rate. However, ATF investigators
- 3:00cleared mr. Schultz concluding, that Dad
- 3:02Muhammad was lawfully killed because he posed a direct threat
- 3:07to this dry. Inside that phrase, every time I
- 3:09see that phrase lawfully killed, whether its military and police.
- 3:12So it always strikes me as very odd because, you know, we can
- 3:17wait, anything can be justified. What can be lawful today in?
- 3:22What is it? March of 2023 can easily be
- 3:26illegal in March 2024 and no longer lawful and then we tend
- 3:31to look at things retrospectively, or was it
- 3:33lawful back? Then can we change the laws?
- 3:36Someone decides that they want. To change what was lawful and
- 3:40start looking at things retrospectively no longer
- 3:44lawfully, kill him. Anyway it's always struck me.
- 3:48As a weird phrase just out of know investigators were told the
- 3:52Afghan man was holding a radio and tactically maneuvering which
- 3:57it's easy to see, okay? When you're in the Heat of the
- 4:01Moment, when you're in a war zone, you're living in a war
- 4:04zone. How someone holding holding
- 4:08prayer beads, as we find out later, that's apparently what he
- 4:11was doing holding prayer beads and maybe wriggling around.
- 4:13Maybe your perception of it. Is he is a threat anyway, so mr.
- 4:19Schultz was granted bail yesterday after Sydney's Downing
- 4:22Center. Local Court heard.
- 4:24He was at risk from Islamic extremist groups and Taliban
- 4:28sympathizes inside prison. Do you think it's it's a little
- 4:31strange that in Australia. We have Islamic Miss groups and
- 4:36Taliban thin sympathizers inside our prisons.
- 4:41One would think that possibly if you are a Taliban sympathizer or
- 4:46you're in a Islamic extremist group participant, the maybe the
- 4:51Australian government could put you on a plane and send you back
- 4:55to Afghanistan? You know, you're a sympathizer,
- 4:59go back or whatever. If you love the Taliban, so
- 5:03much, Coco go live. Give go and live with the
- 5:07Taliban anyway. So magistrate, Jennifer Atkinson
- 5:11told the bail hearing that the helmet cam video of The Killing
- 5:15showed that mr. Muhammad was quiet and not
- 5:18resisting when mr. Schultz shot him.
- 5:21She said mr. Mohammed could be seen lying on
- 5:24his back and holding prayer beads in one of his raised hands
- 5:29after conversation with other Patrol members Shields turns
- 5:32towards the Afghan man and shoots towards him three.
- 5:35Three times. Magistrate Atkinson said the man
- 5:39appears to go limp after the first shot and is not moving.
- 5:43Now, look, if you look at this evidence and I'm not going, I'm
- 5:46not giving any, you know, I'm not saying he's guilty or not
- 5:50guilty. I just I was thinking when you
- 5:54looking back it's easy to look back at video and slow things
- 5:58down and have a good look at what you can see on the video
- 6:01and all your, this is what's actually happening when you're
- 6:06in a situation and you have to make a decision quickly.
- 6:11Your perception at that time can be completely skewed by so many
- 6:16by the situation that you're in. What you think.
- 6:19You see may not be actually what is happening.
- 6:23Your perception can be very different to the facts on the
- 6:28ground but you're in a war, a war zone.
- 6:32And you have to make a decision quickly.
- 6:35What someone can see is being prayer beads when you when
- 6:38you're sitting there watching a video and able to analyze it,
- 6:41you may think is actually a bomb Detonator in their hand and
- 6:44there. Fiddling with that.
- 6:46Your life, you think in your head, your life is under threat.
- 6:51But it's always easy for us to sit there in the comfort of our
- 6:55chairs, and watch a video and think.
- 6:58Oh no, no, no. This is clearly showing the man
- 7:02is guilty. I'm not saying he's not guilty,
- 7:05I just yeah you know when it comes to war zones, think
- 7:13There's always other things to take into account anyway.
- 7:17So goes on to say prosecutors allege mr.
- 7:19Hamid was not involved in active hostilities.
- 7:23Apparently we have to take their word for that.
- 7:26The ADF awarded mr. Schultz, a commendation for
- 7:29gallantry for his service in Afghanistan, but the court was
- 7:33told, he was suspended from Duty days after the Four Corners
- 7:36report and and terminated on medical grounds and February 20
- 7:4121. Speaking with the ABC before the
- 7:44hearing mr. Ma Muhammad's, brother Jem,
- 7:47sheep said, Witnesses and others involvements on the operation.
- 7:51Should also be scrutinized in an open court.
- 7:57I would agree with this if they also brought the politicians
- 8:03into court as well, the people that made the decisions to send
- 8:07the military to Afghanistan Afghanistan, which in my head
- 8:12me, You know, I'm not claiming to be any kind of great
- 8:15intelligence officer here but in my head going to Afghanistan to
- 8:19fight the Taliban was never going to be a good.
- 8:22There's never going to see a good outcome anyway, but you
- 8:25know what, do I know? It goes on to say there were
- 8:29other people with him, it was a complete military Patrol.
- 8:32He said several aircraft landed here, so the family of dad
- 8:36Muhammad has no photos but which to remember him instead the
- 8:41thumb the blood Stay in clothing that he wore when he was killed.
- 8:44I love the way this this article.
- 8:46He's got no photos. I mean, you know, it's a society
- 8:51that's been around a culture has been around for thousands of
- 8:54years and suddenly this group need a photo.
- 8:58Anyway, according to his family, dad Muhammad managed to run the
- 9:01household, despite conditioning stunted growth, in one leg,
- 9:05Muhammad had two daughters a newborn and a toddler at the
- 9:08time of his death, who now have no memory of him.
- 9:11So, The whole lot equal cells Muhammad as he's obviously a
- 9:15righteous and virtuous person, make sure maybe he was, but I
- 9:18just don't like when they're write it up in his articles.
- 9:21Like obviously we have the bad Australian military man and the
- 9:24humble. Virtuous righteous Afghan man.
- 9:29You know, did no harm never did anything wrong in his life.
- 9:33He was just laying there on his back.
- 9:34Holding his prayer beads. So jump, she was just a teenager
- 9:40at the time and in response to the killing Killing.
- 9:42He took up arms with the Taliban, isn't it?
- 9:45Funny, the war is going on. There is who knows how much
- 9:50blood and violence is follow seen.
- 9:52But when he saw his brother killed, that's when he decided
- 9:56that is what, that was the final straw.
- 9:58That was the straw that broke the camel's back.
- 10:01And he decided he had to take up.
- 10:03He had to take up arms with the Taliban after that.
- 10:06This all this is all Schultz's fault.
- 10:09If Shields hadn't have killed and who killed dad Muhammad, and
- 10:12he wouldn't have taken up arms. That's what they'd have, you
- 10:14believe, reading this. He said the drift Grove his
- 10:17parents to misery and illness. My father has become so
- 10:21debilitated because of his Sorrows, it's the same situation
- 10:24with my mother who is all the time on medication.
- 10:28We suffered Financial damage in the millions in Afghan currency.
- 10:36Look, I'm not going to read the rest of the article and just my
- 10:40this opens up such a massive can of worms, you're in a war zone.
- 10:46What you think is going on? What your perception is can be
- 10:49so different. Towards actually happening.
- 10:54At the end of the day, you'll government sends you into a war
- 10:57zone to fight who they say, is the enemy.
- 11:02And then you are going around making split-second decisions on
- 11:06who is the enemy, who's a threat who was not a threat?
- 11:10The trouble is people who are perceived as not being threat.
- 11:14So many times, as we, as we know happened in Afghanistan and in
- 11:20the Iraq War. So many times people who you'd
- 11:24think well, they're not a threat.
- 11:26And in reality they were And then so innocent soldiers died
- 11:31because they didn't want to kill, you know, women and
- 11:36children, who ultimately had detonators in their hands or
- 11:40guns hidden, things like this and then innocent soldiers, die.
- 11:46So what do you do when you're in a war zone?
- 11:48You're in a war zone. Do you really is?
- 11:55My question, is this going to affect the amount of people that
- 12:00will be volunteering to join and Military?
- 12:05Because if you do something accidentally when you're in a
- 12:09war zone then you run the risk of coming back and being held in
- 12:12civilian court. It's not to say that you should
- 12:15not be held accountable for your actions.
- 12:18If you've done something on purpose, if you gone out of your
- 12:22way to kill person. Unlawfully apparently, But then
- 12:27if we're going to look for justice, these people need
- 12:30Justice. These Afghan is need Justice.
- 12:34Do they need Justice from the one person who pulled the
- 12:37trigger will do? They all known also need just as
- 12:40from the people who made the decisions to send the app to
- 12:44send the military there in the first place.
- 12:50I don't know if I can give my opinion.
- 12:53Opens up can of worms that I think is far too.
- 13:00Well let's just say I can understand why Western why?
- 13:04The other Western allies have been very hesitant at sending
- 13:08their Military Officers to civilian courts.
- 13:13I don't know where this is going to go this cool case.
- 13:15It'll be very interesting to follow.
- 13:17Let me know what you think. I think it's very dangerous, to
- 13:20be honest, very dangerous for our Australian military
- 13:24personnel. We already have a very high
- 13:32suicide rate amongst the Australian military.
- 13:39So let me know. Does this kind of action
- 13:42bringing A military personnel to a civilian Court.
- 13:48Like this does this kind of action actually bring Justice
- 13:53and is it helpful is it something that we should be
- 13:56doing? Let me know what you think.
- 14:02That's all I got to say on it. Thanks for listening to the
- 14:05slippery slope. Let me know what you think.
- 14:02That's all I got to say on it. Thanks for listening to the
- 14:05slippery slope.
