- 0:00Speaker 1: What's up, everyone, and welcome back to the Epstein Chronicles.
- 0:05The trial of Nicholas Tartaglioni is well underway at this point,
- 0:10and we have heard some pretty interesting testimony already, and
- 0:14today we're gonna talk about some of that testimony that
- 0:18was given by an ex farm hand of Nicholas Tartaglioni.
- 0:22So let's just jump right into the article and let's
- 0:26see what the Lowhud and Jonathan Bandler have for us.
- 0:31This article was published by The Low Hud and the
- 0:35headline drug conspiracy and killings detailed in Tartaglioni Trial. A
- 0:42farm hand of X cop Nicholas Tartaglioni detailed for a
- 0:45federal jerry on Wednesday the felt cocaine trafficking operation that
- 0:50led to the killing of four men in Orange County
- 0:53seven years ago, and how his boss directed him to
- 0:56help bury the bodies on his mountain side property. And
- 1:00right off the bat, you see here that things aren't
- 1:03going well for Nicholas Tartaglioni. When the first witness that
- 1:07comes up to the stand and tells the jury that
- 1:10he was involved in burying the bodies. Yeah, that's not
- 1:13a good look for the defendant. Marcos Cruz said he
- 1:17was not present at the Liquid Lounge in Chester on
- 1:20April eleventh, twenty sixteen, when his friend Martin Luna was killed,
- 1:24but was fully aware of Tartaglioni's plan to lure Luna
- 1:28there that day over a drug debt. He did go
- 1:32to the bar afterwards to identify for Tartaglioni the two
- 1:36nephews and a family friend Luna had brought along. He
- 1:40said he declined when Tartaglioni asked if he wanted to
- 1:43take the three home, saying he told his boss they
- 1:46would only call police if allowed to live. And remember, folks,
- 1:50I want you to keep in mind that this is
- 1:52the man that they thought it would be a good
- 1:54idea to put in a jail cell with Jeffrey Epstein.
- 1:58Cruse said tartaglion later told him he had strangled Luna
- 2:02with a zip tie and that he and two enforcers
- 2:05had shot the other three men at Tartaglioni's property. Tartaglioni
- 2:10is facing drug conspiracy, kidnapping, and murder charges in the
- 2:14death of Luna. His nephews, Miguel Luna, and Arbano Santiago
- 2:19and their friend Hector Gutiadis, whose bodies were dug up
- 2:23December twentieth, twenty sixteen, a day after Cruz led FBI
- 2:28agents to the spot where he had filled in the
- 2:31hole eight months earlier. So this guy is a key
- 2:35witness obviously, and him being part of burying the bodies,
- 2:40moving the bodies, and having material information about the murders. Really,
- 2:46since Tartaglioni right here, I don't even know how his
- 2:49defense is going to try and contend anything besides Tartaglioni
- 2:55is the guy. I guess they can try and say
- 2:57that this gentleman was the mastermind or something like that,
- 3:02but we've seen time and time again that jurys are
- 3:06way too smart for that nonsense. Cruz has pleaded guilty
- 3:10to his role in the drug conspiracy and as an
- 3:13accessory after the fact to the murder of the four men.
- 3:17He is cooperating with prosecutors in the hope that he
- 3:20can avoid a life sentence in prison and maybe even
- 3:24be released on just the six years he has spent
- 3:27in custody so far. Now, I guess that's a conversation
- 3:31for a different time. But if you help a murder
- 3:35investigation and you didn't actually take part in that murder,
- 3:39and you were helping move the body or whatever, do
- 3:41you think that that person should get a significant amount
- 3:45of time shaved off their sentence if they snitch on
- 3:48their buddies. And I'm always torn with that, because we're
- 3:51relying on the word of a scoundrel who is obviously
- 3:54in trouble themselves. But if we didn't rely on the
- 3:57word of scoundrels like this, very rarely would we have
- 4:01witnesses in situations such as this. Cruz spoke in Spanish
- 4:06through an interpreter as he was questioned by Assistant US
- 4:09Attorney Maureen Comy for more than six hours Tuesday and Wednesday. Now,
- 4:15isn't that interesting. Maureen Comy was also involved in the
- 4:18prosecution of Glenn Maxwell, and that's a common theme when
- 4:23it comes to Jeffrey Epstein and his buddies. It seems
- 4:26like a small handful of prosecutors deal with them. So
- 4:30for those of you who are new to the story,
- 4:32you're going to see the same names pop up over
- 4:34and over and over again. Before Cruse took the stand,
- 4:38Comy warned US District Judge Kenneth Carris and the defense
- 4:42that every time Cruz had recounted the story during preparation
- 4:46for trial, he would vomit at a certain point. But
- 4:50Cruse's spewing wasn't limited to just one point, as he
- 4:53repeatedly leaned down to throw up in a garbage can,
- 4:57with a US Marshall, an FBI agent, and in court
- 5:00staff switching out the garbage cans on several occasions so
- 5:04that the odor would not linger. Well, that's a first.
- 5:07I've never heard of a witness on the stand who
- 5:09needed a barf bag. But I guess when you lived
- 5:12through something traumatic and you got to bury bodies or whatever,
- 5:16it can have some long lasting lingering effects. How the
- 5:21operation played out, Cruz told how the drug trafficking operation
- 5:25was hatched in twenty fifteen after he introduced Tartaglioni to Luna.
- 5:31His boss invested about two hundred thousand dollars, which he
- 5:34told Cruz was his life savings. Cruz detailed an elaborate
- 5:39effort to drive the money to Texas, buy the cocaine,
- 5:42drive the drugs to Florida, and sell it there. When
- 5:46the conspirators couldn't find anyone to drive, Cruse said Tartaglioni
- 5:50said his brother would do it. Hotel records showed that
- 5:53Michael Tartaglioni stayed in a residence in in Houston at
- 5:57two points in December twenty fifteen and January twenty sixteen,
- 6:03but Cruz testified that he was unaware of what he
- 6:06was transporting. Oh yeah, I'm sure he had no idea
- 6:10what was in the vehicle. I mean, I know you're
- 6:12trying to keep your boy out of trouble here and all,
- 6:14but let's be real. Nobody's coming out from Yonkers down
- 6:17to Houston driving a truck home and not knowing what's
- 6:19in it. Cruse said his main role was coordinating between
- 6:23Tartaglioni and Luna in hopes both would pay him. So
- 6:27he was playing the middleman. He hooked the two of
- 6:30them up, and he was hoping that he'd get paid
- 6:33on both ends for doing the connect hooking them up together,
- 6:36and then on the back end of making some dough
- 6:39from the cocaine that's being sold. He could offer no
- 6:43specific dates or months of when the drugs were bought
- 6:47and sold, but the records corroborated the testimony of another
- 6:51investor in the drug conspiracy Luna's construction boss, Jason Sullivan.
- 6:56He is also cooperating witness who testified this week that
- 7:00he helped Tartaglioni lure Luna to the bar, knowing he
- 7:03would likely be killed if he didn't come up with
- 7:06the money. And this is a real life example of
- 7:09what I talk about all the time about getting into
- 7:12the drug game and how it's no joke. If you're
- 7:15not ready to go to the lengths that you see
- 7:17these people going to, the drug game is not for you.
- 7:20And I think way too many people look at the
- 7:22narco trafficking game with rosy colored glasses on, thinking it's
- 7:26all about, you know, hot chicks, cars, money, and while
- 7:30all of that obviously comes with it, in the end,
- 7:33it's not worth it. There's only two outs for you
- 7:36here if you get to this level of narcotics dealing.
- 7:39One you're gonna get clipped, or two you're gonna end
- 7:42up doing a long bid. Tartaglioni enraged after things go south.
- 7:49After Santiago finished selling the initial batch of drugs in Florida,
- 7:53Michael Tartaglioni drove all the proceeds back to Houston, Cruise
- 7:57testified Martin Luna lou there to get the money and
- 8:01meet his suppliers, but he called Cruz to say that
- 8:04he had been double crossed and the money was taken
- 8:07and no drugs turned over. The good old double cross
- 8:11And once again, if you're getting into this game and
- 8:14you're doing it cold and you don't have a real
- 8:16hookup or real connect, good luck. Tartaglioni was enraged when
- 8:21he found out and demanded that Luna find the thieves
- 8:24and get the money back. When that didn't work, Cruise
- 8:27and Luna tried a private investigator, Cruiz Testifight, who told
- 8:31them that the phone numbers Luna thought were the thieves
- 8:34numbers belonged to other people. Tartaglioni eventually sent an associate
- 8:40and enforcer of his Joseph Biggs, took confront Luna. Luna
- 8:44and Cruz took Biggs to a trailer park in Middletown,
- 8:48where Luna said relatives of the thieves lived, but they
- 8:51weren't found. So was it a robbery of Luna getting
- 8:56the money ganked from him or did Luna can talk
- 9:00this whole entire plot so that he could take the money. Now,
- 9:03remember we're talking about drug dealers, gangsters, and thieves. There's
- 9:07no honor here. Bigs, a bodybuilder, Cruz knew only as
- 9:12Jay told Luna that if he didn't come up with
- 9:14the money, there would be blood on his hands. Cruz testified.
- 9:18Cruz said that Luna chose to blame him because he
- 9:21hadn't accompanied Luna to Texas. After that, Luna cut off
- 9:25all contact with the others, and Cruz said he never
- 9:28spoke with him again. Tartaglioni decided by then that Luna
- 9:33had stolen the money himself. Cruz testified and sent Biggs
- 9:37and Gerard benderoth an ex cop and former strongman competitor,
- 9:41to find Luna, but they couldn't because at that point,
- 9:45Luna had gone to Mexico to visit his ailing mother.
- 9:49Once Luna was back, Sullivan offered the plan to get
- 9:52Luna to the bar, which was owned by Michael Tartaglioni.
- 9:56He told him there was construction work there and to
- 9:59provide an estimate. The other men were not expected to
- 10:03accompany him. Crew says he saw the bodies. Cruz testified
- 10:08that he asked Tartaglioni if he could be there when
- 10:11Luna got to the bar, but his boss said he
- 10:14couldn't call me. Question why he had wanted that, because
- 10:18I felt if I could talk to Martin, I could
- 10:20convince him to return the money and end all these problems,
- 10:24he answered in Spanish through an interpreter. When Tartaglioni called
- 10:28him to the bar. Later, Cruse said he saw a
- 10:30blue tarp wrapped around what appeared to be a body.
- 10:34He was shown Miguel, Luna, and Gutierrez in a closet
- 10:38and Santiago in the bathroom. Crew said he was scared
- 10:42for his own life, he said, in addition to thinking
- 10:44the men would contact the police if freed, he told
- 10:48Tartaglioni he didn't want to take them home because he
- 10:51thought his boss was testing them. He testified that he
- 10:54watched Tartaglioni and Benderoth carry the tarp with Luna's body
- 10:59into the back of Tartaglioni's car. Later that night, he
- 11:03said Tartaglioni sent him with Bigs and Benderoff to look
- 11:07for Luna's car so they can move it away from
- 11:09the bar, but they couldn't find it. The next day,
- 11:13he said he didn't see the bodies in the large hole,
- 11:16but filled it with dirt and threw out the blue
- 11:19tarp and duct tape that was next to the grave. Yeah,
- 11:22this is damning testimony for sure. When one of your
- 11:25co conspirators is dropping the dime on you like this,
- 11:28you have little to no hope when the jury starts deliberating.
- 11:33Defense Attorney Ada lisen Ring will resume cross examination of
- 11:37Cruise on Thursday. In the short time she had to
- 11:40question him on Wednesday, she got him to acknowledge that
- 11:43he had repeatedly lied to FBI agents when first confronted
- 11:47him on December nineteenth of twenty twenty. Wait a minute,
- 11:50a guy that just got involved in a murder lied
- 11:53to the FBI. Well, that's a shock. In her opening
- 11:57statement last week, lisen Ring argued that Tartaglioni had no
- 12:01involvement in the drug conspiracy or killings, and was set
- 12:05up by the three cooperating witnesses, who each had powerful
- 12:08motives to lie and minimize their own more significant roles
- 12:13in the killings because they face life in prison otherwise.
- 12:17So it's everybody else's fault, certainly not Nicholas Tartaglioni's fault,
- 12:21just ask them. Meanwhile, the prosecution has evidence that's as
- 12:26high as Mount Everest. So we'll continue to follow along
- 12:29with this one because it's very significant as far as
- 12:32the Jeffrey Epstein overall story goes, and it's going to
- 12:36be interesting to see what else comes out at this trial.
- 12:40All right, folks, that's going to do it for this one.
- 12:42All of the information that goes with the episode can
- 12:45be found in the description box.
