Speaker 5: Thursday edition of the show. Another lovely drive in this
• 1:49
Speaker 5: morning with the rain and whatnot not. As I mean,
• 1:53
Speaker 5: to my knowledge, it's not as many accidents reported this
• 1:55
Speaker 5: morning as there were yesterday. There were a few here
• 1:57
Speaker 5: and there, though, as as you make expack it'll get
• 2:00
Speaker 5: better those we head toward the weekend, of course. The
• 2:02
Speaker 5: announcement was made on Tuesday that Canawa County would move
• 2:05
Speaker 5: their Trick or Treating festivities from tonight's, which is when
• 2:08
Speaker 5: it was originally scheduled, to now Tomorrow night and Halloween Night.
• 2:11
Speaker 5: I had County Commission President of Ben Selango on the
• 2:13
Speaker 5: show yesterday talking about the reasons why. And you know, you,
• 2:16
Speaker 5: as we said yesterday, you're never going to make everyone happy,
• 2:20
Speaker 5: but yes, Trick or Treating is tomorrow night, Halloween Night
• 2:23
Speaker 5: in Canawha County, Halloween Night in Putnam County as well.
• 2:25
Speaker 5: That was the original night over there, all right. Coming
• 2:28
Speaker 5: up a little bit later on, going to introduce you
• 2:30
Speaker 5: to someone named Terra Martinez. She's running for the House
• 2:33
Speaker 5: of Delegates out of Canawha County District fifty four and
• 2:37
Speaker 5: she is an independent. We're going to introduce you to
• 2:39
Speaker 5: her attorney. Rusty web is going to be by the
• 2:42
Speaker 5: program as well, to talk about this opioid settlement. Well,
• 2:46
Speaker 5: you know, I don't want to call it really a settlement,
• 2:49
Speaker 5: but the news that came out of Cabull County, it
• 2:52
Speaker 5: can be quite confusing.
• 2:53
Speaker 4: Where does it go next?
• 2:54
Speaker 5: Rusty to somebody who's been involved in this for some time,
• 2:57
Speaker 5: keeping an eye on this and so he's going to
• 2:59
Speaker 5: join us to wait and on that, plus, your calls
• 3:01
Speaker 5: and text are welcome to and again I promise it.
• 3:04
Speaker 5: On social media, I will get into the hottest thing
• 3:06
Speaker 5: going on social media in the area now and that
• 3:09
Speaker 5: is the swing club controversy in Charleston. I'll get into
• 3:12
Speaker 5: that coming up a little bit later on as well,
• 3:14
Speaker 5: But right now I want to welcome into show the
• 3:16
Speaker 5: chief of staff for Charles Mary Amy Shooter.
• 3:18
Speaker 4: Good one, Matt Sutton, Good morning, sir, Welcome to the show.
• 3:21
Speaker 4: How are you doing by it? I am doing fine.
• 3:23
Speaker 5: First of all, Trick or Treating has been moved Knawa County,
• 3:27
Speaker 5: as we said, from tonight to tomorrow night because of
• 3:30
  Speaker 5: the weather.
• 3:30
Speaker 6: Your thoughts, yeah, I mean it's it's the right call.
• 3:32
Speaker 6: It's all about safety for kids, and that is the
• 3:35
Speaker 6: number one priority in any event that you put on,
• 3:38
Speaker 6: whether it's trick or treat, whether it's the Regatto, whether
• 3:41
Speaker 6: it's just you know, a night in the park. It's
• 3:44
Speaker 6: all about safety, especially as relates to our little ones.
• 3:46
Speaker 6: And we don't want want kids out not only in
• 3:49
Speaker 6: the cold and the rain, but you know, as you mentioned,
• 3:51
Speaker 6: we have a lot of accidents that go on trig
• 3:53
Speaker 6: or treats a hard night throughout the entire county for
• 3:56
Speaker 6: law enforcement ems to try to make sure that people stay.
• 4:00
Speaker 6: It's about safety. It's the right decision. And by the way,
• 4:02
Speaker 6: it's not the first time this has happened. I mean
• 4:03
Speaker 6: in that I've been with Mary Goodwin now for seven
• 4:05
Speaker 6: years and we had to do this before.
• 4:07
Speaker 4: And it's the right decision.
• 4:09
Speaker 5: Was it a couple of years ago we had some
• 4:11
Speaker 5: some pretty uh nasty weather that was more like storm
• 4:14
Speaker 5: or as opposed to just rain there it was like
• 4:15
Speaker 5: some lightning and all that kind of stuff. I think
• 4:18
Speaker 5: what you know, Matt, I think what some people were
• 4:20
Speaker 5: bothered by was that it was going. Now it's going
• 4:23
Speaker 5: to go head to head with high school football, but
• 4:25
Speaker 5: it's going to go head to head in a lot
• 4:26
Speaker 5: of places. And I mean, I like what Selango said.
• 4:29
Speaker 5: YESTERD Commissioner Selango said yesterday, maybe we should just say
• 4:32
Speaker 5: it's October thirty first, no matter what, and just leave
• 4:34
  Speaker 5: it there.
• 4:35
  Speaker 4: Yeah.
• 4:35
Speaker 6: I mean, I think, you know, we've talked about that,
• 4:36
Speaker 6: and I think that that makes a lot of sense.
• 4:38
Speaker 6: And but again, when it you want people want to
• 4:41
Speaker 6: participate in Halloween. My my neighborhood is all kinds of
• 4:44
Speaker 6: decorated and so, and the kids get excited and they
• 4:46
Speaker 6: want to be able to participate.
• 4:48
Speaker 4: So make it a nice night.
• 4:49
Speaker 6: We've already all bought our candy, kids have already got
• 4:51
Speaker 6: their costumes. And make sure the kids can participate and
• 4:54
Speaker 6: most importantly that people can stay safe. I get it
• 4:57
Speaker 6: goes against high school football. There's really not a lot
• 4:59
Speaker 6: you can do about that because we're not going to
• 5:01
Speaker 6: move it into next week.
• 5:02
Speaker 4: That doesn't make any sense.
• 5:03
Speaker 6: So you know, people can participate, you know tonight, I
• 5:07
Speaker 6: know there's some big uh. I think it's high school
• 5:10
Speaker 6: volleyball games that go on because of the state high
• 5:11
Speaker 6: school volleyball tournament. There people getting there's always always.
• 5:14
Speaker 5: There's always a high school football game on a Thursday
• 5:16
Speaker 5: night somewhere to Marshall's playing tonight, you know. For my
• 5:19
Speaker 5: Thundering Herd, they have a game at Coastal Carolina tonight.
• 5:22
Speaker 5: And the municipality is the Selango Commissioner. Silango explain to us,
• 5:26
Speaker 5: you know, the municipalities can pretty much do what they want.
• 5:30
Speaker 5: They didn't have to necessarily go along with what the
• 5:32
Speaker 5: county said. However, it makes it easier for everybody. And
• 5:35
Speaker 5: I'm pretty sure unless somebody tells me otherwise, that the
• 5:38
Speaker 5: municipalities in Kanawa County are all going along with the
• 5:40
Speaker 5: county recommendations and having their trick or treating tomorrow night.
• 5:43
Speaker 5: But look, I mean there's communities having it on Saturday night,
• 5:46
Speaker 5: and there's people that don't like that because they say, well,
• 5:48
Speaker 5: Saturday nights the night that people go out and party
• 5:51
Speaker 5: and go to bars, and we don't want the kids
• 5:53
Speaker 5: out then, So you know, it's you're never gonna make
• 5:56
Speaker 5: and there is no as I said yesterday, Matt, there
• 5:58
Speaker 5: is no trick or treat police. You could go out
• 6:00
Speaker 5: trick or treating in in January if you want to,
• 6:03
Speaker 5: I mean, and you may not get any candy, but
• 6:05
Speaker 5: you can do I mean you.
• 6:06
Speaker 6: Yeah, whatever you want. The cities can, but we we coordinate.
• 6:09
Speaker 6: I know, I can only speak for the City of Charleston,
• 6:11
Speaker 6: and we coordinated close with the county on this because
• 6:12
Speaker 6: it does make sense, because it's a bad you know,
• 6:14
Speaker 6: it's hard to you know, for you all in the
• 6:17
Speaker 6: news media, it would be hard for you to stand
• 6:18
Speaker 6: up here and say and trick or treat tonight is
• 6:20
Speaker 6: in Saint Albans and nitro and then tomorrow night.
• 6:23
  Speaker 4: It's interesting.
• 6:24
Speaker 6: I mean, it would just be confusing for people. Most importantly, again,
• 6:28
Speaker 6: I know it can be I know it can be frustrating.
• 6:31
Speaker 6: I understand that it can. That people have plans, But
• 6:33
Speaker 6: when we make these decisions every single time, and I
• 6:37
Speaker 6: know Commissioner Silango talk with Mary a good one every
• 6:40
Speaker 6: single time, the number one priority of safety of kids,
• 6:42
Speaker 6: and that that's it. That's that's the goal. And if
• 6:44
Speaker 6: you want to be upset about that, I understand. I
• 6:47
Speaker 6: guess I get it. But we're always going to put
• 6:49
Speaker 6: the safety of kids first and that that's what this
• 6:51
Speaker 6: is about. And so hopefully everybody can have a great
• 6:54
Speaker 6: time tomorrow night, and when we can, we can move
• 6:57
Speaker 6: on to the Christmas parade after that, right, I.
• 6:59
Speaker 4: Mean Thanksgivings in the middle.
• 7:01
Speaker 6: But I mean, I don't know like the people you know,
• 7:03
Speaker 6: we just I was in the stores the other day
• 7:05
Speaker 6: and it's all Christmas again.
• 7:06
Speaker 5: So I got news for you. I was in a
• 7:07
Speaker 5: store that there was Valentine's Day stuff out of me
• 7:11
Speaker 5: store before we get to the Christmas bread. And that's
• 7:13
Speaker 5: why you're really here today. I did want to say
• 7:16
Speaker 5: this and allow you to talk about this. W CCHS
• 7:18
Speaker 5: Television no relation by the way out with the story
• 7:20
Speaker 5: late Tuesday about a public hearing that was held Tuesday
• 7:23
Speaker 5: night to discuss the presence of an adult's only establishment
• 7:27
Speaker 5: on Greenbriar Street in Charleston. It said to be a
• 7:29
Speaker 5: swingers club. Just wanted to clarify with you and i'm'll
• 7:32
Speaker 5: talk about this a little bit later on. There was
• 7:35
Speaker 5: a cease and desist that was sent out to them,
• 7:38
Speaker 5: and according to the w CHS story was sent by
• 7:40
Speaker 5: the county, not by the city.
• 7:42
Speaker 4: It is not in city limits.
• 7:43
Speaker 6: It's not in the city limits. Greenbrierce Street can get
• 7:45
Speaker 6: a little bit weird going up and down Greenbrice Streek.
• 7:47
Speaker 4: Es especially now boundary weird. Boundary weird.
• 7:52
Speaker 6: Sorry, and as ken south Ridge. But you know, I
• 7:55
Speaker 6: was actually literally on the phone with our Director of
• 7:57
Speaker 6: Development Service, Dan Rent and when I first when I
• 7:59
Speaker 6: saw the article, and I said.
• 8:01
Speaker 4: Damn, that did I miss a meeting like what happened here?
• 8:03
Speaker 6: And he didn't know anything about it, and I said,
• 8:05
Speaker 6: and then I dug into the article and I said, oh, okay,
• 8:07
Speaker 6: I understand what the county is doing. They do have
• 8:09
Speaker 6: a Charleston address, but it's not in the city of Charleston,
• 8:12
Speaker 6: so it is a county decision for them to make.
• 8:15
Speaker 6: And and with anything, holding holding public hearings is always
• 8:18
Speaker 6: a good idea. And so we were quite caught off
• 8:20
Speaker 6: guard about it, and we kept seeing the articles and
• 8:22
Speaker 6: the mayor was texting me. She was like, you said
• 8:24
Speaker 6: the same thing, like did we miss something? You know,
• 8:26
Speaker 6: this is this is the county. But uh yeah, So
• 8:29
Speaker 6: for for everybody having fun with it or not having
• 8:31
Speaker 6: fun with it however you want to do, you know,
• 8:34
Speaker 6: it is a county decision. And and just like the
• 8:37
Speaker 6: City of Charleston, the county has zoning loss and the
• 8:39
Speaker 6: city has zoning loss. And that's how it works. And uh,
• 8:42
Speaker 6: you know a lot of times, the the opinion of
• 8:45
Speaker 6: what you should do, you have. You have the laws
• 8:48
Speaker 6: and you have to follow them where things get out
• 8:49
Speaker 6: of hand. And I don't know enough about this situation,
• 8:52
Speaker 6: but I just know that zoning laws are important in
• 8:56
Speaker 6: both in all in all areas, and so you know,
• 9:00
Speaker 6: it is what it is. And if you think otherwise,
• 9:03
Speaker 6: the argument is to talk about zoning loss and look
• 9:06
Speaker 6: to look at those.
• 9:07
Speaker 4: And you can have that.
• 9:07
Speaker 5: They can have that discussion at another point. But but
• 9:09
Speaker 5: I agree with you. All right, let's move on to
• 9:11
Speaker 5: the Christmas Parade announcement coming out yesterday that I guess
• 9:14
Speaker 5: applications are out there now, you asking for people sign up,
• 9:16
  Speaker 5: talk about it.
• 9:17
Speaker 6: Yeah, So we open the applications for the Christmas Parade yesterday.
• 9:21
Speaker 6: Those applications we already got twenty one as of eight
• 9:25
Speaker 6: o'clock this morning, so that probably numbers up to probably
• 9:27
Speaker 6: twenty five or thirty already, and so that'll stay open
• 9:30
Speaker 6: through the basically through the end of November or till
• 9:32
Speaker 6: we get to about one hundred and twenty five participants.
• 9:34
Speaker 6: That's about the deal number. Yeah, I would call it
• 9:38
Speaker 6: the max number. It's the number in which we can
• 9:40
Speaker 6: handle through the parade. You know, we could sneak in
• 9:43
Speaker 6: a few here and there, but one hundred and twenty
• 9:45
Speaker 6: five is when we try to get to. We usually
• 9:46
Speaker 6: don't make it through the whole time, praying for the
• 9:49
Speaker 6: application to be open till we get to one hundred and
• 9:51
Speaker 6: twenty five. So make sure you get your application in
• 9:54
Speaker 6: as soon as you possibly can. The Christmas Parade itself
• 9:57
Speaker 6: December eleventh on at seven pm always, I don't think
• 10:02
Speaker 6: any after mind, anybody that tries to move the Christmas
• 10:04
Speaker 6: Parade to the evening time, and it has been in
• 10:08
Speaker 6: the evening time, you know since Marygodwe was in is
• 10:10
Speaker 6: one of the best events in town. So December eleventh
• 10:13
Speaker 6: at seven pm, you're definitely gonna want to be there.
• 10:16
Speaker 6: But if you want to participate in the parade, i'd
• 10:18
Speaker 6: sign up today theme for.
• 10:20
Speaker 4: Because this just went live. I guess yesterday at least
• 10:22
Speaker 4: that's when I got the pressure. He saw it.
• 10:24
Speaker 5: And so if you've already had that many people that
• 10:26
Speaker 5: have signed up in a less than twenty four hour period,
• 10:29
Speaker 5: you're going to have a lot of people sign up.
• 10:30
Speaker 6: Yeah, we usually get tow one hundred and twenty five
• 10:32
Speaker 6: in about in a week or two. We have people
• 10:35
Speaker 6: calling about the Christas Parade in September. I mean, people
• 10:37
Speaker 6: love their parades, and I know that they also schedule
• 10:40
Speaker 6: it out right because there are a lot of Christmas
• 10:41
Speaker 6: brades going out throughout the entire county and in the
• 10:44
Speaker 6: Putnam County and all that areas. So people try to
• 10:46
Speaker 6: plan these out. We try to work to make sure
• 10:48
Speaker 6: that we have you know, we don't want to duplicate nights.
• 10:51
Speaker 6: So it is a great night. I mean this year's
• 10:53
Speaker 6: theme is Tenseltown, so everybody can sparkle up, you know
• 10:57
Speaker 6: you can, you know your nod to your favorite sort
• 11:00
Speaker 6: of classic Christmas movies and and how you interpret the
• 11:04
Speaker 6: theme of Tensiltown. But man, it's a really fun event
• 11:07
Speaker 6: and I will I will forever remember the meeting I
• 11:10
Speaker 6: was in with the mayor even before she took office,
• 11:13
Speaker 6: where she said she was going to move the parade
• 11:16
  Speaker 6: to the night time. And I was I wasn't a
• 11:19
Speaker 6: big parade person. I just not nothing. My family did,
• 11:22
Speaker 6: we weren't. We weren't big parade people. So I was
• 11:23
Speaker 6: just okay and didn't realize actually how impactful it would be,
• 11:32
Speaker 6: not only from a community perspective, from a business perspective,
• 11:34
Speaker 6: from restaurants. Because it was in you know, it was
• 11:36
Speaker 6: on a Saturday morning. It was nice and people attended.
• 11:38
Speaker 6: But this has turned into an entire two month event
• 11:43
Speaker 6: basically after the parade, Yeah, I mean it, so what
• 11:46
Speaker 6: the evening time Christmas Parade was the catalyst for things
• 11:49
Speaker 6: like Holly Jolly Browley and like the Night because we
• 11:51
Speaker 6: started to create this vibe in this atmosphere and Charleston
• 11:54
Speaker 6: around the holidays, and man, it's just such a it's
• 11:56
Speaker 6: such a great night. And you know we keep that
• 11:59
Speaker 6: to about one hundred and twenty five because we've gotten
• 12:02
Speaker 6: bigger before and it can last a long time and
• 12:04
Speaker 6: you know when you kids need to get home and
• 12:05
Speaker 6: get to bed. But it is really a fun event
• 12:09
Speaker 6: and really one in which I know, you know Holly
• 12:12
Speaker 6: Jolly Brawley and L like the night start first. But it
• 12:14
Speaker 6: really is the one that kind of kicked off everything
• 12:18
Speaker 6: for the holidays in Charleston and what what we have
• 12:20
Speaker 6: become over the last couple of years. And so I
• 12:23
Speaker 6: would make sure to get your your entry. And my
• 12:25
Speaker 6: guess is is when I get back to the office
• 12:26
Speaker 6: here in a few minutes, we'll be up to about
• 12:28
Speaker 6: thirty or thirty five entries. We want as many youth
• 12:32
Speaker 6: organizations as we can get. We love bands, we love kids,
• 12:36
Speaker 6: youth sports clubs, kids' activities, and but you know adults
• 12:41
Speaker 6: are welcome to but as many people as we can get.
• 12:44
Speaker 6: We want that out there and then have a fun
• 12:46
Speaker 6: evening in Charleston. That's the big that's the biggest part
• 12:48
  Speaker 6: about this.
• 12:49
Speaker 5: You grab some dinner, go to Holliday Jolly Brawley, swing
• 12:52
Speaker 5: by light to night you know, all these things and
• 12:55
Speaker 5: again you know, talking to the merchants downtown, they love it.
• 12:58
Speaker 5: They love it because as you said, it was on
• 13:00
Speaker 5: Saturday morning for and and it was very well attended.
• 13:03
  Speaker 3: Uh.
• 13:03
Speaker 5: But this has taken it to another another level because
• 13:06
Speaker 5: it's not just about the parade, it's about everything around
• 13:09
  Speaker 5: the parade.
• 13:09
  Speaker 7: Yeah.
• 13:09
Speaker 6: I mean when you get that, you know now that
• 13:11
Speaker 6: we've got the we've got all the trees up, and
• 13:13
Speaker 6: you've got the I think the Charles Snary Alliance is
• 13:15
Speaker 6: doing their window decorating contest again this year. And so
• 13:19
Speaker 6: those type of things really add to that environment. And
• 13:21
Speaker 6: to have the have the Christmas Parade uh, kind of
• 13:24
Speaker 6: as the culmination of a lot of it. Then you
• 13:26
Speaker 6: head into the holidays. It is just it is a
• 13:29
Speaker 6: it is a really special night interest and and all
• 13:32
Speaker 6: the bars are packed, all the restaurants are packed, retail
• 13:34
Speaker 6: establishments are great, and it is a huge night. I mean,
• 13:36
Speaker 6: we've had we have people when we ask and we
• 13:39
Speaker 6: go out and ask sort of the you know, the
• 13:40
Speaker 6: establishments downtown, like what are your biggest draw what are
• 13:43
Speaker 6: your biggest revenue nights? What are your biggest draw nights?
• 13:45
Speaker 6: Christmas Parade is always in the top three or four,
• 13:47
Speaker 6: and and it just because it is such a well
• 13:49
Speaker 6: attended event, and you know you want to you want
• 13:53
Speaker 6: some hot chocolates from Allen's ice Cream. You better get
• 13:56
Speaker 6: there early to get you to get your hot chocolate
• 13:58
Speaker 6: and just come out and have a good time. And again,
• 14:01
Speaker 6: I think the other thing to not to not to
• 14:04
Speaker 6: go back and be a dead horse.
• 14:06
Speaker 4: With the moving of Halloween.
• 14:07
Speaker 6: We had to move the Christmas Bread one year because
• 14:09
Speaker 6: of weather and so stuff happens. But book December eleventh
• 14:12
  Speaker 6: at seven pm.
• 14:13
Speaker 5: Speaking of which somebody asked, as there been a rain
• 14:15
Speaker 5: date set, I guess we'd have to wait till we
• 14:17
Speaker 5: got a little bit closer to do extended forecast and
• 14:19
Speaker 5: things of that nature.
• 14:20
Speaker 6: Yes, I mean when we look at the rain dates,
• 14:22
Speaker 6: we look at a lot of different things. A is
• 14:24
Speaker 6: how long is it going to rain, what's the what
• 14:25
Speaker 6: is the time frame? And so, But we want to
• 14:29
Speaker 6: get it in kind of early in December, so we
• 14:31
Speaker 6: have a little bit of time to move into that
• 14:33
Speaker 6: next week if we need to. And a lot of
• 14:35
Speaker 6: that has to do honestly, because when we did have
• 14:38
Speaker 6: to move it two years ago, I think it was
• 14:41
Speaker 6: our first caller to our bands that participate, the local
• 14:44
Speaker 6: school bands that participate in the youth group, to say, what.
• 14:46
  Speaker 4: Else last year?
• 14:47
Speaker 6: What it may have been last Yeah, know what what
• 14:49
Speaker 6: do you have going on? What do you have going on?
• 14:51
Speaker 6: What can you when can you participate? Because having those
• 14:54
Speaker 6: bands is such a critical part of it, we always
• 14:57
Speaker 6: co coordinate with them before we set a rain date.
• 14:59
Speaker 5: Somebody also said food trucks would be nice if you
• 15:01
Speaker 5: could have them down there. The only thing I would
• 15:03
Speaker 5: worry about would be spacing space. Spacing space is hard.
• 15:05
Speaker 6: I mean we you know, when you think about the
• 15:07
Speaker 6: Chris Brad you don't have a lot of space on
• 15:09
Speaker 6: any space left down down So we've got we've got
• 15:12
Speaker 6: plenty of places downtown to eat.
• 15:13
Speaker 5: Go to the restaurants. Yeah yah, I mean food trucks
• 15:15
Speaker 5: are nice. I love a good food truck, don't get
• 15:17
Speaker 5: me wrong, but I think you're better served by going
• 15:18
Speaker 5: to the restaurants. Matt Sutton, Chief of Staffer, Mayor Goodwin.

• 18:19
Speaker 5: good morning and welcome to the show.
• 18:21
Speaker 9: Good morning, Dave, Thanks so much for having me.
• 18:23
Speaker 5: Thank you for being here. Give us your bia. Who
• 18:26
Speaker 5: is tera to just run.
• 18:27
Speaker 4: It down for us?
• 18:28
Speaker 9: Yeah, my mom said that you were going to ask that, so.
• 18:31
Speaker 4: I pretty much asked us of every candidate. I try
• 18:34
  Speaker 4: to be fair.
• 18:35
Speaker 9: So I am a public servant. I started serving the
• 18:39
Speaker 9: state of West Virginia when I was nineteen years old
• 18:42
Speaker 9: with the Public Service Commission. I've worked for the Department
• 18:45
Speaker 9: of Agriculture. I've worked for the Department of Health and
• 18:49
Speaker 9: Human Resources at the time as the director of the
• 18:51
Speaker 9: Women's Commission. I have given a lot of my free
• 18:55
Speaker 9: time to do work as a volunteer for the I
• 19:01
Speaker 9: was the chair and vice chair of the Advisory Committee
• 19:05
Speaker 9: to the US Commission on Civil Rights for West Virginia.
• 19:08
Speaker 9: I am a public servant by heart, and I'm a mom,
• 19:12
  Speaker 9: I'm a wife, a daughter, and I am a constituent
• 19:16
Speaker 9: of currently a constituent and a candidate for the District
• 19:19
  Speaker 9: of fifty four.
• 19:21
Speaker 4: So why did you decide to run?
• 19:25
Speaker 9: Being on the other side and unders have a unique
• 19:29
Speaker 9: perspective of being on the other side of the legislation
• 19:33
Speaker 9: that has passed at the House, in the Senate and
• 19:37
Speaker 9: signed by the governor and working in state government. All
• 19:41
Speaker 9: of my life, I have really dug into what the
• 19:46
Speaker 9: needs are, working on surveys, working with individuals and having
• 19:54
Speaker 9: their worst day of their life. As a director of
• 19:57
Speaker 9: a soup kitchen here in Charleston. I got to the
• 20:01
Speaker 9: point last session I had taken my daughter's softball team
• 20:07
Speaker 9: to listen and to be recognized, and that they were
• 20:12
Speaker 9: having a pretty controversial bill on the floor, and the
• 20:16
Speaker 9: girls afterwards, after they were recognized, said, why aren't they
• 20:21
Speaker 9: Why don't they ask the kids what we want and
• 20:23
Speaker 9: what we need, and why aren't you down there being
• 20:27
Speaker 9: our voice? And you know, for a bunch of thirteen
• 20:31
Speaker 9: fourteen year olds to ask you to be their voice,
• 20:33
Speaker 9: it's pretty significant. And that was kind of the catalyst
• 20:36
  Speaker 9: for me.
• 20:37
Speaker 4: So, what do you see as the biggest needs of
• 20:39
  Speaker 4: the district?
• 20:42
Speaker 9: Workforce? Opportunities, affordable housing, childcare for folks that want to work,
• 20:50
Speaker 9: and maybe accessible and affordable childcare has been a huge
• 20:55
Speaker 9: topic as long as when I was at the Women's Commission.
• 20:59
Speaker 9: That was something statewide and I had the good fortune
• 21:03
Speaker 9: of when I was working briefly as a consultant for
• 21:09
Speaker 9: Governors of Justice's Office to help with getting a program
• 21:15
Speaker 9: called triest Share a grant to do a pilot program
• 21:20
Speaker 9: in eight counties in West Virginia and giving individuals that
• 21:26
Speaker 9: support that they need to be able to get back
• 21:30
Speaker 9: to work or to have with the opportunity to go
• 21:34
Speaker 9: to work so that they're not worried about who's keeping
• 21:37
Speaker 9: their children and who's taking care of their most precious asset.
• 21:42
Speaker 5: Talking to Cherry Martinez again, who is a candidate for
• 21:45
Speaker 5: a House of Delegates. So Dave Alan Show and five
• 21:47
Speaker 5: eighty Live is brought to you in part by your
• 21:49
Speaker 5: hometown baseball team, the Charleston Dirty Birds, the Selango Law
• 21:52
Speaker 5: Light the Night returning to gilmart Ballpark twenty first of

• 21:56
Speaker 5: you please get your tickets in advanced by visiting Dblightthnight
• 21:59
Speaker 5: dot com. All right, so your running as an independent?
• 22:02
  Speaker 4: Okay?
• 22:03
  Speaker 5: Not?
• 22:03
Speaker 4: Why not as a Republican or Democrat.
• 22:06
Speaker 9: I don't belong to either party. Non affiliate has been
• 22:10
Speaker 9: something that I have just I always said everyone has
• 22:14
Speaker 9: to work for my vote, and I want to work
• 22:17
Speaker 9: for everyone to get their vote.
• 22:19
Speaker 5: And you do realize, I mean, I'm sure you do that.
• 22:22
Speaker 5: It's kind of no matter what office you're running for it.
• 22:25
Speaker 5: It's kind of an uphill client, for instance, because you
• 22:28
Speaker 5: don't have backing of the executive committees and things of
• 22:31
  Speaker 5: that nature.
• 22:32
Speaker 9: I mean, it's true, but I have been having kitchen
• 22:39
Speaker 9: table conversations. Any of the Dems are doing that right now,
• 22:42
Speaker 9: but for about a year and a half, I've been
• 22:44
Speaker 9: having these conversations with individuals in the district, people that
• 22:48
Speaker 9: I love and trust and friends, family, colleagues, and they
• 22:53
Speaker 9: love the concept. And if you look at voting records,
• 22:57
Speaker 9: folks have changed parties either from leaving Republican leaving Democrat
• 23:02
  Speaker 9: to be independent.
• 23:03
Speaker 5: Well, I mean unaffiliated. Independent is the fastest growing party
• 23:07
Speaker 5: in West Virginia for one reason or another. And you
• 23:09
Speaker 5: can you can feel in your own you know as
• 23:11
Speaker 5: to why that is, but it is, I mean it
• 23:13
Speaker 5: is more and more young people are registered as independent
• 23:16
Speaker 5: as well. But it does make it a little difficult
• 23:17
Speaker 5: on those you know, sure.
• 23:19
Speaker 9: Camp and I and I've understood that. And I've had
• 23:22
Speaker 9: lots of folks who have been entrenched in politics say,
• 23:26
Speaker 9: you know, this is this is going to be hard,
• 23:29
Speaker 9: and that's okay. Hard work is what I've always done
• 23:33
Speaker 9: and I look forward to being a pragmatic voice for
• 23:38
Speaker 9: our district and just being there to listen and really
• 23:43
Speaker 9: focus on the issues that people are telling me that
• 23:45
  Speaker 9: they need.
• 23:46
Speaker 5: If you are elected now as an independent, how how
• 23:49
Speaker 5: would that work? Would you caucus with one side or
• 23:52
Speaker 5: I mean how does that?
• 23:53
Speaker 9: It depends on who invites me. I mean I have
• 23:55
Speaker 9: to wait to see who would invite me to caucus
• 23:57
  Speaker 9: with them?
• 23:58
  Speaker 5: Okay, yeah, so that's I mean I really don't know
• 24:01
Speaker 5: so that you it's you got to be invited, I guess, right,
• 24:03
Speaker 5: and it's are you open to one side or the other?
• 24:07
Speaker 9: I think right now, I just want to make sure
• 24:09
Speaker 9: that I'm listening to everyone. I have good relationships. I mean,
• 24:16
Speaker 9: my committee is made up of Republicans, Democrats, independents, a large.
• 24:23
Speaker 4: What a novel concept.
• 24:24
Speaker 9: Yeah, so we can listen to everyone, and I even
• 24:28
Speaker 9: have I think one person who's a libertarian that is
• 24:30
Speaker 9: supporting me, just to I I grew up. I went
• 24:36
Speaker 9: to school at Marshall goheard, go ahead and listening and
• 24:41
Speaker 9: then coming up with what is best for the greater
• 24:44
Speaker 9: common good? Is really what this is about.
• 24:48
Speaker 4: What your campaign strategy look like? I mean, are you
• 24:52
Speaker 4: going to go door to door?
• 24:53
Speaker 9: You go it's a door strong ground game. You know.
• 24:56
Speaker 9: If I learned anything from Mayor Goodwin was a strong
• 25:00
Speaker 9: ground game will get you a lot of places.
• 25:03
Speaker 5: Are you open if there are meet the candidate type
• 25:07
Speaker 5: forums or a debate.
• 25:10
Speaker 4: Or anything like, Are you open to them?
• 25:11
  Speaker 9: Yes?
• 25:12
Speaker 5: Of course, what I know, we don't want to give
• 25:14
Speaker 5: away too much if those things do happen. But if
• 25:17
Speaker 5: you're speaking to a group of people right now, what
• 25:19
Speaker 5: would you say to them about why they should elect you.
• 25:24
Speaker 9: I have over twenty years of experience of understanding state government,
• 25:30
Speaker 9: working in the nonprofit sector and listening and acting on
• 25:35
Speaker 9: behalf of individuals that may not have a voice, and
• 25:38
Speaker 9: even teaching folks how to go to the capital and
• 25:42
Speaker 9: advocate for themselves. I'm here to listen and to not
• 25:49
Speaker 9: just listen, but actually take action. Not I've been able
• 25:54
Speaker 9: to accomplish a lot in the work that I do
• 25:59
Speaker 9: without how passing legislation, But just think what I could
• 26:02
Speaker 9: do to help the district being in office and getting
• 26:07
Speaker 9: some real actionable plans in place for folks.
• 26:09
Speaker 4: Yeah, the website or social media or anything.
• 26:12
Speaker 9: Facebook and Instagram. Right now, I'm Tara Martinez for the fifty.
• 26:15
Speaker 5: Fourth Okay, all right, you know, one of the things
• 26:19
Speaker 5: that's been said about the legislative session over the last
• 26:21
Speaker 5: couple of years, and you can agree or disagree or whatever,
• 26:26
Speaker 5: is that the legislature has been too focused on social
• 26:32
Speaker 5: issues maybe not enough on economic issues. That's been one
• 26:35
Speaker 5: of the criticisms and it's really, quite frankly, come from
• 26:37
Speaker 5: both sides. Some Republicans have said, hey, we are too
• 26:41
Speaker 5: focused on these things, and some Democrats have said, we're
• 26:43
  Speaker 5: two hookused.
• 26:44
Speaker 4: Where are you on all that?
• 26:45
Speaker 9: I completely agree with that. I think that we need
• 26:48
Speaker 9: to really take into consideration what are the needs of
• 26:56
Speaker 9: our constituents will be. I know, as a constitutant now,
• 27:01
Speaker 9: I want to know how we're helping the folks during
• 27:05
Speaker 9: this shutdown. I want to know what's happening. Like Shawn
• 27:10
Speaker 9: Hornbuckle says, the kitchen table conversations, you know, Speaker Handshaw
• 27:17
Speaker 9: yesterday during his or I don't think it was yesterday,
• 27:21
Speaker 9: but Tuesday, Tuesday, talking about how inefficiencies at the federal
• 27:25
Speaker 9: level are causing great heartache and we need to as
• 27:29
Speaker 9: a state step up. And I think everyone agrees on that.
• 27:33
Speaker 5: All right, I do this with every candidate that I
• 27:35
Speaker 5: have on I give you the final thirty seconds. It's
• 27:37
Speaker 5: not timed. I just say, give me, give me, give
• 27:39
Speaker 5: me your kitchen table speech or your stump speech or whatever.
• 27:42
Speaker 5: Why should somebody vote for Tiera Martinez.
• 27:45
Speaker 9: I have lived in this district for over thirty years.
• 27:51
Speaker 9: I grew up in Rowne County, West Virginia, moved to Charleston,
• 27:54
Speaker 9: started working for the state of West Virginia. West Virginia
• 27:57
Speaker 9: has a huge part of my heart. I have worked
• 28:02
Speaker 9: with some of our most vulnerable populations. I'm a mom,
• 28:07
Speaker 9: and I want to see West Virginia citizens stay here
• 28:13
Speaker 9: or come back home and help us grow our state
• 28:17

• 31:44
Speaker 5: it all down for us. What happened in Cable County
• 31:47
Speaker 5: a couple days ago.
• 31:49
Speaker 7: Well, you recall that I think it was July fourth,
• 31:55
Speaker 7: literally July fourth, twenty twenty two. After a ten week
• 32:00
Speaker 7: trial in twenty twenty one, in the summer twenty twenty one,
• 32:05
Speaker 7: Federal District Judge Faber issued I think a sixty two
• 32:09
Speaker 7: page opinion that said that Huntington and Cable County did
• 32:14
Speaker 7: not have a case. That West Virginia law, nuisance law
• 32:17
Speaker 7: did not allow for this kind of look at drugs
• 32:21
Speaker 7: and explosion of drugs and distribution of drugs, and that
• 32:26
Speaker 7: didn't fall within the parameters of the law. And so
• 32:30
Speaker 7: Cable Huntington filed an appeal to the Fourth Circuit Court
• 32:35
Speaker 7: of Appeals in Richmond, which is our you know, it's
• 32:39
Speaker 7: court of sort of the Atlantic Coast Conference of Yeah,
• 32:43
Speaker 7: it's like Maryland, Virginia, West Virginia, North Carolina. Maybe I'm
• 32:49
Speaker 7: not sure, but anyway, so they at some point they
• 32:53
Speaker 7: asked the West Virginia Supreme Court, would you clarify that,
• 32:57
Speaker 7: would you clarify your law for us? In the West
• 32:59
Speaker 7: rgin Ginia Supreme Court basically said, no, we don't believe
• 33:03
Speaker 7: it's factually developed enough for us to give you an
• 33:06
Speaker 7: opinion on what our law is. So four Circuit said, okay,
• 33:10
Speaker 7: so we'll do it. We'll do it on our own.
• 33:12
Speaker 7: This was a panel, and that's going to become important
• 33:15
Speaker 7: here in a second. So this, this panel just ruled that,
• 33:21
Speaker 7: in fact, West Virginia law does incorporate the type of
• 33:25
Speaker 7: legal theories that Cable Huntington has asserted and the entire
• 33:30
Speaker 7: state of West Virginia has asserted as it relates to
• 33:35
Speaker 7: nuisance law and you know, kind of violating the DEA
• 33:40
Speaker 7: rules as it relates to distribution. In other words, should
• 33:43
Speaker 7: have reported spikes, should have reported trends, didn't report either,
• 33:47
Speaker 7: And as a result, they were supposed to stay within
• 33:50
Speaker 7: these guardrails. They went outside the guardrails. They didn't report
• 33:53
Speaker 7: that they went outside the guardrails. And our position, in
• 33:57
Speaker 7: Hunt and Cavill's position, I should say, has been that
• 34:03
Speaker 7: that resulted in this huge, huge opioid epidemic for which
• 34:07
Speaker 7: these distributors should pay to abate, abate to clean up
• 34:13
Speaker 7: the mess, to clean up the mess. So that's where
• 34:15
  Speaker 7: we are well.
• 34:17
Speaker 5: And I found it very interesting that you were talking
• 34:19
Speaker 5: about the reporting of spikes and things like that. I
• 34:22
Speaker 5: mean that that seems to be like that should be
• 34:25
Speaker 5: when there's you know, major major trends maybe in one
• 34:27
Speaker 5: area of the county or one area of town or whatever,
• 34:30
Speaker 5: that should be something they should just jump all over.
• 34:31
Speaker 4: One would think that.
• 34:33
Speaker 7: That's exactly what the DEEA rules and regulations say, is
• 34:38
Speaker 7: that you know, report to US spikes and trends as
• 34:42
Speaker 7: it relates to the distribution appeals from your distributorship. And
• 34:47
  Speaker 7: they didn't. I mean they didn't. I mean, that's that's
• 34:50
Speaker 7: the case we made, or you know, when we went
• 34:52
Speaker 7: to trial, they didn't do that. And and you know,
• 34:55
Speaker 7: I've often called it a conspiracy of thieves. Everybody's making
• 34:59
Speaker 7: money up and down the uh, you know, the manufacturers,
• 35:02
Speaker 7: the distributors, the pharmaceuticals, everybody's making money. Nobody's want to
• 35:07
Speaker 7: report anything because then the jig is up, you know,
• 35:10
Speaker 7: then the DEA comes in and says, wait a minute,
• 35:12
Speaker 7: what's well, what's going on here? But anyway, I you know,
• 35:15
Speaker 7: I'm I tend to get a little animated about these things.
• 35:19
Speaker 5: But you're you know, you do, but ay Valance showing five,
• 35:24

• 35:53
Speaker 5: And Rusty, I can tell you this is a case
• 35:55
Speaker 5: that it got nationwide and in some cases worldwide attention
• 35:59
Speaker 5: because when this came out on Tuesday, after I was home,
• 36:01
Speaker 5: I flipped the TV on CNBC, you know, catch a
• 36:05
Speaker 5: little business news, and they were talking about this.
• 36:09
Speaker 7: Yeah, well, if you're again. When it was tried, you know,
• 36:14
Speaker 7: it was the first trial in federal court in the
• 36:17
Speaker 7: United States, the one before Cable Huntington was in was Cleveland,
• 36:22
Speaker 7: Kyoga County in Ohio. It settled, you know, the day
• 36:26
Speaker 7: before trial. And the other irony about this case is
• 36:30
Speaker 7: that over the July fourth weekend before Judge Faber issued
• 36:36
Speaker 7: his decision, all the cities and counties in West Virginia
• 36:42
Speaker 7: negotiated the settlement of four hundred million dollars with these distributors.
• 36:47
Speaker 7: I mean, like, you can't make this up, the coincidences.
• 36:50
Speaker 7: You can't make up this coincidence. It literally happened the
• 36:55
Speaker 7: weekend before the decision came out. They agreed to pay
• 36:58
Speaker 7: four hundred million without you without you know, saying that
• 37:02
Speaker 7: they were responsible for That's the way settlement's go. You know,
• 37:05
Speaker 7: they doesn't say they did anything wrong. They're just going
• 37:08
Speaker 7: to do it strategically. So they settled for fore under me.
• 37:12
  Speaker 7: So that's you know, that's that's a West Virginia. And
• 37:14
Speaker 7: then the state had previously settled. The state of West
• 37:19
Speaker 7: Virginia had previously settled with the distributors. Uh, I want
• 37:26
Speaker 7: to say about a year before that. So everybody everybody
• 37:29
Speaker 7: had when when Huntington Cable went to trial, well, I'm sorry,
• 37:35
Speaker 7: when the decision came out, every everybody had settled in
• 37:39
Speaker 7: the state of West Virginia except Cable Huntington. So when
• 37:42
Speaker 7: the so when the opioid moneys were distributed, Cable Huntington
• 37:47
Speaker 7: didn't get any of the distributors money because they opted
• 37:54
Speaker 7: to try their own case. Now again, you know, too
• 38:00
Speaker 7: point five billion was put on the board. You know,
• 38:02
Speaker 7: that's what we put on the board. So when it
• 38:05
Speaker 7: comes back to trial and hopefully that'll happen and then
• 38:09
Speaker 7: that you know, in the first of the year, you know,
• 38:12
  Speaker 7: that's that's kind of a starting point for I think
• 38:15
Speaker 7: that they'll use it's two point five billion.
• 38:17
Speaker 4: All right, So where does it go now, Rusty, before
• 38:19
Speaker 4: we let you go, what does it go?
• 38:20
Speaker 7: Now? Well, the reason I said about the panel is
• 38:23
Speaker 7: that there's the distributors can there's a couple of procedural
• 38:26
Speaker 7: things they can do. One is which they can ask
• 38:28
  Speaker 7: the entire the entire en banc E n B, A,
• 38:32
Speaker 7: n C. Which means the whole panel, the whole Fourth Circuit,
• 38:36
Speaker 7: which is fifteen judges, say hey, you look at this,
• 38:38
Speaker 7: and you tell us if you think this is correct.
• 38:41
Speaker 7: I don't think that'll work. Then you could theoretically go
• 38:44
Speaker 7: to the US Supreme Court, because that's the next court
• 38:46
Speaker 7: up in federal court. You have district court, Federal Appeals Court,
• 38:50
Speaker 7: then you have the US Supreme Court. I don't personally
• 38:53
Speaker 7: think there's a constitutional issue there or interpreting West Virginia law.
• 38:58
Speaker 7: It's going to get them to the US Supreme Court.
• 39:01
Speaker 7: So but that's a decision they have to make. But
• 39:03
Speaker 7: ultimately it will it will come back to Judge Favor
• 39:06
Speaker 7: for a retrial, a retrial based on now based on
• 39:10
Speaker 7: the four Circuit Court of Appeals law and not what
• 39:15
Speaker 7: Judge Favor had originally ruled. That's that's that's the law. Now,
• 39:19
Speaker 7: that's the law of the land.
• 39:20
Speaker 5: All right, Rusty. I know, I know, as I said,
• 39:23
Speaker 5: I can hear it your voice a little tired. I

• 46:13
Speaker 5: LIMITS a public hearing was held about It thursday night
• 46:17
Speaker 5: because some people are upset about its close proximity To
• 46:21
Speaker 5: Capitol High school and also a. Church, now the owners
• 46:25
Speaker 5: of the place it is a company Called Creative CONNECTIONS,
• 46:30

• 47:09
Speaker 5: NOT i did, not all, Right but it's about about
• 47:11
Speaker 5: two hundred and fifty. MEMBERS i did talk with someone
• 47:14
Speaker 5: with the county earlier this, morning and they tell me
• 47:17
Speaker 5: that because of the proximity of the club to the
• 47:20
Speaker 5: church and the, school that is a direct violation of
• 47:23
Speaker 5: county zoning. Laws, however the owners of the club have
• 47:30
Speaker 5: said it's a private social club and it operates or
• 47:36
Speaker 5: meets or whatever as it. Were after like eight o'clock at,
• 47:39
Speaker 5: night and so it's not open when a church or
• 47:44
Speaker 5: a school is in. Session they also don't sell food or.
• 47:49
Speaker 5: Drinks they do no local, advertising although they're welcome to
• 47:54
Speaker 5: sponsored the. SHOW i, mean it's a. If let me just,
• 47:59
Speaker 5: say is if it is a, violation as it was
• 48:02
Speaker 5: explained to me by somebody From Canawg county earlier this.
• 48:05
Speaker 4: MORNING i was on the phone.
• 48:06
Speaker 5: With if it's a violation of zoning, laws then in my,
• 48:10
Speaker 5: opinion the county has every right to shut it. Down
• 48:12
Speaker 5: and As Matt sutton said in giving his, opinion again
• 48:15
Speaker 5: this is not in city. Limits but he was, saying,
• 48:17
Speaker 5: look if it's a violation of zoning, laws then work
• 48:20
Speaker 5: to get the zoning laws, change if that's what you
• 48:21
Speaker 5: want to. DO i, MEAN i get. That but if
• 48:23
Speaker 5: it's a violation of zoning, laws you, know case.
• 48:25
  Speaker 4: Closed so.
• 48:29

• 48:53
Speaker 5: and desist order that it's too close To Capitol High,
• 48:56
Speaker 5: school it's too close to a church, there and we've
• 48:58

• 49:01
Speaker 5: adult bookstores and things of that. NATURE i w one
• 49:03
Speaker 5: hundred percent get that AND i respect. That, however it's
• 49:08
Speaker 5: just interesting interesting to me if it's not a so
• 49:11
Speaker 5: if it's not open to the public like a strip
• 49:12
Speaker 5: club or an adult bookstore would, be it's. Not no
• 49:15
