- 2:44All right, what was your enter on duty date with
- 2:47the Bureau of Prisons Answer nine twenty seven, two thousand
- 2:51and five. No, I'm sorry, eleven twenty seven, two thousand
- 2:54and five. Question and when did you graduate from BOP
- 2:58training at the Federal Law Enforcement Training Center? Answer? I
- 3:03believe it was March of two thousand and six. Question okay,
- 3:07we don't have to go through it, or I guess
- 3:09just briefly. I mean what positions have you held with
- 3:12the BP? You don't have to go into each institution?
- 3:16Answer right, I started as a five step one, i've
- 3:19with more responsibility. I was promoted through six seven Senior
- 3:23officer Specialist. I was also a GL nine lieutenant, a
- 3:27GL eleven lieutenant. I was a deputy captain GL twelve,
- 3:31and I was also GL thirteen and currently I'm at
- 3:34GL twelve Discipline Hearing Officer at FCI four Dix. Question
- 3:40all right, great, and is it correct that you used
- 3:42to work at the MCC in New York City? Answer
- 3:46that is correct. Question all right? And what was your
- 3:49position when you were at MCC? Answer? I was a captain.
- 3:53Question okay, and from what dates were you the captain? Answer?
- 3:57I was the captain from September of I believe it
- 4:00was third twenty eighteen all the way till June twenty
- 4:04fifth of twenty twenty. Question okay, great, and then from
- 4:08what dates were you the captain? Answer? I was captain
- 4:12from September of I believe it was third twenty eighteen
- 4:15all the way to June twenty fifth of twenty twenty.
- 4:18Question okay, great. And then was that your first assignment
- 4:21as a captain? Answer? No, it was my second question
- 4:24What was your first assignment as a captain? Answer my
- 4:28first assignment as a captain, I was a deputy captain
- 4:31at MDC Brooklyn. Question okay, and then you got promoted
- 4:35and went to MCC. Answer yeah. Question and what does
- 4:39MCC stand for? Answer the Metropolitan Correctional Center. Question perfect
- 4:44and located at one fifty Park Row, New York, New York.
- 4:48Answer that's correct. Question, Thank you sir. As a captain,
- 4:52would you consider your supervisor when you were at MCC?
- 4:55Answer it would be at that point at that time
- 4:58we was transitioning, so I would normally I would answer
- 5:01to two people, which would be the aw a custody
- 5:04which at the time was redacted However, he was transitioning
- 5:08when that incident happened. It was redacted as the aw
- 5:13over custody at the time. Question all right, so when
- 5:16you're talking about that time, are you talking about August
- 5:19ninth and August tenth of twenty nineteen. Answer that is correct.
- 5:24Question Okay, So are you aware of redacted was still
- 5:27in the A and W charge of custody at that time?
- 5:30Answer no, question she was not. Answer no, basically what
- 5:35it was again with the area of responsibility that it
- 5:38changed prior to the incident, So that week misredacted was
- 5:41going to be even though her responsibility is had changed
- 5:44as the aw over custody and wardendi had appointed or
- 5:49instructed that misredacted would then take over the responsibilities. But however,
- 5:54she was supposed to go on annual leave, so at
- 5:57the time misredacted was actually there as far as she
- 6:01was still in that capacity when the incident happened. However,
- 6:04again the previous question that was asked, normally, as my responsibilities,
- 6:09I would notify the aw over custody and also I
- 6:13would have conversations with the warden. So it would just
- 6:16depend on what the situation may be. So if there
- 6:19was instances where I would run things through the chain
- 6:22from the AW to the warden, and there were times
- 6:25that I would take direction directly from the warden. Question Okay,
- 6:29As far as though in this instance, if you know,
- 6:32be in that August ninth and August tenth, I believe
- 6:35that the first person you contacted, he gets cut off
- 6:38by mister Darden. It was redacted. Question and that was
- 6:44because the other AW was out? Is that what you
- 6:46were saying? Answer? My belief is that she was on
- 6:49annual leave, which was stated that we had closed out
- 6:52on that Friday that she would be starting annual leave.
- 6:57Question okay, but the other AW wasn't in fact you're
- 7:00supervisor at the time. Answer yes, question okay? Which you
- 7:07just said was you went with redacted because she was
- 7:09on answer? That's right? Question Okay? Have you since learned
- 7:13anything about like was that not correct? Answer? Well, what
- 7:18I realized is that once the incident had occurred, AW
- 7:22redacted or responded to the institution at which time or
- 7:25annual leave? I believe she canceled her annual leave and
- 7:28she assumed her position as a w over custody. Question,
- 7:32all right, how do you spell her last name? Answer? Misredacted.
- 7:39Question perfect, Thank you. All right. So is it correct
- 7:42that you were interviewed by agents of the FBI and
- 7:45the DOJ and OIG back when this instance occurred in
- 7:48August of twenty nineteen. Answer that is correct. Question great.
- 7:53I'm just going to go over the report that was
- 7:55written in response to their conversation with you. We want
- 7:58to just go over for act you as well as
- 8:01to fill in some gaps that we found that we
- 8:03just need some clarification on. Answer absolutely. Question. So I'm
- 8:08just going to read it and you stop me if
- 8:10there is anything that you find that is inaccurate. Answer
- 8:14correct question, All right. So redacted began his career with
- 8:19BOP and Florence, Colorado in two thousand and five. In
- 8:22twenty fourteen, he was transferred to the Metropolitan Detention Center
- 8:26MDC in Brooklyn to captain at MCC, his current position.
- 8:32He gets cut off by Darden. Yeah there's a lot
- 8:34missing in between there. Question Yeah, yeah, right right. So
- 8:40it says in Brooklyn, I miss this line. It says
- 8:43where he was made deputy captain in twenty fifteen. In
- 8:46twenty eighteen, redacted was promoted to captain at MCC, his
- 8:50current position where he oversees security for the entire building.
- 8:56Answer well, yeah, there was a little bit missing there because, yeah,
- 8:59I answer on duty and I started my career in Florence. However,
- 9:03I left Florence in two thousand and nine and that's
- 9:05when I went to Pollock, FCC Pollock, and then from
- 9:09FCC Pollock from two thousand and nine, I was there
- 9:12to twenty fourteen, and then from fourteen I left Pollock
- 9:15to go to MDC Brooklyn, and then in eighteen that's
- 9:19when I assumed duties at MCC. Question okay, so they
- 9:24have Yeah, so I guess you are transferred to the
- 9:27MDC in Brooklyn in twenty fourteen, and in twenty fifteen
- 9:31was when you were promoted to deputy captain. Answer that
- 9:34is correct, question okay. It says directly supervises approximately thirteen lieutenants.
- 9:40Does that comprise all of the lieutenants this was at
- 9:44the time, Was that all of the lieutenants at MCC
- 9:47Answer correct question okay, and it as approximately one twenty
- 9:51five to one hundred and thirty five line staff correctional
- 9:54officers under his purview. Answer yes, Well, you know when
- 9:59they say that, what they understand is that under correctional services.
- 10:03That was probably the amount of staff that was again
- 10:06in correctional service as subordinate staff. However, my direct supervision
- 10:11would have been just over the thirteen lieutenants question. Okay,
- 10:15there are thirteen oh thirteen lieutenants, right? I thought you
- 10:18were saying gs thirteen. Gotcha. Redacted also sits on the
- 10:22institution's executive staff, which also includes the warden. Redacted's primary
- 10:27duty is to ensure that the security protocols are met
- 10:30by his lieutenants and substaff, and that policy guidelines are
- 10:34being followed as set forth by the BOP. Answer correct question.
- 10:39Among others, redacted is responsible for the following special housing
- 10:43unit Lieutenant Lieutenant redacted is that correct? Answer? Correct question?
- 10:49As an administrative lieutenant responsible for maintaining paperwork. So when
- 10:53you say an administrative lieutenant, here are you saying whoever
- 10:57was acting in the administrative capacity? Answer? No, I wasn't.
- 11:02Basically administrative duties, the administrative duty falls under the appointed
- 11:07shoe lieutenant. The shoe lieutenant. The appointed shoe lieutenant has
- 11:11certain duties that have to be done daily within the unit,
- 11:14not just the supervision of the line staff that work
- 11:17the unit, but also over all on running of the unit,
- 11:21meaning that ensuring that all paperwork is done. Question okay, answer,
- 11:27all security protocols are followed to ensure that inmates or
- 11:31run rosters, to ensure that inmates are placed in the
- 11:33cracked cells or in the proper cells, to ensure that
- 11:36they're supposed to audit set rosters, to ensure that they
- 11:39have proper accountability of the inmates in the unit. Question So,
- 11:43I guess what I was getting at is like how
- 11:45the shoe lieutenant was redacted? Was there a specific person
- 11:49that was the administrative lieutenant? Answer? Yeah, the administrative lieutenant
- 11:54at the time was redacted. Question and you happen to
- 11:57know how to spell that last name? Answer it's redacted.
- 12:02Question thank you, sir an sis lieutenant responsible for paperwork?
- 12:06And who is that? Answer which lieutenant? Question yes, answer okay?
- 12:14And operations in activities lieutenant? Answer which are on the
- 12:20day of the incident? Question yeah? And would you like
- 12:23to see the duty roster for August ninth and August tenth?
- 12:28Question no, okay, do you know who it was? Answer?
- 12:32So I believe the morning watch lieutenant when that incident
- 12:35occurred was lieutenant. What's her damn name. I just said
- 12:38her name. Question I can show you this answer. Yeah. Question,
- 12:42So I'm showing you duty agent roster from or daily
- 12:45assimon roster from Friday, August ninth, twenty nineteen, as well
- 12:49as one from Saturday, August tenth, twenty nineteen. And you
- 12:53can keep them in front of you, just so you can.
- 12:56We're going to talk about people, so you can reference
- 12:58the two. Answer so right, it appears here it would
- 13:04have been redacted. Would have been the operations lieutenant on Saturday,
- 13:07August tenth, twenty nineteen. Question and is it redacted? Answer? Yeah?
- 13:14Question perfect? And what time did you work? Answer? At
- 13:18that time the shift they were working a different schedule.
- 13:21The schedule was I believe it was ten to six. Question. Okay,
- 13:25so ten pm on August ninth, two six hundred on
- 13:28August tenth. Answer that is correct. All right, folks, we're
- 13:33gonna wrap up right here, and in the next episode
- 13:35we're gonna pick up where we left off. All the
- 13:38information that goes with this episode can be found in
