• 1:31
Speaker 4: I'm doing quite well. Dale. It makes me remember as
• 1:36
Speaker 4: you and I were talking off the air and then
• 1:37
Speaker 4: the bumper music came on. The same rule applies in
• 1:40
Speaker 4: a radio studio that applies in hailing a firearm. Treat
• 1:44
Speaker 4: every firearm if it's loaded. Ah yes, indeed, treat every
• 1:47
Speaker 4: mic as if it's hot. You kind of watch what
• 1:49
Speaker 4: you say when you're in the studio because you never
• 1:51
Speaker 4: know when you might pop on the air. That's a
• 1:53
Speaker 4: beautiful good day again. Today we had that snow and
• 1:56
Speaker 4: cold weather, but it's gonna warm up nicely. Driving into Sport,
• 2:00
Speaker 4: of course, I like to vary my my route sometimes
• 2:04
  Speaker 4: I'll come up I sixty four and I wasn't really
• 2:06
Speaker 4: sure this morning what the status was going to be
• 2:08
Speaker 4: over here on the bridge, so I got off at
• 2:10
Speaker 4: Dunbar and came up through Dogtown. Nice drive along the river,
• 2:13
Speaker 4: there on Seventh Avenue. I was listening to Dave's commentary
• 2:17
Speaker 4: about the Marshall plane crash, so I would be remiss,
• 2:22
Speaker 4: I think if we didn't say something about that today
• 2:25
Speaker 4: Tomorrow was the fourteenth. I can certain things that you
• 2:28
Speaker 4: remember in life, where you were when you heard something.
• 2:31
Speaker 4: I remember where I was when, you know, when the
• 2:35
Speaker 4: intercom came on at Hayes Junior High School and Principal
• 2:38
Speaker 4: Sidebottom said, turned on the radio account of John Kennedy
• 2:43
Speaker 4: being shot in Dallas, and where I was standing when
• 2:46
Speaker 4: the word came in that he was deceased. You know,
• 2:49
Speaker 4: I can remember. I can remember just like it was yesterday.
• 2:53
Speaker 4: It was the Saturday in November. I was in the
• 2:56
Speaker 4: school in Morgantown. It's my last year of undergrad. The
• 2:59
Speaker 4: Mountain had played Syracuse in an afternoon game and won,
• 3:03
Speaker 4: and so I'd gone home back I was living over
• 3:05
Speaker 4: on we actually at that time, I was living in
• 3:08
Speaker 4: a fraternity house. Went back, cleaned up, and went out
• 3:14
Speaker 4: to a party and walked in and one of my
• 3:16
Speaker 4: friends said, Hey, did you hear what happened at Marshall's.
• 3:18
Speaker 4: What are you talking about? And said, they got they
• 3:19
Speaker 4: got beaten. Inn't they by East Carolina said no, no, no, no, no,
• 3:21
Speaker 4: there was a plane crash. Wow. And you know one
• 3:27
Speaker 4: of the one of my high Well, he wasn't a
• 3:28
Speaker 4: classmate of mind in high school. Roger Childress was a
• 3:31
Speaker 4: year behind me. He graduated in nineteen sixty eight from
• 3:35
Speaker 4: Saint Alban's High School. But Roger and I were teammates
• 3:38
Speaker 4: because he was a really, really good football player. He
• 3:40
Speaker 4: played as a you know at that time it was
• 3:44
Speaker 4: you know, ten through twelve school, so Roger played every
• 3:48
Speaker 4: game that he was ever eligible to play. He'd been injured,
• 3:53
Speaker 4: but for some reason he made the trip went down
• 3:58
Speaker 4: to Greenville. It was a big deal for Marshall because
• 4:00
Speaker 4: they were going to fly. They had a private, no
• 4:02
Speaker 4: charter plane, which was unusual for the Herd at the time.
• 4:05
Speaker 4: And that's what happened. I was my dentist in Saint Albans,
• 4:09
Speaker 4: where I grew up, was Bruce McCuskey. Doc McCuskey had
• 4:12
Speaker 4: been there for decades and he had a chilling in County. Said.
• 4:16
Speaker 4: It was probably three o'clock in the morning. He was
• 4:18
Speaker 4: at home when the Saint Albans Police Department came to
• 4:21
Speaker 4: his house, locked on the doors. The doc. You've got
• 4:24
Speaker 4: to come down to the office. We need you to
• 4:25
Speaker 4: get Roger Child's dental record scores. When he said boom,
• 4:31
Speaker 4: then all of a sudden he said, well, you know
• 4:34
Speaker 4: what that means. But I'm like Dave this morning, in
• 4:37
Speaker 4: the full impact of what it meant in Huntington didn't
• 4:42
Speaker 4: come home to me. All three of my kids and
• 4:44
Speaker 4: all three of their spouses attended and graduated from Marshall
• 4:49
Speaker 4: up through the early two thousands, but they're not being
• 4:53
Speaker 4: down there. But it's about two thousand and six or seven.
• 4:57
Speaker 4: I had to try a case in Campbell County. It's
• 5:00
Speaker 4: an injury case. May have been injured by a tractor
• 5:02
Speaker 4: trailer out on sixty four and the case was pending
• 5:07
Speaker 4: in a Circle Court of Cabal County. We're going to
• 5:09
Speaker 4: have a start time of nine o'clock on a Monday morning,
• 5:14
Speaker 4: but the judge wanted to sell there at eight thirty.
• 5:16
Speaker 4: So I got a room down at the Holiday and
• 5:17
Speaker 4: Express by Pullman Square the night before, went down early,
• 5:21
Speaker 4: took my file with me and I turned on the
• 5:23
Speaker 4: TV and what's on it was The Boss Johnson as
• 5:27
Speaker 4: Ashes to Glory the documentary and you cannot watch that.
• 5:31
Speaker 4: You cannot watch that literally dry eyed, and no matter
• 5:35
Speaker 4: where you live, you cannot watch that documentary and not
• 5:38
Speaker 4: grasp the total impact on the Huntington community. I mean,
• 5:42
Speaker 4: the seventy five wasn't just the team members it would
• 5:45
Speaker 4: be today because we got huge coaching staffs and attendant personnel,
• 5:51
Speaker 4: but the community leaders, I mean, attorneys, sports figures just gone.
• 5:59
Speaker 4: And god Bos Johnson talked about how he attended like
• 6:03
Speaker 4: twenty eight funerals, you know, and it's just incredible. So
• 6:10
Speaker 4: there's no amount you just can't forget that. And you
• 6:13
Speaker 4: know there's this, oh, I guess understated animosity sometimes between
• 6:21
Speaker 4: Marshall and WU old fans and alumni, which is certainly
• 6:24
Speaker 4: completely out of place and certainly out of place with
• 6:28
Speaker 4: regard to what happened in nineteen seventy. Never forget it,
• 6:32
Speaker 4: and I guess you know, the ceremony will be tomorrow
• 6:35
Speaker 4: they turn off the fountain for the year, and I
• 6:39
Speaker 4: can see Roger Childers like it was yesterday. Yeah he was.
• 6:42
Speaker 4: But so it's a shame, but life goes on. The
• 6:47
Speaker 4: government reopened, Yeah that happened, if that happened, and once
• 6:51
Speaker 4: again I had to admit in our office, well there
• 6:56
Speaker 4: may have been some impact on some of our clients.
• 6:58
Speaker 4: I didn't hear about it. It had little effect that
• 7:01
Speaker 4: last We don't do any federal government work. My wife
• 7:05
Speaker 4: did work for a while in the US District Court,
• 7:07
Speaker 4: but not being a government employee or the beneficiary of
• 7:13
Speaker 4: snap benefits not much of an effect. We'll see what
• 7:18
Speaker 4: happens once again. President Trump had a good idea that
• 7:23
Speaker 4: he's voiced last night. Whether he can implement it or not,
• 7:27
Speaker 4: that's the problems sometimes, you know, the ideas aren't followed
• 7:33
Speaker 4: up by action. This should never happen again. Well, it
• 7:34
Speaker 4: should never happen to start with. Congress needs to get
• 7:37
Speaker 4: We need some leadership in the White House, and we
• 7:39
Speaker 4: need to get these folks in Congress in a room
• 7:43
Speaker 4: and just lay down the law that we're not going
• 7:46
Speaker 4: to have. I don't care what your partisan is is.
• 7:48
Speaker 4: I don't care about you know what you feel about
• 7:50
Speaker 4: your base at home. Your job is here to represent
• 7:53
Speaker 4: all the people in the United States. Let's pass these
• 7:56
Speaker 4: budget bills. We haven't had a regular budget for what
• 7:59
Speaker 4: twenty years. Can't go on this way. That's not a
• 8:01
Speaker 4: way to rule the greatest country of the world. We're
• 8:04
Speaker 4: going to end up ruining things. Got to get a
• 8:06
Speaker 4: handle on this. Uh oh wait, we got a callyhone call.
• 8:11
Speaker 4: That's great, we have a caller that's called in already
• 8:12
Speaker 4: this morning. And then AUTOCU, what is your first name? Caller,
• 8:14
Speaker 4: you have a question for party.
• 8:17
Speaker 3: Bob in poketality code. Bob didn't ready to have a question,
• 8:22
Speaker 3: but he just mentioned Roger Childers being in the plane crash.
• 8:30
Speaker 3: And I knew Roger from the time he was five
• 8:34
Speaker 3: years old, and I followed football all of my life,
• 8:39
Speaker 3: and I don't remember anybody I ever knew that had
• 8:43
Speaker 3: a fervor for football like Roger did.
• 8:48
Speaker 4: Well, you're right about that, Bob. I mean Roger was
• 8:52
Speaker 4: he was a good guy. I mean, you know, you
• 8:54
Speaker 4: remember the people that you knew in high school and
• 8:56
Speaker 4: remember your classmates, maybe better than underclassmen. But he was
• 9:00
Speaker 4: a really good guy. And our coach was Sam LeRose,
• 9:03
Speaker 4: who was a wonderful person, and Carl Garner, and I
• 9:07
Speaker 4: see coach Crawford. He's now still on the Board of Education.
• 9:10
Speaker 4: But in one game they had Roger played the linebacker
• 9:15
Speaker 4: and he wasn't that big a guy, but he was
• 9:17
Speaker 4: tough as a cob. Oh.
• 9:19
Speaker 3: He was tough. He was tough.
• 9:22
Speaker 4: H he just took it upon himself. We called a
• 9:25
Speaker 4: particular defense. Well, Roger, instead of moving up to the
• 9:28
Speaker 4: line as he was supposed to, he took about five
• 9:32
Speaker 4: steps back and he perfectly anticipated the snap and he
• 9:37
Speaker 4: took off running towards a lot of scrimmage before the
• 9:40
Speaker 4: ball was snapped, And just as was snapped, he jumped
• 9:42
Speaker 4: completely over the center and wrapped the quarterback. And it
• 9:45
Speaker 4: was one of the most well you can imagine now
• 9:47
Speaker 4: we're all sixteen seventeen, eighteen year old boy sitting in
• 9:50
Speaker 4: a locker room watching a but at that time it
• 9:52
Speaker 4: was a grainy black and white film, and you can
• 9:55
Speaker 4: imagine how that was received. I just I just remember that,
• 9:59
  Speaker 4: just like.
• 10:00
Speaker 3: You mentioned that he was injured. Actually he had surgery
• 10:04
Speaker 3: for a brain tumor.
• 10:05
Speaker 4: Didn't he Well, you know, I believe you're cred. There
• 10:09
Speaker 4: was a medical reason that he was. He was disqualified,
• 10:13
Speaker 4: he wasn't playing, but he made the trip.
• 10:15
Speaker 3: But his love for football got him on that plane. Yeah,
• 10:19
Speaker 3: let me ask you this. You lived on Virginia Heights.
• 10:23
  Speaker 3: I believe I.
• 10:24
Speaker 4: Actually lived on West Main Street, right across from Fairview
• 10:27
Speaker 4: Grade School up on the hill. But yeah, he backed
• 10:29
Speaker 4: up to Virginia Heights. I mean I could walk through
• 10:32
Speaker 4: the field behind me and up on the hill there
• 10:34
Speaker 4: on High Street. Most of my friends lived on Lyck
• 10:37
Speaker 4: Skillett out on Fairview Drive or.
• 10:42
  Speaker 3: Skillett.
• 10:43
Speaker 4: Really, there are not many people that alive that remember
• 10:46
Speaker 4: that name of that area. Larry Robinson lived out there,
• 10:49
Speaker 4: and Larry had a lex Skillett reunion down at his
• 10:52
Speaker 4: house in Putnam County for several years before he and
• 10:57
Speaker 4: Kenny gillowwater around the masonry contracting business. They retired and
• 11:00
Speaker 4: Larry went to Florida, but it was a great time.
• 11:04
Speaker 4: Lewis had a little grocery store down there that Hensley's
• 11:07
Speaker 4: had a grocery store right there. That's where we caught
• 11:08
  Speaker 4: the school bus.
• 11:09
Speaker 5: Hensley's. Every every morning I would go there. That's where
• 11:12
Speaker 5: I caught the bus and I would always get up there,
• 11:14
Speaker 5: get off with a pocket full of change, and buy
• 11:17
Speaker 5: some some snacks before going home. That was my bus
• 11:19
Speaker 5: stop too. So did you go to Fairview, Bob, Yes,
• 11:24
Speaker 5: I did. Three Hilltoppers.
• 11:26
Speaker 4: I like it, Yeah exact.
• 11:31
Speaker 3: Did you live out there, Coop, Yeah, I.
• 11:33
Speaker 5: Did when I was let's see, probably from age eleven
• 11:37
Speaker 5: to fourteen, I lived in Saint Albans and so it
• 11:40
Speaker 5: was like really my adventurous years. Frankly, that's where I
• 11:42
Speaker 5: rode the bike all over all over Saint Albans, me
• 11:45
Speaker 5: and my friends up there, and so.
• 11:46
Speaker 4: We were all over that, over that area. Yeah, we were.
• 11:48
Speaker 5: We rode our bikes everywhere up there, found all kinds
• 11:51
Speaker 5: of like hidden trails and just it was. It was
• 11:53
Speaker 5: honestly a great time.
• 11:54
Speaker 4: It was a great childhood. It was indeed, I mean
• 11:57
Speaker 4: I a bicycle was the beans of transport. Danny Hendrick
• 12:01
Speaker 4: lived down at the bottom of the hill for me
• 12:03
Speaker 4: and Bobby Smith lived up on top of the hill
• 12:05
Speaker 4: up off of High Street by next door to Jimmy Dotson,
• 12:08
Speaker 4: and we'd get on our bicycle. We would ride all
• 12:11
Speaker 4: the way out Cole River, across the bridge at Tornado,
• 12:14
Speaker 4: back down Smith Creek into Saint Albans, right all over town.
• 12:18
Speaker 4: That's of course then before when you got your driver's license,
• 12:21
Speaker 4: that sort of changed. Then he laid around the house
• 12:23
Speaker 4: and beggs, well, how many you need anything from the store.
• 12:28
Speaker 4: You just wanted to drive so bad. That's what I
• 12:30
Speaker 4: can't understand about like my grandchildren. Uh, some of them
• 12:35
Speaker 4: waited like a year to get a driver's license. With me, buddy.
• 12:38
Speaker 4: It was the day after my eighth sixteenth birthday. I
• 12:41
Speaker 4: was up at the State Police bricks in South Charlesto,
• 12:43
Speaker 4: waiting in line to take the driving test, which I hate,
• 12:46
Speaker 4: which I failed. I had practiced and practiced at parallel parking.
• 12:52
Speaker 4: I hit the barrel the first time and the trooper said,
• 12:55
Speaker 4: out driver on back again. See he said, you gotta
• 12:58
Speaker 4: wait a week. So the next week I went back
• 13:00
Speaker 4: and it was the same trooper and I really needed
• 13:04
Speaker 4: my driver's legs. I was wanting to go to a
• 13:07
Speaker 4: to a dance, you know, I had had a date.
• 13:10
Speaker 4: I want to take the car and uh. He gets
• 13:13
Speaker 4: in the car and we started up and he said
• 13:15
Speaker 4: did I have you before? I said, yeah, yeah, you
• 13:17
Speaker 4: failed me last week on these barrels. As well. Go
• 13:20
Speaker 4: out here and take a right. So we went out
• 13:22
Speaker 4: to the one driveway of the State Police headquarters. I
• 13:25
Speaker 4: took a rite on Jefferson Roads and take another right
• 13:28
Speaker 4: which pulled me right back into the parking lot. He decided,
• 13:32
Speaker 4: he said, I was having a bad day that day.
• 13:34
  Speaker 4: You take this?
• 13:37
Speaker 3: Did I hear you say that? Larry Robinson was retired
• 13:41
  Speaker 3: to Florida.
• 13:41
Speaker 4: Now yeah he is.
• 13:43
Speaker 3: Oh wow, hadn't seen him for a while.
• 13:49
Speaker 4: Little memories they were that there was the first really
• 13:55
Speaker 4: conferentacee I had with death of somebody that I knew
• 13:59
Speaker 4: really well. There was there were some Cyruses, not not
• 14:04
Speaker 4: not Greg and Paula, but the other Cyrus. You Jean Cyrus.
• 14:09
Speaker 4: We called him jean Or. Yeah, he got shot accidentally
• 14:13
Speaker 4: there in Hensley's grocery store and killed him. Was that
• 14:18
Speaker 4: it was? I mean, we were all played all played
• 14:20
Speaker 4: basketball up there at Fairview, and here somebody came up
• 14:23
Speaker 4: and said, uh, well, jean Or Cyrus is dead. Well
• 14:26
Speaker 4: I went home. I mean it was the first time
• 14:28
Speaker 4: I'd ever really I mean, my grandparents that lived down
• 14:30
Speaker 4: in Norfolk, Virginia, my mom's parents, they had passed away,
• 14:33
Speaker 4: but you know that was a little bit distant. And
• 14:37
Speaker 4: while you loved him and cared about him, they lived away.
• 14:39
Speaker 4: They were people went. But I saw jean Or Cyrus
• 14:41
Speaker 4: all the time, and he was a good guy. He
• 14:44
Speaker 4: was older than me. Uh, just like Larry and Stan
• 14:47
Speaker 4: Smith and those guys. Uh, they always sort of took
• 14:52
Speaker 4: care of the younger group of us that played ball
• 14:56
Speaker 4: up there. We looked up to him, looked up. I
• 14:58
Speaker 4: remember when Stan Smith came back in the army. Uh.
• 15:02
Speaker 4: He played football at Saint Albans and he played for
• 15:04
Speaker 4: the Fort Bragg Dragons when he was in the service.
• 15:08
Speaker 4: And of course he came back and coached at Saint
• 15:11
Speaker 4: Albans uh, which was difficult for me. He started coaching
• 15:14
Speaker 4: the last year I was in high school, and I
• 15:16
Speaker 4: would I called him stand One day he said, now, Harvey,
• 15:22
Speaker 4: you can't be calling me stand. I'm coach Smith. So okay. Joyce,
• 15:28
Speaker 4: his sister and I were in from the first grade
• 15:31
Speaker 4: all the way through high school together. They lived right
• 15:33
Speaker 4: there on the road going into Fairview at the time
• 15:35
Speaker 4: when he had to come in.
• 15:35
Speaker 3: The upper end, right there next to the school.
• 15:38
Speaker 4: Yep, right by. Well, listen, boy, was really good to
• 15:41
Speaker 4: hear from you. Baby. We ought to sit down and
• 15:43
Speaker 4: shoot the bulls stop by the office. Uh. You know.
• 15:48
Speaker 4: Larry used to see Larry good Bit and Kenny Gillenwaters partner,
• 15:51
Speaker 4: and then I had Calvin Holstein Guernsey, his older brother.
• 15:55
Speaker 4: They did some remodeling for me at the house. Calvin
• 15:57
Speaker 4: worked out a little partner's local for years years and Uh,
• 16:02
Speaker 4: you know, there was just a whole slew of Bob Brammer. Uh.
• 16:07
Speaker 4: He worked with us for a while in the office
• 16:09
Speaker 4: after he get out of the State Police, doing some
• 16:11
Speaker 4: investigative work as his older brother Jimmy got killed in
• 16:14
Speaker 4: the State Police. That's another just horrible thing that happened
• 16:18
Speaker 4: in the area. And now my daughter lives over in
• 16:21
Speaker 4: the house that I my grandmother lived in, and Jimmy Dodson,
• 16:25
Speaker 4: who used to live up on the hill, just lives
• 16:26
Speaker 4: right pat. Jimmy retired, They did a whole career in
• 16:30
Speaker 4: the army, retired as a colonel, full Bird colonel. He's
• 16:34
Speaker 4: still living out there across from what used to be
• 16:38
Speaker 4: his uncle Freeman Bird's pasture field. Well.
• 16:41
Speaker 3: Actually, in these very early years, Jimmy and his sister
• 16:46
Speaker 3: Anne lived directly next door to me, really lick Skillen,
• 16:51
Speaker 3: before they moved up on the hill. Let me let
• 16:53
Speaker 3: me mention one other thing here before memory Lane. Did
• 16:58
Speaker 3: you remember a guy Hugheye Hansjoel. They called him Hacksaw.
• 17:03
Speaker 4: Oh I remember Hacksaw had that big chew at the
• 17:05
Speaker 4: back of his mouth all.
• 17:06
Speaker 3: All the time, always, and when he talked to you,
• 17:09
Speaker 3: he always had one eye closed.
• 17:11
Speaker 4: Yeah, he loafed out it. If you wanted to see Hacksaw,
• 17:15
Speaker 4: you just go down there and drive by the West
• 17:17
Speaker 4: Side Volunteer Fire Department. And he had a chair that
• 17:20
Speaker 4: he'd leaned back against the wall in front of the
• 17:22
Speaker 4: fire department. He could sit and at one spot, thank you.
• 17:26
Speaker 3: Well. Until until he always had his address when they
• 17:31
Speaker 3: printed phone books, he always had his address listed as
• 17:36
Speaker 3: leek skilled. Yeah, And the phone company tried to make
• 17:40
Speaker 3: him stop it, and he wouldn't stop it. But finally
• 17:44
Speaker 3: the phone company won and they would not allow him
• 17:49
Speaker 3: to list his address in the phone directory as lick
• 17:52
  Speaker 3: skilled anymore.
• 17:54
Speaker 4: I'm sure that didn't sit well with Hacksaw. He was
• 17:57
Speaker 4: one of the He wasn't really a character. I mean
• 17:59
Speaker 4: he worked car about it. I mean, I think he
• 18:00
Speaker 4: had a pretty good job. He just I just remember
• 18:03
Speaker 4: he had more. He's like Nellie Fox times ten. Remember
• 18:06
Speaker 4: Nellie Fox always had a chew at the back of
• 18:08
Speaker 4: his mouth. He played baseball. I saw. I couldn't see
• 18:11
Speaker 4: how he'd put a whole pouch of like red man
• 18:14
Speaker 4: in his mouth at one time and to last all day. Well, listen,
• 18:19
Speaker 4: we got to go out here.
• 18:20
  Speaker 5: Phone call.
• 18:21
Speaker 4: Thanks a lot for that so much. Gett called the
• 18:23
Speaker 4: office sometime, let's get together.
• 18:24
Speaker 5: We always like we always like memory Lane quite a bit.
• 18:26
Speaker 5: That's that's for sure. You can catch the Peyton Law
• 18:29
Speaker 5: Firm when the phone is threes were four seven, five
• 18:31
Speaker 5: five fifty five beause he six threes are four seven
• 18:32
Speaker 5: five five fifty five fifty six.
• 18:34
Speaker 4: Well, that kind of points out one of the things
• 18:37
Speaker 4: that Tom and I are proud of, and we like
• 18:39
Speaker 4: to really taut when we talk about the Peyton Law Firm.
• 18:44
Speaker 4: And I've I'm seventy six years old. I've lived in
• 18:47
Speaker 4: and around Saint Albans, Nitro Hurricane my entire life. Uh,
• 18:53
Speaker 4: my friends are all from there. My kids grew up
• 18:57
Speaker 4: here and been in and out of these courthouses for
• 19:01
Speaker 4: almost fifty two years. Tom's been doing it for twenty
• 19:03
Speaker 4: five years. There's a lot of value if you're looking
• 19:08
Speaker 4: for a lawyer, if you've got an injury case, you've
• 19:11
Speaker 4: got a problem with an insurance company, maybe a disability issue,
• 19:16
Speaker 4: or if you just need to talk about some issue
• 19:18
Speaker 4: that you have in your private or personal or financial life.
• 19:24
Speaker 4: I mean, I can't tell you anybody who to hire.
• 19:26
Speaker 4: And we don't spend the money for major television and
• 19:32
Speaker 4: billboard ad campaigns, because to do that, you've got to
• 19:38
Speaker 4: spend a lot of money, and you've got to keep
• 19:39
Speaker 4: at it. But I think you're probably better off, at
• 19:45
Speaker 4: least to think about those of us who've been here
• 19:48
Speaker 4: for a long long time and know our way around,
• 19:52
Speaker 4: as opposed to looking at a billboard that talks about
• 19:57
Speaker 4: the biggest law firm in the world. I will say
• 19:59
Speaker 4: this about the commercials that that law firm runs there
• 20:02
Speaker 4: very well. They must be done in la because they're
• 20:04
Speaker 4: really high quality. And the guy that runs the firm
• 20:08
Speaker 4: makes some commentary that makes some sense. But those ads
• 20:11
Speaker 4: run everywhere. They're running Arizona, they running Virginia, they're running Kentakey,
• 20:15
Speaker 4: they run here. But if you want to talk to
• 20:18
Speaker 4: the lawyers who know how we live, how the problems
• 20:23
Speaker 4: we have, then give the Peyton Law Firm a call.
• 20:28
Speaker 4: You can either call us on the telephone at three
• 20:30
Speaker 4: oh four seven five five five five five six. You
• 20:34
Speaker 4: can stop by the office at twenty eight oh one
• 20:36
Speaker 4: First Avenue. Our office has been there in this building
• 20:38
Speaker 4: for thirty two years. Before that, it's down the street
• 20:42
Speaker 4: in the building that's no longer there, or you can
• 20:45
Speaker 4: go online Peyton Lawfirm dot com and when you get there,
• 20:49
Speaker 4: you'll see a tab where you can ask a question.
• 20:52
Speaker 4: And if you fill that out and send an email,
• 20:54
Speaker 4: it only goes to me or to Tom that nobody
• 20:57
Speaker 4: else in the office sees it, and we can we
• 20:59
Speaker 4: can replace of those than we do. And I've gotten
• 21:04
Speaker 4: up sometimes when I can't sleep at night at three
• 21:06
Speaker 4: o'clock in the morning and look and see, well, there's
• 21:07
Speaker 4: a couple of emails from yesterday, and you can reply
• 21:09
Speaker 4: to them. We try and promise, We make a promise
• 21:13
Speaker 4: that we try to return every phone call every day.
• 21:16
Speaker 4: Now we can't always do that because he gets so busy,
• 21:18
Speaker 4: and I don't like to call people after supper time
• 21:21
Speaker 4: because first of all, he might be calling during the
• 21:24
Speaker 4: day while they're alone and he don't want anybody else
• 21:26
Speaker 4: at the house and don't have been calling to a lawyer.
• 21:29
Speaker 4: But we do our best, and I've always said and
• 21:32
Speaker 4: if we don't keep that promise, then you can call
• 21:35
Speaker 4: this radio show the next week can call us out
• 21:37
Speaker 4: on it. And that's happened a couple of times, and
• 21:40
Speaker 4: you just have to knuckle down when they have and say, well,
• 21:43
Speaker 4: I apologize because I promised you I would get promised
• 21:46
Speaker 4: everybody we try and get back.
• 21:47
Speaker 5: You've been publicly available on this show for years and
• 21:49
Speaker 5: years and years, though, so you've always stood about that.
• 21:51
Speaker 4: I was thinking about that coming in the door, because
• 21:54
Speaker 4: my thoughts would look, you think about the past when
• 21:57
Speaker 4: you think about you know, November the fourteenth, nineteen seventy.
• 22:03
Speaker 4: The first time I walked through the doors in this
• 22:04
Speaker 4: station was nineteen ninety nine. That's a long time ago. Yeah, Yeah,
• 22:09
Speaker 4: we started I think in December maybe of ninety nine.
• 22:12
Speaker 4: Paul Howard was the sales agent, and we've been doing this.
• 22:17
Speaker 4: I think we've only missed maybe two or three Thursday
• 22:22
Speaker 4: mornings in that period of time. We'll almost do anything
• 22:25
Speaker 4: not to miss the radio. Now there may be a time,
• 22:28
Speaker 4: like I think in a couple of weeks, I'm not
• 22:30
Speaker 4: going to be around Thomas, going to be out of town.
• 22:32
Speaker 4: He'll probably do it by phone, which we can do.
• 22:35
Speaker 4: But I mean, I think staying power and identity with
• 22:38
Speaker 4: the community and knowing your way around these courthouses and
• 22:41
Speaker 4: judges means a lot.
• 22:43
Speaker 5: So you know, it reminds me of this, and as
• 22:47
Speaker 5: an attorney, you probably get sick of hearing this analogy.
• 22:49
Speaker 5: But as a late person and what I've learned from
• 22:53
Speaker 5: doing the show with you and Tom for so long,
• 22:54
Speaker 5: it really does. Often fiction will reflect reality, just throw
• 22:57
Speaker 5: an absurd lens, you know, to try to focus on
• 22:59
Speaker 5: certain things. And the old movie that my cousin Vinny movie,
• 23:04
Speaker 5: it's not until Joe Peshy starts to incorporate language from
• 23:09
Speaker 5: the locals he understands how grit's being made, the correct way,
• 23:12
Speaker 5: the long way, he understands how to get around in
• 23:14
Speaker 5: the air. I mean, it's absurd, but at the same time,
• 23:17
  Speaker 5: I think there's a there's a truth that it communicates
• 23:19
Speaker 5: that people didn't trust him. He wasn't able to communicate
• 23:21
Speaker 5: until he got to know the area. And so that's
• 23:23
Speaker 5: what it means to have an attorney. You don't have
• 23:25
Speaker 5: to worry about Joe Peshy learning the area, a big
• 23:27
Speaker 5: guy from New York. You got your attorneys here that
• 23:29
Speaker 5: already know how to cook the grits.
• 23:31
Speaker 4: One of the great movie lines of all time is
• 23:33
Speaker 4: Joe Pessi saying, what is a grit? Having grown up
• 23:39
Speaker 4: eating grits all the time, I mean, it's it's always
• 23:42
Speaker 4: a pleasure when you get they do it out west too.
• 23:45
Speaker 4: Out there in the Southwest, grits are big, and of
• 23:47
Speaker 4: course they're big down south, but you get up. When
• 23:50
Speaker 4: I went to school in Morgantown, I've never seen a
• 23:51
Speaker 4: pepperoni roll, right, Yeah, you know. I was at what
• 23:54
Speaker 4: up to the JQ. Dickinson Salt Works last Friday. They
• 23:58
Speaker 4: had a dinner. I've never been to one of their dinners,
• 24:01
Speaker 4: and I was sitting across the table from a man
• 24:03
Speaker 4: and his wife from Winterfred. Now she had grown up
• 24:08
Speaker 4: I think down in Potnam Cottymas. She said, I'd never
• 24:10
Speaker 4: been up with the creek till I met him, but
• 24:12
Speaker 4: they've been married for years and years. We were talking
• 24:14
Speaker 4: about one of the things on the menu was sort
• 24:17
Speaker 4: of the chef's adaptation of a pepperoni roll. Well, I
• 24:22
Speaker 4: grew up in Saint oh It was my dad worked
• 24:23
Speaker 4: for the post Office and his brother he was a
• 24:26
Speaker 4: lifer in the Navy, and my mom would grew up
• 24:29
Speaker 4: the coal camp down in Beckley, but she was a nurse. Uh.
• 24:34
Speaker 4: But every other member male member of the family that
• 24:36
Speaker 4: one of my dad's side, they all worked in the
• 24:38
Speaker 4: coal mines, either worked up at Camilton or Valley Camp
• 24:42
Speaker 4: on the other side of the river. I mean Bruce
• 24:43
Speaker 4: and Clayholder and worked for years and years, and their
• 24:45
Speaker 4: dad did up for carbon fuels, and you know, I said, so,
• 24:52
Speaker 4: then I got to talk about how did it come
• 24:55
Speaker 4: to be that the Pepperoni roll is now the talented
• 25:01
Speaker 4: as being that's the coal miner's friend universally. Well, the
• 25:05
Speaker 4: miners I knew, And when they filled their dinner bucket
• 25:09
Speaker 4: they might have a blowny sandwich or maybe some brown
• 25:13
Speaker 4: beans and corn bread, and maybe their wife make a
• 25:16
Speaker 4: piece of cake or something put in. There wasn't until
• 25:18
Speaker 4: I got up North and Morgantown ever even saw a
• 25:20
Speaker 4: pepper any roll. First time I ever saw a pinball
• 25:25
Speaker 4: machine that didn't have flippers, the old machines. And I
• 25:30
Speaker 4: saw these guys playing them, and they'd rack up games
• 25:33
Speaker 4: of what good is it doesn't have flippers? Don't you know?
• 25:35
Speaker 4: You get paid for these? If you've got a hundred points,
• 25:38
Speaker 4: you'd pay like a dime a point, so you could
• 25:41
Speaker 4: get ten dollars if you get the balls to line
• 25:44
Speaker 4: up correctly, A big difference in this state. We've got
• 25:47
Speaker 4: to take a break. Yeah, let's do this. Maybe we'll

Speaker 4: My wife and her brother, Ronny and his boy or
• 27:50
Speaker 4: we'll quote a rat up with us.
• 27:51
Speaker 5: So, you know, I see the Devrize family doing so
• 27:53
Speaker 5: well over at Indiana with a coach and his son
• 27:56
Speaker 5: playing really well over there. I really hope that coach,
• 27:59
Speaker 5: coach Hodge and West Virginia. You know, they've they've played
• 28:02
Speaker 5: pretty well so far. You know, they haven't had great competition,
• 28:04
Speaker 5: but it looks like they were starting to put some
• 28:05
  Speaker 5: things together.
• 28:06
Speaker 4: They could take a while to gel. Yeah, all new team. Yeah,
• 28:09
Speaker 4: thirteen kids have never played together before. They do play
• 28:12
Speaker 4: with intense intensity on defense. This is a big thing. Yeah,
• 28:15
Speaker 4: Tucker Dereez had twenty seven the other night against Barkuett.
• 28:19
Speaker 4: God bless him. I mean, he's a great basketball player
• 28:22
Speaker 4: and I think his dad sort of sold a short.
• 28:24
Speaker 4: Only thing I would have me talk about today to
• 28:26
Speaker 4: The Supreme Court of the United States rejected a case
• 28:30
Speaker 4: this week. There was a case that went to the court.
• 28:34
Speaker 4: Actually it was brought by the clerk from down in Kentucky.
• 28:37
Speaker 4: After the Oberfeld decision, which validated same sex parriage nationwide
• 28:44
Speaker 4: as a constitutional right. A clerk in Kentucky refused to
• 28:48
Speaker 4: issue a license. In fact, then she said, I just
• 28:50
Speaker 4: want to issue any licenses. If you want to discriminate
• 28:54
Speaker 4: against the gay lesbian community, I just want to issue
• 28:57
Speaker 4: any of them. And some litigation resulted. I think she
• 29:01
Speaker 4: was sued. Perhaps a criminal misdemeanor was filed against her
• 29:08
Speaker 4: for figure to do her job, and that case filed
• 29:11
Speaker 4: its way to the Supreme Court, her hope being that
• 29:17
Speaker 4: the court would take her case, void her the adverse
• 29:22
Speaker 4: effects of her position by reversing obertfell, and the court
• 29:27
Speaker 4: declined to hear it. Well, that brought, you know, accolades
• 29:32
Speaker 4: from one part of society and grunts from others. I
• 29:37
Speaker 4: wouldn't make too much of that. Right the Supreme Court,
• 29:42
Speaker 4: they wait for a case that they can decide in
• 29:45
Speaker 4: a meaningful fashion. Now you know, you've got a disgruntled
• 29:49
Speaker 4: clerk who may have suffered some criminal or civil liability
• 29:53
Speaker 4: for refusal to perform an official duty. Essentially a lot
• 29:57
Speaker 4: a good case, a lot of good case. Now let's
• 29:59
Speaker 4: see what happen. Happens when, say, the trustee of a
• 30:05
Speaker 4: local retirement system gets an application from a surviving spouse
• 30:10
Speaker 4: who has a same sex or an application for certain
• 30:15
Speaker 4: spouse where benefits are made to the government a local
• 30:19
Speaker 4: government agency. So they're the issues clear cut. I mean,
• 30:24
Speaker 4: that was Robert Byrd's position. He he opposed same sex marriage, said,
• 30:28
Speaker 4: I don't know what we're going to do with the
• 30:30
Speaker 4: Social Security clerk who's confronted with someone who now says, well,
• 30:33
Speaker 4: I'm entitled survivor benefits something completely foreign to them, regardless
• 30:37
Speaker 4: of your position on that issue. To me, it hasn't
• 30:42
Speaker 4: done any harm. I mean, I assume there are I've
• 30:44
Speaker 4: got some good friends who are married, they're same sex,
• 30:48
Speaker 4: that they're still the same nice people they were before.
• 30:51
Speaker 4: And I don't think that it's affected my life at
• 30:53
Speaker 4: all that someone in I say, if somebody wants to
• 30:57
Speaker 4: make themselves miserable with a bad marriage, zisco have at it.
• 31:03
Speaker 4: It's not going to affect my life here in West Virginia.
• 31:05
Speaker 4: But I wouldn't make too much of that. That decision
• 31:08
Speaker 4: to not hear a case, that particular case. It was
• 31:13
Speaker 4: just a bad case on the facts. You get a
• 31:15
Speaker 4: good case on the facts, and you know the position
• 31:19
Speaker 4: of justice Thomas, and I think I probably know the
• 31:22
Speaker 4: position of justice Alito is that like the right to
• 31:28
Speaker 4: an abortion that was found in the Dobbs case not
• 31:31
Speaker 4: to be embedded in the Constitution. They are the opinion
• 31:35
Speaker 4: firmly that the right to a marriage of any kind
• 31:41
Speaker 4: is not necessarily protected in the Constitution. We'll see what
• 31:44
Speaker 4: happens when the right case comes along. I suspect they're
• 31:47
Speaker 4: going to take one am sometime in the future.
• 31:50
Speaker 5: I'm kind of glad you brought that up. Just I
• 31:53
Speaker 5: was thinking about this and had read some things about it,
• 31:55
Speaker 5: and I don't know how much of a political animal
• 31:58
Speaker 5: the Supreme Court is now. I don't want to make
• 32:00
Speaker 5: those assertions. However, if the thought was that this is
• 32:03
Speaker 5: something this would be very bad for the incumbent party
• 32:07
Speaker 5: because because of the optics of it and that it's
• 32:10
Speaker 5: generally well more accepted than it was twenty five years
• 32:12
Speaker 5: or twenty years ago when this happened. This isn't the
• 32:15
Speaker 5: right case, like you said, you'd have to have a
• 32:17
Speaker 5: case that would be politically feasible as well, or you're
• 32:20
Speaker 5: just going to wreck one party.
• 32:21
Speaker 4: Well, that's true, but then again it's not. It has
• 32:25
Speaker 4: become unfortunately, it has become at least the perceived role
• 32:30
Speaker 4: of the United States Supreme Court in our society to
• 32:33
Speaker 4: decide big policy issues. That's not the Supreme Court job.
• 32:37
Speaker 4: If somebody's going to set policy in a country. I mean,
• 32:41
Speaker 4: I've always thought about like the cigarette tobacco litigation, subject
• 32:47
Speaker 4: to a lot of criticism, a lot of money changed hands,
• 32:50
Speaker 4: a lot of lawsuits were brought. My answer was, look,
• 32:53
Speaker 4: Congress could have taken care of this. One or another
• 32:58
Speaker 4: of our presidents elected over the last forty years could
• 33:01
Speaker 4: have taken a firm position about the harms of tobacco
• 33:04
Speaker 4: and whether you need litigation. They could have addressed this.
• 33:07
Speaker 4: Asbestos could have been addressed, the scourge of mesas, thelioma,
• 33:12
Speaker 4: the long latent disease that can result from asbestos exposure.
• 33:18
Speaker 4: Congress could have stepped in. They could have created a fund,
• 33:21
Speaker 4: They could have set forth some sort of streamlined process.
• 33:25
Speaker 4: It just wasn't politically in tuned. We just didn't have
• 33:28
Speaker 4: the leadership in Congress of the state level said the policy.
• 33:32
Speaker 4: If the legislative and executive branches will not move forward
• 33:36
Speaker 4: to address issues that really affect the American people, well
• 33:39
Speaker 4: what's left. The third branch is the judiciary and the lawyers.
• 33:46
Speaker 4: It's still a capitalist system. The law is a noble
• 33:50
Speaker 4: professions also a way to make a living. And so
• 33:55
Speaker 4: if there's a void left by the legislative or executive branch,
• 34:00
Speaker 4: the lawyers and the courts are going to fill it.
• 34:02
Speaker 4: And that's what we may not be happy with it,
• 34:05
Speaker 4: but don't blame the lawyers. Don't blame the courts. Talk
• 34:09
Speaker 4: to your elected representatives, to Congress or to the state
• 34:12
Speaker 4: legislature and think about it. When there are presidential debates
• 34:15
Speaker 4: and say what are we going to do about this issue?
• 34:17
Speaker 4: You know we've got you know, the government shut down
• 34:21
Speaker 4: in this is I'm kind of getting far afield here
• 34:24
Speaker 4: from from from the law. But this events that affect
• 34:29
Speaker 4: the people that we represent, whether they're political or practical,
• 34:36
Speaker 4: determine the way we think and try to advise our clients. Now,
• 34:39
Speaker 4: you know, there's a problem that's going to be coming
• 34:42
Speaker 4: with regard to healthcare, affordability of insurance, the ability to
• 34:47
Speaker 4: spread the risk of harm among a large pool of
• 34:52
Speaker 4: the population. That's all insurance is so risk spreading function
• 34:58
Speaker 4: or this really dumb gone Wressmen say, well, this is
• 35:01
Speaker 4: a scam because I paid all this money for insurance
• 35:04
Speaker 4: and I've never filed a claim. So you know, you
• 35:05
Speaker 4: don't understand what insurance is your house. Your house hasn't
• 35:08
Speaker 4: burned down either, but you buy homeowners right, you got
• 35:11
Speaker 4: life insurance and you haven't died. You buy a piece
• 35:15
Speaker 4: of risk avoidance. That's what you're buying. So if indeed
• 35:23
Speaker 4: the problem with the expiration of the covid era tax
• 35:28
Speaker 4: credits for participation in Affordable Care Act insurance is as
• 35:33
Speaker 4: bad as it's predicted to be, then that's going to
• 35:35
Speaker 4: come to the forefront. I thought on the shutdown, if
• 35:39
Speaker 4: I'd have been in Congress, so we'll I'll vote to
• 35:41
Speaker 4: keep the government open. If it's as bad as we
• 35:44
Speaker 4: think it's going to be, then you people are going
• 35:46
Speaker 4: to own it all and we'll talk about this before
• 35:48
Speaker 4: the midterms and we'll go to the ballot box. We'll
• 35:50
Speaker 4: solve this problem, which is the way it's supposed to work,
• 35:53
Speaker 4: I think in the United States. So yeah, that it
• 35:56
Speaker 4: seems to make sense, right you vote. You know, of course,
• 36:00
Speaker 4: I don't know what the legislature is going to do
• 36:02
Speaker 4: here in West Virginia once they come in, if they're
• 36:07
Speaker 4: going to take any steps that will affect the rights
• 36:09
Speaker 4: of the people we represent. There's been you know, another
• 36:13
Speaker 4: onslaught I was reading an op ed by a local
• 36:18
Speaker 4: orthopedic surgeon about availability of health care, and most of
• 36:23
Speaker 4: them I thoroughly agreed with it. I think these doctors
• 36:26
Speaker 4: are burdened administratively by the necessity of filing all these claims.
• 36:30
  Speaker 4: I mean, I've represented some physicians and I take a
• 36:33
Speaker 4: look at their books. It's that you know, you bill
• 36:35
Speaker 4: all this money. But he said, yeah, but we only
• 36:37
Speaker 4: get what insurance pays. We can't. You just can't balance bill.
• 36:40
Speaker 4: In West Virginia, it's such a small community. If the
• 36:42
Speaker 4: word gets out you balance bill, you won't get any customers. Uh,
• 36:46
Speaker 4: they don't make as much money as people think.
• 36:47
Speaker 5: They My practice, insurance and loan will will will drain
• 36:51
Speaker 5: your bank account pretty quickly.
• 36:52
Speaker 4: Indeed it will. But then, of course then it was well,
• 36:55
Speaker 4: we need to reform to eliminate frivolous lawsuits, and I think, well,
• 36:59
Speaker 4: you know it's for the author of that peace had
• 37:03
Speaker 4: been a party to a really well publicized lawsuit over
• 37:10
Speaker 4: the death of a young athlete who submitted to somewhat
• 37:15
Speaker 4: of a routine procedure and died as a result of
• 37:18
Speaker 4: what appear to be a misplaced epinephrine injection. Adrenaline got
• 37:24
Speaker 4: into a vein, and that's it's deadly. It's not the answer.
• 37:29
Speaker 4: I mean the answer. One of the answers is when
• 37:33
Speaker 4: Larry and we had a Supreme Court justice, we got
• 37:37
Speaker 4: oh one minute listen, just like Bob. If you want
• 37:42
Speaker 4: to talk, let's come down to the office. If you
• 37:45
Speaker 4: have a claim, if you suffer a loss or an injury.
• 37:48
Speaker 4: We've been around here long enough, but we know this
• 37:50
Speaker 4: area well enough to really help you. And that's what
• 37:54
Speaker 4: we're here for. We are here Tom Hawk and Harvey
