Speaker 1: What's up everyone, and welcome back to the program. So
• 0:04
Speaker 1: I'm not usually somebody that likes to dip into the
• 0:07
Speaker 1: morbid and get down to every granular detail of a
• 0:11
Speaker 1: crime scene. I think that that is a bit repetitive
• 0:14
Speaker 1: most times, and I think that it's unneeded. But when
• 0:18
Speaker 1: we're talking about Brian Colberger and the fact that he
• 0:21
Speaker 1: has filed this appeal, I think it's very important to
• 0:25
Speaker 1: understand and know just exactly what happened to these four kids.
• 0:30
Speaker 1: So in this episode, we're going to begin taking a
• 0:32
Speaker 1: look at the report from Bena Singh, who is the
• 0:37
Speaker 1: Spokane County Chief Medical Examiner and forensic pathologist, and she
• 0:42
Speaker 1: was the one responsible for the report and the post
• 0:45
Speaker 1: mortem examinations. And just a heads up before we dive in.
• 0:50
Speaker 1: This is graphic in nature and a lot of it
• 0:53
Speaker 1: is stomach turning. But again, I think it's very important
• 0:56
Speaker 1: that we understand the kind of person that we're dealing
• 0:58
Speaker 1: with when we're talking about Brian Colberger. So let's dive in.
• 1:05
Speaker 1: Exhibit S one State supplemental response to Request for Discovery
• 1:10
Speaker 1: regarding Penalty phase experts Venus Singh. The state is disclosed.
• 1:15
Speaker 1: Venus Singh, Spokane County Chief Medical Examiner and forensic Pathologist.
• 1:20
Speaker 1: In this supplemental discovery response, it's anticipated that the state
• 1:24
Speaker 1: will call doctor Singh to testify as an expert regarding
• 1:27
Speaker 1: the autopsies performed at Spokane County Medical Examiner's office on
• 1:32
Speaker 1: November sixteenth, twenty twenty two, on the following individuals, Ethan Chapin,
• 1:37
Speaker 1: Kaye Gonsalvis, Xana Kernodle, and Madison Mogen. This response serves
• 1:43
Speaker 1: to supplement the information in the autopsy reports for Ethan Chapin,
• 1:47
Speaker 1: Kali Gonsalvis, Xana Kernodle, and Madison Mogan attached as Exhibit
• 1:52
Speaker 1: S one A through d photographs and or video, and
• 1:56
Speaker 1: related to reports as previously discovered to defense. The below
• 2:01
Speaker 1: is a summary of doctor Singh's anticipated testimony, but does
• 2:05
Speaker 1: not repeat all specific findings that are detailed in her reports.
• 2:09
Speaker 1: Based on doctor Singh's education, training, and experience as Chief
• 2:13
Speaker 1: Medical Examiner and forensic pathologist, Doctor Singh will testify it
• 2:17
Speaker 1: or performing post mortem examinations on Ethan Chapin, Kaale Gon Solves,
• 2:22
Speaker 1: Xana Kernodle, and Madison Mogen. It's expected that doctor Singh
• 2:27
Speaker 1: will testify that kale gon solves, Xana Kernodle, and Madison
• 2:31
Speaker 1: Mogen endured a high degree of pain and or suffering
• 2:34
Speaker 1: prior to their death as a result of the injuries inflicted.
• 2:38
Speaker 1: It's expected that doctor Singh will testify that Ethan Chapin
• 2:42
Speaker 1: also experienced a high degree of pain and or suffering
• 2:45
Speaker 1: prior to his death as a result of the injuries inflicted,
• 2:49
Speaker 1: but to a lesser degree than the other decedents. Doctor
• 2:53
Speaker 1: Singh will testify regarding chain of custody, observations, examinations, evidence collected,
• 2:59
Speaker 1: test performed, and cause of death. It's doctor Singh's expert
• 3:03
Speaker 1: opinion that Ethan Chapin's cause of death is multiple sharp
• 3:06
Speaker 1: force injuries. Doctor Singh's post mortem examination showed a well
• 3:11
Speaker 1: developed adult male with stab and incised wounds of the scalp,
• 3:15
Speaker 1: face and neck, a stab wound of the upper chest,
• 3:20
Speaker 1: insize wounds of the upper extremities, stab and incised wounds
• 3:25
Speaker 1: of the lower extremities. Associated injuries to include perforations of
• 3:30
Speaker 1: the jugular vein, subclavian vein, and subclavian artery. Doctor Singh
• 3:36
Speaker 1: will testify that there was no evidence of natural disease
• 3:39
Speaker 1: that would have contributed to Chapin's death. Post mortem toxicology
• 3:44
Speaker 1: showed Chapin had a blood alcohol concentration of zero point
• 3:48
Speaker 1: one two two mls and an amphetamine level of two
• 3:52
Speaker 1: hundred and sixty and g mL. And just interject here
• 3:57
Speaker 1: my guess is adderall. In addition, doctor Singh will provide
• 4:01
Speaker 1: testimony regarding evidence that the knife used on Chapin showed
• 4:05
Speaker 1: indications that there was a blade guard. Doctor Singh will
• 4:09
Speaker 1: provide her opinion that Chapin's wounds are consistent with a
• 4:12
Speaker 1: single edged knife as the source of the wounds. Doctor
• 4:16
Speaker 1: Singh will provide her opinion that the use of the
• 4:19
Speaker 1: k bar knife US Marine Corps fighting knife is consistent
• 4:23
Speaker 1: with the injuries observed. It's doctor Singh's opinion that Kaylee
• 4:28
Speaker 1: Goan solve this cause of death is multiple sharp force injuries.
• 4:32
Speaker 1: In addition, blunt force injuries of the head and asphyxial
• 4:35
Speaker 1: injuries are a significant contributor to her death. Doctor Singh's
• 4:41
Speaker 1: post mortem examination showed a well developed adult female with
• 4:44
Speaker 1: stab and incised wounds of the scalp, face and neck,
• 4:49
Speaker 1: stab and incised wounds of the chest and stab and
• 4:52
Speaker 1: incized wounds of the upper extremities associated injuries that include
• 4:57
Speaker 1: punctures of the outer table of the skull, injuries to
• 5:01
Speaker 1: the teeth and tongue, perforations of the subclavian artery in vain,
• 5:06
Speaker 1: and hemorrhage into the chest cavity. Doctor Singh observed blunt
• 5:10
Speaker 1: force injuries including scalp lacerations, bleeding around the brain, and
• 5:14
Speaker 1: a nasal fracture, as well as scrapes on the nose
• 5:17
Speaker 1: and cheeks, bruising around the eyes, and patterned bruises extending
• 5:22
Speaker 1: across the lower face. Doctor Singh will testify that an
• 5:26
Speaker 1: unidentified object was pressed across Gonsalvus's mouth. Doctor Singh observed
• 5:32
Speaker 1: pateechual hemorrhages in the eyes and mouth. Doctor Singh will
• 5:36
Speaker 1: testify there was no evidence of natural disease and that
• 5:40
Speaker 1: would have caused or contributed to Gonsalvas's death. Post mortem
• 5:44
Speaker 1: toxicology showed gonsolvs had a blood alcohol concentration of point
• 5:49
Speaker 1: one zero seven. Doctor Singh will provide her opinion that
• 5:53
Speaker 1: Gonsalvas's wounds are consistent with a single edged or double
• 5:56
Speaker 1: edged knife being used as a source of the wounds.
• 6:00
Speaker 1: Doctor Singh will provide her opinion that the use of
• 6:03
Speaker 1: a k bar full size Marine Corps fighting knife is
• 6:07
Speaker 1: consistent with the injuries observed. It's doctor Singh's expert opinion
• 6:11
Speaker 1: that Xana Kernodle's cause of death was multiple sharp force injuries.
• 6:16
Speaker 1: Doctor Singh's post mortem examination showed a well developed adult
• 6:20
Speaker 1: female with stab and incised wounds of the scalp, face
• 6:23
Speaker 1: and neck, stab wounds of the chest and abdomen, incised puncture,
• 6:28
Speaker 1: wounds of the back, incised wound of the upper extremities,
• 6:32
Speaker 1: and wounds of the lower extremities. Doctor Singh also observed
• 6:37
Speaker 1: associated injuries including punctures of the outer table of the skull,
• 6:41
Speaker 1: perforations of the jugular vein, heart lungs and pulmonary blood vessels,
• 6:47
Speaker 1: hemorrhage into the chest, cavities, and wounds extending into the
• 6:51
Speaker 1: bones of the hand. Doctor Singh will testify that some
• 6:57
Speaker 1: of the injuries sustained are defensive injuries. In addition, Kernodle's
• 7:02
Speaker 1: injuries included scrapes and bruises on the face, torso, and extremities.
• 7:07
Speaker 1: There was no evidence that natural disease would have caused
• 7:09
Speaker 1: or contributed to Colonodle's death. Post mortem toxicology showed Kernodle
• 7:15
Speaker 1: had a blood alcohol concentration of zero point two two
• 7:19
Speaker 1: and an amphetamine level of twelve and G. Doctor Singh
• 7:24
Speaker 1: will provide her opinion that Kernodle's wounds are consistent with
• 7:27
Speaker 1: the single edged or double edged knife being the source
• 7:30
Speaker 1: of the wounds. In addition, the handle and or tip
• 7:33
Speaker 1: of the knife could account for the appearance of serration
• 7:36
Speaker 1: on some of Kernodle's face wounds. Doctor Singh will opine
• 7:40
Speaker 1: that the serration could be caused by Cernodle fighting and
• 7:44
Speaker 1: or holding touching the knife and or hand that is
• 7:47
Speaker 1: holding the knife causing the injury. Doctor Singh will provide
• 7:51
Speaker 1: her opinion that the use of the k bar full
• 7:53
Speaker 1: size US Marine Corps knife is consistent with the injuries observed.
• 7:58
Speaker 1: It's doctor Singh's expert apearinion that Madison Mogen's cause of
• 8:01
Speaker 1: death is multiple sharp force injuries. Doctor singh post mortem
• 8:06
Speaker 1: examination showed a well developed adult female with stab and
• 8:10
Speaker 1: incise wounds of the scalp and face and neck, stab
• 8:14
Speaker 1: wounds of the chest, and incise wounds of the upper extremities.
• 8:18
Speaker 1: Doctor Singh also observed associated injuries, including wounds of the
• 8:22
Speaker 1: lung and liver, as well as perforations of the subclavian vein,
• 8:27
Speaker 1: subclavian artery, and blood vessels of the chest wall. There
• 8:32
Speaker 1: was no evidence of natural disease that would have caused
• 8:35
Speaker 1: or contributed to Mogan's death. Post mortem toxicology testing showed
• 8:39
Speaker 1: Mogen had a blood alcohol concentration of point two eight.
• 8:44
Speaker 1: Doctor Singh will provide her opinion that Mogan's wounds are
• 8:48
Speaker 1: consistent with a single edged knife as the source of
• 8:51
Speaker 1: the wounds. Doctor Singh will provide her opinion that the
• 8:54
Speaker 1: use of a k bar full sized marine corps knife
• 8:58
Speaker 1: is consistent with the injuries observed. Doctor Singh will testify
• 9:02
Speaker 1: that a single large blade singular double edged knife could
• 9:05
Speaker 1: be responsible for all wounds observed on Chapin, Gonsalves, Kernodle,
• 9:10
Speaker 1: and Mogen. Doctor Singh's opinion and testimony will be based
• 9:14
Speaker 1: on her experience, education training as detailed in the Curriculum Vitae,
• 9:19
Speaker 1: which is included with the response as Exhibit S one E.
• 9:24
