Speaker 1: What's up, everyone, and welcome to another episode of the
• 0:03
Speaker 1: Epstein Chronicles. In this episode, we're diving right back into
• 0:06
Speaker 1: the discussion about Jeffrey Epstein and the failure of the
• 0:10
Speaker 1: DOJ to go after his enterprise, and that history is
• 0:14
Speaker 1: why assurances that later prosecutors would follow the facts wherever
• 0:18
Speaker 1: they lead has always rung hollow. After Maxwell's conviction, sdn
• 0:23
Speaker 1: Y publicly promised that no one, however powerful or well connected,
• 0:27
Speaker 1: stood above the law. Fine words are not the same
• 0:30
Speaker 1: thing as indictments. The public has never seen a corresponding
• 0:34
Speaker 1: wave of federal prosecutions dismantling the broader Epstein infrastructure. We've
• 0:39
Speaker 1: not seen racketeering charges against an operational network. We haven't
• 0:43
Speaker 1: seen a comprehensive criminal accounting of Epstein's financial apparatus. We
• 0:48
Speaker 1: have not seen an immigration fraud prosecution tying foreign recruitment
• 0:52
Speaker 1: to the enterprise. We have not seen an obstruction case
• 0:55
Speaker 1: explaining years of alleged concealment. The government's rhetoric expanded, while
• 1:00
Speaker 1: its defendant lists remained astonishingly small. The most serious inference
• 1:05
Speaker 1: is therefore institutional, rather than conspiratorial. Prosecutors understood that an
• 1:12
Speaker 1: authentic reco investigation could not be tightly controlled around Epstein
• 1:16
Speaker 1: and Maxwell, because the statute's logic demands investigation of the
• 1:20
Speaker 1: enterprise itself. Once investigators begin mapping in enterprise, they don't
• 1:25
Speaker 1: know in advance where the evidence will terminate. Financial records
• 1:28
Speaker 1: may lead to professionals. Travel records may lead to additional witnesses.
• 1:33
Speaker 1: Immigration files may expose document fraud. Witness testimony may identify recruiters, facilitators, abusers,
• 1:40
Speaker 1: or people involved in concealment. Cooperation agreements may reveal entirely
• 1:46
Speaker 1: new branches of conduct. A government determined to limit institutional
• 1:50
Speaker 1: fallout would have every incentive to avoid opening that investigative
• 1:54
Speaker 1: architecture in the first place. Now, look, that doesn't mean
• 1:58
Speaker 1: there's a publicly proven memo saying do not charge Rico
• 2:01
Speaker 1: because too many important people will get caught. No such
• 2:05
Speaker 1: evidence is necessary to make the broader institutional critique. Bureaucracies
• 2:09
Speaker 1: rarely document self protective incentives in cartoonishly explicit language. Decisions
• 2:15
Speaker 1: reveal priorities through what institutions repeatedly choose to investigate, charge, immunize, disclose,
• 2:22
Speaker 1: and ignore. In Epstein's case, the pattern included in an
• 2:26
Speaker 1: extraordinarily broad non prosecution agreement, protection for potential co conspirators,
• 2:31
Speaker 1: secrecy from victims, a limited state resolution, a narrow twenty
• 2:35
Speaker 1: nineteen indictment, one subsequent marquee prosecution, and years of public
• 2:40
Speaker 1: uncertainty about the wider network. Individually, each choice can be rationalized. Collectively,
• 2:46
Speaker 1: they form a damning picture of containment. At minimum, the
• 2:50
Speaker 1: government consistently chose strategies that minimize the number of people
• 2:54
Speaker 1: exposed to criminal adjudication. En Rico would have threatened that
• 2:59
Speaker 1: containment because conspiracy liability is especially dangerous to compartmentalize criminal organizations,
• 3:06
Speaker 1: A defendant does not necessarily escape a reco conspiracy merely
• 3:10
Speaker 1: because someone else personally committed particular racketeering acts. The focus
• 3:15
Speaker 1: can become whether participants agreed to further the criminal enterprise
• 3:19
Speaker 1: and understood its essential nature. That allows prosecutors to examine managers, organizers, recruiters, administrators,
• 3:27
Speaker 1: and facilitators according to their actual functions. The statute is
• 3:32
Speaker 1: designed to penetrate division of labor. Epstein's operation depended on
• 3:37
Speaker 1: division of labor. Girls had to be located, contacted, scheduled, transported, paid,
• 3:42
Speaker 1: and sometimes recruited again. Properties had to be staffed, travel arranged,
• 3:47
Speaker 1: and money constantly supplied. The government understood exactly that principle
• 3:53
Speaker 1: when it prosecuted Kelly. Kelly didn't personally drive every car,
• 3:57
Speaker 1: purchase every ticket, arrange every whole time, tell room, or
• 4:01
Speaker 1: escort every victim. Prosecutors alleged that members of his entourage
• 4:06
Speaker 1: performed complementary roles that furthered his objectives. That was enough
• 4:10
Speaker 1: to make their conduct relevant to the enterprise theory. Epstein's
• 4:14
Speaker 1: world contained the same basic division between principle and infrastructure,
• 4:19
Speaker 1: only on a spectacular international skill. The analytical inconsistency is glaring.
• 4:25
Speaker 1: When R. Kelly's assistants allegedly facilitated access to victims, prosecutors
• 4:30
Speaker 1: called it racketeering infrastructure. When Epstein's employees and associates helped
• 4:36
Speaker 1: maintain a steady supply of miners, the government described the
• 4:39
Speaker 1: facts but stopped short of the same organizational indictment. Now,
• 4:44
Speaker 1: the Rainiery comparison is harsher because prosecutors followed peripheral crimes outward.
• 4:49
Speaker 1: Nexium's case included identity fraud, immigration offenses, obstruction, wire fraud, extortion,
• 4:55
Speaker 1: forced labor, money laundering allegations, and sex trafficking with in
• 5:00
Speaker 1: the same organizational story. That is exactly what rico permits
• 5:04
Speaker 1: prosecutors to do when different crimes sustain the same enterprise.
• 5:10
Speaker 1: Epstein's world has long generated serious allegations involving trafficking, financial impropriety,
• 5:16
Speaker 1: immigration schemes, false statements, obstruction, exploitation, and the concealment of
• 5:21
Speaker 1: criminal activity. A competent enterprise investigation would not assume that
• 5:26
Speaker 1: all allegations are true. It would test them. It would
• 5:29
Speaker 1: subpoena records, compel testimony where legally possible, immunize, strategically, prosecute
• 5:35
Speaker 1: provable falsehoods, and build predicate acts one by one. The
• 5:39
Speaker 1: absence of such visible comprehensiveness remains one of the defining
• 5:43
Speaker 1: scandals of the whole Epstein case. There is also an
• 5:47
Speaker 1: accountability reason for rigo that goes beyond convictions. Racketeering cases
• 5:52
Speaker 1: create records. They produce speaking indictments forfeiture allegations, enterprise descriptions,
• 6:00
Speaker 1: operating witness testimony, financial exhibits, communications, plea allocutions, sentencing memoranda,
• 6:06
Speaker 1: and judicial findings. Those materials explain organizations to the public.
• 6:12
Speaker 1: Epstein's story instead became a documentary graveyard spread across civil cases,
• 6:17
Speaker 1: seal filings, regulatory actions, victim testimony, leaked records, investigative journalism,
• 6:24
Speaker 1: and you know, periodic government disclosure, and that fragmentation has
• 6:28
Speaker 1: helped every interested party claim that the public is must
• 6:31
Speaker 1: misunderstanding something. Because the definitive criminal case was never built,
• 6:36
Speaker 1: a Rico prosecution could have forced the federal government to
• 6:38
Speaker 1: put its theory of the enterprise on paper. The failure
• 6:42
Speaker 1: to do so ensured the crucial questions survived Epstein himself.
• 6:46
Speaker 1: And I think this all matters because criminal accountability is
• 6:49
Speaker 1: not simply about maximizing a sentence against one defendant. Epstein
• 6:54
Speaker 1: already faced devastating trafficking exposure in twenty nineteen, Maxwell ultimately
• 6:59
Speaker 1: received twenty years. A prosecutor focused only on those numbers
• 7:04
Speaker 1: could argue that adding Rico would have been redundant. But
• 7:08
Speaker 1: Rico's value was never principally about adding another twenty years
• 7:11
Speaker 1: to Epstein's theoretical sentence. Its value was forcing the government
• 7:16
Speaker 1: to prosecute the organization rather than the personality. Kelly's Rico
• 7:21
Speaker 1: case explained how his entourage allegedly enabled them. Nexium's prosecution
• 7:25
Speaker 1: explained how Raynier's organization transformed different crimes into a single system.
• 7:32
Speaker 1: Epstein's case demanded that same institutional clarity, because almost every
• 7:36
Speaker 1: major mystery surrounding him concerns infrastructure. Who recruited the victims,
• 7:41
Speaker 1: who scheduled them, who arranged travel, who moved money, who
• 7:44
Speaker 1: knew ages, who facilitated foreign recruitment, who responded to law
• 7:49
Speaker 1: enforcement's attention, who helped preserve Epstein's access after the two
• 7:53
Speaker 1: thousand and eight conviction. Those are enterprise questions, not merely
• 7:57
Speaker 1: questions about one man's sexual apple tights. The government's reluctance
• 8:02
Speaker 1: is even less defensible because RICO does not require prosecutors
• 8:05
Speaker 1: to charge every conceivable participants simultaneously. They could have started
• 8:10
Speaker 1: narrowly with Epstein, Maxwell and the strongest provable operational defendants.
• 8:15
Speaker 1: They could have superseded the indictment as cooperators emerged and
• 8:19
Speaker 1: evidence developed. They could have severed defendants where fairness required it.
• 8:23
Speaker 1: They could have charged some participants with racketeering and others
• 8:27
Speaker 1: with standalone offenses. They could have used immunity strategically for
• 8:31
Speaker 1: lesser actors. They could have prosecuted immigration or financial crime separately,
• 8:36
Speaker 1: while using them as evidence of enterprise conduct. Federal prosecutors
• 8:41
Speaker 1: manage complex organizations. This way constantly, and keep in mind,
• 8:44
Speaker 1: a RICO investigation would not have required criminalizing Epstein's entire
• 8:49
Speaker 1: legitimate business life. RICO enterprises frequently mixed lawful and unlawful activity.
• 8:56
Speaker 1: Kelley's alleged enterprise existed alongside a legitimate music career. Colm's
• 9:00
Speaker 1: alleged enterprise was tied to legitimate business and employees. Even
• 9:04
Speaker 1: though the jury ultimately rejected the racketeering charge, Nexium sold
• 9:10
Speaker 1: legitimate looking courses while criminal conduct occurred within its hierarchy.
• 9:14
Speaker 1: The legal question is whether the enterprise affairs were conducted
• 9:18
Speaker 1: through a pattern of racketeering activity. Epstein's legitimate investments and
• 9:22
Speaker 1: financial relationships therefore would not have defeated or reco theory.
• 9:27
Speaker 1: They may have actually made enterprise analysis more necessary. I
• 9:31
Speaker 1: think that the moral comparison with Kelly is particularly difficult
• 9:34
Speaker 1: for DOJ to escape. Kelly was a wealthy celebrity accused
• 9:38
Speaker 1: of using employees and entourage members to obtain and control
• 9:42
Speaker 1: women and girls. Epstein was a wealthy financier accused of
• 9:46
Speaker 1: using employees, associates, victim recruiters, properties, money, and travel infrastructure
• 9:52
Speaker 1: to obtain and exploit girls. Prosecutors looked at Kelly and
• 9:55
Speaker 1: saw an enterprise. Prosecutors looked at Epstein and saw two
• 9:59
Speaker 1: trafficking counts. Kelley's prosecution ultimately produced a racketeering conviction and
• 10:04
Speaker 1: a thirty year sentence. Epstein died before his narrow federal
• 10:08
Speaker 1: prosecution could reach them. The difference cannot be explained by
• 10:13
Speaker 1: statutory impossibility, and the most disturbing explanation is not that
• 10:17
Speaker 1: DOJ lawyers were too stupid to recognize Rico. Federal prosecutors
• 10:22
Speaker 1: understand racketeering law perfectly well. The more troubling possibility is
• 10:27
Speaker 1: that an enterprise prosecution created a risk the government did
• 10:30
Speaker 1: not want to assume. Because genuine enterprise cases expand rather
• 10:35
Speaker 1: than contract. They create cooperating witnesses, They expose finances, They
• 10:40
Speaker 1: pull peripheral actors into grand juries. They generate documentary trails.
• 10:44
Speaker 1: They cross jurisdictional and institutional boundaries. In Epstein's world, those
• 10:49
Speaker 1: trails potentially ran through banks, companies, immigration arrangements, elite households,
• 10:54
Speaker 1: political circles, international relationships, universities, foundations, lawyers, account mountains, employees,
• 11:01
Speaker 1: and powerful social networks. Of course, that doesn't mean that
• 11:05
Speaker 1: every institution or individual in those circles committed crimes. It
• 11:09
Speaker 1: means a properly aggressive investigation could not know where criminal
• 11:14
Speaker 1: evidence would end up until investigators actually followed it. Epstein's
• 11:19
Speaker 1: case was politically radioactive precisely because ordinary investigative methods threatened
• 11:25
Speaker 1: extraordinary people. Narrow charging kept the radius manageable, but Rico
• 11:31
Speaker 1: would have made it uncontrollable. So the case against the
• 11:34
Speaker 1: Justice Department is not dependent on proving some cinematic conspiracy
• 11:38
Speaker 1: in which officials gathered around the table and agreed to
• 11:41
Speaker 1: protect Epstein's friends. The case is built on decisions the
• 11:45
Speaker 1: government had extensive evidence and negotiated downward. It protected potential
• 11:50
Speaker 1: co conspirators, it excluded victims from crucial negotiation. It later
• 11:55
Speaker 1: described employees and associates as components of Epstein's trafficking machinery,
• 12:00
Speaker 1: but still declined to publicly charge the machinery as a
• 12:04
Speaker 1: racketeering enterprise. Comparable federal cases against Kelley and Ranieri demonstrate
• 12:09
Speaker 1: that Rico was capable of reaching organizations built around sexual exploitation.
• 12:15
Speaker 1: And that's why I think that the record deserves anger,
• 12:17
Speaker 1: because Rico exists for exactly the situation in which individual
• 12:21
Speaker 1: crimes are merely the visible outputs of an organized system.
• 12:25
Speaker 1: Epstein's abuse required victims, but the enterprise required recruitment, money scheduling, transportation,
• 12:31
Speaker 1: property secrecy, and continued access. The Maxwell conviction established that
• 12:36
Speaker 1: he had a knowing partner in significant parts of that system.
• 12:40
Speaker 1: The twenty nineteen indictment expressly identified employees and associates helping
• 12:45
Speaker 1: maintain the victim's supply. The government's own words therefore supplied
• 12:49
Speaker 1: the beginning of the enterprise theory. Whatever followed was a
• 12:53
Speaker 1: prosecutorial determination to finish it, and that result is one
• 12:58
Speaker 1: of the most consequential missed uptunities in modern federal law enforcement.
• 13:02
Speaker 1: RICO could have been the mechanism for turning the Epstein
• 13:05
Speaker 1: story from a biography of a monstrous billionaire into a
• 13:09
Speaker 1: prosecution of the machinery that sustained them. It could have
• 13:13
Speaker 1: provided leverage against knowing facilitators, unified crimes, crossing jurisdictions, opened
• 13:18
Speaker 1: broader forfeiture avenues, and forced prosecutors to confront financial and
• 13:23
Speaker 1: immigration misconduct linked to the enterprise where the evidence supported it.
• 13:28
Speaker 1: It could have exposed whether powerful associates were criminals, witnesses, facilitators,
• 13:33
Speaker 1: victims of Epstein's manipulation, or simply people unfortunate enough to
• 13:37
Speaker 1: know them. Instead, those distinctions remain polluted by secrecy and
• 13:42
Speaker 1: speculation because the comprehensive criminal adjudication never occurred. The government
• 13:48
Speaker 1: proudly dismantled Kelly's enterprise and Raynieri's enterprise never dismantled Epstein's
• 13:53
Speaker 1: enterprise in open court. That's not merely a historical curiosity.
• 13:58
Speaker 1: It's an enduring indictment, a federal prosecutorial judgment. And that's
• 14:02
Speaker 1: why the question of RICO will continue hanging over the
• 14:05
Speaker 1: Epstein scandal, regardless of how many documents DOJ releases or
• 14:09
Speaker 1: how many officials in Sissy investigation was thorough. A thorough
• 14:13
Speaker 1: investigation of an enterprise leaves behind identifiable accounting of the enterprise.
• 14:18
Speaker 1: It tells the public who knowingly participated who did not,
• 14:21
Speaker 1: while crimes sustain the organization, how its money moved, how
• 14:24
Speaker 1: victims were recruited, how borders were crossed, how records were handled,
• 14:29
Speaker 1: and how the organization defended itself when threatened. The federal
• 14:33
Speaker 1: government never provided that accounting. Instead, survivors, journalists, civil litigants, regulators,
• 14:39
Speaker 1: congressional investigators, and the public have spent years reconstructing it
• 14:44
Speaker 1: piece by piece, The Department of Justice possessed the most
• 14:47
Speaker 1: powerful investigative machinery in the world and repeatedly chose a
• 14:52
Speaker 1: much more narrow road. Whether that choice arose from cowardice,
• 14:55
Speaker 1: institutional self protection, excessive deference to wealth and influence, fear
• 15:00
Speaker 1: of evidentiary complexity, or some combination of those forces, remains
• 15:05
Speaker 1: a legitimate subject of investigation. What should no longer be
• 15:09
Speaker 1: treated as legitimate is a claim that Rico had nothing
• 15:12
Speaker 1: meaningful to offer because the government's own cases against Kelly
• 15:16
Speaker 1: ray Neery and Comb's demolished. That excuse, all right, folks,
• 15:22
Speaker 1: that's going to do it for this one and for
• 15:24
Speaker 1: the series. All the information that goes with this episode
