- 0:03Speaker 1: This is a Bramble Jam podcast.
- 0:12Speaker 2: This week on your Gabble Gabble, It's send money to
- 0:15Speaker 2: a little old lady that you owe her and she
- 0:17Speaker 2: never gets it. Do you have to pay her again?
- 0:20Speaker 2: Judge Jerry's here to hit on old ladies.
- 0:23Speaker 3: And if a vending machine falls on top of you,
- 0:27Speaker 3: can you Is it your fault? Or are you gonna
- 0:29Speaker 3: get a little snack money? Judge Geno tells us real people.
- 0:32Speaker 2: Real cases. Thank justice is.
- 0:39Speaker 1: I mean you've you've got me hook line and sinker
- 0:41Speaker 1: with your case.
- 0:43Speaker 2: And also like I did that thing where I'm like,
- 0:46Speaker 2: Judge Jerry's here to hit a and he does hit
- 0:49Speaker 2: on her briefly, but then it then it becomes very playful.
- 0:51Speaker 2: It doesn't become like, okay, too serious, but he does
- 0:54Speaker 2: do it, and it is weird. We'll give it to me.
- 0:56Speaker 2: I'm gonna, uh, well, hey it Judge Jerry, which I
- 1:01Speaker 2: typically a skip. Don't. I love Judge Jerry's I love
- 1:07Speaker 2: you love the Jerry and I don't. Typically it's just
- 1:11Speaker 2: a whole rigamarole and I don't. It doesn't do anything
- 1:14Speaker 2: for me, but I gave it a shot. Uh Leuwanda
- 1:17Speaker 2: Cheney is suing Lynette Striblely Luwanda Cheney's Lynette Stribley.
- 1:24Speaker 1: Not the Stribley family.
- 1:25Speaker 2: Luanda Cheney is suing Lynette Stribley for five hundred dollars. Uh.
- 1:32Speaker 2: Luwanda Cheney starts off, and she is a she looks
- 1:35Speaker 2: like a classic just little old lady, like what you're
- 1:41Speaker 2: picturing in her head, that is what she is. She's like,
- 1:45Speaker 2: I might look like a helpless, little little old lady.
- 1:47Speaker 2: I'm eighty one years old, but I'm the nicest little
- 1:51Speaker 2: old lady you'll ever meet. And and and uh, Jerry says,
- 1:56Speaker 2: it certainly looks that way to me, but I'm married,
- 2:00Speaker 2: so I'm gonna try to keep my distance. Why does
- 2:03Speaker 2: Jerry say that? Why do you do that? And then
- 2:06Speaker 2: he chuckles like that's that's just disgusting as weird. How
- 2:13Speaker 2: old is Jerry, I don't know, but probably in his sixties,
- 2:16Speaker 2: so it's not I mean, it's just as weird that
- 2:18Speaker 2: you're like, you're the judge, right, he can't do that.
- 2:21Speaker 2: You imagine Kevin Ross doing that, Bill, No, No, because
- 2:24Speaker 2: this in this courtroom, like judge justice, is so foreign,
- 2:27Speaker 2: it's ridiculous.
- 2:28Speaker 3: Well, it's always I've you know you gotta sometimes you
- 2:31Speaker 3: gotta start off the case with some light sexual harassment.
- 2:34Speaker 2: And the bailiffs like like elbow.
- 2:36Speaker 1: Like the guy with the dreads.
- 2:38Speaker 2: Yeah, yeah, that was a good one, judge. And she's like,
- 2:41Speaker 2: I am the nicest old lady you ever meet, but
- 2:43Speaker 2: language coming out here. But if you crossed me, I
- 2:46Speaker 2: turned into one mean son of a bitch. And she like,
- 2:49Speaker 2: this is like an old eighty year old woman who's
- 2:51Speaker 2: just like I'm not listening, I'm not doing this. And
- 2:54Speaker 2: she's like, Lynette was my boss, and she was a
- 2:56Speaker 2: great boss. We don't know what she was working at.
- 2:58Speaker 2: Eighty one, yes, well before eighty one, but yeah, in
- 3:01Speaker 2: her late late seventeen and I had just sold my
- 3:06Speaker 2: house and Lynette knew I had money and asked for
- 3:08Speaker 2: a fifteen hundred dollars loan. Needed the money, and her
- 3:12Speaker 2: boss asked her that's correct, And I loaned her fifteen
- 3:16Speaker 2: hundred dollars. We wrote up a whole agreement. One hundred
- 3:19Speaker 2: bucks a week is what she'd pay me back, a promise. Now,
- 3:25Speaker 2: that note got lost at work. It was a legal contract,
- 3:28Speaker 2: but it disappeared at work. I lost it. Let me
- 3:29Speaker 2: first tell you I lost it what she said. Now,
- 3:33Speaker 2: I did start keeping text and paperwork and everything to
- 3:36Speaker 2: confirm the does a defendant acknowledge the defendants like doesn't
- 3:40Speaker 2: say a word? Okay? And then she goes judge Jerry.
- 3:44Speaker 2: I was a stockbroker in the nineteen seventies before women
- 3:47Speaker 2: were on the floor of the stock market, like I
- 3:49Speaker 2: was doing like this. This was not usual. I raised
- 3:52Speaker 2: five kids by myself. I watched my money. I would
- 3:55Speaker 2: never try to cheat someone out of money. And months
- 3:58Speaker 2: went by and I never got any money, and I
- 4:01Speaker 2: started texting her, and she finally gave me one hundred
- 4:03Speaker 2: dollars uhat and uh and uh. So then I asked
- 4:07Speaker 2: her again and she said she sent me a check
- 4:10Speaker 2: and I never got the check. And I was like, Okay,
- 4:14Speaker 2: it's clear that you're having a hard time paying this
- 4:17Speaker 2: money back. This is what I said to her, and
- 4:18Speaker 2: I have text to prove it. It's clear that one
- 4:20Speaker 2: hundred dollars a week is too much for you. What
- 4:22Speaker 2: would work for you to pay this money?
- 4:24Speaker 1: Wow?
- 4:24Speaker 2: Above and beyond? And Lynette said one hundred dollars a month.
- 4:28Speaker 2: I could do one hundred dollars a month, and Lawanda said, okay, great,
- 4:31Speaker 2: one hundred dollars a month. It is, let's do that instead,
- 4:34Speaker 2: and so we do have that in Texe. So I
- 4:37Speaker 2: had one hundred dollars I was owed fourteen hundred. Over
- 4:39Speaker 2: the next nine months. She successfully paid me nine hundred
- 4:41Speaker 2: dollars every circle month. Great, she was like, and then
- 4:44Speaker 2: I never got any more money. I sent her a
- 4:47Speaker 2: text and five hundred dollars, she said. At one point.
- 4:50Speaker 2: I sent her a text and I said, you owe
- 4:51Speaker 2: me five hundred. I know you've done your best. Just
- 4:54Speaker 2: give me two fifty. Just give me to fifty. I
- 4:57Speaker 2: need five hundred. I'm eighty one. I'm just here to
- 4:59Speaker 2: be kind. Give me two fifty. And I never got
- 5:02Speaker 2: the money, and I never heard from her again. And
- 5:05Speaker 2: in fact, but that's her boss, which they didn't work
- 5:07Speaker 2: together anymore. Apparently, Oh okay, this is maybe a former boss.
- 5:10Speaker 2: I don't know. She She's like, maybe she changed her
- 5:13Speaker 2: cell phone number, and Lynett's like, I did change my
- 5:14Speaker 2: cell phone number, but not to get out of this payment.
- 5:17Speaker 2: I sent her a money order for five hundred dollars.
- 5:19Speaker 2: It was it was sent in the mail sent it.
- 5:23Speaker 2: I'd already given the money for the money order. There's
- 5:25Speaker 2: nothing I could do. I don't know what happened, but
- 5:27Speaker 2: clearly she never got it. I know if her daughter
- 5:29Speaker 2: took it. I don't know what happened. She didn't get it.
- 5:31Speaker 2: I sent it. Nothing I can do.
- 5:32Speaker 1: We have a proof of this.
- 5:35Speaker 2: So at this point, Jerry's like, so a money order
- 5:38Speaker 2: comes with a receipt, you have that, And she goes, no,
- 5:40Speaker 2: I do not.
- 5:41Speaker 1: Probably Jerry in place as a promisery.
- 5:43Speaker 2: How could you lose it? She goes, I actually believe
- 5:46Speaker 2: my daughter ate it. Yeah, and Jerry goes, Jerry goes,
- 5:56Speaker 2: I love that response. Jerry goes, she ate yeah, and
- 6:02Speaker 2: Lynette just goes, yeah, yeah. Jerry just bug off, bro
- 6:06Speaker 2: it happens sometimes your kids eat stuff. And Jerry was like,
- 6:10Speaker 2: how cod grizz eting paper just the other day? She
- 6:13Speaker 2: was like she was like, well, she licked it and
- 6:17Speaker 2: she kind of licked at a bunch and it got
- 6:21Speaker 2: it just got so like wet that I just threw
- 6:23Speaker 2: it away. And Jerry was like, what do you mean.
- 6:31Speaker 2: She was like, well, I mean it just was like mush,
- 6:33Speaker 2: like you couldn't even read it anymore. How old the kid,
- 6:38Speaker 2: we don't know, no, seventeen. She's like, it just kind
- 6:43Speaker 2: of got mushy, and so I just like I couldn't.
- 6:46Speaker 2: I just threw it away because it had just been
- 6:48Speaker 2: like you couldn't read it anymore. And Jerry's like, I
- 6:51Speaker 2: got Jerry's like, I gotta be honest, I've never heard
- 6:53Speaker 2: this one. I've heard my dog at and I've never
- 6:54Speaker 2: heard my daughter rate it. That's a new one for me.
- 6:57Speaker 2: And Lauana's like, touch, Jerry, Honey, isn't really important. I
- 7:02Speaker 2: don't really care. Five hundred dollars is not a lot
- 7:04Speaker 2: of money. But I strongly believe that if you left
- 7:08Speaker 2: let people slot, uh, and you don't make them face
- 7:12Speaker 2: up to their responsibility, then you're really not helping them
- 7:15Speaker 2: in the long run. And that's why we're here. I
- 7:17Speaker 2: don't really care about the money as much as I
- 7:18Speaker 2: care about Lynette being responsible, and so when I owe
- 7:22Speaker 2: somebody money, they don't have to call me. And I'd
- 7:25Speaker 2: be happy to be friends with Lynette again, even if
- 7:27Speaker 2: she never paid me back. That's what judge Jerry's ready
- 7:32Speaker 2: to rule.
- 7:33Speaker 3: Uh, yeah, you gotta give her the five hundred dollars
- 7:37Speaker 3: and this time, you know, keep your kid away, get
- 7:40Speaker 3: away from the kid away from the receipts and any
- 7:43Speaker 3: any of the sort. But you know what, I also like,
- 7:47Speaker 3: you know, that's tough. You know, she clearly doesn't care
- 7:51Speaker 3: about the money. She even said that she would take
- 7:54Speaker 3: two hundred and fifty dollars. Yeah, so now you just
- 7:57Speaker 3: give her that. Let's me in the middle.
- 7:59Speaker 2: Jerry gives her the full five hundred house like, yeah,
- 8:01Speaker 2: there's nothing here, Like, there's no proof you sent the money.
- 8:04Speaker 2: There's nothing I can do. I think she's been overly
- 8:07Speaker 2: generous with you need to pay her five hundred dollars.
- 8:09Speaker 2: That's great, Yeah, right, kid, just licks it. I think
- 8:13Speaker 2: my I believe my daughter eighth I believe. Yeah, I
- 8:16Speaker 2: believe there's a change.
- 8:17Speaker 3: There's other options, but I think the best is I
- 8:20Speaker 3: caught her licking the receipt ink the ink right off.
- 8:25Speaker 2: It's a real.
- 8:27Speaker 3: Fruit stripe gum situation. The Turner I'm going to go
- 8:31Speaker 3: to a personal injury cord. By the way, judge, you
- 8:33Speaker 3: know you know where the verdicts are always wrong. Uh,
- 8:36Speaker 3: the points don't matter, The points don't matter. The Turner
- 8:40Speaker 3: family is suing Carrington prep uh for like an academy, Yes,
- 8:47Speaker 3: for sixty thousand dollars in past medical expenses forty thousand
- 8:50Speaker 3: dollars and future medical expenses, and two hundred and fifty
- 8:53Speaker 3: thousand dollars for pain and suffering, for a total of
- 8:55Speaker 3: three hundred and fifty thousand dollars. Let's dive into legal saw.
- 9:00Speaker 3: Lauren Turner is there with her twin sons who look
- 9:05Speaker 3: like they do TikTok videos together. This is the best
- 9:09Speaker 3: I can explain them. If you see them, you will
- 9:12Speaker 3: know what I'm talking about. They have TikTok vibes hard,
- 9:16Speaker 3: they probably do a couple of these. And one of
- 9:20Speaker 3: the boys just has scrapes all over his face.
- 9:24Speaker 1: Now, Dan, you actually saw a picture of this kid.
- 9:26Speaker 2: Because we were looking.
- 9:27Speaker 1: We were looking to make sure we don't.
- 9:30Speaker 3: And so you saw this kid scrapes all over. They
- 9:33Speaker 3: look relatively fresh. Diane Watson is the head mistress.
- 9:40Speaker 2: Yeah, what they said, what they say, I get it.
- 9:44Speaker 2: Of ads Carrington bre she's ahead of them ahead, so
- 9:51Speaker 2: she doesn't do any mistressing herself. She just kind did
- 9:55Speaker 2: the supervisors, all the other all the others exactly right.
- 9:58Speaker 2: And so at Carrington it's a private school, she explains.
- 10:02Speaker 2: Actually it's like an eight hundred plus students, most of
- 10:06Speaker 2: which are board students. They don't get enough going on. Okidding,
- 10:11Speaker 2: they stay there. If you had said they were boarded,
- 10:14Speaker 2: there are they bored there?
- 10:15Speaker 3: I know what I said, but some of the students
- 10:17Speaker 3: are day students. I don't actually know what these two
- 10:19Speaker 3: kids are. I think they're day students. She says that
- 10:22Speaker 3: Jason and Jackson, the TikTok boys, are seniors at Carrington Prep.
- 10:27Speaker 3: They're brights, but they are a bit rowdy. Jason's a
- 10:31Speaker 3: class clown. We've actually had to put them in separate
- 10:34Speaker 3: classes because they're disruptive. Now, Laura says, they're not disruptive.
- 10:41Speaker 3: They're twins. It's normal to separate them. You put him,
- 10:46Speaker 3: let them, let them thrive. Gino says that he knows
- 10:49Speaker 3: a thing or two about twins. He has twin brothers,
- 10:52Speaker 3: and the world is safer if they're apart. It's what
- 10:55Speaker 3: he says. She says, they they know how to act.
- 10:59Speaker 3: Trust me. I raised I raised him. You've you've met
- 11:02Speaker 3: with these parents before, like.
- 11:03Speaker 2: I've met with these parents, and then I also have
- 11:05Speaker 2: twin boys, so I'm here. You've may you've you've met
- 11:08Speaker 2: all of all of these. I know exactly when a
- 11:10Speaker 2: parent is lying about things like that. Yeah, So one night,
- 11:15Speaker 2: here's the story.
- 11:15Speaker 3: One night, after basketball practice, the boys want a snack,
- 11:19Speaker 3: so they head to the vending machines. Uh, Jason puts
- 11:24Speaker 3: money into the drink machine, and I'm gonna stop.
- 11:28Speaker 2: You right now and say, I know that these kids
- 11:30Speaker 2: should get nothing. Go ahead right now. I don't care
- 11:35Speaker 2: if the vending machine came to life, and so I'm
- 11:38Speaker 2: gonna on you. I don't think this should get a
- 11:40Speaker 2: don I'm just letting you know, write this stuck.
- 11:41Speaker 3: Okay, go ahead, So puts money in the drink, doesn't
- 11:44Speaker 3: come out, so he pushes it a couple of times.
- 11:46Speaker 3: The machine ends up falling on top of him, all
- 11:48Speaker 3: the way on top of him. This is a with
- 11:52Speaker 3: supplies in it, an over one thousand pounds machine. Glass
- 11:57Speaker 3: shatters all over him, cutting his face, all that good stuff.
- 12:02Speaker 3: Jason claims that he didn't even really hit it that hard.
- 12:08Speaker 3: So Diane explains that part of the school's mission is
- 12:13Speaker 3: to teach respect and responsibility. Mistress, Absolutely, a machine falling
- 12:22Speaker 3: on you after pushing it is a natural consequence responsibility
- 12:31Speaker 3: and respect. You didn't respect the machine, so she doesn't
- 12:37Speaker 3: believe that it is the school's fault, and she says, actually,
- 12:41Speaker 3: Jason violated the school's code of conduct, which is to
- 12:45Speaker 3: respect One of the points is to respect to school
- 12:48Speaker 3: and others property. They were not obviously respecting the school property.
- 12:53Speaker 3: Therefore it fell down. Therefore breach of code of conduct.
- 12:59Speaker 3: Jackson actually had an.
- 13:01Speaker 2: Illustration, made a movement, an animation showing what happened, which
- 13:07Speaker 2: is a kid shaking and it falling down. Now that
- 13:11Speaker 2: we've gotten that out of the way, Diane explains that
- 13:14Speaker 2: he Diane says, he won You should bring your own
- 13:20Speaker 2: drink if you're playing sports. That's exactly right. But also if.
- 13:25Speaker 3: Your drink gets stuck in the machine, there is a
- 13:28Speaker 3: number to call if it doesn't vent correctly, So you
- 13:33Speaker 3: call the number and they will either come out or
- 13:36Speaker 3: you'll get your money back or whatever the thing is there.
- 13:40Speaker 3: Gino tells Laura that she has to understand that her
- 13:45Speaker 3: son didn't just blow the machine down. The machine isn't
- 13:49Speaker 3: a one thousand plus pound machine doesn't just fall down.
- 13:55Speaker 3: It has to have had some serious force. Gino, though,
- 13:59Speaker 3: asked the mistress. The head mistress, no, he would never
- 14:05Speaker 3: Gino asked why the machines weren't secured, Why would they
- 14:09Speaker 3: bolted down or tethered in some way, And Diana explains
- 14:12Speaker 3: that they're actually in the process of doing just that.
- 14:15Speaker 3: In fact, two of the three machines in the vending
- 14:19Speaker 3: area are already bolted. We were waiting on one other, that.
- 14:23Speaker 2: Final machine to get bolted, and it just so happens
- 14:26Speaker 2: that the machine that he was pulling on was the
- 14:28Speaker 2: one that was untethered, and the boulter couldn't do three.
- 14:32Speaker 2: I don't know if it's a I don't know if
- 14:35Speaker 2: it's a new machine that you need to get. I
- 14:38Speaker 2: don't know what the situation of this year is.
- 14:41Speaker 3: Diane says, he's ninety five pounds. I'm sorry, what's the
- 14:46Speaker 3: mom's name? The Lauren Lawn says, he's ninety five pounds?
- 14:50Speaker 3: How hard could uh? How hard could he actually have polled?
- 14:55Speaker 3: Like something was wrong with the machine. So Gino brings
- 14:59Speaker 3: in an engineer to explain how.
- 15:05Speaker 2: This machine person injury. Almost everything about it is frustrated,
- 15:09Speaker 2: it really is.
- 15:11Speaker 3: Brings it an engineer to explain how a machine can
- 15:15Speaker 3: fall over. And this engineer actually comes with some graphics
- 15:20Speaker 3: and there's pretty helpful actually, So if a machine is
- 15:24Speaker 3: at a ninety degree if it's ninety degrees perpendicular to
- 15:29Speaker 3: the g. Yes, the machine needs to move forward thirty
- 15:32Speaker 3: four point five degrees in order for it to for
- 15:37Speaker 3: momentum to begin to gravity to take it down. That's
- 15:41Speaker 3: not a small amount, No, that that's just think about.
- 15:45Speaker 1: In your mind.
- 15:46Speaker 3: Ninety yeah, move it thirty four degrees like it's a
- 15:49Speaker 3: pretty pretty good.
- 15:51Speaker 2: But also this is why the law doesn't make you
- 15:54Speaker 2: bolt down vending machines. It's not required. It should never
- 15:58Speaker 2: be knocked over, So, she says.
- 16:01Speaker 3: The engineer says, as so, when you start rocking it,
- 16:05Speaker 3: momentum then will cause it because it's you know, one
- 16:08Speaker 3: thousand plus pounds. Momentum will begin to help you. So
- 16:12Speaker 3: even if you just start moving in a little bit,
- 16:14Speaker 3: if you continue to shake it, momentum will eventually you
- 16:17Speaker 3: understand how things work. Momentum will begin to also help you.
- 16:21Speaker 3: So even if he is just ninety pounds, which he's
- 16:24Speaker 3: more than ninety pounds, by the way, but there's not
- 16:27Speaker 3: picture kids yoked. He's a TikTok boy. Even if you could,
- 16:34Speaker 3: like are able just to move it a little bit,
- 16:36Speaker 3: eventually the momentum will help you and eventually get it
- 16:40Speaker 3: past that thirty point point five percent magical a magical point.
- 16:47Speaker 3: Diane explains that sure, I wish we would have completed
- 16:53Speaker 3: the bolting process.
- 16:55Speaker 2: It's clear that this did weird. Way is the one
- 17:00Speaker 2: thing about this that's absurd.
- 17:02Speaker 1: That clearly it didn't just happen to be both tomorrow.
- 17:05Speaker 2: I can't we just won boat per day. We bolted
- 17:08Speaker 2: the wrong window day. It was both to tomorrow. We
- 17:10Speaker 2: both it's Tuesday boat this one Wednesday bought that one.
- 17:14Speaker 2: It was that he had that one on Tuesday. We
- 17:16Speaker 2: both that one Wednesday. I don't. I don't control the
- 17:19Speaker 2: bolting schedule. I just let them bolt when they would
- 17:21Speaker 2: both volters gonna. You knew that when you when you
- 17:24Speaker 2: sign the come. It's ridiculous.
- 17:25Speaker 3: One bolt to day, one bolt to day, Ray bolts
- 17:28Speaker 3: m that's Geno's raider role.
- 17:31Speaker 2: This is tough man. These these kids should get nothing.
- 17:35Speaker 2: In fact, someone should rob them. They should have someone
- 17:40Speaker 2: shake them until something comes out of it. Nothing.
- 17:43Speaker 1: Well, they're dumb as rocks.
- 17:44Speaker 2: Yeah, I don't want them to get a single solitary sense.
- 17:48Speaker 2: But Gina, what's the total.
- 17:52Speaker 1: Three hundred and fifty thousand?
- 17:53Speaker 2: Gina is going to give them? Uh, one hundred and
- 17:57Speaker 2: seventy five thousand. Do you want to break down? I
- 18:00Speaker 2: just have. He's gonna give them, Okay, Okay, so he's
- 18:02Speaker 2: gonna give them all right, I'm ready to. First of all,
- 18:08Speaker 2: I just want to put this on the record. I
- 18:09Speaker 2: hate these kids.
- 18:11Speaker 3: I can already tell I've seen I taught I did.
- 18:17Speaker 3: I hate these kids. Gino explains that this is a
- 18:20Speaker 3: classic premises liability case Carrington prep has to take reasonable
- 18:28Speaker 3: measure to keep people safe. In this case, they clearly
- 18:33Speaker 3: knew that the vending machines were not stable, which is
